The HBA will save you money and make you money in 2013 . Our primary focus at the HBA is your business. Every year we work to find new ways to connect you with your customers, be them homebuyers, remodeling clients or consumers interested in the home and garden market. We have a professional staff that works with key members in leadership and on committees to ensure that we have you tapped in to the consumer market. To that end, we produce premier consumer shows designed around you so you can sell your homes, remodeling projects and home & garden goods to customers ready to buy now and willing to become a lead for the future. In fact several companies’ entire marketing plans are designed around these shows exclusively. The HBA also recognizes that our business to business events create long lasting business relationships that help those members that are focused on doing work with other businesses make the critical connections that help them succeed professionally. Over the last few years we have changed up all of our business to business events to drive more participation and a larger benefit to those companies looking to create necessary business to business relationships. We hear it constantly, “I met them at the HBA”. That means that if you have a product or service to sell from building materials, to printing, insurance, or anything a company needs to operate the HBA is one of the greatest places to spend your time in order to broaden your business to business customer base. Beyond that we focus on the fact that information gained from piers and other business persons at the HBA events and committees help you to gain valuable knowledge that help you run your business. To help you take your business to the next level we provide dozens of professional development classes all year long to help you to become a better business person. Whether that means accounting, sales, codes, historic structures, or whatever the case may be we create and deliver a curriculum of courses that will benefit your company. We hold education classes in a group setting but can schedule one-on-one sessions for your particular needs. No other place in our area can provide the type of education the HBA does for so little cost. There are other ways that the HBA makes you money and saves you money. Over the years we developed a worker compensation insurance program that has great reasons to be a part of the program. First, the premiums are designed around your payroll. If you slow down as a company during the cold weather months the premiums reduce in slower months to ease your cash flow necessities. If you stay in the plan for four years you receive dividends annually. In 2012 the total dividends paid to HBA members in the plan was $13 million. In 2013 that dividend will be $14 million. The average dividend in 2013 will be about $6,400 per company. That means that the program literally pays you to maintain your membership and two hour safety class a year. This is an outstanding member benefit that you simply cannot find anywhere else. Our health insurance program also saves you money and is poised to benefit you even greater in 2014 when the Affordable Care Act (Obama care) is enacted in Kentucky. Our health program is an insurance pool that was created in the General Assembly as a “bona fide” insurance program in our Commonwealth. That means that when the act is implemented all participants will pay according to a community rate. Our program will allow its participants to “risk” rate. This means that you will not have to pay for everyone no matter their condition as the act mandates. Estimates exist that show the exchange in our state could cause health insurance costs for employers to increase anywhere from 65-100%. We won’t experience that change with our plan and is yet again and excellent program that saves your company hard earned dollars. One of the hardest to count, but nonetheless the most important product of the HBA is our advocacy. Yes advocacy saves you money and makes you money. If it weren’t for our efforts not only in Frankfort and Washington DC, but locally, the cost of construction would change drastically. Whether it is the length of time during the construction process, the amount of lots a developer can create in a community, the cost of regulations and fees, the HBA is on the front line defending your rights and your wallet. Imagine a world where government and agencies could go unchecked and create any regulation they wished to without the feedback and support of the HBA. That is a frightening world for sure. We spend time commenting and shaping policy at all local planning commissions, the Sanitary District, water districts, and the list goes on. There is not one local regulation and rule involving building and development that the HBA doesn’t have a fingerprint on somewhere. What does this do for you? It keeps housing affordable so that you can build, remodel, develop, and sell products and services to the construction community. It also means that the economy benefits as a whole. If we develop and build more then everyone benefits. Growth is good. And that means that the checkout clerk at the grocery, the CEO of major corporations, and your neighbor down the street all should give a little thanks to our industry for helping Northern Kentucky grow. We know it’s not all about money, and in the coming months we will explain to you how the HBA is fun, interesting, educational, and helps you to overcome the problems you have at work while at the same time being mindful of your time. he 2012 Holiday Party & Inaugural Dinner was the beginning of exciting new changes around the Home Builders Association. 2013 will begin with a new restructured Board of Directors, drafting a 20132016 strategic plan and focusing on redesigning the HBA for the 21st century. “This group of outstanding leaders is bringing new ideas to the
table to make sure that our HBA continues to be one of the largest, most relevant HBA’s in the nation”, said Brian Miller, EVP. The 2013 Holiday Party & Inaugural Dinner was a night of celebration and recognition. Adam Chaney, 2013 HBA President was installed along with his new board of directors. Special men and women were recognized for their outstanding
contributions to this association and Northern Kentucky. harter Member of the Home Builders Association of Northern Kentucky passed away on November 20, 2012. Ed was owner and operator of Wilbers Construction Co. Second President of the Association, he was supportive of the Association over the years. He chaired construction of a dormitory at Campbell Lodge in Cold Spring. He encouraged the HBA to buy a “beginner home” at 516 W. Fifth St., Covington, Ky., leading to building a new home at 209 Grandview Drive, Fort Mitchell, KY. We were always honored when he began the “passing of the gavel” at our annual installation ceremony. A National Director, he held Lifetime Membership. A Kentucky Colonel, Ed was a 3rd degree member of the Knights of Columbus, past Vice President and Director of First Federal Savings and; Past Director of the Diocesan Children’s Home. He is survived by his son Ed, a builder and three daughters and 9 grandchildren.

A
s a business owner, imagine this very common scenario – A young woman with two small children in tow enters your business establishment in order to complete her last business transaction of the day. The young woman successfully completes her business transaction and hurriedly exits your establishment, passing in the doorway an elderly gentleman who is your next customer. As the elderly gentleman walks across the floor of your business, he slips and falls in a spot of clear liquid that, unbeknownst to you, spilled from the cup of one of the children. Traditionally, in order to prevail in a “slip and fall” case such as this, the elderly gentleman would be required to prove that the business owner or his employees either caused the foreign substance to be on the floor, or by the exercise of reasonable case, could have discovered the foreign substance and either removed it or warned of its presence prior to the fall. Absent proof that the business owner or his employees caused the foreign substance to be on the floor, the injured customer is faced with the burden of proving how long the substance had been on the floor before the accident and whether that was a sufficient length of time for notice and correction to have taken place. The Kentucky Supreme Court has found that this is a daunting and virtually insurmountable burden of proof for the customer, especially in light of the fact that it is the duty of the business owner to keep his premises in a reasonably safe condition for normal use by his customers. In an attempt to balance the competing principles of customer notice versus business owner duty, the Kentucky Supreme Court made the determination to shift the burden of proof. Now, in the case of a slip and fall by a customer on a business owner’s premises, the customer must still prove that there was a foreign substance on the floor and that such foreign substance was a substantial factor in causing the accident or injury. However, once such proof has been presented, the burden then shifts to the business owner to prove that neither the owner nor his employees caused the foreign substance to be on the floor and that there had been an insufficient length of time in which to have discovered and removed the foreign substance or warned of the presence of the foreign substance prior to the accident. The Kentucky Supreme Court found that both logic and fairness mandate that, as between two apparently innocent parties, one being a business proprietor having a duty to maintain his premises in a reasonably safe condition for the use of his customers, and the other being the invited customer, the burden of proof with respect to the cause of an unsafe condition of the premises should be on the one with the duty to prevent it. The intent of the Kentucky Supreme Court was not to make business owners an insurer against all accidents on the premises. Rather, its intent was to require the business owner to prove the absence of negligence by demonstrating that the business owner exercised reasonable care in attempting to discover a foreseeable dangerous condition and to correct that condition or to warn its invited customers of the existence of the condition.
