HBA Remembers Past President, Phillip Timothy Duncan

Phillip Timothy Duncan, age 51, passed away Thursday, September 1, 2011 at St. Elizabeth Hospice Edgewood. Phil, as we knew him at the Home Builders Association office was a home builder and 1998 HBA President. He grew up in the building business with his father, Charlie Duncan, and his brothers. He was active on the Registered Builder and Membership Committee along with numerous other committees. Phil displayed his allegiance to the HBA by always wearing a HBA hat, shirt or sweater to HBA events and committee meetings. He is preceded in death by his parents, Charles and Ruth Duncan. His father, Charlie, was an active member of the HBA for many years. He is survived by his wife Janet Berling Duncan of Covington, his son, Taylor Duncan of Covington, his daughter, Kara Duncan of Covington; his brothers, Michael Duncan of Florence, David Duncan of Taylor Mill, Richard Duncan of Hebron, Gregory Duncan of White Oak, OH and Charles Duncan II of Dayton, OH, his sisters, Theresa Webster of Taylor Mill, Nancy Duncan of Florence, Christine Williams of Orlando, FL, Dianna McGarr of Florence, Gail Meece of Orlando, FL, and Sharon Magary of Hebron. HBA Remembers Bob Manning

The staff and students of the Enzweiler Trade School and the HBA Northern Kentucky would like to express their sincere condolences to the family and friends of Bob Manning. Bob was the founder of Arc Electric and a long time supporter of the Enzweiler Trade School. His tireless efforts to educate and improve the lives of skilled tradesmen in Northern Kentucky will be greatly missed. Bob helped found and steer the Enzweiler Electrical Program that we are so proud of today, as well as found NKEA, the Electrical Licensing Authority in Northern Kentucky. He and his family have taught as part of the HBA program and sent students for more than 30 years. Bob was honored by the HBA in a celebration dinner as a “Person who made a Difference”, and that legacy is carried on today by his family, friends, employees and everyone whose life he touched. 6

Dr. Jim Wells will be presenting at HBA Northern Kentucky September 29th, sponsored by Tremco. Jim received his Ph.D. in Mechanical Engineering from Purdue University where he also received his BS and MS in Engineering Science. He specialized in theoretical and applied mechanics, numerical analysis, and composite materials. While at Purdue, Jim was an instructor in engineering mechanics and other courses. During that time, he developed and administrated a self-taught / individualized instruction course in engineering mechanics. Since leaving Purdue, Jim has worked over 25 years in new product research and development in several segments of the construction industry. During his 15 years at Owens Corning, his work focused on insulation and roofing systems for commercial and residential markets. During his 5 years at the Koch Materials National R&D Laboratory, his work focused on asphalt-based industrial, paving, and waterproofing products and systems. Since late 2001, Jim has served as the Technical Director for Tremco Barrier Solutions (TBS), makers of waterproofing emulsions, water-resistive barrier membranes, and insulation systems. Prior to the acquisition by Tremco in April of 2003, TBS was known as Koch Waterproofing Solutions. He is the author of several articles and publications and holds a number of patents. Current Role: Technical Director, Tremco Barrier Solutions, makers of TUFF-N-DRI® Waterproofing, Enviro-Dri™ Weather-Resistant Barrier, and other fine moisture and energy control products and systems.

The 2011 Tour of Remodeled Homes

The Projects

Every year for the past 17 years the Home Builders Association of Northern Kentucky has produced a home show that grabs your attention. Don’t miss the 2011 Tour of Remodeled Homes, scheduled for Oct. 1 and 2 from noon until 5 p.m. The show features the latest trends in home remodeling, including kitchen and bath renovations, room additions, outdoor living areas, and more from more than a dozen select Registered Remodelers from Northern Kentucky and Cincinnati. Visit the show on this great fall weekend to get new ideas for your next home project. ~ Bob Schroder - Arlinghaus Builders, HBA NKY President 1 Adam Miller Homes installed a custom interlocking traditional cobblestone paver patio, combining an aged finish with a present-day design. This patio carries the Old World charm and a natural rustic look, which enhances the richness and warmth of the outdoor entertaining space. Along the border of the paver patio, we wanted to stress the quality of the living space by installing a custom curved paver edge design. Next, we constructed a seven-foot stacked stone wood-burning fireplace on-site that offers a mature stone look and captures an eroded texture feel. We accented the project with limestone stairs down to the yard surrounded with a vinyl fence and a Pergola entrance. 2 Cullen BrosThis tri-level home was built in 1980. The owners, becoming empty nesters, wanted a complete upgrade of all the amenities, a larger kitchen, first-floor laundry and a redesign of the floor plan. New features also include addition of a kitchen pantry, powder room, geothermal heating and cooling, larger master bedroom, vaulted ceilings on the second floor, walk-in shower, wide plank cherry hardwood flooring and custom built cherry cabinets. 3 Cutter Construction When you want to relax, there are always several things to do. Some may want to go to a movie, others may want to hang with friends while enjoying a cold drink and some may just want to play a game of pool. Why go out to relax when you can enjoy these things in the comfort of your own home? This lower-level finish encompasses all of these ways to relax by having a home-theater area, a full bathroom, a billiards area and a full-service bar. 4 Ashley Commercial Group The St. Anthony Lofts is a residential conversion carved from a century-old church located in historic Bellevue. The church consists of five contemporary two-story lofts, each one unique. Interiors will contrast contemporary finishes such as granite counter tops, wrought-iron railings, hardwood flooring, Pella windows and stainless steel appliances with the timeless craftsmanship of the 50-foot vaulted ceiling, original stained glass windows, church lighting, bell tower and soaring wood trusses. The Lofts are within walking distance of Bellevue’s historic Fairfield Avenue, Newport on the Levee and downtown Cincinnati. This unit is available for sale. What the home lacked was a modern space for the family to gather. Enter Corbin Custom Remodelers. The result was a two-story rear addition complete with all the amenities. The lower-level garage provided the much-needed storage and parking space, while the first-floor kitchen, great room, breakfast area, laundry and 10

powder room became a sanctuary that seamlessly flows with the original home. On the exterior, a covered deck was installed with a stone fireplace for relaxing evenings. Features include Schrock cabinets, granite tops, custom cabinetry, Andersen windows, hardwood flooring, coffer ceiling and much more. 6 Cornerstone Craftsmen Thrilled with the quality of their previous bathroom remodel performed by Cornerstone, the owners of this lovely home decided to build more lasting impressions to enjoy. This current Cornerstone project involves a completely remodeled kitchen, and remodeled dining and family room area, including new Wellborn cabinets and stone countertops, highend appliances, new lighting and Pella windows. Combined with the previous upgrades in the bathroom, this project is a must-see on your list! 7 Grosser & Co. Remodeling The best way to describe this remodel is: three-in-one! First, we added much needed square footage by opening up a past addition to add a dining area. Next step was to revitalize the old addition and add a laundry room with cabinets, a much needed powder room and a wood-burning fireplace. Fresh light from the new cathedral ceiling and skylights beam onto the hardwood floors. Then the kitchen was accented with new cabinets, granite countertops and builtin appliances. Lastly, the outdoor living area with screened-in porch, fireplace and deck wrapped this new living and entertainment space all together and was the finishing touch to this spectacular renovation. 8 Bill’s Remodeling & Electric A must-see award-winning whole-house transformation, including a new and expanded kitchen and dining area. Not to mention, a tranquil master bathroom and new laundry room featuring Pella windows and doors, exquisite hardwood flooring, detailed tile work and a grand entry door. 9 Cornerstone CraftsmenStarting their new life together, the homeowners purchased and transformed this spacious home with a golf-course view to create a new beginning for their journey. The scope of this project was immense, making it a mustsee remodel. Highlights of the transformation include a refurbished kitchen, refinished foyer, master bathroom renovation, and lower-level upgrade, including a wet bar, wine room and entertainment area. The once closed-off kitchen, breakfast room and dining room now flow freely together for a great entertaining space or space for spending time with family. 11 Kennedy Gray Design/Remodel This one-of-a-kind custom-designed outdoor living space was exclusively designed by Kennedy Gray Design/ Remodel in coordination with the homeowner’s vision. It features detailed stonework, a wood fireplace and gas fire pit, serving bar and unique outdoor patio with coordinating landscape. 11 Kiser Construction Company, Inc. The owners moved into this 1929 home 25 years ago. They love the location, neighborhood and their house. They needed to update to add more space. Kiser Construction installed a 1,368 square foot addition with a full basement and first floor master bedroom, master bath with walk-in shower, laundry, bar and living room. We refinished the existing hardwood floors, added new oak doors and baseboards, updated the kitchen with new cabinets, added granite counter tops and installed radiant heat and new A/C for the addition and existing house. We tied the two together with the same finishes and character, removed doors and windows and installed brick archways. On the exterior, we added new windows, widened the driveway, and off the rear of the addition added a fountain and great place to gather. The detail in the brickwork is copied from the front of the house. 12 T&J Home Specialist Entertain your friends at a large bar with custom cabinets, granicrete tops, stone accents and tile flooring. If you love wine, then check out the iron gate wine grotto. For the big game, kick back and enjoy the wall-to-wall custom -built entertainment center with bookcases on each side. Don’t forget about the kids — they have their own game room. The master bathroom features intricate custom tile with a large walk-in glass shower and soaker tub. 14 Ireland-May This cottage is an example of designing and transforming a house to reach its full potential. A generous addition complements the original home, while a new detached “carriage house” blends old and new. Handbuilt, hand-finished cabinetry with marble tops make the new kitchen a true showpiece, while architectural details inside and out complete the transformation. This lower level is a must see. 19 KBC Full Service Design/Build/Remodel The owners of this Mason home wanted to turn their family room into the grandchildren’s play area. KBC, along with the owners, designed a new family room, including a stone, woodburning and gas fireplace, hardwood flooring, Pella windows, Velux skylights, a cathedral ceiling, exposed wood beam, 350-year-old wood mantel and outdoor entertaining area with decorative concrete and a stone/limestone fireplace. KBC also updated a high efficiency furnace and Pella replacement windows.

15 Jim Stegman Construction This family had plenty of input for designer Cheryl Stegman, who, along with Stegman Construction, created this beautiful kitchen. The father of this clan, a woodworker, personally made the casings and baseboards for the renovation. This wasn’t the first project in this grand home for award-winning remodeler Jim Stegman. The Newport, Ky., company has renovated a number of beautiful and historic homes in the village of Wyoming over the years. This project features all the amenities, including Fieldstone cabinetry, granite countertops and a sub-zero refrigerator. Original hardwood floors complement the new cabinetry. A handcrafted custom hood, inspired by a magazine clipping, provides the kitchen’s focal point. 16 Neal’s Design-Remodel Over the past few years, Neal’s Design - Remodel has improved the function and livability of several areas of this Madeira two-story home. Projects include: A kitchen, family room, lower level and most recently a secondstory master suite retreat addition and hall bath. HBA Hosts YouthBuild’S Mental Toughness orientation

F

or the last week of August and the first week of September, the Event Center came alive with the sound of young people talking about their future and striving to find ways to make their dreams come true. The Sixth Generation of Northern Kentucky Community Action Commission’s YouthBuild of Northern Kentucky program began with Mental Toughness orientation. Nearly 30 young people came to Erlanger in search of the unique offerings of the YouthBuild program. YouthBuild has for more than three decades offered young people a means to change their future. It is a place where young people are introduced to the strength within themselves, and an opportunity to become the next generation of community leaders. Locally, YouthBuild of Northern Kentucky has served over 100 young people in three years. Those young people have a chance to earn a G.E.D. as well as the Pre-Apprenticeship Carpentry Training certificate offered by the Home Builder’s Institute. The most exciting part of the program is the addition of a formal Mentoring aspect to the existing successful program elements of Education, Construction, Community Service, Leadership, and Counseling. Members of the community have the opportunity to influence the life of a young person during this very important formative time and help guide them towards future careers and success. For the young people who started the program here at the HBA, the future is wide open. They are preparing to be the next generation of leaders, and we are excited to see the contributions they make to our community. Enzweiler Trade SCHOOL Kicks Off TO FULL CLASSES!

T

he Enzweiler Trade program began again on Tuesday the 6th, to packed houses. More than 50 students enrolled in the program’s four different skilled trades. Many of the students are adults, already in the workplace, seeking to change jobs or to further enhance their skills. With students ranging from 18 to 58 this year, the program has a truly diverse and unique demographic, mixing years of education and experience in one place. This year at Enzweiler also welcomes several new staff members. Tom Knuckles will be teaching Facilities Maintenance 2, our first graduating class with that certification. Marshall Lawhorn is the new instructor for Carpentry 1 with 30 years experience in the trade. Bob Rottman was coaxed out of retirement to teach Carpentry 2, as he did at McCormick Trade School. Returning this year is Eddie Moore for Electric 1 and 2 and the Senior Teacher position. Brandt Manning and Hank Sellmeyer will also be returning to help students in Electric 3 and 4 achieve their Journeyman Certificates and prepare for the Electrician’s Exam. Dennis Clark and Jeff Gardner will be running the HVAC program with a new text and curriculum that focuses on hands-on work. Tim McIntosh will be picking up the new Facilities Maintenance students including the group from H.U.D. that will be joining the HBA. We look forward to a great year and a lot of opportunity to help educate the workforce of tomorrow!

LEGAL CORNER KENTUCKY UNEMPLOYMENT CLAIMS CAN BE TRICKY Written by Kelly A. Schoening, Esq.

D

efending unemployment clams in Kentucky requires careful attention to deadlines and understanding the procedures. The administrative process is three steps. The first is a fact-finding and consists of completing forms and occasionally answering questions over the phone. When unemployment receives the information from the company and the employee, a decision is made as to whether the individual qualifies for benefits. It is to the company’s advantage to fully describe the events leading to discharge. Either party can appeal the decision and if the appeal is not filed timely, it will be denied. The second step is a hearing conducted by an administrative law judge (“ALJ”). Both sides can present exhibits and witness testimony. The hearing is the only time either side can present such evidence. It is important to have witnesses with first-hand knowledge and avoid hearsay, if possible. Generally, the referee will ask questions of all witnesses. Then the witness can present testimony and is subject to cross-examination by the other party. Both sides can also be represented by counsel and quite often the company may not be aware that the employee is represented by counsel until the hearing begins. Most hearings are conducted by phone and require that any exhibits be sent to the unemployment office and the other party at least three days prior to the hearing. All hearings are recorded. The third step is a review by the three member panel of the Unemployment Commission. Both sides are entitled to write a brief supporting the individual position. The Commission reviews the tape of the hearing. No new evidence can be presented by either side. The burden of proof in a case of misconduct rests with the employer at all stages of the process no matter who files the appeal. Kentucky unemployment is considered humanitarian in nature and has very specific reasons why a claim for benefits can be denied. If an employee quits without good cause, benefits can be denied. If an employee is terminated for misconduct, benefits can also be denied. Misconduct is defined by Kentucky statue as falsification of an employment application, knowing violation of a reasonable and uniformly enforced rule of an employer, unsatisfactory attendance if the worker cannot show good cause of absences, damaging an employer’s property through gross negligence, refusing to obey reasonable instructions, reporting to work under the influence of alcohol or drugs, conduct endangering safety of self or coworkers and incarceration in jail resulting in missing at least five days of work. The employee gets the benefit of the doubt at all stages. Once the Commission issues a decision, either party can appeal to the Circuit Court. Again, new evidence is not permitted and the court merely reviews what the ALJ did. The hearing tapes are kept for 90 days and either side can obtain a copy of the tape. Although the ultimate decision should not be admissible in other proceedings, the testimony can be used in other proceedings. Because the testimony can be important in defending discrimination claims, it is advisable to obtain a copy of the tape. An unemployment hearing takes careful preparation and attention to detail. It also requires knowledge of cross-examining witnesses properly and presenting exhibits. Failure to adequately prepare and understand the process can result in a loss and payment of benefits. It is also important not to let the employee use the hearing to further another claim against the employer.
