FROM THE EXECUTIVE VICE PRESIDENT Proposed new regulations are expected from the Fish & Wildlife Service and the National Marine Fisheries Service by this spring. It is expected that in a move to further deregulate the rules and guidance that the Critical Habitat, designation may be expunged altogether. Critical habitat is a habitat where no endangered species exist, but regulators deem the habitat suitable for an endangered species to exist. This expansion of species potential range has resulted in vast area declared as habitat during the prior administration. In short, currently the onus is upon you to disprove a species could exist in each habitat. Soon the onus will be upon Fish & Wildlife to prove that an endangered species currently uses the habitat for its survival.

was held January 9th – 11th in Orlando at the Orange County Convention Center. According to NAHB, the event was attended by over 85,000 individuals. Collocated with the Kitchen & Bath Industry Show, the IBS portion itself hosted over 60,000 NAHB members. The show floor expanded from 569,000 SF to 583,000 SF over the previous year. While the show officially opened on the 9th, the actual business of NAHB begins almost a week prior to the show’s opening. Thousands of members serve on over 30 committees and meet prior to the show. One of the most advantageous committees for me to serve on for you as an industry is our Environmental Issues Committee, where I serve as the Executive Officers Council (EOC) EO Liaison for the committee. Here we not only learn about environmental regulations that affect our entire industry but it allows us to work together as federation partners from across the country to overcome the challenges that affect the front line of our industry livelihoods that involve land development and the regulations that rule over what land is regulated and how. As far as this area of NAHB is concerned, there is good news on the forefront. The Trump administration is reviewing all regulations at the Federal level. Of the 50 some odd regulations that are in the USEPA’s purview, 41 are being reviewed for deregulation. The Department of Interior, which houses the US Fish and Wildlife Service that oversees endangered species regulations, of the 50 some odd regulations that they oversee, 43 are in review for deregulation.
Following are some specifics with regards to what you can soon expect as part of the administration regulatory review process: UNIFIED AGENDA 1. 3,521 regulatory actions 2. 470 have recently been completed and 762 are long-term processes 3. What is a part of the “Unified Agenda”? a. Waters of the U.S. Repeal b. Clean Power Plan Repeal c. Implementation of the 2015 Ozone Standard d. Department of Interior – Fish & Wildlife Service i. Revisiting changes to critical habitat designations ii. Reform the EXA Section 7 Consultation permitting requirements e. Housing and Urban Development i. Withdrew Obama era proposal to implement the Federal Flood Risk Management Standard ii. As a result, HUD withdrew its proposal to implement the Standard iii. FEMA plans to issue a notice to withdraw its proposal this month 4

Endangered specie’s two permitting process has resulted in extended delays. The section 7 process. The quickest process has been to admit that habitat existed without any formal process. While this has been the quickest remedy to move land, it has also resulted in heavy fees as well as long delays, especially when considering endangered and threatened bats in our region. The regulation changes were filed on February 2016. The Trump administration is using its Executive Order 13777 and legal settlements as the basis to rescind the prior administration’s rules and policies. In further news on the environmental front, members of NAHB met with USEPA Administrator Pruitt and all ten of his regional managers about storm water regulations. In what amounted to an all-day session, members expressed to those on hand of the hardships caused by storm water regulations for both construction and post construction best management practices as well as the enforcement measures being implemented on the local level. Practically all storm water programs have been delegated by the EPA to the states, who in turn have delegated those same responsibilities down to local governments and agencies or municipal separate storm sewer system (MS4’s) such as SD1 in our region. Because of the meeting and subsequent conversations between Administrator Pruitt and his regional managers, USEPA is drafting nationwide guidance for those delegated the responsibility of storm water management (SD1). This new guidance will introduce a “Find and Fix” method that will dictate a more work-with type of relationship with our industry and deemphasize fines and notices of violations. The ultimate goal is to achieve what the regulations set out to improve in a better relationship rather than a traditional enforce and fine compliance model. NAHB has created recommendations for USEPA to implement in their draft rulemaking regarding waters of the U.S. (WOTUS). The traditional waters that perennially flow and can carry commerce such as waters that are subject to ebb and flow of tide (oceans and gulfs), waters that are presently used, or were used in the past by natural condition or by reasonable improvement as a means to transport interstate or foreign commerce (Ohio, Licking and Kentucky Reivers in our region) and a new concept. The new concept includes perennial and intermittent streams with an annual surface flow greater than “X” cubic feet per second and which flow to waters mentioned above. It will also include wetlands to waters adjacent to those listed above. The proposed language leaves out ephemeral streams, rivers and other waterbodies entirely. These are the stream designations that affect most of our region. Also left out are MS4’s, storm water management features, prior converted cropland (irrigation ditches), manmade ditches, artificially irrigated areas, artificial constructed lakes and ponds created in uplands, or ornamental waters, flooded agriculture
fields, or irrigation ponds, water-filled depressions created in uplands incidental to constructed activity or excavated for obtaining sand or gravel that will fill with water and wastewater recycling structures, detention ponds and retention basins built for groundwater recharge basins and/or water distributary structures. Most streams encountered in Northern Kentucky that are causing issues for the development community are those that are dashed and should not be included in USEPA’s new rulemaking defining WOTUS. What else will not be include in WOTUS? Definitely good news! The following graphic explains the concept.
NAHB’s Board of Directors did vote to support two initiatives. First, they voted to support a new governance structure that was not without controversy. Ultimately the concept of change won the day. As a result, the scope of authority for the Board of Directors and the scope and makeup of the Executive Board is changing. Second, the Board voted to support a pilot project for willing local associations to explore a new membership model. The model decouples NAHB’s exposure to the ups and downs of membership and creates a new guaranteed revenue stream for the national portion of our federation, while leaving all risk of membership fluctuations on the laps of the local and state associations. A final deliberation on the model will be had over the years 2021 and 2022 after the three-year pilot is borne out. On a small note the final step of our process to change our name was approved by NAHB as we are now formally recognized as the Building Industry Association of Northern Kentucky by our national federation partner. Outside of governance and advocacy work, hundreds of valuable education seminars were to be had and there was much to be learned from the exhibitors on the floor of the hall during IBS 2018. ONK has had a very successful 2017. We were incredibly fortunate to secure a matching donation for our $25 for 25 years campaign that brings our total raised to $113,670! Thank you to all of you that participated! Four families realized homeownership through our program – how great is that?! In addition to completing the new build in Elsmere, HONK rehabbed 3 other houses. One of these rehabs is not a typical HONK house in that it is a 1 bedroom, 3 room house. We generally need 4 to 6 rooms to meet the needs of families. However, just before we put the finishing touch on this Covington house a gentleman, having heard about our program, met with our Housing Counselor and has qualified for our program. This house is just what he was looking for: living room, dine-in kitchen, bedroom, full bath, full basement, and enclosed back yard. 2018 is off to a good start!

n 2017 our website traffic jumped from 54,323 unique visitors in 2016 to 101,580. Of those unique visitors 12,618 were searching for members in our directory. Builder members used the site nearly 4,000 times to access contracts, warranties and other documents. 39,420 unique individuals accessed the site to learn about our consumer shows, mostly to plan their visit. The Enzweiler Building Institute captured the attention of over 18,000 unique individuals. NEWSROOM MOLTO PROPERTIES ACQUIRES LAND NEAR CVG AIRPORT OUTSIDE CINCINNATI, OHIO
M
olto Properties, headquartered in Oakbrook Terrace, Illinois, announces the acquisition of 19.22 acres located in the Airpark International Business Park in Boone County, Kentucky. The multi-phase development project will feature two state-of-the-art Class A, industrial distribution buildings totaling over 300,000 square feet. Molto will partner with the Paul Hemmer Company to construct the two buildings with Phase I (142,021 square feet) scheduled to be complete by Q3 2018 and Phase II (160,984 square feet) by Q3 2019. “The close proximity of this site to the Cincinnati/ Northern Kentucky International Airport and Interstate 275 makes this development attractive to regional and national distributors,” stated Todd Naccarato, Managing Principal and Founder of Molto Properties. “We are excited to enter the Cincinnati market with Paul Hemmer Company, which is recognized as one of Greater Cincinnati’s premier providers of construction services.” The Cincinnati market has seen positive absorption for the last 26 consecutive quarters. In 2017, the 284 million square foot market absorbed approximately 6 million square feet. The record high absorption level left the vacancy rate near an all-time low. Molto has retained Jeff Bender and David Kelly of Cushman and Wakefield to market the project.
NAHB ECONOMIST PREDICTS CONTINUED GROWTH
T
he newly enacted tax law will likely spur job and economic growth and keep single-family housing production on a gradual upward trajectory in 2018, according to NAHB Chief Economist Robert Dietz, who offered his forecast in a panel discussion during the Inter- National Builders’ Show in Orlando in January. “We expect that tax reform will boost GDP growth to 2.6% in 2018, and this added economic activity will also bode well for housing, although there will be some transition effects in high-tax jurisdictions,” Dietz said. “Ongoing job creation, wage increases, and tight existing home inventory will also boost the housing market in the year ahead.”
Dietz offered this forecast: • 30-year fixed-rate mortgage will average 4.31% in 2018 and 4.82% in 2019. • 1.21 million total housing starts in 2018 and overall production to grow an additional 2.7% to 1.25 million units in 2019. • Single-family starts to rise 5% in 2018 to 893,000 units and increase an additional 5% to 940,000 next year. • Multifamily starts to edge 1.6% lower this year to 354,000 units. This is a sustainable level due to demographics. • Residential remodeling activity is expected to register a 7% gain in 2018 over last year.

AHB has created a new public awareness campaign to help building industry pros get the resources needed to help keep residential construction workers safe. The Safety 365 campaign is a joint effort of NAHB's Construction Safety Committee and Builders Mutual Insurance Co.

NAHB Elects 2018 Leadership Team NAHB members elected Randy Noel, a Louisiana- based custom home builder, as 2018 chairman of the board during the Builders’ Show in Orlando. Greg Ugalde, a Connecticut builder and developer, was elected first vice chairman, and Dean Mon, a New Jersey builder and developer, was elected second vice chairman. John “Chuck” Fowke, a Florida custom home builder, joined the leadership ladder with his election as third vice chairman. 2017 Chairman Granger MacDonald, a Texas builder and developer, remains on the leadership team as immediate past chairman. Rounding out the association’s leadership is CEO Jerry Howard, who heads NAHB’s professional staff in Washington, D.C. Putting a Dollar Value on NAHB Advocacy NAHB economists have put a dollar value on selected member benefits and advocacy victories achieved in 2017. Add up the dollar value of NAHB services and advocacy victories and you get an average of $7,500 per housing start for a typical home builder. That figure demonstrates how much value NAHB delivers for members. Just a few of the advocacy victories achieved in 2017 that contribute to that number include: • $1,600 Suspension of OSHA Beryllium Rule • $1,200 Reductions in Builder Taxes • $700 Protection of Builder Interest Deduction • $700 Elimination of Flawed Duct Proposal • $1,000 Preservation of Options in Building Codes These numbers represent the value per housing start a typical builder will see in 2018 as a result of key NAHB advocacy victories achieved in 2017. Some members will experience more of these benefits than others.
MEMBER SPOTLIGHT SHAD SLETTO, DIRECTOR PROJECT DEVELOPMENT EGC CONSTRUCTION CORP 1) Tell me how you first got involved in with the Building Industry Association of Northern Kentucky. EGC has been a member of the Building Industry Association of Northern Kentucky for many years. I began attending the BIA’s classes to learn more about the industry, as well as share information with the members about common local and federal issues confronting our industry. As a member of the BIA, EGC is passionate about building a better community. The exchange of ideas and a united approach among all members needs to be actively and continuously supported. 2) What do you think will change about the Building Industry Association of Northern Kentucky over the next five years OR what would you like to see change? It seems futile to try and predict the future at this time. Since I began my first job with a coin-changer on my hip and my trusty dog at my side, the world today is completely different socially, culturally, and economically. With continuous and dramatic disruption fueled by rapidly advancing technology, my current focus is on preparing as best as I can for tomorrow. To prognosticate the future, anyone could be desperately concerned or exceedingly optimistic. Frankly, I’m trying to put more focus on God, with the knowledge that His plan has sustained many faithful followers; It is more reliable than anything I could ever try to create on my own. I am hopeful we can achieve more effective regulations and property rights. Creating a productive environment in secondary education for career and technical education is very important to me as well. Hands-on learning and apprenticeships seem to be valuable methods for educating students that could be more prevalent in school. 3) What might (someone) be surprised to know about you? I can’t hide the position of being a Trump supporter from the beginning, so I guess I’d say being wrong when discussing a topic is not the worst thing that can happen. Being quiet is much worse. Also, I’m actually good at Texas Hold’em, I’m just not very lucky… 4) What do you do when you aren't working or volunteering? I would hope to exercise, but that is not happening. Re-reading “The Subtle Art of Not Giving a F#%k” by Mark Manson. I highly recommend it. 5) What is your best tip to provide to our members about networking with potential customers and clients? Act. Be present in the lives of those with whom you work. Do it based upon obtaining their permission. Listen. People seeking solutions need to be heard.

BIA of Northern Kentucky Supports Kentucky Winter Special Olympics
A
s a volunteer driven organization, we know there is no we could accomplish the services to our members and have our events be as successful as they are without our members and volunteers.
Sometimes as a staff we have a chance to volunteer ourselves and give back to our community by helping others. This past January 22nd, Director of Professional Development, Shawn Cox hit the slopes at Perfect North to serve as a “Ski Buddy” / Guide during the Kentucky Winter Special Olympics. This was his third year to volunteer and to hear him talk about it he’s the one who gets the most out of it, not the athletes. “Its really a privilege to spend a day with these athletes. You build up an instant trust and camaraderie with them and just to see the passion and support they show for each other is truly inspiring. It really has become my 10

favorite day of the winter”. Cox added “I’m very lucky to work for an organization that supports the community in ways just like this, it’s a way to ‘practice what we preach’”. Mark Buerger one of the coordinators for the Special Olympics Kentucky was grateful to have Shawn and the other volunteers available to make the day all about the athletes. “We simply could not do this event without the volunteers. They are the ones who make it possible to have events like this.” Buerger added with a smile “I mean my staff and I we don’t even ski, so we need people like Shawn and all the other volunteers out there”. W
hen it comes to building new communities, the traditional pool and clubhouse will no longer suffice if you want to stand out from your competitors.
This was one of the key messages delivered at an educational seminar on new amenities for lifestyle buyers during the Builders' Show in Orlando in January. “Great community amenities equip people with what they need and empower them to act,” said Teri Slavik-Tsuyuki, the founder and principal of tst ink llc. in Encinitas, Calif. “Find a way to give buyers memories and create a point of view.” Echoing that theme, Thomas Kopf of DTJ Design, Inc. based in Boulder Colo., said that builders should design communities that “create the 12

opportunity for experiences.” He emphasized several key themes: Nature. Consumers are interested in communities that offer trails, ponds and walking paths. Social. Small cafés within a community center, outdoor fireplaces, fire pits and community gardens provide people a sense of pride in where they live and a place to gather year-round. Unique. Knopf cited unique entry features to the community such as a wall designed to look like the remnant of a building that used to exist on the site to provide people places to stop and look at the view. Other suggestions: make a culvert look like a bridge or leave bicycle pumps and tools in designated areas along trails to encourage people to stop and congregate.
Builders should design communities that “create the opportunity for experiences.” Anthony Faranda Dietrich of Charter Homes & Neighborhoods based in Lancaster, Pa., said his firm builds communities that “connect people to each other.” “We’re all about the experience, bringing people into open space and providing a neighborhood experience.” Charter Homes & Neighborhoods has developed communities where stormwater facilities are designed as a pond. “We landscape the area heavily and
turn the homes so that they face water, adding value to the community,” Dietrich said. Other unique design features include a pocket park consisting of a half-acre of longitudinal green space and a “terra park” that contains climbing walls and a sledding hill. The Public Arts Network of Northern Kentucky Announces the NKY Picnic Table Project in 2018
T
he Public Arts Network of Northern Kentucky has announced its new community initiative – The NKY Picnic Table Project -- a low-cost, high-impact project that will bring the region’s communities together with art and food.
Here’s how it works: Any person, family, or group -- such as a business, school, church, neighborhood, city, or club -- can purchase a custom-built picnic able from the Network for $500. After all purchases are made, the picnic tables will be delivered to a local warehouse, where the real fun will start.

Over two weekends in April, the individuals or groups that purchased the tables will visit the warehouse to decorate their tables any way their hearts desire. The Network will supply refreshments, paint, and other art supplies at the warehouse. “The picnic table is a timeless symbol of sharing and togetherness,” said Chris Manning, principal and landscape architect for Human Nature, Inc. and a member of the Public Arts Network. “This project allows individuals and organizations to join other Northern Kentuckians to gather together, show our pride, and decorate their tables to create and celebrate the unique mosaic that is our region.” Once the table artwork is finished, all the tables will be delivered to the Purple People Bridge on Saturday, June 9, for a community picnic over the Ohio River. After the picnic, the tables will be transported to their final homes throughout the Northern Kentucky region, where they will provide unique art and new opportunities for community picnics throughout the year. “As the convening member of the Public Arts Network, we are excited to be spearheading this project,” said Jill Morenz, director of Community Initiatives and Communications for The Catalytic Fund. “The Purple People Bridge will be the perfect setting for this huge picnic to celebrate our Northern Kentucky communities and the individuals who live and work in them.” The Public Arts Network of Northern Kentucky is a group of community leaders who believe that the arts are an essential component of a vibrant and thriving community. As the convening member, The Catalytic Fund is directing this initiative. The Public Arts Network has many goals, including promoting the arts in Northern Kentucky, telling the stories of the region through public art, and identifying, creating, and facilitating region-wide “low cost/high impact” public arts projects, such as The Picnic Table Project. The organization also plans to create and help execute a regional public-art plan by engaging with Northern Kentucky’s diverse communities.
