County by County Commercial Graphs For the period of January through April Boone County has started setting Northern Kentucky’s turnaround back to a new commercial construction market and away from a reinvestment market. While Kenton’s first four months of 2018 look very good over 2017 $25 million of their $35 million in new investment is from one project. Campbell County shows no current presence in the overall commercial construction industry’s improvements.

Total Commercial Investment/Reinvestment So far in January through April 2018, the total investment in Commercial Construction has been $122.475 million. For that same period in 2017, there were $85.748 million or an increase of 42.83% in 2018.

New Commercial Investment Versus Capital Reinvestment For the first time since 2009, we are seeing more new capital investment than we are seeing commercial reinvestment. Between January through April of 2018 over 2017 the amount of new capital investment outpaces capital reinvestment by $27.23 million or an increase of 57.17% year over year.

NKY CONSTRUCTION MARKET REPORT Residential Remodeling In 2018, between January and April, remodeling activity across the Tri-County region has increased 32.51% over the same period in 2017, while the average value of the work being reported has increased 36.45%. Increases across all three counties are being seen with Kenton County leading the volume increase by 71.43%. 167.49% increase for value of reported remodeling projects.

Single Family Residential The first four months of 2018 are signaling a beginning of a resurgence for the single-family housing market. Still the bellwether of the single family residential housing market, Boone County permits are up 23.33% over that same period in 2017. Kenton County permits are up noticeably by 40% but have not kept pace with Boone County’s growth. Campbell County has cooled somewhat and retreated by 22.22% for the first four months of the year over that same period of 2017.

The big news is that we are full speed ahead for The Legacy House. In partnership with the BIA and its many members, the City of Elsmere, and several Community supporters, Housing Opportunities of Northern Kentucky is moving forward on this four-bedroom, two-bathroom house with a two-car garage. It is being constructed as a tribute to all that our founder Fr. Jack Goeke has achieved, and all that HONK continues to achieve thanks to Father’s vision and leadership. The ground breaking was held on June 14 and attended by BIA and City officials, Community leaders BIA members, and many supporters. TV’s channel Twelve (WKRC) John Lomax was the emcee for this successful and well attended event. This is just the beginning and much help is needed. HONK’s goal is to build this house using as much donated labor and materials as can be mustered. Look for details about our upcoming blitz build for The Legacy House. Also, watch for BIA emails that will track our progress and list what trade skills are needed and what materials/supplies we are seeking. NEWSROOM Lumber Costs Adding $7,000 to Price of a Home Since the beginning of last year, rising lumber prices – made worse by tariffs on imported Canadian softwood lumber – have increased the price of an average single-family home by more than $7,000. Lumber prices soared to a record-high $578 per thousand board feet for the week ending May 25 and May futures contracts are selling at the previously unthinkable $600 range. We need a solution now to protect the home building industry and consumers from tariffs that are raising production costs and harming home buyers. Ask your federal lawmaker to sign a letter urging Commerce Secretary Wilbur Ross to reach a new softwood lumber trade agreement with Canada. DOL Allocates $85M for Construction Training The U.S. Department of Labor (DOL) on May 18 announced it will allocate $85 million in grants to sup- port and expand YouthBuild programs across the nation. YouthBuild, a pre-apprentice- ship model, provides at-risk youth ages 16-24 with occupational skill develop- ment to obtain employment in construction and other in-demand industries. DOL said various communities across the nation will be awarded the grants, each of which will range between $700,000 and $1.1 million.

Bringing Housing Home™ Spreads the Word From coast to coast, members of the NAHB Federation stepped up in early May to bring housing issues to the forefront during Bringing Housing Home™, NAHB’s in- district Legislative Conference. Members held more than 150 meetings with their U.S. senators and representatives. At the same time that they forged a closer working relationship with their federal legislators, they also delivered a powerful message: A robust housing industry is essential to creating jobs and ensuring a strong economy. NAHB members and staff briefed Members of Congress on several issues affecting the home building community.

CFPB Amends "Know Before You Owe" The Consumer Financial Protection Bureau (CFPB) announced recently that it has finalized an amendment to its “Know Before You Owe” mortgage disclosure rule that addresses when mortgage lenders with a valid justification may pass on increased closing costs to consumers. The Know Before You Owe mortgage disclosure rule took effect Oct. 3, 2015 and created new Loan Estimate and Closing Disclosure forms that consumers receive when applying for and closing on a mortgage loan. Since then, the CFPB has heard feedback from the industry regarding the need for clarification about when lenders may pass on increased costs to consumers and disclose them on a Closing Disclosure. CFPB said the change is “intended to provide greater clarity and certainty to the mortgage industry.”

Talks centered on the need to enact policies that would: Sensible regulations. Reduce or eliminate unnecessary regulations to make homeownership and rental housing more affordable for teachers, firefighters, police officers and other middle-class families. Flood insurance. Achieve a long-term reauthorization of the National Flood Insurance Program that will keep the program fiscally sound and let builders provide safe and affordable housing. Softwood lumber. Ensure American home builders and consumers have access to a reliable supply of softwood lumber at reasonable prices. Accessible credit. Provide a stable and affordable supply of credit for home buyers, home builders and rental housing. Workforce development. Adopt sensible workforce development and immigration policy that will help the residential construction industry to fill open jobs and boost the nation’s economy.

OSHA Proposes Crane Rule Changes In a notice of proposed rulemaking published May 21, OSHA proposed to amend its rule for cranes in construction, 29 C.F.R. § 1926, Operator Qualification and Certification. The rules require employers to allow only employees who are certified or licensed in crane operations to use the equipment. The new proposal removes a contentious provision that would have required third-party testers to indicate the type and rated operating capacity of equipment an operator was certified to operate. OSHA is leaving intact the requirements for certification or licensing of crane operators, a provision long opposed by NAHB. NAHB believes that no one should operate any crane that they do not know how to operate. It is the responsibility of the operator’s employer to make sure the equipment operator has the knowledge and skill to run the relevant type of crane.

DHS to Allow 15,000 More Guest Worker Visas The Department of Homeland Security (DHS) announced on May 25 that it will issue an additional 15,000 H-2B guest worker visas for fiscal 2018, which ends on Sept. 30. This will be in addition to the annual allotment of 66,000 visas, all of which have already been claimed this year. Given the chronic labor shortages facing the home building industry, NAHB has been urging DHS to significantly expand the number of H-2B visas available for the year.

EPA Delays New Waters of the U.S. Definitions The EPA will wait until August to release its proposed new definitions for “waters of the U.S.,” which means that the final version won’t be ready until the fall of 2019. The proposal would replace the Obama Administration definitions finalized in 2015 and now making their way through the courts. It is widely expected that the Trump administration’s new WOTUS definitions will be narrower and will not automatically assert federal jurisdiction over isolated wetlands.

he 2018 Cavalcade of Homes presented by Florida Tile in partnership with Drees Homes and Adam Miller Homes was once again held on the first three weekends in May. This scattered site home show has been held for over 20 years and gives consumers the opportunity to view the newest homes on the market. CYBER INSURANCE

Whether you are a giant corporation or a mom and pop shop, any business that uses email, or accepts credit card payments, and has online presence is open to claims for cyber-attacks.

Current example of this is the 2013 cyber-attack on Target. This resulted in the theft of credit card information of over 70 million customers. The hackers accessed Target’s data through their HVAC vendor!

One day you wake up and realize you can be under cyber-attack. Even the best firewalls do not provide adequate safeguards against cyber-attacks. Many are not convinced of the need to purchase Cyber Liability Insurance Coverage.

As more of these attacks occur small businesses are now considering the coverages to be “must have “ones.

The discussions of insurance coverage for this exposure mandates consideration be given to a worst-case scenario. How much money could be lost in a breach? Most companies according to Tim Francis, Travelers Insurance Company, find this risk to be the second-biggest worry right behind medical cost inflation. The reality of cyber risk is that the Internet has reached in and grabbed hold and made the world totally unrecognizable. We have discovered that only 15% of businesses have cyber insurance. This recognition is characterized by the lack of education and understanding of the relative risks and coverages available. Many still perceive Cyber Insurance as a data-breach coverage, and if they do not collect personal information, operationally that they will not be a target. Many also believe that criminals will only target large organizations.

Professional insurance advisors stress that no organization is immune to cyber-attack. If it has not happened in the past it is just a matter of time that it will be your turn. An attack is very stressful as the costs resulting from an attack can result in third-party claims, first-party responsibilities, forensics, notification, credit protection, public relations and crisis management, business interruption, cyber extortion, media liability, and regulatory penalty costs. In some respects, we are fortunate. European Union’s General Data Protection Regulations (GDPR) are scheduled to take effect in May 2018. Violating GDPR can cost an organization up to 4% of its overall revenue in fines. Sit down with your insurance advisor and explore your exposures to these damaging claims.

MEMBER PROFILE MIKE WILLENBRINK, PE, LEED AP Tell me how you first got involved in with the Building Industry Association of Northern Kentucky. I first got involved with the Land Development Council (LDC). We are committed to promoting responsible development and preserving development rights for future generations. It’s a great group of people with an important mission and provides another way that I can help shape the future of our communities in a positive way. What do you think will change about the Building Industry Association of Northern Kentucky over the next five years OR what would you like to see change? Our industry has an aging workforce and there is a very real gap with the incoming talent pipeline. The BIA has picked up good momentum bridging this gap with the Kentucky Work Ready Skills Initiative and the Enzweiler Building Institute continuing to partner with the local schools to offer more opportunities for advancement in the construction industry. I see the BIA expanding these efforts and partnerships in the next several years if we’re really going to make a difference in the skills gap. Additionally, the LDC’s advocacy initiatives will continue to be critical. If a land development project was easy, it would already be done. The LDC gets down into the weeds of both existing and proposed regulations impacting the land development side of the industry. Many members probably don’t always recognize the impacts of these efforts, but they will continue to become increasingly important.

What might someone be surprised to know about you? I can confirm that you will get a headache if you travel from the beach in Los Angeles (sea level) to the Sierra Nevada mountains and hike to the top of Mt. Whitney (14,505 feet above sea level) within a 12-hour period with three friends. I used to live in Los Angeles and elevation sickness is a very real thing. What do you do when you aren't working or volunteering? In the past, it was traveling, but more recently, I’ve been spending my time playing with Polly Pocket and Thomas The Train and reading endless numbers of short stories, like “The Little Engine That Could.” Our little ones aren’t in school yet, so they keep us pretty busy. What is your best tip to provide to our members about networking with potential customers and clients? Don’t underestimate the power of face-to-face networking. It’s easier than ever to connect digitally through email or LinkedIn, but there is a much more powerful human factor that allows you to connect better with someone in person.
