Avoiding Construction Delays

V

arious factors can cause delay on a construction site. Delays will always exist. However, delays can be minimized with the cooperation of all involved on the project. That cooperation starts with the construction contract. The contract should contain provisions that clearly define the scope of work, include realistic estimates for the construction schedules, and set forth compensable and non-compensable delays. A clearly defined scope of work is crucial in minimizing disputes, claims, and delays. A misunderstanding about the scope of work could easily result in significant delays and potentially liquidated damages. The construction contract should include an incredibly detailed and very well defined scope of work exhibit. The contract should also reference and incorporate an up-to-date list of drawings and detailed specifications. Further, it should reference and incorporate any project manuals relevant to the project. Realistic schedules are also important to avoid delays on a construction project. The owner, contractor, and all subcontractors must be realistic in determining an appropriate schedule for the project. Sometimes contractors underestimate how long a particular task will take. Resulting delays can spill over into various other portions of the project. On the other hand, overestimating the schedule can cause issues as well. For example, the electrician schedules two weeks to perform the electrical work. Other trades will adjust their project schedules accordingly. The electrician actually finishes its work in two days. The other trades are then scrambling to get the tools, equipment, and labor necessary to follow the electrician much sooner than anticipated. This creates anxiety and chaos on the project site. The parties should create realistic schedules and plan for sufficient materials, tools, and labor. As a result, the parties will reduce delays,

and the project will flow more smoothly. As the project will always encounter some sort of delay, it is essential to clearly define the parties’ rights and obligations related to delays. The contract should include precise definitions of a compensable delay and a non-compensable delay. It should also include any notice the contractor must provide the owner if an occurrence or event caused the delay. Further, the contract should clearly describe the process required to submit a claim for additional time and/or compensation due to the delay. In addition to a clearly drafted contract, the contractor should take further precautions to minimize delays. Contractors should regularly monitor their employees, suppliers, and subcontractors. Contractors should maintain a daily log describing the progress of the project. The log should include details, including who was on the job, what tasks they were performing, and their progress. Further, contractors should take and maintain date-stamped photographs and video establishing the condition and progress of the project. Detailed documentation can be crucial in determining the cause of the delay and whether it is deemed compensable under the contract. Delays are to be expected on a construction project. However, the cooperation of the parties in drafting the contract and throughout the project can help to reduce delays. Land Development Council Hosts First Infrastructure Roundtable March 23rd

T

he Land Development Council of the Home Builders Association of Northern Kentucky held its first quarterly infrastructure roundtable during a luncheon on March 23rd, 2011. The event was sponsored by DBL Law, who was represented by HBA Legal Counsel Joe Cleves. Nearly sixty people were in attendance, from a list that read like a who’s-who for the development community. “Our Land Development Council and our Board of Governors were in attendance, including developers, engineers, contractors and our Land Development Council members,” said Brian Miller, Executive Vice President of the Home Builders Association. Commission, Northern Kentucky Area Planning Commission, Campbell County Planning Commission, Sanitation District Number 1, Boone County Water District, Owen County Electric, Insight Communications, Boone County, Kenton County, City of Independence, City of Taylor Mill, City of Covington and the City of Florence. “We feel like this is a great start to an ongoing dialogue,” said Paul Metzger, Fisher Development, and Vice President of the Land Development Council. “It is a definite step in the right direction. All of the agencies and government representatives were encouraged to give updates about projects in their respective jurisdictions. So many times we find that it is difficult for everyone that was in the room that day to keep each other up to date with what is going on in their areas, and by being able to congregate in one room and talk openly about what each entity is facing helps. It also allows our industry to relay back to them what we are facing. In the future we see this format as a way to face all of our challenges together,” he concluded. As the agencies updated the Land Development Council with what they were experiencing members of the Council were able to ask questions and offer their recommendation with how to interact with our industry. “In the future we see this group evolving. Many of those in attendance are working on major projects. The Florence City Council has hired the Boone County Planning Commission to take a look at Mall Road and the ability to recreate a more vibrant community in that area. While we are engaged with the commission regarding the project and have the opportunity to provide input with regard to how the project will evolve, it would also benefit all of Northern

Kentucky’s infrastructure and development community in knowing how such a large project such as this may impact the landscape of development and residential communities in our region,” said Miller. “Other projects that come to mind as offering great presentations to the entire group are SD1’s Western Regional Treatment Plant, the efforts that Southbank Partners are undertaking regarding a cohesive development plan across the shoreline of Campbell and Kenton Counties, or the 12th Street project in Covington, slated to be completed in the fall of 2012,” he finished. The other Land Development Council Roundtable meetings are scheduled for June 15th and September 21st. Both meetings will begin at Noon. 2011 Kentucky General Assembly Regular Session Wrap Up By Brian A. Miller, Executive Vice President HBA

A

t press time the 2011 General Assembly was in a special session called by Governor Steve Beshear to address the gaps in the State’s Medicare program. The 2011 regular session was a short session according to the terms of the assembly’s annual calendar. “We saw a number of bills come out of the Senate like horses out of a starting gate,” said Walt Dunlevy, Forge Lumber, and the HBA’s State and Local Government Committee’s Chairman. “At several instances our members were called upon to contact their State Representatives and Senators and they responded extremely well,” Dunlevy concluded. “Grassroots is the strength of our federation in the State of Kentucky”, said Brian Miller, executive vice president. “When we see legislation that can improve our industry or harm our industry our members are engaged. They hit the phones, hop in their cars, and start working away on their keyboards. All of our members understand what tenuous times our industry is facing and they all pull together to make sure that our voice in heard in Frankfort,” he finished. Bills were filed both in the Senate and the House concerning immigration. Senate Bill 6, the most employer friendly immigration bill, was sponsored by Northern Kentucky Senator John Schickel. The bill addressed the issue of illegal immigration, while taking into account the best interest of employers in our state. House Bill 470 was passed into law on March 14, sponsored by Representative Tommy Thompson cleared up ambiguity regarding the SAFE Act and seller financing. Prior to this bill there was question as to whether builders and developers could finance the sale of their properties. This situation could harm some smaller builders and developers who don’t have the wherewithal to establish their own finance company. The measure cleared the House. House Bill 256 , sponsored by Rep. Mike Denham, allows the Kentucky Housing Corporation to define “area median income” and to redefine “persons and families of lower and moderate income” to mean combined income that does not exceed 200 percent of the area median income. This bill essentially makes more Kentuckians eligible for home loans. The legislation made it through both houses and was signed by the Governor. House Bill 26 , sponsored by Linda Belcher of Shelby County, established a regional sanitary sewer system at Fort Knox that would lessen impacts on the current watershed that

the Louisville housing market enjoys. This system would be an optional system for cities and counties to join and would not be an obligation unless those governments voted to join the system. While not directly impacting Northern Kentucky immediately, the model could be used as a way to open up capacity and development in Northern Kentucky in the future. What are of more note for House Bill 26 are amendments that were filed to the bill. The final amendments included a few measures that have impact upon Sanitary District #1 in Northern Kentucky. Any rate increase exceeding five percent would have to be approved by at least two of three full fiscal courts, rather than a simple majority of County Judge Executives as currently exists. Any increase below that level could still be approved by the three County Judge Executives. Additionally, as expressed as transparency measures, SD1 would have to post more of their documentation on their internet site. The bill was signed by Governor Beshear on March 17th. One bill of note raised particular attention of the industry in House Bill 226 sponsored by Jim Wayne of Jefferson County. The bill would have allowed cities of the fourth class or larger (3,000 to 7,999 residents or larger) to establish their own building codes where fire codes are concerned. The intention of the bill was to allow cities and counties to mandate fire sprinklers.

The concern of our industry quickly focused its attention on how this process could become quickly manipulated. “This precedent could easily establish the basis for creating a myriad of local building codes that could potentially unravel the decades of work done to establish and strengthen state wide building codes through the Commonwealth,” said Miller. He went on to point out, “We immediately were in touch with our grassroots, who contacted those in the House Committee and the remainder of our Northern Kentucky caucus concerning this legislation. Our membership responded in an outstanding fashion to make our voices heard about the disastrous affects that legislation such as this could have upon Northern Kentucky and our Commonwealth as a whole. The collective voices of our industry were heard and the bill never made it to a committee hearing thanks to the efforts of our members.”

Tour of Remodeled Homes: The 2011 Tour of Remodeled Homes is scheduled for October 1st and 2nd. We have heard from several companies that plan to have entries in the show, including entries in Cincinnati. The HBA will be sending out bi-monthly e-mails listing the entry locations as they are received. Look for information later in April with the early bird and deadline dates. Cincinnati has been named the #1 remodeling marked in the country, so let’s put on a great TORH and show consumers why they should use Registered Remodelers for their projects.
