FROM THE EXECUTIVE VICE PRESIDENT

Transportation Projects and the Economy of Northern Kentucky While the HBA works on specific issues regarding the building and development industry we are also community partners that speak for a broader range of issues than simply building codes, sewer capacity and planning regulations. Of course we are also engaged in state legislative initiatives, construction workforce development, environmental regulations and a host of other specific endeavors to support you and your business. However, we are also a considerable voice for the overall economy of the region.

o that end we often find ourselves weighing in on general growth issues. There is no more impactful issues than transportation projects to move the economy of our region forward. As we get closer to the 2016 General Assembly we felt it was warranted to pass along many of these projects to you. KY Route 536 This is an east/west corridor that Northern Kentucky desperately needs constructed. Right of way acquisition funding has been complete for a good stretch of the project and scoping study funding is being used right now to collect feedback as to the routes through Eastern Kenton County and Campbell County. This project needs to see construction funding to move forward. As a result this would mean additional growth opportunity in Kenton County and neighboring Campbell County. It would also make travel from Independence to areas in adjoining counties much safer. If you have ever traveled Bristow Road you know what we are talking about. Mt. Zion Road Interchange This project would create a Single Point Urban Interchange (SPUI) at the Mt. Zion Road exit. While we have some concern regarding he commercial usefulness of an interchange with such a large footprint we need to see this project move forward to improve the congestion of that interchange. This would further enable the Union area to grow out to US 42 and beyond. Pleasant Valley Road The two ends of this corridor have seen construction and improvements from US 42 to the a north around Iris Ln. On Pleasant Valley. The other end where Camp Ernst joins Burlington Pike has seen a new overpass and road improvements down to Rogers Rd. the middle section needs construction funding to widen the road to handle future traffic needs of Boone County. Possible future projects need to begin a dialogue now As growth moves west into Boone County we will need greater North/ South connectivity to accommodate growth. That means that from Old

Union Road out Hathaway Road and headed up to the West of Camp Ernst to get to Burlington will require a new project. This is an extremely impactful potential route that would open up thousands of acres for growth and development. Newport is creating an amazing corridor with its Route 9 improvements that will likely jumpstart the Ovation project. Our other river cities need to benefit from not only that momentum but from their own new projects. Commercial activity could greatly benefit from a new Commercial gateway entering into a Covington from the south near where Route 16 and 17 intersect. Additionally while there is funding to improve the 4th Street Bridge connection Covington and Newport The 12th Street Bridge empties out onto a one lane headed West. This bottleneck needs correction to take advantage of the recent 12th Street project. The HBA is at the table with the Consensus Committee; a group formed specifically to bring these requests as a community voice to the legislature. The existing projects aforementioned need funding and the new projects above need work to introduce and to gain momentum to eventually occupy OKI’s priority list. We will continue to work with the cities, counties and our community partners to drive the dialogue forward. And lastly....the bridge. The HBA has not taken a position on this project. There are members on both side of the issues regarding this matter. However, we are interested in seeing Henry Fischer’s vision thoroughly evaluated. At first blush we see 50 years of economic growth from his ideas. As long as the bridge project effort is on a hiatus it is essential that we work to secure transportation funding in the 2016 General Assembly. With state budgets stretched thin, transportation projects are the priority of the day. We look forward to having your voice be represented in Frankfort to help make this happen. The greatest period of economic expansion in this country occurred during the creation of the federal interstate system. It is no secret that this is no coincidence. So as we draw closer to the General Assembly let’s speak with one voice to help a Northern Kentucky grow. ith the retirement of long time staff, Janice Beard, HBANKY hired Lindsay Chupek. Lindsay is the Director of Membership. Before coming to the HBANKY, Lindsay, worked as Operations & Donor Relations Director at the Big Brothers Big Sisters of Greater Richmond, Virginia. Before beginning her career with BBBS, she was a high school volunteer and later a mentor in the program. Lindsay has carried over her caring attitude, customer service and events coordination experience from her BBBS days to HBANKY. Lindsay is a graduate of Eastern Kentucky University - GO BIG E. Where she majored in Child Development. As the Director of Membership, Lindsay is responsible for affinity programs, Ambassador Club, Associates Committee, continuing education records, membership development and records, retention, seminar records, Registered Builder/Remodeler program, Retention Committees, Associates Outing, The Sales and Marketing Council, HBA Annual Golf Outing and the Holiday Party. Lindsay and her husband, John, have twin 2 year old daughters and another 4 year old daughter. John works as a Loss Prevention Manager with Lowe’s Home Improvement. She moved to Northern Kentucky to be closer to family. Lindsay became familiar with HBANKY through her brother, Zach Hadden, formerly with Pella Windows. He has given her some insight on HBA life. Lindsay is eager to spend time with her family and explore the Northern Kentucky area. When she has the time, Lindsay enjoys cooking with her oldest daughter. HBA & POLITICAL AFFAIRS Boone County Water to Accept Requests for Cul De Sac Line Downsizing

he Boone County Water District and members of the Land Development Council recently met regarding downsizing water lines in small cull de sacs. As is practice with a Northern Kentucky Water the Boone District will review requests on an individual basis. Also as they renew their tariff they will be inserting language mimicking language found in the Northern Kentucky tariff. Fire flow limits must be adhered to ensure public safety. The potential benefits to developers and builders could be from $3,000 to $5,000 per cul de sac. Should you have any questions about this opportunity please contact the Boone County Water District. If any issues arise from a potential request please contact our offices.

HBA Encourages Department of Housing, Buildings & Construction to Adopt 6 Year Code Cycle

any other states in the U.S. are moving to a six year code cycle. Why? Because as in depth and detailed as our codes are becoming by the time Building Officials, inspectors and builders are able to fully comprehend and implement the codes it seems like we are right back changing things all over again. The building code has been improved so much so that adopting a new code every three years is becoming redundant and unnecessary. Safety issues have been addressed excessively. If there is a pressing issue in the code by the International Code Council we can simply address those piecemeal and move on. When you are able talk with your local building officials to let them know that it is in all of our best interests to move to a six year cycle. Campbell County Moving Forward with Comprehensive Plan

ecently the Campbell County Planning Commission approved the Goals and Objectives of the comprehensive plan update. As required by law a planning commission must update their plan every five years. The Goals and Objectives must be approved by every legislative body which the commission serves. The commission staff is undertaking that process at press time. Me,bears of the Land Development Council have met on several occasions with Planning Director Cindy Minter and feel that she is doing an excellent job listening to our industry. Additional meetings have been held with Campbell Judge Executive Pendery as well. As the plan becomes developed your HBA will be representing your interests as we go through the long process of updating each element of the plan. Watch for public notices from the planning commission to become engaged in this process to have your voice heard.

If youâ&#x20AC;&#x2122;re in the construction business, you may want to ensure that your worksite is free from serious safety risks and hazards. The Occupational Health and Safety Administration (OSHA) recently issued several hefty fines, and even jail time, to a number of construction companies that had repeated and serious safety violations.

n May, nine contractors working at a newly constructed luxury housing complex got slapped with more than $150,000 in fines after OSHA inspectors visited the work site last fall. Inspectors cited the contractors for exposing employees to a number of safety hazards and risks, including 35-foot falls, exposed rebar, head and eye injuries and other hazards that could lead to death or serious injury. This incident is notable because OSHA cited nearly all of the contractors on site, including the developer, project manager, a roofing company, window outfitters, and carpentry, masonry and drywall trade subs. Of the nine companies cited, OSHA had previously inspected four of them for serious violations. One month later, a president and vice president of a local roofing company were arrested for failing to comply with a civil contempt order that came as a result of nonpayment of fines for multiple OSHA infractions. In 2011 and 2012, OSHA conducted several inspections of the companyâ&#x20AC;&#x2122;s work sites and found multiple fall protection, eye and face protection and ladder safety violations, among others.

When the company failed to pay penalties of more than $195,000 plus interest and fees, and continued to violate OSHA standards, the courts issued the arrest. After spending more than a week in jail, the owners were released on bond and given 30 days to either pay off the outstanding penalties, or demonstrate an inability to pay and certify that they have worked to resolve the OSHA violations cited in prior inspections. Their final hearing is scheduled for Aug. 26. More recently, two sister companies were cited with willful and repeat safety violations, including fall hazards for workers installing wood framing more than 10 feet off the ground. The citations resulted in proposed penalties of $153,090. According to the agency, the parent company has a history of OSHA violations and was shut down earlier this year. Its former owner restarted the company as two new ones in February, but continues to ignore OSHA regulations.

New Home Closing Rules Take Effect This October Closing on your new home is an exciting time — but it also can be an overwhelming process. Home buyers are usually required to sign a seemingly endless pile of documents, most of which are written in terminology not used outside of the housing industry and that can be complicated to understand.

ortunately, the process is about to get easier. Under new rules required by the Consumer Financial Protection Bureau, four closing documents will be merged into two. The CFPB recently announced that the changes scheduled to take effect on Aug. 1 will be delayed until Oct. 3 The Good Faith Estimate and Truth in Lending disclosures will be eliminated and combined into a new single Loan Estimate form. The Loan Estimate must be delivered to the buyer no later than three business days after receiving the application. In addition, the final Truth in Lending Disclosure and HUD-1 Settlement Statement are being replaced by the Closing Disclosure form. This form must be provided to the consumer a full three days prior to the closing, and if there are changes during that 72-hour period, the closing could be delayed. This is a big change from the current process that allows the HUD-1 Settlement Statement to be presented to the buyer as late as the day of closing and allows changes to be made to the statement during the loan closing. 14

These new rules are intended to streamline the loan application process and make it easier for consumers to understand by clearly spelling out the most relevant details all on one page – the interest rate of the mortgage loan, the amount of the monthly payments and a listing of all the closing costs. For consumers applying for adjustable rate mortgages, the documents will explain how their interest rate and future monthly payments could change based on certain factors. NAHB Continues Fight to Strike G-Fee Increase from Transportation Bill As the Senate debates legislation to renew funding for a six-year highway transportation bill, NAHB continues to lead the efforts to strip out a provision that would increase the Fannie Mae and Freddie Mac guarantee fees (g-fees) to help pay for transportation programs.

-fees are a critical risk management tool used by Fannie Mae and Freddie Mac to protect against losses on mortgages they have purchased or mortgage-backed securities they have guaranteed. These fees should only be used for their intended purpose – to ensure the safety and soundness of Fannie Mae and Freddie Mac. Reporting on this issue, The Hill (http://thehill.com/policy/ finance/248909-senators-dont-use-mortgage-fees-to-pay-for-highwaybill) cited an official statement (http://www.nahb.org/en/news-andpublications/Press-Releases/2015/july/statement-from-nahb-chairmantom-woods-on-plan-to-raise-g-fees.aspx) from NAHB Chairman Tom Woods, who called it “outrageous” that Congress would consider using the fees to pay for programs unrelated to the housing government sponsored enterprises. “With first-time home buyers still hesitant to enter the marketplace, it makes no sense to impose what amounts to a new tax on homeownership that will disproportionately affect low- to moderateincome borrowers,” Woods said. He added that senators must strip the g-fee provision out of the legislation and look for other means to fund the measure. “Homeownership cannot, and must not, be used as the nation’s piggyback.” SENATORS: G-FEES SHOULD NOT BE USED FOR NON-HOUSING RELATED PURPOSES Sens. Mike Crapo (R-Idaho) and Mark Warner (D-Va.) agree. The two sent a letter to Senate Majority Leader Mitch McConnell and Minority Leader Harry Reid stating that “further increases of guarantee fees should be used to protect taxpayers from mortgage losses and as a repayment for the bailout, not for unrelated programs.” The senators also said that “any legislation which purports to use guarantee fees to offset a portion of its cost will actually be in direct violation of PAYGO [a budget rule requiring that, relative to current law, any tax cuts or entitlement and other mandatory spending increases must be paid for by a tax increase or a cut in mandatory spending], with the overspending contained in the bill serving to greatly increase the deficit.” In a related development, the Senate Appropriations Committee approved a fiscal 2016 spending bill to fund the Treasury Department and U.S. judicial system that contains a provision that specifically prohibits the use of g-fees to offset other government spending. 22

The legislative language “prohibits the uses of increases in a guarantee fee charged by Fannie Mae and Freddie Mac to offset outlays or reductions in revenues for any purpose other than enterprise business functions or housing finance reform as passed by the Congress in the future.” KEY HOUSING-RELATED PROVISIONS IN SPENDING BILL Also of importance to the home building industry, the appropriations bill would prohibit funding to implement an executive order on flood management signed by President Obama earlier this year. NAHB believes the executive order amounts to regulatory overreach that could dramatically increase flood insurance rates on America’s home owners and businesses and impose unnecessary regulatory requirements for home building, home financing, home sales and land development along coasts, rivers, streams, lakes and ponds. We have been urging the president to halt all efforts to implement this new order until the administration provides a cost-benefit analysis to justify the rule, proper maps for regulators and the regulated community to review, and scientific or technical data to substantiate the basis for the rule. The Senate spending bill also contains the full text from Senate Banking Committee Chairman Richard Shelby’s Financial Regulatory Improvement Act of 2015. Shelby’s bill contains many critical reform elements that would alleviate the tight credit conditions that are preventing more buyers from entering the market. Specifically, it would: • Help smaller financial institutions to provide more funds for lending by ensuring they don’t have to abide by heavy capital requirements enforced against large banks. • Increase the amount of loans that can be considered as qualified mortgages by excluding from the points and fees calculation any escrow payments the lender charges the borrower for future insurance payments. • Allow most loans that lenders hold in their portfolio to be classified as qualified mortgages as they pertain to the Consumer Financial Protection Bureau’s ability-to-repay rule. NAHB will continue to work with industry allies and senators to ensure that Congress does not use the g-fees to fund budget gaps, including transportation programs.
