Home Builders Association of Northern Kentucky Says Change Needed at Area Planning Commission By Brian A. Miller, Exec. Vice President HBA

T

he Home Builders Association of Northern Kentucky (HBA) is taking this opportunity to state its position on an effort to alter the Northern Kentucky Area Planning Commission (NKAPC) and to clear up what it believes are misleading statements made in the public regarding the outcomes that may happen as a result of a successful effort to alter the organization. The Board of Directors of the HBA through a unanimous vote has decided to support the dissolution of the NKAPC. By vote the HBA supports countywide planning by the Kenton County Municipal Planning & Zoning Commission, and believes that that organization should employ its own staff who is charged with fulfilling the responsibilities set forth by statute in KRS 100. The NKAPC was originally set up as a “consolidation”…”which provides for a more efficient planning operation” according to KRS 147, the legislation that allows for this type of planning organization. It is notable to point out that NKAPC is the only planning unit of this type in the entire state and as such is the only planning unit capable of levying taxes upon the homeowners and business community in its jurisdiction. Based upon the HBA’s interest and commitment to good planning, the HBA was integral in the formation of NKAPC fifty years ago. The original intent was to service the counties of Boone, Kenton and Campbell, in order to provide for a unified comprehensive plan, zoning regulations, and subdivision regulation across the Tri-County area. This would have allowed for growth to be streamlined in a consolidation of services. At that time Boone County was a more rural county than it is today and decided to not opt in. In the early 1980’s Campbell County spoke through a vote of its residents and seceded from the NKAPC to operate its own planning department. Since then the NKAPC has been operating outside of the spirit of the enabling legislation. Comments have been made publicly by the NKAPC Chairman that what is being attempted will, “turn back the clock to the 1950’s”. The HBA disagrees. The NKAPC has been operating on a fifty year old model that no longer meets the intent of the enabling statute or the needs of the residents of Kenton County. Today’s planning commissions are more responsive, with a higher level of accountability and efficiencies; both in funding and in operations. Good planning requires accountability. Because NKAPC doesn’t rely upon contributions from the County and Cities the organization doesn’t answer to Kenton County residents. A track record of successful small area plans is not the legacy of the NKAPC. Several of their plans have not worked in real world applications. In fact many of their plans 8

contain burdensome mandates and unrealistic components that hinder growth and further suppress the economy. The NKAPC has worked on a total of six such studies in one year alone. This accounts for hundreds of thousands of tax payers dollars that are being wasted by studies that don’t work in the real world and are being funded from city and countywide taxes. At times there are no answers as to who has initiated such studies and we have asked with no response. Specifically, The Hills study that is currently being worked on has no entity that specifically asked for the birth of this study. The current draft of the subdivision regulations that the NKAPC is proposing to roll out is not an update but a complete rewrite costing thousands of dollars. The HBA has reviewed it and found many of the items in that regulation will increase the cost of housing and new industry by thousands of dollars, further stifling growth in Kenton County and placing the cities and the county in further fiscal turmoil. Today’s planning commissions are more accountable and responsible. The NKAPC has a governance structure unlike any other planning commission in the state. Most people may not know that Kenton County already has a Kenton County Municipal Planning & Zoning Commission. That commission is created just like every other commission in the state. The only difference is that they contract with the NKAPC to fulfill their responsibilities to KRS 100, the statute that all other commissions operate under. Recently, the NKAPC Chairman’s public remarks indicated that there would be no comprehensive plan, no staff to update said plan, and no inspections of subdivision streets and sidewalks among other comments. These are the responsibility of the Kenton County Municipal Planning & Zoning

Commission under KRS 100. These services should continue under that organization with full county control. At the NKAPC there is an appointed council that nominates and elects the area planning commission members. This system of appointments and elections has created a scenario where there is not a broad base of citizen and industry representation on their commissions. The Kenton County Municipal Planning & Zoning Commission members are appointed by the cities and the county. As a result they are more accountable to the citizens of those cities and Kenton County. However, because the County Planning Commission contracts with NKAPC to provide for their statutory responsibilities there is a wall that is built between the citizens and the regulations, studies, and mandates handed down by the NKAPC. As a result the NKAPC has become unaccountable and less responsive in their activities. In as much as efficiency is concerned the NKAPC is sorely weak in this area. It is the duty of an area planning commission to “provide(s) for a more efficient planning operation”. The exact opposite is true. For example in handling building permits, what takes other organizations two or three days takes the NKAPC two or three weeks in many cases. Between 2002 and 2010 Kenton County accounted for 5,187 residential building permits. During that same time period Boone County accounted for 10,439; more than double that of Kenton County. Currently the NKAPC has 34 active staff working on planning functions, while the Boone County Planning Commission has 15. That is twice the activity with less than half the staff. Another comparison can be made between the cities of Florence in Boone County and Independence

in Kenton County; Florence being about 25% larger. Florence contributes $314,000 per year and the planning services that Independence would be responsible for under NKAPC are reported by the NKAPC Commissioner to be $480,000. By the NKAPC Chairman’s own admission Edgewood, a city twice the size of Union, could be charged $259,000 for NKAPC services, while Union contributes $68,000 for those same services provided by the Boone County Planning Commission. These sorts of numbers show that the NKAPC is operating in an inefficient manner, spending nearly twice as much for comparable services. Again, growth in residential construction in Kenton County is half that of Boone County, meaning that the NKAPC is providing services at four times the cost when based upon volume of residential work. Since the NKAPC Council approves its own budget there is little oversight that engages the public which has resulted in a $4.79 million NKAPC budget, compared to Boone County Planning Commission’s $1.59 million budget. This has resulted in higher taxes for residents and business owners in Kenton County. In fact,

most cities in Kenton County are built out and require very little planning services, yet the citizens continue to prop up the NKAPC with their tax dollars. This also means higher costs in the way of a multitude of unnecessary studies. Any requested studies should be put out for bid to private firms to keep staffing demands at a minimum. It seems that the magnitude of special studies expands to fill the staff time and funds available. The NKAPC is competing with private industry by paying for the majority of the studies with tax revenues and then expanding their expense by added overhead and staff time. The HBA supports countywide consolidation for planning services under the responsibility of one Kenton County Municipal Planning and Zoning Commission. If efforts are successful to alter the NKAPC, resolution of duties of the NKAPC rests upon the fiscal court in accordance with state statute. The NKAPC has over $2.8 million in the bank which can be used to set up a modern and effective system. There will be the need for the Kenton County Municipal Planning & Zoning Commission to receive funding through

the general funds of the cities and county in addition to fees that planning commissions collect as a result of their approval and review processes. As a result of greater scrutiny by the public and accountability via the voice of the people at city council and fiscal court meetings, the planning services in Kenton County will operate in a more cost efficient and accountable manner. Building inspections should continue under county and/or city control. Currently nearly half of the cities in Kenton County do not use the NKAPC for code enforcement (www.nkonestop.org/OSStable.pdf ). Despite the NKAPC members’ scare tactics the numbers don’t lie. Neither does the obvious need for change at the NKAPC. No matter the outcome of the efforts to alter the NKAPC there needs to be good planning in Kenton County. Good planning is flexible, accountable, responsible and efficient. The NKAPC as it exists today are none of these. Therefore, countywide planning needs to continue under the control of elected officials representing the tax payers of Kenton County.

LEGAL CORNER Returning to Work The Workers’ Compensation Challenges

An injured worker is on the cusp of returning, and the employer makes arrangements for resuming the customary job on Monday. Yet, the worker shows up on Monday with a doctor’s note that limits the amount of lifting, standing or bending the worker can do. These restrictions make it impossible for the worker to resume the customary job. What’s the employer to do? Essentially, the employer has two options: One, the employer can tell the worker to stay off the job. However, such a decision must be reported to the workers’ compensation carrier or third-party administrator. This is because staying off the job due to medical restrictions keeps the employee eligible for a continuation of temporary total disability benefits. Such TTD benefits are mandated as long as the worker is not deemed at “maximum medical improvement” and the restrictions keep the worker from performing the customary and usual job done at the time of injury. Another option is for the employer to offer work that is NOT the customary job but does comport to the physical restrictions. For example, a company might offer desk work to a pest-control worker who can’t move furniture or lift mattresses to spray for bugs. If the employee accepts the desk work, then the company might be exempt from paying temporary total disability benefits. This solution has other advantages as well – the worker is doing a productive service, and the worker stays active and therefore is more prone to eventually return to the customary job. These options, however, trigger a number of ensuing questions and issues: • Is the worker required to accept the less-physical work? – No. The worker always retains the option of taking the less-physical work or refusing it. • Is the employer required to offer the alternate work? -- No. The employer is not required to create a job where none exists. • What if the employee keeps changing doctors who keep issuing work restrictions? – This would trigger suspicions that the employee is, indeed, physically capable of resuming the customary job but wants to stay off work and draw TTD. The one truly legal way to stop this pattern is for the employer to obtain a doctor’s note, record or report that declares the employee at “maximum medical improvement.” These magic MMI words mean that the worker stabilizes so that his medical condition or impairment may reasonably be viewed as permanent. Once a doctor deems the worker at MMI, the eligibility for workers’ comp TTD benefits ceases. • What if the treating doctor will not provide an MMI note? – The employer has the right to schedule the worker for an exam by an independent doctor and ask for an opinion on that issue. The employer also should ask the independent doctor what, if any, physical restrictions the doctor would impose. If the independent doctor imposes no restrictions, then the employer may order the worker to return to the customary job on a specified day. • What if worker refuses to return because his doctor’s restrictions contradict the MMI or return-towork report of the independent doctor? – The employer still may terminate TTD benefits based on the MMI report. If the worker refuses to return, the employer may take action consistent with state and federal law and with the employer’s own policies. The employer should report and discuss any and all of these events to the workers’ comp carrier or third-party administrator. This ensures one or the other does not take contrary action and is fully informed. A coordinated approach often ensures the best outcome for the employee and the employer when it comes time to return to work. ________________________________________________________ R. Sales Team Additions at Wiseway

One of Wiseway’s additions is Mike Quatman for outside electrical sales. Mike has spent most of his career with Murphy Electric Supply and a short time with City Electric before starting at Wiseway. Most of his accounts are in Indiana where he has spent many years calling on those customers and developing strong relationships. We are fortunate to have him on our team. Another new addition to the team is Brian Childs. Brian has worked for companies such as Lebanon Electric, City Electric, and Mesco Electric. Brian’s many years of experience in commercial lighting will be a welcome addition commercial lighting department. He also spent many years in outside sales developing relationships with customers and we are glad to have him on board. Nick Sarakatsannis also joins Wiseway’s electrical outside salesteam. Nick spent many of his years with Graybar Electric and Rexal Electric. He is covering accounts from Franklin Ohio to Northern Kentucky, commercial and residential. His relationships and knowledge will be a great addition to our existing professionalteam. Steve Rizkallah is another addition to the outside sales team. Steve spent many years with Wesco Electric and Edison Electric. He brings to Wiseway many of his relationships in the Dayton area. Welook forward to him growing the electrical business in the Dayton area. An addition to our inside electrical sales is Tony Faulkner. Tony actually rejoins Wiseway after he left a few years ago and pursued a career with City Electric. You might say the cards were stacked in our favor and we were fortunate to get him back on our team. Lastly, Terry Rosenbalm joins Wiseway as a plumbing outside salesperson. Coming to us from Winnelson, he brings many of his relationships with customers in the Dayton area. We look forward to servicing these new customers and we are glad to have him as part of our team. All of these additions to our growing professional sales team addseven more ability to service our customer. Registered Remodeler Roundtable: A roundtable for Registered Remodelers was held on June 9 at our HBA office. Remodelers from Northern Kentucky, Greater Cincinnati and Lexington HBAs were in attendance. The roundtable went very smoothly with most, if not all of the attendees participating in the conversation at some point. Some of the topics discussed were: Codes & Inspections, EPA, Promotions, HBA Services and the Remodeling Market The agenda was informal, so attendees were able to share issues, successes and general information with other Registered Remodelers.
