National Home Ownership Month in June

A Reason to Celebrate Locally By Brian A. Miller, Executive Vice President

P

eople who live in our area are much more likely than the average American to own their own homes and the local market is in much better shape to make that dream a reality. Home ownership here stands at nearly 70 percent, compared to 66.4 percent nationwide. Although Northern Kentucky has traditionally been a single family home market rather than a renter’s market, the area’s high homeownership rate can be attributed to the large stock of affordable housing available. During the past four years, over 5,000 new homes have been built in the Tri-County area of Boone, Kenton and Campbell Counties alone, and a significant number of those homes have been in the low to mid-$100,000 range. The availability of more starter homes combined with the continuation of historically lower interest rates means more people have the financial opportunity to own. While there are threats looming in Washington D.C. to eliminate the mortgage interest deduction and alter the rules

for a home purchase to require a 20 percent down payment, but for today many options still exist for homebuyers with good credit to own a home. While housing production is much suppressed at this time, the current housing production conditions will not last forever and in fact we are beginning to see some changes locally. For the last half of 2010, according to the Federal Housing Finance Agency, the housing price index for the Cincinnati/Northern Kentucky Metropolitan Statistical Area (MSA) rose .91 percent. While that increase seems meager it far exceeds the national statistic of -7.32 percent. Additionally, with all other housing indicators showing Northern Kentucky fairing far better to our neighbors in the Ohio portion of our MSA, our home price appreciation should stand better than that .91 percent. In fact, there has not been an increase in our entire MSA home prices since the 3rd quarter of 2007. Another bright spot when you compare Northern Kentucky to other markets and the country is the state of foreclosures locally. In our

Tri-County area there is a ratio of 1 home in some state of foreclosure or bank ownership for every 886 homes. Compare that ratio to Ohio’s side of the MSA standing at 1 in every 518, Louisville at 1 in every 471, and Columbus Ohio at 1 in every 639 and we stand better regionally. If you look at distressed markets the picture for Northern Kentucky looks even better. The ratio in Orlando Florida is 1 in every 113, Flint Michigan is 1 in every 110 and Las Vegas is 1 in every 39 homes that are in some state of foreclosure or bank ownership. It also stands that the competition for foreclosures against homes for sale in our area is far less. So when will the great recession end? Time will tell, but we can all be thankful that we are in Northern Kentucky, a market that is far better poised for recovery and a much more favorable market for home ownership. WHAT’S THIS? hip Meeting at World of Golf

T

he General Membership Meeting at the World of Golf was a hole-in-one! Mark Krebs, former UK Basketball player, related his journey to the University of Kentucky, playing basketball under three enormously different coaches and the inspiration his mother played in his career. Mark signed copies of his book “Beyond a Dream� and raffled off copies of the book. The lucky winners were David Stephens, Heritage Bank and Adam Chaney, Terrace Holdings.

LEGAL CORNER Read the Contract

T

wo recent cases I encountered highlight the importance of reading contracts and agreements that you sign. This seems obvious, however, both my law practice and personal experience have taught me that many people simply do not read what they sign. The source of this failure appears to be (often unearned) trust in the good faith of the other party, a general dread of examining pages of “legalese,” or both. It can be easy just to flip through the document and sign, trusting that the bargain you struck with the other party has been accurately and faithfully put in writing. Yet, frequently, whether by honest mistake or more nefarious reasons, the written contract contains unfavorable, surprising terms. The problem with this rather lackadaisical approach is that the settled law in Kentucky states that one who signs a contract is presumed to know its contents, and that if he has an opportunity to read the contract which he signs he is bound by its provisions, unless he is misled as to the nature of the writing which he signs or his signature has been obtained by fraud. Clark v. Brewer, 329 S.W.2d 384 (Ky. 1959). Importantly, you should not rely on the exception for fraud, as it is difficult (and expensive) to effectively invoke and prove. The consequences of this rule can be grave. In a recent real estate development matter, I uncovered substantial problems in the legal documents that would have harmed my client’s interest (and the interests of a number of other investors). Astonishingly, despite involving sizable amounts of money, I found that a number of the other parties had not read the documents even though they had already executed them. In the end, those parties had the fortune of benefiting from my client’s diligence in uncovering the problematic terms, but they otherwise would have been bound to what they signed. The other case I recently encountered was just decided by the Kentucky Supreme Court. In that case, the plaintiff alleged that the defendant car dealer intentionally misrepresented the repair history of the vehicle it sold her. The judge dismissed plaintiff ’s suit from court and ordered her to arbitration as a result of a term of the purchase agreement. Arbitration in that instance was likely a much more favorable forum for the dealer than the plaintiff, and she lost her right to present her case to a jury and to appeal. Plaintiff attempted to argue that the dealer did not tell her of the arbitration clause, but the court plainly rejected that argument stating that she should have read the agreement. We live in a busy society where time often equates to money. As well, no one enjoys sorting through page after page of oft-confusing contract language. The construction industry is certainly no exception. The consequences of failing to read documents before signing, however, can be much worse. For those reasons, I recommend that you treat the burdensome task of carefully reading legal documents as simply a cost of doing business. REMODELER’S COUNCIL WHAT’S HAPPENING??

Remodeling Market Index: According to the NAHB’s Remodeling Market Index (RMI), the remodeling market is heading into recovery with an increase to 46.5 in the first quarter of 2011 from 41.5 in the fourth quarter of 2010. This marks the highest level for the RMI since the fourth quarter of 2006.

Tour of Remodeled Homes: The Tour of Remodeled Homes is scheduled for October 1 and 2. The Early Bird deadline for the TORH is June 27 and the final deadline is August 5. All Registered Remodelers should have received entry forms. We have three entries confirmed. Two in Ft. Thomas and one in Crestview Hills. Please contact Karen Lefebvre at the HBA office when you know where your entries are located so we can keep an updated list. If you have any questions about the TORH, please call the HBA office 859-331-9500.

Lunch Sponsorships: We still have opportunities to sponsor a Remodelers Council lunch meeting from July through December. The meetings are scheduled on the first Thursday of each month. If you are interested in sponsoring one of the meetings, contact Karen Lefebvre at the HBA office.

Registered Remodeler Roundtable: Since the Membership Roundtable was such a success at the Lexington HBA, we will be hosting the Remodeler’s Roundtable on Thursday, June 9th from 10:00 am – 2:00 pm. We are looking at dates in June that will be convenient for all associations; however a definite date
