HBA Rules For followers of the TV series, NCIS (Naval Criminal Investigative Service), you know the main character, Leroy Jethro Gibbs, has a list on how to conduct yourself as an agent for the service. Just like in any profession there are certain rules, or standards, in which you should conduct business. Just for fun, perhaps not, we have taken the liberty to alter Gibbs’ rules to reflect our industry. For those that know the show you will notice some of the rules are not known (as of yet perhaps) and some of them overlap chronologically. Some were perfect and are unchanged. Never let buyers stay together. Never screw over your subcontractor. Always wear steel toe boots on the work site. Don’t believe what you’re told. Double check. Never be unreachable, as if smart phones allow you to be unreachable. The best way to keep a sale? Keep it to yourself. Second best? Tell one other person - if you must. There is no third best. You don’t waste materials. Never say you’re sorry. Refer to the contract. Always be specific when you make a promise to a customer. Never take anything for granted. Never assume. Never go anywhere without a contract. Never get personally involved with a buyer. When the job is done, service callbacks and warranty calls. Never date a co-worker, unless they are your spouse. Avoid legal issues by using the HBA contract and warranty. Bend the conduit, do not ever break it Always work as a team. If someone thinks they have the upper hand, refer to the contract. It’s better to document everything than fly by the seat of your pants. Always look under, over and around to avoid worksite injuries. Never, ever bother a builder in negotiations or a contract meeting. Never mess with a subcontractor’s coffee... if you want to live. There are two ways to sell someone. First way, they never notice you. Second way, they only notice you.

Rule #35: Always talk to the model traffic. Rule #36: If you feel like you are being played, you probably are. Rule #38: Your customer, your responsibility. Rule #39: There is no such thing as coincidence. Rule #39a: There is no such thing as a small world. Rule #40: If it seems someone is out to get you, they are. Rule #42: Never accept an apology from someone who just sucker punched you. Rule #44: First things first, hide and secure the metal and tools on the jobsite. Rule #45: Clean up the mess that you make. Rule #51: Sometimes - you’re wrong. Rule #62: Always give people space when they’re leaving the jobsite. Rule #69: Never trust a worker who doesn’t trust their boss.


MEMBERSHIP Meet the HBA Staff - Shawn Cox

D

irector of Professional Development, Shawn Cox, has a lot on his plate since returning to the HBA, he has been working to continue the development of the Enzweiler program. It is the trade school offering classes in carpentry, plumbing, electric, welding and maintenance. The school has been very successful in graduating future workforce members into the Northern Kentucky community. Shawn’s “real job” was with the HBA in 1995 as Director of Government Affairs. This was after graduating from NKU with his BS in Public Administration with minors in Journalism and Management. Upon leaving the HBA he worked for one of the HBA members and later with the Boone County Fiscal Court. Before returning to the HBA, Shawn was the training and development coordinator for Waste Management out of Houston, Texas. When Shawn isn’t visiting area schools and career days during the school year, he can be found overseeing the evening trade school, preparing for continuing education classes, working on expanding the Enzweiler program with other HBA’s and with local high schools and other assignments. Shawn enjoys spending time with his daughter, Kaitlyn. When the two of them are at home they take care of his pets - 2 turtles (Bear and Ojo) and a fish (Sushi). All named by Kaitlyn. He says, “(They are) More like furniture you have to feed but since you do have to feed them guess they count as pets.” An avid sports and fitness enthusiast, Shawn focus is on Mountain Biking and Road Cycling. Notable “Cycling Road Rides” include having completed 2 Ride Cincinnati events in support of Breast Cancer Research (63 miles each), a Ride to Lexington from Northern Kentucky (77 miles) and a “Century Ride” (101 miles). When not biking, he enjoys boating, riding his motorcycle and of course time with Kaitlyn. Shawn was asked what he considered a special occasion in his life. He replied, “It’s hard to beat the birth of my daughter but I will say that the chance to come back “home” to the HBA has been a great experience. I am excited to see how much we can grow our education and trades training programs. HBA EVENTS HOMEFEST

HOMEFEST at Manhattan Harbour a Unique Success!

S

unday, October 18th wrapped up HOMEFEST at Manhattan Harbour in Dayton, Kentucky. The 14 day show produced five spectacular riverfront homes. This single site consumer show brought attention to Dayton and Manhattan Harbour. Manhattan Harbour’s developer Dave Imboden of DCI Properties had a vision many years ago to create a unique, upscale riverfront community. He worked many years to raise the site elevation. His careful planning and energetic forward thinking will leave a positive footprint on Dayton, Kentucky and the Ohio River. The five homes in the show were built by two HBA Registered Builders. Brent Walker a recently new member to our association constructed the first home. Jim Cutter managed the remaining four homes. Each of the five houses were different and unique. From floorplans to interior themes show attendees had a wide variety of products to view. HOMEFEST Manhattan Harbour was a unique single site show for HBA. One of the most challenging being that the show was open to the public not only for three weekends but also four out of five weekdays. Besides the lengthy days there were also specialty days such as Ladies Night, Family Day, Taste of NKY, live art demonstrations, Arteflame grill cooking, local cover band performances and food trucks. HOMEFEST Manhattan Harbour was presented by Florida Tile. HBA is appreciative of the generosity and support Florida Tile put into the show. Each of the five homes displayed their tile and other products. Florida Tile worked closely with the builders and played a key role in this project coming together.

Before thanking the awesome sponsors and partners of HOMEFEST it is important to give recognition to your HBA staff. The entire staff worked tireless hours during the 14 day show. This meant giving up week nights and weekends with their families and friends. All seven employees did so to assure the show was produced to the standards of the association. How Can Involvement with HBANKY Make a Difference For You? By Stacy Smith Rogers

WARNING: Reading this article may cause you to re-think how you spend your time. It might even prompt you to register for an event, sponsor a meeting or even volunteer for a committee!

W

e’ve all been there ... tight schedules, kids’ activities, overwhelming workloads. Life in 2015 is fastpaced! On most days, many of us feel like we are spread too thin. We often weigh the costs of making time for non-essential activities with how much time will it take away, how much money it will cost or how much fun we’ll have. Deciding where and how to invest time, money and effort is tough. So when an upcoming meeting or event hosted by HBANKY vies for space in your calendar, it can be easy enough to wave it off with the argument “there’s simply no time or room in the budget.” However, there’s one question that might prompt you to think otherwise – Can you afford NOT to go, do or support? When it comes to business, lost opportunity costs can often dwarf the initial time and money management excuses for not participating. Just one contact made at a meeting or event can make all the difference.

You can’t simply go to one meeting, give your card away to a builder and expect something in return immediately. By staying involved and going to the events you’ll surround yourself with all the people who play a role in helping that builder be successful.” – Diana DeVore

For members who have been around the HBA block a time or two, it’s hard for them to imagine a successful career without having been active in the association. Diana DeVore, Guardian Savings Bank, has been involved in the association since the early 1980s, but it was in 1988 that she decided to focus time and effort on being an active member. She has served on practically every committee there is and is still going strong. She is the selfproclaimed “ticket seller” for nearly every event that sells raffles or chances to raise money for the association and its important causes, most specifically scholarships for its apprenticeship program. DeVore emphasized the value of being involved and considering every member a potential client. “You can’t simply go to one meeting, give your card away to a builder and expect something in return immediately. By staying involved and going to as many events as you can, you’ll surround yourself with the people who play a role in helping that builder be successful. You potential client isn’t just the builder, but everyone involved in the building process,” she said. DeVore also elaborated on how newcomers can take advantage of opportunities to be connected with key contacts. “If I know someone is new, I’ll offer to introduce them to people at meetings and such. I’m a little seasoned and I know a lot of folks. What I’ve

learned is that you have to commit the time and effort to get to know people.” She also stressed the opportunity that being present and involved affords members. “Staying active gives you a voice. If you don’t take the opportunity to express your opinion, you can’t complain about it later,” she added.

For most people a minimal level of involvement is enough. But for those who want to take it to the next step, they’ll begin to see the benefits.” Jones has been an active member since 1991. Since then, he’s expanded his involvement to the state and national levels and is among one of few associate members across the country to achieve the Life Director status. “By being involved, it keeps you on the 06/2015

BUILDING A SOLID FUTURE FOR NEW MASONRY CLASS

I

n an ongoing series Builder Magazine will be featuring one of our talented and dedicated faculty members / trades people who make the Enzweiler Building Institute the great program that it is. This month’s featured instructor is Mr. Bill Wilson – Masonry. When looking for a new masonry instructor last fall Shawn Cox, Director of Professional Development, turned to the masonry industry to try and find just the right person to lead this effort. One name kept popping up, Mr. Bill Wilson. Jo Ellen Thompson from Star Building Materials and a staunch supporter of the new program knew this was the right person for the job and was a big help to us getting him to sign on. There is now no doubt why Bill is now “The Man” in masonry. Bill started his career in masonry in the late 50’s as a hod carrier and laborer. Taking a break from the industry Mr. Wilson or rather Lieutenant Wilson as he became known, served with distinction in the United States Navy in the South Pacific. Bill’s role was critical during the cold war. Among many things one of his most notable is that he worked on and flew in the P-3 Orion performing submarine detection duties. Upon his retirement in the early 70’s Bill returned to the trade he loves and has never looked back. When asked why he wants to teach the next generation of masons, Bill a humble but honest man simply said “I want to make sure they know how to do it RIGHT”. He added, “in recent years I’ve seen the quality work in masonry slip and we need good hard working people in our trade to stop that slide and perform work and build a career they can be proud of.” Thank you Bill for both your service to our country, and our industry we quite simply could not have this program and the growth it experienced in only one year (from 2 students the first year to a record 13 this year) without you.

Who’s in charge here? Expanded Joint-Employer Definition Will Harm Housing Affordability, Small Businesses

A

recent ruling by the National Labor Relations Board (NLRB) to expand its joint employer standard will hurt housing affordability and small businesses, a prominent Texas home builder told Congress today. Testifying before the Senate Committee on Health, Education, Labor, and Pensions, Ed Martin, president and CEO of Tilson Home Corp. and a past president of the Texas Association of Builders, called the new joint employer standard “alarming.” “Businesses could be found to be joint employers of another company’s workers by merely setting the work schedule of their subcontractors or requesting additional subcontractors to complete a job that is running behind schedule,” said Martin. “There is no certainty or predictability regarding the identity of the employer under this new standard. It is fundamentally unrealistic.” On Aug. 27, the NLRB overturned decades of precedence in the case of Browning-Ferris Industries of California Inc. by dramatically expanding the traditional test for joint employer status in which a company must exercise “direct and immediate control” over an employment relationship. Under the new joint employer standard adopted by the NLRB, a company could be considered a joint employer if it has indirect control or the potential to exercise control of a subcontractor’s employee’s employment, including hiring and firing, discipline, supervision, scheduling, and assigning work and determining the means and method of employment. The new test leaves employers guessing over how much indirect control they must have over another employer’s workers to be considered a joint employer. This is especially problematic for home building firms, which rely on an average of 22 subcontractors to build a typical single-family home.

“We question whether the simple act of choosing a project’s completion date would trigger a finding of joint employment,” said Martin. “For example, if Tilson Homes contracted with a painting company for a home in Austin, would we be prevented from telling the subcontractors when to paint the walls or even when the walls would be constructed? Would we be prevented from scheduling installation of the fire sprinklers or cabinets? Would the roof be completed in time for the codes inspector to visit?” At a time when many of the nation’s housing markets are beginning to see widespread consistent, sustainable growth, Martin warned lawmakers that the NLRB’s joint employer ruling will harm housing affordability and the ongoing housing recovery. “This ill-advised decision will needlessly drive up the cost of housing and could force many small builders out of business by making it too costly to use the independent subcontractors they need to keep their businesses viable,” he said. Noting that the home building industry is highly decentralized, with a majority of firms consisting of less than 10 employees and building less than 10 homes per year, Martin added that the NLRB ruling will lead to a centralization of the industry, with less competition among small firms and higher house prices. “Decentralization of the market is better for the housing recovery because more competition among small firms will yield more affordable housing options for consumers,” he said. “If left unchecked, the Browning-Ferris decision will be damaging to the marketplace and housing affordability,” Martin added. “For these reasons, I strongly encourage Congress to restore the traditional definition of joint employment and ensure a level playing field for all businesses.”


Ralph E. Dusing Receives Distinguished Alumnus Award

R

alph E. Dusing received the 2015 College of Engineering and Applied Science Engineering Technology Distinguished Alumnus Award in recognition for his lifetime of achievement and contribution to the industry. Ralph Dusing is the president of Bluegrass Commercial Group LLC and brings over 39 years of experience in the commercial construction project management industry. He served as the Chairman of the Construction Committee for Habitat for Humanity from 1990-1998, and has served on the CEAS Alumni Board since 2011. Ralph Dusing received an associate’s degree in physics from Thomas More College in 1972, a second associate’s degree in civil engineering technology from CEAS in 1974, and a BS in construction management in 1978. Ralph Dusing received the Engineering Technology Distinguished Alumnus Award on October 9, 2015 at the Griffin Elite Sports & Wellness Complex.
