M
ost employers are aware of the multiple difficulties that social networking poses throughout the work day. Facebook, MySpace, web logs, Twitter and LinkedIn occupy a significant percentage of an employee’s workday according to recent statistics. Clearly, employers are entitled to take disciplinary action if employees violate an existing social network policy of the employer while working. However, a more significant issue arises when discussing the extent to which employers can regulate employees’ activities during non-working hours. Plainly and simply, all employers should have Internet and social networking policies in place. It is only through such policies that employees are aware that there is no expectation of privacy in e-mails and that use of the Internet for inappropriate purposes such as pornography and harassment will not be tolerated. Employees can be advised that they are not to identify themselves on social networking sites as an employee of such employer or criticize any employee of the company. The policy should also indicate that the employer has an expectation of employee loyalty and that any comments on social media sites violating the policy may result in disciplinary action up to and including discharge. Case law and the employment at-will doctrine generally favor the employer but off-duty use of social networking sites is, as yet uncharted territory even for non-union employers. Generally, the courts balance the employee’s privacy interest with the employer’s interest in regulating the employee’s conduct. The court will look to the employee’s conduct in light of the employer’s policies in place and the employer’s interests which are at risk. A recent case filed by the National Labor Relations Board raises further concern for employers. In that case, an ambulance company fired
an employee because she had criticized her supervisor on Facebook. The union employer had a policy which prohibited employees from disparaging co-employees. The NLRB asserted that the termination was wrongful because the employee had been engaged in “concerted activity” with her co-workers. A recognized concern for all employers is that statements by employees concerning their “terms and conditions of employment” is protected by the National Labor Relations Act as concerted activity even for non-union employers. In this case, the NLRB took the position that the policy was overbroad and that it limited an employee’s right to discuss working conditions with one another even though derogatory statements were made about the company. Unfortunately, the case was resolved before any final court decision. In light of the pro-union nature of the existing NLRB Board, we anticipate that further decisions on this matter will be forthcoming. Additionally, we anticipate that employees will challenge an employer’s ability to discipline the employee for Facebook entries during non-working hours. It is critical that employers have policies in place and consistently enforce such policies. If an issue arises with an employee concerning off duty Facebook or social media entries, it is advised that you contact legal counsel to consider your options. As long as the proliferation of social media posts continue, the issues facing employers will become more pressing. CO DETECTORS REQUIRED IN KY RESIDENTIAL CODE
T
he Board of Housing Buildings and Construction has recently passed a code change to the Kentucky Residential Building Code that requires the installation of carbon monoxide (CO) detectors in all new homes. The regulation requiring CO detectors was passed late last year and was finalized through the process in early March. The detectors must be installed in new homes permitted after June 1. The new code requirement calls for carbon monoxide detectors to be installed in new homes with fuel-fired heating and cooling systems or appliances, or attached garages. The detectors must be installed near every bedroom and in a common living area in a home. They must be installed according to manufacturer’s instructions. Unlike smoke detectors, the CO detectors do not have to be hardwired into the electrical system. Builders also have the option of installing dual smoke and carbon monoxide detectors. The mandate also affects existing homes only in that in any remodeling project that requires a permit, the building code official must inform the homeowner that carbon monoxide detectors are required by the code. The remodeler has no responsibility to inform the homeowner of the new code.
THOMAS NAPIER JOINS HBA STAFF AS DIRECTOR OF PROFESSIONAL DEVELOPMENT
T
homas Napier was born on an American Military base in Frankfurt Germany in 1971. His mother is a German citizen and his father was an American Soldier stationed there. Mr. Napier moved to the United States in 1976 with his grandparents Robert and Julia and lived on the west side of Cincinnati. Mr. Napier attended Oak Hills schools until his graduation and then attended the University of Cincinnati. Mr. Napier graduated with honors in Chemistry and Education. He immediately began teaching in Cincinnati Public Schools as a Middle School Science and Math Teacher. During his 5th years teaching, Mr. Napier was nominated for Ashland Oil’s Teacher of the Year and the National Science Teacher of the Year. In subsequent years, Mr. Napier was tapped to be a curriculum designer by Cincinnati Public Schools and later joined the Curriculum Development team. His ability to create and implement quality curriculum was noticed quickly and he was promoted to a leadership position. During this time Mr. Napier attended Xavier University doing coursework on Special Education students and students with unique disabilities. Over the last several years Mr. Napier was honored with a PhD from Miami and New York University in Sociology of Education for his work with outreach to underprivileged and disenfranchised students and historically underrepresented groups in education. Recently, Mr. Napier has joined the Home Builders Association of Northern Kentucky as the Director of Professional Development. Northern Kentucky BUILDER

Marketing: If you haven’t picked up your Registered Remodeler decals, they are available from the HBA office at no charge. Be sure to use decals on your vehicles so consumers know where Registered Remodelers are working in their neighborhoods..
Tour of Remodeled Homes: The 2011 Tour of Remodeled Homes will be here before you know it! The Tour is scheduled for October 1st and 2nd. If you have an entry for the TORH, please let Karen LeFefvre at the HBA office know the location of the project and what the project is (i.e. kitchen, basement, addition, whole house). As soon as we get this information, we will start sending out bi-monthly updates so you can see where the TORH projects are located.
Lunch Sponsorships: We have opportunities to sponsor a Remodelers Council lunch meeting from June through December. The meetings are scheduled on the first Thursday of each month. If you are interested in sponsoring one of the meetings, contact Karen LeFefvre at the HBA office..
Community Service: Thanks to over 30 volunteers who donated their time to frame a 2-story house in Ludlow for H.O.N.K. on April 9 and Quote of the Day 10.
