How the Fed Rate Hike Affects Housing As interest rates rise, GDP growth slow for 2019. Housing affordability last quarter was at a 10-year low, and it appears that conditions at the start of 2019 aren’t likely to improve much. The Federal Open Market Committee recently raised its target for the federal funds rate (the interest rate at which banks lend money to each other) by 25 basis points. This was the fourth rate hike of 2018. However, experts predict

interest rates will rise at a less aggressive pace next year. NAHB Chief Economist Robert Dietz noted in a recent Eye on Housing blog post that the Fed’s “policy projections suggest two rate increases in 2019 and one additional rate increase in 2020.” Nevertheless, NAHB is forecasting no rate hikes in 2020, after what some, including Dietz, anticipate will be a noticeable slowdown in

EPA Proposes New WOTUS Definition The Trump administration in December released its proposed new definition for “waters of the United States” (WOTUS) that will resolve years of uncertainty over where federal jurisdiction begins and ends. This represents an important victory for NAHB members. Under the proposed rule, shortlived ponds, streams and tributaries that only flow in response to a rain event

would be excluded from federal regulation. The rule would also exclude wetlands not directly connected to federally- regulated bodies of water. The action honored a campaign promise made to the NAHB Board of Directors in 2016. The new rule announced today will be open to a public comment period for 60 days and it is expected to be finalized and instituted in all 50 states by the fall of 2019.

GDP growth in 2019. Mortgage interest rates, however, are likely to stay the course for the time being, after a decline in December. The 10-year Treasury rate, which is the key variable for mortgage interest rates, declined recently to below 2.77%. A lower 10year rate typically means lower mortgage interest rates.

Whitmer Sworn In As Governor Governor Whitmer was officially sworn in as Michigan’s 49th Governor of the State of Michigan, and the second female to hold that office. An estimated 1200 to 1400 braved the winter weather to watch her, Dana Nessel (D-Attorney General), Jocelyn Benson (D-Secretary of State), and Beth Clement (Supreme Court) take the oath of office.

The HBA of Michigan government relations team will be reaching out to build relationships with those newly elected.

FHA: Home Warranty Rule

The Federal Housing Administration (FHA) on Dec. 14 published a final rule that streamlines the home warranty requirements for FHA single-family mortgage insurance. The rule eliminates the regulations that require borrowers to purchase 10-year protection plans in order to qualify for certain mortgages on newlyconstructed single-family homes. This final rule becomes effective March 14, 2019.

Housing Forecast Calls for Modest Growth Michigan’s critical housing industry is lagging behind general economic growth The Home Builders Association of Michigan (HBAM) announced today that they expect singlefamily new home construction to rise by just 3 percent in the coming year. For calendar year 2019, HBAM’s econometric model estimates that 17,552 new single-family home permits will be issued across Michigan. The state’s largest construction industry trade association also noted that

2018 production levels should reach 16,999 new single-family homes by year end— the highest level since 2006. The modest 3 per cent growth forecast reflects national economists’ projections for a likely slowdown of North American Vehicle Production and an expected increase in oil prices, both critical factors in the HBAM econometric model. Though not explicitly part of

the HBAM model, shortages in the number of available construction workers contributes to the likelihood that single family home construction will be able to rise above forecasted levels. Click here for full press release.

Blood Lead Levels for Workers Michigan becomes first state to lower acceptable levels.

According to the Michigan Occupational Safety and Health Administration (MIOSHA), an important step toward keeping Michigan workers safe from lead exposure in the workplace was realized with the filing of updated administrative rules that lower acceptable blood lead levels, replacing decadesold standards. The new rules became effective December 11, 2018. The work environment can be the greatest source of lead exposure for adults; a few examples of work activities that may result in exposure to lead: »» abrasive blasting of bridges, overpasses or water towers »» manufacturing or refurbishing batteries »» demolition or remodeling activities »» working in gun ranges The diagnosis and treatment of lead exposure is based on the blood lead level (BLL). measured in micrograms of lead per deciliter of blood (μg/ dL). Former MIOSHA rules allowed workers to have BLLs of 50 - 60 µg/dL before they had to be removed from lead

exposure. Under the former rules, they could return to work when their BLL was below 40 µg/dL. The new MIOSHA rules require that employees be removed from lead exposure when their BLL reaches 30 µg/ dL and may not return to work involving lead exposure until their BLL is below 15 µg/dL. The average BLL in the general population is 1.12 µg/dL. Existing federal OSHA standards for lead – as well as the previous MIOSHA standards for lead - are based on scientific information that is more than 35 years old. Federal OSHA plans to issue an Advanced Notice of Proposed Rulemaking on BLLs for Medical Removal in 2019 and other state OSHA plans like Michigan are currently in the process of updating their rules. A public hearing on the proposed rule revisions was held on August 3, 2018. “We can say with pride that Michigan now leads the nation in protecting workers from harmful lead exposure on the job by being the first state in the nation to update its standards to dramatically

reduce allowable blood lead levels,” said MOEMA President Dr. Michael Berneking. “We hope that other states and the federal government will look to Michigan as an example and work toward making changes in the lead standard in their jurisdictions to safeguard the working populations”. The revised rules were filed with Michigan’s Office of the Great Seal on December 11, 2018, with an immediate effective date. MIOSHA’s enforcement divisions are implementing a 60-day temporary stay on the enforcement of new blood lead levels in order to allow employers time to ensure compliance with the new requirements. Most Americans See Affordability Crisis Nearly three out of four American households believe that the nation is suffering a housing affordability crisis, and a majority of respondents reported this is a problem at all levels, according to a recent nationwide survey. The poll cuts across partisan, regional,

demographic and socioeconomic lines. Among its key findings: 73% of respondents believe that a lack of affordable housing is a problem 68% believe this is an issue in their state, and 54% cite housing affordability as a concern in their neighborhood. 58% said that if they decided to purchase a home in the near

future, they would have trouble finding a home they could afford in their city or county. Nearly a third of America’s 119 million house- holds are cost burdened and pay more than 30% of their income for housing, based on NAHB analysis of 2017 Census data.

Key Forestry Provisions in Farm Bill Congress on Dec. 12 passed the 2018 farm bill that includes key NAHB-supported forestry provisions from Rep. Bruce Westerman’s (R-Ark.) forestry bill to implement critical forest management reforms that will help improve the health of the nation’s forest system and reduce America’s reliance on

foreign sources of timber. The bill would also increase funding for the Collaborative Forest Landscape Restoration Program to empower rural communities to restore effective forest management and improve forest health. It also contains several provisions in the Timber Innovation

Act that will support the development of timber products for building construction. NAHB fought hard to ensure the farm bill contains a forestry title in order to increase the supply of domestically produced timber from federal lands.

NAHB Recognized for Lobbying Clout “The Hill,” a prominent Capitol Hill publication, recently named NAHB CEO Jerry Howard to its list of elite Washington power players. Although “The Hill” highlighted one person from each organization listed, Howard noted that his inclusion represents the hard work of many individuals. “The fact that NAHB is recognized as one of the most powerful trade groups is a testament to the shared efforts of our members; the NAHB staff, most notably Chief Lobbyist Jim Tobin and his government affairs team; EOs; councils and all those who work on behalf of the association to keep housing at the forefront of the national agenda,” Howard said.

Meeting of Members Make plans to attend NAHB’s annual Meeting of the Members, 8:00 a.m. on Wednesday, Feb. 20, at the Westgate Hotel in Las Vegas during the International Builders’ Show. This meeting provides NAHB members an insider’s view of the association’s advocacy priorities and gives them a voice in setting those priorities. Attendees also learn about how to take advantage of NAHB’s many membership benefits and have the opportunity to network with other professionals in the housing industry. Supreme Court to Hear Agency Deference Case The U.S. Supreme Court on Dec. 10 agreed to hear a case that has widespread implications for how courts handle challenges to federal agency regulations. The case, Kisor v. Wilkie, addresses the issue of whether courts should defer to an agency’s interpretation of its own regulations, known also as Auer deference.

NAHB supported the petitioner with an amicus brief as part of a proactive strategy developed to identify cases that put this issue squarely before the Supreme Court. NAHB has long been concerned with this type of judicial deference because it can create incentives for agencies to avoid formal rulemaking processes or create vague regulations

that they can later interpret however they see fit. Either tactic prevents home builders and other industries from participating in developing rules that govern their activities.

2018: A Very Good Year for Industry Pros As we say goodbye to 2018, let’s celebrate NAHB’s many achievements in the past year. We can’t list them all, but these are some of the most important. HBA and member efforts to

grow NAHB paid off with the addition of 2,000 new members nationwide, the best net improvement in more than a decade. Thank you!

As if home building wasn’t

already challenging, builders have been struggling with a labor shortage. A $50 million grant from the Home Depot Foundation to HBI will enable it to train 20,000 new skilled workers over the next 10 years.

Part of building a home

is making sure it meets all applicable building codes. NAHB works hard to ensure those codes are reasonable and fair. In 2018, we asked members to participate in a new campaign called “One and Done.”

Portal goes online. NAHB’s new

housing portal is a website that delivers a wide range of housing and polling data specific to congressional districts and major metropolitan areas. This tool enables builders to demonstrate the importance of the local industry to policy makers.

Yes, we worked closely with the

Trump administration to push for regulatory reforms. We saw tangible progress on many issues like labor rules, environmental regulations, housing finance requirements and more.

Negotiate Now! was just one

of the messages we sent to the administration regarding lumber prices. There have been no negotiations with Canada to date, but our multidimensional efforts have been effective. Lumber prices are down more than 40% from the peak in June. Bravo.

Effective (actually superb)

advocacy is one of NAHB’s many strengths. Washington’s influential insider magazine, The Hill, acknowledged that prowess by naming CEO Jerry Howard to its annual list of DC’s top lobbyists.

WOTUS: Permanently replacing

the Obama administration’s overreaching definition of Waters of the U.S. (WOTUS) is well on its way to becoming a reality thanks to NAHB’s relentless regulatory reform effort. This is a big win for our agenda.

Supreme Court (unanimously!) in response to a member challenge supported by NAHB. There’s no need to set aside habitat for a frog that isn’t there. What will the bureaucrats do next, look for the Yeti?

Eighty-five percent of the 245

House and Senate candidates NAHB endorsed in the midterm election won their races thanks to NAHB’s efforts to ensure that housing’s voice is heard in Congress. Endorsements were based on HBA input. In an unusual election year, this was a big win.

Advantage is the name of the

game with NAHB’s Member Advantage affinity programs. We added several in 2018: Nissan/ Infiniti, Amazon Business, Capital One Spark Business credit card and Kabbage small business loans. Member savings – what a concept.

Reform of the nation’s tax code

in 2017 provided real benefits for members. NAHB worked with the IRS in 2018 to ensure that subsequent regulations support builders, consumers and small businesses. Case in point: At NAHB’s request, the IRS looked at HELOCS and determined they are deductible for home improvements.

Meet Your Professional Women in Building Council

The Professional Women in Building Council at HBA Saginaw was Sue Bailey’s idea. A little over 40 years ago in 1978, Tom Bailey started Bailey Construction. Sue was working at Saginaw General Hospital and holding down the fort in their own family while Tom grew the business. As business bloomed, Sue began getting more involved with helping Tom run things, until several years later when she made the decision to leave the hospital and work with Tom at Bailey Construction full time. Tom and Sue joined the HBA of Saginaw right away because of the good insurance rates. Though being busy prevented them for really digging in to all the wonderful benefits HBAS had to offer, once they were in, they were hooked. Attending general membership meetings

led to joining committees, which led Tom to sitting on the Board of Directors.

When Sue and Tom went to the International Builders Show, Sue noticed an area designated “Women’s Council” (now Professional Women in Building). Without hesitation, she walked in and asked what it was all about. Sue met women from was surprised to meet leaders, past presidents, and board members from Detroit, Jackson, and Mt. Pleasant. Sue was so impressed with the women she met there that she started the journey to create a Women’s Council at the HBA of Saginaw. Once the council was created, there was no stopping her from sharing and building wonderful opportunities for other women in the building industry.

Sue’s family is involved with the HBA, too. Their daughter Linda has her own design company, and along with Linda’s husband Rob, now own Bailey Construction. Tom and Sue’s son Jeff works at MBS International Airport, and he and his wife Shari own Hundred Acre Woods Day Care in Freeland. Sue and Tom have five wonderful grandchildren.

Sue’s goal for the Professional Women in Building Council has always been to grow, to help its members, the Association, and the community. This goal is also the reason Sue believes it’s important to get involved with PWB; to grow personally and professionally, promote the industry, and support the community. Sue’s favorite part about Professional Women in Building, and the HBA in general, however, is the people. “It’s like a big family,” says Sue of the Association. “Tom and I have become friends with so many HBA members. We

Sue is incredibly proud of her involvement with PWB: “Working with the fine women of this association, taking on unfamiliar tasks, taking risks, and being recognized at the national level for our endeavors has been wonderful. I am so blessed.” While Sue considers herself blessed to be a part of this Association, HBA Saginaw is fortunate to have Sue as a part of our family, too.

Construction is poised to be one of the fastest-growing global industries, forecasting that the worldwide volume of construction output will grow 85% by 2030. How will the industry, which is one of the largest sectors in the world economy today, evolve over the next 12 years? What will the job site, which is just beginning to embrace innovative technology, look like in 2030, and how do we get there? As a comparison, 12 years ago, Google had just purchased the startup known as YouTube, Facebook had just been made available to the public and there was no such thing as an iPhone — three fundamental technologies that have transformed our personal and

professional lives. By 2030, the construction site will have experienced a similar leap in technology, recognizable still but overall safer, smarter and faster. The job site trailer, the project’s nerve center, will host an interactive visualization of the building model with a real-time stream of site metrics. In addition, the work being done today to support autonomous vehicles could translate into significant safety gains for operating construction equipment at the job site by 2030. Construction equipment will be able to coordinate with smart sensors in workers’ personal protective equipment (PPE) and in the job site environment to actively detect unsafe conditions and prevent accidents.

Getting to this future vision will require collaboration and integration partnerships so that clients have a one-stop experience while still benefiting from various innovations and improvements that leadingedge technologies are bringing to the job site. Workers will continue to be the industry’s most valuable resource and that the future connected job site will have interactive, immersive tools for ensuring that every worker returns home safely.

New technology and data will bring us closer to zero safety incidents.

In 2030, the construction site will be more connected than ever before. Equipment, materials and suppliers will likely work alongside project leaders and teams to communicate, build and manage projects in real time.

The good news is that steps are already underway to make this a reality. Spurred in part by necessity, and in part by new, advanced solutions, contractors are embracing innovation like never before. Patenaude Resigns After 14 months on the job, Pam Patenaude has resigned
as deputy secretary of HUD. FHA Commissioner Brian Montgomery will serve as acting deputy secretary. NAHB had a good working relationship with Patenaude, who during her time as deputy secretary helped guide HUD through a number of challenging issues and showed strong leadership in addressing housing and community recovery in areas impacted by natural disasters. NAHB will continue to maintain a very positive working relationship with Montgomery in his new role.
