In the Medicare arena, providers are engaged in the Review Choice Demonstration (RCD) while preparing for an update to the Outcome and Assessment Information Set (OASIS-E) and the nationwide expansion of the Home Health ValueBased Purchasing (HHVBP) model, all less than two years since the Medicare payment system was reformed. Medicaid recently received a rare influx of government funds, including $1.1 billion from the federal government for recruiting and retaining direct care workers and a $15

minimum wage mandated by state law to strengthen the health care sector. Even so, the health care labor shortage continues to disproportionately impact Medicaid providers, including private pay and licensed-only providers that contract with Statewide Medicaid Managed Care plans. Clinical management of a home health agency has become increasingly complex due to all of the regulatory requirements and payment systems to manage, along with operating in the face of a pandemic. Clinical supervisors must improve their knowledge and skills in order to ensure the success of an agency clinically, operationally, and financially. The Medicare Home Health Value-Based Purchasing (HHVBP) program will be implemented nationwide in 2023. Join Palmetto GBA representatives for a presentation on several key areas of the Medicare Review Choice Demonstration (RCD) program that providers will face. The speakers will cover RCD basics, tips for navigating each selection, and review the most frequently asked questions from home care providers. The trio will also tackle common issues and take your questions.

In this all-encompassing session, our health care attorneys will cover some of the more pressing matters in compliance, licensing, regulatory, health care fraud, and criminal law: • Impairment Programs: Florida’s impaired practitioner programs (IPN/PRN) serve as “alternatives to discipline” for Practice Act violations, but they carry high burdens for both employee and employer. Attendees will learn how to identify impairment and know when reporting is required, the pros/ cons for reporting, and what kinds of exposure to liability there are for impairment cases. You’ll also learn the drawbacks of the current impairment program system, as well as alternative solutions that nurses and administrators can take with impairment issues.

• Background Checks, Exclusions, Exemptions, and Approvals: What are the best practices when running required Level 2 background checks with the Agency for Health Care Administration (AHCA)? This session goes in-depth on what an AHCA detailed investigation is all about, ways to access the data you need for hiring, how to obtain disqualification exemptions so skilled nurses can join your home care agency, and methods to efficiently navigate AHCA’s regulatory labyrinth. • Third-Party Payor Audits: This session discusses common examples of how home care agencies get into trouble with commercial and government payors; practical ways to protect your entity from audits and investigations; best recordkeeping practices; and how an effective compliance program will keep your staff in line. • How to Conduct Corporate Internal Investigations: Coordinating an internal investigation upon learning of illegal acts (health care fraud, drug diversion, etc.) isn’t just the sound thing to do — it also can help in negotiations with federal investigators regulators, or it can lay the foundation for a solid defense in court. We’ll go over reasons for an internal investigation, how to put one together, who should be conducting it, what the protocol should be, assessing culpability, and employee rights during an investigation. • How Do Recent AHCA Changes Affect Contractors?: If your home care agency relies on 1099 contractors, newly implemented AHCA regulations could restrict their use. Here you’ll get specifics on what could happen if nurse registries get carved out of Medicaid managed care contracts.

Never mind the Public Health Emergency (PHE), in addition to the Review Choice Demonstration (RCD), there are multiple Medicare, Medicare Advantage, and commercial insurance reviewers checking records for accurate claim payment. The best defense against these reviews is generating compliant clinical record content at the time the record is created — not after. By linking actual regulatory requirements with known denial reasons, it shows how proper documentation can avoid a negative outcome. This also applies to all RCD options. Having this knowledge is the basis for staff education so the benefit of prevention can be achieved. Current staff can learn how to chart it right; new staff learn from the actual regulations to start right. The topics covered also apply to Medicare Advantage reviews that occur and are not subject to the RCD.

Medicare-certified home health agencies are required to take part in the Home Health Quality Reporting Program (HHQRP) by collecting and reporting both the Outcomes and Assessment Information Set (OASIS) patient quality of care results, as well as the Home Health Care Consumer Assessment of Healthcare Providers (HHCAHPS) patient survey results. With the implementation of OASIS-E on January 1, 2023, the Transfer of Health Information to the Patient Post-Acute Care (PAC) measure will be collected. The session will discuss this new quality measure and provide an overview of current measures. It will include information on when and how measures will be collected and reported, as well as which measures are slated for retirement.
