The implementation of EXCEED, the last of the three defence research projects selected under the 2018 call for proposals for the EU Preparatory Action on Defence Research (PADR), was officially launched at an online kick-off meeting held this Wednesday and Thursday (4/5 November). It followed the signing, last week, of the Page 16 of 61
grant agreement worth €12 million between EDA and the winning consortium led by STMicroelectronics (France).
EXCEED stands for ‘trustEd and fleXible system-on-Chip for EuropEan Defence applications’. It was selected following an EU-wide PADR call for proposals on the topic of ‘European high-performance, trustable (re)configurable system-on-a-chip or system-in-package for defence applications’ organised by EDA in 2018. The project aims at creating a European supply chain of reconfigurable, flexible and trustable programmable system-on-a-chip family targeting a number of ruggedized and secure defence applications such as for radio frequency (RF) sensors and signal processing arrays, flexible radios, secure positioning and navigation, UAV data links, military networks, flexible cryptography engines, dismounted soldier, guidance and mission critical controllers. The security of the System-on-chip architecture is studied in detail to cope with EU Classified information and defence specificities as well as country-specific requirements, through protection, personalisation and life-cycle management. The project also focuses on System Development Tools. The secure chip is fabricated in a trusted environment in Europe. The demonstrator chip will be a mid-scale member of the family. The winning consortium encompasses a total of 19 participants from 6 EU countries and Norway. More information on the consortium can be found in the EXCEED project page.
About the PADR The EXCEED project is part of the Preparatory Action on Defence Research (PADR) launched by the European Commission in 2017 to assess and demonstrate the addedvalue of EU supported defence research and technology (R&T). It paved the way for a proper European Defence Programme to come as of next year as part of the European Defence Fund (EDF), under the EU’s next Multiannual Financial Framework (20212027). The PADR implementation is run by EDA following the mandate via a Delegation Agreement between the European Commission and EDA signed on 31 May 2017. PART I: EU Defence Package: Policy context and way forward 2.2. Evaluating the Intra-Community Transfers Directive Under Article 17 of the Intra-Community Transfers (ICT) Directive, the European Commission must report to the Parliament and the Council on the review of the directive's implementation. If necessary, the report should be accompanied by a legislative proposal. Therefore, as with the Defence Procurement Directive, the European Commission carried out an evaluation of the IntraCommunity Transfer Directive in November 2016, three years after the transposition deadline, which made it difficult to assess whether the long-term objectives of the directive had been achieved. As required in Article 17, the Commission evaluated the directive's impact on the development of a European defence equipment market (EDEM) and the European defence technological and industrial base (EDTIB), also with regard to SMEs. The European Commission evaluation concluded that while the tools created by the ICT Directive responded to the needs and risks that had been identified, the directive was nonetheless underused. It highlighted that the uptake of new licencing options and certification had been slower than anticipated. This affected primarily integrators (as opposed to component suppliers). Although the number of certified companies in the EU had increased, the majority were located in only two Member States, Germany and France. 'A further obstacle [was] the low awareness, particularly among SMEs, of the tools available Page 31 of 61
under the directive and their benefits across industry within individual Member States. For example, companies could reduce time and administrative burden by using General Transfer Licences to transfer supplies to a certified enterprise'5. The same evaluation pointed out that differences in how the directive had been transposed had led to 'major barriers to its effective application'. More specifically, it meant that there was slow or incomplete application in individual Member States; a general lack of harmonisation in requirements and procedures between Member States; and/or highly diverging conditions and limitations in general transfer licences published by the Member States. This evaluation also noted that it was difficult to assess the ICT Directive's impact on the development of the EDTIB and EDEM. 'In most Member States, transfers are a minor, though not negligible, part of the overall defence trade'6. Independent expert evaluations of the effectiveness and impact of the ICT Directive indicate that there are a number of prevailing barriers and challenges to achieving the full benefits of this directive. Trybus and Butler argue that an ambivalent approach to harmonisation has contributed significantly to the ICTDirective's limited operational effectiveness. They also hold that the dividing line between optional exemption from prior authorisation and mandatory licences is unclear, as is the co-existence of legally and non-legally binding instruments. Some in the defence industry have argued that a common EU definition of the term 'specially designed' (for military purpose/use) should be developed to ensure a clear and harmonised distinction between items that are to be controlled – regardless of whether or not they are sensitive, less sensitive or nonsensitive – and those to which export controls should not apply. The same actors have argued that the 'EU definition should be comparable in its effect to the US definition and apply to both the use of the Transfer Directive and the Common Position on Arms Exports to ensure consistency between the licencing systems for intracommunity transfers and exports'. Hence, those parts and components that do not fall within the definition of 'specially designed' would no longer require a transfer or export licence7. The concern over lack of clarity on the phrase 'specially designed for military purpose' persists, as the annexed research paper demonstrates. Trybus and Butler also explain that Member States still determine their transfer and export control policies. As a result, an overriding export control mentality is pervasive, as evidenced by continuing preference for individual licences and restrictively defined general licences. The certification regime is similarly unclear hindering minimum harmonisation. For these reasons, the authors conclude that at this stage in EU defence integration, intra-EU transfers are still considered to present security risks that legitimise certain controls. Over time, Member States would need to ensure that licensing decisions are a true reflection of risk8. On this issue, some in the defence industry have called for the 'less sensitive parts and components from the Military List

[to] become eligible for General Transfer Licences with no re-export restrictions and simplified rules for their incorporation into larger products'9. Other evaluations, including the one commissioned by the European Commission in 2016, pointed to the slow uptake of the new licensing options embedded in the ICT Directive and 'a shift of liability (and risk) from Competent Authorities to individual economic operators'10. The same evaluation also argued that there was a perceived lack of consistency between the ICT and relevant national and EU legislative and regulatory frameworks11. (This was also found to be true for the Defence Procurement Directive.) This issue has been posited as another reason for uneven implementation across EU Member States. Further challenges, such as differences in the extent of implementation across Member States, are shared with the Procurement Directive. In part, this variability in implementation can be explained by factors such as differences in national perceptions of arms trade controls, and the realities of trying to sustain national defence industries12. This same evaluation also pointed to the slow pace of certification of defence companies13. Rather than amend the ICT Directive, to remedy the above-mentioned problems, the European Commission had committed to14: • improving the directive's implementation in individual Member States by starting a dialogue with national authorities to clarify and better understand the modalities of transposition of the directive into the national legal orders and the reasons for nonimplementation of some provisions in certain Member States and to solve any outstanding issues in this regard; • encouraging Member States to add other products and components within the scope of their general transfer licences (GTL), since the list of products covered by the two recommendations to encourage harmonised functioning of GTLs for armed forces and for certified recipients is not exhaustive. However, Member States were discouraged from adding conditions for transfers under the GTL that contradicted or undermined the conditions listed in the recommendations; • continuing to work closely with the Member States on the harmonisation of further GTLs specified by the directive and to identify concrete areas for more harmonised certification across the EU, including creating synergies with other regimes, such as dual-use product control, to the extent possible. This could lead to further recommendations to the Member States; • providing incentives to industry to join the licence schemes;

raising awareness of the directive's tools and benefits, including through the use of outreach in the Defence SMEs Network meetings and through Member States encouraging operators to use the GTLs; clarifying the information on licensing: 'expand the CERTIDER database by additional information, such as concise but meaningful information on national systems with links to their internet presence'. As the annexed research paper shows, the data in CERTIDER still raises questions about its accessibility and usability.

As such, an analysis of the contracts notices published by Member States over the period 2011-2014 demonstrates that the Negotiated procedure52, the majority until 2013, falls to second place in 2014. During this last year, Restricted procedures are preferred with a level of 54% compared to 45% for Negotiated procedures.
An analysis of the different types of procedures, by value, from 2011 to 2014, confirms that the Negotiated without prior publication procedure is heavily favoured, irrespective of the value range. Only contracts under â‚Ź1 million show recourse to the Restricted procedure at the same level as the Negotiated without prior publication procedure. As for contracts of a total lower than â‚Ź50 million, the Member States mostly use the Negotiated without prior publication procedure (40%), then the Negotiated with publication of a contract notice procedure (38%), followed by the Restricted procedure (20%), and finally Competitive dialogue (3%). When the contracting authorities/entities award contracts by a Negotiated procedure without prior publication of a contract notice (a total of 917 contracts over the period 2011-2014), they shall justify the use of this procedure in the contract award notice as Page 40 of 61
required in Article 28. In 99% of cases, the Member States justify this choice of procedure15, by notably invoking: • In the vast majority of cases (89%), the primary justification involves 'technical reasons or reasons connected with the protection of exclusive rights' (Article 28.1.e), such as in VEAT cases. • To a lesser extent, the other justifications (10%) refer to: 'Additional works/deliveries/services', ‘No tenders or no suitable tenders in response to negotiated restricted or competitive dialogue'(Article 28.1.a.), and 'for reasons of extreme urgency brought about by events unforeseeable by the contracting authorities/entities' (Article 28.1.d).

Defence Ministers met today at EDA’s Ministerial Steering Board (in virtual format) under the chairmanship of the Head of the Agency, High Representative Josep Borrell.
Ministers were presented with the final report of the first cycle of the Coordinated Annual Review on Defence (CARD) developed by the European Defence Agency in close coordination with the European External Action Service (EEAS) and the EU Military Staff (EUMS) over the past 12 months. The report, approved today by Ministers, draws for the first time a comprehensive picture of the European defence landscape based on information gathered by Member States on their national defence spending and capability development plans, and identifies more than 100 collaborative opportunities to be taken up by Member States in six main focus areas. The CARD is designed to serve as a pathfinder for new collaborative programmes and to lead over time to more synergies and increased coherence between Member States´ defence planning, spending and capability development, through cooperation. The findings and recommendations of the first CARD report can be found here.
2021 Budget Ministers adopted the proposal made by the Head of the Agency, Josep Borrell, setting the Agency’s 2021 general budget at €37.5 million. The budget reflects the continuous high demands on the Agency to support Member States in the development of defence capabilities as well as the implementation of EU defence initiatives such as CARD, the Permanent Structured Cooperation (PESCO) and the European Defence Fund (EDF).
Three-Year Planning Framework Ministers also approved EDA’s Three-Year Planning Framework (2021-2023) which provides a coherent and comprehensive overview of the Agency’s activities structured around the three chapters reflecting its core taskings: - prioritising and planning defence cooperation; - supporting technology and capability development; - facilitating the interface with wider EU policies. 'Sustaining European Defence' will be the topic of this year's EDA Annual Conference which will take place on 3-4 December 2020 in online format, due to the COVID-19 pandemic. Registration is already open with only a restricted number of virtual seats available. Europe is facing up to the reality of before and after COVID-19. Today, four years after launching the EU defence initiatives, we have the right tools at our disposal to overcome diverse challenges through cooperation. The work of Europe’s armed forces throughout the pandemic has been lauded by our citizens, but it has equally highlighted key capabilities and investment in European defence. “Sustaining European Defence” is therefore the timely focus of the European Defence Agency’s Annual Conference. The high-level event, to be held over the course of two half days on Thursday, 3 and Friday, 4 December, will provide the annual rendez-vous for the wider European defence community to discuss European defence cooperation and how it can be sustained in light of multiple and varying security challenges. Due to the ongoing COVID-19 pandemic, this year’s Annual Conference will be held in the format of a ‘virtual event’, allowing all registered participants to join via a virtual event platform. Nevertheless, only a limited number of people will be able to register. Registration will be done on a first come, first served basis. Ca răspuns la solicitările formulate de reprezentanți ai mass media, Biroul de Informare și Relații Publice este abilitat să transmită următoarele: Procurorii din cadrul Direcției Naționale Anticorupție – Serviciul Teritorial Suceava efectuează cercetări în trei cauze penale ce vizează suspiciuni privind săvârșirea unor infracțiuni de corupție, de spălare a banilor și de constituire a unui grup infracțional organizat, presupus săvârșite în perioada 2018-2020. În cursul zilei de 26 noiembrie 2020, ca urmare a obținerii autorizărilor legale de la instanța competentă, sunt efectuate percheziții domiciliare în 67 de locații situate pe raza municipiului București și a județelor: Suceava, Bistrița – Năsăud, Botoșani, Neamț și Bacău, din care nouă sunt instituții publice, restul reprezentând domiciliile unor persoane fizice și sediile unor societăți comerciale. În cauză, procurorii beneficiază de sprijin de specialitate din partea Direcției Generale Anticorupție și a Brigăzii Speciale de Intervenție a Jandarmeriei. Raportat la actele procedurale efectuate în prezenta cauză, precizăm că, atunci când împrejurările vor permite, vom fi în măsură să oferim detalii suplimentare.
