Celebrating 50 Years of Title IX

male sports. Title IX – a 37-word section of the Education Amendments of 1972 – changed this by prohibiting gender-based discrimination in any educational institution that receives federal funding. In 2002, Title IX was renamed the Patsy T. Mink Equal Opportunity in Education Act after one of the congresswomen who championed the law

To celebrate the 50th anniversary of the passage of Title IX, the Women’s Initiative hosted the webinar, “A Conversation with Dawn Porter: 50 Years of Title IX and Its Impact on Women,” on Oct. 25. More than 240 people attended, including clients.

Partner and Women’s Initiative Chair Judy Nemsick (NYC) moderated the webinar that featured Dawn Porter, an award-winning documentary filmmaker whose work has appeared on HBO, PBS, Discovery and Netflix, among others. Porter, a graduate of Bronx High School of Science, Swarthmore College and Georgetown University Law Center, practiced at a large firm and in-house at television networks before moving into filmmaking. Her well-known documentaries include Gideon’s Army, which focuses on Black public defenders in the South handling massive caseloads; Rise Again: Tulsa and the Red Summer, which addresses the Tulsa Massacre of 1921; and more recently, The Me You Can’t See, where she helps shine the light on mental health issues.

“37 Words”

Porter discussed her recent work, “37 Words,” a fourpart docuseries on ESPN that focuses on the Title IX’s evolution and impact on women over the past five decades. Prior to 1972, gender discrimination was commonplace in education, particularly in athletics, where funds and resources were disproportionately directed to

During the webinar, Porter shared how she tends to gravitate toward specific kinds of stories, and she likes exploring the role of law in everyday people’s lives. When ESPN reached out to her to create something for the 50th anniversary of Title IX, she immediately accepted, not knowing what the end product would be, and went to work assembling a team of producers.

As her team dug deeper, it found that the original young women whose efforts led to the passage of Title IX – none of whom were lawyers – learned that because colleges and universities receive federal funds, they are prohibited from discrimination based on gender. After ads were placed in local papers asking for examples of discrimination against women, they compiled their reports and shared them with Rep. Edith Green (D-Ore.), who helped develop the legislation that was to become Title IX. Porter said that during hearings, congressmen laughed because they thought it was silly that women were complaining about being discriminated against in employment. It took two more years to pass the regulation, which was rolled into an education bill because, as Green encouraged supporters, “It had to pass, because schools have to be funded.”

The following women became non-equity partners:

“37 Words” includes interviews with politicians and other prominent leaders, including Gloria Steinem and Barak Obama, as well as athletes like Wyomia Tyus, Mia Hamm, Abby Wambach, and Dawn Staley. Porter included interviews with tennis legend Billie Jean King because “[her] advocacy and ability to use her platform to advocate for women, girls and civil rights kept showing up,” she said. “One of the things I wanted to do in this series was remind people that sometimes small actions can be really influential.”

Business Business Litigation

One of the lessons Porter shared is that the original women who worked on Title IX were not necessarily doing it for themselves; they were looking ahead to the girls who would come after them so they would have better experiences.

“Title IX is a story of persistence, creativity, thoughtfulness and community,” said Porter. “It’s a fantastic legal story, but also it’s a social, political and history story.”

Partners from the Sports Industry and Education Teams were invited to ask Porter her thoughts on current Title IX issues. Partner Tyrone Thomas (WAS), a co-leader of Holland & Knight’s Sports Law Practice, asked Porter about the increasing use of name, image and likeness (NIL) contracts where an NCAA student-athlete may use their identifiable factors, talents and features to earn fair compensation for their time and effort – and how it applies to Title IX.

judy.nemsick@hklaw.com

Porter mentioned how teenagers are quite aware of their rights and how those rights should be protected, but the benefits may not come unless you advocate for them. She cited the increasing popularity of women’s sports and the “girl dads” movement as grassroots efforts to reduce stereotypes and increase opportunities, with many dads stepping up to say, “I want my daughter to be able to do whatever she wants.”

2

In addition, the prevalence of social media is helping to create awareness of inequalities in men’s and women’s sports, and a picture is worth a thousand words.

“We don’t have to say anything, we don’t have to march, we don’t have to do anything to show the inequality between men and women,” Porter said. “The question [about disparities] we should all be asking is, ‘How did that pass muster in the first place?’ “

Porter added that it’s in the best interest of colleges and universities to be proactive in doing self-assessments and working with advisors to take a look at their facilities before someone challenges them on social media.

Education Practice Partner Jeffrey Nolan (BOS) asked Porter for her thoughts on how schools are responding to sexual misconduct cases on school campuses. She stated that, while due process is needed, civil rights should not be dependent on which political party is in power, and there should be some basic agreements that are reauthorized by every president.

“Parents are demanding more accountability, and they’re demanding safety for their kids in addition to fairness,” Porter said. “We’re seeing that it’s really hard to take away a right.”

Regarding students’ access to programs and facilities that are consistent with their gender identity, Porter said it’s important to protect children who see themselves as different from the sex they were assigned at birth. Although some states are passing laws against gender-affirming care, she said that the federal government needs to step in and assure that there are basic protections for people.

“I think it’s important that we start somewhere, to plant a flag in the ground and start having conversations about this group of children and what we need to do to protect them,” she said.

Partner Marilyn Holifield (MIA), a fellow Board of Managers with Porter at their alma mater Swarthmore College, concluded the webinar by asking Porter about the reactions she’s received to this documentary that have impacted her the most.

Answered Porter: “We are flooded with people who are saying, ‘Thank you for telling these stories, for giving a voice to a fight that happened behind the scenes.’ The women who made Title IX took inspiration and direct strategies from the civil rights movement for racial equality. There will always be new movements to protect human rights, and we can look to our history for models of how to effect change.”

Attorneys Network at Centerforce Conferences in Atlanta, New York

Holland & Knight sponsored and had a notable presence at Centerforce’s Driving Diversity in Law & Leadership Summit in Atlanta on Sept. 14.

Partner Allison Dyer and Associate MacKenzie Gansert (both ATL) attended the event. In addition, Partner Bess Hinson (ATL) was a panelist during the “Nurturing the Next Generation in Legal” session. She discussed changes and opportunities in a multi-generational workplace, reverse mentoring, succession planning and helping emerging leaders.

“The panelists encouraged attendees to consider that ‘work-life balance’ means different things to different generations,” said Bess. “The panelists discussed strategies for managing a multi-generational team, including embracing direct communication in order to enable understanding, set expectations and reduce stress.”

In addition, Holland & Knight sponsored Centerforce’s Women on Wall Street Conference in New York on Oct. 20.

Partners Amy Leder, Renee Covitt and Judy Nemsick (all NYC) attended the event, along with Cari Schiff, Vice President of Litigation for Patriarch Partners, a firm client. Amy participated as a panelist during the “Fearless Leaders – Lessons Learned from Deal Makers Driving Diversity” session.

“The panelists urged women to advocate for themselves, know their worth and take control of their careers,” said Judy. “Otherwise, we lose out on career advancement opportunities.”

The conference – part of Centerforce’s Inclusion & Equity Series – included leading investors, bankers, fund managers and finance executives, and focused on actionable strategies, best practices and lessons learned to overcome the challenges women face as they advance their careers on Wall Street. Topics included where we are and where we’re headed, the power of mentors and sponsors, busting stereotypes on “The Street,” making the shift from “the old boys’ club” and to a culture of inclusion, building equity through impact investing, and the ROI on inclusion.

The summit – part of Centerforce’s Diversity in Law Series – explored the “new normal” after COVID-19 and the effect that it will have on the career paths of women and underrepresented professionals in legal and corporate America. Topics discussed included prioritizing diversity, equity and inclusion through times of transition, creating a culture of inclusion, cultivating allies and change agents, and busting stereotypes and unpacking unconscious bias.

Partners Share Thoughts on DEI at The Legal 500 Forum Practical Marketing Tips That Work

Holland & Knight sponsored The Legal 500’s International Forum on Diversity and Inclusion on Nov. 8 in Bogotá. The event covered current issues and developments associated with diversity and inclusion in Colombia.

Partner Inés Vesga (BOG) moderated the first panel, “DE&I Beyond Corporate Policies.” The speakers shared stories of companies that have successfully committed to their diversity, equity, and inclusion programs as well as barriers they have faced and the social and organizational benefits achieved.

Partner Norberto Quintana (MIA/NYC) reminded the audience at the Nov. 8 event that each person has the opportunity to contribute and make a difference.

“Companies should implement policies that ensure a climate of professional respect and value for the difference of the team,” he said. “Diversity and inclusion policies send the clear message that the context of dignity at work allows one to bring out the best in oneself. It is a fact that the most diverse teams have the highest degree of accuracy and the lowest degree of error.”

Partner Juliana Saa (BOG) moderated the second panel, “Gender, Equity and Prosperity.” The speakers discussed the bias that women in law continue to face, including wage gaps, the care economy and gender pay, the right to time, and policymaking and women’s representation.

Partner Alexandra Aguirre (MIA/NYC) noted that not all qualities – such as being “ambitious” or “assertive” – are appreciated when they are associated with women.

“Women are not promoted as quickly as men,” she said, “and there is not much inclusion at the managerial level.”

Following the panel discussions, attendees enjoyed cocktails, light hors d’oeuvres and networking.

Partner Vivian Arias (NYC) used to think that marketing and client development would be difficult because, as she admits, “I am not much of a golfer, not a huge extrovert and did not have an extensive personal network when I became a lawyer.” However, what she has learned by watching successful lawyers and rainmakers over the years is that there are many ways to connect with clients and grow those relationships, no matter what your interests or skill sets may be. Vivian shares some of her favorite and most effective tips below.

Find What Works for You and the Client

Many of my client contacts are not local. And even some that are, they – like me – have busy lives, young children and other interests in their free time. For these clients, meeting for drinks or going to a sports event after work is not how they can or want to spend their free time. The COVID-19 pandemic forced many lawyers to rethink client development opportunities, and in some ways, a lot of women have not looked back. For me, I found that clients love receiving a thoughtful gift at the end of the year – a bottle of wine, a hot chocolate kit or a donation to a favorite cause. Depending on the industry or employer, there may be limits or restrictions on gifts to clients; do your research before sending anything so you don’t inconvenience a client who is not allowed to accept gifts. But when permitted, I discovered that this was an effective way to connect with clients who could not participate in a more traditional client development activity.

Personal Interaction Is Key

Even if you can and do send a gift, nothing compares to spending time in person with clients when possible. One way I have found to do this is attending the same conferences.

While it is even better to have a speaking or leadership role at the conference, attending on its own can lead to

5

more in-person client interactions – whether by bumping into someone during a networking break, meeting for coffee before a panel or taking the opportunity to plan a dinner.

Larger industry-focused organizations and bar associations often host annual events, but they also offer women’s networks or affinity groups that have their own events. Other organizations, like Corporate Counsel

Women of Color, host a yearly conference attended by diverse in-house lawyers with different legal practices from all over the country. Junior associates should consider attending continuing legal education (CLE) courses in person rather than watching online and choosing topics thoughtfully based on issues that are relevant to their practice where client contacts may attend. Another idea is to ask partners who are speaking at events if there are extra tickets for associates to use.

You Don’t Always Have to Spend Money

One of the most effective client development techniques I have used is hosting an educational Zoom meeting for clients. Offering to present e-learning programs allows lawyers to showcase their knowledge base and skillset in a face-to-face (even if virtual) setting while providing clients with something that has direct value for their work. It does not necessarily require significant research (when covering a familiar topic) and can be given for free! Additionally, educational programs often check necessary boxes for clients, as many companies hold weekly or monthly meetings and are looking for speakers.

Holland & Knight has offered “lunch and learn” webinars to discuss recent case law, industry hot topics and postmortems on complex transactions. When one client wanted to offer implicit bias training to its workforce, my co-practice group leader, Partner Mark Weibel (DAL), and I worked with Diversity Partner Tiffani Lee (MIA) to develop a diversity, equity and inclusion (DEI) training tailored specifically to the client and its needs. The client has asked us to return for another session this year.

Treat Everyone Like a Prospective Client

Early in my career, I was advised to befriend and build relationships with junior lawyers and businesspeople working with clients. Although those folks may be in junior roles with less responsibility now, they may rise in the ranks over time to positions where they eventually will make legal hiring decisions. For that reason, I was reminded to be responsive and effective, and to provide

the best possible legal service to the junior team members, just as I would to their superiors and managers.

That advice has served me well, and I would add a corollary: Third-party vendors and service providers engaged by our clients are also in a position to make legal referrals and recommendations. We recently had a thirdparty loan servicer for a lender client recommend us to another lender for which that servicer also works, leading to two new client relationships and three new matters. We also have received referrals from vendors, including auctioneers, title companies and appraisers, who regularly work with our clients and have referred us to other potential clients. It may seem simple, but treating vendors, service providers and junior employees like prospective clients who may one day refer business can lead to client development successes

Webinars Share Leadership Lessons and Workplace Advice

The Women’s Initiative hosted two webinars as part of the Debbie Epstein Henry Speaker Series, a quarterly program featuring conversations with New York Times best-selling authors, TED speakers and thought leaders. The quarterly events draw hundreds to more than 1,000 participants from companies, law firms and nonprofits worldwide.

Lessons in Leadership

The fall season kicked off on Sept. 29 with the “Lessons in Leadership” webinar featuring Paula Boggs.

From public service in the U.S. Army, U.S. Department of Defense and White House, to private law firm practice and the top legal job at Starbucks, to writing, recording and leading her own band as an esteemed musician, Boggs excels and makes an indelible impact on everything she does. During this fireside chat interview, she delved into how she had the courage to be the first in many leadership positions and how she sets the standard for excellence –partly by overcoming failures along the way.

In addition, Boggs uncovered how she channeled grief and fear and invited creativity into her life to garner both success and meaning. She also shared how diversity, equity and inclusion can be woven into the fabric of our every day to bring us more purpose and satisfaction. Lastly, she left attendees humming “music for the soul” with her “Seattle Brewed Soul Grass,” a magical fusion of folk, blue grass, jazz, rock and world music.

Culture, Flexibility and the Future Workplace

The year wrapped up on Dec. 1 with the webinar, “Culture, Flexibility & the Future Workplace.”

Stanford Graduate School of Business professor and author Hayagreeva “Huggy” Rao and work flexibility strategist, futurist and author Cali Williams Yost shared their wisdom on how to design today’s jobs and workplaces to give employees more freedom while also facilitating collaboration, training and relationship building.

Rao and Yost offered advice about the right mix of inperson and virtual work, whether to mandate anchor days and how to align schedules to make on-site time purposeful and additive. They also shared insight into how to avoid the “quiet quitting” trend and how to inculcate a strong culture and loyalty while giving employees more autonomy. In addition, they explored how to enhance your presence online when you’re not in person and what types of parameters and articulated expectations can create just the right balance to give both managers and employees the assurances and flexibility they need.
