Conditions concerning Vendors 17

"The Auctioneers" means Holt & Company, Auctioneers of Modern and Antique Guns. " Th e Auctioneer" means the rep resentative of Holt & Company, Auctioneers of Modern and Antique Guns conducting the sa le;

18. All goods wi ll be insured by the Auctioneers whi lst in their custody or in the premises unless written in st ru cti ons to the contrary are received . Th e va lu e of the cover sha ll be the gross sel ling price of the goods or, in the case of unsold lots or lots withdrawn before sale, the auction va lu e as estimated by the Auctioneers. Th e premium for in surance cove r shall be £1.00 (+VAT) per £100. Th e minimum charge will be £1 .00 (+VAT) per lot.

" Th e hammer price" means the price at which any lot is knocked down to a buyer. "De li berate forgery" means an imitation made with the intention to deceive as to autho rship, origin, age or source, which is not so describ ed in the catalogue and which has a va lue materia ll y less than if it had been in accordance w ith the descripti on in the catalogue .

23. A w ithdrawal fee of 5.9% (inclusive of VAT) of th e lower estimate (or reserve price, if there is one) sha ll be payable to the Auctioneers for any lot withdrawn after it has been catalogued but before sa le.

Conditions concerning Buyers 8.

A buyer's premium of 17.6% (inclusive of VAT) will be added to the hammer price of all lots sold.

Buyers will be required to supply to the Auctioneers their names and addresses and if required, a deposit immediately after the fall of the hammer.

Commission bids will be executed free of cha rge but must reach the Auctioneers at least one hour before the beginning of the Sa le. Telephone comm ission bids must be confirmed in writing.

By making a bid , prospective purchasers acknow ledge acceptance of these Conditions.

Should any lot provide to be a deliberate forgery, the Auctioneers, upon receipt of written notice of this fact within one year of the sa le, shal l rescind the sale or repurchase the lot for an amount equa l to the hammer price plus premium (inclusive of VAT ), provided that: (a) the lot is returned in the same condition as at the time of the sale;

Shou ld the purchaser fai l to pay for and remo ve any lot within seven days fo llowing the sale, the Auctioneers sha ll have the right to re-se ll the lot at auction or by private treaty w ithout giving notice to the buyer. Any li ability to the buyer shal l be limited to the hammer price origina ll y paid .

Th e vendor indemnifies the Auctioneers against any cla im relating t o goods sold on his behalf.

25. A vendor who enters for a sale goods which are assets of a VAT
