HBA of F-M President’s Report

HBA extremely active on local, state, national levels during first quarter

Your HBA of F-M was founded to give our local building industry a legislative voice. The very reason for our Tyrone Leslie existence is to represent your interests Heritage Homes at the local, state and national level to keep housing affordable for consumers, promote housing incentives and avert unnecessary regulations. The HBA, its members and staff have been the extremely active this year with legislative initiatives at all three levels. • Locally, we have been working with the city of Fargo on its sign code and tree preservation ordinance. West Fargo is moving toward adopting the new version of the International Residential Code and Moorhead has been working on lowering the cost of its infrastructure. • In January and February, groups visited Bismarck twice and St. Paul once to take part in their legislative sessions, meet with legislators and work with our state associations, North Dakota Association of Builders and Builders Association of Minnesota, to make sure your voice is heard. We worked on an organized effort with The Chamber, F-M Area Association of Realtors and Greater F-M Economic Development Corporation and Convention and Visitors Bureau to make a collective local impact on our state legislators. • Nationally, members and staff traveled to Washington, D.C., last month for the National Association of Home Builders Legislative Conference and visits to Capitol Hill. We were able to meet with U.S. Sen. Kent Conrad, U.S. Sen. John Hoeven and U.S. Rep. Rick Berg. We were all excited about the process and glad to be heard when speaking about issues that affect our industry as well as our state and cities. We left knowing we have great representation in Washington, but also knowing that it is more important than ever for HBA members to speak out to Sen. Conrad, Sen. Hoeven and Rep. Berg about the importance of securing funding for flood protection for the city of Fargo and the surrounding cities. Since we have not faced an all-out flood catastrophe, and considering the funding crisis on the federal level, it is more important than ever for members to stress the importance of permanent flood protection to our industry and com-

munities. NDAB and BAM have been successful advancing legislation important to our industry. NDAB introduced bills to give our industry a voice on the North Dakota Real Estate Qualifications and Ethics Board and to change requirements for architect consultation on certain buildings. BAM introduced bills to delay the requirement for jurisdictions to verify lead paint certification for contractors when pulling permits, and is working on preventing mandatory fire sprinkler requirements in new buildings. NAHB continues to work on credit availability for AD&C loans as it remains a serious problem for most home builders and shows little sign of easing. You can see that we are busy upholding the reason this HBA was founded: to give you a legislative voice.

NDAB-PAC

You may have seen promotions for fundraising for the North Dakota Association of Builders political action committee (NDAB-PAC). If you haven’t already sent in your contribution, I urge you to do so. It is our goal to get as many of our members engaged in supporting PAC as possible. Club 2012, launched by NAHB, asks members to contribute just $20.12 to make housing “one voice stronger.” BUILD-PAC, which is NAHB’s PAC, could easily be one of the largest PACs in the nation if all members participated by contributing. We already have 13 brand new contributors for 2011, which is a great start! Remember, your contribution is divided amongst the NAHB’s BUILDPAC, NDAB and your local HBA when you contribute to NDAB-PAC. Your dollars have helped us keep building industry issues on the forefront of the minds of lawmakers.

Flood update

Thank you to all who volunteered to help the cities of Fargo and Moorhead prepare for this year’s flood by filling sandbags March 9-10. Look for a list on page ?. The HBA appreciates your support as the cities requested assistance in preparing for what could be a record flooding event. As this issue goes to print, warmer weather has moved into the area and the springtime melt has begun. Most predictions are pointing toward an early-April crest. If you have questions or concerns about events you are registered for as we move into April, please call the office at (701) 232-5846. If an emergency situation develops, the Association will relay messages for members that need help with the flood fight to our e-mail list as it has been greatly appreciated by those who have used it in past floods.

Golf Outing sponsorships available

The HBA of F-M’s biggest social event of the year is sneaking up and it’s time to make sure it’s on your calendar! This year’s Golf Outing is scheduled for June 13. (Rain date is set for Tuesday, June 21.) The entire membership has already been sent sponsorship forms, but don’t worry - there are still some spots available! A form is included as an insert in this issue for your convenience. Those who return the form and payment before April 25 will be eligible for early-bird registration beginning April 29. Registration for the rest of the membership will be sent as an insert in May’s Plains Builder. For only $180 you will get: your company name listing on a sign at the hole and on the sponsor sign at registration; the name listed on score cards; a listing in the program; recognition in the Plains Builder and your company name announced at lunch and during the evening dinner. Heritage Homes moves into top 7 for Small Business of the Year

The U.S. Chamber of Commerce awarded Heritage Homes of Fargo the 2011 Blue Ribbon Small Business award. On March 14, Heritage Homes made the next cut and is now one of the top seven Blue Ribbon businesses up for the DREAM BIG Small Business of the Year award. Heritage Homes was among only 75 recipients of this prestigious award nationwide. The winners were recognized for their critical role in job creation and economic growth. This award honors their strong commitment to their employees, customers and community. “They (the recipients) are on the forefront of our economic recovery,” said Thomas J. Donohue, U.S. Chamber president and CEO. All seven final contestants will be recognized at America’s Small Business Summit, May 23–25, in Washington, D.C., where the winner will receive a $10,000 cash prize courtesy of the U.S. Chamber of Commerce.

Parade of Homes features 58 homes in the F-M metro area

Get outside, enjoy spring and visit the HBA of F-M’s 51st Annual Parade of Homes April 30-May 8. This year’s event covers West Fargo, Fargo, Moorhead and Dilworth. Hours run noon – 5 p.m. weekends and 6:30 - 8:30 p.m. weekdays. Renderings, descriptions and maps will be included in the Parade of Homes guide available starting April 25 at all Hornbacher’s locations or the HBA office, 1802 32nd Ave. S., Fargo. Fargo building official issues reinterpretation of IBC fireresistant requirements Section 705.5 of the 2009 International Building Code states fire-resistance requirements of exterior walls. Ron Strand, Fargo inspections administrator, has given a reinterpretation of Section 705.5 and provided the HBA of F-M with the following information: “It applies only to structures regulated by the IBC. This would exclude one- and two-family dwellings and townhouses and be mostly apartment and motel/hotel construction in the case of residential development. “The reinterpretation was developed in response to Fire Department concerns about the rapid fire spread up the exterior wall of the Galleria apartment fire.

Horizon Awards • May 12 Holiday Inn, Fargo The interpretation is actually a liberalization of the requirements of Section 705.5 in that use of the open yard required for a ‘one-sided’ fire-rated assembly would not allow decks or patios within the required 10 feet of fire separation as they constitute use of that space and fail to meet the openness test. “By prohibiting a combustible finish, the thought is we could continue to allow patios and decks without requiring full fire-rated assemblies and enable better shear wall construction practices. At the same time, we inhibit fire spread on the exterior wall finish within a reasonable distance (5 feet) of the decks and patios. The interpretation also mitigates against the severity of future multi-unit fires, essentially ‘killing two birds with one stone.’”

It’s more than merely recycling. It’s finding ways to turn substance into style by taking raw material from one source and repurposing it in a completely unexpected way. If it sprouted from the earth, designers are finding a way to use it in homes. Flooring is one area where a homeowner might find a surprising substance under their feet – like palm, for example. How about wall coverings made of banana trees? Ceiling tiles of jute? And, while not as exotic as these other materials, sustainably grown pine can be found

The Fargo City Commission has instructed its staff to develop an ordinance helping preserve existing trees in the city and in future development areas. The HBA of F-M took part in a group that will meet and review ordinance proposals, make comments and suggestions and to discuss the feasibility of preservation in certain areas. The city has now released its second draft of the ordinance. The HBA is looking for additional input from its members. HBA advocates for housing at the nation’s capitol by Bryce Johnson, Executive Vice President

Members and staff from the HBA of F-M recently attended the National Association of Home Builder’s Legislative Conference in Washington, D.C. Joining hundreds of association members from across the country, the HBA went to Capitol Hill to advocate for housing on a number of issues including retention of the mortgage interest deduction, funding for a F-M diversion, addressing AD&C credit crunch, infrastructure needs for western North Dakota and fair, marketbased appraisal rules. Attending from the HBA of F-M were Don Dabbert, Jr., Dabbert Custom Homes; John Gunkelman, Dakota Construction of Fargo, Inc.; Tyrone Leslie, Heritage Homes, HBA Executive Vice President Bryce Johnson and HBA Public Affairs Coordinator Rocky Schneider. Along with NDAB members from around North Dakota, the HBA met with U.S. Sen. Kent Conrad and U.S. Sen. John Hoeven along with U.S. Rep. Rick Berg. These face-to-face meetings with elected leaders are critical to addressing the numerous issues facing the housing industry. Each meeting gives a chance for members to share concerns with those who have a vote to make a difference. Each office had the same message that began and ended with support for housing and growth. The problem is the country faces serious economic challenges, making each issue more difficult to address. Due to these challenges, it is important to make sure that the collective voice of the building industry is heard. If you have the opportunity to speak with Sen. Conrad, Sen. Hoeven or Rep. Berg, or are willing to call their offices, be sure to express how important federal funding for permanent flood protection is to the F-M area. While they are supportive, their constant attention is needed in order to convince the Army Corps of Engineers to fund the project. City of Fargo looks to address flood, future development concerns by Rocky Schneider, Public Affairs Coordinator

While the city prepares for the seemingly yearly flood event, Fargo’s Engineering Department is looking to the future to avoid many of the pitfalls that come along with the area’s flood-prone terrain. The city hopes that being proactive with these changes will save money in the future and give homeowners peace of mind that their homes will be built safe from flooding.

Building setbacks

The Fargo City Commission approved the drafting of an ordinance to change the setback requirements along rivers. The new setback requirement would be 450 feet from the center of the river or 100 feet from the floodway, whichever is greater. Previously the city used the 100 feet guideline. The county uses 450 feet The discussion on building setbacks from the river arose after the city spent millions of dollars on home buyouts that were allowed to be built by the river. In many cases, the homes were built during times when the distance was safe, but over time, the river levels and flood impact has changed. Architect and appraiser bills move forward

House bill 1469, a bill to bring balance to the current requirements on using an architect on private projects, will be heard in the Senate Industry, Doreen Riedman Business and Labor Committee March NDAB Executive 29. It will then move to the full Senate Officer for their vote. We encourage all of you to contact Senators and ask them to

“Support HB1469!” This bill passed the House with a vote of 91-3. We are working hard, lobbying senators and ensuring an effective hearing in the Senate committee.

Appraiser Bill Now in House

Senate Bill 2187, a bill to reform the appraiser chapter of the N.D. Century Code, is supported by the North Dakota Association of Builders along with the N.D. Association of Realtors and the two bankers’ groups. If passed, the bill would: • Add two members to the N.D. Real Estate Qualifications and Ethics Board, increasing it from five to seven. We are asking for a builder and a realtor to be added. • Apply term limits of two five-year terms. One must be off board for at least two years before being reappointed. • Establish standards for approval of permit applications. When denied, applicants must be provided with an explanation. This is not always provided now. • Require more transparency of board activities, provide meeting notices, upgrade the information available on their website. • Require permitting of applicants licensed in good standing in another state having equivalent licensing requirements within 30 days. The bill will be voted on by the House Industry, Business and Labor Committee and the full House of Representatives in late March. BAM 2011 President Todd Bjerstedt’s thoughts for the year

If you’re here, it’s safe to assume you’re committed to the building industry. Many of us have lost much the past few years. Some have literally lost everything. Yet, here we are. It makes you wonder how we got here, doesn’t it? Well, I have some theories. Some are here to network; some to learn. Others are here to promote their business and sell product. But given that the construction industry isn’t as lucrative as it used to be, I believe most of us are here for two main reasons. Camaraderie. How many times have we heard a football player say the reason for their last season or two is not the money – it’s the locker room? My wife, Denise has asked me why I don’t do more with my friends. Fact is, I spend time with my friends every day. It just so happens a high percentage of my friends are in the construction industry. Nobody understands, accepts, encourages or challenges me more than the friends I’ve made the past 25 years in the construction industry. The simple fact is, if we are to stay in this industry, we need each other. You Care. The second reason I believe you’re here is because you care. You care about your family and your livelihood. You care about what happens to your friends in the industry. You care about what happens to the construction industry because it is noble and worth preserving and protecting. Most of you care about your customers and the millions of Americans who still believe homeownership is the foundation of the American Dream. Because I believe you care and want to succeed I would like to challenge you with five thoughts as we enter 2011.

1. Don’t assume things will return to “normal.” What we experienced a few years ago was not normal. Waiting, wishing or assuming that things will return to the way it was is not healthy. Tom Brokaw made an interesting observation in his documentary The Greatest Generation, stating that after World War II, America had no competition. In the years following the war, we built 80 percent of the world’s automobiles, the average American income doubled preto-post war, making it 15 times more than the rest of the world. No wonder we prospered! In today’s worldwide economy, America faces competition unlike any time in history. We cannot afford to make the mistake of assuming the “good, old days” will return simply because history repeats itself. Richard Nixon said, “Nostalgia is not a crime as long as people don’t act on it.” It’s time to move on in our thinking. 2. Do your homework. The most intellectually enlightening time in my career was in 2007. I spent the year working for a company that does market research for the residential construction industry. Part of my duties included physically driving through hundreds of neighborhoods counting the inventory of lots, homes under construction, model and spec homes and researching plat approvals at

county recorder offices in the 13-county area. I was dumbfounded at the excess inventory in the marketplace. Even more astounding was how much information is available to help anyone in the construction business know their client, what they need and how much they’ll spend to get it. So challenge number two is: do your homework and discipline yourself to plan your business activities around facts not habits.

3. Stay engaged in your builders association. I can’t tell you how many people I meet in the construction industry who have no idea what is going on in the world of politics and building codes or how it affects them. Some are aware of what’s happening but believe nothing can be done about issues like warranty law or mandatory sprinkler systems. That’s just not true! The Builders Association of Minnesota has become a force at the capitol and we need to keep it that way. I often say, “If we’re not at the table we are on the menu,” and it’s true! (This is one historical pattern that does repeat itself). Remember, those who make the decisions impacting your business rarely know as much as you do, so when we lobby, we educate. We absolutely need to stay at the table. 4. Think outside the box. The movie The Patriot (2000), starring Mel Gibson, is a war-hero’s story in which he comes home to find former troops building him a new house. I noticed the structure looked similar to a modernday construction site, but the movie was set in the late 1700s. What product do you own that is still built the same way it was 220 years ago? I am convinced we don’t build the way we do because of consumer preference. This may sound crazy, but I don’t recall any customers demanding I place 2’ x 6’ studs every 16 inches. But they have always demanded style, sustainability and above all, value. Are there better ways to meet the demands of future homeowners? I believe there are and only those of us that figure them out will be here in 10 years. Are you afraid of change? If so, you better get over it! Big box stores and big companies will figure out a way to meet the demand, if we don’t. 5. Don’t give up. Winston Churchill said, “The pessimist sees the difficulties associated with every opportunity and the optimist sees the opportunity with every difficulty.” Let’s face it. It can be hard to see the light at the end of the tunnel, but we know it’s there. Industry experts tell us we are at or near the bottom, and I think that’s true. As a youngster, I recall jumping a little too far off the dock into the lake at my grandmother’s cabin. I struggled to get back and remember the sense of relief in feeling the bottom of the lake. It wasn’t solid, but it was there and I think that’s where our industry is now, beginning to feel the bottom. Don’t give up! Cass County Electric Cooperative updates aid-to-construction charges, effective May 1

Cass County Electric Cooperative has updated its aid-to-construction charges, effective May 1. CCEC wants builders to be aware of all changes. Raw material costs continue to rise the cost to provide service also continues to increase. Through construction and purchasing practices CCEC has held these costs down to the best of its ability. It is implementing a small change to its aid-to-construction charges. New residential lots have increased to $300. This group has not changed since 2008. Single-phase commercial or non-platted residential will change $1 per amp based on the service size. This will better reflect the increased cost of the wire size, metering requirements and other materials needed to serve this group. There has been no change to the transformer aid to construction although CCEC has seen costs increase on these materials. CCEC has chosen to recoup these incremental cost increases through a series of aid-to-construction charges instead of passing on these costs through its rates. Tour de Habitat raises over $27K

Builders, remodelers work with EPA to clear up confusion over lead rule enforcement

The nation’s home builders and remodelers continue to work with the Environmental Protection Agency to clear up confusion over enforcement of the agency’s new lead renovation, repair and painting rule. In a recent conference call with the National Association Larry Leadhead EPA Lead of Home Builders and the Building Industry Association of Enthusiast Southern California, the EPA’s Region IX discussed how it is going about the inspection process in its area and what will be required of businesses to show they are in compliance. Staff members from Region IX — which includes California, Nevada, Arizona, Hawaii and the U.S. territories in the South Pacific — explained that there are variations in how the different regional offices approach inspection targeting. The EPA’s enforcement policy outlines not only the fines but also some of its enforcement flexibility. The conference call was prompted by NAHB Remodelers member Ben Morey, who reported receiving a perplexing phone call from someone who at first claimed to be from the EPA — and when prodded, then said they were working on behalf of the agency — to check the status of his firm’s RRP certification. It was established in the conference call that the EPA is not calling firms to check for certification. The unsolicited call to Morey was probably from someone trying to drum up business, call participants agreed. To enforce the rule, Region IX said it is piggybacking RRP inspections with inspections to see if managers of multifamily properties are complying with a requirement to distribute EPA information to building occupants on safe remodeling practices. Large window installing companies are also being targeted. Responding to tips and complaints, Region IX is sending warning letters to contractors and also placing them on a target list for possible inspections. Tips and complaints in Region IX can be made at www.epa. gov/region9/toxic/lead/tips-complaints.html. While EPA employees in Region IX are primarily focused on going to the offices of remodeling firms and inspecting their records for compliance with the RRP, site inspections are expected to begin shortly. Records of remodeling work in pre-1978 housing need to be up to date and somewhat detailed. At a minimum, the records should contain: • Proof of delivery or notification of the “Renovate Right” brochure to all required persons (home owners, tenants, parents and guardians at childcare centers) such as a receipt form with signature • If used, the sampling results of any pre-renovation test kit (D-Lead, LeadCheck) and the name and lot number of the kit • A copy of the firm’s RRP certification • A copy of the renovator’s certification • The lead-safe work practices used to reduce the production of dust during renovations — including work-area containment, posting warning signs, clean-up procedures, waste handling, etc. — which can be demonstrated by providing a checklist • Explanation of on-site worker training in lead-safe work practices

BAM succeeds in legislature, extends deadline for Certified Renovators to Aug. 1

The Builders Association of Minnesota put forth a bill to extend the deadline for Minnesota municipalities to verify the lead certification qualifications of residential contractors, remodelers, manufactured home installers, or roofers performing work on structures constructed prior to 1978 prior to issuing building permits. BAM understood that the Environmental Protection Agency’s website isn’t updating frequently enough to give Minnesota municipalities accurate information of who has or has not been trained as a certified renovator to perform work on pre-1978 homes. This bill pushed for an extension of the original Feb. 1 deadline to show proof of certification back to Aug. 1 of this year. This will hopefully give the EPA enough time to update its website to show that those working in Minnesota who are affected by this rule have or have not completed the required training to perform work.

John Koerselman is the president and owner of Red River Drywall & Painting Services, Inc. and has been involved with the HBA of F-M for seven years. The annual Golf Outing every June was the activity that drew him towards the Association in the beginning. He then began to realized that there was much more he had to offer and a variety of ways to show his support. Koerselman is a member of the Public Issues Committee, Political Action Committee, volunteers his time for the Herdina Academy for the Construction Trades, attends the International Builders Show, exhibits at the Red River Valley Home & Garden Show and is also involved in legislative visits in both North Dakota and Minnesota. Red River Drywall & Painting Services, Inc. has also sponsored general membership meetings. Outside of work and the Association, Koerselman enjoys traveling, hunting, fishing and spending time with family and friends. Home & Garden Show celebrates 50th annual event, a rich history in the F-M area by Krista Mund, Communications Manager

The Red River Valley Home & Garden Show celebrated its 50th annual event Feb. 25-27, welcoming over 10,000 consumers to the Fargodome. Featured speakers, the Renegade Gardener Don Engebretson and Grilling Buddies Mad Dog & Merrill, gave outstanding seminars attracting hundreds of consumers to the main stage, sponsored by Accent Kitchen & Bath. First known as simply The Home Show, it began in 1962 at the Fargo Civic Center. HBA Past President Lee Amble (1978) became involved in the HBA of F-M in 1967 with his company, Valley Water Conditioning. He remembers early shows as an exciting way to meet the public. “Exhibitors were quite competitive over booth spots on the Civic Auditorium floor,” he says with a smile. Early shows featured hourly door prizes, 40-50 exhibitors and a homeowners’ clinic covering building, electrical, landscaping, interior decorating, plumbing, heating and air conditioning and financial. In the 1970s, The Home Show moved to West Acres Mall then back to the Civic Center, and found its current home at the Fargodome in 1993. HBA Executive Vice President Bryce Johnson organized the show in the early 1990s. “It had continually sold out the Civic Center, and Association leaders were excited to have a larger venue for expansion and growth,” she says. Today, the Home & Garden Show hosts over 300 exhibitors, filling the main floor of the Fargodome as well as its lobby and concourse. Education has remained an integral part as organizers bring in national speakers annually and encourage building industry sponsors to offer seminars for consumers; these have included kitchen and bath remodeling, housing incentives and ways to finance home projects. Amble now lives in Arizona, but travels back to the F-M area to visit family and has visited the show. He says, “I am amazed at the growth of the show and it makes me feel proud to be one of the many people involved at the very beginning. The show is tremendous and has mirrored the growth of the HBA itself in many ways.” Amble and Johnson attribute the show’s success to leaders and volunteers who recognized how the event could showcase the industry and provide a service to consumers looking for one-stop remodeling and new home construction shopping. 50th annual show draws over 10K consumers

The Red River Valley Home & Garden Show’s exhibitors did not disappoint in 2011, putting their usual hard work, effort and pride into their booths. The result was another top-notch show at the Fargodome! With just over 330 companies represented, consumers had a wide variety of services to learn about and products to see. Consumers from around the region created great crowds throughout the weekend, with total attendance at just over 10,000. This year featured a 2-for-1 entry promotion on Friday from 3-6 p.m. The array of seminars brought in around 1,400 attendees. Seminars included offerings from Don Engebretson, a renowned gardener and Mad Dog and Merrill, the Grilling Buddies from Wisconsin. Accent Kitchen and Bath also offered local seminars on upcoming trends. The Kids Workshop, sponsored by The Home Depot, was a success once again with hundreds of kids participating in construction projects.

1960s Home & Garden Show ‘Idea Book’ tidbits 1. Moorhead State Bank offers $5 for each improvement loan upon approval. 2. A flooring article advertises carpeting for kitchens and bathrooms as another addition in floor coverings to the market. 3. An ad touting “Sliding Walls of Glass,” or as we know them now, sliding glass doors. 4. “Dacor Miracle Bricks” offered “new decorating vistas to the amateur and professional alike…. Are molded individually to look like real bricks, yet are only ¼-inch thick. They may be applied to any surface with a special mastic developed to look like real cement when dry.” 5. There was “growing public acceptance” of drywall construction rather than plastering interior walls and ceilings. 6. Paula is a former cosmetologist with a love of home design and an ability to address lifestyle choices to meet the current home-buying market. “All of our homes have a ‘look’ to them,” says Paula. “We have introduced many exterior and interiors choices that are craftsman related. Everything from front porches, exterior trim and window styles to interior floor plan design are customized for today’s buyer.” Paula Rae Homes & Gardens, Inc., began after the couple took their time visiting several of the HBA of F-M Parade of Homes. “We noticed that there were styles of homes that weren’t being built in the Fargo-Moorhead area. This motivated us, in our business plan, to create our own distinctive style of home that would be different than anything else being developed,” says Lute. According to Paula and Lute, there is always something new, exciting and interesting in the building industry. Examples include new products, energy-related topics and green construction. “We are excited about the trend towards building smaller and smarter homes with attention to detail. This has been a

Approaching each job as if it were their own brings tremendous customer satisfaction by Alison Streyle, Communication & Office Coordinator

All Finish Concrete, Inc., began through word of mouth and has grown into a company that specializes in an array of concrete work. A friend of Chad Ohnstad, owner of All Finish Concrete, Inc., gave a contractor his name and put in a good word. Who would have known that was all it would take to get this company off the ground? Today, the company, located in Moorhead, is in its sixth year of business and is immersing itself in various residential projects around the community. “We began doing strictly residential jobs, but have now expanded and can say we’ve done all types of concrete work from decorative patios to large-scale commercial projects,” says Ohnstad. As the company grows, Ohnstad says that the projects continue to get more interesting and exciting with the number of improvements made to concrete and its ability to do amazing things. “Concrete craftsman have the opportunity to take their imaginations and talents to levels unheard of, even compared to five years ago. It has come a long way and I see a lot more new ideas for the future,” he says. With everything growing, developing and changing, All Finish Concrete, Inc., has managed to keep customer satisfaction as the top priority. “We believe that the way we treat our customers and how we approach each job is what keeps customers coming back and allows word of mouth to help spread our customer base. We make sure to look at each and every project as if it were our own. You can see the difference it makes to a customer when you go the extra distance to make sure they are satisfied before, during and after the project,” Ohnstad explains. There are also tough areas and snags that the company has run into, but is finding new ways to work through them. “Keeping the rising cost of materials down so the builder can get concrete work done at a fair price is difficult, but it is reality. We have resorted to purchasing materials in bulk to help keep the cost down and so far it has been working well for us,” says Ohnstad. Although there are struggles to deal with and obstacles to overcome, Ohnstad still loves his job. He says working with contractors and helping them meet their customers’ needs is definitely enjoyable and has a feel-good aspect to it knowing All Finish Concrete was a part of it all. Working with the homeowners on custom projects is another favorite aspect of his job.

What is the latest trend in your business/ industry?

“Right now in the resurfacing industry we are seeing a lot more design and color come into play. It is popular in areas such as showers and floors. Conservative solid colors on the countertops have also been a big hit with our customers. “We are extremely fortunate to be able to change, adapt and compliment almost any surface easily and as quickly as the trends are. It has definitely kept us on our toes as well as we work to keep evolving on a day-to-day basis.”

What do you think is the biggest challenge facing the industry and how are you dealing with it?

“The rising costs of materials and fuel combined with the shrinking household budgets has definitely been the biggest challenge for us. “We continue to do what we have always done. We keep our product prices fair to both our customers and ourselves without sacrificing any quality or service.”

Value of green building the focus of upcoming Green Building Conference

HBA of F-M says goodbye to long time member: Jim Fay by Alison Streyle, Communication & Office Coordinator

Jim Fay worked with Amerland Co., Inc. for 57 years from 1953-2010. Fay passed away on March 8, after a long battle with cancer. He will be truly missed, but never forgotten. The HBA of Jim Fay F-M appreciates all he did for the AssoAmerland Co., Inc. ciation and the industry in his many years as a Realtor in the F-M communities. Fay is said to be one who has always been driven by the service to the customer philosophy. Many in the industry would say that he was one of the most trust-worthy, reliable realtors in town. Morrie Schwinden, former Amerland Co., Inc. Realtor, says “Jim never tried to sell someone a house they didn’t like or they couldn’t afford.” Fay was open to meeting all kinds of people, visiting with them and making sure he could find the house that fit them just right. According to Schwinden, Fay began holding open houses almost every Sunday in order to meet people and soon became known as “Mr. Open House.” He also began conducting “Realtor open houses.” These times were made for fellow Amerland Realtors to guesstimate the price one of his homes would end up selling for. All guesstimates would go into a drawing for a $25 Open House Award given away as the opening event of each Amerland Co., Inc.’s general membership meeting. This award has continued on and is now a ritual in the company. Realty was only the second job Fay ever held. After college, Fay was hired by a company to travel across North Dakota surveying businesses, but realized it wasn’t his ideal career path. He heard about openings at Amerland Co., Inc. from a shoe salesman who had suggested he try out realty. Fay immediately found his calling. He became so great doing what he loved that in the last stretch of his career he didn’t need to use advertising due to the high amount of recognition from people he worked with. Bob Kiefert, Amerland Co., Inc. Realtor, worked for Fay for 14 years and knew him for over 50. “Jim was wonderful to work for and is very much missed around here. He never put pressure on his employees and ran a good ship here. If you ever needed anything to make the job easier, he got it done! Any and all complaints were taken care of right away. Jim never put it on the back burner,” says Kiefert. Fay made a tremendous impact on the realty industry and Amerland Co., Inc. He will always be remembered. Thank you for everything “Mr. Open House.”

tion of an increased BFE, Fargo has been requiring buildings to meet a level 2.5 feet higher than the current BFE. With the new data being used by FEMA the current level may not be high enough in some areas to move homes out of the 100-year flood plain. The 100-year flood plain is a significant level because homes under this height are required to purchase flood insurance if the home has a mortgage. After reviewing FEMA’s new draft BFE maps, Fargo officials are looking to increase the current BFE level by 1 foot. On top of the 1 foot increase, the city plans to increase its own requirement up another 1/2 foot. This means that homes will have to be built 3 feet higher than the BFE. With both requirements together, homes will be required to be built 1.5 feet higher than the current level. Officials are concerned about the added costs and availability of clay to meet the new levels. The HBA of F-M has met with officials to address how best to keep the city growing and protect current homes. Fargo has yet to establish a timetable for implementation of this new rule, but it will likely occur in 2011. HBA Education ‘season’ wraps up with great turnouts

The HBA of F-M closed out the 2010 year with EPA Certified Renovator training and Workforce Safety & Insurance safety courses which focused on electrical safety compliance and CPR/First aid training. No rest was taken as 2011 rolled in three months full of great educational John Rogalla Stenerson Lumber opportunities. The Skills & Technology Education Training Center almost seemed like home Commitee Chair to HBA education classes this year as it hosted four great classes.

Electrical contractor continuing education

The year started off with an electrical contractor license renewal class Jan. 7. The class brought in 66 attendees and Tim Pull, North Dakota State College of Science, once again, did a great job speaking. Minnesota contractor continuing education

Minnesota residential building contractors’ license renewal classes were held Jan. 19 and Feb. 16. January topics included: Geothermal 101; Minnesota Hot topics: Building Code; Basics of Building Braced Walls; and Minnesota Home Warranty Law. Contractor insurance policy requirements change

Insurance companies must provide DOLI notice of policy cancellation or nonrenewal

Minnesota’s insurance laws (M.S. 60A.36) changed Jan. 1, 2011, so that a contractor’s or business’s insurance company must provide the Department of Labor and Industry a written notice of a policy cancellation or nonrenewal, subject to the terms of the policy. Cancellation notice

In the event of a policy cancellation, insurers are required by law to send a written notice to the department “at the same time that a cancellation request is received from or a notice is sent to the insured.” Notice to DOLI is required to be made if the insurance company cancels or non-renews the policy, subject to the terms of the policy.

Policy endorsement

Before an insurance company can notify the department of a policy cancellation or non-renewal, it needs to know who and where to send the notice. The licensed business or contractor must notify the insurer, through an endorsement to the insurance policy, that the department will be notified if the insurance company cancels or non-renews the policy. Plumbing contractor licensing changes are coming

Beginning Jan. 1, 2012, the Minnesota Department of Labor and Industry will license individuals and businesses that perform or offer to perform plumbing work, with or without compensation, as a licensed plumbing contractor or licensed restricted plumbing contractor. Master plumbers and restricted master plumbers will no longer “hold” the license for a plumbing contractor, but rather will be the “responsible master” for the contractor. The plumbing contractor, as a business entity, shall “hold” the license for itself. The Minnesota Legislature made this change in 2010 to align regulation of plumbing contractors with that of electrical contractors, high pressure-piping contractors, elevator contractors, residential roofers, technology system contractors and residential building contractors. The law clarifies that business entities contracting to perform plumbing work shall be directly accountable for their business actions as a contractor.

Licensure of plumbing contractors

Although plumbing contractors have filed bonds and liability insurance with DOLI and the Department of Health for many years, they have been doing it on behalf of their master plumber. A plumbing contractor’s license was actually the master plumber’s license, not the business’ license. In 2010, the Minnesota Legislature shifted this responsibility to the plumbing contractor as a business entity rather than leaving it with the master plumber. The change goes into effect with the license period starting Jan. 1, 2012. Information currently provided by plumbing contractors when filing a bond and liability insurance will not change. This information includes: • contractor name, address information, contact information • federal and state business, employer and tax identification numbers • business name filing(s) with the Minnesota Secretary of State • business disclosure of owners, partners, officers, or members • responsible licensed master plumber or restricted master plumber • plumbing contractor code compliance bond • certificate of liability insurance • certificate of compliance with Minnesota workers’ compensation laws

The primary differences plumbing contractors will experience in 2012 are: • License number: Each licensed plumbing contrac-

tor will be issued a license number that will remain with the licensed business entity as long as it remains licensed. This will eliminate use of the master plumber’s license as the plumbing contractor’s number. • Responsible licensed plumber: Each licensed plumbing contractor will designate a master plumber or restricted master plumber as its “responsible licensed Plumbing contractor licensing con’t on pg 33

Nielsen stressed that problems in the housing sector resulting from the economic impact of the credit crunch have placed an enormous toll on the nation’s economy. The sharp decline in home building from the 2005 peak — a drop of one million units — has translated into the loss of 1.4 million construction jobs and $70 billion in wages. Factoring in industries that provide materials and services to home builders, the total impact of the housing slump has been the loss of more than three million jobs and $145 billion in wages in all housing-related industries. “NAHB estimates that over the next decade there will be a need for at least 1.7 million additional homes per year,” said Nielsen. “This translates into five million jobs and significant economic activity,” he said. “Without increased AD&C lending, this future demand will not be met, job loss will occur and job creation will suffer.” Nielsen delivered a similar message on the urgent need to open up the lines of credit for new housing production in a March 7 address to the board of directors of the National Association of Counties during its annual legislative conference in Washington, D.C.

Qualified Residential Mortgage

On a related topic, NAHB urged the federal regulators to take an expansive approach in defining a Qualified Residential Mortgage in the forthcoming credit risk retention rules required by the Dodd-Frank Act. The law requires lenders to have “skin in the game” by holding a small percentage of each loan that they sell into the secondary market. What is still to be determined is how the risk retention rules will be established and how regulators will define the terms of certain high-quality, lower-risk mortgages that will be exempted from the risk retention requirements. Nielsen warned that if agencies establish a QRM standard that is significantly tighter than current credit standards — which are already tougher than they have been in decades — millions of creditworthy borrowers would be deemed, by regulatory action, to be higher-risk borrowers.

“As a result, they would be eligible only for mortgages with higher interest rates and fees, which would prohibit many potential first-time home buyers from purchasing a home, especially if the definition includes an excessively high minimum down payment requirement,” said Nielsen. Further, an overly restrictive QRM definition would also drive numerous current lenders from the residential mortgage market — including thousands of community banks — and enable only a few of the largest lenders to originate and securitize loans. “This sharp dilution of mortgage market competition would have a further adverse impact on mortgage credit cost and availability,” said Nielsen. “We therefore urge the agencies to define the QRM’s parameters in a way that facilitates a housing recovery and ensures access to conventional mortgage credit for all buyers and refinancers, while preserving high quality, empirically sound underwriting and product standards,” he said. Because of changes in the cancellation notice language of the ACORD Certificate of Liability Insurance and notification requirement for cancellation or non-renewal of liability insurance, DOLI will now accept the most recent version of the ACORD Certificate of Liability Insurance form (ACORD 25 2010/05) as evidence of insurance coverage. The content on the certificate must include: • the insurance company name and its National Association of Insurance Commissioners (NAIC ) number; • the policyholder’s legal name, assumed name (doing business as or dba) if applicable, and physical address; • the policy information including policy number, effective date, expiration date, and policy limits; • insurance agent information and signature; and • DOLI identified as the certificate holder.

Enforcement

Any licensed business or contractor failing to keep liability insurance coverage in effect is immediately presumed to be unlicensed and, as such, prohibited from acting or holding themselves out as a licensed business or contractor. Unlicensed activity is a misdemeanor and will result in enforcement action against the business or contractor, including a civil penalty of up to $10,000 for each violation. Licensed businesses and contractors that discontinue their liability insurance coverage must terminate their license by returning the license certificate to the department. NAHB provides guidance on changes in OSHA’s fall protection requirements

The National Association of Home Builders has created a new guidance document to help association members understand the key changes to the Occupational Safety and Health Administration’s residential construction fall protection directive. On Dec. 22, OSHA withdrew its Plain Language Revision of OSHA Instruction STD 3.1, Interim Fall Protection Compliance Guidelines for Residential Construction. First issued in 1995, the directive was a source of confusion among home builders over what fall protection methods and systems should be used to comply with OSHA’s fall protection standards. Starting on June 16, those engaged in residential construction need to follow 29 CFR 1926 Subpart M Fall Protection Regulations. Among the significant changes:

• Roofing contractors must use guardrails, personal fall arrest systems (harnesses and lanyards) or safety nets on all roofs with slopes exceeding 4-in12 when working 6 feet or more above a lower level. • All other trade contractors must use guardrails or personal fall arrest systems (harnesses and lanyards) or safety nets when the height from one elevation to another is greater than 6 feet. • However, employers who can demonstrate that these fall protection systems are not feasible or create a greater hazard can use a plan outlining alternative fall protection measures that must be followed. • The fall protection plan must be in writing and site-specific. However, a written plan developed for repeated use for a particular model or style of home will be considered site-specific. • The use of fall protection plans is limited to “residential construction” in which the structure will be used as a home and constructed with traditional wood frame materials and methods. • The limited use of structural steel in a predominantly wood-framed home — such as a steel I-beam to help support wood framing — does not disqualify a structure from being considered residential construction. The fall protection guidance document contains an easy-to-read chart highlighting the differences between the requirements of the Interim Guidelines and Subpart M regulation. NAHB expects OSHA’s policy change to ultimately make it easier for home builders to understand what’s necessary to achieve compliance, to ensure safer worksites and to reduce the occurrence of costly accidents. Public Issues

The public issues committee is responsible for keeping tabs on governmental action that affects the industry and then informing the industry on the status of those issues.

• A task force has been established to review infrastructure requirements in Moorhead. The group has submitted recommendations of topics to consider to the city. The purpose of the recommendations is to ultimately reduce infrastructure costs. The city has said they will respond within six to eight weeks. • The HBA participated in the Builders Association of Minnesota’s Builder Day on the Hill. Members who went met with Sen. Langseth and Rep. Marquart and Rep. Lanning. Several pieces of legislation were discussed: new home warranty legislation, a bill dealing with the state building code and the jobs bill.

• Fargo City Commission is developing an ordinance to help preserve existing trees in the city and future development areas. HBA took part in meeting and reviewing ordinance proposals, making comments, suggestions and discussed feasibility of preservation in certain areas. • Fargo officials are looking to increase its current base flood elevation requirements of 2.5 feet higher than BFE to 3 feet. The HBA has met with officials to address how to best keep the city growing and protect current homes. No timetable has been established, but the change will most likely take place in 2011. Remodelers Council

This council represents the remodeling industry in the local HBA of F-M through national Remodelers membership. It has its own dues and community service projects and is the committee behind planning the Fall Home Show.

• The 2011 Fall Home Show is scheduled for Oct. 1-2 at the Fargo Civic Center. We are working on a featured speaker and seminars. Ideas are welcome. • The Council will also be constructing a handicap accessibility ramp in Moorhead this month. Details will be in the next issue. Next meeting: TBD

Meet your HBA board of directors: Nancy Michelsen

Nancy Michelsen, CityWide Electric, has been on the HBA of F-M board of directors for a year and a half. She is also a past chair of the Parade of Homes Committee. Michelsen joined the Parade Committee when she decided it was time to get Nancy Michelsen more involved. After that, she wanted CityWide Electric to do more than just serve on a committee and volunteer for HBA activities. She moved her way up and is now enjoying her time on the board. According to Michelsen, the best part of being involved with the board of directors is the ability to meet various members, the great insight people bring to each meeting and also being in touch with all the current events the of Association, both locally and nationally. “The impact the HBA has with the public and the current issues of the home building industry are relayed through contact with the board of directors and staff. The board of directors plays such a key role for the Association. I can’t imagine where the industry would be if the board didn’t exist,” says Michelsen.

Region IX has sent letters about the RRP requirements to tens of thousands of licensed contractors and have placed numerous articles in trade publications. The EPA recognizes that there are uncertified contractors in the marketplace and is seeking tips and complaints about anyone operating out of compliance.
