A cake and coffee open house reception to honor Bill Swanson for 40 years of service at Dakota Refrigeration, Inc., was held in June. Swanson is a lifelong resident of the Fargo-Moorhead area. After graduating in 1975 from Minnesota State Community and Technical College, Moorhead, he began working as a service technician for the company and was later promoted to service manager. He now works in sales. Hoglund Landscape Inc. was awarded first place from the North Dakota Nursery and Landscape Association for design and installation. Stan Hoglund has been a member of the Home Builders Association of F-M for 31 years.

HBA Remains Concerned With Oxbow Injunction, Encourages Membership Recruitment In May, a federal judge issued an injunction resulting in cessation of all work on
the Oxbow ring dike until the Minnesota Department of Natural Resources completes a study on impacts of the F-M Diversion. Along with work on the ring dike itself, construction of homes replacing bought-out properties was threatened to be stopped by the F-M Diversion Authority. When the injunction was issued, there were eight homes under construction being allowed to continue, five homes under contract, and 25 homes in line for funding and construction, with more anticipated to follow. The HBA of F-M met with the affected builders, the city of Oxbow and the F-M Diversion Authority. The Association has closely monitored the situation, and members addressed the issue with North Dakota’s Congressional Delegation in Washington, D.C., in June. As of press time, everything remains at a standstill, with a lawsuit pending between the Diversion Authority and the Richland/Wilkin Joint Powers Authority. Please watch our email communications for updates on this issue, and respond when the HBA requests the membership to contact officials regarding this issue. The impacts of stopping home construction in Oxbow is far-reaching and affects many home-building-industry businesses. See page 9 for more information.
1-for-1 Challenge more important than ever
As we head into the second half of 2015, I would like to remind you of my “1-for-1 Challenge” to recruit just one new member this year! Your HBA needs to recruit 51 new members to reach our goal of 90 by the December board of directors meeting. We especially need new Builder members as we’ve set a goal of 20 new Builders and have recruited 11 as of now. Most members assume everyone that they do business with is already a member of the HBA. Take a look through the directory (hard copy or at www.hbafm.com/directory). You may be surprised to see how many companies aren’t a member yet. Think about businesses and people you work with each day who may be interested in membership; sometimes all it takes is a phone call or a personal visit. It is surprising how many will gladly join – they just need to be asked. HBA Says Goodbye to Pfau At the end of July, the HBA of F-M said goodbye to Public
Affairs Intern Mike Pfau. He worked part-time since February to assist in monitoring local, state and federal legislation affecting the home building industry, working with the Public Issues Committee and keeping members informed of regulatory changes. Pfau plans to graduate in May 2016 with a bachelor’s degree in public relations and advertising from North Dakota State University. He will finish off the summer visiting the East Coast for three weeks, and will keep his part-time job at the Boiler Room throughout the school year. He has management experience in the service industry and studied in France for six months prior to joining the HBA. He is originally from Fargo and is an avid soccer fan. “During my internship, I learned a lot about the inner working relationship between private and public entities,” he says. “I was also able to practice my writing skills, both professionally and creatively. Additionally, I had the opportunity to gain experience in office culture, something

that was new to me.” Pfau says that his favorite part of the internship was helping with events like the Red River Valley Home & Garden Show and the Spring Parade of Homes, as well as “getting to work with such an awesome staff.” Executive Vice President Bryce Johnson says, “Michael is the type of person who is enjoyable to be around and work with. He fit in right away with our tight-knit staff. He’s extremely positive, willing to take on any task, and puts the maximum effort into any project given to him. He is genuinely interested in what happens within the HBA of F-M whether it involves our public affairs issues, association management issues or our events and communications efforts. We will miss him, wish him the best of luck, and know that he will go far!”

The September issue will list all of the builders on the Fall Parade of Homes, as well as the addresses and prices of each home. The official Parade magazine will be available at all Hornbachers locations starting Sept. 21 and an insert will be included in The Forum Sept. 20. The Fall Parade of Homes runs Sept. 26-27 & Oct. 3-4, noon – 5 p.m. each day. The 4th Annual Remodeled Home Tour will run in conjunction with the second weekend of the Fall Parade, Oct. 3-4. August Building Official’s Corner Implementation of the new flood proofing requirements
Inspectors began implementation of the new flood proofing requirements quite some time ago. They have Ron Strand Fargo Inspections Administrator not been doing a “soft start” on this implementation as these are very specific requirements and tied closely to FEMA requirements. For that reason, you may have gotten the feeling of being taken by surprise, but this was never intended to be the case. Both Fargo Engineering and Inspections Departments have made significant efforts to make their application known to contractors, designers and the public through seminars, publications and news releases. In addition, Fargo provided a new and improved flood proof design document to strengthen our flood proof foundation requirements, safeguard property and safeguard the basement exemption we presently all enjoy. The HBA of F-M has also provided an alternative to some of the provisions of the Fargo design with an eye to make some alternatives available to certain aspects of that design. The HBA and city have worked closely to refine those designs. Remember too, that a registered professional engineer may also certify other designs as flood proof using the FEMA preconstruction flood proofing certification form.
As you plan your new projects for the future, make sure you are aware of the location of those projects with respect to the flood plain. Projects located in both the 100 year flood plain (having a 1 percent chance of flooding in any given year) and the area contained within the 41-foot river gage elevation are governed by requirements to safeguard them from flooding either through elevating the project or how the project is constructed (flood proofing). The more restrictive requirements of the two zones will govern. You can confirm your location and the applicable requirements by contacting either the city of Fargo Engineering or Inspections Departments.
Frequently Asked Questions
Q: Does the end wall blocking (blocking from end wall to parallel floor joists) of a floor structure in a flood proof structure have to be engineered? A: Yes, since designs have been prepared for that purpose, a design must be selected. Q: When is engineering design required for my foundation? A: Design is required for any foundation that cannot be judged to be empirical, for all flood proof foundations, for all pier foundations, for any damaged or potentially damaged foundations and for all foundations for which an inspection was not completed. Q: Will bracing requirements be changing again or can we rely on what we’ve come to understand over the last few years? A: The 2015 International Codes will contain bracing requirements that differ from those enforced in Fargo today. Q: Can I pour my foundation if I called to request the foundation inspection within the time requirements for that call and the inspector doesn’t show up? A: No, the inspector must either conduct the inspection or specifically authorize the pour to occur without the inspection. There is no implied consent to pour without the inspection. Q: I’ve heard that there have been changes to fastener requirements for decks in Fargo, is that true? A: The fasteners required for deck construction have always been dependent on the treatment used for the deck materials and/ or the connector manufacturers’ requirements for use of their products. Some recent inspections have revealed the use of improper fasteners, particularly in the case of use of nails for hangers. Always check for the proper type and size for the model of hanger you’ll be using.
2015 International Codes Hearings
It is once again time to update our adopted International Codes, which happens every three years. The Board of Appeals conducts detailed and extensive hearings which include review and analysis of the change to each of the codes. Those hearings stretch over the course of several months and are preparatory to the Board’s formulation of a recommendation to the Board of City Commissioners for their action. These hearings are your opportunity to affect change to the construction code requirements implemented for the city of Fargo and to be administered for the next three years. You should also remember the code modifications made during these hearings also have a very good opportunity to become a part of the state code adoption as well. By taking part in the hearings, you take part in shaping development in our community and state, plus participants in the hearings have an early idea of code changes that are occurring. HBA Continues Work to Help Builders with Projects in Oxbow After Judge Issues Injunction
by Chelsea Smith, Communications & Office Coordinator In May, a federal judge issued an injunction, forcing all working on the Oxbow ring dike to stop until the Minnesota Department of Natural Resources completes a study on impacts of the F-M Diversion. The HBA of F-M has been working closely with Oxbow city officials in hopes that the judge will reconsider the definition of the injunction. Read more of the initial injunction in the July Plains Builder. The HBA now knows that there are 16 builders heavily impacted by the injunction, but as of press time, the HBA is still gathering data. This injunction not only affects the builders, but home owners, trade partners and subcontractors. After speaking with seven of the 16 builders about trade partners and subcontractors, the HBA learned that 55 companies in Minnesota will also be impacted by the injunction, demonstrating that the impact reverberates through the chain. Since the injunction was issued, the city of Oxbow requested to be a defendant in the lawsuit which was granted by the federal judge in early July. Working with Oxbow city officials, the HBA has issued a declaration on behalf of the builders, trade partners and suppliers that are impacted by the injunction. The declaration outlines the negative economic impacts for all of the parties involved, and the stress placed on home owners, business owners, employees, trade partners and suppliers. The HBA also had the opportunity to speak at the Business Leaders Taskforce to express concerns about Oxbow and get the business community engaged in the issue.
HBA Members Travel to Grand Forks for Board ofLastDirectors Meeting month, a group of HBA members traveled to Grand
Forks for the North Dakota Association of Builders Board of Directors Meeting and Golf Tournament. Those attending were: myself, Clay Dietrich, Dietrich Homes, Inc.; Carlita Dietz, Jay Dietz Construction, Inc.; John Gunkelman, Dakota Dan Lindquist Construction of Fargo, Inc.; John Koerselman, Red River Dan Lindquist Drywall & Painting Services, Inc.; Tom Spaeth, Accent Construction, Inc. The meeting had a packed agenda, and I took away a couple of key points. It was discussed that the local association hosting the State Meeting will decide what the PAC fundraiser will be, rather than always having a golf event for PAC. I will also be a part of a working group trying to better define the make-up and protocol for the State Government Affairs Committee. The directors submitted John Gunkelman as an appointee for the North Dakota Building Codes Advisory Board. John Koerselman was named as the State Build-PAC Trustee. Implementing a Workplace Harassment Training for all State Board members was also discussed. Finally, after looking at the budget needs and not having an issues fund, a dues increase was disucussed, along with a possible implementation date.

The Association has closely monitored the situation, and members addressed the issue with North Dakota’s Congressional Delegation in Washington, D.C. • Representatives from the F-M Area Association of Realtors, HBA of F-M and the financial community met with Fargo officials on the rising cost of special assessments. • HBA requested, and was granted, a change with the city of West Fargo to allow a longer sewer pipe extension past the utility easement in new residential developments. The city is also considering a reduction in the width of utility easements from 10 feet to 5 - 7 feet by using duct banks for telecommunication wires. Both of these requests were made to increase safety and work efficiencies. • Hosted a local showing of NAHB's webinar and coordinated a lunch session with local experts on changes to closing disclosures. • Supported member company, First International Bank and Trust, by attending its customer appreciation event. • Hosted a press conference with local dignitaries recognizing June as National Homeownership Month in the F-M metro. • Met with representatives from the city of Fargo and the truss manufacturing industry on the requirement of overwidth permits for trucks. • Attended the Regional Workforce Study and Strategy Session hosted by the Greater Economic Development Corporation. • Attended the F-M Diversion Authority Meeting. • In addition to education and special meetings, five committees came together for regular monthly meetings, the HBA of F-M executive committee and board of directors met. NORTH DAKOTA ASSOCIATION OF BUILDERS This month, I wanted to point out some important legislation that passed nationally recently, as well as the National Association of Home Builders’ stance for our industry. On May 27, the Environmental Protection Agency and the U.S. Army Corps of Engineers finalized the long-awaited rule to define “waters of the United States” and the jurisdictional scope of the Clean Water Act. This rule takes LeRoy Kurtyka effect in August. It is important to NDAB President the homebuilding industry because it changes what areas can be regulated by the federal government under the act. Despite the agencies’ claims that this rule is narrower in scope than existing regulations, the final rule contains changes that could significantly expand federal jurisdiction, triggering additional expensive and time-consuming permitting and regulatory requirements. Waters of the United States: The Final Rule: NAHB Policy Calls on the Agencies: 1. To adopt regulations, guidance and policies asserting that “navigability” is the guiding factor to determine the geographic reach of the Clean Water Act, consistent with congressional intent. 2. To adopt regulations, guidance and policies asserting federal authority only over activities that “discharge” or “add” materials to jurisdictional waters. 3. In revising their regulations on the extent of Clean Water Act jurisdiction, to provide a set of clear and common-sense criteria that can be understood by those regulated and can be uniformly applied by the Corps and EPA field officers in all districts.
Why It Matters
Despite some improvements to the original proposal, the final rule contains overly broad language that could place millions of additional acres of private land under federal jurisdiction. The rule is so extreme that the federal government will actually regulate certain roadside ditches, isolated ponds and channels that may only flow after a heavy rainfall. This means, for example, that a builder in Arizona would have to get a permit for an activity in a dry desert wash that could be 30 miles from the nearest river. Such intrusive federal encroachment is bad governance and will inevitably lead to bureaucratic delays, increased project costs and mitigation fees, and ultimately, decreased housing affordability. This federal overreach goes well beyond congressional intent and the limits of jurisdiction set forth by the U.S. Supreme Court. The bottom line is that, contrary to this rule, EPA and the Corps must recognize there are limits to the reach of the Clean Water Act. Without these limits, home builders and developers must obtain costly federal permits even when their activities impact the most marginal features commonly found on private property.
Together Again
June was a busy month for many reasons, but for North Dakota Association of Builders Board of Directors it meant a chance to get together for our summer board meeting. The NDAB directors will once again be joining together in Dickinson Nov. 19-20 for our board of directors meeting, NDAB-PAC meeting and Annual Banquet. NAHB has been involved in trying to shape this rule since it was first proposed in April 2014. NAHB submitted extensive comments, urging the agencies to withdraw the rule and suggesting that Congress is better equipped to determine which areas should be affected by federal statute. NAHB also sought significant changes to make the proposal more understandable and workable in the field. NAHB continues to successfully engage legislators on this rule. With bipartisan support, the House approved H.R. 1732, the Regulatory Integrity Protection Act, which would require EPA and the Corps to withdraw their rule and develop a new plan to safeguard America’s waterways in consultation with state and local governments and other affected stakeholders, including small businesses. NAHB is also urging the Senate to pass companion legislation, S. 1140, the Federal Water Quality Protection Act. Now that the rule is finalized, NAHB is considering all of its options, including legal action. The U.S. Supreme Court has already ruled twice there are limits to the scope of federal jurisdiction under the Clean Water Act.

2015 Legislative Report, Hot Off the Press Session is over, and the dust has
settled. Membership with the Builders Association of Minnesota means access to a complete Legislative Report of what happened at the Capitol each year, what laws changed, and how it will affect your business. Regular session convened January 6 and thousands of bills passed both the House and Senate during the course of the regular session’s five-month duration. And yet, as the Legislature raced to its Constitutionally mandated adjournment date of May 18, 2015, the heavy lift of session was left undone – to pass a balanced budget for the biennium starting on July 1, 2015. Rather, the state witnessed a budget meltdown resulting in vast segments of the state’s budget to be undone or vetoed, leaving us waiting for special session to have resolution on many policy and budgetary items. Special Session was convened June 12, 2015, after a slew of meetings and negotiations between the Governor and House and Senate leadership. Six pieces of legislation were passed and signed by the governor completing the state’s next two-year budget. Approved were three revised omnibus finance bills that the governor had vetoed at the end of the regular legislative session and the passage of the omnibus Legacy funding bill, a bonding bill, and the Revisor’s bill, a technical corrections bill. The marathon special session concluded on June 13 with Governor Dayton signing all six bills into law and ending the threat of a partial

state government shutdown. Looking into the future, BAM expects the industry to lead on housing affordability and tort reforms, improving the code adoption process, seeking consumer protection statewide including code inspections and licensed builder enforcement, and making progress in the area of appraisals. Moorhead Requests Builders’ Partnership to Install Sidewalks In Moorhead, front yard sidewalks are required to be installed before buildings
are occupied. While this is not a new requirement, there are a number of neighborhoods where homes have been occupied for extended periods of time and sidewalks have still not been installed. Initial and subsequent home owners are not always aware of this requirement and are frustrated by the expense and coordination required to install the sidewalks after their homes are constructed. Surrounding residents are eager for walkable neighborhoods. It is the city’s preference that sidewalks be installed before occupancy whenever weather allows. There is provision within city code that allows the certification of occupancy before the sidewalk is installed if: • Owner/builder provides a signed contract for the sidewalk installation (to be completed within 60 days of certificate of occupancy or 60 days from when weather permits sidewalk construction), or • A petition is in place for assessment of the sidewalk cost under city contract. As you build homes in Moorhead, and as the city works to consistently address this requirement in new housing neighborhoods, we ask for your partnership. The city will uniformly enforce the sidewalk installation policy. Enforcement remedies allow the city to install the sidewalk and assess, or to withhold future permits until sidewalks are constructed, but we’d much rather work together with you to address this construction requirement. • Clearly identify the responsibility for sidewalk installation and payment in your bid documents; • Install sidewalks before the home is occupied; or • Submit a signed contract for sidewalk installation to the Engineering Department prior to requesting the certification of occupancy. With your next new home permit, you will receive a sidewalk installation acknowledgement as a reminder of the requirements discussed above. We will work to further refine sidewalk permit procedures in the coming months and plan to share an update before the 2016 construction season begins. Questions? Home Builders Post Strong Second-Quarter F-M Metro Permit Numbers
by Krista Mund, Communications Manager Midway through the year, new housing activity is off to its fastest start since 2005, according to the HBA of F-M’s second-quarter building permit report. With 611 housing permits through the end of June, the F-M metro community encompassing Dilworth, Moorhead, Fargo and West Fargo experienced a 22 percent increase over last year’s 500 housing permits. All four cities have seen an uptick over last year in both new housing and residential remodeling. Single-family homes increased by 46 permits community-wide, while twin-home construction saw a surge from 74 permits last year to 112 this year through second quarter. Row-house permits more than doubled, from 25 permits (64 units) to 59 permits (91 units). Housing permit values also grew, from just under $105 million last year to $129.6 million through June. Remodeling permits went from 922 to 1,044, but total valuation dipped from $15 million to $14.6 million. While total building permits are up 6 percent, total value across all communities through second quarter is down about 34 percent from last year. At $416.5 million, total construction value still exceeds the five-year average of $353.7 million. Total permits and values include housing, multi-family, new commercial, residential and commercial remodeling, public and miscellaneous categories. HBA of F-M Workforce Study
by Jenny Erickson, Director of Development & Education In April, the HBA of F-M asked members about their workforce. The Association is participating in a wider study being completed by the Greater Fargo-Moorhead Economic Development Corporation as many industries around our community are in need of employees. Twenty-seven members provided valuable information that will be helpful in promoting careers in the industry. The results are shown in the graphs to the right. The National Association of Home Builders has also recently released information compiled by the Bureau of Labor Statistics on careers in the construction trades. “Employment of construction laborers and helpers is projected to grow 25 percent from 2012 to 2022, much faster than the average for all occupations. Laborers and helpers work in all fields of construction and demand for these workers will mirror the level of overall construction activity.” (Bureau of Labor Statistics, U.S. Department of Labor, Occupational Outlook Handbook, 2014-15 Edition, Construction Laborers and Helpers.)
Regional Workforce Study completed
The Greater Fargo-Moorhead Economic Development Corporation, Fargo Moorhead West Fargo Chamber of Commerce, FM Area Foundation, FM Convention & Visitors Bureau and United Way of Cass-Clay spearheaded a regional workforce study. The results of the study were released in June and provided great information, as well as strategy, to fill the over 6,000 open positions in the Fargo-Moorhead area. In the Fargo-Moorhead area, the construction industry had the secondlargest growth with 7,653 jobs in 2004 to 10,434 jobs in 2014. Construction wages were found to be in line with the U.S. median average wages. The skills gap was acknowledged and reported to be a national problem. It is a gap that not only affects building but also 16

manufacturing and any other type of skilled trade. One of the reasons every company in the metro area seems to be looking for employees is that the region’s population increased 20 percent from 186,000 people in 2004 to 223,500 in 2013. The increase in population has a direct affect on the homebuilding industry. The unemployment rate in the area has remained below 4 percent and the labor force participation rate is 75 percent. These numbers mean that most of the people in the area that can work are working. The study came up with a framework to help address the need for workforce in the community. 1. Cultivate: strengthen the pipeline of local talent to support employers in the region. 2. Attract: enhance and coordinate efforts to bring new talent to the region. 3. Build: develop a framework for financial self-sufficiency and upward mobility for workers in basic-skill jobs. 4. Innovate: encourage the development of innovative solutions to address the region’s workforce-related challenges.

Howard has over 25 years of association experience and a lifetime in the housing industry. Howard began his association career at the National Association of Realtors, where he served as a legislative analyst for tax issues. Prior to joining NAHB, Howard served as the chief lobbyist for the National Council of State Housing Jerry Howard Agencies where he was instrumental NAHB CEO in the development of the low-income housing tax credit as part of the Tax Reform Act of 1986. Howard came to NAHB as tax counsel in 1988 and served in a variety of roles, including chief lobbyist. He was promoted to executive vice president & chief cxecutive officer in February 2001. Before embarking on his association career, Howard practiced real estate law in his home state of South Carolina. His exposure to the housing industry has literally encompassed a lifetime; he grew up working in a variety of roles for his father, a developer. Howard earned a bachelor’s degree from the University of Vermont and received a doctorate from the University of South Carolina. He, his wife Christina and their children Eirann, Meaghan and Sean live in Virginia, just outside of Washington, D.C. At the Oct. 29 meeting, Howard will give updates from the NAHB Fall Board of Directors meeting and talk about the current state of the industry, politics in Washington, D.C. and the presidential election. He will also take questions from our members via our polling software that we’ve been using at previous meetings. We will also announce the 2016 HBA of F-M board of directors and award the Builder of the Year, Associate of the Year, Extra Mile, BEAM (Builders Engaging Associate Members) and Spike awards. New Design Center Bridges Gap Between Lumber Yard and Architectural Services by Michael Pfau, Public Affairs Intern A few years ago, the design department at Simonson Lumber & Hardware, Inc., was just a couple of desks shoved in the corner of the store with two designers overloaded with work. Now, the new multi-level design center allows the designers room to create and provide a one-of-a-kind service to their clients. Constructed mostly of refurbished materials found in the lumber yard, the new design center is a sleek, modern space. Its functionality along with upgraded technology will allow the designers to complete more projects as their workload greatly expands. With clients in mind, the goals for the new design center were to improve not only the quality of the drawing, but giving clients a better of sense of where they’ll be living, says Brent Behm, resident designer. The upgraded technology and space allow the designers to create 3D versions of every project along with a digital copy. Using hyper-models, which is a combination of a 3D model and construction documents, clients can see a more detailed depiction of their home. It gives life to the design, especially when designers can add furniture in order to show a better scale of the home. The 3D versions are especially helpful when showcasing a lake front property, since a 2D drawing does not depict side slopes well. With four 3D printers, another interactive feature is available. Taking as much as 30 or more hours of printing, the model homes can come in different scales. This allows for a physical showcase of the project, adding even more depth. Yet, there is nothing like being able to physically walk around your future home. That is what Behm and Zak Skaro, a pro install salesman, demonstrated as they immersed me in a rustic Tuscan farm house overlooking the sea using the Oculus Rift, a virtual reality headmounted display. Touring the home, I was able to actually experience the 20

design, something that a 2D paper rendering could not possibly deliver. At Simonson Lumber & Hardware, Inc., there is a big push for improving design, like designing houses better adapted to North Dakota or getting away from conventional construction seen everywhere in the city, says Behm. Another element in improving design is promoting it through public education. The center will feature a design library that can house past projects and be a reference hub for clients. It will also allow for clients to come and design the whole house, including finishes such as sinks or light fixtures, items not found at Simonson. board of trustees spent time forming a strategic plan to make an even bigger impact in the next 20 years. Since 2013, Home Builders Care has continued to provide a positive outlet for the housing industry to give back to the community. Promoting the industry to young people and spurring interest in career opportunities has become more important than ever as every employer in the Red River Valley is looking for employees and providing great opportunities. Careers in trades must be promoted to young people as four-year liberal arts programs continue to be pushed and supported at many levels. Home Builders Care has been persistent in working with high school students and promoting opportunities like the Herdina Academy for the Construction Trades and promoting trades at the Health, Tech & Trades Career Expo. However, we have to start promoting trades careers even earlier. That was the driving force behind the Lego Home Building Competition. The first competition was a great success and we will continue growing this program. In 2016, the Lego Competition will be expanded to allow more students to participate and we will work to promote construction careers to the parents while fostering an interest in students ages 5-13. The Herdina Academy for the Construction Trades continues to be the best promotion of the construction industry, linking students with contractors. Graduates of the 2015 Academy took jobs with Swenson Masonry and Voxland Electric. That is the biggest success of the program: students finding jobs that they enjoy! Because the Academy is such a success promoting the industry, Home Builders Care and the Herdina Academy steering committee are evaluating ways to expand the reach. Regional Workforce Study Focuses on Affordable Housing
A regional workforce study was recently released by the Greater Fargo-Moorhead Economic Development Corporation, Fargo Moorhead West Fargo Chamber of Commerce, F-M Area Foundation, F-M Convention & Visitors Bureau and United Way of Cass-Clay. One of the strategies outlined in the Regional Workforce Study is “Build,” which includes priority projects that focus on affordable housing advocacy. The “Build” strategy includes increasing access to and the supply of affordable housing. Ensuring there is enough housing available for the growth of employees in the region is critical. HBA staff and Home Builders Care will continue to be involved with efforts of the greater community to find ways to increase the housing supply. Stay tuned as the HBA and Home Builders Care works to help HBA members continue to build affordable housing.

Regulatory Update at a Glance-Lead: Renovation, Repair, and Painting (RRP) Regulation Residential RRP Implementation
• On January 14, 2015, EPA proposed a rule to remove the hands-on training requirement for the refresher training course that EPA certified renovators must take to maintain their certification under the RRP program. • NAHB comments were submitted on February 13, 2015 in support of the EPA proposal to amend the refresher training requirements allowing for the course to be completed entirely on-line. • According to updated information recently released by the agency, EPA now anticipates publishing a final rule in December 2015. • On April 16, 2015 EPA published a final rule extending certain renovator certifications. This extension provides renovators whose certifications would have expired prior to EPA’s anticipated promulgation of a final rule amending the refresher training course requirements the time necessary so that they can take advantage of the savings offered by the rule. • The EPA extension impacts as many as 380,000 certified renovators out of an estimated 536,000 total renovators certified under the RRP program. • Remodelers and other contractors who got their EPA Lead-Safe Certified Renovator certifications on or before March 31, 2010, now have until March 31, 2016, to get recertified. • Remodelers who got their certifications between April 1, 2010 and March 31, 2011, will have 6 years to get recertified. • Certified renovators who received their original certification after March 31, 2011 will have 5 years to get recertified consistent with existing regulatory requirements under the program. • It is important to note: • The extension only applies to individual certification, not firm certifications. • The EPA extension of renovator certifications will not affect all certified renovators. The extension does not apply to renovators operating under one of the 14 state authorized programs regardless of when they originally got their certifications. • The 14 states authorized to administer the RRP program are AL, DE, GA, IA, KS, MA, MS, NC, OK, OR, RI, UT, WA or WI. • NAHB originally asked for an extension during a meeting with OMB staff in November 2014 and then called for a direct final rule in NAHB’s February comment letter on the proposed amendment. An extension was called for to provide the industry with needed certainty and ensure as many certified renovators as possible would have a chance to benefit from the savings offered by the proposal to amend the refresher training course requirements despite delays in finalizing the rule.
Lead Test Kits
• EPA was directed by Congress to address the lack of commercially available lead test kits and to identify solutions that would allow for an accurate test kit to meet the prescribed criteria under the 2008 rule. If no solution is reached by the end of the fiscal year, EPA should revisit the test kit criteria under the rule and solicit public comment on alternatives. • NAHB worked to secure inclusion of language with the FY 2015 final appropriations package. In response, EPA has scheduled a public meeting for June 4 to open the dialogue with stakeholders on the status of lead test kits in the marketplace. • Bob Hanbury, NAHB member and former Chair of NAHB Remodelers, will provide testimony on behalf of NAHB. He will highlight the real-world implications for remodelers and consumers working to comply with this regulation without the affordable, reliable lead paint test kit the rule was predicated on. His testimony will also offer EPA the following recommendations for moving forward given the increasing likelihood that a test kit that meets the regulatory criterion will not be brought to market. • Limit the scope of housing stock covered by the regulation to homes built before 1960 which have a greater likelihood of containing lead-based paint. • Revisit the issue of an opt-out or other regulatory alternative to ensure that the rule is effectively targeting the identified at-risk population present in target housing or child-occupied facilities. • Review and revise the economic analysis for the rule given that both the 2008 and 2010 analyses were predicated on the presence of a lead-based paint test kit that meets EPA’s regulatory criterion would be available. The new economic analysis should be undertaken separate from actions EPA is undertaking in other rulemaking proceedings. • EPA staff has indicated that this will not be the only opportunity stakeholders will have to weigh in on the issue.

HBA sets dates for certified lead renovator refresher courses
by Jenny Erickson, Director of Development & Education 2015 marks the five-year anniversary since hundreds of local contractors received their Certified Renovator designation from the Environmental Protection Agency to comply with the Renovation, Repair and Painting rule. It is required for all contractors disturbing six square feet or more in structures built in 1978 or earlier. Contractors must take a four-hour refresher course every five years to keep the certification active. Individuals who completed the initial renovator certification course accredited by EPA on or before March 31, 2010, must complete an EPA-accredited renovator refresher course before March 31, 2016, to maintain renovator certification. Individuals who completed the initial renovator certification course between April 1, 2010, and March 31, 2011, have one year added to their five-year certification. The refresher class and exam must be completed and passed before deadline or you will have to re-take the full eight-hour Certified Renovator class. The Builder member nominees will be evaluated on loyalty, ethics, trust, communication and consideration. HBA of F-M staff will compare those lists, and send common companies the Builder evaluation form. A committee of past HBA of F-M Associates of the Year reviews the evaluations and chooses a winner.

by Michael Pfau, Public Affairs Intern Dawn Schmitt, sales manager and Dawn Cruff, Luxury Designs interior designer at Luxury Designs has been involved with the Membership Committee for two years, and has been the chairperson since last year. “I had felt disconnected in the HBA, and another member suggested joining a committee,” Schmitt says when describing why she became involved. “This committee is all about new members, so I thought it would be a good fit for me.” After becoming involved with the Membership Committee, Schmitt realized the importance of this committee to the HBA. “It is so important to our organization that we keep members engaged. Our committee does that through suggesting ways to be involved and get the most out of their membership,” Schmitt says. In describing her favorite part of participating on the membership committee, “I get to call new members and find out more about their business. We have lots of interesting and fun HBA members.” Currently, the committee is working on ideas for a mentorship group along with ways to appeal to a younger membership.

by Chelsea Smith, Communications & Office Coordinator Scott Persoon, foundation superintendant for Camrud-Foss Concrete Construction, Inc., has been Scott Persoon, CamrudFoss Concrete Construction involved with the HBA of F-M for a little over a year. Persoon is involved in the education committee, where he focuses on education for HBA members with changing codes and recruiting young workers into various trades. Persoon was instrumental in helping create alternative methods for flood proof basements and spent a lot of time assisting the HBA with retaining the area’s basement exemption. The HBA is very appreciative for all of the time he spent helping with these topics! When he isn’t helping out the Association, Persoon likes to golf and spend time at the lake with his family.

Six times a year, the HBA staff chooses a “Member of the Month” to recognize volunteers who do something extra for the HBA. Each October, the Extra Mile Award is given to one of those members and is awarded at the HBA’s Annual Meeting.

Affiliate vs. Associate Membership: What’s the Difference? by Allison Weckman, Membership & Marketing Coordinator You may have heard about the HBA of F-M’s Affiliate membership, not to be confused with an Associate membership. Here’s a breakdown of what each is, including a visual representation:

communication from the HBA or discounts from NAHB or NDAB, that employee must become an Affiliate Member. An Affiliate membership covers only that single employee. • Dues are $50/year.

Associate Member:
• The company is a member of the association. The HBA of F-M has two member types, Associate and Builder members. Associate members are related to the homebuilding industry, but do not actually build or remodel homes. • Each Associate member of the HBA has a primary contact. This is the Association’s point of contact. In addition, this primary contact also can take advantage of discounts through the National Association of Home Builders and the North Dakota Association of Builders. • With an associate membership, any employee of the member company can attend events, take advantage of education courses, etc. All employees, besides the primary contact, are considered dependents of the member company. However, dependents are not able to take advantage of discounts through NAHB and NDAB. They do not receive direct communication from the HBA. • Dues are $525/year.
Affiliate memberships are good for: • A member company has multiple locations; having employees at multiple branches signed up as Affiliate members ensures that each of your locations is listed in the Membership Directory & Consumer Guide. See image below for an example. • An employee would like to take advantage of discounts offered through NAHB or NDAB, for example, the GM discount. In order to take advantage of the GM discount you need a PIN from NAHB. Only primary contacts and Affiliate members receive a PIN from NAHB. • An employee would like to stay up-to-date with happenings at the HBA including events, public issues, education courses, etc. Signing up as an Affiliate member would allow the employee to receive direct communication from the HBA. he National Association of Home Builders “BEAM” (Builders Engaging Associate Members) award is an honor bestowed on one Builder (or local entity) chosen by a committee of Associate members as the one who personifies the motto, “It’s good business to do business with a member.” The HBA of F-M names a winner on the local level that advances to the state (North Dakota Association of Builders) level, and possibly to the national level. The Builder member nominees will be evaluated for the business period of May 31, 2014 – June 1, 2015, on: • Loyalty • Ethics • Trust • Communication • Consideration Two Builder members who receive the most nominations will be notified and asked to submit their list of suppliers/trade contractors. HBA of F-M staff will compare those lists, and send common companies the Builder evaulation form. A committee of past HBA of F-M Associates of the Year reviews the evaluations and chooses a winner.

Each fall, two HBA of F-M members receive its highest honors: the Builder and Associate of the Year awards. The awards are based on work expended in the interest of fellow members, the Association and the community within the past year (Aug. 1, 2014 - July 31, 2015). These members are judged on:
1. Member Involvement and Industry Promotion (30 points) HBA of F-M involvement and what it has meant to the nominee personally and professionally over the years. The ways he/she furthers good business practices and promotes the home building industry to the general public. 2. Civic Activity (15 points) Local, state and national level participation in civic and service clubs, charitable activities, political commissions, fraternal or religious groups, etc. 3. Professional Accomplishments (20 points) For business owners, the development of his or her business from beginning to present. For employees of member companies, his/her role in the business and how he/she has developed it from the time started to the present. Also, actions taken to improve upon professionalism and/or role in the trades industry. 4. Local Association Activity (30 points) Association offices and committee work, special assignments, membership recruitment, etc. 5. State and National Association Activities (5 points) Offices held and committee work, attendance and participation at state and national conventions, director meetings, etc. Recipients of the Builder & Associate of the Year Awards will be chosen by a committee consisting of past winners, board members and HBA of F-M staff. The award will be presented at the Oct. 29 Annual Awards Gala. Local winners go on to represent the HBA of F-M for consideration in the North Dakota Association of Builders’ Builder and Associate of the Year awards selection in November.
