• Butler Machinery Co., Fargo, has hired Matt Cordell as a warranty analyst and Noel Saur as lead GPS specialist. Dan Butler was elected to the board of directors of the North Dakota Implement Dealers Association. He has been a member of the NDIDA board since 1999 and served as chairman in 2007. • Matt Nygard has been hired as a construction accountant at Roers Construction and Development, Inc., Fargo. Aaron Baldwin, Dave Bartell, Larry Bekkerus, Jim Sander, Al Sondrol, Ron Thoreson and Danny Wang have been recognized for 10 years of employment with the company. • Western State Bank has received the Patriotic Employer Award from Employer Support of the Guard and Reserve, a Department of Defense volunteer-based organization whose mission is to gain and maintain employer support for members of the National Guard and Reserve. • On Dec. 10, Realtors in the FargoMoorhead area and throughout North Dakota manned Salvation Army kettles during Realtor Bell Ringing Day and raised more than $50,000. The Fargo Moorhead Area Association of Realtors has donated more than $800 in gift cards and cash and over 200 toys, hats and mittens to the Stepping Stones Resource Center in Fargo. • Gate City Bank has donated $10,520 to Malaria No More, an organization that aims to end malaria deaths in Africa by 2015. The donation will purchase 1,052 mosquito nets, which will be sent to communities in Africa to help prevent the population from contracting malaria. Employees from Gate City Bank’s 32 offices participated in the fundraising. All funds raised were matched dollar for dollar by the bank. 2011 HBA dues are not deductible as charitable contributions

The 2011 dues payments to the HBA of F-M are not deductible as charitable contributions for federal income tax purposes. However, dues payments may be deductible as an

ordinary and necessary business expense, subject to an exclusion for lobbying activity. Because a portion of your dues is used for lobbying by National Association of Home Builders, North Dakota Association of Builders and HBA of F-M, the following portion is not deductible for Builder and Associate members: 16.49 percent of total dues: $65.15. Remodelers Council members: 14.72 percent of total dues: $7.36. Affiliate members: 14.53 percent of total dues: $4.36. Williams accepts job as Fargo public works service manager

Mark Williams has accepted a new position as the city of Fargo’s public works services manager. Previously, Williams was employed for eight years as the city of Fargo’s planner/zoning administrator. On Dec. 21, a group of students from Fargo North High School Construction Technology class completed an accessible entrance/front steps to help a homeowner with a disability remain in his home. The home is located at 2209 9th St. N. The students, led by North High senior James Simonson, saw a need and decided to help. They conceived the project and constructed it under their own initiative. Funding for the project was provided by a grant from Wal-mart and the students worked with the Fargo Department of Planning and Development to make the project a reality.

Builder performance guidelines required in Minnesota

As of Jan. 1, Minnesota builders must, by law, include a set of performance guidelines with the contract for customers. Guidelines are available at no cost to HBA of F-M members through the Builders Association of Minnesota. BAM’s Building Performance Guidelines were put together by a task force made up of its members. Countless hours were dedicated to creating and refining this document to provide the best possible product for builders. HBA sets priorities for 2011: Check out marketing opportunities to promote your business

The HBA of F-M’s priorities for 2011 were set at the January board of directors meeting. Much of what your Association does remains consistent from year to year: Membership and public affairs are always top priorities, but the items addressed change each year. Please read below for the details Tyrone Leslie in each section, many of which are Heritage Homes new this year. For 2011, I would like to challenge each of you to consider the HBA’s marketing opportunities through print and online advertising. The Plains Builder and Membership Directory & Buyer’s Guide are valuable resources to members and the public: They provide a great way for you to present your business as a member of the HBA and leverage your commitment to professionalism by being a member. Your HBA is also launching website advertising opportunities this year on www.hbafm.com. The website is viewed by thousands of consumers and members every week. Check it all out. If you are interested in the options, contact Jenny at (701) 232-5846 or jenny@hbafm.com. Of course, we also have priorities in public relations, education, PAC, charity, Past Presidents Council, communications and administrative. See our list below for details. Membership

• Recruit 65 new members (22 Builders and 43 Associates) with a retention rate goal of 93 percent. • Continue efforts to introduce the concept of micro-involvement while increasing committee involvement. • Focus on evaluating, improving and possibly eliminating (if unnecessary) current member benefits and programming. • Continue to concentrate on cost-saving measures and supporting current members in the challenging times ahead. • Explore ways to enrich the membership experience through involvement and networking, and offer more creative opportunities for members to market their services.

Public Affairs

• Work with the North Dakota Association of Builders to propose legislation and advocate for affordable housing, opposing unnecessary regulatory increases across the entire state of North Dakota and supporting infrastructure funding in oil-producing counties. • Promote cooperation with the Builders Association of

Minnesota through attendance at the Minnesota Builders Convention and Builder Day on the Hill. • Continue to monitor and support legislative efforts of BAM by facilitating more staff and local member involvement and contact with local and state legislators, as well as federal offices (limited to the districts the HBA covers). • Work with Fargo on establishing an ordinance for the planting and preservation of trees. • Expand the HBA’s relationship with other community organizations to further interests of home building and the business community. • Create community days at the capitols of North Dakota and Minnesota where legislators across the state can share ideas and concerns in an effort to strengthen bridges. • Establish a policy to guide the use of an issues fund (established in 2010) to support campaigns, measures and regulatory changes beneficial to the home building industry. • Continue promotion and education of the local tax incentives available to both consumers and the industry. • Continue to support efforts toward permanent flood protection on a metro-wide level. • Continue to work with Moorhead on lowering citywide special assessments and streamlining the development and construction process. • Maximize promotion of energy efficiency in new homes through tax incentives, building codes, appraisal process, etc. • Work with the F-M Area Association of Realtors to fairly represent the value of new homes when comparing to existing homes during the appraisal process.

Public Relations

• The HBA of F-M will continue to promote positive news happening within the industry while immediately addressing the negative. • Expand benefits to members by improving communication with the community, becoming the go-to source for consumers. • Educate consumers about HBA’s legislative successes impacting them. • Promote the National Association of Home Builders’ NFL Players Association program touting homeownership as the American dream.

Education

• Increase the number of member participants achieving professional designations offered by the state and national associations by providing University of Housing courses and applying for N.D. Professional Builder credit with NDAB. • Continue to offer the most current education on regulatory changes affecting the industry; examples are EPA (lead), building codes and storm water. • Stay on top of Minnesota Department of Labor and Industry regulations governing Minnesota contractor

One of our goals this year is to broaden the support for PAC by increasing the number of contributors. The National Association of Home Builders political action committee, BUILD-PAC, has created a new nationally recognized contributor level called the “Century Club.” This $100 level Tyrone Leslie Heritage Homes makes it easier for more members to help promote PAC and PAC Committee be recognized for their support. We hope that with increased Chair education and awareness of the issues our industry faces, fundraising will be able to grow on past successes. What is NDAB-PAC?

NDAB-PAC is the North Dakota Association of Builders’ Political Action Committee. It is a non-partisan political action committee that provides support for candidates who are friends of the building industry. People who show they care and are concerned about he building industry’s future make contributions to NDAB-PAC because they believe that cooperation equals strength.

Why does the HBA prefer that its members give to NDAB-PAC instead of BUILD-PAC?

NDAB-PAC is the North Dakota Association of Builders’ political action committee. The HBA of F-M prefers that its members give to NDAB-PAC because: • 30 percent goes to your local HBA for use in local elections • 30 percent goes to NDAB-PAC at the state level • 40 percent goes to BUILD-PAC at the federal level BUILD-PAC is the National Association of Home Builders political action committee. If you give directly to BUILD-PAC, the full amount will go to BUILD-PAC. Nothing is shared with the local and state associations. • On the state level, the NDAB-PAC Committee decides which candidates to support based on their voting record and merits. President’s message

The Legislative Session is moving along quickly, and there are close to a thousand bills already introduced. North Dakota Association of Builders is monitoring bills affecting our membership, and is present at the Capitol every day, protecting and promoting the interests of the home building Joel Fiest NDAB President industry. We have introduced a bill to revise the state law regarding architect requirements on buildings. Our bill proposes that architects are required on these private buildings: • All new buildings exceeding two stories in height (except private residences, farm buildings, and up to three-story apartment buildings) • New buildings with an occupancy classification having the most need for checks and balances: Assembly group A-1, Educational group E, High-Hazard group H, or Institutional group I • Building remodeling or addition projects if in or changing to one of the groups listed above. Currently, architect services are required on many types of private buildings “designed for occupancy by ten or more individuals,” as referenced in the International Building Code occupancy load information. Here are some examples and the maximum size of buildings, at which time the services of an architect are required: Maximum size; architect then required Garage...................................................................1849 sq. ft. Ensure contractors are licensed

We’ve been talking with Secretary of State Al Jaeger and his staff about problems with subcontractors working without a license. When confronted, they claim to be working under a general contractor, though the general Doreen Riedman contractor has simply hired them as a NDAB Executive subcontractor. Officer Subcontractors, and any firm that charges more than $2,000 on a job in the state, must be a licensed contractor, showing certificate of liability insurance and workers compensation coverage. We encourage members to help ensure that all contractors and subcontractors working in the state are licensed by the Secretary of State. Especially in areas around the state where there are more out-of-state contractors, we ask you to be “watchdogs” and report those who may be working without a valid license. If you suspect a contractor may be unlicensed, contact the Secretary of State’s office at (701) 328-3665. For more information on contractor licensing, visit the website at: www.nd.gov/sos. There are many reasons to be a member of the builders association. You get resources, information, education, events, advocacy and benefits from three levels: local, state and national. Here are some of the benefits from the Builders Association of Minnesota. 1: $10,000 in legal contracts, code guides and building best practices On the BAM members-only website (www.bamn.org) you have access to up-to-date contracts available in both pdf and word formats. Legal requirements frequently change, so it’s important your contracts and procedures reflect those changes. Login, click on Legislation/Legal, and look under Legal Resources. HBA of F-M members can log into the BAM website by calling the HBA of F-M at (701) 232-5846 to receive a username and password. 2: Building performance guidelines *NEW* Effective Jan. 1 you must, by Minnesota law, include a set of performance guidelines with your contract with customers. You can buy those guidelines, but as a member the guidelines are free. BAM’s Building Performance Guidelines were put together by a task force made up of BAM members who put in countless hours creating and refining this document in order to provide the best possible product for you. Minnesota’s Legislative Session kicks off Feb. 4

The Minnesota Legislative Session began Feb. 4 with the usual pomp and circumstance, but this year the legislature is already running at a sprint. The House and Senate have both already introduced bonding bills that are $300 million more than the Governor proposed. Minnesota economist Tom Stinson was quoted saying the Minnesota Legislature could stimulate the economy by funding building projects now. This year there will be an emphasis on “shovel-ready” projects. Check out both bills House File 2700, authored by Rep. Larry Hausman, and Senate File 2360, authored by Sen. Keith Langseth, at www.house.leg.state.mn.us to see if building projects are being proposed for your area. This session fiscal priorities will dominate due to the updated 2009 budget deficit of $1.2 million and the extended outlook of more than that for the 2010-2011 biennium. This year is an election year and every seat in the legislature is up for election or re-election including the executive branch. The Builders Association of Minnesota has two members running in the Minnesota senate elections. Jim Gander will be running against Senator Ann Lynch in Rochester and John Pederson is running for an open seat being vacated by Senator Tarryl Clark in St. Cloud. At the board meeting Jan. 8, 2010 the BAM Board approved legislative priorities for 2011. BAM will be lobbying and monitoring a number of issues that affect the residential construction industry. BAM’s Government Affairs Committee has started to meet on a weekly basis and BAM will be keeping you updated on what’s happening.

Looking at new rules from the Federal Reserve Board to ensure that appraisers remain independent when they are determining the value of residential properties, the National Association of Home Builders Residential Real Estate Appraisal Summit III in Washington, D.C., on Dec. 9 reviewed the significant headway that builders have made over the past year in addressing critical concerns over inaccurate appraisals and identified areas in need of further attention to resolve issues that have been impeding the sales of new homes. Under the direction of the Dodd-Frank Wall Street Reform and Consumer Protection Act, which was signed into law on July 21, the Federal Reserve is now receiving comments on an interim final rule that, among other things, forbids appraisers from being coerced to reach a targeted value on mortgage transactions secured by a primary home. The Fed rule will replace the Home Valuation Code of Conduct, which had the unintended result of appraisers limiting interaction and in some cases breaking off communications with builders and others who can provide factual information that can help ensure that valuations are accurate. Opening up communications in the appraisal process was one of the issues reviewed during the two previous NAHB summits, which involved active discussions among association members, industry partners and the housing government-sponsored enterprises. In a major development on June 30, Fannie Mae released new and additional guidance on its appraisal-related policies, providing good news on many fronts for builders who were being frustrated by faulty evaluations that were based on foreclosed or distressed properties as comparables or made by appraisers who lacked the appropriate knowledge and experience to complete assignments. Included in its clarification, Fannie Mae noted that authorized third parties, including builders, were allowed under the code of conduct to communicate with appraisers to provide additional information or explanation on the basis for a valuation or to correct factual errors in an appraisal report.

The critical piece for home builders

The Fed rule incorporates the key features of this guidance from Fannie Mae. “The Fed’s interim rule makes it clear that home builders and others can ask an appraiser to consider additional information about a property, including information about additional comparable properties,” said Joe Robson, NAHB’s immediate past chairman. “That’s the critical piece for home builders,” Robson said. “We must have a system in which our members can present additional information when the comps being

used are foreclosures and other distressed properties. Such properties simply do not reflect the value of a new home, which may have been built to new codes, may incorporate important green building features and may include new appliances and amenities that do not exist in the distressed property.” Robson noted that many appraisers still have a poor understanding of the many aspects of construction that add value to newly built homes, making it particularly important for builders to be allowed to provide them with relevant information. “While we have made progress at the regulatory level regarding the need for robust communication between the appraiser and third parties that can provide verifiable data, we have concerns that this message is not getting out to practitioners,” he added. “We continue to hear from builders that appraisers or lenders do not support third-party communication.”

Finding qualified appraisers for new construction

NAHB is in the process of developing a continuing educational curriculum to ensure that appraisers have the necessary experience and education to value new construction. However, builders are seeing licensed or certified appraisers who do not appear to be qualified to do appraisals of new construction. Appraisal con’t on pg 32

Adopt a student for the Construction Trade Academy For $75, you can support a high school student as he or she explores the world of construction. Parkinson wins 2010 ‘Extra Mile Award’

Over the past year, Parkinson has shown great leadership and a will to help the Association grow by helping gain new members and retain existing through chairing the New Member Development and Retention Committees throughout 2010. “Cary did an amazing job as chairman for the committee. During the last membership drive (Nov. 1, 2009 - Oct. 1, 2010) he recruited two members, has been devoted to retaining members and makes at least a dozen calls each week,” says Jennifer McKinney, HBA membership coordinator. Outside of the HBA, Parkinson is a member of the West Fargo Economic Development Advisory Committee and the Sales and Marketing Executives of Fargo-Moorhead. The HBA staff chooses “Members of the Month” six times throughout the year, and the Extra Mile Award is given in January to one of those people. These honors are to recognize volunteers who do something extra for the HBA.

Member of the Month: Kevin Gustman

Kevin Gustman works in the sales department for Twin City Garage Door, Inc. and is an extremely involved and dedicated member. Gustman’s involvement with the HBA of F-M began shortly after he began working at Twin City Garage Door, Inc. in 1986. Networking opportunities and keeping up-to-date on issues involving the building industry are what prompted him to intially get involved. Today he is involved in almost every area of the Association. He is a member of the Remodelers Council, attends almost every General Membership Meeting, recruits for membership drives, exhibits at the Home & Garden Show and the Fall Home Show and, on top of that, he volunteers a large amount of his time to help deliver a ton of World of Thanks packets to HBA members. “Kevin has been a tremendous help in any area he’s been asked. He is willing to volunteer his time, recruit, exhibit and much more. We, at the HBA, appreciate his dedication to the Association and are thrilled to have him as one of our members. HBA has homeowners’ manual template available for free

Two of the most important things a builder can do is make his or her customers comfortable throughout the home building process, and provide them with the proper information to take care of their home for years to come. Not only can a homeowners’ manual help you as a builder accomplish this, it may also help minimize call backs and offer you “protection” by proving you’ve taken steps to educate clients on the home’s operation and maintenance. The HBA of F-M has a template from the National Association of Home Builders available for its members to use and customize. Energy efficiency rebate money still available Federal tax credits extended to 2011

Builders, continue to urge customers to apply soon for the North Dakota Utility Rebate Program while its remaining $1.3 million rebate dollars are still available. North Dakota utilities, working in partnership with the North Dakota Department of Commerce, launched special limited-time rebate programs last summer after the state received funding for energy programs through the American Recovery and Reinvestment Act (ARRA). Federal tax credits for home energy efficiency improvements have also been extended for 2011, although at lower levels than last year. “There will never be a better time than right now to purchase energy efficient equipment,” said Mark Nisbet, North Dakota principal manager for Xcel Energy. “The rebates and tax credits make purchases much more affordable and you can reap the benefits of the energy savings every month on your utility bill. With a significant amount of rebate money still available, we encourage home owners and businesses to evaluate their options and consider making upgrades during the upcoming year.” Xcel Energy has four rebate programs available for homeowners: heating (for the purchase of energy-efficient furnaces and boilers), water heating, insulation and ground source heat pumps. Along with the ARRA rebates, residential natural gas customers may apply for existing Xcel Energy heating and water heating rebates, further increasing their savings. Cass County Electric Cooperative has rebates available for ENERGY STAR qualified heating, ventilation, air conditioners, water heaters, insulation, lighting, air-source heat pumps, geothermal heat pumps, renewables, and more. Currently, the dollar value remaining available for co-ops is about $1.2 million. Residential customers can receive up to $5,000 in rebates. Businesses can qualify for rebates by purchasing energy-efficient boilers, furnaces and lighting equipment. Each business can qualify for up to $15,000 in rebates. Qualifying equipment must have been purchased after June 1, 2010. Rebates will be available on a first come, first served basis until the funding is depleted or until December 31, 2011.

Utilities urge caution during snow removal

Local communication and electric utilities are urging caution when doing snow removal. With such a large accumulation of snow, utility boxes can quickly become buried due to the piling and drifting of snow. In such instances, the utility boxes become invisible to those doing snow removal and have the potential of being hit by snow removal operators. Damage to utility boxes can cause severe communication and electric power outages, and is potentially dangerous to those that might come into contact with the damaged equipment. Utilities are requesting that property owners keep utility boxes marked or clear of snow. Snow removal operators are urged to find out where utility boxes are located before moving snow by contacting area utilities for assistance. Student Chapters at the International Builders Show

At the 2011 International Builders Show, Jan. 12 – 15 in Orlando, three of our local student chapters attended the show and participated in the Residential Construction Management Competition. Students from North Dakota State University, North Dakota State College of Science and Minnesota State University Moorhead travelled to Orlando and competed against 46 schools from around the country. The student groups began working on these housing projects back in September of 2010 and made their final presentations to a panel of judges during IBS. The competition is a great way for students to get a feel for bidding a project and presenting their company to prospective clients.

OSHA makes changes to residential fall protection requirements

The Occupational Safety and Health Administration on Dec. 22 withdrew the Plain Language Revision of OSHA Instruction STD 3.1, Interim Fall Protection Compliance Guidelines for Residential Construction. First issued in 1995, the directive was a source of confusion among home builders over what fall protection methods and systems should be used to comply with OSHA’s fall protection standards. The confusion stems from the variety of sources of fall protection compliance information that builders and trade contractors need to find, read, understand and then follow. To understand what they need to do to protect workers, builders have to read OSHA’s fall protection regulation, then read the interim fall protection guidelines and then find the 25 or more letters of interpretation of what is required. Because falls continue to be the leading cause of costly accidents, injuries and even fatalities in the home building industry, NAHB is actively engaged in seeking solutions to address this very real and serious problem. Concerned that the interim guidelines were making the work environment less safe for employees on the home building site, NAHB in April 2008 asked OSHA to withdraw them and instead follow the fall protection regulations in OSHA standard 29 CFR 1926 Subpart M, which allows residential construction employers some flexibility in providing fall protection systems. This important enforcement policy change will require employers to take additional steps to ensure worker safety when working six feet or more above a lower level. The new Compliance Guidance for Residential Construction will go into effect on June 16, 2011. Among the significant changes resulting from the withdrawal of OSHA STD 03-00-001: • Roofing contractors must use guardrails, personal fall arrest systems (harnesses and lanyards) or safety nets on all roofs with slopes exceeding 4-in-12 when working six feet or more above a lower level. • All other trade contractors must use guardrails or personal fall arrest systems (harnesses and lanyards) or safety nets when the height from one elevation to another is greater than six feet. However, employers who can demonstrate that these fall protection systems are not feasible or create a greater hazard can use a plan outlining alternative fall protection measures that must be followed. • The fall protection plan must be in writing and site-specific. However, a written plan developed for repeated use for a particular model or style of home will be considered

site-specific. • The use of fall protection plans is limited to “residential construction” in which the structure will be used as a home and constructed with traditional wood frame materials and methods (although the limited use of structural steel in a predominantly wood-framed home — such as a steel I-beam to help support wood framing — does not disqualify a structure from being considered residential construction). NAHB expects the OSHA policy change to ultimately make it easier for home builders to understand what's necessary to achieve compliance, to ensure safer worksites and to reduce the occurrence of costly accidents. Meet your HBA board of directors: Nancy Kelly

Nancy Kelly is in charge of sales and marketing for Heartland Labor in Fargo and has been with the company for a year and a half. She got involved with the HBA of F-M about 15 years ago after Terry Cullen, Cullen Insulation, Inc., (a board member at the time) encouraged her to become Nancy Kelly Heartland Labor involved. “He told me it was a fun organization and would be a good thing to get involved in for networking purposes and also for long lasting friendships,” says Kelly. Over the 15 years of her involvement, Kelly has been involved in countless ways. She is currently serving her second term on the board of directors and served as secretary and associate vice president in the past two years. She is also a member on the New Member Development Committee and the Public Affairs Committee. She donates to NDAB-PAC and volunteers for World of Thanks and the Herdina Academy for the Construction Trades. She has also helped raise money for Lake Agassiz Habitat for Humanity’s Tour de Habitat bike race and has been a member of a competing team. Kelly was also voted as Associate of the Year in 2008. As a member of the board Kelly sees it as an important part of the Association. “The board is a cross-section of Builders and Associates who bring a variety of ideas, knowledge and opinions to the membership,” explains Kelly. “Having this group of people of all areas of the industry come together helps keep our Association on top of everything affecting the building industry as a whole.” Kelly has always enjoyed her time serving on the board and looks forward to fulfilling her second term. She said that the friendships she’s made are incredible and it’s a great feeling to know that you have made a difference in the Association. “Getting involved in the Association at any level really gives you an idea of the pulse of the organization. I really encourage all members to get involved so they can experience what I have,” she says.

MSUM student chapter update

Brooks Duesterhoeft, 2010 Minnesota State University Moorhead Student Chapter president, gave us some insight on what it’s like to lead a National Association of Home Builders student chapter. The MSUM Student Chapter, CM Society has over 40 members and is active with the HBA of F-M and NAHB in multiple Brooks ways. At the local level, it participates in Duesterhoeft MSUM Student the Fall Home Show and Red River Valley Chaper Home & Garden Show by helping exhibitors move in and out. At the national level, it sent a team to compete at the International Builders Show, Jan. 12-15 in Orlando. The team competed in the Residential Construction Management Competition. Duesterhoeft, originally from Miesville, Minn., just graduated from MSUM with a degree in construction management. He has already gained some experience in the field already from interning last summer with Park Construction Company where he was able to work on a pump station project in Devil’s Lake, N.D.

HBA: How did you become interested in construction?

Duesterhoeft: “My dad has his own small construction company. When you grow up around that and are constantly being involved with construction, it’s hard not to be interested. Since then my interest has continued and I still enjoy it.”

HBA: What are your responsibilities as president of the CM Society, the MSUM NAHB Student Chapter? Duesterhoeft: “My responsibility as 2010 president was

The Appraisal Foundation's Appraisal Practices Board is in the process of establishing minimum education, experience and examination requirements for real property appraisers. In response to a draft of the board’s qualification criteria for appraisers — which are not likely to take effect until Jan. 1, 2015 — NAHB said appraisers must have adequate knowledge of lot values and new home construction when they are establishing values for newly constructed homes. “It is necessary that an appraiser of new construction make every effort to obtain comprehensive information on the subject property, including lot values, custom features, upgrades and energy efficiency data,” NAHB said. “A new construction appraisal requires the appraiser to have the ability to read plans, review the materials description lists and evaluate the builder’s contract and any other special additions.”

HBA: What were the goals of your student chapter for 2010?

Duesterhoeft: “We had goals to place well in both the ASC (Associated Schools of Construction) competition and the IBS competitions.”

HBA: What are some of the projects the student chapter was involved in this past year?

Duesterhoeft: “We were involved in the HBA of FM’s Home and Garden Show, Fall Home Show, Adopt A Highway along Interstate 94 and competitions. I’m sure the chapter plans to be involved in all of those again in 2011.”

HBA: What was your favorite part of belonging to the student chapter?

Duesterhoeft: “Definitely meeting people within the industry and making connections that will help me out for future career opportunities.”

HBA: What do you like about MSUM and its program?

Duesterhoeft: “There are a ton of opportunities to get involved with various things such as the CM Society and competitions. There is a great push we get from the program to start getting involved early to help us out in the long run.” 2011 President Darren Dell took over Duesterhoeft’s position as president in January.

In markets where new home sales have been exceedingly slow, finding comparable properties has been difficult. “We have experienced wild fluctuations of real estate values during this current housing downturn,” said Robson. “Never before have we faced the level of foreclosures and short sales. In some markets and some situations, foreclosures do accurately reflect market value, but we have seen case after case where foreclosed properties have become the standard comparable.” Robson said that inaccurate valuations have unnecessarily contributed to the downward spiral of home values, with distressed sales adversely affecting values and unjustly undermining what should have been healthier neighborhoods. Builders at the summit expressed concern that the new Fed rules might not allow appraisers to look at the sales contract, which should have some relevance because it is an indication of what a buyer in the market is willing to pay for the property. It appears that the Fed rules do not prohibit the appraiser from receiving the contract, as long as it is provided for information purposes and there is no coercion involved. Parade rules

A home may be occupied by the builder provided it was completed after Jan. 1, 2010. Homes may be entered in four consecutive Parade of Homes after the home was completed. Any new home that has never been occupied by a consumer and was built after Sept. 1, 2009, may be entered in the Parade of Homes. ANY new home that has never been lived in by a consumer AND is less than two years old is eligible for the 2011 Spring Parade. • Builders must include their contractor’s license with the Parade registration. • Builders only must sign the paperwork to submit home entries for the parade. • Builders must submit full-color renderings of each home model. If the builder does not have access to these services, BuilderFusion can assist in creating a full-color rendering at a fee of $300 per model. • No late entries will be accepted and no late fees will be assessed. • Only completed homes may be open during the Parade. HBA makes advances on strategic plan

Last spring, HBA of F-M leaders formulated a three-year strategic plan for the Association. The group consisted of HBA directors, committee members and staff. Facilitators from the National Association of Home Builders traveled from WashingBrent Atkins ton, D.C., to conduct the planning session. Minnkota The HBA’s mission statement remains the same: “The misWindows, Inc. sion of the Home Builders Association of Fargo-Moorhead is to provide quality services, benefits and education to our members and the community. Striving to be a visible and proactive influence, the association represents the collective interests of the home building industry.” At the March planning session, we discussed four areas critical to the HBA and formulated objectives and strategies (listed to the right). The planning group appointed me to monitor the plan and work with staff to make regular reports to the board and membership. A common theme in this strategic plan is the need to communicate “return on investment” to the current membership and demonstrate the HBA’s positive impact on the community to consumers. In these challenging economic times, our leaders identify the importance of showing members what they are receiving for their dues, as well as increasing the HBA’s good works in the public’s eyes – which will positively impact members, too! Progress: Staff is working on articles to run in the Plains Builder showing how much an HBA membership saves for members through member discounts and benefits. It also developed a PAC accomplishments flyer detailing money saved for members through state and national legislative achievements the past two years. We will also look at innovative ways to attract new members, but realize that “closing the sale” will be harder than in the past. This ties in with using our return-on-investment information and legislative achievements to convince nonmembers of the need to join. The plan also directs the HBA to look at the reach and methods of our communication to members and consumers. Progress: HBA staff has set up Facebook pages for the Association and its public events and is regularly marketing them to members and the public. The board has included in its priorities for 2011 to explore expanding technological communication options for use with the membership: smart phone apps, texts and website. Online interactivity of our Plains Builder, Membership Directory & Buyer’s Guide and public event guides is in the works as well. Leaders want to see staff, directors and committee chairs maintain a personal touch with members, and this intent will be kept in mind at all times. Sometimes all it takes to get someone involved is personal contact over a cup of coffee or a phone call. Progress: Committees are making an effort to grow themselves by members that are already active talking to other members about getting involved. Committee chairpersons are also charged with extending contact to existing committee members to keep that “personal” touch going. Government affairs has grown immensely in the past ten years. Our goal is to keep that momentum rolling and build on it; this is the basis of our existence, so it is critical. Every effort will be made to involve more members, build better relationships with government officials and communicate our successes effectively, which goes back to communicating return on investment. Progress: We have started 2011 off with a bang, working with the F-M Chamber of Commerce, Convention & Visitors Bureau, F-M Area Association of Realtors and Greater F-M Economic Development Corporation to organize “City Days on the Hill” in both Bismarck and St. Paul. We hope to increase our area’s visibility with legislators and expand communication on our indus-

Your HBA is also organizing members to participate in the North Dakota Association of Builders’ and Builders Association of Minnesota’s legislative events at each capitol. Operations speaks for itself: we must maintain the financial health of the HBA in uncertain economic times, increase our non-dues revenue efforts and keep a quality staff in place. Progress: Staff and the board of directors have proposed a balanced budget for 2011 and are keeping in mind the need for cuts if participation in our public events declines. We are also looking at ways to increase advertising participation by members to supplement non-dues revenue in that way. HBA members earn professional designations through NAHB, NDAB by Krista Mund, Communications Manager

HBA holds class to help members with designations The HBA of F-M is holding “Building Technology: Systems and Interior Finishes” 8 a.m. - 4:30 p.m. Feb. 16, in Fargo. This class focuses on the main elements of the mechanical and interior finish systems used in residential construction. It explores plumbing systems, heating, venting and cooling systems, electrical systems, and interior finish systems. By participating in this course, you will be able to: • Identify the various codes and requirements that impact the design and installation of mechanical and interior finish systems. • Define common terms and elements used in mechanical and interior finish systems. • Identify the factors that impact the selection or upgrade of mechanical and interior finish systems. • Explain installation techniques for wall and floor systems. • Identify criteria for evaluating the performance of mechanical and interior finish systems. This class will help any builder working towards a Certified Graduate Builder designation as well as provide continuing education credits for Certified AgingIn-Place specialists, Certified Graduate Remodelers, Certified Green Professionals, and more! This class has been approved for seven hours of contractor continuing education by Minnesota Department of Labor and Industry, including one hour of energy. A designation from the National Association of Home Builders or the North Dakota Association of Builders says a lot about a builder, remodeler or building industry associate. Professional designations offer excellent opportunities for HBA of F-M members to improve skills, advance their careers, and be recognized for their commitment to professional growth. NAHB has several designations for builders, remodelers and associate members. Your HBA of F-M is making efforts to recognize those members who have earned their Certified Graduate Builder, Certified Graduate Remodeler, Certified Green Professional, Certified Aging in Place Specialist or North Dakota Professional Builder designations. You will see that we have highlighted those members in the 2011 Membership Directory & Buyer’s Guide and will highlight those members in the guides for the Parade of Homes and Home Shows. The goal is to educate consumers on what it takes to attain these designations and to give more value to the members who choose to earn them. Here is an explanation of the designations the HBA is highlighting: National Association of Home Builders designations www.nahb.org - Click on “Tools” and “Find Professional Builders and Remodelers and Related Providers” NAHB has the most targeted curriculum, accomplished teachers and widely respected education opportunities in the business. • Certified Aging-In-Place Specialist (CAPS): teaches technical, business management, and customer service skills essential for aging-in-place markets. • Certified Graduate Builder (CGB): exclusive designation designed to emphasize business and project management skills. • Certified Graduate Remodeler (CGR):exclusive professional designation to emphasize business management skills as key to professional remodeling. • Certified Green Professional (CGP): teaches builders, remodelers and other industry professionals techniques for incorporating green building principles into homes—without driving up the cost of construction. Professionals with home building designations To earn designations, members must take NAHB-approved through National Association of Home Builders courses from a set curriculum and keep up with continuing or North Dakota Association of Builders education. North Dakota Professional Builder designation www.ndbuild.com North Dakota Professional Builders (NDPB) are required to: • Meet membership requirements of its local association. • Must have held a contractor’s license in the state of North Dakota for at least two years. • Comply with all appropriate North Dakota statutes concerning contractors. • Build in compliance with appropriate local, state and national building codes. • Adhere to the Code of Ethics of NDAB. • Complete seven hours of continuing education annually. NDAB makes its best effort to determine a builder’s qualifications for certification as an NDPB. While the program recognizes the professionalism of a builder, NDAB does not make any warranty or representations, express or implied, to home buyers or others. Additionally, it has not inspected the construction of any home and, therefore, does not and cannot address the specific quality of a home. 2011 PLT Code Changes and Review This 8 hour session covers the 2011 National Electrical Code changes that affect installations done on technology circuits by power limited technicians. In addition, common violations of the limited energy NEC articles will be addressed.

About the instructor: Tim Pull, instructor at North Dakota State College of Science for 24 years in the electrical department, has a master electricians license for Minnesota and North Dakota. He has done more than 100 NEC classes through the outreach and customized training division of NDSCS.

EPA Remodeling, Renovation & Painting (RRP) Rule Effective Feb. 1, 2011 - Minnesota now requires lead certification when issuing permits

Municipalities will be verifying lead certification for residential builders, remodelers, roofers and manufactured home installers when requesting a permit to work on homes constructed prior to 1978.

Effective April 22 - building and remodeling firms must have one or more “certified renovators” assigned to each job where lead-based paint is disturbed. Eight hours of training is required to become a “certified renovator.”

In addition to having a certified renovator(s), firms working in pre-1978 homes will need to submit an application to become certified before offering or performing the work covered under the rules. The EPA has up to 90 days to certify or recertify a firm once it receives a complete application. • Firm certifications cost $300 and are valid for five years. • Firms must apply for re-certification. The EPA RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation. The term renovation covers all activities done for compensation that disturb painted surfaces including most repair, remodeling and maintenance activities such as window replacement, weatherization and demolition.

What structures? The RRP rule applies to all renovation work performed in residential houses, apartments and child-occupied facilities such as schools and daycare centers built before 1978.

To become certified, a renovator must successfully complete an EPA or stateapproved training course. All renovation workers must be trained. Renovation workers can be trained on-the-job by a Certified Renovator to use lead-safe work practices, or they can become Certified Renovators themselves.
