Public Issues Report of Area Affairs Interview with the expert: Sneak peek at 2014 Minn. session

Editors note: Redmond Associates is a lobbying firm that represents Builders Association of Minnesota at the capitol. Here is a sneak peek of the 2014 session from Brain Halloran. Question: This upcoming Minnesota legislative session is commonly known as a “bonding” session; tell us a little bit about what that entails. Answer: Minnesota operates on two-year biennial cycles. The 2013 session was the first year of the biennium, so the principle responsibility of lawmakers was to pass a budget to fund state government for fiscal years 2014-15. With that $38 billion blueprint set, lawmakers will focus on crafting a public works borrowing package or “bonding” bill. Members of the Capital Investment Committees (in the House and Senate) are traveling the state to review projects that enhance and/or build infrastructure like bridges, roads and transit, convention centers, water treatments systems and education facilities. There are nearly $3 billion in requests by state agencies and local governments. I expect the overall bonding package to be in the $850 million range. Last session gave us a glimpse of the contours of what the 2014 session’s bill may look like when an $800 million bill narrowly failed in the House on a mostly partisan vote. Whatever the ultimate size of the bonding package, it will have to include some bipartisan cooperation. For most legislation to pass, a simple majority is required; bonding bills, however, have a higher standard for passage set at three-fifths majority. The current balance of power holds at 39 democrats and 28 republicans in the Senate, and 73 democrats and 61 republicans in the House. Bonding bills are always complicated jigsaw puzzles to compile so I expect session 2014 to be no different. Q: Session is starting unusually late; how might that impact lawmakers’ legislative agendas and pacing? A: The Minnesota Constitution says, “the legislature shall not meet in regular session, nor in any adjournment thereof, after the first Monday following the third Saturday in May of any year.” Translated that means lawmakers must complete their work by May 19, 2014. Legislators set their official start date for Feb. 25, 2014, leaving less than three months to complete their work.

Advocacy

What your Association did for you in November 1. Gathered Minnesota-area builders to meet with Rep. Ben Lien and discuss topics such as licensing and permitting practices, the sprinkler mandate in Minnesota, continuing education for residential versus commercial contractors and enforcement issues with the Minnesota Department of Labor & Industry. 2. Met with city of Moorhead staff and leadership on the Minnesota Administrative Law Judge hearing regarding a sprinkler mandate. In addition to learning how the city is proactively helping to provide witnesses and testimony on the negative effects the mandate would bring to border cities, HBA staff also helped define the city's role in the process and provided feedback and information on the issue. 3. Coordinated with Builders Association of Minnesota to provide additional materials and assistance for the ALJ hearing, while also distributing the link to BAM's sprinkler mandate petition. 4. Coordinated a training session between Fargo builders and city of Fargo Inspections Administrator Ron Strand. He covered the city's adoption of a new building code and items expected to cause some concern amongst the builders and inspectors.

News from the National Association of Home Builders recession. Also at the top of the list of smaller metros are Housing markets continue Casper, Wyo.; Bismarck, N.D.; and Grand Forks, N.D., respectively. slow climb back to normal Dec. 5 - Markets in 54 out of the approximately 350 metro areas nationwide returned to or exceeded their last normal levels of economic and housing activity, according to the National Association of Home Builders/ First American Leading Markets Index (LMI), released today. The index’s nationwide score of .86 indicates that, based on current permits, prices and employment data, the nationwide market is running at 86 percent of normal economic and housing activity. The LMI figures for November showed that 55 housing markets were operating at or above their last normal levels and the nationwide market was operating at 85 percent of normal growth. LMI data for the two months were released simultaneously because of the delay in collecting data during the partial government shutdown in October. “This index shows that most housing markets across the nation are continuing a slow, gradual climb back to normal levels,” said NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. “Policymakers must guard against actions that could impede or even reverse the modest gains of the past year.” Noting that smaller metros accounted for most of the 54 markets on the current LMI that are at or above normal levels, NAHB Chief Economist David Crowe said that “smaller markets are leading the way, particularly where energy is the primary economic driver. Nearly half of the markets in the top 54 are in the energy states of Texas, Louisiana, North Dakota, Wyoming and Montana.” “The fact that more than 125 markets on this month’s LMI are showing activity levels of at least 90 percent of previous norms bodes well for a continuing housing recovery in 2014,” said Kurt Pfotenhauer, vice chairman of First American Title Insurance Co., which co-sponsors the LMI report. Baton Rouge, La., tops the list of major metros on the LMI, with a score of 1.42 – or 42 percent better than its last normal market level. Other major metros at the top of the list include Honolulu, Oklahoma City, Austin and Houston, Texas, as well as Pittsburgh – all of whose LMI scores indicate that their market activity now exceeds previous norms. Looking at smaller metros, both Odessa and Midland, Texas, boast LMI scores of 2.0 or better, meaning that their markets are now at double their strength prior to the

The LMI shifts the focus from identifying markets that have recently begun to recover, which was the aim of a previous gauge known as the Improving Markets Index, to identifying those areas that are now approaching and exceeding their previous normal levels of economic and housing activity. More than 350 metro areas are scored by taking their average permit, price and employment levels for the past 12 months and dividing each by their annual average over the last period of normal growth. For singlefamily permits and home prices, 2000-2003 is used as the last normal period, and for employment, 2007 is the base comparison. The three components are then averaged to provide an overall score for each market; a national score is calculated based on national measures of the three metrics. An index value above one indicates that a market has advanced beyond its previous normal level of economic activity. Editor’s Note: In calculating the LMI, NAHB utilizes employment data from the Bureau of Labor Statistics, house price appreciation data from Freddie Mac and singlefamily housing permits from the U.S. Census Bureau. The LMI is published on the fourth working day of each month, unless that day falls on a Friday -- in which case, it is released on the following Monday. For historical information and charts, please go to nahb. org/lmi.

Interview con’t from page 11

What this means in a practical sense is that in order for most legislation to be successful, it must be introduced early in session (or even before it starts), vetted quickly and pass aggressive committee deadlines. While committee deadlines are not yet set, policy deadlines will likely be mid-March. Q: The term “Unsession” has been used. What is that and what are your thoughts on the impact of the “Unsession” discussions? A: While legislators will be engaging in the usual plate spinning necessary to move multiple priorities simultaneously, Gov. Dayton has added another “plate” in the form of “Unsession” reforms. Earlier this year, he began floating the idea of eliminating outdated statutes and improving government efficiencies. He has since instructed his administration to gather ideas along those lines, and has asked the public and the legislature to do the same. A website has been created to collect suggestions and I’m told around 1,600 ideas have been offered. It is too soon to tell how much traction this reform initiative will get. Q: Despite pressure on lawmakers to keep the 2014 agenda limited to bonding and “Unsession” work, what other issues are likely to surface? A: Even with talk of limited time and legislative appetite, expect to see activity on a broad suite of issues such as:

NDAB holds Annual Meeting in Williston

In late November, I traveled to Williston with my fellow HBA of F-M members and HBA Public Affairs Coordinator Mike Obach to attend the North Dakota Association of Builders’ Annual Meeting and Awards Dan Lindquist, Banquet. The event began with a Dan Lindquist briefing on current Bakken Formation Construction, Inc. oil production methods, held at the regional headquarters of StatOil, Inc. We were then treated to some very informative, albeit chilly, site visits – first to a currently drilling rig that had drilled to over 19,000 feet, then to a location that had four wells currently pumping all at once. This was a very educational experience, and it was great to be able to learn so much about what is developing for our neighbors to the west. After the tour, we went to the Director’s Reception hosted by Ken Callahan of the Williston Area Builders. We all want to thank Ken and his wife Joann for their tremendous hospitality. Everyone enjoyed themselves very much. The Annual Meeting began Friday morning. It was held at the Grand Williston Hotel and was directed by 2013 NDAB President Eid. There was a video message from the new NDAB Executive Officer Kim Schneider, as well as a presentation on deed tax reform from Rep. Scott Louser of Minot. We also enjoyed the attendance of the National Association of Home Builders’ third Vice Chairman of the

Minimum Wage The Legislature will try to increase the minimum wage above the current $6.15 per hour. The Senate legislation was at $7.75 per hour and the House was at $9.50 per hour, but both bodies could not come to agreement on a final package before session ended in 2013. Healthcare As you know, Minnesota has launched its own version of the Accountable Care Act (federal health care law). Expect adjustments to that rollout to continue, and much debate to follow. B2B Taxes The B2B issue will certainly be an issue of discussion. Some legislators have expressed an interest in adjusting or eliminating the new B2B taxes on warehousing, labor and telecom. The challenge will be to find the money to pay for the adjustment (through more taxes and/or new cuts) since those new dollars were used to craft the FY 2014-2015 budget. Brian Halloran has been successfully representing clients on behalf of Redmond Associates since 1996. He specializes in lobbying and client strategy development. Halloran was recognized in MN Law and Politics “Top Lobbyists” story as an “Up and Comer” in the field early in his career. He was also selected as a Humphrey Policy Fellow and is a regular speaker to groups about lobbying and public affairs. Board Ed Brady from Bloomington, Ill. Brady shared much insight into national issues, and frequently expressed how impressed he was with the dedication of NDAB’s members. He also shared an update on the restructuring of the NAHB web site. A major discussion topic was on effects of infrastructure needs for home building in western North Dakota. There was also lengthy discussion on how we can improve our relationships with state legislators prior to the 2015 legislative session. The board also voted to keep John Gunkelman on board as NDAB’s State Representative. The Awards Banquet was held that evening, along with a silent auction to benefit NDAB-PAC. The auction garnered over $6,000 for our political action committee. For awards, Mike Hophauf of Bismarck won NDAB Builder of the Year, while Chip Shea of Grand Forks won NDAB Associate of the Year. It was a wonderful event, and we appreciate how well the Williston Area Builders took care of us. I encourage more of our local members to get involved with NDAB, and plan to attend future events. It is an outstanding opportunity to get to know our colleagues from across the state. Members that attended Annual Meeting: John Gunkelman, Dakota Construction of Fargo, Inc.; Jason Eid, Eid-Co Buildings, Inc.; Carlita Dietz, Jay Dietz Construction, Inc.; Don Dabbert, Jr., Dabbert Custom Homes; Terry Lipp, Ferguson Bath, Kitchen & Lighting Showroom; Tom Spaeth, Accent Contracting; Sylvia Lunski, Design Direction, Inc.; Darrick Guthmiller, Kochmann Brothers Homes, Inc.

HBA of F-M Builder and Associate Member Feature Benjamin Custom Focal Point Homes, LLC Kitchens

Offering creative solutions for clients

“Your vision is our focus” by Megan Vry, Office Support

“Your vision is our focus,” says Justin Stevens, shop manager for Focal Point Kitchens. Stevens liked to be hands on in high school and knew Justin Stevens Shop Manager he had a knack for building when he always finished the required projects before the rest of the class. Since he was so far ahead, Stevens was able to be creative and work on other larger projects such as entertainment centers, night stands and dressers. This was the moment he decided to give a career in cabinetry a try. At age 17, Stevens graduated from Fargo South High School and started his first cabinet shop that summer. It wasn’t until February 2010 that Stevens started Focal Point Kitchens, inspired by the saying “kitchens are the focal point of the house,” and opened a shop in Davenport, N.D. At the beginning of Focal Point Kitchens, Stevens followed demand. The company started building custom kitchens for homes out west, mainly in Minot. Focal Point Kitchens was trying to make a name for itself in hopes that one day it could secure jobs in the Fargo-Moorhead and lakes areas. Stevens has now been in the custom cabinet industry for 12 years with a four-person shop dedicated to quality and the support of his wife, Brittnee; a baby boy, Landon; and a black lab puppy, Ruby. Stevens says “We have one of the best teams that puts out a quality product in a timely fashion, making lead times less than most shops.” Interestingly, Focal Point Kitchens not only does kitchens, but covers any room that needs custom cabinets: bathrooms, bars, offices, mantles and anything in between. In fact, Stevens’ versatility and his custom finishes make his work unique. He always strives to provide the latest and greatest finishes from paint to spray stain and glazing to weathered looks. When asked what he likes about his work, Stevens replied, “I enjoy working on the job site and meeting people. The greatest reward is seeing the final product and the customer’s reaction when they see my work.” Like most business owners involved in the home building industry, big challenges have a tendency to always be present. Stevens’ biggest hurdle is getting his name out. He is working on a website that should be up and running around February (along with a new show room) and he uses a Facebook page to help spread the word about Focal Point Kitchens. The company has exhibited in the Fall Home Show and Home & Garden Show hosted by the HBA of F-M.

Benjamin R. Anderson grew up in Lisbon, N.D. where he attended Benjamin Anderson high school and started building full President size movable homes (1,600 sq. ft. and larger) with his father. When Anderson was 16, his family decided to move to Frazee, Minn., where he finished high school and graduated in 2004. Following graduation, Anderson attended North Dakota State University and worked with Benjamin Homes Construction as a subcontractor for a variety of different area builders. Anderson graduated in 2009 from NDSU with bachelors of science degrees in business administration and political science with a law emphasis. A year after graduating from NDSU, Anderson founded Benjamin Custom Homes, LLC. Anderson started his company by building full-size, movable homes in the “speculation market.” He served a market area when construction logistics may be a problem and where moving a house to a new foundation, “is the most pain-free construction technique” says Anderson. Anderson offered customers the ability to acquire a custom home and have it placed on a foundation or basement in half the time of standard techniques. Even though custom building is the main focus of Benjamin Custom Homes, LLC, the company also offers products which are in his words, “limited only by the imagination of our clients.” By using innovative methods or products Anderson is able to solve any client’s needs. Whether the need is a living space underneath garage floors, custom handicapped-accessible showers and vanities, Anderson and his team at Benjamin Custom Homes, LLC can do it all. Currently, Benjamin Custom Homes, LLC, specializes in custom exteriors ranging from roofing to siding and windows to doors. The company also offers asphalt, steel, and rock-coated steel roofing products. Since the company uses a wide variety of unique products, including steel, vinyl, cement board and LP products, the client can get exactly the look he or she wants. As Benjamin Custom Homes grows, Anderson noticed HBA of F-M’s vast presence in the F-M area through its events like the home shows and the parades. That presence was the main influence for Anderson in his decision to join the Assocation. As a new HBA member, he looks forward to the growth of his company by participation in the HBA events and becoming an active leader. He wants to encourage others to “choose an area which you are passionate and focus on that. Don’t try to be the jack of all trades because you may never master any at all.”

HBA of F-M Industry Spotlight Bath Fitter • Angela Kohout

2500 Cleveland Ave. N. • Roseville, MN 55113 (651) 645-1100

What is your company’s focus?

“Bath Fitter is the original, and still the best, at acrylic tub liners and surrounds. We are the only company in the industry with a custom seamless wall - no silicone or grout in the corners! We can redo a tub and/or shower in as little as just one day! We custom manufacture and install easy to clean, life-time warranted products in many designs to fit your lifestyle and budget.”

What is the latest trend in your industry?

“Top trends are to remodel with all ages in mind and to “age in place.” Home owners are asking themselves, ‘Is this going to work for me now, in ten years and for my grandkids if they are over?’ Using glass and subway patterned tile is a popular choice in the bathroom, in basic colors, as these materials are an investment. Customers are choosing to add color with accessories and on the walls where it is easier to change when the trend does. They are looking for style, function, ease of maintenance and durability. “Our Bath Fitter products fit the bill. That is one of the reasons Bath Fitter had one of our best years ever in 2013!”

What do you think is the biggest challenge facing the industry today and how are you dealing with it? “Competition. We have to be better than ever at educating our customers as there are so many choices and similar products out there. In the end, we want happy customers, so we have to make sure we are meeting their expectations. Honesty and integrity are what we strive for so that the whole process from Bath Fitter staff members show their the appointment to the install goes smoothly. Communication holiday spirit. is key!”

How do you plan to advertise your remodeling projects in 2014?

Consider being a part of the 3rd Annual Remodeled Home Tour, Sept. 13-14, 2014 by Alison Streyle, Events Coordinator

The HBA of F-M expects to see an increase in the number of projects on the third annual Remodeled Home Tour and, if you have a project you want to show off, this is the perfect avenue for your company to advertise.

See what the Tour provides for you (what it would cost an individual company):

• Television ads on both network and cable channels ($1,000) • Multiple radio ads on over ten stations in the F-M area (at least $1,500) - Plus, possibility to get a live remote from entry location! • Three print advertisements in the top three area magazines related to the industry (approx. $2,000) • Half-page dedicated to your project (includes company logo, website and phone number) in event magazine ( printed - distributed in The Forum and available at all Hornbacher's) ($1,000) • Promotion on HBA of F-M website and InForum website, social media, poster distribution to community businesses ($1,250) • Hundreds of consumers interested in remodeling directly in front of your project... priceless! TOTAL: $6,750 in promotion Entry cost: $600 (1st entry) | $225 (additional entries) If you have the perfect project – make sure to start planning TODAY. Talk with the home owners and get everyone on board now as the project is still in progress. Working with your home owners from the get-go allows for any questions and arrangements to be taken care of and planned out. Consider different options to offer the home owner that may help them agree to their home being a part of the Tour. Here are some great options: • Offer a price break or discount on their project. • Offer the painting of another room in the home. • Offer a cleaning service to come in after the Tour is completed to get their home back to normal. • Reserve a room for them at a hotel (in or out of town, depending on their preference) to give them somewhere to stay while the Tour is running. • Buy them a gift card for dinner out on you so they don’t have to worry about cooking and cleaning before the Tour begins the next day. Choose what works best for you and then offer some options to your home owner so he or she can pick what is most beneficial to them! Working on this now helps them stay calm and excited about the Tour instead of creating stress and anxiety about having people in their home, etc. We want this event to be exciting and fun for everyone involved: “The Tour is a unique opportunity to get remodelers, home owners interaction with consumers directly in front of and consumers. Entry work you've done, letting them see the results of applications will be sent your products and/or services, ask questions and out in June, but feel free to talk with them about their potential projects. to contact the HBA of We can attribute several appointments and sales F-M at (701) 232-5846 or directly to the event and exposure was great!” – info@hbafm.com at any Ursula Hegvik, Smart Spaces, Inc. time with questions or concerns.

A few of the volun

Judge Eric Lippman presided over the one-day hearing that featured passionate testimony, both for and against fire sprinklers. BAM presented a myriad of evidence that showed hard-wired smoke detectors are far more effective than sprinkler systems when it comes to saving lives. Since mandatory inclusion of detectors became code, there have been zero deaths in Minnesota in new, single-family construction for at least 10 years. There was opposition from the Minnesota Fire Marshals Union, along with members of the National Fire Sprinkler Association, who claim that sprinklers would provide an additional measure of safety. Dietrich argued that the main concern is getting people out of the danger immediately, which smoke detectors do, and that properly trained fire fighters know whether or not to enter a suspicious structure. He testified that any code changes should provide real solutions, not expensive fixes (like fire sprinklers) that a home owner could easily and legally shut off. Dietrich also made the point that the leaders in the Minneapolis/ St. Paul metro need to understand how detrimental this requirement could be to border markets such as Moorhead and Duluth. Now that the hearing is over, Judge Lippman has opened a comment period from now through Jan. 2. During this time, anyone for or against sprinklers can submit evidence and/or written supporting testimony. Then, there will be five days for rebuttal, closing Jan. 9 and the judge will make his ruling. The HBA will be following the results and will keep its members informed.
