Share Support of Diversion Financial Plan With Commissioners

The financial plan released by the Diversion Authority in May shows one way to fund and finance the F-M Area Diversion project; the plan calls for an extension of existing sales taxes, but requires no tax increases and no use of special assessments. Cass County Commissioners and Fargo Commissioners will now consider specific ballot language and whether this is the best funding method to put on the November ballot. Please share your support of the financial plan with commissioners and ask them to approve adding sales tax extensions to the November ballot. Turn to page 9 for talking points and contact information. It’s refreshing to say that the F-M community has been reaching milestones when it comes to the F-M Area Diversion. 1. The Minnesota Department of Natural Resources Environmental Impact Study came back saying it does not identify any additional reasonable alternatives to the Diversion Project. 2. Fargo, Moorhead, Cass County, Clay County and Cass County Joint Water Resource District have all signed the Joint Powers Agreement which is critical to secure federal funding for construction to begin on the Diversion in August. As federal sponsors, Fargo and Moorhead also approved an additional contractual agreement with the federal government called a Project Partnership Agreement. Now is not the time to pause on the F-M Area Diversion. Without its protection, 20,000 home owners in Fargo-Moorhead will see incredibly high increases in flood insurance premiums in as little as four years.

One of your HBA of F-M’s core objectives is to advocate on your behalf at the local, state and national level. We’ve been busy hitting all three levels. 1. Locally, we’ve been constantly monitoring politics related to the Diversion, sending messages to our membership as needed and contacting officials as time neared to approve critical agreements. 2. At the state level, we hosted leaders from across the state in Fargo to participate in the North Dakota Association of Builders board meeting and legislative social with state legislators. Advanced Engineering and Environmental Services has hired Dan Hanson as an electrical engineer and Tammy Jo Anderson Taft as a communications specialist. Hanson earned a bachelor’s degree in electrical engineering from North Dakota State University. Previously, he worked as a senior sales engineer for Square D by Schneider Electric. Shawn Tennyson has been promoted to senior vice president of marketing at Bell State Bank & Trust. Tennyson earned a commercial art degree from Minnesota State Community and Technical College. He joined Bell State Bank in 2014 and previously served as project management director on the marketing team. Rick Ohren has joined the JK Property Partners team at Berkshire Hathaway HomeServices Premier Properties. Ohren is a licensed Realtor in North Dakota and Minnesota. He will concentrate on residential properties at BHHS as a buyer specialist. Joseph Rizzo of Beyond Shelter has earned the designation of Housing Credit Certified Professional from the National Association of Home Builders and NAHB Multifamily. Lies joined Wells Fargo in 2003 as a credit manager for Wells Fargo Financial in Jamestown, N.D., and was promoted to branch manager. North Dakota Association of Builders Comes to Fargo

by Krista Mund, Executive Vice President June 15-16, the HBA of F-M welcomed the North Dakota Association of Builders to Fargo for its summer board meeting and legislative social. Board and PAC meeting discussion included: • North Dakota building code hearings will be July 7-8 in Bismarck, and the new code will become effective Jan. 1, 2017. For NDAB-PAC: • 2015-2016 cycle goal is 42,480.89. • So far North Dakota has raised $68,786.66 or 150 percent of the cycle goal. (That number does not include over $7,000 that was just sent to NAHB BUILD-PAC.) Diversion Authority Releases Financial Plan: Contact Commissioners to Express Support The Diversion Authority’s financial plan released in May shows one way to fund and finance the F-M Area Diversion project.

It calls for an extension of existing sales taxes but requires no tax increases and no use of special assessments. Please contact Cass County Commissioners and Fargo Commissioners to share support of the financial plan. Soon, they will be considering adding sales tax extensions to the November ballot. Reasons to support the F-M Metro Flood Protection Financial Plan: • The current Metro Flood Protection Financial Plan is affordable. • Extension of existing sales taxes represents a multi-generational approach to ensuring the long-term financial health of the project: • Without property owner payment of special assessments • Without increasing taxes, after voter-approved extension of existing sales taxes • Cass County half-cent sales tax • Fargo half-cent sales tax passed in 2009 • Fargo half-cent sales tax passed in 2012 • Fargo one-cent sales tax – one-quarter cent dedicated to F-M Area Diversion passed in 2006 • Financial plan includes multiple delivery models • Fargo in-town flood mitigation designed to support Diversion, not replace, as protection • U.S. Army Corps of Engineers will use traditional design-bid-build for Southern Embankment • Diversion Authority using innovative public private partnership (P3) delivery model to design, build, finance and maintain the Diversion channel

Overview of NAHB-OSHA Overtime Rule Confined Spaces Rule Settlement Doubles Salary The National Association of Home Builders (“NAHB”) has reached a settlement with the Occupational Safety and Health Administration (“OSHA”), Threshold, resolving NAHB’s legal challenge to OSHA’s Confined Spaces in Construction final rule, issued May 4, 2015. NAHB filed a Petition for Review of the rule in the Takes Effect U.S. Court of Appeals for the Fifth Circuit. The settlement, reached after months of negotiations with the Agency, clarifies Dec. 1 that the rule has a very limited application in the residential homebuilding industry. OSHA has published a lengthy set of “Questions and Answers” (“Qs and As”) that describe application of the rule to common spaces in the residential homebuilding environment, such as attics, basements, and crawl spaces. The entire Qs and As are published here: https://www.osha.gov/ confinedspaces/. The Qs and As define “residential home building” or “residential home construction” as work on any residence being built using traditional wood frame construction materials, methods, and procedures that are typical to single-family home or townhouse construction. Traditional wood frame construction materials and methods include (1) framing materials – wood (or equivalent cold-formed sheet metal stud) framing (not steel or concrete), wooden floor joists and roof structures; (2) exterior wall structure – wood (or equivalent cold-formed sheet metal stud) framing or masonry brick or block; and (3) methods – traditional wood frame construction techniques. Work on multi-family residences may also be considered “residential home building” or “residential home construction” provided that the work similarly meets this criteria.

Application of the Rule Limited in Residential Home Building

The Qs and As clarify that the vast majority of the rule’s requirements only apply to permit-required confined spaces; attics, basements, and crawl spaces in a residential home will not typically trigger these requirements. They also clarify that the mere presence of physical hazards (such as electrical equipment and mechanical hazards) in a space in a residential home would not make the space a permit-required confined space under the rule. The presence of physical hazards would only make a space a permitrequired confined space if an entrant has exposure to a serious hazard and the exposure could impede the entrant’s ability to exit the space without assistance.

Attics will Rarely Be Considered Permit-Required Confined Spaces

In guidance material issued by OSHA shortly after the rule was published, OSHA suggested that attics in residential homes could regularly be considered permit-required confined spaces. The Agency has since withdrawn the OSHA Fact Sheet on “Confined Spaces in Construction: Crawl Spaces and Attics.” Instead, the Q and As now clarify that attics will rarely be permit-required confined spaces as they typically do not contain the types of hazards or potential hazards that make a confined space a permit-required confined space. OSHA also clarifies that the performance of duties outside of an attic would rarely turn a “confined space” into a “permit-required confined space” because that work is unlikely to create a hazardous atmosphere or physical hazard in the attic that could impede the ability of an entrant to safely exit the space without assistance. The Qs and As also state definitively that the presence of asbestos in a confined space in a residential home would not trigger the permit-required confined space requirements.

Initial Evaluation of Space Does not Require a Physical Survey The rule requires an employer to conduct an initial evaluation of a confined space to determine if it is a permit-required confined space as defined by the

May 18, 2016 NAHB today blasted the Department of Labor (DOL) after it issued its final overtime rule, stating that the regulation will hurt the workers it is intended to help while also causing major harm to the nation’s small business owners. In a hard-hitting official statement, NAHB Chairman Ed Brady said: “The sheer arrogance displayed by the Department of Labor in failing to heed the concerns of the nation’s small business community will result in severe repercussions that will harm workers, small businesses, housing affordability, job growth and the economy. “By radically doubling the current overtime salary limit of $23,660 to $47,476, this blatant regulatory overreach will essentially hurt many of the workers the rule was meant to help. Small business owners across the land, including the vast majority of home building firms, will be forced to scale back on pay and benefits, as well as cut workers’ hours in order to avoid overtime requirements and remain in business. “Congress can play a constructive role by moving quickly to pass the Protecting Workplace Advancement and Opportunity Act (House bill H.R. 4773 and Senate bill S. 2707), legislation that would force the agency to withdraw this rule until it has considered the effects it would have on small businesses, consumers, workers and the economy.” The rule, which will take effect Dec. 1, indexes the salary threshold to inflation every three years, forcing employers to go through this process on an ongoing basis. Moreover, the huge spike in the overtime threshold could force many employers to convert salaried employees to hourly workers in order to remain solvent. You will often read about, or hear us talking about, NDAB-PAC and BUILD-PAC. NDABPAC is the North Dakota Association of Builders’ Political Action Committee. It is a non-partisan political action committee which provides support for building-industryfriendly candidates. NDAB-PAC recognizes there is strength in numbers. People who show they care and are concerned about the future of the building industry make contributions to NDAB-PAC because they believe that cooperation equals strength. You, alone, can’t influence the Legislature or Congress on issues that can devastate your business. NDAB-PAC is your front line of defense. It monitors legislative issues and works to protect and promote the building industry. NDAB-PAC’s ability to defend and promote your business rests squarely on the financial support it receives from members. By pooling contributions from NDAB members, NDAB-PAC is able to help elect legislators who understand and support the issues and concerns of members. You can also choose to contribute to BUILD-PAC, the National Association of Home Builders’ Political Action Committee, one of the most recognized and well-respected PACs in Washington. Recently, we offered up a challenge to our NDAB-PAC Trustees to educate our members on the importance and value of PAC. Those that contributed at a level of Century Club ($100) or higher were gifted a set of NDAB Pilsner glasses. The number of glasses received was based on the level of contribution. Our valued volunteer PAC trustees stepped up to the challenge and blew us away! We had many new supporters step up, some supporters raised their contribution level and others renewed their contribution. For more information, please contact our office or reach out to your local association to speak to your local Executive Officer or PAC trustee. November will be here shortly and that means election time once again. These PAC funds will go toward local legislative candidates and other statewide office holders, just as donations went out for city commission and mayoral candidates during the June election. Members had an opportunity to speak with some of these candidates at our Birdie with the Builders legislative social held last month at the Fargo Air Museum. There were over 150 people in attendance! Participation is Key

To all of those that were able to make it to Fargo for our NDAB meetings, I would like to take this time to thank you for attending, and to thank you for taking time out of your busy schedule. It is truly great to see the attendance growing at NDAB Meetings. I can see how passionate our group is about our industry and how we are trying to make a

difference. Our summer event in Fargo was a great success. We had representation from all six locals and many elected officials. It was amazing to talk with our elected officials about the building industry. The one thing that I have noticed over the last year is that our officials are talking with us and looking to us for input. We need for them to understand our industry and the importance it has on the economy at the local, state, and national levels. On June 14, we had the N.D. primary, many local elections and we will have one more go-around in November. As a builders association, we need to reach out to all elected officials, as well as to all those that are on the ballot in November, and make sure we are included in the discussions when it comes to the building industry. When November rolls around, we need to make sure we are voting for the people on the ballot that are supportive of the building industry. Aug. 8-11, NAHB is having the mid-year Board of Directors Meeting in Miami. Hopefully we can get all of our local HBAs, along with NDAB, to have representatives attend. I encourage you to make the trip and see what it is all about. Get involved in all three memberships, your local, NDAB, and NAHB. The more we get involved, the more our voices are heard. Forx Builders Association builds a house each year with the trade students at Northland Community & Technical College. Bid packages were let and opened already for the 2017 Project House. With the retirement of Loren Abel after 30 years as residential carpentry instructor, new instructor Chris Swenby is taking over those duties. Congratulations to both Loren and Chris. • Our Annual Golf Outing is on the calendar for Sept. 15 at the Grand Forks Country Club.

• Members met at The Post for the Annual Scholarship Picnic. Donations from the event fully funded the BSC scholarships that the BMHBA gives each year. • Members met with officials to encourage continuing property tax exemptions on new construction. • Builder members participated in “Get it Sold,” a facilitated sales training that tied into leads generated through the Spring Parade of Homes. • The BMHBA is teaming up with the BismarckMandan Development Association, Chamber and Bismarck-Mandan Board of Realtors to host infrastructure discussion forums. The events will educate members on current and future needs and serve as a strategy session for financing ideas. • The Annual PAC Golf Tournament is July 12 at Prairie West Golf Course in Mandan. 2016 Session: Our $4 Million Success, Expanded 6-Year Code Cycle, and Other Legislative Wins

In the 2016 Minnesota Legislative Session, many of the big issues facing the State of Minnesota went unaddressed by the lawmakers. With no tax relief bill and no bonding bill passed during the regular session, talk continues to revolve around the possibility of a special session. Compromise, however, seems unlikely. During these times of political gridlock, it is a good idea to reflect on what was accomplished for the building industry. Believe it or not, the Builders Association of Minnesota was able to secure $4 million from the legislature for the Construction Careers Foundation. This supports ongoing efforts to attract middle and high-school-aged youth to the construction industry! Our members – from the Twin Cities to far reaches of the state – need workers, and the Builders Association of Minnesota was successful in working with the legislature and stakeholders to achieve momentum in the right direction. By working with the bipartisan House and Senate authors, testifying at the legislature, and having our members speak with their legislators, we were able to secure this important funding. BAM extends a huge thank you to Sen. David Tomassoni (DFL-Chisholm) and Rep. Jason Rarick (R-Pine City) for their commitment to this important issue! BAM also had the pleasure of working with the Minnesota Mechanical Contractors Association, other partners in the craft trades, as well as the Department of Labor and Industry, to secure this funding.

Committee members were pleased with the outcome of the event and want to extend a thank you to all those who were able to attend. The committee is working hard to reach out to members who have not attended an HBA event in the past due to cost, limited availability or just not feeling comfortable in an event setting. These happy hours have been a great way to meet fellow industry peers in a relaxed setting. The HBA and its leaders want to be able to serve you and are always looking for new ways to make the Association valuable to you. The Membership Committee has moved its monthly

meetings to be a “traveling” happy hour for the summer whenever possible. If you have some great ideas for engaging new, young, or life-long members come to the next meeting. BEYOND THE BUILDING by Sami Eidenschink, Membership & Marketing Coordinator You can see it from miles away, but do you know what goes on inside the giant All Finish building that sits adjacent to Interstate 94? The HBA got the chance to tour the 30,000 sq. ft. facility recently and found there was a lot more than meets the eye. When you first walk up to the door, you feel like you might be headed into a new hotel in town, or maybe a conference center to watch your favorite band. Although the exterior seems most important, what is on the inside really counts. From floor to ceiling, and back down to the tiny accents and details, All Finish wants to show you what it can do as soon as you walk through the door. There are offices, shops, inventory and acres of All Finish equipment. But beyond the interior looks, it is so much more! It is full of employees who enjoy their jobs and make up what All Finish is all about, and it starts with Chad Ohnstad. Ohnstad is president of All Finish Concrete and has been working in the industry since age 23. Ohnstad started his company seven years ago with just three guys on the team. Since then, they have grown to an operation of 20 crews. How did All Finish grow so quickly? Ohnstad credits his employees. “It comes back to the employees; you need to find the best people to do the best work,” he says. Whether his employees are on-site or off working on a job, you can easily see how valuable they are to All Finish. It has its: incorporated a new system so everyone can see where a project is at and who is working on it just by looking at the TV monitor. So whether you are in the shop or upstairs in the conference room, you are constantly working as a team. Although they have teams that specialize in commercial and residential, Ohnstad’s

favorite work is in the residential sector working alongside local builders who have helped make All Finish what it is today. All Finish Concrete is a one-stop concrete shop. It has in-house concrete pumps, telebelts, cranes for flatwork, specialized crews for floor coatings, decorative concrete and grinding and polishing concrete. For foundations, they use aluminum wall forms and lay out each foundation with a robotic total station which helps create a more accurate layout of the walls. There are a lot of unique pieces to what makes up All Finish and the HBA is excited to have them be a part of the Association! As he looks forward to 2017, Ohnstad hopes to get more involved in the HBA through its various committees and events and continue giving back to the trades that helped him start a company he’s dreamed of, in an industry he loves.

July Member of the Month

by Chelsea Smith, Communications Coordinator Six times a year, the HBA of F-M staff recognizes a “Member of the Month”. This recognition goes to a member who has gone above and beyond to support the Association and staff. The HBA would like to congratulate Diana Stead of Stone Holding Company for being chosen as July’s member of the month. Stead has been a longtime supporter of the HBA, with over 20 years of involvement. Her involvement with the HBA all started from her passion to connect. “It isn’t a question of whether the HBA of F-M is valuable to businesses, it’s discovering what that business finds valuable and making that connection,” Stead says. Stead is the 2016 Remodelers Council Chair and is involved with the Events Committee. “It’s all about the connections,” she says. Stead stresses the importance of getting out of your office and making an effort to attend a monthly committee meeting, or making it to a few events a year. These meetings and events help the member discover what is important to them and how they can make the most of their membership. Not only is she involved in the Remodelers Council and Events Committee, Stead is passionate about working with homelessness, troubled youth and is taking ministry classes on motivational speaking. Through her passions, she has become involved in a collaborative project between Dakota Boys & Girls Ranch, Home Builders Care of Fargo-Moorhead Foundation and the Remodelers Council. The Association is working with Dakota Boys & Girls Ranch to fix and maintain a

property that houses twelve previously homeless kids. Stead has been instrumental in rallying to get donations and involvement from other members. Thank you to Stead for all of the effort and passion she brings forth to the HBA of F-M. The HBA staff appreciates her hard work and excitement to help with the smallest tasks. Stead, Claire Anderson, L2H; Eric Miller, Capital Credit Union; Jamie Stenseth, Showplace Kitchens and two additional members still to be selected as “Member of the Month,” will be nominated for the Extra Mile Award for 2016. This award will be presented to one of them at the Awards Gala & Annual Meeting Oct. 25. Congratulations to Stead and thank you for all your work behind the scenes!

Remodelers Council Members Complete Bathroom Remodel For Christine Home Owner

by Krista Mund, Executive Vice President With funding from Bell State Bank & Trust, HBA of F-M members helped a Christine, N.D., home owner by remodeling her bathroom left in disrepair by an unlicensed contractor. The project was funded by Bell State Bank & Trust’s Pay It Forward program and managed by HBA of F-M Remodelers Council member Stone Ridge Builders, Inc. HBA members Ferguson Bath, Kitchen & Lighting Showroom; Lampert Lumber; Laney’s, Inc.; Precision Plumbing, Electric, Heating & Cooling, Inc. and Sherwin Williams Co. provided products, materials and labor at a discount for the project. Delores Kramlich’s ordeal began when she paid a friend

$1,200 to remodel her bathroom. He started the work but never finished, leaving her without a shower, with leaky plumbing and rotted-out floors. After her story aired on local media in April 2015, the contractor refunded Kramlich’s money, but her bathroom remained in disrepair. In March, Bell State Bank & Trust contacted the HBA of F-M about assisting to finish the bathroom. Kramlich had to flush the toilet with water in a bucket and took sponge baths for almost two years due to her dilapidated bathroom. She could not leave the water on in her home due to leaking pipes, and had to turn the water on and off several times a day by accessing it in the basement. She says, “It’s wonderful to have the bathroom functioning and I’m very appreciative of the work. I just had my 78th birthday so I’m looking forward to a shower and working plumbing again!”

Herdina Academy for the Construction Trades Wraps Up 19th Year by Jenny Erickson, Director of Development & Education

The 19th annual Herdina Academy for the Construction Trades brought about new opportunities for high schools students to experience the construction industry. In 2016, Home Builders Care Foundation entered into a partnership with the city of Fargo and Fargo Public Schools on a house build which is a neighborhood revitalization project. Through this partnership, Home Builders Care was responsible for building the garage. The garage will be utilized in the fall for Fargo Public Schools Construction II students while building the house. Home Builders Care brought the garage build to the Herdina Academy, and it was a perfect fit for the students to experience an actual construction site. This year, the students spent time at both the garage and on the Minnesota State Community & Technical College campus experiencing as many trades as possible. The 18 students started off the week with a safety presentation and a tool demonstration. The students also heard from Bruce Taralson, city of Fargo inspector and Gary

Opp, Opp Construction. The garage build was a great handstayed on-schedule, even when there was a glitch with the truss delivery. They also spent one of the hottest days in June roofing, but they seemed to love it! The garage allowed the students to learn about trusses and garage doors. The garage siding, soffit and fascia was installed at the beginning of the second week. The building is now ready for the Fargo Public Schools’ students in the fall! At the M State campus, the students worked with steel studs, drywall, texture and window installation. They also worked with different flooring materials and used wood lathes to make pens. During the second week of the Academy, the students took tours of Minnkota Windows and D & M Industries, Inc. They also spent time in the HVAC/refrigeration, electrical and plumbing labs. The Academy is the Association’s most important workforce development initiative. The HBA of F-M is very proud of how many of our members are willing to work with and mentor the students. Herdina Academy Brings Tools to Teen Hands

June was a great month for workforce development. Home Builders Care partnered with Fargo Public Schools and the city of Fargo for the Herdina Academy for the Construction Trades. This year, students worked on a garage needed for a Neighborhood Revitalization project. The garage build for this project will be used in the fall by the Construction II students at Fargo South and Davies High Schools each year who build a home. With the garage already on site, students will be able to get started on the house right away as they will have a place for tools and storage, as well as

shelter from inclement weather. June was declared Homeownership Month and the press conference was held on site of the project. The press conference was a kickoff to the continued promotion of the project. Not only does it promote construction careers, but it also promotes the wonderful programs that are already in place in our local schools. At the press conference, we heard the mayors from Moorhead and West Fargo and the City Administrator of Dilworth express interest in having similar programs in their communities, giving HBA of F-M staff a lead for future expansion of the Herdina Academy. The Career & Technical Education programs at Fargo Public Schools are very supportive of the great programs at the local high schools and we want to reinforce their activities. We also love that the city of Fargo has supported this program for 11 years. We are already looking forward to what our next project will be.

Curling for Construction

Mark your calendars for our first-ever “Curling for Construction” fundraising event Nov. 4. Have you wanted to learn how to curl, but never had the chance? Now is the time to learn from fellow members and play your first game. It will be a fun, casual event held at the Fargo Curling Club to raise money for Home Builders Care.

We are trying to launch a merit-based scholarship for our Herdina Academy students and would like to have a mentorship component to this scholarship. Members would help provide guidance for the students and hopefully encourage them to further their education and pursue a career in the industry. Why did you join the Membership Committee?

I was previously on the Events Committee and was able to be involved with some of planning for the Home & Garden Show, Member Meetings and HBA Golf Outing. I chose to switch to the Membership Committee in 2014 to help recruit new members, and maintain contact with current members and those deciding whether or not they should renew their membership.

Why would you encourage other members to join a committee?

I would encourage other members to be involved with a committee for a few reasons. Strong committees directly affect the success of the events, meetings, membership drives, etc. Being involved in a committee is a great way to meet other members and can lead to excellent business relationships. A committee with the HBA allows you to be more involved in the building industry and gives you a firsthand look at the challenges and successes the members face. 28

Cass County Electric Cooperative hosted a groundbreaking ceremony to mark the beginning of construction of the Prairie Sun Community Solar array, the first community solar installation in North Dakota. The groundbreaking was June 1 at the future site of the installation on 63rd Street South, just south of 52nd Avenue South in Fargo. The project, a partnership with the city of Fargo, will provide participating CCEC members with solar energy credits on monthly electric bills upon its completion. Recently acquired grant funding from the North Dakota State Energy Program and the U.S. Department of Energy have resulted in a 58 percent reduction in participation costs for Prairie Sun Community Solar. Currently the output of one full panel costs $700. At current electric rates, participants can expect to see roughly $35 in yearly solar credits. Top Tour Tips!

The deadline for registering a home for the Remodeled Home Tour is this month. If you want to put a project on the tour but have not been able to get your home owner on board or have concerns about pricing or staffing, here are a few tips from Tour veterans to help you! Split the Cost! Splitting the cost with subcontractors, landscapers or other members who have also done work on the house is a great way to showcase your work for less than it would cost you to take out an ad in a magazine. Share the Space! If you are worried about staffing, assign vendors, designers or let Remodelers Council volunteers help work the house. Do not let the fear of not being able to have someone working the house stop you from putting a project up. Go The Distance! Home owners typically have a wish list of projects they want done in their home. Offering a discount on one of those items on their wish list will not only be an additional sale for you, but give you a chance to show off even more of your work to consumers and make your client happy. Offer an Incentive! If home owners are on the fence, offer to paint areas that lead to the remodeled area to spruce them up such as exterior walls, entryways or hallways. Fixing small annoyances will mean a lot to a home owner. Make it EASY! Making the tour easy on home owners is key for their participation. Offer them a free cleaning of the remodeled area after the Tour, let them know they are welcome to stay in their home during the Tour if they want or, if not, they can always take advantage of a free night stay at the Courtyard by Marriott in Moorhead the Saturday of the tour (limited to the first ten projects). Reassure them all areas of the house that are not a part of the Tour will be blocked off and volunteers will be stationed so no one can go to parts of the house that are not part of the Tour. This unique event is a great opportunity to reach thousands of consumers who are serious about taking on a remodeling project or are in the process of one. Overtime Rule Doubles Salary Threshold, Takes Effect Dec. 1 continued from page 10 making previously, and lose the workplace flexibility that comes with being a salaried employee. This 100 percent increase to the salary threshold for overtime eligibility will hit the homebuilding industry particularly hard and harm housing affordability. It will reduce job-advancement opportunities and the hours of full-time construction supervisors, leading to construction delays, increased costs and less affordable housing options for consumers. NAHB estimates more than 96,000 construction supervisors would become overtime eligible under this rule. “Given the huge economic disruption this rule will cause, the Department of Labor needs to start over and produce a sensible plan that will gradually raise the overtime threshold from its current rate and properly take into account the regional variations in wages and cost of living,” said Brady. OSHA clarifies in the Qs and As that this evaluation does not require a physical survey of the space. Instead, the evaluation requirement may be met through existing experience and knowledge of the space, provided this information is adequate to make the determination required by the rule. Rev. 5.23.16

Multi-employer Communication Provisions Limited

Paragraph (h) of the final rule includes requirements that host employers, controlling contractors, and entry employers communicate with each other regarding the presence of hazards in permit-required confined spaces. The Qs and As also clarify the limited nature of these communication provisions. The rule only requires a host employer to communicate the information in paragraph (h) if it is known by the host employer and does not require the host employer to perform a separate assessment to gather the information. In addition, the communication provisions only require host employers to convey information to a controlling contractor through reasonable means. There is no requirement in the standard for the host employer to verify that the information has been received by the controlling contractor or transmitted to entry employers by the controlling contractor. If the controlling contractor (i.e., general contractor) owns or manages the property, then it is both a controlling employer and a host employer. The Qs and As also make clear that multiple communications of the information in paragraph (h) between employers on a residential home building site (whether at a single home building site or a site with multiple homes being constructed) are unnecessary where the potential hazards of confined spaces remain the same or substantially the same, as long as any minor differences between the spaces are not relevant to which provisions of the standard apply. With this settlement, OSHA has agreed to provide the Qs and As to its Regional Offices, to the State Plan Programs, and to publish it on its webpage. OSHA will also incorporate the Qs and As into its compliance directive for the rule. PARADE MOBILE APP The Home Builders Association of Fargo-Moorhead Parade of Homes and Remodeled Home Tour has partnered this year with ParadeTix to provide the official app that offers event attendees information on homes, maps, digital tickets, home photos and more. The app also provides contractors with Parade data collection, and advertising opportunities. Align your brand with many of the Fargo-Moorhead area’s builders, remodelers and HBA members. The event’s general admission remains free, but Parade goers will use the app as their digital ticket that will grant them entry to the homes, to view more information on homes, and to navigate to the homes. Attendees can also purchase tickets for the luxurious featured homes through the app. Make sure your company is seen every time they open the app by purchasing a mobile ad!

MOBILE ADS - $500 Ads will be displayed on the home listing page and builder page. These ads will appear in line as event goers scroll through the home listings.
