‘Keep it Local ND:’ Oppose Measure 2 Chances are good you have heard about North Dakota Measure 2, a controversial initiative on the June ballot to abolish property taxes. Your HBA of F-M, along with the North Dakota Association of Builders Terry Becker Terry Becker and several other organizations, are Construction, LLC strongly opposed to the measure. The “Keep it Local North Dakota” campaign is off to a strong start. We believe that we should keep local government local. You should decide what’s best for your community. Here are three core reasons why you should vote NO on Measure 2 in June: 1. Local governments know what is best for residents. Local governments – city councils, county commissions, school boards – are more accountable to the people. Local officials can respond more effectively to the immediate needs of their constituents. 2. One-size-fits-all government does not work. Measure 2 requires the Legislature to determine what is best for local governments. This is counter to political and regional reality: What works for West Fargo may not work for Williston. Measure 2 would make the Legislature responsible for determining the funding for more than 2,000 political subdivisions. That’s not practical. 3. Measure 2 will require tax increases. To make up for the more than $800 million in lost annual revenue, legislators and local officials will have to raise taxes and fees to fill the gap. Please spread the word wherever you can about the reasons to oppose Measure 2. At first blush, getting rid of property taxes seems enticing, but explore the issue more and you will find many flaws and problems.

HBA continues to advance on strategic plan goals
In the spring of 2010, HBA of F-M leaders formulated a three-year strategic plan for the Association. The group consisted of HBA directors, committee members and staff. Facilitators from the National Nancy Kelly, Association of Home Builders Heartland Labor traveled from Washington, D.C., to HBA Strategic Plan Monitor conduct the planning session. The HBA’s mission statement remains the same: “The mission of the Home Builders Association of Fargo-Moorhead is to provide quality services, benefits and education to our members and the community. Striving to be a visible and proactive influence, the Association represents the collective interests of the home building industry.” At the planning session, we discussed four areas critical to the HBA and formulated objectives and strategies listed to the right. Brent Atkins, Minnkota Windows, Inc., monitored the plan in 2010 and 2011. With his term expiring on the board last year, I have been appointed to monitor this final year of the plan and make regular reports to the board and membership. A common theme in this strategic plan is the need to communicate “return on investment” to the current membership and demonstrate the HBA’s positive impact on the community to consumers. In these challenging economic times, our leaders identified the importance of showing members what they are receiving for their dues, as well as increasing the HBA’s good works in the public’s eyes – which will positively impact members, too! Much has been accomplished, and even completed, within the plan and requires an ongoing effort by staff and members. The following are some bullets of additional progress the HBA has made since the last published update in August: • In an effort to continually enhance the Association’s events and moving toward “virtual events,” the Home & Garden Show offered website links from the HBA’s site directly to exhibitors’ sites for an additional fee. • To reach out to more consumers through educational channels, the HBA is now providing Membership Directory and Buyer’s Guides to The Village to distribute at its home buyer education classes. • An “issues fund” has been established by the HBA, and a policy is in the works, to provide funding for governmental and public policy issues that may arise. It has already been utilized for a campaign to defeat North Dakota Measure 2 to abolish property taxes. • The HBA is collaborating with many other organizations, including The Fargo-West FargoMoorhead Chamber of Commerce on defeating Measure 2 to abolish North Dakota property taxes.

• In an effort to further reach our members regularly and consistently through mediums besides print, the HBA now distributes a “weekly email” with updates on events, education and other pertinent items. • HBA legislative successes have been regularly showcased in public event guides and the Membership Directory & Buyer’s Guide to promote the Association’s achievements that not only help the industry, but home buyers and remodelers. If you are interested in reviewing the entire strategic work plan, please contact the office at (701) 232-5846. Also please remember, we have several committees to choose from with varying focuses. If you would like to try one out, let us know! Your involvement can be as little or as immense as you want – it is your decision and it is your Association. Look for updates in the Plains Builder on the plan progress every six months.

HBA members attend International Builders Show in Orlando
Several HBA members made the trip to Orlando for the National Association of Home Builders’ International Builders Show in January. Every year is a chance to learn new things and see all the new products and techniques that are available. As an industry, it is projected that we will see new home starts increase over levels seen in 2011, which were down significantly. This was great to hear, as it shows many markets improving in terms of employment growth, house price appreciation and permit numbers as well. Read more on page 10.

National directors hear forecast for national recovery in 2012, NAHB still struggling
Last month, the National Association of Home Builders held its board meeting in conjunction with the International Builders Show in Orlando. IBS and the national board meetings are a great way to network with members in the industry while keeping on top of the key issues facing home building. Overall, the 2011 recap from NAHB is grim, but there is a ray of hope for 2012, and it appears that markets around the country are starting to recover. As usual, our members came back from this meeting feeling incredibly lucky to live in this prosperous area. HBA leaders at the meeting, besides me, included Terry Becker (National Director and HBA president), Terry Becker Construction, LLC; Don Dabbert, Jr. (Life Director and BUILD-PAC Trustee), Dabbert Custom Homes; Jason Eid (North Dakota Association of Builders First Vice President), Eid-Co Buildings, Inc.; John Gunkelman (Life Director and NDAB State Representative), Dakota Construction of Fargo, Inc.; Ken Krajsa (Associate National Director), State Bank & Trust; Tyrone Leslie (National Director), Heritage Homes; Dan Lindquist (National Director), Dan Lindquist Construction, Inc.; and Dan Parrow (Home Builders Care Foundation Treasurer), ISR Homes.
News, statistics from the board meeting
• Single-family permits for 2011 were at about 470,000, the lowest since the 1940s. NAHB economists predict that permits will be up to 600,000 for 2012, and listed the Minneapolis area as a major market on the rebound. • In September, there were 12 cities on NAHB’s improving markets index, and now there are close to 100. This index takes into account employment growth, house price appreciation and single-family housing permits. • In 2011, money spent on remodeling exceeded money spent on new construction for the first time. • Attendance at the International Builders Show was up by about 10,000 from last year, but compared to the past, the show’s size and attendance is still suffering. • Overall, NAHB expects to lose about 10,000 more members nationwide and then hopes to stabilize. • There were nine bylaws amendments on the table at the board of directors meeting, none of which passed. One
of the main proposed amendments would have reduced the board size from around 1,100 to 750 members. Approximately 50 percent of the National Directors were not present at the February meeting. • NAHB staff is down from about 400 at its peak to 245 employees with another round of staff cuts passing at this board meeting. NAHB also dipped into its reserves to fill its budget shortfall.
Legislative update
• One of NAHB’s current focuses is on the Home Building Lending Improvement Act of 2012, legislation to help restore the flow of credit for new housing production in order to create jobs, meet rising housing demand and bolster the economic expansion. With new housing inventories at or near record lows in many parts of the country, builders should be gearing up to produce homes to meet sizable demand from pent-up household formations and the growing list of metro areas on the Improving Markets Index whose economies are recovering. However, banks have largely cut off home builders from the credit they need to finance new projects or complete those still underway. • Other legislative issue priorities include appraisals, housing finance reform, loan limits, budget appropriations/sequestration, low income housing tax credit, foreclosures, southern pine design values, fall protection guidelines and injury and illness prevention programs. • We also had an opportunity to hear Federal Reserve Chairman Ben Bernanke deliver remarks during a special session. Bernanke specifically acknowledged housing’s role in economic recovery and job growth and the challenges facing builders in today’s market. He mentioned a number of factors, including the overhang of distressed and foreclosed properties, tight credit conditions for builders and potential home buyers, and the large number of “underwater” mortgages, leaving the rate of new home construction at only about onethird of its average level in recent decades. He has been willing to meet with NAHB leadership on a regular basis to receive updates from us on the state of the housing market and discuss industry concerns.

Fargo drafts River Setback Ordinance by Rocky Schneider, Public Affairs Coordinator
The city of Fargo has drafted an ordinance that would amend the Land Development Code to include building setbacks for lots along rivers. The ordinance is modeled after a similar ordinance already in place in Cass County. HBA of F-M representatives have taken part in numerous discussions regarding the ordinance over the last year and are currently reviewing the draft for comment. The draft ordinance includes the following: Setbacks for unplatted lots • The building setbacks for unplatted lots will be 450 feet from the centerline of the Red and Wild Rice Rivers and 175 feet from the Sheyenne River, or 100 feet from the FEMA floodway, whichever is greater. The 450foot zone will be broken up into a 350-foot minimal disturbance zone and a 100-foot limited disturbance zone; each zone has a different specific set of rules.

important appointments and we’re so pleased to have representation from our local association and state on these national committees. • The North Dakota Association of Builders was given $5,000 from NAHB’s State and Local Issues Fund to assist with the Keep it Local North Dakota coalition opposing Measure 2. • Three teams from NAHB Student Chapters competed in the Residential Construction Management Competition at IBS this year: Minnesota State Community and Technical College-Moorhead, North Dakota State College of Science – Wahpeton and North Dakota State University. These student groups worked hard since September on a project that was presented to a panel of judges Feb. 9-10. The competition has 48 post secondary schools competing and it is amazing that three of the teams come from this area.
Setbacks for platted lots • For areas that are platted and have not yet been built upon, approval from the City Commission is needed to acquire a building permit. There are five criteria in the ordinance that a project would need to meet. • For platted lots already built upon, there would be new regulations overlaid upon the property. Enlargement or alteration of the structure that is already within the disturbance zone would be allowed as long as it did not extend closer to the river. Any such enlargement, alteration or interior remodeling may not exceed the limits of the “substantial improvement” provisions of Fargo’s floodplain management regulations. New subdivision requirements • The ordinance would require new subdivisions to identify disturbance zones and to dedicate the areas for drains. Drains would require an area equal to 175 feet on either side of the centerline, along with an allowance for the city to acquire an additional 150 feet. Tree preservation provisions • Fargo has also been working on a tree preservation ordinance. This ordinance will likely work in conjunction with the setback ordinance and could possibly be encompassed within the same sections of municipal code. While the river setback ordinance deals with land disturbing activities through construction, the tree preservations sections will deal with the same topic except through the removal of significant trees. It was great to see so many North Dakotans at the International Builders Show in Orlando, Fla. Signs of optimism for the industry’s recovery could be felt throughout the show, and exhibitors noted increased booth traffic Eddy Mitzel and solid sales leads. NDAB President The 2012 IBS featured exhibits from more than 900 suppliers representing all facets of the home building industry. There were also 165 educational sessions on design trends, green building, marketing, remodeling and other building industry topics. Nearly 2,500 people attended a special address by Federal Reserve Chairman Ben Bernanke, where he discussed how restraints on credit for home buyers and home builders alike continue to impede the housing and economic recovery. However, building on significant upward revisions to numbers for the previous two months, nationwide production of new single-family homes and apartments increased 1.5 percent to a seasonally adjusted annual rate of nearly 700,000 units in January, according to the U.S. Commerce Department. This marks the second-best pace of overall housing production since October of 2008. “Today’s solid housing starts report indicates that builders are putting more of their crews back to work, and adds to the growing field of evidence that the overall housing market is gradually but consistently moving in the right direction,” said Barry Rutenberg, chairman of the National Association of Home Builders and a home builder from Gainesville, Fla. “The fact that the three-month moving average for housing starts has now increased for nine consecutive months and is approaching the 700,000 mark for the first time since October of 2008 is indicative of a solid recovery in housing activity stemming from recent firming in employment and consumer confidence measures,” agreed NAHB Chief Economist David Crowe. “That said, housing production is still far from what would be considered normal in a healthy market, and many challenges remain for home builders in terms of tight credit conditions, difficult appraisals and the continued flow of foreclosed properties on the market – all of which are certainly slowing the pace of improvement in both housing and the overall economy.”

Minnesota’s 2012 Legislative Session
Every legislative session has its own personality. The process is basically the same, but the character of the place changes. This year’s legislative session started Jan. 24 and it promises to be short with a predicted end date in April. This means the pace will be fast and BAM will be moving quickly to push our issues through and oppose unreasonable legislation. BAM’s priorities for the 2012 session include contractor enforcement, the contractor recovery fund, and opposing a fire sprinkler mandate. The committee deadlines were announced for 2012 by House Speaker Kurt Zellers and Senate Majority Leader Dave Senjem. By March 16, committees must act favorably on bills in the house of origin. By March 23, committees must act favorably on bills or companion bills that met the first deadline in the other body. By March 30, committees must act favorably on major appropriation and finance bills. The next big determining factors for the session, at the time of writing, are the ruling from the courts on redistricting and the February economic forecast for the state. Both will provide more structure and ultimately more urgency at the Capitol. From the time the forecast is released, legislators will have just three weeks until the first committee deadline.

In addition to the legislative session, BAM is also in the midst of working on adopting a new residential building code. Karen Linner, BAM’s director of codes and research, and her team of members from across the state are working hard and putting in the hours to represent the residential construction industry and ensure the code is reasonable and Minnesota-specific.

Green homes market expected to increase five-fold by 2016: Up from a $17 Billion opportunity today Green remodeling is growing especially fast due to the economy and decline in new home construction
Feb. 9, 2012 - McGraw-Hill Construction, a part of The McGraw-Hill Companies (NYSE: MHP), today released findings from a new Green Home Builders and Remodelers Study at the National Association of Home Builders International Builders’ Show in Orlando. Green homes comprised 17 percent of the overall residential construction market in 2011 and are expected to grow to between 29 and 38 percent of the market by 2016. By value, this equates to a five-fold increase, growing from $17 billion in 2011 to $87-$114 billion in 2016, based on the five-year forecast for overall residential construction. According to the study, construction industry professionals report an even steeper increase in green home remodeling: 34 percent of remodelers expect to be doing mostly green work by 2016, a 150 percent increase over 2011 activity levels. Many home builders have shifted to the remodeling market due to the drastic drop in new home construction. In fact, 62 percent of the builders who do both new and remodeling work verified that the economy has increased their renovation work. “The housing market is critical to the U.S. economy,” said Harvey M. Bernstein, vice president of industry insights and alliances, McGraw-Hill Construction, “and the results of our study show that despite the drastic downturn in housing starts since 2008, green has grown significantly as a share of activity — indicating that the green market is becoming an important part of our overall economic landscape.” The green home building study, produced by McGrawHill Construction in conjunction with NAHB and Waste Management, is designed to provide key insights into market opportunities, backed by proprietary research surveys and the power of the Dodge database. The study reveals business benefits afforded by green building, such as a competitive marketing advantage: 46 percent of builders and remodelers find that “building green” makes it easier to market themselves in a down economy, and an overwhelming 71 percent of firms that are dedicated to green home building report the same. “This study demonstrates phenomenal growth in green building and indicates that we can expect even larger increases in the coming years,” said NAHB Chairman Barry Rutenberg, a home builder from Gainesville, Fla. “In a sample of NAHB builder and remodeler members, nearly 90 percent reported building green at some level. This is a powerful testament to the importance of green home building—and transforms the way we think of homes overall.”

By 2016, many more builders anticipate that they will be dedicated to green building work on over 90 percent of projects — 33 percent expect to be dedicated to green work in 2016, up from 17 percent in 2011. Remodeling will grow even more dramatically — 22 percent of remodelers report that they anticipate they will be dedicated to green work in 2016, nearly triple the 8 percent who report being dedicated to green work in 2011. These builders are clued into the revenue opportunity afforded by green building and know that home buyers will pay more for green homes, according to 61 percent of builders and 66 percent of remodelers. “Home buyers and builders increasingly want to do what’s right for the environment,” said Jim Halter, VP for Construction Solutions, Waste Management. “This trend has been taking off within our business as customers look to recycle and divert more materials from landfills. We’re excited to see the results of the study; they validate the services we offer.” Many factors are driving the green homes market, with “higher quality” and “increases in energy costs” topping the list, indicating that today’s green home buyer is not just a green consumer. Buyers recognize that green homes have lower bills due to higher building performance. The reported costs of building a green home have also gone down significantly. Builders report that the cost to go green is now 7 percent, as compared to 10 percent in 2008 and 11 percent in 2006. While green is growing across the U.S., three regions are seeing higher than average growth. The West Coast has seen the highest green growth; the Midwest’s northern region, west of the Mississippi, is second highest; and New England is ranked third. McGraw-Hill Construction will continue analyzing the results of the Green Home Builders and Remodelers Study and release a printed report in April during the NAHB’s National Green Building Conference and Expo in Nashville. Become a North Dakota Professional Builder
Builders in North Dakota have the opportunity to set themselves apart from others in the marketplace by becoming a “North Dakota Professional Builder.” Having the certification will provide marketing opportunities for builders, and North Dakota Association of Builders will promote and provide website links to these builders. The NDPB certification program is the only one of its kind in the state of North Dakota and is administered by the NDAB. This voluntary certification program for home builders was established to recognize professionals in the home building industry. The term “professional” is used to describe the manner in which a NDPB conducts business and the process the builder follows in delivering a new home. The North Dakota Professional Builder certification program is truly wise for both the home builder and consumer.

4 things any remodeler needs to know about the EPA’s Lead Paint Rule
The U.S. Environmental Protection Agency’s Lead: Renovation, Repair and Painting Larry Leadhead rule governing the work of EPA Lead Enthusiast professional remodelers in homes where there is lead-based paint took effect April 22, 2010. The rule addresses remodeling and renovation projects disturbing more than 6 square feet of potentially contaminated painted surfaces for all residential and multifamily structures built prior to 1978. It requires a cleaning inspection after the work is completed and grants the remodeler flexibility in determining the size of the work area, which can reduce the size of the area subject to containment. The EPA rule also lists prohibited work practices including open-torch burning and using high-heat guns and high-speed equipment such as grinders and sanders unless equipped with a HEPA filter. Additionally, the rule establishes required lead-safe work practices, including posting warning signs for occupants and visitors; using disposable plastic drop cloths; cleaning the work area with HEPA vacuuming and wet washing; and
individual certification through a training course. The full rule and brochures for consumers and renovators can be downloaded from the EPA’s website. A 2006 NAHB study on lead-safe work practices showed that a home was better off after a remodel than before, as long as the work was performed by trained remodelers who clean the work area with HEPA-equipped vacuums, wet washing and disposable drop cloths.
Summary of the Rule
Review the points below for a quick summary of the new EPA lead paint rule. 1. Training and Certification As of April 2010, firms working in pre-1978 homes need to be certified. Firms need to complete the application for certification and submit a fee of $300 to the EPA. Along with the firm certification, an employee also needs to be certified as a Certified Renovator. This employee is responsible for training other employees and overseeing work practices and cleaning. The training curriculum is an eight-hour class with two hours of hands-on training. The portion of training that is not hands-on training can be completed online through an approved provider. The HBA of F-M will provide classes like this on March 14 and Nov. 14. See the ad on this page for details. Both the firm and Certified Renovator certifications are valid for five years. A Certified Renovator must take a fourhour refresher course to be recertified. February ‘Chilly’ Cook-off by Alison Streyle, Events Coordinator
The third annual “Chilly” Cook-off held Feb. 9 was another great success. Fabricators Unlimited sponsored and hosted the event at its downtown Fargo showroom. Nine chili recipes were entered and just under 60 members attended to taste-test and vote for People’s Choice! Team “Op’salicious” took the win for the second year in a row! Team members from Ferguson Bath, Kitchen & Lighting Showroom included Team “Op’s-alicious” won the People’s Choice. The team Aaron Hummel, Josh consisted of Aaron Hummel, Rothstein and Khris Josh Rothstein and Khris Walz Walz. They took home of Ferguson Bath, Kitchen & Lighting Showroom. the grand prize of an HBA cooler and multiple cooking and grilling supplies. Congratulations! Second place was also from Ferguson’s Bath, Second place went to Alisha Kitchen & Lighting Showroom; “White Hot Chili Wiesshoff and Lori Holden, Ferguson Bath, Kitchen & Peppers” was made up of Lori Holden, Alisha Lighting Showroom, with their White Hot Chili Peppers team. Meet Your Events Committee Chair by Krista Mund, Communications Manager
Jessica Grondahl, marketing and promotions coordinator and webmaster at Nodak Stores, currently serves as chair of the HBA of F-M Events Committee and has been Jessica Grondahl active with the group for about two Nodak Stores years. She became involved because she finds Association events to be an exciting channel to use her talents. She enjoys helping organize and plan important networking events as well as the annual Home & Garden Show. “All of the events provide a time and place to inform and strengthen the HBA membership,” she says. “The Events Committee makes sure members have a consistent place to be informed and recognized, network, and to showcase their businesses to the public. Our goal is always to serve the HBA membership in its best interest as a whole.” Her favorite part of participating on the committee is seeing members grow as their participation grows and watching it benefit them professionally. “I’d be hard pressed in finding a downside to being involved in some way with HBA committees and events,” she says. “We have a great Association with quality people.” Grondahl notes that her committee is looking to add more socializing and networking time to the conventional General Membership Meetings. It just completed a fun February General Membership Meeting called the “Chilly” Cook-off at Fabricators Unlimited and, as of press time, was looking forward to a successful Home and Garden Show with exciting headliners.

A fairly new company to the area and to the HBA of F-M, Differding Toby and Stephanie Differding Signature Homes is started Differding Signature Homes in dedicated to building September 2010. quality homes in the Fargo and West Fargo area. After building a couple of personal homes, Stephanie and Toby Differding received great feedback and it naturally led them to founding Differding Signature Homes in September of 2010. Stephanie’s banking background and a love for decorating combines with Toby’s 16 years of framing and remodeling to make them a great team. “Our homes have a quality you can feel,” says Stephanie. “We truly wouldn’t build anyone else a home that we wouldn’t live in ourselves.” Since Differding Signature Homes is a small company, it is able to listen to each customer from start to finish and provide attention to detail and quality in each home it builds. “We want it done right the first time as we handle any call backs ourselves,” says Toby. The couple is looking forward to the spring Parade of Homes at the end of April, and the possibility of beginning digging basements earlier than normal. Differding Signature Homes continues to focus on building custom homes in the $250,000-400,000 price range. For both Toby and Stephanie, getting to work with customers is the best part of their job. “We love working with people to combine our ideas with theirs to give them a home they love and are proud of,” says Stephanie. “It’s important for people to feel included in decision-making and giving them the personalized home they want.”

Terry Lipp, Ferguson Bath, Kitchen, & Lighting Showroom, has been an active member of the HBA of F-M for 17 years, serving on the board of directors, New Member Development & Retention Committee, Terry Lipp and the Remodelers Council. Ferguson Bath, Kitchen, & Lighting Showroom Lipp joined the Remodelers Council at first to network and promote products with other businesses, but his involvement has now developed into a much more rewarding experience. “It has evolved into a wonderful opportunity to meet friends and become more engaged in our industry,” says Lipp. “It has been great to learn about other businesses that are involved within the remodeling industry.” Lipp’s many years of involvement with the Remodelers Council, and being chairperson for one of those years, has allowed him to be a part of many projects, including the Gladys Ray Shelter bunk bed project, and several wheelchair ramp projects. “All of the ramp projects are special and it is extremely rewarding to see the homeowner’s expression after they use the ramp for the first time,” says Lipp. Many of these projects work with local government, private agencies, and the Home Builders Care Foundation to help those locally who are in need of assistance. Lipp sees these projects as a great way for the Association and its members to give back to the community, and sees the quality of work and donated time as incredible. “The RENEW house was probably my favorite project for many reasons. First, I earned the nickname ‘Demolition Man’ from Dave Anderson, which really meant I did something that could not be screwed up — I think,” jokes Lipp. Lipp is the builder sales representative at Ferguson Bath, Kitchen, & Lighting Showroom where he has been providing quality products and services for residential construction for nine years. Ferguson Bath, Kitchen, & Lighting Showroom offers appliances and lighting fixtures, as well as plumbing fixtures, water heaters, water conditioning products, heating and cooling products and indoor air quality products. Lipp has a bachelor’s degree in business administration-management from Northern State University in Aberdeen, S.D., and almost 25 years of sales experience. For Lipp, projects like the RENEW Home showcase what the remodeling industry has to offer for products and services, like interior design, storage solution and overall construction knowledge. Overall, the Remodelers Council provides a rewarding experience for networking and community service. “All of this can be done without a huge time commitment, so please join the Council and become involved,” says Lipp. “It will be one of the best business decisions you make.”

OSHA’s fall protection guidelines
The United States Department of Labor's Occupational Safety and Health Administration (OSHA) has issued a directive rescinding the Interim Fall Protection Compliance Guidelines for Residential Construction (STD 03-00-001). Prior to the issuance of this new directive, STD 0300-001 allowed employers engaged in certain residential construction activities to use specified alternative methods of fall protection (e.g., slide guards or safety monitor systems) rather than the conventional fall protection (guardrails, safety nets, or personal fall arrest systems) required by the residential construction fall protection standard (29 CFR 1926.501(b)(13)). Employers could use the alternative measures described in STD 03-00001 without first proving that the use of conventional fall protection was infeasible or created a greater hazard and without a written fall protection plan. With the issuance of the new directive, all residential construction employers must comply with 29 CFR 1926.501(b)(13). • Residential construction employers generally must ensure that employees working six feet or more above lower levels use guardrails, safety nets, or personal fall arrest systems. A personal fall arrest system may consist of a full body harness, a deceleration device, a lanyard, and an anchor point. (See the definition of “personal fall arrest system” in 29 CFR 1926.500). • Other fall protection measures may be used to the extent allowed under other provisions of 29 CFR 1926.501(b) addressing specific types of work. For example, 1926.501(b)(10) permits the use of warning lines and safety monitoring systems during the performance of roofing work on low-sloped roofs. • OSHA allows the use of an effective fall restraint system in lieu of a personal fall arrest system. To be effective, a fall restraint system must be rigged to prevent a worker from reaching a fall hazard and falling over the edge. A fall restraint system may consist of a full body harness or body belt that is connected to an anchor point at the center of a roof by a lanyard of a length that will not allow a worker to physically reach the edge of the roof. • If the employer can demonstrate that use of conventional fall protection methods is infeasible or creates a greater hazard, it must ensure that a qualified person: • Creates a written, site-specific fall protection plan in compliance with 29 CFR 1926.502(k); and • Documents, in that plan, the reasons why conventional fall protection systems are infeasible or why their use would create a greater hazard. Herdina Academy for the Construction Trades
The Herdina Academy for the Construction Trades is coming up June 4 to 15. We are looking for Adopt-A-Student sponsors to help defray the costs of materials, instructor fees and tools of the Academy and keep the registration fee low for students. You can adopt a student for the low price of $75 and help support skill-training and education for students interested in the construction industry. With the Academy coming up, we will also need support of various contractors to work directly with the students to demonstrate their career. A Triple Player is someone who supports the HBA through their member dues, contributes at least $365 to NDAB PAC and donates at least $365 to HBC. Student chapters at IBS
Our four student chapters recently traveled to Orlando to attend the International Builders Show. Three of the four chapters participated in the residential construction management competition. The competition is a great way for students to expand their knowledge and practice presenting a project to a potential investor. Fundraising
This key area has been the most important focus of the HBC board for the last few years. Framework for the Future was launched to encompass all the fundraising goals of the Foundation and is the longterm initiative to build the endowment fund to maintain current giving, support additional projects and provide for endowment growth. We have been working toward this goal by launching the annual fundraising telethon, which was very successful in increasing the number of HBA members supporting the Foundation.
Public Relations
Promoting the Home Builders Care Foundation to members and consumers has been the focus of this key area. The Home Builders Care Build for Habitat will provide many opportunities to promote the Foundation and all that it does for the members of the Association and the community.

One way we can promote the Foundation is to speak at service club events and meetings. If you belong to a group or club that is in need of a speaker, please consider asking the Home Builders Care Foundation. We would love to speak and let more people know about our Foundation. Hopefully you have seen the HBC newsletter, The Framework, that was distributed to the membership three times in 2011. The first issue of 2012 will be coming out in April. We distribute this by email, so make sure we have your email address at the HBA office. This newsletter has a lot of great information about members giving back to our community. Donors are also recognized in the 2012 Membership Directory and Buyer’s Guide with a star by their member listing and their classifications. Check out this year’s Directory to see all of the donors!
Workforce Development
Scholarships and training are essential parts of Home Builders Care. We have continued our annual scholarship giving each fall. We have also remained active with the Health Tech & Trades Career Expo and the Herdina Academy for the Construction Trades.
Operations
The board of trustees is continually working to maintain the operations of the Foundation. We are always working on better ways to train and become knowledgeable on how the Foundation runs.

NAWIC observes Women in Construction Week March 4-10
The Fargo-Moorhead, ND Chapter #246 of the National Association of Women in Construction (NAWIC) will celebrate Women in Construction Week March 4-10, 2012. NAWIC’s mission is to enhance the success of women in the construction industry. “The National Association of Women in Construction is committed to enhancing the success of all women in construction - not just those who are NAWIC members,” says Judy DeWeese, president of NAWIC. “We accomplish this through educational opportunities, networking, and community/industry service projects. If you are a woman employed in any area of the construction industry, we welcome you to join us!” The focus of WIC Week is to highlight women as a visible component of the construction industry. It is also a time for local chapters to give back to their communities.

WIC Week provides an occasion for NAWIC’s members across the country to raise awareness of the opportunities available for women in the construction industry and to emphasize the growing role of women in the industry. “While there are more than one million women employed in the construction industry, women only comprise approximately 10 percent of the construction workforce. These women, whether they are administrative specialists, general contractors, subcontractors, trades people, or professionals, are vital elements to the construction process,” says DeWeese. “‘Women in Construction Week’ is simply a time set aside to thank those women for all their efforts toward successful construction projects. WIC Week will also bring attention to the industry and encourage others to realize that construction is a viable, profitable career field.” Members of the Fargo-Moorhead, N.D. Chapter #246 will be giving back to the community through donations of personal hygiene bags to the local womens shelter, cooking at the Ronald McDonald House, making no-sew blankets for Project Linus as well as wearing our NAWIC pins and clothing to work during the week. Our monthly membership meeting, which is held the second Thursday each month, will be held March 8 at the Holiday Inn, Fargo. 2. Work Practices Once work starts on a pre-1978 renovation, the Certified Renovator has a number of responsibilities. Before the work starts this person will educate residents by distributing the Renovate Right pamphlet post warning signs outside the work area and supervise setting up containment to prevent spreading dust. The rule lists specific containment procedures for both interior and exterior projects. It forbids certain work practices including open flame or torch burning, use of a heat gun that exceeds 1100°F, and high-speed sanding and grinding unless the tool is equipped with a HEPA exhaust control. Once the work is completed, the regulation specifies cleaning and waste disposal procedures. Clean up procedures must be supervised by a certified renovator. 3. Verification and Record Keeping After clean up is complete, the certified renovator must verify the cleaning by matching a cleaning cloth with an EPA verification card. If the cloth appears dirtier or darker than the card, the cleaning must be repeated. A complete file of records on the project must be kept by the certified renovator for three years. These records include, but aren’t limited to: verification of owner/ occupant receipt of the Renovate Right pamphlet or attempt to inform, documentation of work practices, Certified Renovator certification, and proof of worker training. NAHB believes that record keeping will be a major enforcement tool for the regulation. Remodelers are required by EPA to share a copy of records developed under rule requirements with the customer within 30 days of completing the remodeling work. 4. Exemptions It is important to note that these work practices may be waived under these conditions: • The home or child-occupied facility was built after 1978. • The repairs are minor, with interior work disturbing less than six square feet or exteriors disturbing less than 20 square feet being exempt. • If the house or components test lead free by a Certified Risk Assessor, Lead Inspector or Certified Renovator.
The new directive interprets “residential construction” as construction work that satisfies both of the following elements: • The end-use of the structure being built must be as a home, i.e., a dwelling. • The structure being built must be constructed using traditional wood frame construction materials and methods. The limited use of structural steel in a predominantly wood-framed home, such as a steel I-beam to help support wood framing, does not disqualify a structure from being considered residential construction. • Traditional wood frame construction materials and methods will be characterized by: • Framing materials: Wood (or equivalent cold-formed sheet metal stud) framing, not steel or concrete; wooden floor joists and roof structures. • Exterior wall structure: Wood (or equivalent cold-formed sheet metal stud) framing or masonry brick or block. • Methods: Traditional wood frame construction techniques.

A company who is willing to let imagination soar, Sculpture by Design has no limitations to its hand-crafted, Brenda and Tony Thibodo, Sculpture by artistic, concrete Design, joined the HBA of F-M December products. From 2011. countertops and table tops, to outdoor bars and sculptures, Brenda and Tony Thibodo can sculpt and carve concrete into just about anything. Brenda and her husband started creating concrete statuary in 1990. Since then, they have opened a retail store, and expanded into their current craft of creating and designing custom concrete creations. They offer custom sinks, showers, fireplace mantels and hearths, countertops, tables, custom fire tables, engravings, water walls and more. Since their start, technology has helped to improve their materials and sealers, and cut down on production time. “We designed a custom planter for Extreme Makeover: Home Edition for the Grommesh family in 2011. Because of the new technology, this was done in only three days.” says Brenda. Sculpture by Design is not only expanding its business, but is also one of the newest members of the HBA of F-M. The Thibodos are excited to expand their market into the Fargo-Moorhead area. (With their second year exhibiting at the Red River Valley Home & Garden Show) “We hope to attend events whenever possible,” Brenda says. She is also excited to possibly gain new business associates and customers, as well as educate the membership on their business, and continue to expand. “Concrete can be very artistic and unique,” says Brenda. “And we want to educate people that there is more to concrete than just sidewalks and driveways.”

‘Home Energy Score’ • Home Energy Score will allow consumers to find out how their home compares with others and how much money they could save to an existing home by adding insulation, sealing air leaks or doing other upgrades. This class will discuss score methodology, appraisal valuation, and key components to a building that will have largest impact to energy efficiency. Nine U.S. communities tested 200+ homes per metro area of varying type, age, and condition. The score based on a scale 1 – 10, similar to a miles-per-gallon label for cars will be accepted by Fannie and Freddie in secondary market and by American Journal of Appraisers to include an energy efficiency category in assessing the appraised value of a home. • Speaker: Larry Mayer, Solution Design, Inc., is a trained Building Professional Inc.(BPI) analyst and envelope specialist. Consider contractual and legal concerns for building professionals providing design solutions to the Aging in Place client. Erik Listou, CGR, CAPS, CGP, CAASH, CLR, LDST is a 40-year plus veteran of the building and remodeling industry. Listou was twice voted Colorado's top remodeler by the Denver HBA, and has been recognized locally and nationally with projects and leadership awards. As an instructor for NAHB, Listou teaches remodelers and builders remodeling business principals (CGR), aging in place (CAPS), and green building (CGP). A founding member of the Seniors Council in Denver, Listou is actively involved with the Remodelers and 50+ Housing Council in Denver as a board member and chair of the education committee, and is involved with DRCOG initiatives on aging. Listou volunteered as president, then staff executive director, of the Denver Habitat for Humanity in the early 1990's and has continued his passion for community as an industry spokesperson by authoring over 60 articles, and has been quoted in the media on industry issues. As the founder of the Build Responsible Foundation, Listou produces educational and awareness programs for home shows, seminars and programs for communities and businesses. He has also hosted a Denver-based talk radio show and television programming, and provides continuing education for the building and remodeling industry.
