• Dennis Daugherty and Kevin Riley have been named to the board of directors at Robert Gibb & Sons, Inc., Fargo. • Dewey Uhlir has been inducted into Park Co. Realtors Hall of Fame, which recognizes associates and staff who have 20 years of service with the company. Dave Oksendahl has been awarded the Graduate, Realtors Institute designation by the National Association of Realtors, and Shari Zimbelman has been awarded the Accredited Buyer’s Representation designation by the Real Estate Buyer’s Agent Council. • Union State Bank has been presented the Director’s Award by the North Dakota District Office of the Small Business Administration for its commitment in supporting small businesses in North Dakota. Union State Bank provided more SBA support to its clients than any other financial institution in North Dakota and now ranks as the No. 1 SBA loan provider in the state. • Sanford Health has named John Vastag, who is also a partner of Perfect Temp, as director of legislative affairs for North Dakota. He will serve as the liaison to state and elected officials and will also work with the different business units within Sanford to develop, coordinate and implement policy initiatives. • Starion Financial donated more than $180,000 to community organizations and capital campaigns in the communities it serves in 2010. Major donations included: University of Mary schools of business and technology; Trollwood Performing Arts School; Sitting Bull College; Dakota Zoo; Ducks Unlimited and Missouri Valley Family YMCA. • Blue Cross Blue Shield of N.D. in Fargo has named Pat Gulbranson vice president of corporate administration, Dr. David Hanekom has been named vice president of medical management and chief medical officer, Judd Wagner was promoted to vice president

of marketing and chief marketing officer and Lynne Devitt has been named manager of membership and underwriting. • Donny Hines, Nor-Son, Inc. director of safety, received his certification as an Occupational Safety and Health Administration trainer from the National Safety Education Center by completing the #500 Trainer Course. Requirements for this designation require completion of the OSHA #510 training course and individuals must have at least five years of construction safety experience. The certification appoints Hines as an OSHA authorized trainer for both OSHA 10-hour and 30hour courses, and authorizes him to issue course completion cards. The OSHA Outreach Training Program is a voluntary program to train workers in the basics of safety and health hazard recognition and prevention. It authorizes trainers who complete construction and general industry train-the-trainer courses to conduct occupational safety and health classes for workers. • First International Bank & Trust in Fargo has named Joe Straus as a mortgage loan officer and Becky Riggs as a mortgage loan assistant. • The Kilbourne Group, Fargo, has hired Margaret Ashiem as chief financial officer. • David Berg, president and chief executive officer of American Crystal Sugar, has been named to the board of directors of State Bank and Trust. • Keller Williams Roers Realty in Fargo has recognized Carrie Jacobson as Rookie of the Year; Sarah Hockhalter as Agent of the Year; Carol Simenson as Culture Keeper of the Year; and Brenda Smith as Listing Agent of the Year. The company has also recognized several agents with 2010 awards. She completed courses in buyer representation and an elective course focusing on a buyer representation specialty. • Wells Fargo Home Mortgage has promoted Kelly Cooper to mortgage consultant. • The North Dakota Association of Realtors has awarded its 2010 Realtor Involvement awards. Area award recipients include Todd Anhorn, Keller Williams Roers Realty; Lyn Dwyer and DeAnne Mason, both with Prudential Premier Real Estate; Lisbeth Fandrich, Barb Grande, Peggy Isakson, Todd Randall and Joy Stumbo, all with Coldwell Banker First Realty; Vicky Matson and Dewey Uhlir, both with Park Co. The award recognizes and promotes education participation, achievement and involvement in community service, and political, educational and local, state and national association activity. • State Bank & Trust of Fargo has purchased Bell Mortgage, a 130-year-old mortgage company based in Minneapolis. The purchase combines the largest independently owned bank in Minnesota, North Dakota and South Dakota with the tri-state area’s largest private mortgage company. Another spring, another flood HBA urges members to donate employees for flood fight

With two consecutive years’ experience dealing with our area’s flooding issues, the HBA’s staff and leaders are looking ahead and making contingency plans for our events and classes scheduled in March and April. If they need to be postponed, the HBA will communicate with members and the media as necessary as soon as possible. If an emergency situation develops, the Association will relay messages for members that need help with the flood fight to our e-mail list; it was greatly appreciated by those who used it in past floods.

State legislative report

Several HBA members made the trip to Orlando for the National Association of Home Builders’ International Builders Show in January. More than 77 people from the F-M area attended and over 110 from North Dakota were there. Every year is a chance to learn new things and see all the new products and techniques that are available. As an industry, it is projected that we will see new home starts increase over levels seen in 2010, even after seeing an increase last year over 2009. This was great to hear, as it marks two years of the industry moving in the right direction.

Outside of the flood concerns, your HBA and its members have been very busy legislatively. We were involved with F-M area organizations for “City Day on the Hill” Feb. 3 in Bismarck. Representatives from the HBA, F-M Area Association of Realtors, Greater F-M Economic Development Corporation, Fargo-Moorhead-West Fargo Chamber and the Convention and Visitors Bureau were able to talk to legislators about issues affecting our community as a whole. We were also involved with our state associations, North Dakota Association of Builders and the Builders Association of Minnesota, in visits to their Capitols in February. These trips focused on the building industry and strengthening relationships with legislators. Both NDAB and BAM have seen great legislative success so far with their initiatives. NDAB’s bill to revise the state law regarding architect requirements on buildings has passed the N.D. House with strong support and now heads to the Senate. A bill to get building industry representatives on the state appraisal board is also working its way through the legislative channels. BAM was successful in passing legislation to delay the effective date (from Feb. 1 to Aug. 1) of a law requiring local jurisdictions to verify lead certification on permits for work in residential structures built prior to 1978. It is also working to oppose mandated fire sprinklers in new single-family homes in response to a pending provision in the 2012 International Residential Code.

GMM City Night March 24 The annual City Night General Membership Meeting will be held March 24 at the Radisson in downtown Fargo. Relationships with public officials are critical in today’s residential construction market. City Night is an opportunity to thank local jurisdiction staff and elected officials for their hard work and willingness to listen to the building industry’s concerns about new laws and regulations. City officials from Fargo, Moorhead, West Fargo and Dilworth, as well as other local leaders, have been invited to attend the meeting.

Both Riedman and Perri are busy with legislative sessions and are working hard fighting for issues important to the building industry.

About Doreen Riedman:

Doreen Riedman is the executive officer of the North Dakota Association of Builders, a position she has held since 1997. Primary duties include serving as the chief lobbyist for the association, both on the state and federal levels, working with state legislators and North Dakota’s congressional delegation. She has served as the NAHB Executive Officers Council state EO liaison to the BUILD-PAC Board of Trustees, is a past member of the EOC Awards Committee, and is a long-time Gold Key BUILD-PAC contributor. Riedman is the past secretary/treasurer of the North Dakota Lobbyists Association, past president of the International Association of Business Communicators/Great Plains Chapter, and is currently on the state board of directors of Special Olympics North Dakota.

About Pam Perri:

Pam Perri has been the executive vice president of the Builders Association of Minnesota since August 2001. The association serves the residential construction industry. While at BAM, she has overseen the creation of the Builders Legal Action Fund and started a general liability insurance company for the membership where she served as CEO. Most recently, BAM created Project Reenergize, a nationally recognized program for the American Recovery and Reinvestment Act. The Builders Association of Minnesota has over 3,000 members statewide.

Dabbert achieves NAHB Life Director status

Congratulations to Don Dabbert, Jr., Dabbert Custom Homes, on reaching Life Director status through the National Association of Home BuildDon Dabbert ers. In January, Dabbert was named Dabbert Custom Life Director at the 2011 International Homes Builders Show in Orlando. To gain this status a member must be recommended by the local or state association of which he or she is a delegate, and have served as a voting director for ten or more years, attending two meetings of the board per year. “We are so proud of Don. Achieving life director status is a great accomplishment,” says HBA Executive Vice President Bryce Johnson. “The addition of Life and Senior Life Directors is a privilege for our local Association and is also advantageous because they are viewed as voting members on the NAHB board of directors, but are not included in the regular allotment of directors that NAHB allows us based on our membership numbers.” Dabbert is very active within the HBA of F-M, North Dakota Association of Builders and NAHB. In 2003, he was the HBA of F-M president and was also named the local Builder of the Year. He is also a member of the local Public Affairs Committee and Political Action Committee. On the national level, he is a member of the Design Committee. Life Directors must continue to meet attendance requirements to retain voting privileges. A Life Director who has attended two meetings per year for a period of ten consecutive years after becoming a Life Director will be designated as a Senior Life Director. Senior Life Directors will have attained a permanent seat on the board with no attendance requirement. In addition to Dabbert, John Gunkelman of Dakota Construction of Fargo, Inc. is a Life Director, John Mahan, Mahan Construction, is an inactive Life Director and Gerald Eid, Eid-Co Buildings, Inc., is a Senior Life Director.

In January, the National Association of Home Builders held its board meeting in conjunction with the International Builders Show in Orlando. Legislative update

As always is the case with NAHB, legislative affairs were on the top of the agenda. The top issues NAHB is working on include the AD&C credit crunch, appraisals and continuing to fight for tax reform that does not negatively affect home building. Taxes are always a hot topic when discussing national politics. This year was especially imperative for NAHB due to the board allotting a large amount of money to be spent fighting efforts by some to do away with the mortgage interest deduction. Along with retaining the energy efficient retrofit incentives available, NAHB was happy to see President Obama sign the tax credit extension bill into law. On appraisals, NAHB has been tireless in its efforts to alleviate the issues seen around the country when it comes to the appraisal process. With the expiration of the Home Valuation Code of Conduct rules guiding appraisals, NAHB had the opportunity to provide input before the Fed enacted new rules as part of the Dodd-Frank Wall Street Reform. The Fed is now actively pushing open communication between appraisers and builders so that all relevant information can be provided and used to help appraisals reach a fair market value. NAHB saw some success last year in getting legislation to address the AD&C crisis through the House, but the session ended before any action was taken on the Senate side. NAHB is continuing to brainstorm ways to loosen credit and get banks lending again. Many in the U.S. Congress are working on ways to address this problem, but no easy answers have risen to the top.

NAHB administration

NAHB membership continues to struggle facing uncertain economic conditions in many parts of the country. The national retention rate is around 70 percent, compared to our 90 percent locally. This rate makes it difficult to create accurate revenue streams and budgets and also limits the amount of programming that can be accomplished. NAHB economists do see positive times for the future including a 7 percent increase in new single-family homes in 2010. More than likely, it will still be several years before the

most damaged communities can turn their housing situation around and that will continue to drag down a larger area of nation. The Futures Taskforce, which is looking into inner administration and board structure of NAHB, continues to cause a lot of discussion across a host of issues. The task force is looking at the size of the board, essential programming and what to cut, holding online committee meetings, and a number of other potential cost saving items.

BUILD-PAC update

NAHB’s political action committee, BUILD-PAC, continues to be one of the strongest in the country. This is good news despite the less than 2 percent of members who contribute. This incredibly poor showing of support from its membership is concerning to NAHB and to BUILDPAC officials. If every member gave only the minimum level, BUILD-PAC would be the strongest political action committee in the country. In an effort to increase numbers of contributors, BUILD-PAC has come out with the 2012 club for the 2011-2012 fundraising cycle. The idea behind the 2010 club is for every member should be able to afford to contribute $20.12 to join and help make BUILD-PAC “one voice stronger.” If you haven’t contributed yet, what are you waiting for? Public Issues Report of Area Affairs

City of Fargo keeping busy this winter: Sign code, design district, tree ordinance by Rocky Schneider, Public Affairs Coordinator

As is the case during winter when building activity is slow, local jurisdictions turn their sights inward on how they can modify and hopefully improve their processes and regulations. The city of Fargo is no different and has been busy this winter finalizing a new sign code, trying to create a new commercial design district and developing a citywide ordinance to preserve trees.

Sign Code

Fargo officials held meetings for 18 months, in which hours of testimony was heard and discussion was had about the wide range of issues dealing with signage. After the completion of this process, the city adopted the sign code. While many sections of the sign code needed updating and modernization, as it relates to the building and real estate industry, the HBA of F-M worked hard to keep changes to a minimum. Due to legal challenges, the city was forced to repeal the sign code it had just passed after 18 months of discussion. Subsequently, the city has re-adopted its old sign code. The city now plans to go through the new sign code section by section and, where there is no debate, adopt it in parts.

Commercial Design District

With the growth that has been experienced over the last decade, the city has seen many developers come in with new ideas and visions of how their projects should be built. Some are experienced and come in with detailed plans that include provisions for landscaping, design and other building conditions that have to be met by those builders and owners within the development. Others look to the city to provide recommendations on aesthetic choices that would set their developments apart from others. With this in mind, the city planning office is developing a new zoning category that would provide developers with a design option. This zoning category is envisioned to be used along major corridors in the city but is also able to be used anywhere a developer chooses. The current draft design district has many requirements, including: architectural features, building materials to use and not use, and what colors can or cannot be used on buildings.

As usual, the HBA of F-M has an active role in both the Minnesota and North Dakota Legislatures. With both the North Dakota Association of Builders and Builders Association of Minnesota having weekly government affairs meetings and the legislature’s break-neck pace, it has been quite the task keeping track of all the legislation affecting the home building industry. Fortunately, BAM and NDAB have talented staffs and lobbyists keeping track of day-today actions at the Capitol and keeping abreast of what’s on the minds of legislators. In North Dakota, HBA staff has made several trips to Bismarck to help lobby legislators, meet with other organizations to build coalitions and to testify on legislation. NDAB has put forth two pieces of legislation this session. The first bill, HB 1469, deals with when an architect is required on a private job. It fixes a law that was passed in 2009 mandating confusing and overburdensome requirements on the building industry. UPDATE: Shortly before press time, the House passed HB 1469 by a vote of 91-3! The other bill, SB 2187, deals with appraisals. As most are aware, the appraisal process has been the cause of much strife since the housing bubble burst nationwide. While many of the problems experienced locally were the cause of happenings elsewhere, there were some issues locally that NDAB feels the Appraisal Board has failed to address. SB 2187 would add two positions to the state Appraisal Board, one builder and one Realtor. This bill is still in discussion and the exact makeup of the board is still unknown. It is likely that there will be some change and the important issues will be heard.

City Day on the Hill

The City Commission recently instructed staff to look into developing an ordinance to help preserve existing trees in the city and in future development areas. The HBA is taking part in a group that will meet to review ordinance proposals, make comments and suggestions and to discuss the feasibility of preservation in certain areas. Except around the riverbeds and shelter belts, Fargo is naturally lacking of trees. The biggest obstacle facing the city’s efforts to preserve trees is the level of the land as

The joint trip to the Capitol was meant to show a consolidated effort by a community to address concerns it is facing. City Day on the Hill had great support from members of all five groups and gave an opportunity for many people to travel to Bismarck and see the legislative process up close. Local legislators enjoyed seeing and hearing from their constituents and updating them on the issues that were before them. We’re very pleased with the progress made during the first half of the Legislative session. NDAB introduced to revise HB 1469 regarding architect requirements on buildings which received a ‘Do Pass’ 13-1 recommendation from the House Industry, Business and Labor (IBL) Committee, and then passed the House 91-3. Appraiser bill passes unanimously

Senate Bill 2187, a bill to reform the appraiser chapter of the N.D. Century Code, is supported by the National Association of Doreen Riedman Home Builders NDAB Executive along with the Officer North Dakota Association of Realtors and the two bankers’ groups. If passed, the bill would: • Add members to the N.D. Real Estate Qualifications and Ethics Board, from five members to seven. • Apply term limits of two five-year terms, must be off board for at least two years before being reappointed. • Establish standards for approval of permit applications. • Require more transparency of board activities, provide meeting notices. • Require permitting of applicants licensed in good standing in another state having equivalent licensing requirements within 30 days. The bill was amended by the Senate and may need some “tweaking” on the House side, but the bill is very favorable and will work to improve the appraiser equation in the housing market. Builders, realtors, lenders and appraisers are all partners in the housing industry, and we all need to work together to build, sell, appraise and finance homes. 2011 Minnesota Builders Convention was a success

The 2011 Minnesota Builders Convention was a blast. Thank you to all who attended, sponsored and helped make the convention a major success. From the leadership training to the final farewell breakfast morning, members were kept busy with networking, education, political talk and fun. On the first night of the convention, members attended the National Association of Home Builders Leadership Training and the BAM Government Relations Committee meeting. The new Minnesota Department of Labor and Industry Commissioner Ken Peterson and Assistant Commissioner Jessica Loomens talked with the committee. Later that evening, Casino Night was a hit and the hospitality suites, hosted by our sponsors, were the place to be. The BAM board meeting was the next morning, followed by keynote speaker Kit Welchlin. The evening began with a cocktail reception and silent auction which, along with the Heads or Tails game during the dance and the Wine Wall Raffle, raised $4,800 for BAM-Political Action Committee. NAHB survey shows AD&C credit problems not abating

Credit availability for AD&C loans remains a serious problem for most home builders and shows little sign of easing, according to National Association of Home Builder’s 2010 nationwide fourth quarter survey of more than 300 respondents. The survey is an important tool for both gauging industry conditions and qualifying NAHB’s position in negotiations with regulators and lawmakers on the need to resolve the credit crunch situation.

Unfortunately, the number of survey respondents reporting that they have access to credit has hit alarmingly low levels, with conditions steadily worsening from the final quarter of 2007 through the middle of last year. Many respondents said that they are also experiencing adverse treatment regarding an outstanding AD&C loan. Even worse, 92 percent of builders who reported tightening on singlefamily construction loans said their particular loan was performing prior to the lender’s decision to tighten, while 94 percent of the multifamily construction loans called into question were also in good standing. Another sobering finding was that, as a result of the poor financing climate, 58 percent of builders are putting single-family construction projects on hold. At the same time, half of multifamily developers surveyed said they are waiting to build until credit conditions improve, at a time when rising occupancy rates indicate increasing tightening in the available stock of rental apartments in many parts of the country. On a related note, the Federal Reserve’s January 2011 Senior Loan Officer Opinion Survey on Bank Lending Practices reported continued tight lending conditions by banks to businesses and households, with little change from the last survey. As a whole, the Fed survey is consistent with NAHB survey data of builders’ responses with respect to tight lending practices, particularly with respect to AD&C loans, although not to the degree to which builders continue to report an overly tight lending environment.

Storm water seminar in Jamestown This spring, the North Dakota Water and Pollution Control Conference will host a workshop dealing with storm water and erosion control at construction sites. Members sought to help collect data on storm water from construction sites

National Association of Home Builders’ members with active construction sites are being sought to assist in data collection efforts on the turbidity, or cloudiness, of storm water discharges from construction sites. The field data will help NAHB assess whether a numeric turbidity limit expected to be proposed shortly by the Environmental Protection Agency and finalized in June can be consistently achieved by builders and developers using passive control systems. Under effluent limitation guidelines previously proposed by the EPA, storm water running off construction sites disturbing 10 or more acres would have been limited to 280 Nephelometric Turbidity Units. As a result of an ongoing lawsuit by NAHB and a petition from the Small Business Administration, the EPA was forced to revise the limit. Any turbidity limit will require developers to significantly change how they plan, design and operate their construction sites and manage storm water discharges. NAHB will provide storm water collection kits to volunteers including instructions and the sampling protocol. Members who already have monitoring data for the turbidity of the water coming off their site can also participate by filling out data sheets provided by NAHB. Storm water refresher for builders from N.D. Dept. of Health

As a builder who builds new homes, there are certain responsibilities that you must fulfill in order to reduce the amount of soil erosion and subsequent Stella Stormwater sedimentation from your lot. Although EPA Storm Water a disturbed area that is less than one Enthusiast acre would not be regulated by the North Dakota Department of Health by itself; it is part of a larger common plan of development that is regulated. The purpose of this article is to provide some general guidelines that may be used on sites that involve construction activity that disturb less than 1 acre of soil. You have probably already noticed some sediment and erosion control devices being used throughout other areas of the development where construction activity is taking place. Because each site is different, some lots may require additional controls or alternative controls. Check with the developer and local officials to make sure all storm water requirements are addressed. Sediment and erosion control devices are only specified to handle a two-year, 24-hour rain event. A two-year, 24hour event in North Dakota ranges from 1.9 inches of rain in the west to 2.3 inches of rain in the east over a 24-hour period. This is a little less than nine hundredths of an inch of rain per hour.

Perimeter controls

Perimeter controls are utilized to capture sediment before it leaves the construction site. These types of controls include vegetative buffers, silt fences and sediment logs. Vegetative buffers consist of a minimum 25-foot-wide strip of 4-to-12 inch high dense grass. The 25 foot is adequate for 125 feet of disturbed area upslope from the strip. For every 5 feet of additional disturbed area, 1 foot should be added to the buffer strip. The buffer can be used on slopes up to 5 percent and must be located on the contour of the slope. Silt fence and sediment logs are two types of controls that are used to capture sediment from disturbed areas that are located upslope. These types of controls capture sediment by restricting the flow of the runoff and causing water to pond behind them. The ponded water allows more time for the sediment in the runoff to settle out. A rule of thumb that may be used in deciding a minimum amount of silt fence to be used is: 1 linear foot of silt fence for every 100 square feet of upslope disturbed area.

Sediment traps and cut-back curbs

Sediment traps are small storm water detention areas that allow sediment to settle out of runoff. Traps are usually located next to inlet structures including manholes and inlets located in yards. The size of the sediment trap around an inlet should be 2 feet deep and excavated 10 feet away from the inlet around the entire inlet. Another type of trap that can be used is called a cut-back curb. Cut-back curbs are small traps that are used to pond water behind the curb and gutter system. The cut should be made 3 to 4 feet wide

and 3 to 4 inches deep. The excavation of the cut may be offset a maximum distance of 5 feet from the curb. When a driveway access is encountered and no driveway has been constructed, securely install a plank of wood (2”x4”, 4”x4”) in order to continue the curb.

Inlet Protection

The purpose of inlet protection devices is to reduce the amount of runoff flow into the storm sewer inlet. The device causes runoff to pond and allows more time for sediment particles to settle out. Inlet protection devices are the last line of control for capturing sediment and must be used along with an appropriate perimeter control and/or sediment trap. Caution should be used when choosing and installing an inlet protection device so as not to cause property damage due to flooding. The device should be installed so storm water can bypass the device if too much runoff is received.

Stabilized site access

A stabilized construction site access is used to reduce the amount of sediment tracked from a site onto the street by vehicles or equipment. Vehicles and equipment must never be allowed to enter or exit the site from any other place, especially when there are wet soil conditions.

Roof drains

All roof drains should be provided with sufficient splash pads and/or downspout extensions to prevent erosion from roof runoff. Local regulations may not allow you to discharge roof runoff directly to storm sewers. Do not connect any roof drain directly to any storm sewer without contacting local officials first.

Temporary cover

Temporary cover is used to reduce erosion and should be applied immediately to: • Areas where construction activity has ceased and is not planned to resume within 21 days. • Areas with a continuous slope within 200 feet of any surface water. • Temporary stockpiles such as topsoil and clay. Clean aggregate, demolished concrete and sand stockpiles are exempt. The cover may be obtained by planting fast-growing plants like rye, oats or winter wheat, or it may be obtained by spreading straw, wood chips, wood fiber blankets, or erosion netting over the area.

Permanent cover

Permanent cover is any type of cover that will not likely be disturbed again by construction activities. The permanent cover may either be gravel, asphalt, or concrete areas, or be the application of seed, sod or mulch to an area. Permanent cover should be applied to all completed areas that will not be disturbed or have additional construction activities performed in the area. While construction activity is occurring, parking areas, staging areas and areas immediately surrounding the building site should not be permanently seeded. An area that has been permanently seeded should be blocked off if nearby construction activity is occurring to allow the cover to grow.

The National Association of Home Builders awards the Membership Cup each year to the one local association for its most outstanding membership efforts. There are seven group levels within NAHB based on association size that are eligible to contend for the Membership Cup. it relates to flooding. Any building done on land south of town requires bringing in several feet of dirt. Trying to preserve vegetation and meet the federal and city requirements for base flood elevations is difficult. The group is looking at this problem and how to best manage it. The ordinance will take time to develop as it is a long-term issue and should not be rushed to solve an immediate problem. NDAB Board and Legislative Reception

HBA of F-M members got another opportunity to be a part of the legislative process during NDAB’s board meeting and legislative reception in Bismarck. The legislative reception, held in cooperation with the Realtors Association, is a popular event that many legislators from around the state attend. The event was a great chance for members to meet and talk with their legislators about issues affecting the building industry. The Minnesota Legislature has been active and the Builders Association of Minnesota has been busy introducing legislation, keeping tabs on bills and testifying before committees. BAM’s Builder Day on the Hill was held Feb. 22. HBA of F-M members who did attend include John Gunkelman, Dakota Construction of Fargo, Inc.; Bryce Johnson, HBA executive vice president; Bob Kochmann, Kochmann Brothers Homes, Inc.; John Koerselman, Red River Drywall and Painting Services, Inc.; Ken Krajsa, State Bank & Trust and Rocky Schneider, HBA public affairs coordinator. Details on the event will be in the April issue. One of the biggest items before the Legislature addresses fire sprinklers. BAM is looking at passing similar legislation to what North Dakota passed in 2009, to prevent fire sprinklers in single family homes. With hard work and support from its members, BAM is expecting success and a great session. As with North Dakota, legislators like to hear from constituents. Dave Galt, the company’s general manager, describes these types of enhancements to include chip flooring, cabinetry and storage solutions. We believe that having this type of image for a customer is more efficient than presenting them with a hand-drawn sketch with some scribbled figures on the side.” Galt says that being able to see the expression on a customer’s face is priceless and loves meeting with customers after a completed project to hear their comments on the entire process to help them improve next time. “I enjoy receiving thank you notes or cards from a customer after doing business with them or running into someone months later who comes up to me and is still excited and loving the project we did for them. It is worth every minute of the work put into it and you know it was appreciated,” he explains. Although there are many great things to enjoy about Galt’s job, he does admit to facing the challenge of explaining to a customer who has had a previous product failure from another company what Tailored Living featuring PremierGarage does to ensure that its products won’t fail. This varies from location to location and mainly pertains to floor coatings, explains Galt, but it is something the company has to overcome in order to build trust with customers. “If you are starting out in the industry, make sure you have good support and the proper training. What is your company’s focus/ specialty?

“Thermo-Tech Windows is based out of Sauk Rapids and specializes in middle to high-end vinyl windows and patios for new construction as well as replacements. The company has also expanded and now covers 11 states and just moved into Canada.”

What is the latest trend in your industry?

“Right now we are seeing a lot of advances in energy efficiency. A huge trend is triple-paned energy-effiecient windows. These windows have R5 ratings that help save homeowners a good chunk of change.”

What is the biggest challenge you’re facing and how are you dealing with it?

“Staying up-to-date on the changes from the Department of Energy and Energy Star keeps all window manufacturers scrambling to make sure they have the top-notch products and knowledge of what is available. We definitely work to keep ourselves on top of all the changes. We attend seminars and/or conferences that are available. “With the economy as it is right now, we have been doing more replacements than in the past. It is nice to be able to have other options for different economic situations. Remodelers asked to comment on certification, record keeping costs of lead rule

Remodelers and contractors who are trained and certified under the Environmental Protection Agency’s Renovation, Repair and Painting (RRP) rule now have the opportunity to provide the agency with comments on the cost of certification and recordkeeping under the new regulation. The EPA announced it was seeking comments in a routine Information Collection Request published in the Federal Register on Jan. 26. The various estimated cost burdens of the RRP rule are included in a supporting statement from the EPA. In its economic analysis of the rule, the EPA estimated that remodelers would spend 3-1/2 hours familiarizing themselves with the rule and completing the initial firm certification form. It should take another three minutes per project to complete, present and explain the post-renovation checklist to the property owners or tenants, according to EPA projections. Lastly, the EPA said that it expected remodelers to spend a little less than five hours on recordkeeping. Comments from remodelers are due by March 28. Student chapters place at the International Builders Show

All four of HBA of F-M’s local student chapters attended the International Builders Show in January. Minnesota State University Moorhead, North Dakota State College of Science and North Dakota State University all participated in the Residential Construction Management Competition while in Orlando. NDSCS placed 3rd among nine two-year schools. NDSU placed seventh and MSUM placed 20th among 35 schools in the four-year division. Competing at IBS is very challenging. These students dedicated a lot of time and hard work to their projects and it paid off. It is so great to see all of our local school chapters engaging in the industry.

Become a Triple Player

The foundation, created in 1993 by the Home Builders Association of FargoMoorhead, is a local 501(c)3 nonprofit charitable organization. It was established with funds donated by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling. The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.

I challenge each and every member to become a Triple Player. A Triple Player is a member who pays HBA of F-M membership dues ($395), contributes at least $365 to NDAB-PAC and donates at least $365 to Home Builders Care. This option is one of the best ways to support the building industry.

Herdina Academy for the Construction Trades

The 13th annual Herdina Academy for the Construction Trades is slated for June 6-17. The Academy is available to high school students age 16 and older who are interested in construction. The two-week course is supervised by educational professionals like you! The HBA of F-M will need industry volunteers to work with the students as they experience a variety of different professions. During the two-week course, the students build sheds that are available for sale and can be built to order. Fargo-Moorhead is home to four NAHB student chapters

The National Association of Home Builders supports students pursuing careers in the construction industry through student chapters at schools across the country. Students in technical schools, community colleges and universities who are enrolled in fields such as carpentry, construction management, engineering, architecture, etc. can become members of their school’s student chapter. The HBA of F-M is fortunate to have four area schools that provide construction-related degrees. Your HBA is one of only a few associations in the country that sponsors more than one chapter. The HBA of F-M works with chapters at Minnesota State Community & Technical College, Minnesota State University Moorhead, North Dakota State College of Science Wahpeton and North Dakota State University.

Minnesota State Community and Technical College

M State student chapter members study in programs of carpentry, construction electricity, construction management, engineering and plumbing technology. They are able to participate in a variety of activities at their school and in the community. They also have the opportunity to attend the International Builders Show every year held either in Orlando or Las Vegas. This past year they volunteered a significant amount of time and talent for the Extreme Makeover: Home Edition project in Moorhead.

Minnesota State University Moorhead

Students attending MSUM and studying in the construction management program are eligible to be a member of the NAHB student chapter. MSUM students can participate in competitions available only to student chapter members. This year the chapter placed third at the Associated Schools of Construction competition and twentieth at the Residential Construction Management competition at the Interna-

tional Builders Show. The MSUM student chapter has also adopted a section of Interstate 94 in Minnesota and volunteers at numerous events around the community.

North Dakota State College of Science

The students belonging to the NDSCS chapter can be studying a variety of programs as the college offers programs in architectural drafting and estimating technology; building construction technology; civil engineering and surveying technology; construction management technology; electrical construction; heating, ventilation, air conditioning/R technology; and plumbing. Students have also participated in the Residential Construction Management competition at the International Builders Show and placed third at the 2011 show. The student chapter has been actively volunteering and has also traveled to Louisiana to help with the Extreme Makeover: Home Edition project where many from our area were involved!

North Dakota State University

The NDSU student chapter represents students from the architecture, construction engineering and construction management programs. This student chapter has also been a long-time participant in the Residential Construction Management competition. At the 2011 International Builders Show, the team placed seventh in their division against 35 other schools from across the nation. These students also volunteer their time around the community and often help at HBA of F-M events and regularly attend GMMs. All four of our local student chapters are vital to the continuation of our industry. We are lucky to have a variety of programs to train and educate the next generation of workers. Home Builders Care of Fargo-Moorhead Foundation supports these groups and awards scholarships to them each fall. If you would like to donate specifically to support scholarships, please ask about our Trades for Grades program and designate your donation.

What to do when money is tight by Jennifer Elder - Tiffany Construction & Development Corp.

Through your cash flow projections, you can see it coming. But despite your best efforts, there’s not enough cash to pay all your bills. What do you do now? Addressing a cash shortfall should be done early - and honestly. Almost all businesses experience a cash crisis. How you manage the crisis is the key. The steps you take - or don’t take - will affect your reputation and that of your business. They will affect your relationships with your employees, vendors and bankers. Ultimately, your decisions will determine if your business will survive. All this may sound dire, but it becomes so only if you ignore the situation. The following are several steps you can take to improve your cash situation quickly:

Become a spending disciplinarian

Cut out all unnecessary expenses. From now on, before making every business expenditure, ask yourself, “Will this get me another customer?” Do you really need $40-a-pound coffee in the office? Do you need a new piece of equipment, or can you buy it used? Do you use all six phone lines or can you cut it down to four? Do you need a new truck just because the lease is up on your old one?

Be rabid about collecting your cash

Try to get your customers to pay on time or even early. If you have not received a payment from a customer on the day it is due, call him and ask when you can expect payment - get a specific date. Continue calling until your bill is paid. Remember the expression, “the squeaky wheel gets the grease.” Offer discounts to your customers who pay early.

Send invoices more frequently

Instead of sending customers an invoice once a month, consider billing them weekly. It might be a bit more work, but will get you cash in your checkbook sooner.

Make deposits daily

Don’t wait until the end of the week to make a bank deposit. Make a deposit every day that you receive money.

Develop a plan

If your cash crunch looks to be more than temporary, create a plan to address the issue. Don’t just pay some vendors - like the ones who call you often or the ones with small balances. Work on a plan to pay something to everyone. You might want to get some advice and assistance from your accountant or lawyer.

Talk to your bankers

It is usually too late to borrow money when you really need it, but it is worth asking. Meet with your banker to see if you can get a line of credit. Or, see if you can adjust the terms of existing loans. Your bankers won’t be happy about adjusting the terms, but it’s a better solution for them than seeing you go bankrupt.

Talk to your creditors

Be upfront with your creditors. Calling them in advance and asking for an extension of the due date is better than having to explain why you haven’t paid your bill. These are not easy phone calls, but they will maintain your integrity and reputation. Be honest. Suggest a payment schedule, but don’t make promises you can’t keep. If you don’t know when you can make the next payment, tell your vendor when you’ll be making the next decision and follow up with them then. Again, your vendors may not be happy with you, but most will understand as long as you stay in contact with them regularly. Sell items that you are not using. Get rid of excess inventory and unused tools on eBay, craigslist or other online classified services, or in your local paper.

Stockpiled material consists of gravel, sand, excavated soil, topsoil or any other similar material. These piles should never be placed in any storm water conveyance system (e.g. curb and gutter, drainage ditch), overnight or over the weekend. They should also never be allowed to sit in a conveyance system if inclement weather is approaching. An appropriate erosion control device should be in place between any stockpile and any storm water conveyance system. Only a minimal amount of stockpiled material should be placed directly against any device and in no case shall it be more than 1/6 the height of the exposed height of the device.

Waste disposal

All construction debris must be placed in an appropriate container to prevent the debris from being carried away from the site by wind or water. All debris should be properly disposed of at an appropriate facility. All liquid or soluble materials (e.g. oil and paint) should be properly stored to prevent spills, leaks or discharges. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste must be in compliance with applicable regulations.

Concrete-wash water

Concrete wash water must never be discharged to any waters of the state, storm sewer systems or allowed to drain onto adjacent properties. Wash water disposal must be limited to a defined area of the site or to an area designated by the developer for cement washout. The area must be sufficient to contain the wash water and residual cement.

Removal of sediment and erosion controls

If any construction activity leads to the accidental removal of a sediment and erosion control device, the device must be replaced immediately. If any construction activity must be done where there is a device already in place, the device may be removed but must be replaced once the activity has ceased. Sediment and erosion control devices must be used and maintained until 70 percent of pre-existing vegetative coverage has been achieved on all pervious surface areas, such as lawns, that are located upslope from the device.

Inspections and housekeeping

Inspection of all sediment and erosion control devices and measures should take place every 14 calendar days and within 24 hours after any storm event greater than 1/2 inch of rain per 24 hour period. Any device or measure that is in need of maintenance or repair should be done following housekeeping guidelines. Good housekeeping should be practiced at all times. Housekeeping includes cleaning and maintaining all erosion and sediment control devices, cleaning sediment off of streets, and picking up all debris that has been deposited off site by wind or water. Sediment control devices, such as silt fence, should be cleaned out once the amount of accumulated sediment has reached 1/3 of the exposed height of the device. If the device is not functioning properly, it should be repaired or replaced. Any removal of sediment, or repair or replacement of any device should be done within 24 hours of discovery, or as soon as field conditions allow access. Sediment traps or basins should be cleaned out once the amount of accumulated sediment has reduced the storage volume of the trap or basin by 1/2. Drainage and removal of sediment must be done within 72 hours of discovery, or as soon as field conditions allow access. Soil or sediment that has been deposited or tracked onto any street should be removed within 48 hrs. Removal may

EPA Remodeling, Renovation & Painting (RRP) Rule Effective Feb. 1, 2011 - Minnesota now requires lead certification when issuing permits

Municipalities will be verifying lead certification for residential builders, remodelers, roofers and manufactured home installers when requesting a permit to work on homes constructed prior to 1978.

Effective April 22 - building and remodeling firms must have one or more “certified renovators” assigned to each job where lead-based paint is disturbed. Eight hours of training is required to become a “certified renovator.”

All registrations must be pre-paid and received at least 24 hours in advance of the class. Refunds will only be provided if notice of cancellation is received 24 hours before the class.

This class has been approved for 4.5 hours of North Dakota Professional Builder credit by the N.D. Association of Builders. See www.ndbuild.com for more details on NDPB.

To become certified, a renovator must successfully complete an EPA or stateapproved training course. All renovation workers must be trained. Renovation workers can be trained on-the-job by a Certified Renovator to use lead-safe work practices, or they can become Certified Renovators themselves.
