Advanced Engineering and Environmental Services has promoted Nick Stattelman to the position of survey practice leader. Julie Dykema has joined Advantage Realtors as a sales associate. sales criteria including attainment of sales goals and customer service performance levels. Kirk Carlson, a Realtor with Coldwell Banker First Realty, has earned the company’s Merit Award for 2014. He was recognized for his outstanding dedication, loyalty and integrity. Carlson has been a Realtor in Fargo since 2013 and was awarded Rookie of the Year in his first year with the company. Dawson Insurance Agency was named a 2014 top-performing agency for SECURA Insurance, a regional property and casualty insurance company based in Appleton, Wis. This is the agency’s first time earning a topperformer award from the company. Jed Dunham and Josh Grimley, employees of Personal Touch Embroidery and Marketing, have completed 3M/Lowen certification for vehicle wraps. The Next Generation Ultimate Double Hung Window from Marvin Windows and Doors was selected at the 2015 International Builders’ Show as the winner of the Best of IBS Award, given by the National Association of Home Builders. Marvin’s window was selected out of hundreds of applicants as the best and most innovative window product on the market by combining state-of-the-art technology and craftsmanship, resulting in a traditional-looking window that is modern and innovative. Bruce Donarski of NetWork Center Inc., has achieved VSP 5.5 certification from VMware. Chris Feickert, a sales associate at Park Co. Realtors has earned a broker’s license. She completed 90 classroom hours approved by the North Dakota Real Estate Commission and passed a licensing exam.

NAHB Victories Save Nearly $7K per Housing Start Last Year The National Association of Home Builders exists to serve the needs of its

members, and it does this by fighting for the housing industry on major policy issues, by providing solid educational and networking opportunities, and with member savings programs with major retailers. Each year, NAHB economists run the numbers and put a specific dollar value on NAHB’s achievements so that members can see the return on their investment. All together, NAHB’s efforts saved the typical home builder roughly $6,800 per housing start last year. Below is a summary of NAHB programs and policy victories that contributed to tangible savings for members in 2014. There are many ways to calculate an estimate of the benefits of membership. The numbers below are averages, and some members will experience more of these benefits than others, depending on location, business volume and the aspect of the industry in which they work. And while there are many ways to parse the numbers, the key point is that NAHB’s efforts deliver significant value for the membership. • National Flood Insurance Act saves business for builders and remodelers • Farm Bill generates additional home building and remodeling • EPA drops post-construction storm water rule • U.S. Supreme Court ruling on Clean Air Act benefits multi-family builders • Keeping costly provisions out of building codes saves on construction costs • Value of NAHB designations earned during the year • Delayed Affordable Care Act Requirements saves costs for the building industry • Workforce act funds training for careers in home building • Extending Mortgage Insurance Tax Deduction preserves new home sales • Extension of Energy Tax Credits stimulates new construction and remodeling For details on any of these items visit www.thevalueofnahb.org Combine NAHB’s efforts with actions in Bismarck (partnering with North Dakota Association of Builders) and in St. Paul (partnering with the Builders Association of Minnesota), and your dues dollars are well worth it. March brings wide variety of education

We recognize that knowledge is power, and information is valuable to you. There are 22 working days in March, and half of those are dedicated to education at the HBA of F-M. We will offer continuing education for Minnesota power limited technicians and plumbers, refresher classes for those impacted by the EPA Renovation Repair & Painting Rule, NAHB advanced green and business management classes, an OSHA 30-Hour Construction Course and a lunch session on succession planning. been part of the Moorhead building codes team since 2000. He also has experience as a mechanical inspector for the city of Fargo. He holds certifications as both a Minnesota Certified Building Official and Master Plumbing Certification from both Minnesota and North Dakota, having worked in the trades for several years prior to working in building codes. Moorhead City Manager Michael Redlinger notes: “The city is very fortunate to retain and promote Jack as our building official based on his history with the city and his field experience. We also thank Kurt for his 20 years of service and the team approach shared with Jack these past many years. The transition from Kurt’s leadership to Jack’s will be smooth.” Kerry Peuser, an architect with Michael J. Burns Architects, served on the interview panel, “I’ve worked with Jack on projects and appreciate his code knowledge and his willingness to look at a variety of alternatives to achieve code requirements that save resources or improve the project in some way. The city of Moorhead is lucky to have him.”

International Builders’ Show Members attend International Builders’ Show, hear reports on national housing market

by Ken Krajsa, Bell State Bank & Trust, NDAB Associate National Director Members and HBA of F-M leaders attended the International Builders’ Show and board of directors meeting in Las Vegas in January. Special thanks to the HBA of F-M directors and staff who attended on behalf of our local Association and industry. Thank you to the North Dakota Association of Builders for hosting a reception for all North Dakotans in attendance! It’s always nice to have a gathering of familiar faces and a place to connect during that busy week in Vegas. Here are the highlights from the board and committee meetings: • As a result of NAHB’s advocacy efforts last year, builders saved an average of $6,882 per housing start for the typical home builder. • At the board of directors meeting, it was reported that 2014 saw 1 million housing starts which was the first time since 2007. The nation is at 49 percent of normal production, and NAHB projects that rate will be 68 percent this year, and 90 percent by 2016. • At the committee level, members learned that the top issues for builders include lot availability and pricing, labor, regulation and building code and AD&C/ mortgage financing and appraisals. • NAHB is projecting 3 percent economic growth in 2015 and this would be only the second time in the last

decade the nation had growth at that level. • Interest rates are currently low, but short-term rates will go higher later this year. • Consumer confidence is higher and the housing industry is seeing trade-up buyers. • There is action to create an accurate National Home Construction Database for builders to enter data on their projects to assist with accurate appraisals for new homes. Currently, the MLS is Director of Development & Education Jenny Erickson being used and Executive Vice President Bryce Johnson attend the International Builders’ Show in Las Vegas. which is not consistent since many newly constructed homes do not pass through it. Outside of the board and committee meetings, here are the highlights: • North Dakota State University, North Dakota State College of Science - Wahpeton (two teams) and Minnesota State Community and Technical College - Moorhead, competed in the National Association of Home Builders’ Residential Construction Management Competition. This is the first time in many years that M State has sent a team, and they received “Rookie of

the Year!” Congratulations to all four teams on their hard work. • NAHB’s new website will launch soon. Stay tuned! • The International Builders Show and the Kitchen & Bath Industry Show will continue to co-locate for the next five years. • NAHB’s field representatives have been hired and are beginning to visit the states within their jurisdictions. These representatives help local and state associations serve their diverse memberships.

IBS Student Chapters recap

In January, students from our local NAHB Student Chapters at Minnesota State Community and Technical College, North Dakota State College of Science and North Dakota State University traveled to the International Builders’ Show in Las Vegas. While there, they competed in the Residential Construction Management competition. NDSU competed against 35 other schools and had to create a mixed-use-development in Nashville, Tenn. M State and NDSCS competed against 15 other school teams and prepared construction documents, schedules and estimates for a home in Las Vegas. HBA of F-M members that attended the presentations are very proud of the Student Chapters. M State was awarded the Rookie of the Year award since this was the first time the construction management program competed. While in Las Vegas, students also attended the NDAB reception and were able to meet members from all over the state. The National Housing Endowment and Home Building Institute are very supportive of the students while at the International Builders’ Show. Students are able to attend education sessions, walk the floor and attend a job fair. Home Builders Care Foundation of Fargo-Moorhead, in conjunction with the HBA supported the Student Chapters through a National Housing Endowment scholarship. These funds helped the students travel to Las Vegas. Thank you for supporting the Home Builder Care Foundation! Because of you, we could assist the students experience at the International Builders’ Show.

Local Issues Update Fargo

• The revised FEMA Flood Insurance Rate Map was adopted on Jan. 16, 2015. Flood insurance is mandatory for mortgaged structures in the Special Flood Hazard Area. Check www.fargofloodinsurance. com for map updates. • In December, Fargo’s City Commission adopted revisions to its floodproof foundation requirements. HBA of F-M leaders involved with preparatory meetings on these changes were not presented an opportunity to review the final document and were surprised to find troubling changes affecting cost. Association leaders are working with Fargo’s engineering and inspections departments to iron out issues and provide education to the industry on the changes so contractors can prepare accurate bids and planning for projects. • In January, Fargo learned it would be allowed to continue participating in FEMA’s “basement exception” which allows construction of homes with basements even though they are in the floodplain. Due to the no basement failures for over 40 years, and strict floodproof foundation standards, FEMA will allow the exception until the floodplain is revised again.

and Senate that the HBA of F-M is monitoring: • They took a special interest in SB 2375, which forms special purpose tax districts and a community facilities district for public improvements. • There are five pieces of legislation that relate to the F-M Diversion, including one, SB 2076 which the HBA and NDAB oppose, that appropriates money to another study of the diversion. A second bill, SB 2144 focuses on diversion funds, which passed the Senate 47-0. HB 1415 pertains to funding for in-town levee work for Fargo. The HBA supports this bill. It is sponsored by House Majority Leader Al Carlson and passed the House 84-4. SB 2020 pertains to appropriations for the State Water Commission and includes funding for flood protection for the Fargo area. It remains in Appropriations Committee. HBA supports. This has a do not pass recommendation from the committee. • Finally, the group thanked the legislators who voted against HB 1451, the sprinkler bill, which failed. They topped off the day visiting with House Majority Leader Al Carlson, Senate Majority Leader Rich Wardner and Senate Minority Leader Mac Schneider.

Moorhead

• The 2015 Minnesota Building Code became effective Jan. 24. A new provision requires fire sprinklers in certain housing types and sizes including two-family dwellings, townhouses and single-family dwellings of 4,500 square feet or more. • The 2015 Minnesota Energy Code was scheduled to become effective Feb. 14. Home builders should be aware of the changes regarding foundation insulation and blower door testing requirements. • Minnesota contractors who are members of the HBA of F-M have access to the Builders Association of Minnesota’s members-only website at www.bamn. org. BAM’s code guides are valued at over $10,000, and they will help you navigate and comply with the new codes. State Issues Update Several HBA of F-M volunteer leaders traveled to Bismarck

and St. Paul in mid February to take part in the North Dakota Association of Builders and Builders Association of Minnesota’s legislative events.

North Dakota

NDAB hosted a chili and oyster stew feed with the North Dakota Association of Realtors. The HBA of F-M group spent the day at the capitol meeting with legislators on upcoming issues. There are several bills in both the North Dakota House 10

Here is a brief on additional bills of interest:

Housing Incentive Fund • HB 1014 involves the Housing Incentive Fund credits and using the flex PACE program. • SB 2257 extends the Housing Incentive Fund program and tax credit, while seeking to continue providing appropriations. • HB 2220 pertains to the state’s Housing Incentive Fund and providing money and tax incentives for affordable housing in the state. HBA/NDAB support. Assessments • HB 1054 concerns the assessment of agricultural property (Passed House 89-1). • HB 1057 focuses on the notice to property owners regarding assessment increases (Passed House 89-1). • HB 1340 relates to Infrastructure and the Public Vote. Additionally, it concerns methods of protest regarding special assessment projects (Passed House 92-0). • HB 1392 involves a special assessment imposition for mobile home parks and single-family residential properties (Passed House 77-10). • SB 2054 relates to assessors’ training and certification (Passed Senate 26-20). www.hbafm.com


Real Estate • HB 1074 concerns the application deadline for renewing real estate licenses and practicing as a real estate broker or salesperson (Passed House 82-1). • HB 1100 relates to real estate permits (Passed House 84-2). • HB 1220 involves the acceptance of funds by closing agents in real estate transactions (Passed House 900). Eminent Domain • SB 2361 relates to the use of eminent domain by the Western Area Water Supply Authority (Passed Senate 40-6). Building Professionals • HB 1128 focuses on bonds for at-risk construction managers (Passed House 91-1). • HB 1401 concerns sales and use tax exemptions for purchases made by contractors, subcontractors, or builders purchasing on behalf of an exempt entity (Passed House 93-0). • SB 2185 focuses on disciplinary action procedure in terms of professional engineers and land surveyors. • SB 2233 is about the public opening of subcontractor bids (Passed Senate 47-0). • SB 2278 pertains to contractor licensing fees. (Passed Senate 33-13). Property Tax • HB 1059 concerns a state-paid property tax relief credit (Passed House 92-0) • HB 1070 relates to the property tax exemption for affordable housing (Passed House 74-18). • SB 2307 provides a provision of property tax relief through residential property tax reduction and provides a renter’s income tax credit (Passed Senate 47-0). Miscellaneous • HB 1007 relates to providing an appropriation to defray

expenses of the veterans’ home and provides and exemption. • HB 1136 is centered upon regulating limited liability companies. • SB 2024 concerns reclaiming a township or city zoning authority • SB 2147 changes the language in the One Call statute to require excavators to pay the operator’s cost of utility location on any excavation site after the first two requests. It passed the Senate 28-18. HBA/NDAB oppose. • SB 2188 pertains to construction fraud (Passed Senate 45-0). • SB 2311 concerns human burial sites • SB 2336 concerns the approval of the state water commission regarding expanding the western area water supply project. Recently Defeated Bills • HB 1341 concerns the size of improvement districts for special assessment improvements (14-78). • HB 1449 relates to first-time home buyer closing assistance (10-81). • HB 1058 pertains to notices by political subdivisions in relation to a proposed property tax levy increase (4249). • HB 1069 relates to the availability of property tax information online (28-62). • HB 1332 relates to the exercise of eminent domain authority on behalf of unelected boards (22-68). • SB 2095 relates to out-of-state contractors that come into North Dakota during emergencies to do work (839).

Minnesota

In St. Paul, at BAM’s Building Industry Day at the Capitol, the HBA of F-M set up meetings with state legislators including Sen. Kent Eken, Rep. Paul Marquart, Rep. Ben Lien and Rep. Jeff Backer. They covered several bills including SF 104, which relates to statutory housing warranties, HF 539 and SF 201, both relate to adopting a sixyear cycle for code adoption and a 12-month implementation period, and SF 118, which prohibits mandatory fire sprinkler installation. Finally, there was discussion on HF 473, also called “This Old House,” which relates to taxation and authorizing valuation exclusion for certain improvements to homes and commercial-industrial property. A Busy Time of Year Winter is flying by and we’ve been

busy working for our members at the North Dakota Association of Builders. In January nearly 300 North Dakota home building industry leaders attended the National Association of Home Builders International Builders’ LeRoy Kurtyka Show in Las Vegas for a week of NDAB President training, networking and 2015 product previews. We had a great turnout for our Annual North Dakota Reception with over 170 people attending and we enjoyed several small group get-togethers throughout the week as well. NAHB business meetings were also conducted during this week and 2015 looks to be a good growing year for associations at all levels - local, state and national. Membership drives will be a focus this year and we were introduced to our five regional field representatives that were hired at the start of the year. We welcome Michael Blake Bezeruki as our area field representative. He comes to NAHB by way of Weber-Merrrit, where he recently served as a government affairs consultant, lobbying on behalf of NAHB as a part of the grassroots program. Michael has experience fundraising and assisting with a U.S. congressional campaign. He will reside in Springfield, Ill., and will be making visits to his 11 states throughout the spring, summer and fall. We look forward to hosting him in North Dakota soon. The next national meeting dates for NAHB are June 2-6 in Washington, D.C. Business meetings and Hill visits will be conducted and we hope many of you will attend to take advantage of these opportunities. In February a constant focus for NDAB is our legislative session. I’m happy to report that Kim has been tirelessly involved on behalf of our members and that, collectively, we’ve made a difference in a number of bills to date. Thank you for your participation in our NDAB calls to action and remember that you can reach out to us at NDAB, or to any of your legislators at any time with your concerns or input. We appreciate knowing the issues at the top or your minds. In March we look forward to our NDAB board of directors coming together for the spring Board meeting and we will also be participating in NAHB’s second annual Bringing Housing Home event for which we will be meeting with our national delegates Congressman Cramer, Senator Hoeven, and Senator Heitkamp, based on their availabilities, to update them with our industries main concerns and any national legislative issues we feel important. Heating Up While the weather outside seems

to be getting colder, the temperature at the North Dakota Association of Builders office, the Capitol and at the gathering for the legislators, statewide offices, builders and realtors is heating up in February! A big thank you goes out to all who joined us in Bismarck in mid-February Kim Schneider for the Oyster and Chili Feed NDAB NDAB Executive Officer co-hosted with the North Dakota Realtors Association. The room was packed with friendly faces from both sides of the aisle and from across the state. It’s with great respect that we work closely with the members of the 64th legislature and we appreciate that after putting in a long day they joined us over a hot bowl of chowder and chili to catch up on the issues and hear our stance. Not only did legislators join but we had special guests from the North Dakota’s Tax Commissioners office, Attorney General’s office, Ag Commissioners office and the State Treasure office. Prior to this gathering, NDAB-PAC members from each local association and the executive officers met to discuss the future of NDAB-PAC and the importance of the role it has in North Dakota. We welcomed Meghan Everngam, assistant vice president, BUILD-PAC with National Association of Home Builders. NDAB-PAC is the North Dakota Association of Builders’ political action committee. It is a non-partisan political action committee which provides support for candidates who support the building industry. NDAB-PAC recognizes there is strength in numbers. People who show they care and are concerned about the future of the building industry make contributions to NDAB-PAC because they believe that cooperation equals strength. You alone can’t influence the Legislature or Congress on issues that can devastate your business. NDAB-PAC is your front line of defense. It monitors legislative issues and works to protect and promote the building industry. Also, a portion of your contribution is passed along to BUILD-PAC, NAHB’s Political Action Committee, one of the most recognized and well-respected PACs in Washington. If interested in learning more about NDAB-PAC or how to contribute, please contact our office or reach out to your local executive officer. March will also bring us to NAHB’s Bringing Housing Home Legislative Conference for in-district Congressional Visits. We will host meetings March 10 with our national delegates along with North Dakota Secretary of State Al Jaeger. These meetings bring face-to-face time with decision makers who are back in their home state to discuss issues that matter to our industry. Members are welcome to join the discussion or share questions and topics of concerns with their local associations to bring forth to our meetings. Our 2014 meetings were very successful and we appreciated the time to sit down and have open dialogue with representation from all six local associations. Homeowner Attorney Fee Bill Stalled A bill to allow home owners to recover attorney’s fees in

warranty claim litigation failed to move out of the Senate Judiciary Committee Jan. 27. The bill was tabled and will not be brought up again unless the author can reach a compromise with interested parties. Testifying agains the bill was BAM President Mike Paradise, BAM Executive Vice President Remi Stone, and BAM legal counsel Rob Moschet. The bill, SF 104, authored by Senator Barb Goodwin (DFLColumbia Heights) would have granted attorney’s fees to home owners if they prevailed, however, it would not allow builders to recover attorney’s fees in the event the builder prevailed - even if the home owner’s lawsuit was frivolous. Not only does the bill deviate from the well established legal principle known as the “American Rule” (each side pays for their own attorney), but it would have incented plaintiffs’ attorneys to bring weak claims that could be easily settled along with the reward of their fees. The one-sidedness the the bill was particularly disconcerting to the BAM. BAM does not expect the bill to get a hearing in the House of Representatives.

Construction Codes Bills on the Move Saint Cloud legislators are carrying BAM’s proactive codes

legislative agenda this year. Senator John Pederson (R - St. Cloud) and Representative Tama Theis (R-St. Cloud) are lead sponsors of SF 201 / HF 160. These bills are slated to have a hearing in the next couple of weeks in both the House and Senate. The bills proposed the following: • 6-year code cycle guaranteed in statute • 12-month implementation period for all future codes • Free codes for all by the next code cycle • Immediate delay of the 2015 code effective date Also prepared is an amendment to the bills that will direct the Minnesota Department of Labor and Industry to establish clear methods to achieve a performance path to achieve energy efficiency under the International Energy Conservation Code for the whole house system outside the normal prescriptive method outlined in the code.

Over 150 people attended and enjoyed a packed agenda. We started the night with a Year in Review video that covered everything the Association did in 2014. Being a part of this association network is important to Verity Homes. The company stresses that by requiring all of the trade suppliers they work with to be a member as well. “We feel strong about HBA involvement in political action and policy making and how important it is to our industry,” says owner Arthur Goldammer. They sometimes meet resistance, until they explain what the Association does and its importance. Goldammer attended the University of Mary to pursue a business degree. Not originally planning to join the home building industry, after a few years of remodeling work, Goldammer knew he wanted to start his own home building business. Verity Homes began in Bismarck ten years ago, and just expanded to Fargo in October of 2014.

Moving to the Fargo market was a given for Goldammer, with the booming economy and need for housing units; he knew Verity Homes would be there, but had to wait for the right time. Verity Homes works with its in-house sales team to give customers more time and attention during the buying process. Each sales team member has his or her own social media page, allowing customers to interact with their agent directly. The use of its in-house sales team doesn’t eliminate the very important role of Realtors in the home building industry; Verity Homes works often with outside agents as well. Verity Homes makes the process easy and smooth for customers through pre-pricing its options and allowing customers to personalize their homes. About 85 percent of Verity Homes’ customers are first-time buyers. Outside of building for its customers, Verity Homes

participates in charitable endeavors, like North Dakota’s first Homes for Hopes. According to Homes for Hopes’ website, “A Home for Hope is a charity home built by a builder and his/her trade partners – subcontractors, suppliers, and consultants – on a largely pro bono basis. The net proceeds go to support the fight against global poverty, especially through the work of HOPE International.” The money goes toward micro-loans in developing countries, which enable entrepreneurs to pursue their business and help their families break free from poverty. Verity Homes also participates in the special Olympics, ASPCA, Human Society, Santas for Seniors, Toys for Tots and the American Cancer Society. In addition, we launched our first ever Lego Home Building Competition at the Red River Valley Home & Garden Show. Kids, ages 5-13, built homes out of Legos and competed for cash prizes. Registration filled up quickly, with kids excited to build a Lego home! The event went over extremely well and HBC is excited to continue this competition next year. Housing Affordability Edges Up in the Fourth Quarter Feb. 19 - Slightly lower interest rates and home prices in

markets across the country contributed to a slight increase in nationwide housing affordability in the fourth quarter of 2014, according to the National Association of Home Builders/Wells Fargo Housing Opportunity Index (HOI) released today. In all, 62.8 percent of new and existing homes sold between the beginning of October and end of December were affordable to families earning the U.S. median income of $63,900. This is up from the 61.8 percent of homes sold that were affordable to median-income earners in the third quarter. The national median home price declined from $220,800 in the third quarter to $215,000 in the fourth quarter. Meanwhile, average mortgage interest rates decreased from 4.35 percent to 4.29 percent in the same period. “This upturn in affordability for the final quarter of 2014 is a positive development and is in line with what we are hearing from builders in the field that more prospective buyers are starting to move forward in the marketplace,” said NAHB Chairman Tom Woods, a home builder from Blue Springs, Mo." “Affordable home prices, historically low mortgage rates and an improving job market will release pent-up demand and help keep the housing market moving forward in the year ahead,” said NAHB Chief Economist David Crowe. Syracuse, N.Y. claimed the title of the nation’s most affordable major housing market, as 92.8 percent of all new and existing homes sold in the fourth quarter of 2014 were affordable to families earning the area’s median income of $67,700. Also ranking among the most affordable major housing markets in respective order were Akron, Ohio; Dayton, Ohio; Harrisburg-Carlisle, Pa.; and Scranton-Wilkes-Barre, Pa; the latter two of which tied for fourth place. Meanwhile, Cumberland, Md.-W.Va. topped the affordability chart among smaller markets in the final quarter of 2014. There, 96.2 percent of homes sold during the fourth quarter were affordable to families earning the area’s median income of $54,100. Other smaller housing markets at the top of the index include Kokomo, Ind.; Wheeling, W.Va.-Ohio; Binghamton, N.Y.; and Salisbury, Md. For a ninth consecutive quarter, San Francisco-San MateoRedwood City, Calif. was the nation’s least affordable major housing market. There, just 11.1 percent of homes sold in the fourth quarter were affordable to families earning the area’s median income of $100,400. Other major metros at the bottom of the affordability chart were Los Angeles-Long Beach-Glendale, Calif.; Santa AnaAnaheim-Irvine, Calif.; San Jose-Sunnyvale-Santa Clara, Calif.; and New York-White Plains-Wayne, N.Y. All five least affordable small housing markets were in California. At the very bottom was Napa, where 12 percent of all new and existing homes sold were affordable to families earning the area’s median income of $70,300. Other small

Under the EPA Lead: Renovation, Repair and Painting (LRRP) rule (40 C.F.R. § 745.90(a)(4)) • Individuals who completed an initial renovator certification course accredited by EPA before April 22, 2010 • Must complete an EPA-accredited renovator refresher course before July 1, 2015, to maintain renovator certification. • Individuals who completed an initial renovator certification course after April 22, 2010 • Must complete a renovator refresher course accredited by EPA or an authorized State or Tribal program within five years of the date the individual completed the initial certification course. • If the individual does not complete a refresher course within this time, the individual must re-take the initial course to become certified again.

• Look up when your individual and firm certification expires on the EPA website: http://cfpub.epa.gov/ flpp/searchrrp_firm.htm What are the requirements for EPA Lead-Safe Certified Renovator Firm recertification? • Requirements exist for EPA Lead-Safe Certified Renovator Firm recertification as well. Renovation firm certifications also expire every five years. Firms should be aware of their expiration date and plan on submitting their recertification application at least 90 days before the expiration to ensure recertification is complete before their current certification expires. There is no penalty for applying for recertification early and certification will be extended five years from the date of the current expiration regardless of how early a firm applies. • Firms applying for certification can apply online and are able to complete both the application and payment online. • A certified firm maintains its certification by submitting a complete and timely Application for Firms, noting that it is an application for recertification, and paying the required recertification fee. Can I apply early for recertification? Yes, but be aware of the following difference between individual recertification and renovator firm recertification. • Renovator firm certification will be extended five years from the date of the current expiration regardless of how early the firm applies for recertification. • Individuals who recertify by taking a refresher training course from an EPA-accredited training provider will have recertification that lasts for a period of five years from the date the refresher training course is completed, not from the date that the previous certification expires.

Tax Reformless The combination of ongoing weak

GDP growth and a steep rise in corporate inversions designed to reduce U.S. corporate tax liabilities has again brought the perennial idea of tax reform to the fore. Done right, tax reform is a winner. By closing loopholes and lowering marginal rates the economy can better perform and Elliot Eisenberg, Ph.D. GraphsandLaughs LLC GDP growth can be raised. That said, despite the positive rhetoric coming out of Capitol Hill, don’t count on it soon. Moreover, the sharp, and short-lived seven-day brawl about scaling back tax breaks for 529 college savings plans is painfully instructive and illustrative as to why. In his State of the Union address, President Obama proposed doing away with the tax-free treatment of capital gains in 529 college savings plans. Instead, he proposed increasing the size of the American Opportunity Tax Credit, available only to families with pretax incomes of less than $180,000, from $1,000 per year to $1,500 per year and to allow it to be used for five years, up from four. Looked at in isolation, the economics behind this particular policy is pretty solid. First, there is limited evidence that tax breaks designed to increase savings actually do so. Rather, the evidence generally finds that tax breaks reward individuals who would have saved anyways. Worse, the tax incentives

don’t seem to increase the total amount of savings either! Second, most of the tax shelter goes to higher income households. According to the White House, 70 percent of the benefits from 529 plans go to households with incomes greater than $200,000, while a GAO study from 2010 found that 47 percent of families with a 529 plan had incomes above $150,000. A recent College Savings Foundation study found that not quite 10 percent of 529 account holders have household income below $50,000. In short, these plans give tax breaks to wealthier households who already send their kids to college and would have saved as much with or without the plan. By contrast, giving all households with incomes below $180,000 slightly more money for college might raise the percentage of kids from middle- and lower-class households that attend college. More concerning is that via 529 plans, the American Opportunity Tax Credit, guaranteed student loans and now increasing student loan forgiveness, government, through the tax code and elsewhere, heavily subsidizes college costs. This dramatically inflates the cost of college tuition. Real tax reform would scrap these inflationary subsidies and implement a more coherent and more focused approach. But here is the rub: taking away the advantageous tax status of 529 plans created an instant coalition of three powerful groups that rolled the administration. The groups included parents with kids bound for college fearful they were about to lose a valuable tax break that they “deserved,” higher education that was concerned it was losing a subsidy and the financial industry which feared losing the billions in fees associated with administering a huge $250 billion program. While everyone claims that they want a simpler tax code with lower rates and bereft of deductions, loopholes and credits, taking any of these away creates winners and losers. And while the winners may be numerous, what they stand to gain is nebulous and distant. By contrast, losers quickly organize themselves and make themselves heard. If doing away with something as small as this was impossible, good luck with larger tax issues that touch deeper pockets. January New Home Sales Maintain December Pace

by Robert Dietz Despite some analysts’ expectations of a monthly decline, the rate of new home sales in January maintained the gains reported in the December report. Combined with upward revisions, the effectively flat monthly change from December to January keeps new home sales near post-recession highs. According to estimates from the joint Census Bureau and HUD release, the January pace of new single-family home sales stood at a 481,000 seasonally adjusted annual rate. This was down a negligible 0.2 percent from the 482,000 pace for December, which marked the highest rate since the Great Recession. The January 2015 pace was 5.3 percent higher than the sales rate recorded in January 2014. Total inventory was 218,000 (seasonally adjusted), marking a 5.4 months’ supply at the current sales rate. Because the monthly new home sales estimates possess a large statistical confidence interval, it is useful to gauge trends using a three-month moving average. On that basis, new home sales have been trending upward since the middle of 2014. This is consistent with the NAHB/Wells Fargo Housing Market Index, a measure of single-family builder confidence. The HMI has been in positive territory (above a level of 50) for the last eight months. According to Census/HUD estimates, inventory continues to rise gradually as the residential construction market recovers. Total new home inventory came in at 216,000 in January (nonseasonally adjusted). Of that total, 40,000 were homes that have not begun construction, 116,000 were currently under construction, and just 60,000 were completed, ready-to-occupy residences. With respect to sales prices, there were gains over December for sales in the $150,000 to $300,000 range, as well as well as the $400,000 to $750,000 class. As first-time buyers enter the market, sales growth should occur in the lower price ranges of the new home sales market. Regionally, the January report noted a significant decline in new home sales for the Northeast, falling from a 31,000 annual rate in December to 15,000 in January. This decline was certainly due to weather impacts. Overall, while the headline numbers suggest a flat report, given that the gains recorded in December were maintained despite a regional decline in the Northeast, the January report marks a positive sales pace to build on in 2015.

I joined the HBA of F-M Membership Committee to meet new Builders, Associate members and to keep up with the news and events in the building community. I enjoy meeting new people and currently do mortgage and construction financing at VISIONBank, so talking to new people and participating in the Membership Committee seemed like a natural fit for me.

Why would you encourage other members to join a committee?

I have been involved in many community organizations throughout the years and the HBA of F-M has a friendly atmosphere that really makes everyone feel comfortable that belongs to the committees. The staff at the HBA of F-M is very welcoming, they encourage participation and always are willing to answer a question and welcome suggestions to improve the Association. 32

Remodelers Council Update, Benefits to Joining The HBA of F-M continually looks at ways to provide value to its members and

the Remodelers Council is no different. Remodelers Council members pay $70 annually to be included in a separate Remodelers Council section of the Membership Directory & Consumer Guide, network with colleagues and perform community service. In 2014, the Remodelers Council completed two handicap accessible ramps for area residents in need. The Remodelers Council also helps plan the Remodeled Home Tour and has set a goal of featuring 20 projects for 2015. As an added benefit for Remodelers Council members, in 2015 we will be adding a new component to our bi-monthly meetings allowing members to showcase products and services that our Remodelers should be aware of. With new products and trends continually popping up, we feel this will be a great benefit for our Remodelers Council members. Virginia Remodeler Robert Criner Selected as 2015 NAHB Remodelers Chair Feb. 4 - Remodeler Robert Criner, GMR, GMB, CAPS, of Newport News, Va., was recently appointed the 2015 chairman of the National Association of Home Builders Remodelers during the International Builders’ Show in Las Vegas. In December, Fargo’s City Commission adopted revisions to its floodproof foundation requirements. HBA of F-M leaders involved with preparatory meetings on these changes were not presented an opportunity to review the final document and were surprised to find troubling changes affecting cost. Association leaders are working with Fargo’s engineering and inspections departments to iron out issues and provide education to the industry on the changes so contractors can prepare accurate bids and planning for projects.

Last month, Fargo learned it would be allowed to continue participating in FEMA’s “basement exception” which allows construction of homes with basements even though they are in the floodplain. Due to the no basement failures for over 40 years, and strict floodproof foundation standards, FEMA will allow the exception until the floodplain is revised again.

The 2015 Minnesota Building Code became effective Jan. 24. A new provision requires fire sprinklers in certain housing types and sizes including two-family dwellings, townhouses and single-family dwellings of 4,500 square feet or more. The 2015 Minnesota Energy Code was scheduled to become effective Feb. 14. Home builders should be aware of the changes regarding foundation insulation and blower door testing requirements.

FARGO SPECIAL ELECTION FOR MAYOR, COMMISSION IS APRIL 28 Fargo residents will go to the polls April 28 to elect a new mayor and fill an open seat on the city commission. Dr. Tim Mahoney has vacated his commission seat to run for mayor against Brad Wimmer. Mara Brust, Cole Carley, Tony Gehrig, Bradford Shaffer, John Strand and Scott Wagner are vying for the open commission seat. The HBA of F-M plans to host Candidate Forums to allow its leaders to meet the candidates and ask questions specific to the home building industry. February 2015
