• Prudential Premier Real Estate’s annual charity golf tournament raised more than $22,000 for Sunshine Kids, a nonprofit organization dedicated to kids with cancer. • Cass County Electric Cooperative has received $22 million in financing from the U.S. Department of Agriculture Rural Development for improvements to its electrical grid. The cooperative will use the loan to serve 4,984 customers with 246 miles of new line, improve 36 miles of existing line and make $4.1 million in Smart Grid investments. • The Fargo Moorhead Area Association of Realtors has donated 100 fleece blankets to Project Linus. This is the fifth year the group has cut and tied blankets which are used in police, fire and other emergency vehicles. • Vicky Matson, a Realtor with Park Co. Realtors, was elected and installed as president-elect of the Dakotas Chapter of the Council of Residential Specialist for 2012. • In the monthly TCI Insurance new business sales contests, adviser Dean Vetter was recognized as the top producer for July and adviser Leon Opdahl was recognized as the top producer for August. • Accelerated Green Works was named business of the month by Core Health Chiro. HBA of F-M President’s Report

HBA signs on for 2012 Habitat for Humanity build

Your HBA of F-M, Home Builders Care Foundation and Remodelers Council leaders are excited to announce that we will all come Tyrone Leslie together to build a home with Lake Heritage Homes Agassiz Habitat for Humanity in the summer of 2012. The home’s location has not been determined yet, but we are excited to start planning and fundraising for our first-ever Habitat build! Several of us met with representatives from Habitat for Humanity in October, and it is estimated that we will need up to $60,000 in cash to complete the build. We will also need donations of materials, products and labor. Right now, it is still early, but there are ways you can help prepare! 1. Cash (plain and simple) – If you would like to donate to this build, contact Habitat for Humanity at (218) 284-5253 or visit www.lakeagassizhabitat.org. Don’t forget to designate your funds to be used for the HBA build. 2. Tour de Habitat – Many HBA members are also involved in the Tour de Habitat bike race each March that raises funds for Habitat for Humanity. You can designate the funds raised from your team to go toward the HBA build, so start forming teams with an eye for supporting your industry’s build! If you would like more details about registering a team or have questions, contact Jackie at Habitat for Humanity: (701) 284-5253. 3. In-kind donations of materials and labor – Another way you can help out is by thinking about in-kind donations. Though it is too early to actually determine the materials, products and volunteers needed, it is never too early to think about it! If you can help, contact the HBA at (701) 232-5846.

Candidate Forums

Last month, your HBA hosted Candidate Forums for the Moorhead and Dilworth elections coming up Nov. 8. It was wonderful to see our conference room packed with members interested in hearing what the candidates have planned for these cities if they win their races. These legislative issues, working with elected officials and shaping our political landscape are core reasons the HBA was founded. If you live and vote in Moorhead, please take the time to review our recommendations for the elections on page 11 and get out to vote Nov. 8. We believe these candidates are the best for the future of our building industry. Look for future correspondence on our recommendations for the Dilworth election. Results of the candidates forum were not available at press time.

HBA releases housing impact study

Hot off the presses, our local housing impact study is now available! National Association of Home Builders Senior Economist Elliot Eisenberg conducted the study, which covers 2010, and presented it at the HBA’s Annual Meeting/General Membership Meeting Oct. 11. We also released it to the media and community partners to illustrate the importance of a vital new housing market to our area. November is Spike Appreciation Month

A home with no nails would fall apart; likewise the HBA would fall down without its Spikes. They fasten the Association together and are membership champions. HBA members earn Spike credits for member recruitment and retention. Those in the Spike Club earn recognition at certain levels of credit accumulation and other perks. Member Appreciation Night

Members make our Association great. To show appreciation, we invite every member to come to our tenth annual Member Appreciation Night Nov. 8 at the Holiday Inn of Fargo. Each member company receives two free dinners as a sign of thanks, if they pre-register. Our keynote speaker will be Kevin McKinnon, president of the Greater Fargo-Moorhead Economic Development Corporation, discussing local economic development, flood protection, and pros and cons of living and working in the area compared to other regions. Cass County Commission Chair Darrell Vanyo and Vice Chair Scott Wagner will also be presenting on North Dakota property tax measure #2 and how it affects you.

Annual Meeting

Congratulations to all the nominees for Builder and Associate of the Year that were awarded Oct. 11. Jason Eid, Eid-Co Buildings, Inc., received Builder of the Year; and John Koerselman, Red River Drywall & Painting Services, Inc., received Associate of the Year. They are both to be commended for their efforts to make the Association and Home Builders Care Foundation better. Good luck representing the HBA at the North Dakota Association of Builders’ Annual Meeting Nov. 18 in Minot. Also, thank you to everyone who donated money when we passed the basket for the Minot Association of Builders’ flood recovery efforts. When all was said and done, your HBA, HBC and member donations totaled $7,650. We are family in the North Dakota building industry and MAB Executive Officer Vicky Flagstad and her members are very grateful to receive the contribution.

HBA holds information session on ND Measure #2

On Oct. 18, HBA of F-M hosted a discussion on the upcoming vote in North Dakota to eliminate property taxes. The vote on Measure #2 will be June 12, 2012. Joining the discussion was Sen. Ron Sorvaag from Fargo. Sorvaag serves on the legislative review committee charged with determining the affect the measure would have on current policy. Rocky Schneider, HBA public affairs coordinator, gave a presentation to a group of interested members detailing the pros and cons of the measure. Schneider also covered what would need to happen if the measure was successful and how the taxation system in the state would have to go through a complete overhaul. The HBA Public Issues Committee and board of directors will be meeting over the next couple of months to discuss a public position on the measure and what, if any, action should be taken. Ad deadline for 2012-2013 HBA Development Map: Nov. 15 Take advantage of a great opportunity to promote your company and/or developments to thousands of consumers. uilder and Associate of the year awards are given to recognize HBA of F-M members who have gone above and beyond the call of duty for the Association, the industry and the community. The award is based on member spirit, civic activities, business accomplishments, state and local Association activities and overall support of the HBA and industry. Both the Associate and Builder awards were chosen by

Builder of the Year Nominees Terry Becker, Terry Becker Construction LLC

Owner of Terry Becker Construction, LLC, Terry Becker is immediate past president of the HBA. He has been involved in the Association since 1998, originally joining to take part in the Parade of Homes. Since then, Becker Becker has served as the project manager for the house that Home Builders Care Foundation built to raise funds for Habitat for Humanity in 2006. He serves on the Health Plan Management Committee, has won multiple Parade of Homes Horizon Awards and received 2009 Recruiter of the Year from the HBA. Becker contributes to NDAB-PAC, donates to HBC and previously received the HBA Extra Mile Award. He was a Builder of the Year nominee last year as well. As past president, Becker has had a busy year helping the HBA advocate for its legislative issues and attending local, state and national meetings.

Stan Birky, Stan Birky Construction, Inc.

Stan Birky owns Stan Birky Construction, Inc., and currently serves on the HBA board of directors. He is a member of the Parade of Homes Committee and is a five-time Horizon Award winner. This year, he attended Birky the Builders Association of Minnesota convention on behalf of the HBA and has recruited three new members since becoming active on the board, earning Spike Candidate status. He regularly attends General Membership Meetings and actively engages new attendees. Stan is also a past attendee of the NAHB International Builders Show. Builder nominees con’t on pg 10

a committee consisting of past winners, HBA Executive Committee members and HBA staff. A nomination form was inserted in the Plains Builder this summer seeking candidates. Please fill them out for fellow members you think are deserving. The HBA hopes members will aspire to win this award. Each local association in North Dakota nominates a Builder and Associate for these awards and those winners are recognized at the North Dakota Association of Builders’ competition at its annual meeting Nov. 18 in Bismarck. HBA of F-M winners for the 2011 award are Jason Eid, Eid-Co Buildings, Inc.; and John Koerselman, Red River Drywall & Painting Services, Inc. See the facing page for their stories.

Associate of the Year Nominees Terry Lipp, Ferguson Bath, Kitchen & Lighting Showroom

Terry Lipp is currently a builder sales associate with Ferguson Bath, Kitchen & Lighting Showroom. He has been involved with the HBA for many years in the plumbing sales industry. Along with being a director on the HBA board, Lipp he currently serves on the New Member Development Committee, is past chair of the Remodelers Council and is a Club $20.12 PAC supporter. He is a Life Spike, was a strong supporter of the Council’s RENEW House project and regularly volunteers time for the Council’s wheelchair ramp projects. This year, Lipp helped coordinate a fundraiser for HBC through the Fargo Force hockey team. Lipp was also nominated for the Associate of the Year award in 2008 and 2009. He is the driving power behind Ferguson’s sponsorship support of the HBA.

Sylvia Lunski, Design Direction, Inc.

Sylvia Lunski owns Design Direction, Inc., and was named to the HBA board of directors last year. She has been active with the Remodelers Council for five years and regularly helps with community service projects. She Lunski volunteered tons of time for the Gladys Ray bunk beds project, the RENEW House project and wheelchair ramp projects. Lunski is a regular exhibitor in the Home & Garden Show and has volunteered for show preparation. This year, she participated in the HBA’s legislative advocacy efforts and served on the Fall Home Show Task Force. She supports Habitat for Humanity, has made an effort to promote membership and was also nominated for Associate of the Year in 2010.

third generation builder, Jason Eid, Eid-Co Buildings, Inc., is a strong advocate for the housing industry, with a commitment to HBA of F-M’s mission to represent the collective interests of the home building industry. Eid is the son of Senior Life Director Gerald Eid and president of Eid-Co Buildings, Inc. HBA Executive Vice President Bryce Johnson says, “Jason has an analytical mind and a big heart. He is very accessible to the HBA staff and consistently supports the Association’s issues. He serves as spokesperson when called upon to help get our message across and is always willing to step up and help.” Eid’s building-industry lineage shows in his commitment to speaking out for its issues and careers in the industry. “Promoting the construction industry is natural for me, as I live, eat and breathe home building,” he says. “I am proud to provide the opportunity for homeownership and enjoy the development, construction and financing aspects of the process.” In addition to his time on the New Member Development Committee, Eid also served on the Education Committee and currently sits on the Public Issues Committee. He is active at the state and national levels with North Dakota Association of Builders and NAHB as a director on their boards. A Gold Key PAC contributor and Triple Player (contributes at least $365 to NDAB-PAC, Home Builders Care and pays HBA dues), Eid has been very involved with countless government affairs over the years on issues such

as storm water, the two-year tax exemption, building code changes and zoning changes. He is a past appointee of the Health Plan Management Committee and a newly named trustee for 2012. Eid-Co is an Energy Star builder and Eid personally holds the Certified Green Professional and North Dakota Professional Builder designations. He was also nominated for Builder of the Year in 2009 and 2010. “The insight and knowledge that I have gained from my fellow members has been invaluable and complements the other education I have received,” he says. “I have a desire to improve myself and those around me, getting a chance to see the world through others’ eyes is a great gift for me. Just being part of the organizations also shows me how other businesses are run so that I can look at my own to see if something can be done better.” Besides being active in the HBA, Eid enjoys spending time with his wife Kristie and children Emily, Paige and Thomas. He is active as a youth ministry volunteer at Hope Lutheran Church, supports Cully’s Kids Foundation, Northern Prairie Performing Arts Board and is a Beginning Experience donor/advocate. Eid-Co has been in business for 60 years and is a charter member of the HBA. Through the years, the company’s goal has been to make homes energy efficient, affordable and be practical for the way people live. It has built over 5,000 homes in the F-M area and is recognized nationally as a leader in the use of permanent wood foundations.

ohn Koerselman joined the HBA of F-M in 2004 simply because he wanted to play in the Golf Outing that year. “I paid my membership dues. Played golf, and that was it,” he says. Inc., the HBA offers. 2010 Associate of the Year. “While I was there, I saw quite a few people that I either did business with or knew,” he says. “It didn’t take long to realize how important the HBA is not only to my business but also the community in which I live.” John owns Red River Drywall & Painting Services, Inc. He started in the drywall industry in 1993 when he wanted out of the restaurant business. A few years later, he had an opportunity to start a business with a partner, and Red River Drywall was born. The partnership lasted for over seven years and, in 2004, he took sole ownership of the company. “This was a new opportunity for me as I needed to build HBA Builder and Associate con’t on pg 10

a company into something that was truly my design,” he says. Red River Drywall & Painting Services, Inc., has grown from sales of $80,000 in its first year to a record year in 2009 of over $4.5 million. “I know that not every year will produce record sales, but I would like to think that with the practices I have learned from the HBA and its members, Red River Drywall will always be able to be a profitable company,” he says. Koerselman currently serves as Public Issues Committee chair. He has been active in the Association’s governmental affairs, participating in many legislative activities for both North Dakota and Minnesota this year including the North Dakota Association of Builders board meeting, NDAB Builder Day on the Hill and Builders Association of Minnesota Builder Day on the Hill. He is also a Gold Key NDAB-PAC contributor and recently became a Triple Player (contributes at least $365 to NDAB-PAC, Home Builders Care and pays HBA dues). Koerselman has sponsored many Association events over the past few years, too many to list. He has also supported the Construction Trades Academy, is a regular GMM attendee, donated time and material for the RENEW house and was a 2010 Associate of the Year nominee. He was recently named Member of the Month by HBA staff and will begin a first term on the HBA board of directors in 2012. HBA Executive Vice President Bryce Johnson says, “John continually impresses members and staff with sincerity and dedication to the HBA’s core mission of advocacy and being a voice for the building industry. His heartfelt commitment to his fellow members and our mission is amazing.” Away from the HBA, Koerselman enjoys spending time with his wife, Patrice, and children Jessica and Andrew. He is a member of the F-M-WF Chamber of Commerce, serves on the F-M Builders Exchange board, is a regular United Blood Services donor, volunteered and donated materials for the Extreme Makeover Home Edition in 2010, supports the Sunshine Kids Golf Tournament and is chair of the Horace Parent Teacher Organization. He says, “Seeing how I can contribute to the HBA and the community only makes me want to do more. I truly enjoy my involvement with the HBA. Don Dabbert, Jr., owns Dabbert Custom Homes and currently serves on the Dabbert HBA board of directors as an NAHB Life Director. He is also active on the Public Issues Committee and is an NAHB BUILD-PAC trustee for the North Dakota Association of Builders. Dabbert is a Gold Key contributor to PAC, past HBA president and past winner of the local Builder of the Year award in 2000 and 2003. In 2003, he went on to win the NDAB Builder of the Year award as well. This year, Don won two Best of Show Horizon Awards in the “under $165,000” category and “$165,000 to $180,000” category.

Tyrone is chief operating officer and co-owner of Heritage Homes. He is current Leslie president on the HBA’s board and has served as chair of both the Public Issues Committee and PAC Committee, and as HBA board liaison to HBC. He is passionate about PAC, and shows it by regularly convincing fellow members to contribute. In 2007, he began serving as NDABPAC trustee for the HBA. The HBA members listened to Moorhead Candidate candidate from all four wards. Elections for Forums also Moorhead and Dilworth will be Nov. 8 provided a venue to determine support for the candidates. In Moorhead, there is an election for City Council in each of the four wards. The HBA of F-M released a housing impact study for the Fargo-Moorhead metro area during a press conference Oct. 11. National Association of Home Builders Senior Economist Elliot Eisenberg presented the findings that show financial benefits of growth to the metro area and surrounding community. A full version of the study, with a copy of Eisenberg’s slides, is available at www.hbafm.com or by contacting the HBA at (701) 232-5846. “The study shows that construction of a new home pays for itself, plus the infrastructure it needs after only one year,” says Eisenberg. “The amount of economic activity following the construction of a home is tremendous. For every 100 single-family and 75 multifamily units, net income after just one year is nearly $46,000 and eventually grows to as much as $379,900 thereafter. Housing study con’t on pg 18

CEO gives national update

We were honored to have National Association of Home Builders CEO Jerry Howard visit Minot in October for the Minot Assocation of Builder’s Annual Awards Banquet. Howard provided a national Joel Fiest update, saying that in most of the NDAB President country, real estate values continue to decline and the economy as a whole is teetering toward a double-dip recession. The housing sector, which accounts for 18 percent of the gross domestic product, is actually in a depression, and that unemployment in construction nationwide is 25 percent. “There are home builders around this country that have not only gone bankrupt, there are some that have committed suicide. We are in a real estate depression, ladies and gentlemen, nationwide,” Howard said. “Despite the flood, you should be very thankful that you are where you are, in the community that you have, with the leaders that you have that are pro-growth, that are tackling problems and getting it done.” A Time magazine cover story earlier this year insinuated the American dream of home ownership was dead. To prove that wasn’t true, NAHB hired two pollsters, one Democrat and one Republican, to get views on home ownership. They surveyed 2,000 likely voters in all 50 states, and 75 percent of them said investing in a home is the single largest measure of success next to providing for their children’s education. Over 70 percent said that despite the depression in the housing industry, they would still encourage their children or their friends to buy a home. Jerry stated that a quote from Abraham Lincoln couldn’t be any more appropriate for the current state of our country. “The strength of America lies in the homes of its people,” he said.

Legislature Studying Property Taxes, Special Assessments

In June 2012, North Dakotans will vote on initiated Measure 2 that, if passed, would eliminate property taxes in our state. No other state does not have property taxes, and it is one of our three major tax revenue sources, along with income and sales taxes. Property taxes account for approximately $800 million per year, and without them, we would need new revenue options to maintain existing services. Legislators are studying the property tax structure, along with special assessments and other infrastructure financing options. Effective tax rates on property are currently nine percent for residential property and ten percent for commercial. North Dakota Association of Builders was invited to provide input at the interim Tax Committee meeting in midOctober, and builder-developer Don Dabbert Jr. of Dabbert Custom Homes in Fargo, testified. Dabbert explained that special assessments are an important tool for developers, and how developers partner with municipalities to create new developments. Doreen Riedman NDAB Executive Officer

• Special assessments allow for more development, since small- to mid-size developers would be unable to develop raw land individually. • Today’s banking regulations limit the amount of credit extended for land development, so special assessments are even more important. • By spreading the cost of infrastructure over 20-30 years, property owners are able to pay the special assessments over time, and generally at a low interest rate. • With specials, developers are able to add amenities to the property to make it more desirable, livable, and marketable. • And, housing pays for itself in less than one year, as illustrated in a new economic impact study conducted by the HBA of Fargo-Moorhead. We will continue to work with the Legislature and others to make sure the voice of builders and developers are heard. Minn. contractor license renewals begin in December DLI encourages contractors to verify information online in License Lookup

Contractors with licenses that expire March 31, 2012, may start renewing licenses online Dec. 1. Contractors will be able to access the online licenses renewal process at www.dli.mn.gov/paycenter.asp by selecting the “renew your license” button. Contractors will be able to upload renewal documents to DLI when submitting the renewal. Typical documents to be uploaded include: Minnesota Secretary of State business registration documents, certificate of liability insurance, workers’ compensation insurance coverage information and the qualifying person’s continuing education certificate(s). Information available to the public through the department’s online License Lookup has expanded to include liability insurance, workers’ compensation insurance and the designated qualifying person. Most insurance information is current as of the most recent license renewal. Contractors may verify their information at www.dli.mn.gov/ LicVerify.asp by selecting “verify a contractor license” and then searching for your business name or your new number. DLI also encourages qualifying persons to verify their information and submit corrections to the department.

Minn. Department of Labor & Industry changes license numbers

In a letter sent to all contractors Oct. 6, the Minnesota Department of Labor and Industry stated it was moving to an online licensing system and had changed all licensed contractor numbers effective Oct. 3. The letter included a new certificate for immediate use when obtaining a building permit or proving licenses or certificate of exemption status with the state of Minnesota. It says, in part, “Effective October 3, 2011, every license, registration and certification now includes a two-character license class code (such as “BC” for residential building contractor) followed by a six-digit number (123456). This change was necessary to implement the new standardized and simplified license application and online renewal processes for all licenses, certifications and registrations (pursuant to Minnesota Statutes 326B.091 to 326B.098)…. Only the first two characters on the licenses or certificates have changed. The remaining six digits are from your current certificate, excluding ‘20’ for those with eight-digit certificate numbers. Contractors with four digits had leading zeros added to their certificate number.” With regard to how the new number must be used, DLI stated: “Your new license or certificate number must be included on all communication with the department and on all contracts, effective immediately.” The letter states license or certificate numbers on all printed materials and advertisements including website and vehicles need to be changed to the new number “as soon as practicable.” The Builders Association of Minnesota inquired further as to what “practicable” means and received the following guidelines: • Website information - as soon as possible • Printed materials (letterhead, business cards, etc.) - upon reorder • Advertising materials - upon reorder • Vehicles and other equipment - upon replacement Renewing licenses online can now be done at www.dli.mn.gov/paycenter.asp by clicking on “Renew Your License.” For more details, visit www.dli.mn.gov/ CCLD/ccld_license_changes.asp.

HBA sets 2012 Minn. contractor, electrical contractor continuing education dates

The HBA of F-M has set its Minnesota building contractor continuing education dates for 2012: Mark your calendar for Jan. 18 or Feb. 1. A registration form is enclosed. Both dates will include the same set of classes satisfying seven hours of continuing education which are pending approval with the Minnesota Department of Labor & Industry. Topics will include Minnesota building code hot topics by Moorhead Building Official Kurt Wenzel and a variety of industry topics: building a safe stair system; ventilations to save energy; best practices on siding installation; knowing commercial and residential doors; engineered tall walls and light gauge steel beams. Electrical contractor continuing education will be Jan. 13 at the Skills & Technology Training Center in Fargo. Class title is “2011 NEC Rules for Motors, Transformers, and Taps.” Questions and discussion are encouraged throughout. The seminar is approved by both the Minnesota and North Dakota State Electrical Boards. Tim Pull, instructor at North Dakota State College of Science for 25 years in the electrical department, has a master electricians license for Minnesota and North Dakota. He has done more than 100 NEC classes through the outreach and customized training division of NDSCS.

News from the National Association of Home Builders Oct. 17, 2011 - Federal Reserve Chairman Ben Bernanke to address open board session at IBS

NAHB members who attend the 2012 International Builders' Show will have an outstanding opportunity to hear Federal Reserve Chairman Ben Bernanke deliver remarks during a special session at the board of directors meeting on Feb. 10. Testifying before the Joint Economic Committee in Congress on Oct. 4, Bernanke specifically acknowledged housing's traditional role in fostering economic recovery and job growth and the challenges facing builders in today's market. "The housing sector has been a significant driver of recovery from most recessions in the United States since World War II," he said. "This time, however, a number of factors — including the overhang of distressed and foreclosed properties, tight credit conditions for builders and potential home buyers, and the large number of 'underwater' mortgages — have left the rate of new home construction at only about onethird of its average level in recent decades." Chairman Bernanke clearly understands the contributions that builders can make to the economy when given the chance, and throughout his tenure he has been willing to meet with NAHB's leadership on a regular basis to receive updates on the state of the housing market and hear builder concerns.

Oct. 19, 2011 - Housing starts rise 15 percent in September

Nationwide housing starts rose 15 percent to a seasonally adjusted annual rate of 658,000 units in September, marking the strongest pace of residential construction since April of 2010, according to figures released by the U.S. Commerce Department today. The gain was largely attributed to a sharp increase on the multifamily side, which has been trending upward due to increased demand for rental apartments. “Today’s numbers are very welcome evidence that builders are putting some crews back to work on singlefamily homes in select markets where economic conditions are improving, and on multifamily homes in places where demand for rentals is on the rise,” said Bob Nielsen, chairman of the National Association of Home Builders (NAHB) and a home builder from Reno, Nev. “That said, extremely tight lending conditions for both building and buying new homes, along with stubbornly high foreclosures that are putting downward pressure on home prices, continue to weigh NAHB con’t on pg 31

EPA takes enforcement action on lead rule

A YouTube video of workers scraping paint from the siding of an old Maine home has led to an enforcement action under the Lead: Renovation, Repair, and Painting rule Larry Leadhead by the U.S. Environmental Protection EPA Lead Enthusiast Agency's Region I (New England) office. Despite being an EPA-Certified Renovator, the contractor – Colin Wentworth of Rockland, Maine – failed to apply for firm certification and follow the work practices required in the regulation, such as posting warning signs, setting up plastic containment around work areas, collecting dust and debris, using high-speed scraping machines equipped with HEPA filters, and maintaining records to demonstrate compliance with the rule, EPA said. At least six children, one of whom was under six years old, lived in the four-unit building at the time of the project. “It’s important that remodelers get trained and obtain certification from EPA, as well as follow the lead-safe work practices outlined in the rule to minimize exposing children to lead hazards,” said National Association of Home Builders Remodelers Chairman Bob Peterson, CGR, CAPS, CGP, and president of Associates in Building & Design, Ltd. in Ft. Collins, Colo. “NAHB has created resources for remodelers to help them comply with the rule and adapt their businesses accordingly.” This is the first action brought regarding lead-safe work practice violations under the rule, which became effective over a year ago. The maximum penalty for the alleged violations is $37,500 per violation, per day. “It's interesting to note that EPA chose to launch its enforcement program by taking action as a result of an anonymous public video posting,” said Amy Chai, senior counsel at NAHB. The specific fine for this enforcement action was not indicated, but the contractor could be liable for a maximum of $37,500 per violation, per day, according to the EPA. “Many renovation firms have done the right thing by becoming certified, sending their employees to training and following the appropriate, health-protective work practices. Enforcement of these rules is important to protecting children and the business interests of those contractors who are following the rule,” said Curt Spalding, the regional administrator of the EPA's New England office (Region I), in a press release. NAHB advises remodelers to review the requirements of the lead regulation and use the resources available at www. nahb.org/leadpaint to prepare for compliance. The memberonly tools include sample contract language, liability and insurance guidance, materials for educating consumers and more.

Summary of the Lead Rule

Here's a quick summary of the EPA lead paint rule: 1. Training and Certification All firms working in pre-1978 homes need to be certified by the EPA. Firms need to complete the application for certification and submit a $300 fee. Along with the firm certification, an employee will need to become a certified renovator. This employee will be responsible for training other employees and overseeing work practices. The training curriculum is an eight-hour class with two hours of hands-on training. Approved trainers are listed in the EPA directory. Both the firm and certified renovator certifications are valid for five years. A certified renovator must take a four-hour refresher course to be recertified. 2. Work Practices Before work starts on a pre-1978 renovation, the certified renovator must educate residents by distributing the Renovate Right pamphlet, post warning signs outside the work area and supervise setting up containment to prevent spreading dust. The certified renovator must also be present during specific stages of the work. The rule lists specific containment procedures for both interior and exterior projects. It forbids certain work practices, including open flame or torch burning, use of a heat gun that exceeds 1100°F, and high-speed sanding and grinding unless the tool is equipped with a HEPA exhaust control. Once the work is completed, the regulation specifies cleaning and waste disposal procedures. Clean-up procedures must be supervised by a certified renovator. The EPA has a sample checklist for keeping records of required work practices. 3. Verification and Record Keeping After clean up is complete, the certified renovator must verify the cleaning by matching a cleaning cloth with an EPA verification card. If the cloth appears dirtier or darker than the card, the cleaning must be repeated. A complete file of records on the project must be kept by the certified renovator for three years. These records include verification of owner/occupant receipt of the Renovate Right pamphlet or attempt to inform, documentation of work practices, certified renovator certification, and proof of worker training. Remodelers are also required to share a copy of records developed under the rule requirements with the customer within 30 days of completing the remodeling work. 4. Exemptions It is important to note that these work practices do not apply to residential structures or child-occupied facilities built after 1978, and some or all of the rule's requirements may be waived if: • The repairs are minor, with interior work disturbing less than six square feet or exteriors disturbing less than 20 square feet being exempt. • The house or components test lead-free by a certified risk assessor, lead inspector, or certified renovator. The HBA of F-M, Home Builders Care Foundation and Remodelers Council will build a home with Lake Agassiz Habitat for Humanity in the summer of 2012. The home’s location and recipient family has not been determined yet. HBA representatives met with Habitat for Humanity organizers in October; up to $60,000 in cash will be needed to complete the build. The HBA will also need donations of materials, products and labor. It is still early, but there are ways members can help prepare! 1. Tour de Habitat - Many HBA members are also involved in the Tour de Habitat bike race each March that raises funds for Habitat for Humanity. The HBA also released a 2011 third quarter permit report showing construction activity within the four cities of Dilworth, Moorhead, Fargo and West Fargo. Due to flooding worries and flood-affected regulations, permits continue to reflect challenges the building industry faces. Total housing starts were down over 20 percent at 447; last year at this time, there were 569 housing starts. This year’s production is the second-lowest in the last 20 years; 1997 (another major flood year) was the lowest. HBA President Tyrone Leslie, Heritage Homes, says, “The last three years, our region has shown incredible perseverance and sense of community, but all of that success has come at a cost. Safety concerns, undecided regulations, increased development costs, and financial uncertainties of buying a home or locating a business are just a few of the results that have followed years of flooding.” Leslie spoke about the great efforts that have already been made across the communities to protect from flooding, but the work isn’t done yet. He covered three main points currently impacting growth: • The need for permanent flood protection for new and existing homes; • Unknown regulations being developed both locally and federally that create an unstable business environment; and • A changing perception the region faces from a community of growth and prosperity to a community continually battling potential flood disasters. “Jobs will be lost if permanent flood protection isn’t decided on soon,” Leslie says. “These aren’t just policy discussions; we’re talking about real people with families and lives.” Eisenberg says, “In our current economic situation, the buzz word of the day is jobs and there are not too many industries that have the job-creating power of the housing industry. The construction of a new home takes an entire team across a wide breadth of the workforce. From plumbers, to electricians, to carpenters, to the cleaning crew, the local job-creating benefits from building a new home are incredible.” More on the housing study: NAHB previously performed the study for the F-M area in 1997 and 2005. Since the NAHB model was initially developed in 1996, it has been successfully applied to over 340 metropolitan areas, non-metropolitan counties, and states across the country. HBA donates $7,650 to Minot Association of Builders for flood recovery The HBA of F-M, Home Builders Care Foundation and individual member donations resulted in $7,650 for Minot Association of Builders flood recovery. Devastating floods this summer destroyed MAB’s office. The monetary donation from the HBA, HBC and members will help keep MAB’s operations functioning; the Association was unable to hold two of its largest yearly revenue-generating events due to the devastation. Another stunning example of the damage and resulting heartache from the flood is that MAB Executive Officer Vicky Flagstad lost her home and will likely face a total rebuild. With her home currently uninhabitable, Vicky, like so many others (including many MAB members) faces a long road to normalcy. HBA leaders will keep tabs on her situation and look for opportunities to help as time goes on.

We have taken several price increases over the last few years, but last year was the worst. The one supplier where we purchase most of our materials had three price increases equating to a 17 percent increase. What is the latest trend in your business/industry? “To become more environmentally friendly. We accomplish this by preparing the painting surfaces by dry ice blasting, which uses frozen CO2 at high super sonic speeds. Since no secondary media is introduced, there is no secondary waste to clean up, except for the coating being removed. We also use the new environmentally friendly water-based paints.”

What do you think is the biggest challenge facing the industry today and how are you dealing with it? Becoming environmentally friendly presents a wide arrange of challenges, starting with the paint products. The old oil products were used for a long time and had been improved. The new paint is still in the developmental stages and are a lot more expensive. The next challenge is training the craftsman to know to apply the new products and it can be a real learning curve.

Council pledges support for Habitat build, is organizing Remodelers Showcase The HBA Remodelers Council has some big projects in the works for 2012! As is mentioned in HBA President Tyrone Leslie’s message (page 6), we will be helping the HBA and Home Builders Care Foundation build a home for Lake Agassiz Habitat for Humanity next summer. This is a wonderful chance for our industry to give back to our community and help a family achieve the dream of homeownership and experience all of the great things that come along with it. If you can help with the project, please let us know. We will need donations of cash, teams for the Tour de Habitat (these funds can be designated to our build), donations of materials and products and, very importantly, donations of skilled labor. Another event we are working on for fall 2012 is a Remodelers Showcase. This will be held in conjunction with the Fall Parade of Homes; it is a way for area remodelers to show off renovated homes and for landscapers to showcase yards they have turned into beautiful outdoor living spaces. Details are in the works. Staff and Parade of Homes Committee members have traveled to similar Remodelers Showcases in the Twin Cities area and Sioux Falls to gather ideas and help shape the HBA’s event. Watch for more information soon!

What is the Remodelers Council?

The HBA Remodelers Council was formed in 1990 and assists in the planning and coordination of the Fall Home Show. The Council and its members are known to be very active, within our area, participating in many community service projects. It has partnered with Lake Agassiz Habitat for Humanity on builds in the past and coordinates the construction of wheelchair accessibility ramps as well. The Remodelers Council partnered with the Home Builders Care Foundation and the city of Fargo on exciting projects as well: the renovation of a 100-yearold home called the RENEW House and building bunk beds for the Gladys Ray Shelter. It is an extremely important document not only to the city of Fargo, but to the building industry… your industry. How the comprehensive plan is crafted and prioritized can make a huge impact on Bryce Johnson your livelihood. This website and public meetings are its primary vehicle for gauging support for various initiatives and ideas. HBA staff and leaders have been attending public meetings, but that is not enough. Right now, there are very few comments on the website from our industry, with a lot of input in other areas. We need you, especially those directly involved in the building, remodeling and development fields, to weigh in on our issues and where the industry thinks Fargo should be headed. The foundation, created in 1993 by the Home Builders Association of FargoMoorhead, is a local 501(c)3 nonprofit charitable organization. It was established with funds donated by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling. The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.

Home Builders Care gives away its annual fall scholarship awards every November. This year, our reception will be at 4:30 p.m. Nov. 8 at the Holiday Inn. Held right before the Nov. GMM and Membership Appreciation event, this is a great time for you to meet our winners and enjoy light appetizers and punch. Home Builders Care has been awarding fall scholarships since 1995 and has given out almost $150,000 to over 168 students. We have been able to make an impact because of the generous donations made by HBA of F-M members. See a list of our contributors on facing page.

HBC has been a gold sponsor of this event since its beginning. Over 2,500 ninth grade students from around the area come to check-out potential careers. This is a great opportunity for our industry to promote all of the different career opportunities available in this region. HBC and your HBA of F-M will have a large booth at the event and work with other industry representatives to have a large showing from construction. Triple Player Spotlight: Dan Lindquist by Kirsten Rosenow, Communication & Office Coordinator

Dan Lindquist, Dan Lindquist Construction, Inc., has been a member of the HBA of F-M since 1997. Since becoming a member, Lindquist has been involved on the Education Committee, Public Issues Committee, Health Trust Plan Management Committee, served as past HBA president and is currently on Lindquist the board of directors. Lindquist is a Triple Player, meaning he pays his membership dues and contributes at least $365 to both the Norht Dakota Association of Builders Political Action Committee and Home Builders Care. For Lindquist, donating is a good way for him to stay involved and have a voice when time doesn’t allow for him to always be around physically. “I see contributing to NDAB-PAC as an effective way of making my voice heard. It is bascially a group of individuals with similar concerns, coming together as one, to influence decision makers at all levels of government,” says Lindquist. Contributions to HBC allows Lindquist to give back to the community through skill training, education and housing-related projects, and student scholarships. “I earn a living by being a home builder. Building homes has enabled me to own a home and support a family. I don’t know another occupation that would fit me so well. That is the reason I feel it’s importatnt to give something back,” he says. Lindquist encourages people to consider both NDABPAC and HBC, since strength comes in numbers and any amount is a meaningful donation. “HBC has established such a positive reputation in the community and donating is a great way to be a part of that,” he says. Framework for the Future is HBC’s long-term fundraising initiative to build the endowment fund to maintain current giving, support additional projects and provide for endowment growth. HBC hopes to become self-sustaining while also increasing its impact on the industry and community.

down new construction and corresponding job growth.” He noted that for every one new single-family home built in this country, three new full-time jobs are created. “The big gain in multifamily housing production for September was in the wake of a below-trend number in August and in keeping with characteristic volatility in that sector,” said NAHB Chief Economist David Crowe. “However, there’s no doubt that demand for apartments is rising as restrictive mortgage lending policies and concerns about future employment push consumers to pursue rental options.” Meanwhile, Crowe said, “Single-family starts showed a slight uptick for the month, which was right in line with our forecast for the third quarter and in keeping with what builders have been telling us in recent surveys regarding the emergence of improving conditions in select local housing markets.” Single-family housing starts rose 1.7 percent to a seasonally adjusted annual rate of 425,000 units in September, regaining much of the ground they lost in August. Meanwhile, multifamily starts, which often display substantial swings from month to month, rose 51.3 percent to a seasonally adjusted annual rate of 233,000 units, their highest level since October of 2008. Regionally, starts rose across the board in September, with a 12.7 percent gain in the Northeast, a 9.3 percent gain in the Midwest, a 15.7 percent gain in the South and an 18.1 percent gain in the West.

How do I become a Spike?

Before becoming a Spike, you are a Spike candidate. That means you have earned between one and five Spike credits. Once you earn your sixth Spike credit, you become an official National Association of Home Builders Spike! To retain Spike status and become a Life Spike, you must earn a minimum of one Spike credit (new or retention) each membership year until you reach a total of 25 credits.

How do I earn Spike credits?

Members earn one Spike credit for each new member they sponsor. HBA Retention Committee members accrue Spike credits when helping to renew memberships each year. Spikes receive a half credit for recruitment and a half credit for the renewal of Affiliate members. The NAHB recognizes and rewards membership development efforts with its Spike Club awards program.

North Dakota tops PAC fundraising

To start the 2011-12 election cycle, the National Association of Home Builders created a new level of giving for its political action committee, BUILD-PAC, called Club 2012. The goal of Club 2012, at only $20.12 a year, is to increase of the number of contributors. At the Fall Board of Directors meeting in Milwaukee, North Dakota was recognized for being tied for the highest number of Club 2012 contributors. Usually when North Dakota is on top nationally for something it is per scale of population, but North Dakota’s total number of Club 2012 PAC supporters is more than 48 other states, most with higher population and bigger memberships. PAC has played a crucial role in the Association’s advocacy program. Giving to PAC is voluntary and it would not have had the success without the support and buy-in from each of the contributors listed on this page. The 22nd Annual Fall Home Show was held Oct. 1-2 at the Fargo Civic Center. Even with the great weather and the North Dakota State University Bison football homecoming game, the event was a success! Over 1,100 consumers made their way through the 72 exhibits in the Civic Center’s Centennial Hall and exhibitors said the quality of the consumers was terrific. Consumers were welcomed Accent Kitchen & Bath, the shows platinum sponsor, held by HBA staff, Jenny Erickson, great seminars on current kitchen and bathroom trends and Development & Project Coordinator; received great evaluations. Featured speaker MS. Electrical Contractor Continuing Education

Satisfies continuing education requirements for electricians in North Dakota and Minnesota. Class Topic: 2011 National Electrical Code rules for motors, transformers and taps. Questions and discussion are encouraged throughout the class. This seminar is approved by both the Minnesota and North Dakota State Electrical Boards. About the instructor: Tim Pull, instructor at North Dakota State College of Science for over 25 years in the electrical department, has a master electricians license for Minnesota and North Dakota. He has done more than 100 NEC classes through the outreach and customized training division of NDSCS.

MARCH 1, 2012: Deadline for Minnesota contractors to submit documents to Dept. of Labor & Industry for renewal of licenses expiring March 31, 2012. HBA of F-M members and non-members are welcome to attend! These courses, scheduled for Jan. 18 and Feb. 1, 2012, are pending approval by the Minnesota Department of Labor and Industry for 7 credits for residential contractor continuing education satisfying credits (referenced to the left) toward continuing education for building contractor, residential remodeling or residential roofing continuing education requirements for re-licensure. This includes the required 1 hour of energy (for all contractors).
