News Briefs Hires & Promotions • Advanced Engineering and Environmental Services, Inc., has hired Weston McGruder as an engineer in training and Sam McQuade as chief financial officer. • Coldwell Banker First Realty has hired Cyndee Engberg as a member of the sales team. • Dawson Insurance has hired Cindy Fleming as a commercial lines account manager. • Dakota Supply Group has promoted Anne Bryson to the position of branch manager at both its Grand Forks, N.D., and Bemidji, Minn. Bryson locations. Bryson will take over for Clair Zirnhelt, who will retire from DSG at the end of 2013. Bryson has worked at DSG since 1986, serving in a number of key positions, including time in the quotations department and most recently as an account manager. • Twenty-eight Bell State Bank & Trust employees have pooled together to donate their personal and Pay it Forward funds to the Kristin Bonham family of Hawley, Minn. Bonham’s 15-year-old daughter, Rylie Efterfield, died in a house fire in July that also destroyed the family’s home. Bonham is a single mother caring for five young children. • BW Insurance held its inaugural Husks for Harvest event Aug. 21 to raise money and awareness for Farm Rescue. The event, which featured corn on the cob, a pig roast and door prizes, raised just over $10,000 to help support Farm Rescue. • Peggy Isakson, senior sales associate with Coldwell Banker First Realty, has been named to the Realtors Political Action Committee North Dakota Hall of Fame. • Conmy Feste Ltd. attorneys Kim E. Brust and Stephannie N. Stiel have been selected to the list of Great Plains Super Lawyers for 2013. • Heritage Homes has pledged to donate $500 for every new home sold in October to the Edith Sanford Breast Cancer Foundation. The company’s office building in Fargo was also illuminated with pink lights in October. • Ric Todd has achieved the Microsoft Installing and Configuring Windows Server certification and Dana Eckart has earned the Cisco Sales Expert certification. Nov. 5 is Election Day. Moorhead residents will elect council members and a new mayor. Your HBA has supported Mike Hulett for mayor; Alex Huseby in Ward 1; Mark Altenburg in Ward 2; Brenda Elmer in Ward 3; and Ben Anderson in Ward 4. See page 11 for more details on our selection process and the candidates themselves. If you are a Minnesota resident, please get out and vote for housing. We have supported these candidates with funds you helped us raise through the North Dakota Association of Builders political action committee (NDAB-PAC). You will see, the F-M area continues to experience an astounding resurgence. Construction values are breaking records. As long as the weather holds, I’m sure we will continue to see high activity!

Elliott celebrates 35 years with FHRA Jill Elliott has been recognized for 35 years of service to the Fargo Housing and Redevelopment Authority. She began working at FHRA in 1978 as a tenant services coordinator at New Horizons Manor. She was promoted to project manager and later to assistant manager. She has been serving as deputy director since 1994, where she oversees 4,500 tenants and 70 staff. FHRA held a surprise party for Elliott on Sept. 30 to thank her for her service and celebrate the milestone.

Congratulations Builder, Associate of the Year nominees! by Krista Mund, Communications Manager
Builder and Associate of the year awards are given to recognize HBA of F-M members who have gone above and beyond the call of duty for the Association, the industry and the community. The award is based on member spirit, civic activities, business accomplishments, local, state and national Association activities and overall support of the HBA and industry. HBA of F-M winners for the 2013 award are Darrick Guthmiller, Kochmann Brothers Homes, Inc., and Terry Lipp, Ferguson Bath, Kitchen & Lighting Showroom. Both the Associate and Builder awards were chosen by a committee consisting of past winners, HBA Executive Committee members and HBA staff. A nomination form was inserted in the Plains Builder this summer seeking candidates. The HBA hopes members will aspire to win this award. Each local association in North Dakota nominates a Builder and Associate for these awards and those winners are recognized at the North Dakota Association of Builders’ competition at its annual meeting Nov. 22 in Williston. See page 27 for Guthmiller’s and Lipp’s stories.
Builder of the Year Nominee Don Dabbert, Jr., Dabbert Custom Homes
Don Dabbert, Jr., owns Dabbert Custom Homes and currently serves on the HBA of F-M board of directors as a National Association of Home Builders Life Director. He is also active on the Public Issues Committee and is an NAHB BUILD-PAC trustee for the North Dakota Association of Builders. Dabbert is a Gold Key contributor to PAC, past HBA president and past winner of the local Builder of the Year award in 2000 and 2003. In 2003, he went on to win the NDAB Builder of the Year award as well. Dabbert’s homes have won Parade of Homes Best of Show Horizon Awards several times. He is very active legislatively, serving on the NDAB Government Affairs Committee and testifying as needed at the capitol in Bismarck.
Associate of the Year Nominees Dan Beecher, Foam Doctor’s, LLC
Dan Beecher is president of Foam Doctor’s LLC in Fargo. He served as chair of the Remodelers Council last year, and has been a member of the group for four years. He joined the HBA of F-M in 1991. Over the years, Beecher has volunteered for wheelchair ramp projects and donated spray foam for last year’s Home Builders Care Build for Habitat. Beecher demonstrated insulation techniques to high school students at the Herdina Academy for the Construction Trades this year, which was very wellreceived. He also volunteered his tailgating grill and talents for the Remodelers Council picnic, Muddy Boots Builder Picnic and August Family Picnic.

She has been a Parade of Homes Committee member since 2004, serving as chair in 2009 and 2010. Hart also served on a task force to evaluate the Parade of Homes Horizon Awards and judging, volunteered to speak to consumers about voting no on N.D. John Koerselman owns Red River Drywall & Painting Services, Inc. He became active with the HBA in 2004 through the Golf Outing and then joined the Public Issues Committee, serving as chair in 2011. He has been active in the Association’s governmental affairs, participating in many legislative activities for both North Dakota and Minnesota this year. He is also a strong supporter of NDAB-PAC and serves on the HBA board of directors. Koerselman has been a longerterm sponsor of the Annual Meeting and Golf Outing. He has also supported the Construction Trades Academy, is a regular Membership Meeting attendee, donated time and material for the RENEW house in 2009 and was 2011 Associate of the Year.

Paul Krabbenhoft, Coldwell Banker First Realty, has been a real estate agent for 23 years and has been with Coldwell for the past six years. He was elected to the HBA of F-M’s board of directors in 2011, and has been active on HBA committees for several years. Currently, he serves on the Public Issues Committee, participating as needed with legislative and advocacy efforts for both North Dakota and Minnesota. Krabbenhoft was very active in participating in the HBA’s activities with N.D. House Bill 1020 involving funding for permanent flood protection and attended the Builders Association of Minnesota’s and North Dakota Association of Builders’ member legislative activities at the capitol. He has been an elected Clay County Soil and Water Conservation District Supervisor since 1985 and is also part of the Clay County and Moorhead Planning Commissions.

Paul Lindemann, Lindemann Finish Carpentry, Inc., has been a member of the HBA of F-M for nearly six years and is on his third year with the Public Issues Committee, currently serving as chair. He was very supportive of the HBA’s efforts regarding N.D. House Bill 1020 regarding permanent flood protection, attending many meetings and offering his perspective on the issue. He continues to be a Gold Key contributor for NDAB-PAC and has been involved with NDAB’s PAC meetings. Last year, he participated in Lake Agassiz Habitat for Humanity’s Tour de Habitat, supported the Home Builders Care Build for Habitat and helped with the Extreme Makeover: Home Edition builds locally.

Public Issues Report of Area Affairs F-M area construction industry permit values exceed records by Mike Obach, Public Affairs Coordinator Krista Mund, Communications Manager
The Fargo-Moorhead area building industry continues to experience an astounding resurgence. Overall construction values have surpassed last year’s third-quarter peak, as evidenced by the HBA of F-M’s year-to-date building permit report. This brings the area back to levels it hasn’t experienced since the mid-2000s. Total construction value is already over $523 million, which is the highest posted through the first three quarters, and supersedes last year’s record by just under $90 million. For reference, the previous third quarter high was in 2006 at $428 million, and current numbers are almost $100 million higher than those numbers. HBA of F-M President Darrick Guthmiller, Kochmann Brothers Homes, Inc., says “Our members continue to enjoy a wonderful work season here in the valley. Although there was a late winter and wet spring, we are still building houses at an amazing rate!” For the F-M area as a whole, single-family construction has exceeded the previous high of 745 permits in 2004, hitting 770. Residential construction is still at record levels, posting the highest number of housing starts (single-family, twin home and row houses) since 2005: there have been

HBA endorses five for Moorhead races, all candidates uncontested in Dilworth by Mike Obach, Public Affairs Coordinator
This fall is a rather slow one on the election front, with only eight races in our local area – and only five of those being contested. The city of Moorhead has the mayoral seat and four of the eight city council seats up for grabs – one in each ward – while the city of Dilworth has its mayoral seat and two of the four city council seats up this year. As of the filing date, no one in the Dilworth races had an opponent. It looks like Chad Olson will remain mayor for four more years, Jim Aasness will remain on city council, and newcomer Jason Kakac will join him. The HBA of F-M will set up meetings with all three candidates to share our industry’s support of the continued growth of Dilworth. Although there are only three candidates for three slots in Dilworth, Moorhead races have more than made up for that. There are four mayoral candidates and 13 individuals running for the four city council seats, which have made the races very exciting. The HBA held three Candidate Forums and the overall feedback is that it has been outstanding to meet so many quality candidates. The level of commitment to public service is very positive and bodes well for the city’s future. Here is a recap of the five races and who your HBA is supports (all candidates listed in order of filing, per the city of Moorhead city clerk).

This pace is up 34 percent from the 732 starts in 2012, which was itself a 64 percent increase from the previous year. • The city of Moorhead has shown great growth, with 43 more total housing starts than last year at this time, and a 24 percent increase in single-family residences. • In Fargo, every category, other than residential remodeling, has experienced an increase from last year, with total housing starts increasing by just under 40 percent from third quarter of last year. • Dilworth has seen its total housing starts double, as that number rose from 12 to 25. • In West Fargo, where housing (and all construction) numbers have seen the most impressive growth in the region, there has been another 20 percent increase over last year’s total housing starts; multi-family construction has almost doubled. “Despite this record growth, our metro area still faces challenges in flood insurance mandates and the wait for permanent flood protection,” Guthmiller says. “Our industry is working hard to keep up with demand and to find the workforce necessary - these are positive challenges as it means we are busy putting people to work and creating jobs.” If you have questions regarding the permit report, contact Mike Obach at (701) 232-5846 or mike@hbafm. com. • Mayor: The four candidates are Councilman Mark Hintermeyer, Councilman Mike Hulett, Del Rae Williams and Kevin Shores. The members have chosen to endorse Mike Hulett. He is a current councilman from the Ward and was the city’s former human resources director. He is also a past Moorhead school board member and Chamber of Commerce board member as well as a former Naval officer. • 1st Ward: The three candidates for Luther Stueland’s vacated seat include David Hallman, Mari Dailey and Alex Huseby. The HBA has endorsed Huseby, a local small business owner and former Infantry officer with the Minnesota Army National Guard. • 2nd Ward: The two candidates are current councilman Mark Altenburg and Jim Haney. The members have decided to support Altenburg for another term. He was recently named the director of advancement for Minnesota State Community and Technical College - Moorhead and as a council member, has been very supporting of initiatives to improve the means and availability of housing in Moorhead. • With former 1st Ward councilman Dan Bohmer withdrawing his name from contention, the race for Moorhead’s 3rd Ward is now down to the incumbent, Councilwoman Brenda Elmer and Julian Dahlquist. The HBA will continue to support Elmer, who recently was hired as the regional director of the MN/ND Chapter of Associated Builders and Contractors. • Finally, in the 4th Ward there are five candidates Election Day con’t on page 32

In preparing reports for the National Association of Home Builders’ Fall Board of Directors meeting, I noticed that the North Jason Eid Dakota Association of Builders has hit NDAB President a major milestone: We have exceeded 2,000 members statewide! Congratulations to our local associations on making this happen. It is an exciting time in our great state and our industry is doing very well. Several of our leaders traveled to Colorado Springs, Colo., last month for NAHB’s board meeting. I am happy to report that NDAB’s own Ralph Applegren, Applegren Construction, Grand Forks, was unanimously approved as national Area 10 chairman. He began serving as an NAHB National Director in 1992, is now a Senior Life Director and previously served as NAHB’s state representative for North Dakota. Congratulations! Area 10 chairmen serve on NAHB’s executive committee. Area 10 includes Iowa, Minnesota, North Dakota, South Dakota and Wisconsin.

News from the Builders Association of Minnesota Why do we have BAM’s Legal Action Fund? The home building industry’s legal action efforts came to life in 2003 in response to the significant amount of government regulation negatively impacting the residential construction industry. Having developed sophisticated legislative and regulatory programs, the industry found that more and more often the court system was the venue of last resort to stop cost-drivers. Initiative litigation was the next logical step to managing government actions that danced around the intent of state statutes. To that end, the creation of the fund completed the industry’s three-fold approach to government regulation. Since its inception, the fund has validated its purpose by providing a legal voice for the industry and by taking on cases that have statewide implications in order to strengthen and protect the industry. These cases set legal precedent for important statewide policy issues facing the home building industry and the decisions made can be called upon to help resolve similar problems as they arise for members across Minnesota. Equally important is making sure members have the business tools to protect their bottom line. To help in that realm, the fund makes available only to Builders Association of Minnesota members six essential contracts templates that help members manage business transactions, reduce liability exposure, and comply with state law. The contracts alone have an estimated value of $10,000.

Any member of BAM may bring a legal issue forward and request help from the Legal Action Committee by contacting a member of the Legal Action Committee or BAM staff. The committee reviews the facts of the case and assesses whether it has statewide significance for the housing, residential development and building industry. At the direction of the Legal Action Committee, BAM may become directly involved as a party to litigation on behalf of its members, submit an amicus curiae brief arguing the legal and policy impacts of a court decision or engage in actions regarding a pending legal or regulatory matter. Statewide significance means those cases that present an opportunity to establish judicial or administrative precedent and have widespread and meaningful economic impact on the industry. The legal battles that face the industry are often immense – both in cost and the universal impact on every business working in the industry – and it is important to have a reliable ability to engage in these fights for the industry. The BAM board of directors approved this year, by unanimous voice vote, a Legal Action Fund Assessment for 2013 in the amount of $35 per member. In its ongoing efforts to respect local association budgeting cycles and to provide stability to the fund, BAM’s board of directors approved an assessment schedule for the next five years with a transition to having the fund be supported solely by BAM’s operating budget. After 2013, the Legal Action Fund assessment amounts by year are: $35 per member in 2014, $30 in 2015, $25 in 2016, $20 in 2017 and $15 in 2018. After the five-year period the Legal Action Committee will be funded by BAM’s operating budget only.

We have solid facts and arguments on our side, but this is still a big fight to which the Legal Action Fund is supporting. This decision set BAM on a course to force an administrative law judge hearing on the matter. BAM’s Legal Action Fund hired Joe Springer, an attorney from Fredrikson & Byron to represent the industry. BAM has also retained the services of Karen Linner, BAM’s former director of codes and research, and Steve Orlowski, an expert from NAHB.

Meet Your Board: Stan Birky

Stan Birky of Stan Birky Construction, Inc., has been a member of the HBA of F-M since 2005. The company was founded in Detroit Lakes Stan Birky, in 1981, and he and his son Brad began Stan Birky with small remodeling jobs, additions Construction, Inc. and pole buildings. In 1993 he moved to the Fargo-Moorhead area and began building new construction. Aside from being a member of the HBA of F-M board of directors, Birky has been a regular Parade of Homes participant and long-time committee member, entered a remodeled home on the 2nd Annual Remodeled Home Tour, an alternate National Director and will soon be the new board liaison for Home Builders Care. Birky joined the HBA of F-M board of directors five years ago, and said he became involved to participate in the leadership of an industry that has been very good to him. “Actually, it was because Bryce bought me breakfast,” he laughs. Birky says that one of the reasons the board is important to the HBA is because “the board has maintained a professional presence in the community and hears reports from committees that stay abreast of industry issues.”

He says that the best part about being an association leader is the development of relationships with others in the industry and understanding the scope of influence the HBA of F-M and its leadership have in the industry. Birky grew up on a family farm in Nebraska. He earned a bachelor’s degree in education and taught school for two years before entering into the building industry. Away from work, Birky, along with his son Brad, enjoys raising registered Black Angus cattle.

The 24th Annual Fall Home Show, hosted by the HBA of F-M Remodelers Council, was completely sold out with a waiting list and welcomed a fantastic crowd at its new home, Scheels Arena! The show ran Sept. 27-28 and although being on the ice made things a bit chilly, the consumers had great things to say about the new venue. Over 1,850 consumers enjoyed the variety of exhibits and were able to get everything under one roof! With a total of 95 exhibiting companies, there was plenty to see: new home builders, remodeling contractors, flooring, siding, spas, windows, water purification, decks, heating and air conditioning, interior decorating and design, kitchen and bath design, cabinetry, garages, plumbing and more! The HBA of F-M’s Annual Meeting had a fabulous turnout. About 100 members attended and heard updates from the Builders Association of Minnesota Executive Vice President Remi Stone on the fire sprinkler mandate and administrative law judge hearing. Next, Greater Fargo-Moorhead Economic Development Corporation President Jim Gartin spoke on Economic Gardening, the key to our communities continued success. A fun social game focused on understanding one another and included members looking at photos of HBA staff and creating the best caption as to what they thought each staff member was thinking! HBA of F-M Associate Member Feature Dustin Murray Construction Small business with a personal touch by Mariah Wenaas, Communications & Office Coordinator
Dustin Murray’s first experience with the building world was when he was 10 years old and helped his step-dad build a house. “I may have just been in his way more than anything, but I really enjoyed the work,” says Murray. This early experience with construction planted a seed that continued to grow. He also did some construction work throughout high school, and then went to work framing houses after graduation. Murray later decided he wanted to attend college, and chose Minnesota State Community and Technical College’s carpentry program, from which he graduated in 2002. While Murray was in school for construction management, he began working as a framer for a local custom home builder, where he stayed for over eight years and ended up as a foreman. In 2012, Murray founded his company, Dustin Murray Construction, in West Fargo. His employer was going out of business, and Murray concluded it was time to start out on his own, like he had always dreamed. The company originally focused on small jobs; handyman-type work, and sometimes subcontracting different jobs such as framing, siding and finish work. Murray first heard of the HBA of F-M when he was in the carpentry program at M State. He was a part of the Student Chapter and ended up becoming the president. Throughout the years Murray has worked for other HBA member companies and had attended meetings and picnics prior to starting Dustin Murray Construction. “When I started my own business, I felt it was the right thing to do join the HBA - so I could be a part of the organization that supports and helps my business,” Murray says.
One thing that sets Dustin Murray Construction apart from the others is the personal aspect. “I am the one meeting with the client, and also doing the work,” says Murray. Murray stays busy with many types of jobs and enjoys the variety in his dayto-day work. Dustin Murray Construction focuses more on remodeling than on new construction, since it is still a fairly new company. However, the company is growing. Outside of work, Murray and his wife Melissa are expecting their second child this winter. When asked what the biggest challenge facing the industry is, Dustin Murray started his construction business last year. Murray says he’s not personally dealing with any issues, but that he hears from several other contractors that they are having a hard time finding good employees who will stay around. To those wanting to start their own business in the industry, Murray advises making sure to really watch your workload. “It is far too easy to just say yes to work, and end up having too much on your Dustin Murray Construction plate,” says Murray. 213 5th Ave. W West Fargo, ND, 58078 (701) 361-4946

I believe there needs to be more in-store seminars with builders, cabinet shops, kitchen and bath dealers, as well as reviewing the ‘dos and don’ts’ with homeowners. “Another issue is ‘buying direct’ when more information is needed to get a professional installation. HBA awards its highest honors to Guthmiller, Lipp: Builder, Associate of the Year 2013
D
arrick Guthmiller is a quiet leader. Over the years, his growth at Kochmann Brothers Homes, Inc., has mirrored his activities within the HBA of F-M. Guthmiller became involved with the Association’s Membership Committee in 1999, a few years after joining Kochmann Brothers Homes, Inc. as a drafter/estimator. Within the company, he was promoted to manager and currently serves as part owner and chief business officer. Over the years, he has also become involved with the HBA’s Education Committee and numerous public Darrick Guthmiller, Kochmann Brothers affairs and Homes, Inc., receives the Builder of the Year legislative award from 2012 winner Dave Anderson, efforts and Dave Anderson Construction. groups, taking on more and more responsibilities. “I’ve learned a lot from fellow members and from various HBA activities,” he says. “My involvement in the HBA has benefitted me not only professionally and personally, but I’ve also made some life-long friends.” Guthmiller cares about education and his industry’s future which is reflected in his commitment to volunteering at the Herdina Academy for the Construction Trades and Health, Tech & Trades Career Expo yearly. He earned the Certified Graduate Builder designation from the National Association of Home Builders and serves on the North Dakota State College of Science Construction Technology Advisory Committee. As for community service, Kochmann Brothers Homes, Inc. and Guthmiller designed and built two ticket booths for Park Christian Football Field; they also supported the 2012 Home Builders Care Build for Habitat and Guthmiller drew plans for its garage and for a 2011 State Bank & Trust Pay It Forward remodeling project. Guthmiller has been involved with the Lake Agassiz Habitat for Humanity Tour de Habitat bike race since 2007 and has served as a team captain since 2009.

Through his involvement on the HBA board of directors and in his role as president, Guthmiller has been the HBA’s main spokesperson with the media. He regularly participates in industry advocacy meetings including issues involving N.D. House Bill 1020 regarding permanent flood protection and FEMA’s impending flood insurance changes. He is a supporter of NDAB-PAC as a Gold Key contributor. Over the years, Guthmiller has been a reliable volunteer for the HBA’s annual World of Thanks deliveries as well as marking booth spaces on the arena floor for the Fall Home Show and Red River Valley Home & Garden Show. Kochmann Brothers Homes, Inc., exhibits in the Home & Garden Show and donated to the Fargo Motor Patrol Fish Fry which raised funds for Home Builders Care Foundation. HBA Executive Vice President Bryce Johnson says, “When you step back and look at the amount of time Darrick has given the HBA in the past 14 years, it’s staggering. He’s the type who prefers to avoid the limelight, has a steady hand and calm demeanor, and is a very effective leader because fellow members and community leaders trust his opinion and direction.” In addition to his construction life, Guthmiller is a real estate agent and is a member of the F-M Area Association of Realtors. He has degrees in construction management and architectural drafting and estimating from NDSCS in Wahpeton. Away from work and the HBA, Guthmiller enjoys spending time with his wife, Sarah, and their sons, Quinn (age four), and Asher (2 months). The foundation, created in 1993 by the Home Builders Association of FargoMoorhead, is a local 501(c)3 nonprofit charitable organization. It was established with funds donated by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling. The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.

Triple Player Spotlight: Tyrone Leslie
HBA of F-M Immediate Past President Tyrone Leslie’s history of supporting the industry is evident. Whether through his participation on the HBA board of directors and the Public Issues Committee, or his chairmanship of the PAC Committee, Leslie is not only a huge supporter of the local HBA, but he also represents the larger industry as both a Tyrone Leslie, state and national life director. Heritage Homes Leslie owns Heritage Homes, and has been a member of the HBA since 1998. He became a Triple Player in 2011(a list of all current Triple Players can be found to the right). To become a Triple Player, members give $365 to both Home Builders Care and North Dakota Association of Builders political action committee, in addition to paying their annual HBA dues. “Giving to PAC is a critical in supporting the HBA, and therefore the local industry,” says Leslie. “The PAC utilizes our dollars by supporting individuals or groups that oftentimes are called upon to assist or advocate for the building industry. “On the other hand, HBC is the white hat of the industry and encourages young people to pursue careers in the building industry. HBC can utilize the means of our builders and associates to accomplish some wonderful philanthropic projects!” he says. For Leslie, supporting both HBC and NDAB-PAC is his way of investing in the housing industry and ensuring that in the future the industry realizes its full potential in the future. “Tyrone understands the importance of donating to PAC, of how important it is that we have a strong voice amongst our legislative representation. He was the individual that encouraged me to get more involved in both the HBA and NDAB-PAC,” says John Koerselman, owner of Red River Drywall & Painting Services, Inc., and the current PAC Committee vice chair. The HBA of F-M will offer Environmental Protection Agency Remodeling, Renovation & Painting (RRP) Rule certified renovator training in March through the University of North Dakota’s Environmental Training Institute. To satisfy requirements by the U.S. EPA, building and remodeling firms must have one or more certified renovators assigned to each job where paint is disturbed in homes built in 1978 or earlier. Eight hours of training is required to become a “certified renovator.” Also, Minnesota requires lead certification when issuing permits. Municipalities verify lead certification for residential builders, remodelers, roofers and manufactured home installers when requesting a permit to work on homes constructed prior to 1978. A four-hour refresher course every five years is required to keep the Certified Renovator designation current. Since the HBA first hosted Certified Renovator classes in early 2010, the Association will offer its first refresher classes staring January 2015. Lipp has a big personality and is cheerful and passionate about the industry in which he makes a living. He first became involved with the HBA nearly 20 years ago when working with Kohler Plumbing Company. “I met many friends and business associates back then, and I continue those relationships today,” he says. “I’ve developed close friends through my involvement and it certainly has been good for my business, too.” Today, Lipp is a builder sales associate at Ferguson, which he says is a company that understands the significance and importance of the home builder through the product specification process. “My goal with everyone is to make the process of building a new home or completing a remodeling project as easy as possible by aligning our supply chain,” he says. “A manufacturer’s design change to a common product can cost our industry a lot of money. By communicating these changes, we make sure this does not happen.” Along with being secretary on the HBA board of directors, Lipp is active on the Remodelers Council and is a past chairman of that group. He is a Life Spike and served on the New Member Development Committee for two years. Lipp is a strong supporter of the Council’s projects including the Home Builders Care Build for Habitat, wheelchair ramp projects and Restoring Existing

Neighborhoods for Everyone’s Well-being House. Ferguson donated the plumbing, lighting and appliances for the RENEW House, and donated the plumbing fixtures for the Habitat project. It also donated to the Fargo Motor Patrol Fish Fry, a fundraiser for Home Builders Care. Lipp grilled lunch on several occasions at the Habitat build and, over the years, provided grilling services and sponsorship for the Remodelers Council Picnic and Muddy Boots Picnic. A past supporter of the Builders Association of Minnesota’s convention, Lipp is a regular volunteer to make deliveries for World of Thanks. He has supported the Lake Agassiz Habitat for Humanity’s Tour de Habitat stationary bike race, serves on the Dorothy Day House of Hospitality board of directors, and has achieved “Gallon” donor status as a volunteer with United Blood Services. HBA Executive Vice President Bryce Johnson says, “Terry lights up a room and has everyone smiling when he’s around. Over the years, he has been a valuable asset to the HBA and we are truly indebted to his commitment to the industry and this Association.” Away from the HBA and work, Lipp enjoys all forms of fishing: ice, fly, deep sea, lake, etc. He also enjoys spending time with his wife of 25 years, Angie, and their twin sons, Jon and Zach. Both sophomores, Jon attends North Dakota State University and Zach attends Concordia College in Moorhead. The Lipps live in Fargo.

committee. Area 10 includes Iowa, Minnesota, North Dakota, South Dakota and Wisconsin. Flood insurance at the national level is still a hot topic and a major concern. NAHB is in the process of gathering information on the most current effects. If anyone has new construction addresses that have seen the increase in flood insurance premiums, NAHB staff needs those addresses and the information surrounding them. At the fall board meeting, there are a variety of committee and subcommittee meetings that provide attendees with myriad options for training and education. This year, HBA members attended meetings updating them on nationwide trends and forecasts in areas such as: state and local governmental affairs; markets and investment trends; construction safety and health news; new and emergent building products; and future additions to codes and standards. North Dakota continues to be a shining star. For the second year in a row, NAHB economists made note of our booming construction industry and our outstanding forecast for the near future. Currently, North Dakota is the only state that has seen housing prices stay static for an extended period of time. We also have by far the lowest foreclosure rate in the nation. Fall board and other national meetings provide tremendous opportunity for our members to get involved in high-level discussions that can help shape policy for years to come, as well as learn key information that helps to make our local organization that much stronger. A look back
The BAM Legal Action Fund has a near perfect record. In 2012 the fund won its case against the city of St. Paul stopping the city from overriding the state building code with its egress window policy. This win upholds the Minnesota Supreme Court ruling on Sax v. city of Morris, and signals to all municipalities in Minnesota the imporance of not exceeding the State Building Code by ordinance, formal enactment, development agreement, or policy. It is a significant, precedent setting win for the industry and can be used in future cases where a municipality is attempting to exceed the State Building Code. In addition to the city of St. Paul case, the BAM Legal Action Fund has successfully addressed other statewide legal issues including: zoning ordinance, plat approval, takings claims, TID charges and special assessments, 60-day rule, eminent domain, water intrusion and construction defects. The value of legal action is a proven member benefit. One of the industry’s first fights was on over-collection of building permit fees. West Central Builders Association has used this ruling numerous times when the city has tried to raise building permit fees. This lawsuit challenged the amount of fees collected by the city of Shakopee. As a result of the litigation, the parties entered into a detailed consent decree that resulted in the city reducing building permit fees for residential properties by between 69 and 91 percent. The consent decree contains requirements for all cities to provide greater transparency when setting fees. The National Association of Women in Construction is an international not-for profit organization comprised of women employed in various construction-related fields that promote the construction industry. The Fargo-Moorhead, N.D. Chapter #246 of NAWIC, in its goal to promote education and support the future workers of the construction industry, offers programs for all ages through our Chapter’s “Construction Educational Programs.” K-12 programs included are “Block Kids Competition,” for first through sixth graders, “CAD/ Design Drafting Competition,” for ninth through senior, and “Scholarships” to local male and female students pursuing education in a construction-related field. For the adults, monthly membership meetings cover the many different aspects of the industry through speakers, tours and networking as well as a variety of opportunities for professional development to gain leadership skills and serve as a leader in various capacities.

Louie Johnson, Dakota Underground Company, passed away this summer at age 72. Johnson started the company with his son, Jeff Johnson, in 1989 and was a HBA of F-M member since 2008. It began as a municipal sewer and water utility contractor which has since expanded into earth moving, concrete paving and concrete structures, just to name a few. Dakota Underground Company is a family-owned business that takes pride in a strong work ethic, which was derived from Johnson himself. Before Dakota Underground Company, Johnson had started Johnson Construction and worked for Butler Machinery. He served

Spike Club Q & A What are the benefits of becoming a Spike? The Spike program is a way to recognize you for your contributions to the HBA of F-M and you will be regarded as an accomplished and connected member. Additionally, Spikes receive: • Increased visibility, recognition and networking opportunities at industry events; • Unique and valuable lapel pins for each level of achievement; • Additional VIP treatment throughout the year. • Free Ticket to the Spike party at IBS How do I become a Spike? Before becoming a Spike, you are a Spike candidate. That means you have earned between one and five Spike credits. Once you earn your sixth Spike credit, you become an official National Association of Home Builders Spike! (Provided you have earned those six credits within two consecutive membership years.) Spike credits are earned by recruiting and retaining NAHB and Council members. To retain your status as a Spike you must earn a minimum of one Spike credit (new or retention) each year until you reach a total of 25 credits, at which point you are elevated to Life Spike status. How do I earn Spike credits? Members earn one Spike credit for each new member they sponsor. HBA Retention Committe members accrue Spike credits when helping to renew memberships each year. Spikes receive a half credit for the recruitment and renewal of Affiliate members. Will I earn Spike credits for recruiting and retaining members into a Council? Yes, when a new Council membership is activated the recruiter earns a half credit, and when that member renews his or her council membership, the sponsor earns a quarter retention credit. Minimum Interference
In his recent State of the Union address, President Obama suggested raising the federal minimum wage from $7.25/hour to $9/hour, an almost 25 percent increase. His argument: the minimum wage peaked in 1979 at Elliot Eisenberg, about 48 percent of the median wage Ph.D., GraphsandLaughs, and has steadily declined to about 38 percent today, and working should LLC be encouraged. Yet working full-time for minimum wage one earns barely $14,500/year, just below the poverty threshold used by the Census Bureau for households of more than one. Unfortunately, stylized facts do not make good policy. Raising the minimum wage hurts those in most need of a job, and policy should be based on facts not feelings. Proponents of raising the minimum wage suggest that a higher minimum wage makes work more attractive, which increases the supply of labor and reduces costs for absenteeism, shirking and monitoring. Were this truly the case, and if net labor costs actually fell as wages rise, we would see lots of employers voluntarily offering higher wages. But, that is not the case, putting the lie to this line of reasoning. The primary problem with raising the minimum wage is, outside of one questionable study, there is no evidence to support the claim that higher wages raise household incomes. It turns out that the reduced employment and thus the loss of income suffered by some households more than offsets the higher incomes enjoyed by households that hold onto their now suddenly higher-paying jobs. Worse, as both these effects are primarily to be found in low-income households, increases in the minimum wage simply end up redistributing income between poor households. The other big problem with this entire approach assumes that poverty is a result of low wages. It’s not. Low wages are the result of limited skills, which results in low productivity and thus low wages. The solution is to increase the skills of low wage workers, not raise their wages and keep them dependent on legislation for more money. For many workers, minimum wage jobs are the first jobs they hold and are therefore critical in helping them gain valuable work experience (and in the process increase their skillset) which will get them a higher future wage. Moreover, in many of the poorest households, no one works. To raise low household incomes, a far better approach is the Earned Income Tax Credit (EITC). This is because the EITC does not raise the wage rate paid to workers by employers. Rather, it is a federal income tax credit for low to moderate income working individuals and families. In 2012, the income thresholds were $14,340 for a single person and $19,680 for a childless couple. Above that level no tax credit is available. Unlike raising the minimum wage, with the EITC employers are not encouraged to replacing low wage workers with technology, offshore jobs, or reduce non-monetary employee compensation such as free uniforms, holidays, time off, or break time. The easiest way to help more low-income families would be to raise EITC income thresholds. Lastly, at present, teen unemployment is 22.7 percent. Worse, for blacks 16 to 19 it is 38.2 percent while for men 16 to 19 it is 25 percent. These are numbers that are roughly 30 percent to 40 percent higher than their historical averages. To now suggest that the solution is to make these workers even less appealing to employers boggles the mind. Even more HBA of F-M Education! There’s a New Code in Town: 2012 IRC Update * Two chances to attend: Nov. 13 OR Dec. 16 * WHEN: 8:30 - 10:30 a.m. Nov. 13 or Dec. 16. WHERE: Cass County Electric Cooperative/Enventis, 3312 42nd St. S., Fargo COST: FREE! Fargo Inspections Administrator Ron Strand will instruct this class on the 2012 International Residential Code, its significant changes, and Fargo’s amendments that were adopted in September. He will also update attendees on the International Energy Conservation Code and Chapter 11 residential energy provisions of the IRC. This class will expand on the details covered in classes this summer and address some problem areas inspectors are seeing on the code. Coffee and pastries will be provided. About the instructor: Ron Strand has been Fargo inspections administrator (building official) for 27 years. He previously served as building official in Devils Lake, N.D. Strand has certifications as building inspector and plans examiner, and holds a journeyman plumbing license. He has served two terms as the North Dakota Building Officials Association president and is a charter member of the board of directors for the five-state Region 3 Upper Great Plains Chapter of the International Code Council. He currently serves as Region 3’s Education Committee Chairperson and Nominating Committee Chairperson. Strand is an author and presenter of many seminars and articles regarding the International Code set.
Lunch & Learn: Why is Ventilation Necessary? Condensation & Mold
WHEN: 11:30 a.m. - 1 p.m. Nov. 20 WHERE: HBA of F-M, 1802 32nd Ave. S., Fargo COST: $10 (includes lunch!) Proper ventilation is a concern for home builders and remodelers. It is necessary to prevent condensation and mold in exterior wall assemblies and condensation on windows. This class will cover the types of ventilation, how to correctly size a fan, whole-house exhaust and supply, as well as ASHRAE standards and how to effectively meet them. About the instructor: Brendan Loughrey has held various positions in the ventilation Industry over the past ten years. He is currently the north central regional sales manager for the Panasonic Eco Products Division. His first-hand background and experience gives him an ability to educate best practice and preferred method of installation to distribution, installers, architects, designers, engineers and builders.
HBA to offer lead paint certified renovator training in March, refresher courses in early 2015
The HBA of F-M will offer Environmental Protection Agency Remodeling, Renovation & Painting (RRP) Rule certified renovator training in March through the University of North Dakota’s Environmental Training Institute. To satisfy requirements by the U.S. EPA, building and remodeling firms must have one or more certified renovators assigned to each job where paint is disturbed in homes built in 1978 or earlier. Eight hours of training is required to become a “certified renovator.” Also, Minnesota requires lead certification when issuing permits. Municipalities verify lead certification for residential builders, remodelers, roofers and manufactured home installers when requesting a permit to work on homes constructed prior to 1978. A four-hour refresher course every five years is required to keep the Certified Renovator designation current. Since the HBA first hosted Certified Renovator classes in early 2010, the Association will offer its first refresher classes staring January 2015. The National Association of Home Builders also has a number of resources to help its members comply with the lead paint rule.
