HBA of F-M President’s Message What has your HBA done for you (and the rest of the industry) lately? Represent!
In just the past 30 days, your HBA of F-M leaders have: • Met with U.S. Sen. Heidi Heitkamp about housing issues in North Dakota, • Represented you in a meeting with FEMA officials regarding our area’s basement exception, • Appeared on your behalf at a Fargo City Commission meeting regarding the city’s adoption of the 2012 IRC, • Represented you at a meeting of the North Dakota State Building Code Advisory Committee, which is in the process of amending the state’s building code to the 2012 IRC. Your HBA office is always bustling, dealing with the daily regulatory and legislative issues that come up. We are the voice of the industry, and I thank you for supporting this Association! Members are what make the HBA great. In our strategic planning talks, there has been discussion about showing membership value and offering member exclusivity. Bottom line: It’s hard to put a dollar amount on “advocacy,” government relations and our representation of your industry. It’s impossible to make advocacy a members-only benefit. Everyone in the local home building industry benefits from the HBA’s actions on your behalf. If you support the HBA of F-M, your building industry associates should, too! It’s amazing how many HBA of F-M members aren’t even aware that the vendors and trade contractors they work with are non-members. Check out our Membership Directory and Consumer’s Guide and then invite them to join the Association. Not sure how to start the conversation? The HBA staff is here to help. Contact Allison Weckman at (701) 232-5846 or allisonw@hbafm. com. Darrick Guthmiller Kochmann Brothers Homes, Inc.
September is Associate Appreciation Month
Associate members make up the majority of our great HBA, and every September we make a point to highlight them. This month is designated by the National Association of Home Builders to pay tribute; Builder members, please thank the Associates you work with every day. At the Family Picnic in August, the HBA honored them by giving away prizes and by featuring dessert served by the Builders in attendance. Plus, all Associates in attendance were entered in a drawing for a half-page ad in the Plains Builder and a gift card for “lunch on the HBA.” See pages 21-22 for a recap.
November brings Leadership Difference speaker
Do it now: Block off your afternoon for Nov. 7. We are bringing in a world-class speaker, David Mitchell of Leadership Difference, for our November keynote session titled “The Power of Understanding People.” Mitchell’s keynote will be accompanied earlier in the afternoon by a session titled “Building Industry HR: Avoid Costly Legal Consequences of Employee Misclassification” delivered by Ryan Braley, an expert at Avitus Group. Mitchell brings 18 years of experience on topics like leadership, customer service, selling skills and personal performance enhancement. He was named Best Speaker of the Year by Meeting Professionals International this year! These two sessions will give you and your employees some great takeaway tips, practices and procedures. Don’t miss it!
Join a committee in 2013! Your HBA of F-M is here to support you. Not only do you make the Association what it is, but we rely on people like you to serve on committees to ensure the HBA is always moving in the right direction to best serve the membership. Whether you are interested in public issues, events, education or membership development and retention, we have a committee for you. For more details on any committee, contact Allison Weckman at (701) 232-5846 or allisonw@hbafm.com.

The Kitchen Magician
Featured speaker Paul F. Ryan is a nationally recognized home improvement expert. Known as the “kitchen magician,” his seminars feature cost-effective kitchen improvements that will bring years of enjoyment and a nice payday when it comes time to sell. Ryan has remodeled hundreds of kitchens through his work as television show host on both the DIY and TLC cable networks, and off-camera as a licensed building Paul F. Ryan will cover contractor in the Twin Cities. cost-effective kitchen Ryan says, “People often ask improvements. how I got the ‘magician’ tag. What happened is the DIY crew coined the term after seeing so many of my clients literally spellbound at the transformation of their remodeled kitchens!” He has been in the construction industry for over 25 years. It all began at the Valleyfair Amusement Park in Shakopee, Minn., where he helped build everything from rides to structures. The TV gig was happenstance: in the early 1990s, a company needed someone to host a video project who could talk about tools while using them. Ryan was the perfect fit. He became a household name through hosting the national cable broadcast “Kitchen Renovations” and on the popular DIY broadcast “Weekend Handyman.” In addition, he has hosted the DIY broadcast “Home Energy Savings” and TLC’s “How-2 Crew” and has appeared on HGTV and The Food Network. Public Issues Report of Area Affairs Meet your elected official What is your background (education/prior work experience, etc.)?
I was Grand Forks-born and raised on a farm near Warren, Minn. Darrell Vanyo I graduated from NDSU in 1972 and Cass County have lived in West Fargo since the Commissioner early 1980s. I try to be very involved in the community, previously serving on the D-M Council of Governments, the West Fargo Economic Development Committee and the board of directors for Hospice of the Red River Valley. Currently I chair the F-M Flood Diversion Board of Authority, and sit on the F-M Economic Development Committee.
services, and for our maintenance needs. And of course, the continued progress of the F-M Diversion, which is so integral in protecting all that we’ve developed so far.
What do you see as the future issues facing Cass County?
Handling the growth with a limited, yet smart, budget. And, of course, the F-M Diversion is an issue that we will be working on for quite some time.
What are the best and worst parts of your job?
The best is seeing projects that you’ve worked on actually come to fruition. For me, besides the jail expansion, it’s also the creation of the county sandbagging station and lowered mill levies. The worst part is in some of the nastier criticism that elected officials can receive, but you learn to deal with it and keep on fighting.
Why did you decide to run for public office?
Is there anything you would like to see the HBA do more of?
What issues are most important to you?
What advice would you give someone running for office?
It wasn’t initially any specific issues, but rather the fact that I felt public service was important and would be very interesting. I actually lost my first race in West Fargo, but shortly thereafter there was a run-off to fill a vacant seat, and I was able to win.
You’ve done a great job in being very involved in state legislative issues, both visually and vocally. Continue to advocate for your industry, as we are all working toward the same goals.
When I first ran for West Fargo City Commission, it was the Sheyenne River Diversion. Then, when I first ran for Cass County, the expansion of the County Courthouse was a big deal. Now my biggest issues are expansion across the county – in the law enforcement division, in our social
Try to have multiple issues that you are passionate about. You will need more than one thing to focus on, no matter how big the issue. And most importantly: care about the public’s needs, and where their money goes.
HBA hosts Candidate Forums for Moorhead mayoral, City Council races by Mike Obach, Public Affairs Coordinator
The HBA of F-M will be holding a series of member forums with declared candidates for Moorhead’s mayoral and City Council races. The events will take place in September and provide an opportunity for HBA members and the candidates to get to know each other, and also where both stand on key issues. The candidates will have the chance to share their vision and ideas with a group of key local citizens. The first forum will feature candidates for Moorhead’s mayoral race. It will begin at 11:30 a.m. Sept. 5 at the HBA of F-M. The remaining two Moorhead Forums will be Sept. 12 at 7 a.m. (Wards 1 and 2) and 11:30 a.m. (Wards 3 and 4), both at the HBA of F-M. Pre-registration is required as seating is limited and meals will be served. Prior to the forums, HBA staff will send questionnaires to all declared candidates and distribute the answers to concerned members. This information will help us to form questions and prepare ourselves to best utilize the format of the member forum. To register, or if you have any questions, please contact Mike Obach (701) 232-5846 or mike@hbafm.com.

At the end of July, North Dakota Association of Builders’ members attended a public hearing for adoption of the North Dakota State Building Jason Eid Code. This event was coordinated NDAB President, by the Building Code Advisory Eid-Co Buildings, Committee, made up of appointed Inc. officials from multiple elements of the building and development industry: one representative each from the plumbing, mechanical contracting, electrical, architectural, home building and engineering fields, along with one building official and one fire official. The public hearing meeting is a chance for this committee to receive public input on all proposed amendments to any facet of the state building code. This input can be from a member of jurisdictions that follow either the North Dakota State Building Code or a modified version per a Home Rule charter; input can be from anyone, not only a city’s designated building official. Prior to the public hearing, the Advisory Committee had allowed until April 30 for any code-abiding jurisdiction to submit amendment proposals to the 2012 International Code Committee’s five separate construction codes, including the International Residential Code (IRC), which is used for all one- and two-family dwellings. The Advisory Committee’s recommendations were distributed Aug. 12 to the eligible towns, cities, counties and committee members that make up the voting assembly. This assembly has about three weeks to review all of the proposed amendments before finalizing. This meeting will occur Sept. 4-5 at the North Dakota Department of Commerce’s offices.

Don’t leave money on the table: check out member rebate program
No one likes to leave money on the table. So, what if you could get a rebate for your loyalty to many of the nation’s leading housing industry product suppliers? Well, now you can! The North Dakota Association of Builders’ Member Rebate Program increases your bottom line. For the minimal effort of informing NDAB about home construction products you use, and when you close on a home or project, you’ll be putting money back in your pocket. Both Builder and Remodeler companies, no matter how large or small, qualify for the program, and you are not required to use products from every manufacturer.
No change needed in your business practices
Besides the money, the nextbest part of the program is that it doesn’t change the way you do business. You are not required to submit receipts and you do not have to change how you purchase products. NDAB does the paperwork, collects the money and mails quarterly rebate checks directly!

News from the Builders Association of Minnesota 2013 Mid-Year President’s Message
by Chase Kompelien, Kompelien Custom Homes
I hope this message finds you so busy with work you barely have time to read it! Every day you make business decisions, often prefaced with the question “why is this good for my company?” It’s important to know the “why” regarding your business decisions and one of those “why” questions may be about your membership in the builders association. My membership “why” boils down to excellence and being the best builder I can. With my builders association membership, I’ve built business relationships in my community and across the state. I receive the inside track on industry information and trends and I’ve influenced the politicians and regulators that make decisions on how we do business every day. Builders Association of Minnesota exists to unify the statewide home building industry and help you be the best you can as a home building professional. It was created to bring the state industry together and amplify the sound of our voices together, and that’s exactly what we do today. BAM represents you and your business at the state’s Capitol, regulatory agencies and in the courts because industry unity and doing business with members is good business. Simply put, we are stronger and have a louder voice together.
Protecting your business at the Capitol
If you haven’t seen it yet, we put together a great summary of what happened this legislative session and what might affect your business. Wins this year included mitigation of what would have been an expensive radon requirement, protection of the industry’s warranties and general liability coverage, and preventing hidden fees such as street improvement districts from becoming law. There were many other pieces of legislation that we worked on and we will continue to work on, but one thing I learned from being at the Capitol this year was, although we have the facts, politicians oftentimes side with emotion and disregard the facts. I guess that’s called politics.
in all corners of the state. There are several examples of legal wins that benefit the industry. One in particular is the building permit fee win against the city of Shakopee. Since that case, my local city tried to raise building permit fees above the cost of providing the service. We used this industry win to keep them from doing so. The BAM board of directors will be discussing how to support the Legal Action Fund financially for the next several years. Let your state representatives know what you think so they can bring that to the table for the meeting Sept. 18.
$28,000 holiday dollars!
In 2012 alone, BAM members added $28,000 in rebates to their bottom lines by using the Holiday Station Stores program. On average, each participating member got a $400 check. That nearly covers the cost of membership! Sign up to get a cut of that rebate! Not only will you get a ten-cent-per gallon discount in the first 90 days and four cents per gallon off thereafter, but you’ll get a rebate at the end of the year. You don’t want to miss out on a piece of a Holiday pie! Check out the other awesome discounts too!
Thank You
You’ve probably heard the phrase, “you get out what you put in,” but what does that really mean? It means, the more involved you get, the more you learn about how our industry is regulated and the laws governing our business. The more involved you get, the more influence you have in defending our industry and in shaping the laws and regulations we have to meet as licensed residential contractors and associates. Ultimately, the more involved you get, the more you learn – from the business contacts you meet, from the experience you have at the Capitol, from participating in events and on BAM’s working teams (committees) – the more value you are able to provide your customers. Knowledge is power. Thank you for your commitment to the industry. I look forward to seeing you at BAM’s events and in our working group meetings.
$10,000 in legal resources
One of the big benefits of BAM membership are legal resources such as the set of six contracts available for free to members and estimated to be worth over $10,000. This year, BAM has updated the contracts to reflect the changes made to state law. As a bonus, a sample change order document has also been added to the set. Check out the updated contracts at www.bamn.org. If you need your username and password, contact Katherine at katherinen@bamn.org.
Legal protection
Membership with the builders association means collective legal protection. BAM’s Legal Action Fund takes on cases with statewide significance, meaning that a successful case will help home building professionals

News from the National Association of Home Builders Higher mortgage rates prompt pause in new-home sales in July
“New-home sales figures refer to newly signed contracts to purchase a home, rather than a completed sale, and it’s likely that the higher rates caused some buyers to delay putting pen to paper,” explained NAHB Chief Economist David Crowe. “However, there is still a great deal of pentup demand for homes in markets nationwide, and builders continue to report improving consumer interest. This suggests that what we’re seeing is a temporary pause, and that buyers will return to the market once they are confident that the higher mortgage rates are here to stay.” Every region recorded lower new-home sales in July, with declines of 5.7 percent, 12.9 percent, 13.4 percent and 16.1 percent reported for the Northeast, Midwest, South and West, respectively. Meanwhile, the inventory of new homes for sale edged up to 171,000 units in July, which is a 5.2 month supply at the current sales pace.
Builder confidence rises 3 points in August
family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores from each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. Two of the HMI’s three components posted gains in August. The component gauging current sales conditions rose three points to 62, while the component gauging sales expectations in the next six months gained a single point to 68 and the component gauging traffic of prospective buyers held unchanged at 45. All but one region saw a gain in its three-month moving average HMI score in August. The Midwest and West each posted six-point increases, to 60 and 57, respectively, while the South posted a four-point gain to 54 and the Northeast held unchanged at 39. Editor’s Note: The NAHB/Wells Fargo Housing Market Index is strictly the product of NAHB Economics, and is not seen or influenced by any outside party prior to being released to the public. HMI tables can be found at www. nahb.org/hmi. More information on housing statistics is also available at www.housingeconomics.com.
August 23, 2013 - Sales of newly built, single-family homes declined 13.4 percent to a seasonally adjusted annual rate of 394,000 units in July as higher mortgage rates prompted a temporary pause in buying activity, according to newly released data from HUD and the U.S. Census Bureau. “The drop-off in sales in July is in part a reflection of buyers’ reaction to the recent uptick in mortgage rates as people reassess their budgets to determine how much house they can afford,” said Rick Judson, chairman of the National Association of Home Builders (NAHB) and a home builder from Charlotte, N.C. “Consumers just need a little time to adjust to the new parameters of the market.”
August 15, 2013 - Builder confidence in the market for newly built, single-family homes rose three points to 59 on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI) for August, released today. This fourth consecutive monthly gain brings the index to its highest level in nearly eight years. “Builders are seeing more motivated buyers walk through their doors than they have in quite some time,” said NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. “What’s more, firming home prices and thinning inventories of homes for sale are contributing to an increased sense of urgency among those who are in the market.” “Builder confidence continues to strengthen along with rising demand for a limited supply of new and existing homes in most local markets,” noted NAHB Chief Economist David Crowe. “However, this positive momentum is being slowed by the ongoing headwinds of tight credit and low supplies of finished lots and labor.” Derived from a monthly survey that NAHB has been conducting for 25 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-

Complying with the EPA Lead Paint Rule during emergency renovations
In the case of emergency renovations, often in the wake of a natural disaster, the EPA’s lead paint rule (LRRP) contains some accommodations. For the full guidelines, read the post-disaster LRRP FAQ from the EPA: http://www2.epa.gov/lead/post-disaster-renovations-andlead-based-paint-fact-sheet. Larry Leadhead EPA Lead Enthusiast
Which parts of the LRRP rule are in effect for emergency renovations? All emergency renovations in pre-1978 homes still require cleaning, cleaning verification, and recordkeeping under the LRRP rule. These requirements must be performed by an EPA certified renovator.
Which provisions of the LRRP rule are not required for emergency renovations?
Emergency renovations are exempt from the following LRRP rule provisions: information distribution, posting warning signs at the renovation site, containment of dust, and waste handling. Contractors working on emergency renovations do not need to be EPA trained or certified but an EPA certified renovator is required to do the cleaning, cleaning verification, and recordkeeping under the LRRP rule as noted above.
www.RIGELS.com
609 Main Avenue • Moorhead, MN 218.233.6104
Are there any emergency renovations that are exempt from the LRRP rule? The LRRP Rule does not apply to an activity that demolishes and rebuilds a structure to a point where it is effectively new construction, i.e., a teardown.
Which activities qualify as emergency renovations?
Emergency renovations are renovation activities in pre1978 homes that were the result of a sudden, unexpected event like a natural disaster and must be performed immediately to protect personal property and public health. This information is from the National Association of Home Builders’ website. For more information, please contact Nissa Hiatt at (800) 368-5242 ext. 8451, or nhiatt@ nahb.org. Building Official’s Corner
IRC training seminars, I-Codes adoption We’ve just completed another series of seminars on the 2012 changes to the International Residential Code and Energy Codes. Thanks to the Ron C. Strand Fargo Inspections efforts of Mike Obach, HBA public Administrator affairs coordinator, your Association and member volunteers, they were a success. It was a pleasure presenting them to all of you who attended. If you weren’t able to attend one of the scheduled seminars perhaps you might be able to talk Mike into one more so that you could. My guess is that if he judges the interest sufficient to warrant another, he would set one up. I’d be happy to participate.
2012 I-Codes at Fargo City Commission
The culmination of the review of the newly available 2012 I Codes was reached when the Fargo City Commission considered the second reading of their proposed adoption Aug. 19 and passed the codes. They became effective on or about Sept. 3. The reason for the additional two weeks is that the adopting ordinances contain a penalty clause and therefore cannot go into effect until final publication in the newspaper. As has been the case in the past, we will use a “soft start” for implementation of the new provisions of this code set. This may enable you to honor outstanding contracts or other similar commitments without sustaining any additional financial loss. In addition, it should give you at least a little time to accommodate any new provisions within the scope of your projects. Feb. 21-23 Fargodome
You should also be aware that the 2012 International Energy Code, together with Chapter 11 of the International Residential Code dealing with residential energy code requirements, were not recommended for adoption at this time. This would mean that the 2009 edition of each would remain in effect and be enforced for the foreseeable future.
State adoption process and effective date
North Dakota is keeping to its path for adoption of the I-Codes statewide. As I write this article, the North Dakota Building Code Review Committee had held its first meeting to determine the ballot make-up for the statewide vote scheduled for Sept. 4-5 in Bismarck. Representatives of the HBA of F-M and I were present for that meeting in July, and were successful in securing favorable recommendations and nearly all of our requested amendments. Should that result be sustained during the actual voting it will mean that the state codes and the codes here in Fargo will be nearly identical. Should you have any questions regarding either the local or state adoptions of these codes feel free to contact me at your convenience at Fargo Inspections.
Future articles and present construction season
As we move forward with implementation of these new codes, I will try to include specific information on code enforcement questions that arise. It has been very busy in our office this year and particularly so most recently. Judging by the amount of activity, I would venture to say this has been a pretty successful year for us all. During the past year, we lost two staff members to retirement. We are moving forward with the process to fill both positions as quickly as possible. Have a great, productive and successful fall.

HBA of F-M Associate Member Feature soybeans. Rocking Horse Farm The coming months will see Rocking Horse Farm Fargo development brings genuine blend of modern and rural to its residential and commercial community
Tucked in the southwest corner of Fargo’s city limits, sitting north of 52nd Avenue South and west of Veterans Boulevard, Rocking Horse Farm will be a true example of a master-planned community that bends over backward to make its distinctive vision a reality. In 1999, ground was broken on the first of five anticipated farmstead office buildings inside Rocking Horse Circle, a unique road that forms a half-mile-long ring around the workspace of several companies that now call the development home. That first structure… designed as a red barn with grain bin on the outside, modern office building on the inside… encapsulates the nature of Rocking Horse Farm perfectly, blending the flair of the modern into the quiet solitude of the farm. In the 14 years since, Rocking Horse Farm has lived and breathed that combination, firmly rooting modern and rural values into its DNA. Businesses have thrived in its relaxing work environment, while farmers have continued to nurture the land, annually planting and harvesting wheat, corn and

embarking on its next chapter, as the 160-acre development finalizes its master plan, which will establish residential neighborhoods alongside its existing and future commercial presence. Approximately 400 housing units will transform the current environment at Rocking Horse Farm, fulfilling the long-term vision for the development. Residential lots will become available to build on in 2014. “We feel this will become one of the more unique developments in the area, and we think it will present a matchless opportunity for homeowners who are looking for a walkable, mixed-use community,” says Ken Promersberger of Rocking Horse Farm LLC. “We believe the comfort of small-town living, blended with all the conveniences of the city, will attract many families.” While tractors and cash crops may soon be disappearing from the landscape, new residents can be sure that rural elements will remain – ensuring Rocking Horse Farm stays true to its name. Some low-density neighborhoods are planned to preserve the feel of wide-open spaces, with

Brian Kounovsky, Managing Partner Valley View Development
“We are currently developing 200 acres of land in Fargo on the corner of Veterans Blvd. and 40th Ave. S. The lots are located across from West Fargo’s Sheyenne High School and Liberty Middle School and home to the city’s newest elementary school.”
What is the latest trend in your industry?
“We have all heard it: ‘sustainable living’ or ‘sustainable land development;’ the desire to have developments with shopping, parks, public transportation, mixed-use buildings alongside traditional living, walkable developments. This is happening to a degree in the F-M area with some success, however it is a big risk. As a community, we love our SUVs and are not afraid to jump into them and head out to another part of town. Taking this on as a core value as developer in this market will be very risky. We are trying to incorporate sustainable living into our development but at a less risky level.”
What do you think is the biggest challenge facing the industry today and how are you dealing with it?
“I think coming up with a new neighborhood concept that everyone will love is the biggest challenge. There is a lack of natural features in the Red River Valley; as one gets away from the river, everything else is pretty much the same. The further we can break from the ‘stack and rack’ lots, the more desirable those neighborhoods will become and higher resale values will follow in the future.”
September
What is your company’s focus?
“We specialize in land acquisition and development focusing on residential projects with future plans to include commercial development.”
What is the latest trend in your industry?
“As I see it, cost has become more of a factor to many home buyers. The overall trend is toward higher density developments, smaller lots and narrower streets which effectively lower lot costs and special assessments. With smaller lots, the footprint of homes tends to be reduced and additional levels are added to maintain the desired square footage. As for aesthetic appeal, the more natural settings with water features in walkable communities, close to conveniences appeal to most new home buyers.” Ed Wilson, Chief Manager Wilson Investments
What do you think is the biggest challenge facing the industry today and how are you dealing with it?
“I believe development and growth need to be managed in a healthy manner. Good planning and market demand should lead the way. So often I’ve seen that a strong growth cycle in a particular housing market has had an unhealthy long-term effect on the future market once the growth plan overshoots demand creating a surplus, which has a negative impact on the whole industry. Personally, I have never been a proponent of development done in 100 plus lots per phase. The approach Wilson Investments has taken has been to closely monitor the available lot inventory in our community and to plan and develop accordingly.”

It was established with funds donated by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling. The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.
Charity Ride is a success

Eligible high school students must be planning on attending Minnesota State Community & Technical College (M State) or North Dakota State College of Science (NDSCS) and pursuing a degree in a construction field. High school students from any area town can apply. Scholarships are also available to members of the National Association of Home Builders student chapters at Minnesota State University Moorhead (MSUM), M State, North Dakota State University (NDSU) or NDSCS. All scholarship applications can be downloaded at www.hbcfm.com. Applications are due at 4:30 p.m., Oct. 4 to the HBA office. Awards will be announced at a scholarship reception in November.
Support Your Foundation
HBA of F-M members have many ways to support Home Builders Care. The HBC Board challenges you to find at least one way that works for you to give back to your foundation. • Monetary donations are always appreciated and we have numerous recognition programs (see page 27 for levels). You can even give online using your credit card. Just click on the Donate button of the HBC’s website www.hbcfm.com. - One of my favorites is the Triple Player which was set up to recognize those HBA members who support the HBA through membership dues and give at least $365 to both NDAB-PAC and Home Builders Care. • Use Goodsearch and Goodshop when searching and shopping online. Make sure you type in Home Builders Care of Fargo-Moorhead Foundation as the group you support. Goodshop also offers discounts and coupons so you can get a little something for yourself while giving back. • Take your aluminum, magazines and paper recycling to Minnkota Recycling and indicate that you want the proceeds to go to Home Builders Care. • Host us at any public or networking event you organize. We have found these events are great for spreading awareness about Home Builders Care while raising some money. • Adopt a Herdina Academy for the Construction Trades student for the 2014 session. For only $75 you can help us provide this course to area high schoolers. • Volunteer at the Health, Tech & Trades Career Expo coming up Dec. 12. We always need people to represent our industry. grassy meadows, trees, bike trails, parks and wildlife ponds further helping to offer clear views to adjacent Osgood Golf Course and many other areas that contribute to a genuine feeling of nature. The distinctive red barn in the heart of Rocking Horse Farm is well known for producing the delightful aroma of fresh chocolate chip cookies, but there should be no doubt that the residential development will be anything but cookie cutter. Following the growing trend of “new old” homes, Rocking Horse Farm is encouraging traditional, classic housing designs with elements of contemporary creativity. While the rural-themed neighborhood community will be immune to the hustle and bustle of traffic, nearby arterial streets keep schools, recreational destinations and shopping centers just a few minutes away. Osgood Kindergarten Center, Sheyenne High School, Liberty Middle School, Family Wellness and Scheels Arena are just a few of the amenities nearby. Hornbacher’s, Costco, Walmart and the future Sanford Medical Center are right down the road as well. “Whether building a dream home or seeking a stimulating work environment, families and business owners we feel will agree that Rocking Horse Farm will be a true community at its very best… a place with small-town warmth where one can live, work and play,” says Rocking Horse Farm Promersberger. Work platforms: Practical advice for use in residential construction by C.J. Flanery & Jennifer Landman, ACME TOOLS
Editor’s note: There has been a lot of buzz about OSHA and fall protection in the F-M area building industry recently. This is due to a change requiring home builders and trade contractors to comply fully with the Occupational Safety and Health Administration Compliance Guidelines for Residential Construction. This change happened in 2011, but there was a phase-in period that ended March 15, 2013. Residential home builders are now required to comply with the new rules regarding guardrails, personal fall arrest systems (harnesses and lanyards, etc.) when workers are exposed to vertical drops of 6 feet or more in height. This is the second installment article of three.
Is this where you do your work? If yes, then you’ll need to know the most current rules and regulations which you can download for free from www.itsdf.org. If you own a Telehandler (class VII power industrial truck), this tool aids your crew in getting up safely at heights with weight to complete your job. ANSI (American National Standards Institute) B56.6 is the regulation in which work platforms are governed while OSHA is the enforcement organization. As a general practice, OSHA gathers rules written from ANSI and puts them to a standard to be enforced. These regulations are written by necessity due to injuries and fatalities because of improper use of work platforms. Operators of Telehandlers need to be trained and qualified to operate the equipment safely. When Telehandlers started hitting job sites, it seemed natural to put people up in the air; workers fabricated their own platforms from metal or wood. Telehandlers can lift up to 10,000 pounds, so the temptation is to build wide,

tall and heavy, but this equipment has lifting zones that vary drastically which can lead to tipping. Work platforms have many specific rules such as slipresistant surfaces, weight of the empty platform, maximum widths, fall protection use, anchorage points, etc. Self fabrications to standards may not be cost effective. What most contractors need to understand is work platforms need to be no wider than 10 inches outside of load-bearing tires. In most cases, a 116-inch wide by 4-foot platform depth is the accepted size with guard rails, anchorage, and a means to secure the platform to the lifting mechanism. While platforms are being manufactured larger than the accepted personal sizes, these items are to lift material or use for leading-edge fall protection. Do not use platforms from the end forks’ pockets for elevation of people or equipment; platforms are to be used from the middle forks’ slots. The work platforms are not designed to work on the long end because it does not meet safety-rated specifications and would be a violation. End pockets are for loading and unloading the basket itself. Lastly, the use of fall protection is a requirement for the crews in the work platform with the tie-off point to be defined and free of trip hazards. The operator of the roughterrain forklift needs be within 25 feet of the occupants in the work platform. For more specifics, refer to the link provided by Industrial Truck Standards Foundation: www.itsdf.org. Pricing for work baskets vary with models of platforms and are under $2,000 for most sizes, plus freight, to get to your location. ACME TOOLS has been an HBA of F-M member since 1982. C.J. Regulation and its unintended consequences
Looking around the United States there are cities like Boston, Los Angeles and Washington, D.C., that have very high house prices. Yet there are equally successful cities Elliot Eisenberg, Ph.D., like Austin, Dallas, Louisville and GraphsandLaughs, Oklahoma City that have much more LLC affordable home prices. Why the difference? Of course the surf is better in L.A., than in Dallas, but it has always been better, and 40 years ago L.A. was not an expensive city. The reason for this disparity is regulation. Simply put, each piece of legislation that becomes law, and each regulation promulgated by the bureaucracy, regardless of how well-meaning, increases home prices. Sure, having a 30-foot setback looks nicer than a 20-foot setback, but it makes lots more expensive. And while requiring a brick façade may add gravitas to a house, it too raises its price, and the list goes on. Worse, as housing prices are artificially pushed up, distortions are introduced that have negative unintended economic consequences. Imagine yourself new to town and looking to buy a house. Happily, you quickly find your dream house, but it costs $205,000 and all you can afford is $200,000. Turns out the house you love was built in 2009, the first year houses were required to have cement driveways and picket fences, which raised the price of those houses and all subsequent ones by, you guessed it, $5,000. The solution, look for a house built before 2009. But just like you, everyone else in your situation is doing the same thing. As that happens, the price of homes built prior to 2009 rises. After all, demand for them is suddenly up, way up. And presto, the house that used to sell for $200,000 now costs $203,000. An alternative is to look for a house in a neighboring town where asphalt is still allowed and picket fences are optional. And as luck would have it, you find a beautiful $200,000 house and move in. The only problem; your commute to work is now twice as long as it would have been if you had been able to buy that original house. And that increases carbon dioxide emissions, causes needless wear and tear to roads and infrastructure, requires you to buy a new car more often, and hire a sitter for your kids, as you are all too often caught in traffic driving home. But wait, it gets worse; suppose your uncle owns a huge parcel of land and planned to build entry-level houses on it for $200,000. He can’t now because of the cement driveway and picket fence rules which force the price up to $205,000. The problem is folks like you can’t afford those houses, so he goes upscale and builds $225,000 houses, and in that way does well, but contributes to the affordability problem. To review, forcing anyone to do something they otherwise would not have done makes whatever it is more expensive. In this case, it raises the price of new entry-level

In addition, it raises the price of houses built prior to the law, which in turn pushes home construction into neighboring areas which adds to sprawl and boosts carbon dioxide emissions. The moral of this sad tale, think twice before reflexively solving problems through regulation and legislation. The consequences can be quite far-reaching and unintended. Spike Club Q & A
How do I earn Spike credits?
What are the benefits of becoming a Spike?
The real benefits are intangible—you are recognized for your contributions to the HBA of F-M and regarded as an accomplished and connected member. Additionally, Spikes receive: • A coveted invitation to the biggest party of the year, the Spike Party/Directors Reception at the International Builders’ Show;* • Increased visibility, recognition and networking opportunities at industry events; • Unique and valuable lapel pins for each level of achievement; • Additional VIP treatment throughout the year. *
Invitations are sent only to eligible Spikes who have at least six credits and one new member recruitment credit between Jan. 1 and Oct. 3. The recruitment credit may be composed of one full credit received when a new Builder or Associate member is recruited or two half credits received when Affiliate or Council members are recruited. (The HBA’s October board meeting for approving new members is Oct. 17, so you must have recruitments turned in for that meeting!)
Members earn one Spike credit for each new member they sponsor. HBA Retention Committe members accrue Spike credits when helping to renew memberships each year. Spikes receive a half credit for the recruitment and renewal of Affiliate members.
Will I earn Spike credits for recruiting and retaining members into a Council?
Yes, when a new Council membership is activated the recruiter earns a half credit, and when that member renews his or her council membership, the sponsor earns a quarter retention credit.
How can I get a ticket to the IBS Spike party?
You must be a Spike in good standing as of October 31 (having at least six credits) and you must have earned at least one new member credit between Jan. 1 and Oct. 3. The new member credit can be one full credit earned when a new Builder or Associate member is recruited, or two half credits when an Affiliate or Council member is recruited. Read more information about the Spike Party on the previous page!
How do I become a Spike?
Before becoming a Spike, you are a Spike candidate. That means you have earned between one and five Spike credits. Once you earn your sixth Spike credit, you become an official National Association of Home Builders Spike! (Provided you have earned those six credits within two consecutive membership years.) Spike credits are earned by recruiting and retaining NAHB and Council members. To retain your status as a Spike you must earn a minimum of one Spike credit (new or retention) each year until you reach a total of 25 credits, at which point you are elevated to Life Spike status.

Rocky Mountain States Stand Down for Construction Fall Safety
Voluntary Work Stand Down Focus: Preventing Falls
Falls are the leading cause of death in construction, accounting for one third of all workrelated deaths in the industry. In partnership with North Dakota OSHA, the HBA of F-M supports a voluntary "Stand Down" that can be very helpful in focusing all workers in the importance of safe work practices. A kick-off meeting will be webcast to meeting locations across the six states of Region VIII. The Rocky Mountain States Stand Down web page will continue to provide educational materials and links to online resources to assist employers with training for their workforce. Participants in the Stand Down will receive resources to take back to their job sites to use in safety talks and employee training. The Stand Down Commitment Form will track the training and fall prevention efforts that occur at the job sites during the month of October, 2013.
