IS THE SIZE OF YOUR

HOME RELEVANT?

H

ave you ever wondered how big your house is? For many, size matters and can often be a point of distinction when evaluating a property for purchase. Yet for an aspect this important, there seems to be a lot of questions, and questions can lead to conflict. Naturally, when buyers find out their recently purchased home is smaller than they believed, they want to be reimbursed for the difference. In a recent situation like this, a buyer asked for $100,000 from the seller! ! However, disputes over home size and price are often not that straightforward and only through continued education will these situations be reduced.

So, who determines a home’s size, and how is it measured? When a property is listed on the MLS, the square footage is auto-populated from the county records. These records are often inaccurate, and may not be updated to include changes from construction or remodels that have altered square footage. Yet, because these are the only official records for reference, they are often used in advertising with a caveat about their validity and that any conflicting information, and their sources, will be disclosed by the seller. Other home measurements may originate from sellers, the original builder’s plans, the architect of a remodel, or an appraiser when a property was refinanced. There may be many conflicting measurements from many sources. The most commonly accepted source is the appraiser, a licensed professional who is trained to determine value, and is the sole source in determining the value of the property for the lender. Many people often use square footage as the only criteria to establishing value when purchasing a property. Price per square foot is a common measurement used when looking at comparable properties and their selling price. However, there are many other factors that determine value, especially at the high end of the market. The quality of the interior finishes, a desirable lot, an appealing floor plan, the location, and school district are just a few of the factors that also affect value. Many people’s criteria for determining value may differ, and may be more subjective. For sellers when determining a listing price, a knowledgeable agent is crucial as they have toured all recently sold properties, and have a better reference about the pros and cons of comparable properties beyond size. When buying a home, sometimes disclosures and warnings about potential discrepancies are not thoroughly read, or understood by buyers as they get lost in the purchase contract. If a buyer finds out their home is smaller than advertised, is it then “worth” less? Not necessarily. In the example in which the buyer sought $100,000 dollars, the advertised square footage was based on the original architect’s plans. During construction, some changes were made that reduced the square footage, and was not reflected in the listing. When the buyer sought compensation from the seller, the appraisal for their loan actually incorporated the lesser square footage and found the property was valued accordingly, thus eliminating any claims that the property was worth less. An appraiser will always do his or her own assessment on square footage and not just use the advertised size. An experienced agent can, and should ensure that a buyer understands that discrepancies may occur regarding square footage, review disclosures, and set realistic expectations regarding size. There are many reasons we are drawn to a particular property, which are at times emotional and often unquantifiable reasons. In the unfortunate event there is a surprise regarding size, it is important to remember that size is not everything — it is still the house that you paid for.

THE IMPORTANCE OF THE PRESENTATION WITH

MULTIPLE OFFERS

urchasing a home is a demanding task in any market. Today’s market presents additional challenges with a shortage of inventory and an abundance of cash buyers. Add the strong possibility of multiple offers and the situation moves from difficult to overwhelming! Preparing yourself and an offer to compete in a multiple offer situation is critical to buying the home you want.

First, you must decide if you want to make an offer. With the current lack of inventory and interest rates on the rise, the time to buy is now. Each time a property sells, a new comparable is created to substantiate the next listing at an equal or greater price. Better to write your best offer and get in front of this now, rather than later when prices may be more. Before writing an offer, there is much information to be gathered. Your agent’s level of communication with the listing agent is extremely important - you want to make sure you have the answer to some important questions. • Is there a date and time set for offers to be presented? If so, the listing agent has a duty to disclose the number of offers being presented. • Does the listing agent have an offer of their own? This may create a conflict of interest and may necessitate their manager’s involvement. • Has the seller and listing agent agreed to a variable rate commission? If the listing agent has agreed to reduce their commission if they represent a buyer, this should be disclosed to your agent in the MLS and to the buyer. • Are there terms most appealing to the seller? A quick or long close of escrow, an as-is clause, no contingencies or a rent back may be just a few considerations. • If all owners of record are at the presentation, will a response be forthcoming today? This is good information to know in case there are concerns about additional offers surfacing during your negotiations. Another important question centers around pre-emptive offers. A pre-emptive offer is one presented prior to the date and time set to hear offers or prior to any exposure of the property on the market. • Is the seller committed to the date and time set to hear offers or would they entertain an offer before then? Regardless, it is important to write your offer as soon as possible and let the listing agent know it is ready to present. When preparing an offer, rely on the experience and expertise of your agent. He or she can determine how best to accommodate as many of the seller’s needs as possible without compromising your own. Some of the following topics will help guide you through that discussion. Making a first impression; You have one opportunity. Alienating the seller will hurt you and create success for your competition. Terms vs. price; Price will always be a primary concern for a seller. No matter what price you offer, make your terms clean and desirable. Selection of a lender; Undervaluing the importance of a local, reputable and experienced lender will ensure your failure. Shopping for a lender and obtaining a preapproval letter is advisable prior to making an offer. Ask the listing agent if they are familiar with your lender. Ask your lender to call the listing agent before the offer is presented to answer any questions about your ability to obtain a loan. Verification of funds; Provide proof of the amount and whether your funds are liquid.

Contingent vs. Non-contingent; You will need to discuss this with your agent. Both options involve risk. Educating yourself on the property; Read the inspections and disclosures meticulously and more than once. Ask your agent for help with any concerns. As is; This term may be desirable to the seller, but be sure you are familiar with the condition of the property and are willing to accept it without hesitation. Close of escrow; Be familiar with the needs of the seller and the possibility of a rent back. Rent back; The seller may need to retain possession after the close of escrow. Providing the rent back free of charge may create an advantage for you. Now that your offer is written, the seller will consider options on how it will be presented. It is important to have a strategy for any type of presentation. The most desired presentation for a buyer is one where their agent is face to face with the listing agent and seller. This gives your agent an opportunity to convey your message to the seller and answer any questions about you or your offer. It also provides more transparency to buyers and their agents, often minimizing potential back room deals in the listing office. Other options could involve your agent presenting or faxing your offer to the listing agent who would in turn present your offer to the seller. If your agent is unable to present your offer directly to the seller, you may enclose your offer in a sealed envelope with instructions outlined on the outside of the envelope specifying when and where your offer should be opened and presented. It’s always preferable that the offer be opened and presented in front of the seller. This will help keep your offer confidential. With multiple offers being equal or close, an organized presentation may mean the difference between success and failure. A listing agent and seller will evaluate the content of your offer and the presentation, organizational skills and knowledge of your agent. Providing copies of all pertinent documents for each person at the presentation and preparing information about you for the sellers to review will inform the seller about who is purchasing their home and the intended use. Accompanying your agent to the presentation will convey a high level of commitment and may accommodate a quick acceptance or change to your offer. Be sure you are aware of your financial limitations if the seller counters your offer. The seller will have numerous options available when responding to multiple offers — from rejecting them all to countering more than one offer creating additional competition, or simply selecting one. This process can be emotional, so prepare by discussing the different possibilities with your agent in advance. Finally, what constitutes an accepted offer? Your offer will be deemed accepted when the listing agent delivers to your agent, or to you, an offer than has been fully signed by the seller(s). Unless and until the signed offer is delivered to you, there is no acceptance. To prevent another offer from being accepted in the interim, it is wise to receive the accepted offer as quickly as possible. Every market has challenges and opportunities. This market is no different. With a good agent, a lot of knowledge and a little luck, you will achieve success even if there are multiple offers!

Computer Security

ohn Wondolowski, Chief Technology Officer, CMI – An Information Technology Solutions and Services Company headquartered in Mill Valley, California. We have recently experienced two very strong and very widespread cyber-attacks. In May, the WannaCry ransomware attack infected more than 200,000 victims and more than 300,000 computers. At the end of June, the Petya cyber-attack looked to be a copycat of WannaCry by demanding a ransom to unencrypt the computer user’s files. Security Researchers however believe that the ransomware

was a decoy and that the targets suffered more malicious results. These attacks are covered by every news outlet, as will future attacks, and as a result our attention is now much more focused on how to protect ourselves. At a minimum, you should consider adopting the following actions and behaviors to lower your risk profile. It is inarguable that there will be future attacks and that your computer, your home security system, your television, and even your car are at risk. That sounds scary but rather than be scared let’s focus on lowering our risk profile.


STOP USING THE SAME PASSWORD The world has gotten more complicated and we are supposed to make our passwords complex and then we are supposed to remember them. Your logon to your home computer, your logon to your company’s network, your Amazon password, your Netflix password, your email password, your password to your bank’s portal, are all only a small part of the passwords that you need to generate and remember. The most widespread practice is to create one or two or three passwords that you consider strong and reuse them. The average person in California will have more than 12 passwords that they need to remember. But you cannot control or protect against an event where your school’s system or your bank’s system or your insurance company’s system is breached and your logon and password are stolen. When that happens, your credentials are sold on the Dark Web and the buyers then use those to login to your more lucrative accounts. You could have your Facebook credentials breached and stolen and sold to any number of bad guys. Those bad guys will try your credentials on many other sites – even your company, or your bank, or your 401k account. If you reuse your login name and password you have a high-risk profile of being breached.

GET A PASSWORD MANAGER Password managers are great because you store all your passwords, generate strong ones for you, and in general, the only password you need to remember is the one to open your password manager. Most password managers save and generate secure passwords for you, meaning you only have to remember one password – the one that opens your vault. Many password managers automatically log you in to multiple authentication pages. Fortunately, there is a wide choice of password manager software utilities. Some great free ones and some great low-cost options. Just put the term password manager into your search engine and scan the options.

STOP WHAT YOU ARE DOING RIGHT NOW AND BACK UP YOUR DATA There are also great options for backing up your computer’s data. Choose one of those options right now and start backing up your data – daily. That way if you were attacked you could simply restore from the backup data rather than pay the ransom or deal with an infected computer. Options range from web-based cloud services to buying your own personal cloud that is not ‘mapped’ on your computer and protected by a firewall to the outside. If you are backing your data up to a secondary storage device that is connected to your computer (mapped) then it is likely that secondary storage device will be compromised by the same attack and your risk profile would not be significantly lowered. There are free options, low cost options, and other options that offer significantly more functionality and other excellent features. But, stop what you are doing and start backing up your data now.

BE ON THE GUARD FOR PHISHING AND SPEAR PHISHING ATTACKS Open your email with the same caution you use to open your front door late at night. You need to know who sent you the email and have an idea as to why it was sent. If you do not know for sure then do not click to open an attachment and do not click on any web links. If for some reason your fingers were faster than your cautionary brain, then stop – do not enter any information in a web form – and then after exiting click on your anti-virus protection software and run an immediate full scan. Phishing is simply an email campaign that attempts to get you to click on an attachment or link that will download malware to your computer. Spear Phishing attacks are more personalized emails that attempt to coerce you into providing personal information (ideally, they want your credentials).

RESIST THE CONVENIENCE OF PUBLIC FREE WIFI For your security, it is simply not worth the convenience to use Public WIFI. Your risk profile increases significantly every time you connect to Public WIFI in the coffee shop, restaurant, hotel, etc. Not only can bad guys broadcast a connection that looks like Public WIFI and capture your data, they can also put themselves in the middle of your Internet sessions and capture your keystrokes.

REMEMBER THE BASICS Use reputable antivirus software and a firewall. Maintaining a strong firewall and keeping your security software up to date is critical. Regularly download and update your computer and software programs with all critical security patches that the vendor supplies. Make sure automatic updates are enabled and that they are happening.
