What exactly is new urbanism? The answer will depend on whom you ask. What is accepted is that new urbanism promotes environmentally-friendly communities by creating walkable neighbourhoods containing a wide range of housing and job types, sporting facilities, libraries and community centres, with architecture that builds a sense of community. One example is the Angus Glen Community in Markham, built by Kylemore Communities under the leadership of Patrick O’Hanlon. Inside this issue of Condo Life, you can read the conversation I recently had with O’Hanlon about new urbanism. He is so dedicated to the concept that he is working with San Francisco-based Peter Calthorpe — a founding member of the Congress for New Urbanism — on a 47-hectare development called Langstaff Gateway, situated on brownfield lands north of Highway 407 between Yonge Street and Bayview Avenue. True to the new urbanism concepts, Langstaff Gateway will include a mix of housing types — stacked townhomes, six- to eightstorey midrise buildings and residential towers up to 50 storeys — as well as employment lands and access to three major public transit corridors — GO, TTC and York Region Transit/VIVA. Also, the new Highway 407 Transitway will move people to Pearson airport. Another project on the drawing board for Kylemore is the redevelopment of the lands of the York Downs golf course, which will almost promote new urbanism. Chatting with the charming O’Hanlon is always a pleasure, and listening to his enthusiasm and watching his Irish eyes smile when discussing these exciting projects makes an otherwise average day extraordinary.

BUYING A CONDO WITH A GROUP OF FRIENDS With real estate prices hitting record highs, many first time homebuyers might be wondering how they’re going to get their foot into the market.
For some solo ownership is simply out of reach. To mitigate costs of their first home many are now looking to co-purchase properties they would be unable to afford on their own. In this case, up to four people buy a property together and split all the costs.

As you can imagine, breaking up a co-owner of the home over something trivial like parking will not be that easy. Real estate lawyer Leclair says there should be a comprehensive maintenance agreement between the two parties that would detail how unexpected expenses will be dealt with. He also recommends setting up an emergency fund that both parties contribute to equally.
Trendy way to borrow Co-mortgages are nothing new but have become more popular lately. Some financial institutions are now launching products that are specifically aimed at this group of people eager to find a way to buy their first home. With condo prices up in major cities across the country, this could be a viable option for many first time homebuyers. But, before you start hunting for that perfect place to buy with your buddies, there are many factors to consider in a co-mortgage situation.
Ability to borrow more Something to consider. If you plan to keep this home as an investment and later borrow more for a second home, beware that your credit worthiness will be based on the entire mortgage. In a co-mortgage situation all borrowers are 100 per cent liable for the mortgage, regardless of how much equity stake they have. This can mean the bank offers you a smaller second mortgage then you expected.
Plan for the worst Seek legal advice Many of us only talk to a real estate lawyer once we have found the house we want and put in the offer. Real estate lawyer Ray Leclair is with LAWPRO, and he says anyone thinking of buying a house should seek legal counsel first, and this is especially true in the case of a co-mortgage. Leclair says in a co-mortgage homebuyer’s should “plan for the divorce because you’re getting into a business arrangement together and there is a certainty that it will end.” Leclair says it should be clear how long each owner intends to own the house and how the sale of the house would work.
Everyday bills Similar to when you rent, some are going to have a better bedroom or an ensuite bathroom. Some of the owners might have a car and need access to the driveway while others take their bike or walk.

In a co-borrowers agreement the home title would most likely be tenants in common, rather than the more common joint tenancy. With tenants in common if one owner was to die the share of their home would become part of their estate. Each owner should have a will drawn up that clearly states what would happen in the event they were no longer there. It should detail who would be managing that estate and who would inherit their share of the property. These details should be shared with the other co-owners so they know what to expect. Make sure your real estate lawyer explains how the ownership agreement will work. Buying a home is a big financial commitment. Make sure the people you are buying with realize this and are taking the purchase seriously. Also choose co-borrowers who share your financial values; this will help make your experience buying with friends a bigger success. CL

OUTDATED ZONING BYLAWS ACT AS BARRIERS TO INTENSIFICATION Zoning bylaws control the use of land in a community. While official plans set out a municipality’s general policies for future land use, zoning by-laws put those plans into effect. They regulate how land can be used, determine what types of buildings can be built, and control the size, height and location of new developments. These bylaws are administered by municipalities and vary by neighbourhood. All new development applications must conform to the zoning bylaws of the area to get approval. Unfortunately many municipalities across the GTA are operating with badly outdated zoning bylaws that don’t align with provincial policies. Ontario’s growth policies mandate intensification in much of the GTA, such as the development of high-rise or mid-rise condominiums and stacked townhomes in urban areas and near transit stations. However the zoning bylaws for many of the urban areas and the areas around transit stations have not been updated to reflect the desire for higher density development. North York is a good example of an area with out-of-date zoning. Much of North York is covered by zoning bylaws that were developed in the 1950s and that only allow for the development of single family detached homes, including areas along and adjacent to the Yonge and Sheppard subway lines. The extent of outdated zoning bylaws was recently brought to light when a local planner made a map that broke down residential zoning in the City of Toronto. It showed that more than half of the City is zoned for single-family detached homes. As well, areas on and around subway lines, such as the majority of land around Yonge Street north of Eglinton, were zoned for low density development when as per the Growth Plan they should be used for transitoriented high-rise communities. Needless to say, the map garnered interest from local media and lots of discussion on social media.
Outdated zoning bylaws in municipalities across the GTA are contributing to our worsening housing supply shortage, further eroding choice for new home buyers and ultimately adding to the price growth of new homes.

Antiquated zoning creates unrealistic public expectations of land use, particularly when it comes to height and density. Community opposition to intensification is a growing challenge in the GTA, and outdated zoning bylaws play a significant role. Explaining to residents that the stacked townhome development proposed for their neighbourhood is in accordance with planning policy would be a lot easier if the area wasn’t zoned for detached homes. Out-of-date zoning makes the already long approval process even longer and contributes significantly to delays in bringing projects to market, which results in additional costs for new-home buyers. A couple of recent studies quantified the effect of development delays. Earlier this year the Fraser Institute found that development approvals in the GTA are delayed by an average of 18 months and play a significant role in rapidly decreasing housing supply. An earlier study by the Ontario Association of Architects found that each month that a project is delayed ends up costing the purchaser $2,375. That’s an extra $28,500 per home if the development is delayed by one year. Municipalities are required to review their official plans every five years and update their zoning bylaws no later than three years after a revision. It’s time for the Province to start enforcing this rule so that zoning bylaws can be used can be an effective tool for implementing provincial intensification policy and help deliver the development that is needed to house our growing population. ILLEGAL BUILDING – WHY IT MATTERS! There are all kinds of fraudulent schemes, but one that may not get as much attention as it should is the illegal building of new homes. Certainly, it affects consumers and registered builders alike. So, it’s no surprise that when I am out at events speaking with Ontario consumers or new home builders, the subject regularly comes up as a topic of conversation. What is illegal building? And why is it important that we work to stop it? First of all, for consumers, it can mean that their new home is being built by someone who does not actually have the financial or technical expertise to build new homes. It can also mean that the home is poorly built and does not meet Ontario’s Building Code specifications. It may even be a hazard to live in. The buyer or property owner may also encounter unexpected liability issues during the construction of an illegally built home, especially if an on-site accident happens during construction. And the buyer may not be aware of their rights or responsibilities under the statutory new home warranty once the home is completed. Illegal building also contributes to the underground economy. So, for the majority of good registered builders, the practice can create unfair competition. Since many illegally built homes are eligible for warranty protection under the legislation, registered builders effectively subsidize the warranty on these homes. Illegal building can also have a negative effect on the reputation of the industry overall. One challenge we face in combatting illegal building is that not every new home buyer knows that all builders, by law, must be

registered with Tarion and that they have an obligation to provide the new home warranty. Consumers who aren’t aware of this can be deceived by stories of the warranty being optional or too expensive. An illegal builder, meanwhile, may want to avoid the accountability and warranty obligations that come with building a new home. They may also be trying to avoid municipal building code inspections or workplace health and safety legislation. They are gambling that no one will report them to Tarion. Not the homebuyer, neighbours, municipal building departments, subtrades, suppliers or other registered builders. That is why we work closely with everyone in our industry to raise public awareness about this issue and to create confidence in our new home marketplace. Tarion’s ability to combat illegal building depends in part on purchasers and others in the community reporting suspicious activity. Here are some red flags that may suggest your builder is operating illegally: • They say they built the home for themselves, but then decided to sell it; • They say you don’t need a Tarion warranty because they offer their own; • They give you an inflated cost for the Tarion warranty — the maximum cost is $1,500; and, • They give you a short contract to sign; or worse, no contract at all. In short, illegal building affects everyone. It can create liability risks for the purchaser, impact the building industry, including its reputation, and prevent the homeowner from understanding their warranty rights and responsibilities. That’s why illegal building matters.

In excess of 2,000 people pre-registered for the condo. Plaza also invited residents of two high-end rental buildings in the neighbourhood to a special event to inform them about the buying opportunities available. Yonge-Eglinton provides easy access to the subway and the new Crosstown LRT line … not to mention an impressive array of shops, restaurants, offices, schools and parks. Plaza knows from feedback gathered from its buyers that subway access is a priority for them, along with the advantages that come with living in walkable neighbourhoods.

Plaza keeps closely in tune with market trends and has demonstrated its ability to be ahead of the curve. “One thing we’ve seen in the last two projects is that large suites are selling and that’s refreshing,” says McLellan. Plaza’s generously designed two-bedroom suites were an immediate hit with buyers and those plans will be offered at Plaza Midtown, along with one bedroom-plus-den and three-bedroom units. Many of the two-bedroom plans (710 to 740 square feet) are on corners or in wide-shallow configurations and the threebedroom suites are a spacious 825 to 900 square feet in size. The townhouses offer an option for those that need even more space. “When you take a look at the Yonge-Eglinton neighbourhood, a semi-detached home that needs renovating is priced at more than $1.2 million,” says McLellan. “Or you can buy a brand new 825-square-foot new condo for $660,000. “Affordable ownership of a single family home is becoming more and more challenging,” he adds. “It’s going to continue to be a driver of the condo market. In fact, 99 per cent of all new construction in the 416 is condos.” At two Plaza projects currently being occupied, Muse at Adelaide and Bathurst, and Epic between Queen and Lisgard across from the Drake Hotel, most buyers have been end users, not investors, which speaks volumes about the shift to condos because of affordability, says McLellan. Two more Plaza projects coming later to market this year or early next continue the company’s mandate to deliver buildings in Toronto’s most sought-after neighbourhoods. One is a 12-storey mid-rise building with approximately 200 units at 170 Spadina, just north of Queen St., at the crux of the hip and happening Entertainment and Fashion Districts. The other will be another mid-rise building near Jane and Bloor, in vibrant Bloor West Village with its lively mix of shops, eateries and services. What these projects have in common is accessibility to transit and high Walk Scores. As much as it is committed to excellence in design and creating residential buildings in the best transit-oriented locations in the city, Plaza is equally committed to excellence in customer service. Menkes Developments unveiled a public art installation in downtown Toronto featuring a stencil attributed to the anonymous British artist Banksy, referred to as “Guard with Balloon Dog.” Designed in the stenciled approach to graffiti art associated with works by Banksy, the piece was originally The Banksy piece, applied to the rear facade of the vacant building previously situated at 90 Harbour Street in May 2010, when comprised of three Banksy visited Toronto following the release of his film, Exit Through the Gift Shop. PATRICK O’HANLON Kylemore Communities is celebrating its 20th anniversary BY GALE BEEBY
Eight years ago, I had the pleasure of meeting the indomitable Patrick O’Hanlon for the first time over lunch at Auberge du Pommier, a sophisticated restaurant that specializes in fine French cuisine. He ordered the “grilled cheese sandwich.”
It was the beginning of a beautiful friendship. O’Hanlon is never one to mince words; he speaks his mind and that is a quality that I — although not all — appreciate. It’s the Irish in him. Born in Dublin and raised in Toronto, O’Hanlon has a degree in urban planning from Ryerson University. Following school he went to work for the Region of Peel and then moved on to Bramalea Ltd., which at the time was one of the largest building and developments companies in the GTA. “Working at Bramalea was a good training ground,” O’Hanlon told me. “I didn’t speak for the first five years. Yes, really,” he assured while acknowledging my scepticism. “I was a human sponge and I just listened and learned.” From there, O’Hanlon joined Gordon Stollery in Angus Glen Development, and then founded Kylemore Communities with Stollery and Frank Spaziani. “It’s that word ‘quality’ again,” said O’Hanlon. “I couldn’t have done better for partners than Gordon and Frank.” The Angus Glen master-planned community, which follows new urbanism planning principles and which began in 1997 with highend homes around the 36-hole championship golf course of the same name, has now expanded to over 1,400 residences, including The Brownstones, a collection of townhomes along the south course, and The 6th, a midrise condo building also overlooking the south course, home to the 2015 Pan Am Games golf tournament. Today, O’Hanlon and Spaziani work alongside the next generation of the Stollery family, represented by Cailey and Lindsay, to bring Gordon Stollery’s vision for Angus Glen to fruition. Angus Glen Community, which includes The Shoppes of Angus Glen within walking distance of most of the homes and where Kylemore is now headquartered, won the prestigious Places to Grow Community of the Year award from the Building Industry and Land Development Association in 2013.

Q: Who would you consider a mentor? A: David Ptak, who was vice president of Bramalea’s Residential Group when I worked there. Working for Bramalea gave me a strong foundation. What I learned most from David were the words “quality, quality, quality” — not just in the context of building materials or workmanship but also the quality of the people you work with and the people you count as friends and business partners. I couldn’t have done better for partners than Gordon and Frank. Q: What’s on the drawing board for the future? A: We’ve got two really big exciting projects coming: the redevelopment of the York Downs Golf and Country Club and Langstaff Gateway, which is a huge mixed-use development.

Q: Let’s talk about York Downs first. What is the plan and the timeline? A: It’s still currently being used as a golf course, but we purchased the 400 acres for $412 million. Our initial plan submitted to the City of Markham has 2,400 homes in a new urbanism style like Angus Glen. This is a joint venture partnership with Angus Glen, Kylemore, and Minto Communities. The new parks, green spaces and schools will be positioned so that they can be conveniently accessed by the wider community. However, there is still a lot of work to be done before we can bring the full plan forward. Q: Now, Langstaff Gateway. I remember you talking about this the first day I met you, eight years ago. A: Oh yea, it’s really exciting! And I’m very enthusiastic about working with Peter Calthorpe, an urban planner who is a champion of new urbanism and walkable cities. Langstaff Gateway — located south of Highway 407 and east of Yonge Street — is just industrial land now, but the vision is to build a massive live/work/play master-planned community designed by Calthorpe. He calls it the most transit-oriented site he has ever worked on. Actually, it really is a literal gateway to everywhere in the GTA

and beyond. It’s at the intersection of three main public transit lines: GO, the TTC subway, York Region transit and VIVA rapid transit services. As well, Highway 407 and Highway 7 are right there and the new 407 Transitway will move people quickly to Pearson airport. Transit is just one of the key principles of new urbanism that are being applied to the 47-hectare site. Peter’s preliminary plan also calls for all residential, business and retail building to be within walking distance of each other and we’ll probably integrate “people movers” into the site. It will be the densest new project in North America. We’re proposing to build stacked townhomes, six- to eight-storey midrise buildings, and residential towers up to 50 storeys. Q: Tell me about how Kylemore gives back to the communities it builds. A: I believe in the importance of strong communities, where people can live and work and grow together. As a company, we have a policy of social responsibility and are involved in a number of initiatives that create positive impacts on our local residents. To that end, we created Kylemore Kares and we host several events throughout the year to raise money for local charities. These include our annual Kylemore Kares Charity Golf tournament, the Kylmore Hockey With Heart tournament and our annual holiday toy drive, to name a few. Q: What do you do for fun? A: I become a real Canadian, lace up some skates and play hockey. My position is goon. I’m the nicest guy in the world until I step out on the ice. Then I become Patrick O’Hooligan. I also golf — I’m pretty good — and can often be found kicking a soccer ball. CL

FINDING THE SWEET SPOT BY SUSAN FERRIGAMO Maybe they plan to downsize from a detached home and move into it, eventually. Maybe they have a teenager that will be ready to leave the family home in a few years and live independently. Maybe they prefer to let the property value increase over the years, and enjoy the monthly cash flow from the rental income it generates. Regardless of the reasons, they likely have the same thing in mind: How to make their suite stand out against the rest in the competitive rental market, in the most cost effective way. Let’s start with the basics. Anyone renting a condo suite will want to be sure it is clean. If the Standard floor finishing is carpet, in the bedrooms or elsewhere, do consider changing it to a solid surface such as laminate or engineered wood flooring. You will be thankful years down the road when it still looks pristine.
It’s no secret that a large number of the condo units sold in the GTA every year are purchased by investors.

Does the Builder offer window coverings? If so, it is a great idea to take this option. Otherwise, consider what a month of rental income will cost you by doing it yourself after occupancy. Many of us reside in what is considered a “small space.” Whether we are urbanites, condo dwellers or empty-nesters who have down-sized, we find that our square footage is at a premium.

Here are a few tips to keep in mind: • Set a realistic budget. As a designer I often find some believe that since the bathroom is a small area it will not cost a lot to renovate. On the contrary, once you start looking at all the options available to you today, whether in tile, fixtures or storage, you might be surprised at what is out there and how much it can cost. Do some investigating to see what the best options are for you, and look to working with a designer to maximize your bathroom design options. • When shopping for tile don’t be swayed into believing that because your room is small you must stay with a small-scaled tile. In fact, a simple large–scaled tile can produce a much simpler look in your bathroom. Also, tiles is a great way to add personality and charm to your design, so mix it up a bit and consider adding some pattern to your space. • Valuable dollars are often lost on incorrect purchases or poor scheduling; be wise when renovating and look for assistance from professionals to not only be efficient with your designs but your dollars.
