MOBILIZING CANADIAN COMPASSION TO END HOMELESSNESS
our Unnatural Disaster - Homelessness in Canada We have come together as compassionate Canadians on several occasions over the past twelve months. We opened our hearts, homes and communities to thousands of Syrian families seeking refuge from a devastating civil war. We also opened our hearts and wallets to contribute over $165,000,000 to the Red Cross to help fellow Canadians rebuild their homes and lives after wildfires destroyed most of Fort McMurray. We are, in fact, very good at ‘disaster relief.’ When faced with a disaster, Canadians act. We seize ideas, find untapped strengths. We use what we have and become resourceful. We don’t wait for a perfect plan. We don’t seek permission. In the face of disaster, we rise up and take a stand, reflecting a spirit that ‘we’re in this together’, that if a member of our family or a guest in our house is in trouble, we’re all in trouble. Unfortunately, we have yet to ‘rise up’ to address the unnatural disaster of homelessness that afflicts over 235,000 Canadians every year. Somehow we’ve grown accustomed to seeing fellow Canadians sleeping ‘rough’ on the street. We walk around. We step over. We look the other way.

Today, with ‘The 20,000 Homes Campaign’, we have an opportunity to look homelessness in the eye, and to put an end to an every day disaster that has been swept under our collective carpets for decades.
Today, this formidable grass roots campaign is unfolding across the country, a campaign that isn’t simply about counting the number of homeless people. It is about getting to know each and every person by name and understanding each personal story. It is then about wrapping our arms around every person with the support needed to make the difficult transition from street to home.
The incredibly successful ‘100,000 Homes Campaign’ south of the border demonstrated that fulsome community engagement works, that chronic homelessness CAN be eliminated. This campaign has clearly shown that the ‘key’ to success is NOT about adding shelter beds to an already challenged system. It is, rather, about a ‘key’ to a front door, a place to call home, a safe and private place to re-group with support from new friends, neighbours and health care workers from the local community. ‘The 20,000 Homes Campaign’ is building on the success achieved in the United States, and is currently unfolding in 36 communities across the country. The campaign’s manifesto tells it as it is, calling homelessness ‘a national emergency requiring urgent and immediate action.’ It goes on to say that ‘The time has come to stop managing homelessness, and start ending it.’ If we’ve given any thought at all to chronic homelessness, we’ve probably concluded that this is a problem for government to solve, that we don’t have a role to play. The reality is that we do have a role, and that we all have something meaningful to contribute. There is no doubt that government funding is needed, but the path to ending chronic homelessness is a shared path, with every one of us walking hand in hand to the finish line. We’ve shown the ‘best of our love’ to our new Syrian friends, and have tapped a deep well of compassion in the face of many emergencies and natural disasters over the years. It is time to show the same depth of compassion for thousands of homeless Canadians who need our help. It is indeed time to end homelessness in our communities.

Although it is an old cliché, it is true: It is the season for giving. The holidays seem to make us incredibly grateful for all the wonderful things we have in our lives — family, friends, home, Canada — and also brings to mind those less fortunate than ourselves. (I could mention our American cousins and their new president here, but I think I’ll pass.) There are any number of great ways to spread the joy (and your cash) during the holiday period. There are a great number of charities that do great work and they deserve our time and attention. Giving money to a worthwhile cause is always a great thing, and I give to my favourite charities throughout the year. But I also try to get my “hands dirty” — I believe that giving time is more important (and harder) than signing a cheque. For example, you could volunteer at a homeless shelter on Christmas day (or any day of the year), pack gift boxes for the Santa Claus Fund, commit to working on a Habitat for Humanity build site, offer your expertise to Make-A-Wish Canada and help an ill child fulfill a dream, help out at your local community centre, or volunteer with Big Brothers or Big Sisters. Because I have worked around the building and development industry for 10 years, I find myself favouring groups that work on shelter issues, like Raising The Roof and Habitat for Humanity. Children’s issues are always at the front of my mind, too, which is why I fundraise for Make-A-Wish Canada. Mental health issues are also important to me so I support the Centre for Addiction and Mental Health (CAMH) as well as Hats On For Awareness. So, I challenge you during this festive period to find time to make a difference. After all, many hands make light work.

THE GTA GROWS UP, NOT OUT, AND OUR NEIGHBOURHOODS ARE CHANGING Many communities across They are developing by growing the GTA are changing. up and not out as mandated by
provincial policy. However, many of the people in those existing communities don’t want change because they like their neighbourhoods the way they are. As a result, there is more opposition than ever to development projects. Not-in-my-backyard sentiments or NIMBYism is not new, but today it’s stronger because Toronto and the rest of the GTA are intensifying. The growing chants of NIMBY affect more than just developers. They are problematic for all of us, especially new home buyers, as they add to the GTA’s housing supply shortage, creating delays and additional costs which are ultimately passed on to the people buying new homes. Developers don’t just build what they want and where they want it. There are numerous government policies and plans at all levels that dictate where and how development happens. When the Ontario government introduced the Greenbelt and Growth Plan 10 years ago, it changed how development happens in the GTA. The plan mandated that 40 per cent of all new homes be built within existing communities to house our rising population, which grows by about 100,000 people each year. In accordance with this policy, our industry now builds as many high-rise condos as single family homes. However, there is little public understanding and even less support for intensification. When these policies were first introduced, our industry encouraged the government to educate residents about how and why their
neighbourhoods will change, but to no effect. “Not in My Backyard” can be heard on everything from condos near subway stations to townhomes projects in Scarborough to semis in Burlington. Developers are now increasing their efforts in working with community stakeholders by engaging residents earlier and working together to create projects that benefit everyone. By communicating with residents in the early stages of the development process, community stakeholders can properly respond to the proposed changes. It’s important to help them understand the goals and benefits of intensification and specific projects. New development and neighbourhood renewal can help our communities thrive, which is something we all want. Bringing more homes and housing choices can bring new life to established neighbourhoods. With more people come more amenities like shops and restaurants. All this leads to higher property values and means local governments collect more property taxes, which they can invest in things like parks and transit. The GTA continues to grow, it attracts people and businesses. We need to build new housing to accommodate this growth, and work together to create thriving complete communities. It’s time to turn NIMBY to YIMBY and say ‘yes-in-my-backyard.’ BILD recently create a couple of animated videos on NIMBYism to raise public awareness of this important issue. FINDING THE SOURCE OF A CONDO LEAK ISN’T ALWAYS A CUT AND DRIED ISSUE It’s one of the worst You come home to your unit after a long day at work and you feelings you can want to unwind, only to find a experience as a puddle of water in your kitchen. condominium owner. You can’t relax after all. Instead, you have a leak to investigate. The first question you’d like answered is: Where did the water come from? Well, don’t automatically assume the leak originated from the unit directly above yours. Just as excessive noise sources are difficult to trace, leaks can be too. Usually, leaks emanate from somewhere in your own unit or from the unit directly above yours. Not always, though, and this was illustrated in a recent legal case in Toronto — Roa vs. TSCC-1764. As pointed out in a tweet by Denise Lash of the Lash Condo Law firm in Toronto, a condo unit owner sued his condominium corporation after the corporation registered a lien against his unit (suite 602) for non-payment of repair costs relating to a leak in the unit below (suite 502). The corporation took the position that the unit owner was responsible for these repair costs as he failed to properly maintain his unit and, in particular, the ensuite shower in the unit. “The owner of suite 602 was away approximately eight months a year since he purchased the unit from the developer about four years earlier, and as a result, he made limited use of the showers in the unit,” Lash explains. “The leaks in suite 502 continued after caulking and silicone applications in suite 602 (which was recommended by the corporation’s plumbers) and even after the owner of suite 602 stopped using the ensuite shower. The plumbers hired by the condominium corporation indicated that on two visits they could not find any leak emanating from suite 602, and did not

produce any report detailing the source of the leak and how it was stopped. “The Small Claims Court found that the owner of unit 602 was not liable for the repair costs relating to the leak in suite 502 as the corporation did not provide any “unambiguous and straightforward” evidence as to the source of leak. In arriving at this decision, the judge noted that the parking garage, the gym and other units in the building also experienced leaks.” Lash reports that the plaintiff unit owner was awarded damages in the amount of $5,958 consisting of the lien amount, the amount paid to the corporation’s plumbers, the plaintiff ’s legal costs relating to the lien, and $1,500 for inconvenience. The unit owner also received $1,800 for costs and disbursements for the two-day trial. “Whenever there is a leak that causes damage to the common elements and/or other units,” Lash says, “management and the board should be checking the condominium declaration and by-laws to determine if there are provisions in the documents that assign responsibility for payment of damages caused by the leak.” That’s not all, though. Lash cautions that a thorough investigation needs to be conducted to determine the cause of the leak, and condo management should obtain a written report from a plumber or other independent qualified professional that clearly spells out the cause of the leak. Don’t let leaks dilute your condominium experience. Face the reality that, at one point or another, they could very well happen in your unit. Be aware that water can be damaging almost anywhere. Be prepared, though. Know how to deal with the issue. Have insurance. Get legal assistance, if need be. Most of all, though, be sure to ascertain who is responsible for the leak and where the actual source of the leak is. CL

MEETING NEW HOMEBUYER EXPECTATIONS If so, we want to hear from you! Every year, Tarion sends out a customer satisfaction survey to new home and condominium owners in their first year of possession. The survey, which will land in mailboxes in the next week or so, asks them about key aspects of the buying experience, including the Agreement of Purchase and Sale, the construction stage, the Pre-Delivery Inspection and the customer service the builder provided after the sale closed. It also asks new condo owners to rate their condo builder. And we include questions about their relationship with Tarion and whether we met their expectations. Why is this important to us? Because we want to better understand first-hand the experiences of new home buyers in the province, which includes the condo-buying experience. We want to know if that new condo and the builder met expectations and what improvements could be made along the way, whether it be for individual homes, condo units or a condo’s common elements. This happens in two ways. First, the responses and comments help us understand what Tarion does well and where improvements to our processes or communications materials can deliver better customer service. This consumer input helps identify general trends and also specific areas for focus. For example, past years’ feedback has led to new features being added to MyHome, our digital web service that helps homeowners manage their warranty online. Second, we use this consumer feedback to assess how well new

home builders, including condo and high-rise builders, are serving their customers. The survey, which is now offered in Mandarin, Farsi and Punjabi, asks about the relationship with builders. Did the buying experience go smoothly? If there were issues with the condo after move in, did the builder listen to concerns and fix any warranted issues? The survey results also help builders improve their customer service. Where we have enough responses, builders are given detailed individual reports comparing their results to the provincial average (without identifying the participants). We then follow-up with these builders to help analyze their scores and to improve on them. This survey feedback is also critical to us in another important way. Every year, it determines which builders are the finalists and recipients of the Homeowners’ Choice Awards, as chosen by their customers. Presented by Tarion, these are the only awards that give Ontario’s new home buyers the power to have their new home builder recognized for customer service excellence. These awards are useful for future new home buyers doing research about a builder. When a builder becomes a finalist or a recipient of the award, that information is put on their record in the Ontario Builder Directory (on Tarion.com) for everyone to see. So, that’s why we want to hear from you! If you’ve taken possession of a new home or condo in the past year, please look out for the Tarion survey that will arrive this month by email or mail. It only takes a few minutes to complete. Your answers will help improve customer service overall for new home and condo owners across Ontario. NEW MORTGAGE RULES: WHAT YOU NEED TO KNOW New mortgage rules announced in October by the Federal Government are making it harder for some condo buyers to afford their new home.
The rule changes impact anyone taking out an insured mortgage. If you’re out shopping for a condo right now, especially if you’re a first time homebuyer, how much you can borrow is going to be reduced. Here’s what you need to know.
Stress test As of October 17th insured mortgages must pass a “stress test,” in order to prove borrowers can make their payments even if rates were to rise. Lenders have to make sure the borrower qualifies at the Bank of Canada posted fixed rate. This rate is almost always higher than the banks posted rates. According to the Department of Finance, to qualify for mortgage insurance, a homebuyer must have a GDS* ratio no greater than 39 per cent and a TDS* ratio no greater than 44 per cent. Qualifying using this test proves homebuyers have a buffer and would be able to continue servicing their debts even in a higher interest rate environment, or if faced with a reduction in household income.
Tighter terms Insured mortgages will also be subject to stricter terms, even those that are not high ratio. As of November 30th, insured mortgages must only be for the purpose of purchasing a property that the borrower will live in. The loan has to be amortized to a maximum of 25 years and the purchase price cannot be more than one million dollars. Credit scores will also play a role; anyone with a score less than 600 will no longer qualify for insured mortgage.
Reduced borrowing The tighter terms and the stress test means new homebuyers seeking an insured mortgage will qualify for a smaller mortgage. Therefore, many may have to lower their expectation of the kind of condo they have thought of buying. This can mean less square footage, fewer amenities or a location further away, all in order to find a home that fits within your borrowing limits.
Closing loopholes Along with creating new rules to keep Canadians from borrowing outside of their limits, the Government also wants to “improve tax fairness.” When you sell your primary residence it’s not subject to

capital gains taxation. Starting now the sale of any property will have to be reported to the Canada Revenue Agency during tax time. This means anyone who owes capital gains tax will be immediately asked to pay it. This targets anyone selling a home that was not their primary residence.
Banks sharing the risk Currently all insured mortgages are backstopped by the taxpayer. The government wants lenders to share the risk of mortgages defaulting. They are starting the consultation process that could result in banks having to pay a deductible on defaulted mortgages they approved. Banks say this will lead to higher rates and smaller lenders criticize that this will squeeze them out of the market all together. First time homebuyers could be the biggest losers with these new rules. Generally speaking the amount you can afford to borrow will drop by as much as 25 per cent. It will mean they have to save more of a down payment to buy their first home or lower their expectation of the kind of home they are looking for. CL *DEFINITION OF TERMS: Gross Debt Service (GDS) ratio — the carrying costs of the home, including the mortgage payment and taxes and heating costs, relative to the homebuyer’s income Total Debt Service* (TDS) ratio — the carrying costs of the home and all other debt payments relative to the homebuyer’s income.

So Epic Condos, a 20-storey boutique condo building across from the celebrated Drake Hotel, will surprise and delight. It’s already built — so no waiting years to move in — and a handful of suites are still available at extremely competitive prices. While first time buyers will find the price tag of the smaller suites very attractive — 585-square-foot one-bedroom plus den at $343,900 — families will be bowled over by the value offered in the 1,080-square-foot three-bedrooms,which are priced at $589,900. The fabulous amenities, including a fully equipped gym, guest suites, rooftop patio with barbecue area as well as theatre and lounge areas, are ideal for entertaining or simply relaxing. It’s obvious by the number of strollers that downtown is fast becoming a magnet for young families. Not surprising considering the amount on offer — museums, parks, the lake shore, celebrations and festivals, good schools, and great grocery shopping choices. But the constant challenge for families is size and affordability of housing — lowrise homes are usually out of reach and condos in the price range just don’t offer the amount or kind of space they need. In recent years, however, the city of Toronto has advocated for more choice, and developers have been responding. Developer Plaza, for example, intentionally included several three-bedroom suites at Epic. The layouts are well-designed to offer ample room for children, and the $589,900 (or $562 per square foot) price tag is an extra incentive for moving downtown so your kids can take advantage of all the city has to offer. And there’s another perk — those three-bedroom suites are penthouses on the top floor with great views. Scott McLellan, senior vice president for Plazacorp, says the aim with Epic was to offer suites as affordable as possible. That’s one reason why the price includes all closing costs, except land transfer and legal fees. “The other is we thought it would make it easier for an end user to have everything included,” he says. While prices alone offer plenty of incentive, the condos also offer a good array of features, such as granite counters, stainless steel appliances, stacked washer and dryer, and laminated hardwood flooring. Ten of those suites on sale are furnished models, adds McLellan. The biggest feature, of course, is the location. It’s part of the whole evolution of the Queen West area, which is now hopping with good restaurants, artisan and fashion boutiques, very close to Trinity Bellwoods Park, and within easy access to public transit,

the island airport ferry, the Gardiner and the QEW. Affordable housing is an elusive goal in large cities. And while it feels like Toronto is just out of reach, it’s a relatively inexpensive city compared to others, when looking at price to income. According to a National Bank of Canada survey that looked at 970 square foot condos in 18 global markets, the price in London UK was 33.6 times the average income, while Toronto’s condos come in as one of the most affordable at 9.4 times the income. Even so, Epic is one of the most affordable options in Toronto, especially for families. Several suites remain in a variety of sizes and configurations, ranging from 585 to 1,080 square foot, priced from $343,900 to $589,900, with an average square foot price of $590. CL

Is this the ultimate Toronto love story? Ishac and Tania got married, walked into a sales centre the next day and bought a condo before leaving on their honeymoon. It’s a true urban fairy tale. The sun shone down as autumn leaves framed the Sales Centre of Affinity Condominiums for the grand opening of this new community in the rediscovered neighbourhood of Aldershot in Burlington. The crowd grew excited as Rosehaven Homes’ pre-construction manager, Joseph Durante, took to the podium to introduce the six-storey condominium that will comprise two buildings, each with its own set of amenities including terraces, gyms, party rooms, bike storage and more. Silvio Guglietti of Rosehaven Homes, spoke to the audience of how proud they felt to bring this new building to the area. Menkes Charity Golf Classic at the Lionhead Golf Club in Brampton was the 18th annual event hosted by Menkes Developments. Always well attended by family, friends, employees and sponsors, the tournament has continued to be a success. This year, Menkes had even more to celebrate. A NEW HOME OR CONDOMINIUM A GREAT WAY TO KICK OFF THE NEW YEAR The lights are dimming earlier these days as the proverbial fall back in time has just occurred.
That means its darker earlier, and many of us start thinking about the seasonal shut down of all things commerce and otherwise. Having said that, the numbers don’t lie and early in the new year we’ll hear about more record high numbers in new home and condominium purchasing. Some of the new projects were sold out before anyone had a chance to blink an eye. As some recent foreign visitors of mine to our great city said after touring some neighbourhoods with me, Canada is still very much ‘on sale.’ Pricing remains competitive; it has to. The choices remain great and the bar just keeps rising. There may be a few great new opportunities at the end of the year, but look for possible good inventory specials in the market. Sales are in the air. Everyone likes a holiday special. Builders offer it; consumers jump on it. The new year brings more great hope and what should be an assortment of new products in great locations inside and outside of the GTA. New taxation policies in Vancouver, particularly, are making Toronto an even better bet than ever before. I am writing this article on the ‘morning after’ – the morning after Hilary was ‘trumped’ by the Donald. The pundits think that will add more cache to our country from a real estate perspective; Toronto remaining the focal point. Those same pundits say as well that new, tighter mortgage regulations will help ensure that we stay in a good place, and that buyers don’t overextend, and builders should be responsible in ensuring that we continue to provide products that

work for our consumers. In short, year 23 in our seven-year cycle looks like a good one and a responsible one. A recent study conducted by the Canadian Housing Industry suggested that the OECD’s economic growth forecast showed Canada as having one of the healthiest growth forecasts in terms of GDP growth of any country in the world. Two notable exceptions were China and India, two countries whose residents have taken a comfortable place in our great city and are helping to fuel our buoyant market. Most importantly, while watching out for rising house prices, there is a strong movement to ensure that housing remains accessible to young and new Canadians alike. This just means more good news for consumers. And with the holidays in the air, there are lots of good reasons to celebrate and find yourself that new home that you always wanted. CL

Inspirations from the mid-century modern era continues forward this year and is accompanied by a retro revival in furniture design from the ’60s and ’70s. Modern meets classic in 2017, creating for us easy yet well-appointed living spaces. Transparency in materials and finishes this year is notable. Whether we are working with Lucite and glass or soft flowy sheers, many of our finishes evoke a softness and easiness in design. Another great trend for 2017 is texture. Be it great lush fabrics like velvets and natural linens, which you will find from Alendel Fabrics, or rough-hewn barn board, faux furs and metals, texture is everywhere this year, adding to our desire to create relaxed homes that still evoke a feeling of luxury. Rich jewel tones are still trending this year but are now warmer and more muted; again playing on adding a richness and luxury to our designs. As popular as the deep, rich muted tones are, we are also seeing softer, more romantic palettes that add a hint of colour to an easy neutral environment. This year ahead is not about perfect, shiny finishes. In fact, it’s quite the opposite. Warm matte black continues its popularity, beautiful polished concrete that exudes texture and warmth is notable and great coloured metals are being seen in an abundance of applications. 2017 is all about creating a home for ourselves that is cozy yet luxurious, current yet classic. As our spaces are becoming more and more integrated attention still needs to be given to the fluidity and functionality needed for day-to-day living. When thinking about the direction for your home for this coming year remember, ultimately what is on trend is creating a living space that is warm, comfortable and relaxing for everyday living and easy entertaining.
