BUILDING CITIES AND CREATING JOBS The industry is one of the largest employers in our region. Building and renovating involves a number of different professionals all working together. Last year alone, more than 196,000 people were employed in a wide variety of on-site and off-site jobs. In addition to builders, developers and a wide range of tradespeople, the industry employs everyone from urban planners and lawyers to marketers and designers and dozens more. In fact, each of those construction cranes you see across the city represent up to 500 jobs. As the GTA continues to grow by up to 100,000 people every year, so does its need for new homes. That means opportunities for people looking at careers in building, development or renovation. These careers include office work, jobs on construction sites, positions in sales offices and in many other well-paying professions. In 2015, people who work in the industry collectively earned $11.4 billion in wages. The Building Industry and Land Development Association (BILD) represents all facets of the industry and our 1,450 member companies include more than just builders and developers. Some of our members manufacture and supply the materials used to build homes, some plan and prepare the site for development, and others assist purchasers in the homebuying process. These are just a few examples of all the people involved in building great cities. Each year, BILD holds a number of award programs to recognize excellence in the industry. One of them is our Associate Awards, which recognize members for their quality of service, professionalism, leadership and innovation when working with builders or renovators. What makes this award program special is that nominees are evaluated by their clients as opposed to a panel of judges.

The building, development and renovation industry builds homes and cities and that creates jobs and provides employment for thousands of GTA residents.

A NEW HOME IS A MILESTONE EVENT Purchasing a condominium or new home is one of the most significant investments you will make in your lifetime.

Moving in to your new place is a milestone event — one you look forward to with excitement and anticipation. Occasionally, however, it is an event that requires some patience. Sometimes construction of a new condominium can be delayed for reasons beyond a builder’s control, and this can create uncertainty and stress for both the buyer and the builder. Some Ontario builders and purchasers are faced with this situation right now. Last May, a strike by five different unionized construction trades — frame, trim, drywall, tile and electrical — went on strike. The labour disruption created a dramatic slowdown in home building in various parts of the province. In some cases, construction ground to a complete halt. The strikes are now over, but their effects are not. Some builders are still having difficulty completing homes according to agreed-upon timelines because they have faced unexpected challenges in getting construction capacity back up to pre-strike levels — challenges that stem from ripple effects of the strike. Trades who were not on strike were also affected by the labour disruption because they were unable to work until construction sites returned to normal operation. In addition, the supply chain for materials for new construction in the province was seriously impacted. Some suppliers were forced to lay off staff during the strikes and then found it difficult to ramp up deliveries of materials because these laid-off staff found new employment elsewhere.

In fact, the sheer scope of the strikes’ continuing impact on the delivery of finished new homes and condominiums is unparalleled in Ontario. As a result, occupancy dates set out on the Agreements of Purchase and Sale may no longer be realistic because homes are simply not ready for move-in. For a new condo owner, this means that their milestone plans to move in to their new home may have to be delayed for a while. For builders, the delay affects their core business of building and selling condominiums and homes. Faced with the unprecedented nature of this situation, new condo buyers should review their Agreements of Purchase and Sale and Tarion.com to understand both their contractual and their warranty rights. At the same time, we strongly encourage purchasers and builders to work together to find mutually agreeable solutions to these delays. No one likes to put plans on hold. Purchasers are eager to start this new chapter in their lives, and builders have financial and reputational reasons to ensure their customers move into their new homes as fast as circumstances allow. Keep in mind that Tarion backstops what is in fact the builder’s warranty. The great majority of purchasers in Ontario enjoy a positive and productive relationship with their builder. That’s why we feel it is important – for the mutual benefit of purchasers and builders – to communicate openly and find common ground on how to manage these delayed closings. This will help preserve the quality of this important relationship going forward. FIXED RATE MORTGAGE PENALTIES What some Canadian homeowners with a closed mortgage may be unaware of is the high cost to break it before the term is up. Many times homebuyers do their due diligence by shopping around for the best rate to save money, but fail to look at what penalties would have to paid if they tried to get out of that agreement. If you’re condo hunting this busy season, and concerned about the costs of breaking your current mortgage, here’s what you need to know.

Unlike riskier floating rate mortgages, where the interest you pay to borrow money can change, fixed rate loans comes with a guarantee of what that loan will cost you for the term.

How closed mortgages work Also called fixed mortgages, closed mortgages come with a fixed cost of borrowing for a fixed term. The mortgage agreement is a contract with the bank that the borrower agrees to keep to. If the borrower decides to pay that mortgage off before the term is up or break the mortgage for a better rate somewhere else, they will have to pay what is called an interest rate differential or IRD. This is the money the bank will no longer receive from you the borrower because you decided to end the agreement early.

How the penalty is determined According to the Financial consumer Agency of Canada the prepayment charge for a closed, fixed-rate mortgage is usually the greater of three months’ interest on the outstanding balance of your mortgage, or IRD. That is an amount based on the difference

between two interest rates. The first is the interest rate for your existing mortgage term. The second is today’s interest rate for a term that is similar in length to the time remaining on your existing term. For example, if you have three years left on a five-year term, your lender would use the interest rate it is currently offering for a three-year term to determine the second rate for comparison in the calculation.

Calculating IRD Mortgage holders can use a number of online calculators to figure out what their penalty or IRD would be if they wanted to break their mortgage agreement before the maturity date. If interest rates have gone down since you signed your agreement the IRD can be very high. This is because it is based on the amount you are paying and the difference in the interest you fixed with the bank and the interest rate that the lender can charge today when re-lending the funds for the remaining term of the mortgage. If rates have gone up the penalty may be more affordable.

Other charges to be aware of Mortgage holders often receive a fixed rate that might be better than the posted rate. This is often referred to as a posted rate. If you choose to break that mortgage early, the bank may calculate your IRD at that higher rate before the discount. There is little mortgages holders can do about this as there is no uniform system among lenders about this or regulation by the Bank Act. Best advice when getting a mortgage is ask how the penalty is calculated. If the bank bases it on the non-discount rate, then this mortgage may not be the right one for you. CL

These recommendations come from firsthand experience that I’ve encountered with my clients over the years, and I hope they help you in the moving process. Good luck!

Check in with the seller Before the moving process begins, you may have questions about your new home and the sellers are most likely the best people to fill you in on some of the questions I’ve posed below, and they’ll also be able to leave behind important information and documents, including manuals and servicing records for appliances and utilities.

Update your information One of the first things you might want to do is update your information. Change your address to avoid missing any bills or important pieces of mail. Book an installation appointment with your cable, phone and Internet providers to avoid any interruptions in your service. Once you inherit the keys, don’t forget to ask for the keys to be labeled, it will help with not having to guess which key is for what, or you may want to change the locks just for ease and added peace of mind.

Get to know your home

Learn where to locate the shut off valve, hoses, window screens etc. Inherited an alarm system? Learn the code and how to arm and disarm it. Find out how to maintain a pool or hot tub, and don’t forget to check when garbage day is. After all, you’re going to have a lot of stuff you’ll need to get rid of. If you have pets, check the fence lines at your new home to make sure they’re secure.

Capitalize on an empty space After the sellers move out, you have an empty space to capitalize on. You may want to take advantage and give the place a thorough cleaning, or measure all rooms to ensure that your furniture can fit (don’t forget to measure the doorways!). This might also be the perfect time to undergo any renovation projects you had in mind. From applying a fresh coat of paint, to installing hardwood, or undergoing a full kitchen makeover, you may not find a better time to accomplish these tasks. DAVID HIRSH Seeing potential where others see problems defines Brandy Lane’s mission to transform developed urban areas into thriving communities BY GALE BEEBY

David Hirsh has an imaginative mind that lets him see the possibilities of transforming urban blight to urban delight.

“Thinking creatively really does work,” Hirsh, 58, said over lunch in an Italian restaurant near his home in North York. “In fact, our business depends on it. For over a quarter of a century we’ve pushed the envelope to design new residential products.” Hirsh, who grew up in Downsview, initially wanted to be a doctor, a dream that was never fulfilled, mainly because his family couldn’t afford the high cost of a university education. “Now I’m a builder with a cure for urban blight,” he says with a self-deprecating laugh. It’s hard not to like David Hirsh. His mission to bring new urban life to older areas can been seen in his company’s many developments, including Loggia on The Queensway, Liberty Walk in North York and The Station at Wilson Road and The Allen. Village Mews, located at Rogers Road and Kane Avenue, certainly exemplifies Hirsh’s desire to create affordable infill projects in existing neighbourhoods. Brandy Lane’s most recent project, The Davies, is a luxury 36-suite condominium with eight penthouses at Avenue Road and Cottingham, overlooking Robertson Davies Park. “We constantly strive to find innovative ways to deliver top quality and build homes and amenities that ring true to our clients’ needs,” Hirsch said. “For instance, our communities in Collingwood appeal to active enthusiasts who want to enjoy year-round activities. It’s for that very reason that we incorporated features such as an outdoor heated pool, community trails and a skating rink that doubles as a landscaped area during the warmer months.” Hirsch explains that he sees every new community as an opportunity to create more than just a condo tower or a tract of new home. “We recognize and embrace the fact that our neighbourhoods have a snowball effect on future homeowners’ lives as the impetus for ongoing growth in an area. The key to our success is understanding how changing demographics and homeowner needs affect what we do, and responding accordingly.”

Condo Life: Tell me a little bit about your background, where you grew up and went to school. I’ve read your adoptive parents wanted you to be a doctor. How did you come to work in the development industry? David Hirsh: I grew up in North York, well, Downsview to be exact, at Keele and Wilson. I was adopted by Holocaust survivors who taught me a lot about life. I was raised to be successful, and that’s what drives me. As a kid my parents were relatively poor. My father was a carpenter and my mom stayed at home. They were ordinary people. But as a kid I was always daydreaming about how I would renovate the homes we lived in. I loved the old neighbourhood where I grew up. My friends and

I used to bowl at the old York Bowl. Funny how life turns out because we tore York Bowl down in order to build The Station. After high school I bought a haberdashery franchise. But it wasn’t for me so I went and got my real estate license and started as a resale agent but it didn’t go so well; incredibly high interest rates put a real damper on the market. I think I sold one house. In 1992, I went to work for Great Gulf as a sales rep and then I moved to Senator Homes as their sales manager. But I always need new challenges, and in 1986 I was asked to become a partner in a new company, Brandy Lane. I was so ambitious and aggressive as a young man (there is a little laugh following this statement). Brandy Lane expanded rapidly and we were building an average of 200 homes a year CL: What have been the strongest influences in your professional life? When you entered the industry, did you have someone you would consider a mentor? DH: Certainly my current partners, Zan Stern and Bill Glied; we’ve had a 30-year partnership. They changed my life because they saw my ambition and recognized my abilities. And they’re more than just partners; they’re my friends, my family. A true mentor to me is Angelo Breda from Senator Homes. I still channel him sometimes. I learned a lot from him. He was a great man, a real builder, a carpenter by trade who knew the business from top to bottom. CL: Because of your history as both a lowrise and highrise builder, you’ve seen a lot of changes in the industry over the years. How has Brandy Lane changed with the province’s initiatives?

CL: What has made you the proudest? DH: Loggia on The Queensway. It was the first project built under the guidelines of the City of Toronto’s Avenues and Midrise Buildings initiatives, which wanted more intensification along the city’s arterial roads, or “Avenues.” We faced a lengthy planning process but we were able to go with what the city wanted. Loggia is two midrise buildings joined by a floating podium with amenity space. Loggia made me very happy for two reasons: an end user bought every single unit — it sold slowly but steadily — and it won an urban design award from the City of Toronto. CL: What is your pet peeve? Development charges, the Greenbelt, Places to Grow, transit issues? DH: I’m pretty optimistic. I am supportive of density and I would like to see easier accessibility to transit. I just wish everybody would stop arguing about it and just do it. And that dovetails into development charges. I don’t mind them but they should be tied to transit. If the transit issues were addressed and helped, the market would work better. CL: What do you do for fun? DH: I love to explore the city; I take walks and go to the theatre and restaurants. I love to cook and entertain as well. It’s a very nice life. My friends are my family. I’m also a student of architecture and urbanism. I don’t consider myself a workaholic because I love it, I love real estate. I put a piece of me into each project. CL

DH: In 1985, we were a different group at Brandy Lane. But in 1997 it changed dramatically. I wanted to move the company from building subdivisions to urban infill projects, unique products emphasizing urban intensification. We wanted to change an area and create a new lifestyle for the purchasers. There was a parting of ways with some of the partners who didn’t agree with this approach. So now, the words we live by are re-urbanization and intensification; we build mostly condos, midrise and highrise, as well as townhomes. But infill renewal is not just for urban areas. We are very involved in introducing an urban form not previously built in Collingwood, which offers fabulous amenities and an opportunity for people to enjoy the incredible four-season lifestyle there. For some, a chalet or detached house isn’t always an option, and there is a better way. We’re building small buildings with condo units priced from $180,000. It’s a carefree lifestyle in a compact urban form. The city of Collingwood has been very easy to work with. CL: With the province’s Places to Grow policy and the Greenbelt restrictions, where do you see the real estate and housing market in 20 years? DH: The provincial guidelines demand compact urban growth and that is not a bad thing. I like what’s going on in GTA and I’m not wound up about the Greenbelt or Places to Grow. I believe in urban life. This is world-class city, a city of neighbourhoods, and the demographics are changing. As a population, we are moving away from the suburban lifestyle because of urban sprawl and the commute times. People don’t want to spend two to three hours a day in their cars, and young people certainly prefer city life. What we’re doing is finding sites with the potential to become great neighbourhoods, choice locations that have become neglected.

The Martin Goodman Trail is right around the corner, too. P27 still has some luxury suites available, and if Toronto’s resale condo market is any indication, where two-bedroom units are getting multiple offers, they won’t be available for long. THERE IS A CONDO IN YOUR FUTURE! If you are an empty-nester and/or retiree, you likely agree. Baby boomers are aging and retiring at unprecedented rates. For many, single-level living with no exterior and common area maintenance seems like a great way to accommodate their current needs. This market has long been attracted to condos for those reasons. Urban professionals who live there have a quicker work commute, and some may even be able to walk to their place of employment. Single women and families also thrive on the knowledge that condo living is relatively safe, as there are security measures built in, along with having the concierge there to keep track of who is entering and leaving the building. Families are grateful that Toronto and the GTA have good school systems, and every municipality is dotted with natural areas such as lush parks. Even in the heart of Toronto, you can walk your dog and take the kids to the park to play. Consider, too that some parents are buying condo suites for their grown children to live in while attending university, and then selling them at a profit later on. Investors have taken to condos as part of their financial portfolios and contribute to the need for rental options in the city. The demand is so strong, that condominiums will be extremely desirable for years to come. I may not be a fortune-teller, but after many years in the industry, I feel confident saying that whatever your life circumstances at the moment, there is probably a condo in your future. CL

Kylemore Communities’ Annual Holiday Party for trades, consultants and colleagues kicked-off the season in high style. The Markham-based luxury homebuilder and developer hosted the get-together to thank its building partners for their contribution to another successful year. Guests were asked to bring a new toy to help brighten the holidays for Markham families. For a fifth consecutive year, the toys collected were donated to the Christmas Food and Toy Drive organized by Unionville Alliance Church (UAC) and partner churches, which in turn distribute hampers to area families. “Helping others is what unites a community and strengthens our ties to each other,” said Kylemore president Patrick O’Hanlon, who is well known for his philanthropy and charitable work. Shen Yun brings essence of traditional Chinese culture to life through classical Chinese dance

When Zhuge Liang was given just 10 days to produce 100,000 arrows for battle, it was the year 208 in ancient China, when no machines existed that could help the great military strategist produce so much ammunition in such a short time. But Zhuge Liang, revered as the “embodiment of wisdom” in traditional Chinese culture, had no trouble accomplishing this incredible feat. Indeed, his uncommon wisdom told him he needed only three days, with the help of some large boats and a small army of men. How he succeeded is a fascinating tale among the many cherished myths and legends passed down through the Middle Kingdom’s 5,000 years of history and culture. It made for a captivating performance of classical Chinese dance against a striking animated backdrop presented by Shen Yun Performing Arts as part of its 2015 global tour. This timeless story, from the Chinese classic historical novel “Romance of the Three Kingdoms,” is just one of many that have been vividly brought to life by New York-based Shen Yun, the world’s premier classical Chinese dance and music company, since its establishment in 2006.

A life-and-death challenge Along with the richly expressive power of classical Chinese dance, Shen Yun’s innovative digital backdrop charmed theatregoers with its animated setting of the banks of the mighty Yangtze River where the story took place. Converged there, some 1,800 years ago, were the great armies of the three rival states at the time. On the river’s south were the 50,000-strong forces of reluctant allies the Shu and the Wu. North of the Yangtze was the massive Wei army, totalling 800,000 troops. Zhuge Liang, the brilliant chief strategist of the Shu, had enemies in the Wu camp who wanted to bring him down. They challenged him to get 100,000 arrows ready for war in just 10 days. To their shock, with utter calm and confidence he told them that he really needed only three days. He even agreed to sign a pledge that would see his execution should he fail. How he prevailed with ease was masterfully depicted through the Shen Yun dancers’ seamless interaction with the action backdrop, which transported theatregoers back in time amid the developments of the amazing story. In the early morning of the third day, a heavy fog was blanketing the river when Zhuge Liang commanded his fleet to sail toward the enemy’s bank while his soldiers pounded their battle

drums. Panicked and blinded by fog, Wei archers fired endless volleys of arrows in the direction of the thunderous sound. But instead of bodies of live men, those arrows lodged in the trunks of figures made of straw—fashioned to capture the sought-after ammunition as well as hide the soldier-drummers in the boats. It was a spectacular presentation of a success story loved by audience members young and old, as Zhuge Liang sailed home victorious with boats laden with arrows “borrowed” from his powerful foe.

Achieving the Tao — the Heavenly Way Sagas such as this one featured by Shen Yun every year not only display excellent artistry and sophisticated entertainment but also reflect the essence of China’s millennia-old culture. It is this essence rich with wisdom that Shen Yun performers seek to revive and embody through classical Chinese dance. This essence is characterized by moral values vital to human beings such as honesty and kindness, propriety and tolerance, and the concept of harmony between humanity and the universe. The latter refers to a deep respect toward heaven and earth and respectful relationships between people. The ancient Chinese believed that by cultivating their character to abide by these virtuous principles, they could gradually transcend the human realm to achieve the Tao, or the Heavenly Way. One would then become an enlightened being able to see and gain access to the full wisdom and truths of the universe. In the 100,000-arrows story, this harmony and wisdom can be seen well manifested in Zhuge Liang’s ingenuous plan and confidence that he needed just three days to achieve his goal. As an advanced cultivator of the Tao, he had the ability to see things others could not see and accomplish things ordinary people could not accomplish. With his supernormal capability he foresaw the favourable conditions of fog on the third day that became a critical factor for his success. Theatregoers can look forward to an all-new program in Shen Yun’s 2017 season featuring other beloved stories of wisdom that will not only entertain but also greatly inspire. CL
