Independent Finance’s general manager Sam Wani fills us in on the latest movements in mortgages Last month saw seven foreclosures happen in the Land Department. This is the highest number of foreclosures done in a month. Five of these were sold in the first round – and of these, three were sold at 30% higher than the reserve price. This is a real indication of a rising market. The fact that foreclosures are happening more frequently is a sign of the maturing of the legal process. The slow foreclosure process has been the biggest hurdle in the lending cycle. Banks make money from continuous lending, which
means they need liquidity. If they are sitting on repossessed property and are unable to liquidate it, the profit margins are lowered – which then means lower returns to the shareholders. One of the ways to mitigate this is to adopt strict lending terms, but we have all seen what a lack of lending flexibility does to property prices. Therefore, more foreclosures are a welcome sign. Land Department carries out between 500 and 800 real estate transactions in a month. Seven foreclosures in a month is a very small fraction, and
will hardly make any impact on property prices. With the number of transactions expected to rise in coming months, the market can easily absorb a larger number of foreclosures. More foreclosures will also open up the market for auctioneers and investors looking to invest in these high-return assets. With this, an important gap in the market will be filled. But we really don’t expect it to happen anytime soon as the numbers have to be much larger than seven a month. independentuae.com

The advantage of a Trust owning your property

Most people prefer not to think about what will happen to their property on death. However, failure to make proper plans can create real problems and cause great expense (including tax liabilities) for next of kin, problems that they will be forced to sort out at a time when they are emotionally upset and most vulnerable. Making a will is a sensible way for an individual to put his or her affairs in order. However, the administration of a deceased’s estate can be costly (often around 4% of the total value of the estate), result in long delays (normally at least one year, even for a simple estate) and very often involve a large tax bill (inheritance tax or estate duty rates are often extremely onerous). One alternative to making a will is to set up a Trust during one’s lifetime. With careful planning this can eradicate delays, costs and taxes and provide other benefits such as protecting assets from future creditors or providing anonymity. For many reasons the use of Trusts as a means of holding and passing on family wealth, even for modest estates, has increased dramatically in recent years.
What is a Trust? Unlike a company, a Trust is not a legal entity. It is best described as a relationship; an arrangement whereby property is transferred from one person (the Settlor) to another person (the Trustee) who holds the April 2012
property for the benefit of specified people or objects (the Beneficiaries). A Trust deed sets out the terms and conditions upon which the Trustees must hold and administer the Trust assets. The Trust deed also sets out the rights and interests of the beneficiaries. A Trust can also be created by a will but if assets are ‘transferred’ to Trustees during lifetime they should be unaffected by the subsequent death of the settlor. Another word for ‘transfer’ is ‘settle’; hence the transferor of the assets is called the Settlor and the Trust is often referred to as a ‘settlement’. Those unfamiliar with the Trust concept may be concerned about transferring ownership of their property to a Trustee. However, the duties of Trustees have been developed over centuries through English equity and common law and are now in many cases codified in statute law. This law distinguishes between legal ownership (Trust assets are held in the name of Trustees) and beneficial ownership (only the Beneficiaries may benefit from the assets). Further, even greater duties are imposed on professional Trustees who, in reputable and well-regulated jurisdictions such as Gibraltar, for example, are required to be licensed.
So what are the main advantages of a Trust? Trusts can be very useful means of tax

planning. They can be very flexible, even the Settlor can continue to benefit from the Trust assets, and have many other advantages, including:
in continental Europe and other civil law jurisdictions, as well as in countries of Islamic tradition. A Trust can be used to overcome forced heirship claims.

A portfolio of international property can be held under one single Trust. In some circumstances, depending on local laws, a ‘local company’ may be required to sit under the Trust (i.e. it’s common for a Jebel Ali Offshore company to hold Dubai property, and have a Trust acting as a shareholder of the company).
Many Settlors prefer to make complex arrangements for the distribution of their assets. They may wish to provide a source of income for a spouse or make provision for the education of children. A Trust is a very convenient and flexible method of making such arrangements.
2. Tax planning A properly-established Trust may produce substantial savings in income tax, capital gains tax and inheritance tax/estate duty.
There is no public register of Trusts or Trustees. The ownership of Trust assets can remain entirely confidential in most circumstances.
3. Preserving family assets

Preserving family assets against mismanagement or spendthrifts is a common motivation for establishing a Trust. An individual may wish to ensure that wealth accumulated over a lifetime is not dissipated or divided up but is preserved as one fund. The fund can then accumulate further with provision for payments to members of the family as necessary, preserving some assets for later generations.
A discretionary Trust can provide a structure that is capable of rapid change as circumstances demand.
4. Avoiding forced heirship Forced heirship is a particular problem

Where can I set up a Trust? Virtually all low tax or zero tax common law jurisdictions have some form of Trust law. Gibraltar is at the forefront of best practice development in the area of Trusts and was one of the first jurisdictions to introduce the regulation and supervision of Trust companies. Professional Trustees must be licensed under the Financial Services
Ordinance 1989 and are regulated by the Financial Services Commission (FSC). Gibraltar Trust law is derived from English common law and the rules of equity, supplemented by certain legislation. Gibraltar’s Trustee Ordinance is based on the Trustee Act 1893. ‘Asset protection Trusts’ are also permitted, although all Trusts provide some element of asset protection.

Why did you decide to set up home in this area? Pippa: We wanted space. The large house and spacious garden feel so open, and there are no high-rise buildings – you don’t feel closed in by anything. And the Triangle is different from many other villa developments too: we have our own plot, and are not attached to any other houses at all. Our money went much further here, as well – you get large rooms and a fair bit of outside space, and there’s a real feeling of privacy. Have many families moved into the neighbourhood? Pippa: Oh yes, there are lots – it’s a great area for people with small children because there’s no traffic and it’s really quiet. Kids can go cycling, play in the street – when we first moved in we even played cricket on the road because there was nobody else here. You just don’t get that in the city. We have a bit of garden fence chat, too – people often strike up conversations. When we first moved in we spoke to our neighbours about what they’d done with their gardens; people interact with each other here, and it was a great way to pick up tips. Having your own plot, are there any opportunities to extend the villa? Pippa: Yes – we’ll be able to build a third bedroom above the garage. The great thing about this area is that the house styles cater to different people and different needs. James: We love the downstairs living area – with all the doors open, you get

‘It’s liberating to have so much space... If you want a quiet life, it’s wonderful’ such a nice breeze through the house. There’s lots of light, and although it’s open-plan the archways between the dining room, lounge and kitchen areas make the spaces cosy. How would you define your interior décor style? Pippa: We couldn’t! We have quite an eclectic mixture of things... We like to bring pieces back from places we’ve travelled to – we’ve just come back from Nepal, and recently from Hong Kong and Vietnam. We have lots of picture frames throughout the house, and we make montages from all of our adventures – whenever we come back from somewhere we put one together, and they tell stories that really mean something to us. I think that might be the clue to our style, actually – we’ve furnished the house with things that are personal, and that have meaning to both of us.
Where’s your favourite local furniture shop for home buys? James: We’ve bought a lot of pieces from Pinky in Al Barsha – it’s great for wooden furniture with a bit of personality. Between there and Ikea we’ve been able to kit out most of the house; we haven’t spent a lot of money on furniture. Pippa: We were living in an unfurnished apartment in JBR before, so we brought some furniture with us, but to be honest we’ve replaced most of that now. For example, our original kitchen table was minute, and when we stuck it in the dining room here it looked ridiculous so we had to buy a bigger one. Most pieces were too small for the scale of this house, and we wanted nice bookcases and coffee tables to make the most of the space. Because we’re planning on staying here for a while, though, we haven’t felt the need to rush out and get everything at once – we can keep looking around until we find things that we really like. And what about the garden – where did you buy your plants? Pippa: From the Al Aweer plant souk behind Academic City – down the Emirates Road, towards the airport. It’s fantastic: cheap as chips, with lots of nurseries. It’s like having 50 small garden companies all together. There are lots of stalls, one after the other,
and you can get everything you need from there, even gravel, fencing and soil. You can buy plants and trees in all stages of growth – if we wanted to put in a really tall tree, we could buy it from there, and they could deliver it as well. The vendors are really knowledgeable, which is very handy: you can quiz them about the plants and learn about the care they need. James: We couldn’t believe how reasonable the costs for the garden were. For our patio, three big palm trees, the grass and all the plants and bougainvillea around the edge, the cost was AED10,500 – and that’s including the labour. So even if you’re going to rent, it won’t break the bank to put your own stamp on the garden – and if you’re buying, you can’t really go wrong. What should people be aware of if they’re looking to move to this area? James: The fact that it’s a new development can make it really difficult to find – you can struggle with taxis sometimes, and the signage round here needs a lot of work. If you’ve got people visiting from overseas or the city, they can be a bit daunted by these things, but they will improve over time. And if you rely on getting taxis or the Metro, this area really isn’t for you just yet. You really do need a car to pick up groceries, although we manage some days with bicycles. If we need a few things we just cycle to the garage – it’s perfect for getting the papers on a Saturday morning. Pippa: In the beginning we found it a bit too quiet – there was no white noise. When we lived in JBR we were used to street noise, cars, lots of people. Here the noisiest thing is birdsong! But we love it – it’s like being in the countryside. Lastly, what’s the best thing about living in Jumeirah Village Triangle? James: The freedom – it really is liberating to have so much space. I will quite happily potter around the house at the weekend – something that I just didn’t do in the JBR apartment. Of course, if you’re looking for a bit of life, places like JBR are great – we do sometimes miss the hustle and bustle of the city. But if you’re up for a quieter lifestyle, this place is wonderful. Pippa: We sometimes have whole weekends without leaving the house – it’s the best feeling in the world.

Your need-to-know guide to what’s in and around the area Renting and buying Expats are able to both buy and rent property in this new residential complex – and as villas are newly-built you’ll have a blank slate to put your mark on. As the area is under development, houses are still being constructed: a whopping 6,000 are planned. Take your pick from two- to four-bedroom villas and one- to two-bedroom town houses – there’s something for everybody. At present, much of the neighbourhood is quiet, but as the properties fill up you can expect a real community feel. Shared green spaces and pristine landscaping will make the area picture-perfect – and pedestrianised walkways will be perfect for strolling to the shops.
Shopping and a bite At the moment, the handiest haunt for groceries is Town Centre in The Springs, a 10-minute drive away from JVT. The complex has a large Spinneys April 2012
supermarket, where you’ll find everything for the weekly shop, as well as a plethora of cafés and eateries like Shakespeare & Co. (shakespeareandco.ae) and Copper Chimney (04 363 9948) for grabbing some lunch or a takeaway. For walkingdistance amenities you’ll have to wait a little longer, though: the planned retail complexes in Jumeriah Village Triangle will feature supermarkets, smaller convenience stores, and a number of restaurants. The Gardens Shopping Mall, a hub for groceries and services, will be right on your doorstep too – perfect for stocking up on supplies.
Leisure time In this growing development, you’ll be spoiled for choice once the leisure areas and community hubs are completed. Plans include a lake complex, salons, swimming pools, basketball courts, sports pitches and gyms – and local events such as concerts and markets. In the meantime, Dubai Marina is just a short
drive away for nightlife and amenities, and the JBR public beach is handy too. Head to Tips and Toes (tipsntoeshaven. com) at The Springs for spa treatments, or tee off at The Springs Hotel and Golf Club – excellent ways to wind down on the weekends.
Schooling The finished development will have schools for all ages – and as JVT predominantly features homes for families, you can be sure that the quality will be high. For now, the development’s proximity to the Emirates Road and surrounding residential hubs opens up easy-reach options for education. Dubai British School (dubaibritishschool.ae) is roughly two kilometres away, or try Dubai International Academy (diadubai.com). For growing tots, head to Chubby Cheeks Nursery (chubbycheeksnursery.com), and eco-friendly families will love the holistic approach to schooling at Home Grown Nursery (homegrownnursery.ae).

Make your house stand out from the crowd with a little insider know-how Create a blank canvas by removing knick-knacks and clutter. Visitors will want to imagine themselves in your house, and seeing your life laid before them may distract them from their vision. Be brutal: a few framed photographs will be enough to create a welcoming atmosphere, but anything else should be packed away in boxes. Think of it as a head-start on the moving process – and great preparation for the impending cleaning spree. Make your home sparkle – there’s nothing like grime to put a potential buyer off. And finally, if you use a maid’s room as a dumping ground, clear it out – show off its potential as an office or playroom, and let the viewers imagine how they’d use the space. Smart tables and chairs can add al fresco appeal, so if you’re planning to buy new furniture for your new house, buy it now and place it on display – and then reap the rewards. With many sellers moving overseas, properties may not be furnished during viewings. It’s worth hiring furniture if there is none – carefully-selected pieces will illustrate how the rooms can be used and make smaller properties feel more spacious. If you’re a landlord with property on the market, let your tenants know your plans to sell. It’s important to keep them in the loop to build their co-operation – you will need them to help keep areas clean and tidy. Establish some ground rules regarding viewings (for example, what time they will take place), and offer incentives such as a gardener or window cleaner in return for their help. Occupied properties are best viewed when nobody is at home so potential buyers can open cupboards and comment freely. Vacant properties should be viewed during daylight hours as DEWA has often been disonnected.

Denise McGinty, founder of expert cleaning company Housekeeping Co (housekeepingco. com), shares her secret tips for taking care of stubborn stains… Remove candle wax from wood by scraping off as much wax as possible by hand with a blunt knife edge. Then, cover it with greaseproof paper and use an iron on its lowest setting to smooth over the surface; the wax will adhere to paper. Finally, polish the area with goodquality furniture oil. Get rid of chewing gum by placing the affected item in the freezer for an hour. The gum will harden, so you can scrape it off with ease. Clean ingrained dust and sand from fabric with a powerful vacuum cleaner that uses water filtration. It’s amazing what comes out of mattresses, carpets and sofas! Remember to change the filter and bags regularly, and always empty the water after each use. Refresh leather sofas with a damp cloth – you’ll see any grime, dust and cigarette smoke residue come off on the material. Let the leather dry naturally, then massage in specialist oil on a microfibre cloth. This should be done twice a year. Revive woven garden furniture by vaccuming it, then washing with a water jet on a powerful setting. Bird droppings and bits of food can be a nightmare to remove – use a soft kitchen brush and warm soapy water to get into the crevices.

MURGH MALAI TIKKA Chicken tikka starter marinated in a subtle creamy marinade Serves 4 800g boneless chicken leg, diced 75ml fresh cream 120g cream cheese 5g ginger paste 10g garlic paste 40g clarified butter Juice of 3 limes 5g white pepper 3g aromatic spice powder ¼ sprig fenugreek Pinch of salt

1. You’ll need to make two marinades for this dish; for the first, combine the lime juice, ginger, garlic, salt, chicken and clarified butter. Cover, and set aside in the fridge for one hour. 2. While the flavours infuse, make the second marinade by mixing the cream cheese, cream, spice powder, fenugreek and white pepper in a bowl. 3. Remove the chicken from the first marinade and thread onto a metal skewer. Drizzle with the second marinade and place under a grill or tandoor at 300°C. Cook for 15 minutes, rotating regularly. 4. Serve immediately with a spicy tomato relish and naan bread, or warm khaboos (flat bread).

Better Food PALAK ANJEER KEBAB Spinach and fig patties Serves 4 1kg spinach 100g figs 200g channa dal (yellow lentils) 200g clarified butter 10g chopped fresh green chilis 50g milk powder 10g chopped ginger 5g chopped coriander 5g garam masala 3g mace powder Pinch of salt

1. In a large pan, boil the channa dal with the garam masala until tender, then drain. 2. Blanch the spinach in boiling water, drain, leave to cool, then purée into a fine paste. Sauté in a frying pan until dry. 3. In a separate pan, sauté the channa dal until dry. Combine with the clarified butter, milk powder, mace, coriander, ginger, chilis and figs, and add the puréed spinach. Form into palmsized patties and fry on a hot plate. Serve with fresh coriander.

milk • 500ml 2g saffron • 50g sugar • 1. Mix together the curd cheese and flour, and shape into small round balls (roughly 1cm in diameter). 2. Add the sugar to the water in a large
saucepan and simmer until the sugar has dissolved. Gently place the curd balls in the syrup and cook slowly for 15 minutes. 3. Combine the milk, saffron and sugar in a pan and simmer until the volume has reduced by half, then leave to cool. 4. Drain the curd balls and add them to the saffron mixture; chill thoroughly, and garnish with pistachio flakes.
