This globetrotting couple feel right at home in the vibrant community Words by Hazel Plush; images by Nasir Rauf
For Simon Nestel and his wife Shimi, DIFC is perfectly-placed for a life spent on the move. Travelling for business and pleasure for up to nine months of the year, the couple love the luxury development’s strategic location, and the Jumeirah Living World Trade Centre Residence has been their Middle East base for the past three years. “We lived upstairs in a duplex apartment for two and a half years, but we decided to downsize in April,” says Simon. “It’s great because when we’re away our staff can come and go as they please, and the Jumeirah management take care of any issues while we’re gone.” “We’re only 10-15 minutes from the airport,” says Shimi. “Living here really makes life easy. We feel like we’re in the heart of Dubai: Deira and Bur Dubai are just a few minutes away, and Dubai Marina is close by too.” The couple have a number of other properties all over the world, but they’ve clearly put a lot of care and attention in

to their Dubai base. The décor, brimming with character and detail, is full of talking points: “We have a very eclectic taste,” says Simon. “We are big art collectors, and we like to decorate to suit the space available. Paintings work perfectly because we can keep the walls blank and just pack up the artwork if we want to move on. We’ve also inherited many pieces that have travelled around the world with us.” One such item is a vast lion rug that has been in Shimi’s family since the 1960s. “The lion was shot legally when we lived in Kenya,” says Shimi. “It has become part of the family – all of us kids would play on it. There is so much history attached to it.” As for more conventional décor, the couple have taken to duplicating key pieces throughout their numerous homes. “We have multiple copies of photographs, music and movies in all of our houses,” says Simon. “It’s brilliant to be able to leave and not have to pack a suitcase. We do think of the apartment as home, but then we feel like that with the other properties too.”

Many of the couple’s travels are businessrelated, so the hotel facilities on their doorstep are vital. “We have great access to meeting rooms, and the hotel is great for entertaining clients,” says Shimi. The couple converted the apartment’s third bedroom into an airy office space – and, as we chat about their work, it’s clear that their business is a true passion. “Through our company we’ve recently taken on the Pay It Forward initiative in the UAE,” says Simon. “It’s a global concept of spreading good in the world, and we became involved because we wanted to work with the local community.” The couple are spreading the word through Pay It Forward bracelets – if you do a good deed for someone, you pass the bracelet on to them to encourage them to do the same – an idea that’s being snapped up by local businesses that are keen to incorporate it into their corporate social responsibility effort. When not hard at work or travelling, the couple like to make the most of life in Dubai. “We love to eat out, but we enjoy the low key eateries in Satwa and Karama as much as we do dressing up for highend dining,” says Shimi. “We love the old part of Dubai, and during the winter we take camping trips or head to the beach. There’s always something to do here.” “The international lifestyle suits us down to the ground,” continues Simon. “And it works both ways – because Dubai is on the way from Europe to India, visitors tend to stop over for a few days. It’s such an energising place to live, we couldn’t help but fall in love with it – and it seems that everyone else feels the same way!” November 2012

DIFC is a hub for luxury apartments: the high-rise development is brimming with top-quality accommodation. You won’t find any villas here, but that’s not to say there isn’t any variety: take your pick from studio and multi-bedroom apartments, with duplex options and spacious balconies aplenty. Expats are able to buy and rent in the area, and while this is still a prestigious place to live, prices aren’t as eye-watering as in previous years. The close proximity to key business buildings can reduce commuting time significantly, and the excellent links to Sheikh Zayed Road puts the rest of the city within easy reach too.
It’s not all about business in DIFC: there’s plenty to keep the whole family entertained, and lots of places to unwind at the weekend. The Ritz-Carlton Spa, DIFC offers a handy sanctuary away from the daily grind, and there are gyms and salons throughout the complex too. The vast neighbourhood of art galleries marks the city’s hub for all-things artistic; a leisurely stroll around the exhibitions will entertain even the choosiest of culture vultures. The DIFC Centre of Excellence is the home of a number of educational institutions, so if you feel like picking up a few new skills, you’ll have plenty of choice on your doorstep.
It’s for good reason that DIFC is renowned for its fine dining options: you’ll find glamorous eateries galore, including Japanese restaurant Zuma, juicy steaks at The Ritz-Carlton, DIFC’s Center Cut and fine grills with a spectacular view at At.mosphere (122 floors high in the Burj Khalifa). There are plenty of coffee shops and cafés too, although expect to jostle with caffeine-craving businessmen during the week. The main shopping areas boast everything from supermarkets to luxury boutiques – plus, interior design faves D.tales, The Rug Company and Andrew Martin in the Gate Village and Balcony retail sections.
Thanks to its great transport links, DIFC is within easy reach of a number of schools, including Dubai English Speaking School (dessdubai.com), Jumeirah English Speaking School (jess.sch.ae), English College Primary (englishcollege.ac.ae), Jumeirah Primary School (jumeirahprimaryschool.com) and Wellington Primary School (gemswps.com). Even closer to home, Hummingbird Early Learning Centre (hummingbird. ae) in the Balcony area is handily placed for little ones. The DIFC Centre of Excellence boasts a number of business schools to its name, and has an excellent reputation within the higher education network.

Dubai’s economy is expected to grow by 4.5% in 2012. Market confidence and employment prospects are encouraging people to buy their own homes. 90% of property purchases in the first half of 2012 was by end users. 60% of all transactions used bank financing. The average loan-to-value was 80%. These are extremely good signs that signify an end to the speculator market that plagued the UAE’s real-estate industry for so long. Villa and town houses have seen price rises of as much as 21%. Price rises for apartments have, however, been much lower. There are demand-supply issues in these segments, but the

fact that prices have risen in both areas proves that end users are entering the market in large numbers. This phenomenon will have two impacts. The first: the average time a home owner retains a single property before upgrading is seven years. This will provide long-term stability and reduce price volatility. The second: end users tend to have higher equity in their homes to reduce risk. Consequently, the risk factor to the lender reduces too. This will help to reduce the cost of funds and interest rates. The number of lenders that offer mortgages stands at 27. Latest entrants are Emirates NBD, Union National Bank, Aafaq,
National Bank of Abu Dhabi, CBI and Emirates Money. More are hoping to enter the market. We expect there to be 30 by the end of 2012. This is good news for customers. The number of lenders ensures healthy competition and choice for customers. We will also see niche providers targeting different segments of the market. Selfemployed people can now buy property in the name of their company and raise a mortgage in its name too. A few interest-only products have also launched, where the customer repays interest only and pays off the capital part of the loan at the end of the term. November 2012

“Death and Taxes”
The advantage of a trust owning your property
Making a will is a sensible way for an individual to put his or her affairs in order. However, the administration of a deceased’s estate can be costly (often around 4% of the total value of the estate), result in long delays (normally at least one year, even for a simple estate) and very often involve a large tax bill (inheritance tax or estate duty rates are often extremely onerous). One alternative to making a will is to set up a trust during one’s lifetime. With careful planning this can eradicate delays, costs and taxes and provide other benefits such as protecting assets from future creditors or providing anonymity. For many reasons the use of trusts as a means of holding and passing on family wealth, even for modest estates, has increased dramatically in recent years.
So whaT iS a TRUST? The concept: Unlike a company, a trust is not a legal entity. It is best described as a relationship; an arrangement whereby property is transferred from one person (the settlor) to another person (the trustee) who holds the property for the benefit of specified people or objects (the beneficiaries). A trust deed sets out the terms and conditions upon which the trustees must hold and administer the trust assets. The trust deed also sets out the rights and interests of the beneficiaries. A trust can also be created by a will but if assets are “transferred” to trustees during lifetime they should be unaffected by the subsequent death of the settlor. Another word for “transfer” is “settle”; hence the transferor of the assets is called the settlor and the trust is often referred to as a “settlement”. Those unfamiliar with the trust concept may be concerned about transferring ownership of their property to a trustee. November 2012
Most people prefer not to think about what will happen to their property on death. However, failure to make proper plans can create real problems and cause great expense (including tax liabilities) for next of kin, problems that they will be forced to sort out at a time when they are emotionally upset and most vulnerable
However, the duties of trustees have been developed over centuries through English equity and common law and are now in many cases codified in statute law. This law distinguishes between legal ownership (trust assets are held in the name of trustees) and beneficial ownership (only the beneficiaries may benefit from the assets). Further, even greater duties are imposed on professional trustees who, in reputable and well-regulated jurisdictions such as Gibraltar, for example, are required to be licensed.
wheRe can i SeT Up a TRUST? Virtually all low tax or zero tax common law jurisdictions have some form of trust law. Gibraltar is at the forefront of best practice development in the area of trusts and was one of the first jurisdictions to introduce the regulation and supervision of trust companies. Professional trustees must be licensed under the Financial Services Ordinance 1989 and are regulated by the Financial Services Commission (FSC). Gibraltar trust law is derived from English common law and the rules of equity, supplemented by certain legislation. Gibraltar’s Trustee Ordinance is based on the Trustee Act 1893. “Asset protection trusts” are also permitted although all trusts provide some element of asset protection.
confidentiality Regulations require trustees to know the identity of the settlor and ultimate beneficiaries of a trust. This information is kept completely confidential. Disclosure to third parties is only required in very particular circumstances and must be accompanied by a court order. In the case of asset protection trusts, the register maintained by the Registrar of Dispositions to record the transfer of assets to asset protection trusts is closed and its contents privileged.

Taxes The vast majority of Gibraltar trusts are set up as discretionary trusts so that beneficiaries only have a contingent interest. The beneficiaries can therefore avoid any tax liability until assets are distributed to them. Trust income is exempt from tax in Gibraltar if the trust is established by a non-resident, has no Gibraltar beneficiaries and derives no income locally (other than bank interest). The terms of the trust must expressly exclude Gibraltar residents from being beneficiaries.
asset protection trusts Asset protection trusts (APTs) are permitted in Gibraltar. These must be registered with the Register of Dispositions and require that: • • • •
the settlor is an individual the settlor is not insolvent at the time of the disposition the settlor does not become insolvent in consequence thereof the disposition is registered.
If these requirements are satisfied the disposition will not be voidable by any creditor of the settlor and the application of the Fraudulent Conveyances Act and the Bankruptcy Ordinance are excluded. Only professional trustees licensed by the FSC can act as trustees of APTs and an application fee of £300 is payable upon registering the trust and £100 is payable annually to maintain the registration.
So whaT aRe The main aDvanTageS of a TRUST? Trusts can be very useful means of tax planning. They can be very flexible, even the settlor can continue to benefit from the trust assets, and have many other advantages including:
asset protection All trusts provide some element of asset protection but specifically see APTs above.
Tax planning A properly established trust may produce substantial savings in income tax, capital gains tax and inheritance tax/estate duty.
deceased’s estate can be wound up and distributed can cause delay, expense, unwanted publicity and upheaval.
confidentiality There is no public register of trusts or trustees. The ownership of trust assets can remain entirely confidential in most circumstances.
avoiding forced heirship Forced heirship is a particular problem in continental Europe and other civil law jurisdictions, as well as in countries of Islamic tradition. A trust can be used to overcome forced heirship claims.
estate planning Many settlors prefer to make complex arrangements for the distribution of their assets. They may wish to provide a source of income for a spouse or make provision for the education of children. A trust is a very convenient and flexible method of making such arrangements.
protecting the weak A trust allows a person to provide for those who may be unable to manage their own affairs such as infant children, the aged or persons suffering from certain illnesses.
property holding A portfolio of international property can all be held under one single Trust. In some circumstances, depending on local laws, a “local company” may be required to sit under the trust (i.e. it’s common for a Jebel Ali Offshore company to hold Dubai property, and have a Trust acting as a shareholder of the company). preserving family assets Preserving family assets against mismanagement or spendthrifts is a common motivation for establishing a trust. An individual may wish to ensure that wealth accumulated over a lifetime is not dissipated or divided up but is preserved as one fund. The fund can then accumulate further with provision for payments to members of the family as necessary, preserving some assets for later generations.

If you’re tired of rooting through the vegetable aisle in your supermarket only to find battered produce imported from afar, you’re not alone. With the return of leisurely sunny days, your mind may revisit memories of farmers’ markets and freshly-picked goodies – a seasonal cook’s dream. It’s a reverie that Becky Balderstone experienced when she first arrived in the UAE: “The supermarkets here are full of imported produce with so many air miles, and I so missed the farmers’ market concept from the UK. After a little investigation, though, I realised that the UAE is home to so many beautiful farms – all of which are awash with fantastic produce.” The seed was planted, and Becky founded Ripe, a shop that provides local, seasonal, organic and fresh fruits and vegetables to the UAE community. But it didn’t end there. Last year, The Ripe Food and Craft Market made its debut, the realisation of Becky’s dream. For Becky, the pursuit of fresh produce is paramount: “We work with a number of farms, some of which are world-class and internationally-certified, and others that are very simple structures with local certification. We sell produce from Al Ain, Sharjah, Abu Dhabi and Liwa; the farm owners are very skilled and have been farming for years.” With local supermarkets

brimming with imported fruit and veg, it’s hard to imagine that succulent crops can be grown just down the road – especially in the harsh desert climate. “The biggest challenge for the farmers is the heat,” says Becky. “Open fields aren’t suitable for most vegetables so green houses have to be used. During the cooler months, much more variety is on offer.” The markets allow consumers to buy produce within hours of it being harvested – and the freshness is palpable. From November onwards, the likes of red cabbage, pumpkin and sweetcorn hit the stalls, with wild cucumber and mulberries joining the ranks later in the year. Staples such as tomatoes, peppers, salad leaves and potatoes are available all season. This autumn, the Ripe market returns to the European-style cobbles of The Courtyard, Al Quoz, and it’s in excellent company. Ethical bakery and restaurant Baker & Spice will be hosting Farmers’ Market on the Terrace – weekly stalls at Souk Al Bahar and Dubai Marina Promenade that offer yet more farm-fresh produce. Yael Mejia, Food Consultant at

Last season, between November and April, UAE produce included cherry tomatoes, aubergines, courgettes, fennel, beetroot, organic free-range eggs and strawberries. In the region, we also enjoy fantastic mangoes, melons, peaches, nectarines and grapes when in season.” During the summer, produce for the restaurant is sourced throughout the Middle East, but the winter markets bring
local goodies to the fore: “The farmers are a dedicated group of people who have learned to work with nature not against it,” says Yael. “Water and exposure to high temperatures are the main challenges. Crops are grown under shade, and water is drip fed to plants. We are dedicated to sourcing produce in a way that minimises our food miles and carbon footprint so the journey from field to plate is significantly shorter. The people who crave out of season crops are gradually being converted to a different way of thinking about their shopping decisions.” The benefit of Dubai’s farmers’ markets is two-fold: not only do consumers have the pick of the crop at their fingertips, but the local economy gets a boost too: “We work with the farms in a number of ways,” explains Becky from Ripe. “We encourage the production of food that is in season and able to grow, and provide organic seeds for items that are in high demand. Also, we are a central distribution point for the farms so they can focus on growing while we look after everything else.” Alongside the ever-increasing range of fruit and vegetables, you’ll find a hearty selection of gourmet home-made produce at both markets. Look out for honey, cheeses, chutneys, cakes and chocolates – all created by local chefs and artisans. With such an emphasis on ethical choices, the savvy shopper will do well to bring their own bags; “Every little bit helps, and if each customer helps the cause, we can make great strides as a community,” says Becky. You won’t find the reams of packaging that adorns supermarket produce, so make a point of refilling bags and punnets or use non-plastic carriers. Another feature that you won’t find in the supermarket aisles is a sense of sociability: “The markets are fun, and foster a sense of community,” says Yael. It’s a highlight for Becky, too: “Our aim is to encourage people to support local farmers, spread awareness of the excellent food we have
locally and regionally, and create the wonderful social feel that we all know and love from markets at home.” Now that really is a recipe for success. Furnishing my apartment in London was my first experience of working with Andrew Martin – that was 15 years ago, and I just knew I wanted to take this concept back to the Middle East. The showrooms never fail to surprise me every time I visit – and I do go there quite often.
I adore artwork – contemporary Middle Eastern pieces in particular. I have recently acquired a unique piece by Abdul Rahman Katanani, a Palestinian artist whose work depicts the tragedy of his fellow Palestinian refugees. His work is poignant, yet it never delivers any evidently sad or depressing messages. I display the painting on the wall of my living room and just keep falling deeper in love with it every day.

French fancies Serve up gourmet Gallic fare inspired by Le Classique’s new seasonal menu
A glimpse of Chef Benoit Cart’s CV reads like a definitive list of fine French dining: from the Michelin-starred Le Vieux Logis, Relais & Chateaux in Tremolat to The Hurlingham Club in west London, his experience has been honed over 13 years in specialist kitchens. Now, Cart can be found at Emirates Golf Club’s Le Classique, and the Executive Sous Chef is keen to bring authentic fare to fore. “French cuisine is steeped in tradition, with many families practicing cooking techniques that have been passed down through generations,” he says. “The regional menus in France feature dishes
that are influenced by the local culture and terrain. For example, in the small town of Bresse in the Burgundy region, you will find the Bresse chicken – arguably the best chicken in the world.” For the budding French cook, Cart’s advice is simple: “Use fresh, high-quality ingredients wherever possible, and never be without Dijon mustard, cream, butter, a selection of cheeses and herbs. In France, the variety of terrain provides a rich offering of produce; farmers have centuries of experience cultivating their land, and this is reflected in the quality of the produce – so fresh ingredients are essential.”

6 large white or yellow onions, peeled and thinly sliced 250g clarified butter 1/4 tsp sugar 2 garlic cloves, minced 8 cups beef stock 1 bay leaf 1/4 tsp thyme Pinches of salt and pepper 8 slices French bread, toasted 1 1/2 cups Swiss gruyère or emmental cheese, grated
1. In a large saucepan, fry the onions in the clarified butter on medium heat until well browned, but not burnt (for 30-40 minutes, or longer). Add the sugar 10 minutes into the process to help with the carmelisation. When cooked, drain any excess liquid.
2. Add the garlic and sauté for one minute. Add the stock, bay leaf, and thyme. Cover partially and simmer for about 30 minutes, until the flavours are fully blended. Season to taste with salt and pepper. Discard the bay leaf. 3. To serve, ladle the soup into either individual oven-proof soup bowls or one large casserole dish. Cover with the toast and sprinkle with cheese. Bake in the oven for 10 minutes at 350°C, until the cheese begines to bubble and is slightly browned. Serve immediately. November 2012

4 slices red Mediterranean tuna Splash of balsamic vinegar 15ml olive oil 60ml basil oil 30ml balsamic vinegar 2 tomatoes, chopped into quarters ½ cucumber, peeled and sliced into ribbons ½ red bell pepper, peeled and cut into cubes 100g fresh green asparagus 100g green beans 3 pink radishes, thinly sliced 200g small fava beans 20 black olives 12 basil leaves ½ Romaine lettuce 2 scallions ½ clove garlic 2 salted anchovy fillets 2 slow-roasted tomato, thinly sliced Pinches of fleur de sel, ground pepper, and espelette chili
1. Boil the green beans and asparagus in salted water, and shell the fava beans and remove the shoots. Peel the scallions and slice them finely, and rub the inside of a salad bowl with the half clove of garlic.
2. Combine the salad and season with olive oil, basil oil, fleur de sel and pepper. Set aside in the fridge. 3. Marinate the tuna in balsamic vinegar
for 5 minutes, blot dry, and sprinkle the chili on top.
4. Sauté the fish in a little olive oil for 30 seconds on each side, and transfer to a serving dish. 5. Arrange the salad on top of the tuna slices with the anchovy fillets and olives, and dress with the balsamic marinade, basil oil and fleur de sel.

6 pears, peeled and cored with stalks intact 500ml red grape juice 150g granulated sugar 2 tbsp lemon juice 1 vanilla pod, split 1 cinnamon stick 2 star anise 4 cloves 1 bay leaf
1. In a deep pan, combine the grape juice, lemon juice, vanilla pod, sugar, cinnamon stick, bay leaf, cloves, and star anise. Bring to the boil.
2. Turn the heat down and add the pears. Simmer for 10-12 minutes before turning the pears and cooking for an additional 8-10 minutes. They should be tender. 3. Remove the pears and allow them to cool. Boil the sauce until the liquid is reduced by half, then pour over the pears to serve. Vanilla ice cream and almond macaroons make a tasty accompaniment.
