Bribes and Graft: Is it Worth it? by John Quam

ribing and paying graft is a true detriment to the progression of a country as a whole by communities, and the individual agencies that seem to promote the proliferation of asking for money for extra services or turning a blind eye to necessary permits.
To illustrate, let me share a striking first-hand example. At an annual general homeowners’ association meeting, the HOA administrator was presenting the budget and year-end financial reports for approval. There was a line item of over $800 dollars that was notably out of place. When questioned, the HOA administrator I have had many conversations with indicated this amount was paid to pay off people telling me what they have gotten a municipal official. Asked to elaborate, he away with. Sometimes they have fed clarified it was to pay someone off to get someone in authority money to ignore things moving on a building project. Road to repetition In a more individual context, I recently heard of a person being pulled over by the police in a rental car. The driver had only a black and white copy of his passport. The police immediately threatened to confiscate the car and cause many other problems. However, in a veiled manner, the driver was given the option of paying $600 to be let go. Being a tourist and scared of the consequences, he ended up paying the officer almost $300 dollars for being allowed to drive away. Of course, there are other actions this driver could have taken, such as calling the vehicle rental agency or asking for a supervising police officer to come to the scene. But this would take time and add to the hassle and stress, which is why many people in the same situation pay and just go on their way. Naturally, these scenarios will keep recurring as long as the perpetrators are encouraged to continue behaving the same way. Once you have paid someone off, do you think it ends there? It may not even stop for you personally. You could become a repeat financial supporter of the same offenders because they know you are willing to pay.
Paying a bribe to a traffic officer will put you on his radar as an easy mark. “Hey, here comes Johnny! Let’s pull him over again. We can make some side cash.” I wonder, how many people leave Costa Rica with a bad taste for these actions? For a country to remove the stigma of accepting graft is difficult, and it holds back progress. The police might not respond when you need them unless you pay them. The officials of muni agencies may cause you other problems if you don’t pay them more. It is a cycle that must be broken. That will require a shift in attitude away from being considered the “normal” way of doing things. All in all, it is a bad idea to be a party to these misdeeds, directly or indirectly. It hurts not only you but also others. It diminishes the reputation of a country that is promoting its place in the world of happiness and green. The green is not cash!

C
osta Rica’s popularity as a relocation destination is nothing new. Tens of thousands of expats from all corners of the world have made themselves at home here in recent decades, permanently or part-time, while foreign investment markets for vacation rental properties have been buoyed by steady tourism growth. But there’s no question that unprecedented global circumstances over the past two years have had an impact on the real estate scene in Costa Rica. The dynamics are no less vibrant now, but decidedly different, in some exciting ways. Notably, there’s been an uptrend in younger expat home buyers, as well as owners who are here to stay.
That vacation travel to Costa Rica rebounded with the easing of international and local pandemic restrictions was hardly surprising. The country’s full reopening of international borders on November 1, 2020 was pivotal. Never before had people everywhere seemed more motivated and eager to get away from their cooped-up status quo. The usual reasons for North Americans seeking to escape the cold and daily grind were compounded by so much more that had rocked their world in unfathomable ways: from health crises and economic loss to social isolation and divisive politics. Tropical haven Meanwhile, everything that has always made Costa Rica so appealing to tourists — as well as a haven to those already owning vacation homes here — was waiting with open arms. Similar deciding factors saw new floodgates of interest in property ownership open up at the same time. Potential foreign buyers included those who might never have otherwise contemplated the notion of buying a piece of pura vida paradise.
Increased acceptance of remote jobs as being a feasible lifestyle choice, not just a lockdown necessity, was hugely influential. Home-centered priorities shifted, with people rethinking the needs and preferences that their living space should best accommodate. What they value in their outdoor surroundings took on added importance too, from seeking a closer connection with nature to growing their own food. Others became more eco-conscious and interested in more sustainable ways of living. These were the kind of house-hunting incentives that kept realtors in Costa Rica busy hosting visitors — mostly from North America — throughout 2021, even during what is normally the low tourist season. At the same time, other foreign buyers moved forward with their pre-pandemic intentions, while sellers benefited from the market becoming unstuck. In fact, 2020 had been forecast as the strongest year in a decade. So some of the recent market activity has been about regaining momentum that was derailed for nine months.

hile there is no denying that real estate sales in Costa Rica are currently brisk and the outlook bright, that is never a good reason to rush such an important decision. he second-home real estate market in Costa Rica is extremely active at the moment, according to Coldwell Banker Tamarindo Realty. Time on the market for properties priced at market rate is under one month. Many properties are selling at full asking price before they are published, just by word of mouth between agents. For luxury properties — $1 million and higher — the market is active but not as hot. Potential buyers interested in touring properties are advised to register your interest with a realtor early enough to stay informed of new listings. Then take your time until finding the right home. When ready to move forward, be prepared to present an offer immediately. Have sufficient funds on hand to put a 10% refundable deposit down within 10 days, and to pay the balance within a month.

Covid 19 has changed everything and can be used against an applicant. Make sure that you are not penalized too harshly for poor claim experience. A strong insurance company pools it’s members by using an “age-banded” rating and does not base the annual renewal rate solely on one’s claim experience for the year. This is one of the most important issues related to annual renewals. Many international carriers weigh in a member’s annual claims experience over many other factors. elcome everyone! Whether you are here in Costa Rica on vacation, searching for a home or living here full time, you’ve had an opportunity to witness the beauty, warmth and friendliness of this amazing jewel of a country. I’ll take a few minutes to tell you about myself and how I arrived here in Costa Rica, and why I love my work with Tres Amigos Realty Group. My search I had been searching for a tropical place to relocate from Canada, after having endured too many long, cold winters. It’s interesting what can spur you to action in life; I still remember seeing a cartoon where the character asked, “Why do I live where the air hurts my face?” I realized I had often asked myself the same question. At that point I knew I wanted and needed to be away from the cold for good. After taking two years to research and plan my arrival in Costa Rica, I was immediately captivated by the country as soon as I walked off the plane in 2014. As with many of my colleagues and friends here in the area, it was love at first sight for me. I knew that I had found my home.

In case you had your head in the sand the last two years, you would know that the real estate market in Costa Rica has been completely affected by the global pandemic. At the beginning of the pandemic, we were busy feeding our less-thanfortunate friends and neighbors, and then dealing with closed borders. After that came hesitancy to travel, even though the borders have been completely open for over a year and a half.

What P is the Procedure to Write an Offer and Close?
urchasing a property in Costa Rica is about as easy as it can get. Under Costa Rican law a foreigner has the same rights as a citizen, and can own property outright — fully titled, fee simple, just like in the USA or Canada. The majority of the property in Costa Rica is titled. The only exception is some of the beachfront property, which is called “concession” and is similar to a lease. I discuss this in another blog. You can own a property using the same vehicles as in North America. You can own property in your personal name or put it into a Costa Rican corporation that you form. You can also use a trust or a foundation, a self-directed IRA or a non-profit organization. And you can will it to your children or your heirs. All of these ownership options can be easily set up by a reputable Costa Rican law firm.

Unlike in North America, our offers to purchase property are very simple and straightforward. Most of the time, they are three or four pages long. None of these offers are 20-page documents like when you buy a house in the USA. They are more like term sheets than long, formal offers. The first page generally details the owner’s information, the seller’s information, the property information and the purchase price. Page 2 is your due diligence page, with contingencies, closing date, fees, arbitration clauses and items included or excluded in the sale. The last page is the signature page. A faxed or scanned offer is a legal document in Costa Rica, so you don’t have to be here to sign the original. We can send you the offer by email after you get home and you can sign it and send it back once all your questions are satisfied. We are not here to pressure you to buy. Take time This is a big decision and we want to give you all the time necessary to make sure this is exactly what you want to do. Go home, talk it over, check your finances and then write the offer. Don’t let anyone tell you that you have to buy this now. We have always been a firm believer that if it is meant to happen, it will.
A deposit of 5% to 10% of the purchase price is placed in the escrow account as good faith. This deposit is normally completely refundable during the due diligence (DD) process. The DD period usually lasts anywhere from 14 to 21 days, giving your attorney time to confirm that everything is OK with the property. This will include a full title search in the National Registry, confirming that the property is free and clear of all mortgages, annotations, liens and encumbrances. Your attorney will also make sure that all municipal, national and corporate taxes are paid up to the date of the closing, and that any homeowners fees and all utilities and service contracts are also current at time of closing. The lawyer will also send you the estimated acquisition costs so you know exactly what the closing costs will be. During the DD period, we can also order a home inspection if you so choose, and any land surveys or engineering work. In addition, you can get quotes for construction, renovations, repairs, landscaping or furniture / interior decorating. There are many qualified professionals here in the area to assist you with these matters.
We are not here to pressure you to buy.
Relax Upon acceptance of an offer, a secure escrow account is set up with a company that is registered with the banking authority of Costa Rica, known as SUGEF. They will act as a third party to ensure that everyone is protected during the closing. Do not allow a law firm or a real estate company to accept or handle your money. Always ask for a separate, secured, registered escrow.

What is the Property Purchasing Process in Cos by Rick Philps
M
any of you reading this will have purchased a property in other jurisdictions previously, particularly in Canada or the United States. The general flow of the property purchasing process in Costa Rica is very similar to that in these other jurisdictions, but the considerations are very different.
The flow The general flow of the purchasing process in Costa Rica involves: • Locating a property. • Gathering preliminary information to make an offer. • Having a lawyer draft the interim property purchase agreement. • Placing a deposit — customarily 10% of the purchase price — in escrow with an escrow company. • Carrying out the legal due diligence to satisfy the stipulated conditions contained in the agreement. • Confirming that the agreement is accepted. • Proceeding to the closing on the agreed-upon closing date.

The considerations Since there is no regulation of the real estate industry in Costa Rica, it is very important to select a realtor who has good local knowledge of the area where you wish to purchase a property. No formal MLS exists in Costa Rica. Accordingly, the only manner of assurance that you have been presented with the various property purchase options in an area is your realtor’s personal knowledge of existing sale properties. Another key consideration is to select a real estate lawyer for the closing who is knowledgeable in the areas of legal

due diligence to be completed in the property purchase. It’s important for the purchaser’s lawyer to review the realtor’s offer to be presented to the seller before it is signed. The legal due diligence considerations undertaken will vary significantly between purchasing an existing fully constructed property and that of a building lot for future construction. These differences are discussed in a separate blog that I have written. One significant difference in Costa Rica is the treatment of the closing costs. They are negotiable as a payment between the seller and purchaser, and should be addressed in the initial offer presented. Closing costs routinely approximate 4% of the property purchase price, and are comprised of the notary fees, value added tax (VAT) on the notary fees, property transfer tax, National Registry fees and escrow fees. A Costa Rica notary public, who also must be a qualified lawyer, will attend the closing and be responsible for drafting the property title transfer deed, and its execution by the seller and the purchaser on the closing date. In Costa Rica, the amount of oversight by various government agencies for those matters of legal due diligence is considerably less than in many foreign jurisdictions such as Canada and the U.S.
The ability to acquire the necessary information to satisfy due diligence conditions is also not as readily available. This can result in a request by the purchaser for an extension of the time limits to satisfy the due diligence conditions. The burden of conducting this due diligence falls entirely to purchasers and the lawyer that they select to represent them. The lawyer must carry it out in the correct manner for buyers to reach an informed decision on whether to proceed with the property purchase. In Costa Rica, there are no title insurance companies that carry out this due diligence process. My opinion For foreigners making a first-time property purchase in Costa Rica, it is very important that they select the correct professionals to represent their interests on an independent basis. Purchasers should always select a lawyer to represent them, who is acting independently of the seller’s interests in all respects. eal estate is one of the topics that we get asked the most questions about. The real estate market in Costa Rica is very robust. Buyers and sellers alike need to be aware of the country’s regulations and laws. This article will answer some of the most frequently asked questions.
Do I need to be a Costa Rica resident to own real estate?
We always encourage anyone selling or buying property to retain an attorney with experience or expertise in real estate. It’s important to coordinate a meeting (virtual or in person) to discuss in detail all the aspects and relevant matters.
To apply for residency in Costa Rica, the Costa Rican government requires applicants to provide proof of financial stability in one of three ways:
In my home country, we go through a due diligence process when buying real estate. Is that required in Costa Rica?
LEGAL EASE
Yes, before any purchase, due diligence may be performed by the buyers’ attorney, checking that all the paperwork of the property is in order. It should also ensure that there are no outstanding charges or taxes and there are no encumbrances or liens on the property. During the due diligence period, the buyers and buyers’ attorney shall have the right — but not the obligation — to perform a complete study of the property. That includes, but is not limited to: physical, title and survey, confirmation of no adverse possession, survey plan, boundaries and other documents.
No, it is not required by law to be a Costa Rica resident to own real estate in Costa Rica (concession land is an exception). However, many expats do make the choice to do so.
1. As a retiree with pension: Certification that the applicant receives a lifetime pension of at least $1,000 USD per month. 2. As an investor: Must demonstrate a real estate investment in Costa Rica with a value of at least $150,000 USD per recent law #9996, which reduced the amount from $200,000. 3. As the holder of a fixed annuity: Certification that the applicant receives a guaranteed annuity of $2,500 USD, per month, for at least two years. Other requirements are to provide a birth certificate, police records from the home country and marriage certificate (if applicable) — all duly apostilled or legalized by the Costa Rican consulate in the country of issuance of the certifications.
Property taxes are 0.25% of the purchase price or registered value, whichever is greater.
What taxes am I required to pay? The primary taxes are: 1. Real estate tax and garbage collection fee Property taxes are 0.25% of the purchase price or registered value, whichever is greater. They can be paid a year in advance or quarterly to the municipality where the property is registered. The garbage collection fee is USD $200 per year. Due date for the 1st quarter: March 31 of each year. 2. Home luxury tax The home luxury tax only applies to houses, condos or apartments with a construction value exceeding a certain amount. This amount is adjusted each year, and is currently 137.000.000,00 in 2022, or USD $240,000. Due date: January 15 each year. Those liable for this tax shall fill out the form called Formulario Único de Inscripción, Declaración y Pago Impuesto Solidario para el Fortalecimiento de Programas de Vivienda, Law #8683, every three years and pay the tax annually. The next assessment shall be made and submitted in 2025.
3. Annual corporate tax Payment of an annual corporate tax is required under Law 9428: Tax over legal entities. A fixed fee is payable for inactive corporations and a progressive rate for active corporations, depending on their gross income. The amounts range from USD $120 for inactive corporations to up to USD $380 for active corporations. The amounts are adjusted each year. The due date for this tax is January 31 each year. 4. Capital gains tax Law 9635 created a capital gains tax of 15%, which applies to all investment income and real estate. A capital gain arises from the difference between the value of an asset at the time of purchase and the asset’s value at the time of sale. If there is a gain (positive value), this amount is subject to a 15% tax.

Experiencing the Arenal Adventure
W
e escaped our casa on Costa Rica’s hot and dry Pacific coastline and headed less than three hours away to Arenal. I’ve seen plenty of photos and read Howler articles, but it was nothing like experiencing this region first-hand. Wow, we were amazed! The hillsides and fields were green, while the wind turbines rotated in the constant breeze. The temperatures dropped 20 degrees as we drove along the winding road 142 off Highway 1, just east of Liberia. We found ourselves at a secluded bed and breakfast. As the photo on the right displays, it was overflowing with beautiful nature. We used Deals In Costa Rica to choose and arrange for our Saturday hike. Within seconds of meeting up with our tour guide, José Banabedas, we knew we had a knowledgeable guide who loved his job.
“My grandfather told me what it was like before the 1968 eruption that changed this region and Costa Rica,” José shared with us. He provided many details about the famous Arenal Volcano eruption event, and the restoration progress made in the aftermath. He also told us the amazing story of how Lake Arenal was created in the 1970s, representing what was then the most ambitious hydroelectric project ever undertaken in Costa Rica. José also elaborated on all the nature we were seeing along the way. It was an easy hike, with many opportunities for informative talk stops during the two-hour walk. We learned a great deal from José about the area’s history and fascinating details about the prime climate, including the flourishing growth of trees and flowers made possible by the rain.

he Maleku are an indigenous group of people living in northwest Costa Rica. It is the country’s smallest tribe, numbering only about 650 people. They speak the Maleku jaica language, but all are bilingual in Spanish.

The forest is everything to the Maleku community. Dago, one of the Maleku elders, said that the forest is their pharmacy, restaurant, chapel, and hardware store. He can show you plants for medicinal purposes; reeds for weaving strong, waterproof bags; gourds to make bowls and cups; and saps for glues. However, since their forest has been repurposed and stripped by outsiders, the Maleku people can no longer sustain themselves from what the forest produces. They turned to tourism to raise money for themselves, but the pandemic stopped nearly all income from that. Dago explained that the way out for his people is not from donations, because they do not want to become dependent on others. He is convinced that their children must have both a Maleku and Costa Rican education, thereby learning skills to work in whatever job they choose. However, he pointed out, they need help now to buy uniforms, school supplies and backpacks.
CULTURAL HERITAGE
Dago knows that the Maleku residents’ future depends upon not isolating themselves, but rather learning to thread their cultures with others to grow together. His vision is to join with like-minded people and share knowledge and experience so that everyone can benefit.
Whether the sharing comes from face-to-face meetings, where people walk alongside each other, or from video courses, it is his dream that the Maleku traditions, language, and culture are not lost.

Coldplay Concert to Promote Sustainability Kicks Off in San José by Turner Mojica

t’s no coincidence that Coldplay will be making its first appearance in Costa Rica with the “Music Of The Spheres World Tour” on March 18, 2022. Their show at the National Stadium is sold out. Howler’s friends at Live Nation, the world’s largest concert promoter, have informed us that the multiplatinum British band has created a comprehensive set of sustainability and regenerative initiatives addressing global issues regarding environmental and social concerns.

It’s the first time that a band of this caliber has created its own mandate in the hope of inspiring fans and paving the way for other bands to do the same. Costa Rica historically has been at the forefront of confronting climate change through programs such as renewable energy.

“This is why we’re starting the tour in Costa Rica, where 99% of power mains are renewable,” lead singer Chris Martin said. Coldplay has pledged to do the following: • Reduce consumption, recycle extensively and cut CO2 emissions by 50%, and work with partners and suppliers to reduce their impacts and emissions wherever possible. For remaining CO2 emissions, the band is creating a carbon fund for the drawdown of carbon via nature- and technology-based solutions. • Support new green technologies and develop new sustainable, super-low carbon touring methods. Make the tour as environmentally beneficial as possible by funding a portfolio of nature- and technology-based projects and by drawing down significantly more CO2 than the tour produces. • Adapt tour operations to minimize emissions, in line with the best science and practices: from set build to travel to freight to power. W
hen the borders closed to Costa Rica in early 2020, Alexis O’Reilly, husband Colin and son Brendan, who was 4 years old at the time, had a moment of panic just like everyone. The difference, Alexis jokes, is that it was only for a brief moment. The family had moved to Costa Rica two years earlier on what was intended to be a sabbatical of sorts for Colin, who admittedly was back to work within a few months — determined to reinvent himself as necessary and never to look back. As those around her who were not native to Costa Rica made plans to return to their home countries, Alexis remembers asking Colin to sit down and talk about where they wanted to “ride out” what was to come. She laughs when recalling that he didn’t even sit down; he was convinced that they were where they were supposed to be. One evening shortly thereafter, a family friend messaged Colin and said, “Lets buy an eco-resort.” Alexis was not surprised. “Those two are like peas in a pod.” she says with a smile. “They can be heavy and a bit too much for some people to keep up with. But they are perfect for each other and complement each other extremely well.” Afterwork rumblings were overheard from time to time, but Alexis could see that the concept was coming from a good place. “They both put their family above all else, and Roca Mística was born out of their desire to protect us by finding a place where we could take care of each other."

CO N S C I O U S AND S U BCONSCIOUS LE ARNING — PART 2
L
et’s continue where we left off! Part 1 of my Howler article “Of Two Minds,” in the February 2022 issue, ended with this question: Can I use my conscious mind to rewrite a program in my subconscious mind? The answer is, yes. OK, so, how can you do this?
MINDFULNESS
One of the ways you put new programming in your subconscious mind is by practice.
Remember when you were a child, and you repeated something over and over and over again to make a habit out of it? Remember when you learned your ABCs this way? How many times did you just start with A, B, C … and then got to a certain point and stopped because you didn’t know what came next? Slowly and repeatedly, you kept adding more letters and repeating from the beginning … and what were you doing? Repeating and adding until you got to the end.
Repetition creates habits Eventually, you no longer needed to learn it anymore. Why? Because your repetition made a habit out of it. Now this information is enclosed in the habit mind and you can just call it up. It’s already a habit.
But the issue here is not whether the conscious mind believes it or not. You’re repeating the new idea over and over again to accomplish the subconscious mind’s habituation with a new program. The subconscious now acquires a new program: I am healthy! Creating coherence
Keeping it simple: start repeating the new The function of the mind is to create habit — a new behavior or idea you want to write in your subconscious mind. Keep repeating and coherence between your programs and your reality. repeating, even if it doesn’t feel “real” at the time. It will become real as that idea becomes So what will happen is that the mind will help “downloaded” as a program. to create an environmental situation where Your subconscious will take that program and health can be restored. Why? Because your new program says “I’m healthy”. then use it to manifest life from it. Let me share a typical example. Imagine someone sick with a chronic disease and the new program this person wants to write is, “I am healthy. I am in control of my health.”
Even though your biology says “I’m not healthy,” the function of mind is to adjust the biology so it manifests the expression of the program.
I invite you this month to try the following: It is understandable that your conscious mind finds it hard to say, “I am healthy,” knowing you If you are constantly repeating your stories about tragedies that occurred in the past, or have an illness at the moment. illnesses you currently have, simply stop and start focusing all your energy on rewriting a new program.

When you are constantly talking about your illnesses, or all the things that were “wrong,” you are giving all your attention and energy to those events and ideas and giving them power over and over again. It is in your hands to choose differently so you can put your attention and energy into a new behavior, habit or idea that can be empowering and uplifting.
As Oprah Winfrey once said, “I live in the space of thankfulness — and for that, I have been rewarded a million times over. I started out giving thanks for small things, and the more thankful I became, the more my bounty increased. That’s because — for sure — what you focus on expands. When you focus on the goodness in life, you create more of it.”

Gain Confidence to Make Decisions for You and Your Business

welcome March with a special salutation to all the women around the world: Happy International Women’s Day!
Every year on March 8, we celebrate a day to recognize women in culture, politics and business, and to inspire women to collaborate in sending important messages globally as “a world that is diverse, equitable, and inclusive.” As a coach, it is important for me to inspire women to understand that we have the power to be and become that person that we want to be. I would like to empower all of you to take that step towards being or having whatever you’ve been dreaming of.

Let’s start with this definition for our plan to be and become what we want. Empowerment: “Having the knowledge, confidence, means, or ability to do things or make decisions for oneself.” The empowerment plan 1. Define your vision Create a clear image of: • Who you want to become. • What you want to do. • For what purpose do you want to do it?
There are no limits. Imagine yourself as that person — how does it make you feel? I empower you to have the confidence that you will become the person who is in your vision. 2. Define your goals What will you do to become that person? Confidence gives you power, so when you are able to lead your goals, the results will be successful. Giving meaning to your plan will fuel your desires and your ambitions, in the best possible way. 3. Take action What can you do to become that person? Here is where you take steps that will help you be the person that you imagine. Make decisions To create your empowerment plan, make decisions about changes, adjustments and new actions to take. Remember that plans are not perfect — you can edit and restart as many times as possible. What’s important is that you are focused on your vision and goals.
There are no limits. Imagine yourself as that person — how does it make you feel?

Empowerment is a state that can conquer anything. We, as women, have demonstrated that we can do as many different jobs as we want. I think that if we get the chance to have that confidence in ourselves — and to use it for empowering others to be the best they can be — we will be fulfilled. It will create a chain reaction in conveying the greatest message of this movement: Women are strong, smart, self-driving, intuitive, focused and integral human beings. Any one of us can decide to be and become the best person for any job or position in our society.
