FINANCIAL VIEW As experts warn us to be wary of mortgage “urban myths”, Vicky Shaw investigates Sometimes, the truth can hurt. But that doesn’t mean it can be ignored, avoided, or magicked away. And certainly not when it comes to your mortgage. Yet the financial ombudsman has warned that a large number of people are putting their faith in “urban myths” about what lenders can and cannot do and, as a result, are regularly landing t h e m selves in trouble. “When times are hard, it’s completely understandable that people will look for solutions that might offer some relief from the pressure they’re facing,” says Martyn James, a spokesman for the ombudsman service. “The good news is there are lots of ways you can get help if you’re struggling with your mortgage – but you need to speak up and seek help as soon as you can. “Don’t put your faith in mortgage ‘urban myths’ that suggest you can break your contract or stop paying your premiums indefinitely. “If it sounds too good to be true, it is.” Here are common “mortgage urban myths” that the ombudsman has heard in the last year: ■■ If your lender can’t produce an original mortgage contract, it’s “unenforceable”. The ombudsman has seen this myth attach itself to numerous debt problems, including bank charges, and it crops up quite often on internet forums. But the service warns only a court can decide if a contract is unenforceable, and pinning your hopes on a slight technical loophole letting you off paying off your mortgage is “dangerous”. ■■ Repossessions have been going down, so lenders are more relaxed about arrears Yes, it’s good news that repossessions are on a downward path, but these figures are not a guarantee of what will happen to you in the future. Lenders do work hard to try to keep people in their homes and generally don’t want to repossess properties, which can be a messy and costly business for them.

But, just because repossession is a last resort, this doesn’t mean that your home isn’t at risk if you don’t keep up with your payments. ■■ Mortgages are long-term investments and my situation will improve if I can make it through the next year or so Mortgages are potentially the longest financial commitment most of us will make. But a lot can happen over a couple of decades, so it makes sense to think about how your finances would cope with a sudden life-changing event, such as losing your job or a relationship breakdown. ■■ I can always “port” my mortgage Many people believe they can simply port or switch their mortgage to another type of deal under their existing contract. But people often don’t realise that this is up to the lender, and is not a guarantee. Mortgage lending rules have been toughened up. For example, interest-only mortgage deals are considered a “niche” product nowadays and people looking to buy a home or re-mortgage now face more probing questions into their spending habits than they did before. The ombudsman has seen numerous cases involving people who thought they could move to a different deal but no longer qualified. While many lenders may allow you an interest-free period to help you back on your feet, this isn’t a longterm agreement. ■■ If I’m in financial difficulties, my lender is obliged to refund charges and help me out If you tell your lender you’re in trouble, they should look at your situation and tailor a plan to help you. This may include removing some charges and debit interest. But these solutions are not indefinite and it makes sense not to rely on their support, but to take a long, hard look at your finances yourself.

S a piece of local railway history, this week’s featured property can only be described as truly charming. Sitting alongside the Huddersfield to Sheffield railway line, the old station master’s house in Brockholes Lane dates back to 1850, pictured right, and has been the home of Susan Hughes for the last 24 years. Her late husband Thomas, restored the Station House to its former glory and many of the old railway signs and original features are still on display. I’m not sure of the time but there is a morning and an evening train which runs from here all the way into Leeds and back, so ideal for anyone commuting.’’ Today this unique house is simply a charming property with extensive grounds and still scope to extend and improve. Susan said: “Despite all the work we have done, the old ticket office and toilet block are still to update and convert to living accommodation.’’ This section of the property could easily be converted to use as a holiday let, bed and breakfast accommodation or a separate annexe, subject to planning consent.

Hiring painters and decorators

Colour clangers and dodgy decorators head a top-10 list of issues addressed by a leading trade body last year. Members of the Painting and Decorating Association (PDA) were called in to remedy hundreds of decorating dilemmas in homes all over the country. Problems created by substandard contractors were at the heart of most of them. Poorly wallpapered rooms featuring overlapping seams or open joints, a general lack of preparation and weak standards of finish were also prominent on the list of decorating issues reported to the PDA. The lack of any proper quotation prior to the start of any work was another common factor. PDA chief executive, Neil Ogilvie, says the list serves to illustrate why householders in need of a painter or decorator should engage members of the PDA. Restricted supply leads to increases in rogue landlords and the number of tenants forced to choose inadequate properties. “Having a place to call home is of upmost importance to every one of us, whether we own or rent. To ensure this is possible and affordable, the Government needs to address the restrictions people face when finding a place to live,’’ the statement added. NAEA and ARLA are calling on the Chancellor to support mobility in the property market by addressing the ‘‘unfair’’ and hugely expensive Stamp Duty slab structure, which they say restricts home ownership and reiterating support for institutional investment in the private rented sector by fully regulating the industry. The joint statement added that affordability is a central issue. “The introduction of the Government’s Help to Buy

scheme has offered a welcome boost to buyer confidence. However, costly barriers still need to be addressed – namely the thousands of pounds demanded up front in Stamp Duty,’’ the statement went on. “Stamp Duty, in its current ‘slab structure’, distorts the UK housing market, acts as a barrier to first-time buyers and therefore restricts the demand to build new homes. Help to Buy is a good temporary measure, but tackling the unfair and hugely expensive Stamp Duty is an achievable, long-term and sustainable way to support access to, and mobility up, the housing ladder. For those who choose to rent, or cannot afford to buy, many will have experienced first-hand the tight supply of the UK rental market. “Demand for private rented housing has seen sustained and consistent growth over the past five years. ARLA has always campaigned against poor practice and our members adhere to a professional code of conduct. As a consequence, we urge the Government to introduce a full mandatory regulation of agents. Regulation will bring two key benefits: better standards for those using industry services and, a much needed stamp of professionalism and quality on the lettings industry which will help trigger the much-needed investment in a large-scale development of homes by professional organisations. The industry needs to be seen as stable, attractive and above all comprehensively regulated, in order for significant investment to be secured.’’

Adults struggle with financial questions More than one third of adults are unable to answer questions that a teenager would be expected to know about savings, the cost of a loan and tax, research has found. Over 2,000 adults were tested by the Open University Business School (OUBS) on questions of a GCSE standard, which involved them making calculations to work out which savings accounts

paid the most, how much income tax someone would be liable for, which currency exchange rates were the best and how expensive it would be to take out a loan. Across all seven multiple choice questions they were asked, an average of 41% of adults, equating to two in every five, were unable to come up with the right answer.

Investors lacking a plan

More than nine in 10 (93%) of buy-to-let property investors have no plan in place for their investment over the next five years, according to research from specialist buy-to-let business Platinum Property Partners. The survey, conducted among more than 500 UK buy-to-let investors, found that half have no written business plan, yet the most common reason given for someone having a buy-tolet property was to help them secure a decent retirement income. Here are some tips for investors from Platinum: ■■ Set financial goals. Work out what you hope to gain from your buy-tolet portfolio. This could be capital growth, long-term income to supplement retirement income or to provide a substitute income now. ■■ Factor-in voids and bad debt. There will be periods when the property is empty and not generating rental income. These are known as void periods and the National Landlords Association (NLA) recommends that buy-tolet investors budget for at least two months a year when the property is empty — or when tenants fail to pay their rent. ■■ Regular evaluation. Regular assessment of income and costs will enable you to calculate your return on investment and gross annual profit. It will also show how fluctuations in rent charged, fees payable and mortgage interest rates can affect these figures and whether you need to change any plans.

As the property market recovery continues, many landlords may choose to cash-in on their investments and renters may find themselves in the position of having to find a new home. Susan Fitz-Gibbon, president of the Association of Rental Letting Agents (Arla), says: “If you receive notice that your landlord is selling, the

most important thing to remember is that as the tenant, your tenancy agreement remains valid.” Arla says you have the right to stay until the date stipulated in your tenancy agreement, but check for any break clauses which can enable the landlord to end the lease early — or for you to end your tenancy earlier if you want to. The amount of notice

that a landlord must give for prospective buyers coming to view the property may be set out in your tenancy agreement. If not, you should still be given reasonable notice, often 24 hours. If a property sells, the new owner must also respect the tenancy agreement. It could be a good idea to have a new agreement

drawn up, with your new landlord’s name on it. You may be offered the chance to buy the rental property you’re living in yourself, before it goes on the market, although landlords aren’t obliged to do this. If you have a good relationship with your landlord and are in a position to buy, it might be worth taking the plunge.

A TRAPPED badger bashing its way out of a shed and a pigeon causing £8,000 of damage to a home after flying down a chimney are among the most bizarre but successful claims that an insurance provider has seen in recent months. In another incident, a snail chomped its way through £78 worth of carpet at the home of a 73-year-old man from Preston, according to RIAS, a specialist provider of insurance products for the over-50s. The provider analysed successful claims from over 400,000 home insurance customers, made between September 2012 and October 2013, to find the most unusual, many of which involved children or animals.
