SCORECARD M EAS U R I N G S U PP ORT F OR E QUALITY I N TH E 111TH CON G R E S S
Dear Friends, With fair-minded leadership and a president supporting, rather than vetoing, measures to protect the lesbian, gay, bisexual and transgender community, the 111th Congress passed two historic bills that are now the law of the land. Even with Democratic majorities in both houses of Congress, it is important to remember that a majority of lawmakers were not consistent supporters of all pro-equality legislation. Thanks to the hard work of the LGBT community and our allies, we were able to build majorities for important legislation in this Congress. The Human Rights Campaign was a part of historic developments, including legislative repeal of “Don’t Ask, Don’t Tell,” the first federal statute to explicitly protect our entire community in the hate crimes law, and confirmation of the first Latina Supreme Court Justice. The fight to repeal “Don’t Ask, Don’t Tell” faced many twists and turns due to the determined opposition of Senate Republican leaders. After the successful votes in the House and in the Senate Armed Services Committee to attach repeal language to the National Defense Authorization Act, a minority of senators twice blocked the chamber from even considering the legislation. Exceptional leadership by Reps. Patrick Murphy (D-Pa.) and Steny Hoyer (D-Md.), House Speaker Nancy Pelosi (D-Calif.), and Sens. Joseph Lieberman (I-Conn.), Susan Collins (R-Maine) and Harry Reid (D-Nev.) secured successful House and Senate votes in the final days of the 111th Congress, allowing a freestanding repeal bill to be signed into law by President Obama before the end of 2010. The Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act, which became law in October 2009, was a major step in our work toward equal legal protections for our community. Now, the entire LGBT community is a part of the civil rights laws of our nation. This law is itself important but also paves the way for other critical protections. The Senate confirmed two of the most LGBT-friendly Supreme Court justices in history, Sonia Sotomayor and Elena Kagan, and HRC was proud to have supported their nominations. We also helped defeat measures that would have harmed the LGBT community — one to prevent the District of Columbia from issuing marriage licenses to same-sex couples, and the other preventing governments from protecting their citizens through needleexchange programs.

For the first time, House and Senate committees approved important legislation to provide equal benefits to federal employees with same-sex partners. Rep. Tammy Baldwin (D-Wis.) and Sen. Lieberman worked tirelessly to get this important legislative action on the Domestic Partnership Benefits and Obligations Act. The 111th Congress was also a time for us to build support for our legislative agenda. The Employment Non-Discrimination Act, which would prohibit employment discrimination based on sexual orientation and gender identity, had a record 46 Senate co-sponsors and 204 House cosponsors. Additionally, this was the first time the Senate included gender identity in this crucial legislation. Measures to eliminate unfair taxes on same-sex couples’ health insurance, provide early treatment for HIV and provide equal treatment under our immigration laws now have more co-sponsors than ever before. The Respect for Marriage Act, which would repeal the discriminatory Defense of Marriage Act, was first introduced in the 111th Congress and had 121 co-sponsors. We will keep working to pass these pieces of legislation until LGBT people are fully equal under law. Although our great champion and friend, Sen. Edward M. Kennedy (D-Mass.), did not live to see the hate crimes bill signed into law, Sens. Patrick Leahy (D-Vt.) and Carl Levin (D-Mich.) provided courageous leadership for which we are all grateful. In the House, openly-gay Reps. Barney Frank (D-Mass.), Baldwin and Jared Polis (D-Colo.) led the charge for our civil rights, joined by countless allies. There is still much work to do. We need to pass a fully inclusive Employment Non-Discrimination Act. We need to repeal the Defense of Marriage Act, expand funding and treatment for HIV/AIDS, and ensure that our families are equal under law. As you read this scorecard, see how your representative and senators measured up for the past two years. Our goal is full equality. It is up to you, their constituents, to get them there. U.S. Senate A Leahy Amendment to National Defense Authorization Act (S.Amdt. 1511) Sen. Patrick Leahy (D-Vt.) offered an amendment to the National Defense Authorization Act for Fiscal Year 2010 that would expand federal jurisdiction to reach serious, violent hate crimes perpetrated because of the victim’s race, color, religion, national origin, sexual orientation, gender, gender identity or disability. The Senate voted to invoke cloture on July 16, 2009, by a vote of 63-28 (Roll Call Vote No. 233, 1st Session, 111th Congress). Democrats — 56 yes, 0 no, 2 not voting; Republicans — 5 yes, 28 no, 7 not voting; Independents — 2 yes, 0 no. HRC supported the motion to invoke cloture. HRC also supported the amendment, which passed on a voice vote after the cloture vote. B “Don’t Ask, Don’t Tell” Repeal Motion to Proceed, December Following the failure of the first attempt to invoke cloture in September 2010, Sen. Harry Reid (D-Nev.) moved to reconsider the motion to proceed to consideration of the National Defense Authorization Act for Fiscal Year 2011, which contained a provision allowing for the repeal of the “Don’t Ask, Don’t Tell” law. On Dec. 9, 2010, the Senate again failed to invoke cloture by a vote of 57-40 (Roll Call Vote No. 270, 2nd Session, 111th Congress). Democrats — 54 yes, 1 no, 1 not voting; Republicans — 1 yes, 39 no, 2 not voting; Independents — 2 yes, 0 no. HRC supported the motion to invoke cloture. C “Don’t Ask, Don’t Tell” Repeal Act of 2010 (H.R. 2965), Motion to Invoke Cloture Sens. Joseph Lieberman (I-Conn.) and Susan Collins (R-Maine) introduced the “Don’t Ask, Don’t Tell” Repeal Act of 2010 (S. 4023), a standalone bill to repeal the “Don’t Ask, Don’t Tell” law on Dec. 9, 2010. On Dec. 18, 2010, the Senate successfully voted to invoke cloture on an identical House bill (H.R. 2965) by a vote of 63-33 (Roll Call Vote No. 279, 2nd Session, 111th Congress). Democrats — 55 yes, 0 no, 1 not voting; Republicans — 6 yes; 33 no, 3 not voting; Independents — 2 yes, 0 no. HRC supported the motion to invoke cloture. D “Don’t Ask, Don’t Tell” Repeal Act of 2010 (H.R. 2965) Sens. Joseph Lieberman (I-Conn.) and Susan Collins (R-Maine) introduced the standalone bill (S. 4023) to repeal the “Don’t Ask, Don’t Tell” law. On Dec. 18, 2010, the Senate voted on the final passage of an identical House bill (H.R. 2965) by a vote of 65-31 (Roll Call Vote No. 281, 2nd Session, 111th Congress). Democrats — 55 yes, 0 no, 1 not voting; Republicans — 8 yes, 31 no, 3 not voting; Independents — 2 yes, 0 no. HRC supported the bill. E District of Columbia Marriage Referendum (S.Amdt. 3568) Sen. Robert Bennett (R-Utah) offered an amendment to the Health Care and Education Reconciliation Act to suspend issuance of marriage licenses to samesex couples in the District of Columbia and require a referendum. A budget point of order was raised against the amendment. The Senate voted against

waiving the budget point of order on March 25, 2010, by a vote of 36 to 59 (Roll Call Vote No. 89, 2nd Session, 111th Congress). F Judge Sonia Sotomayor Confirmation On Aug. 6, 2009, the Senate voted on President Obama’s nomination of Judge Sonia Sotomayor to serve as an Associate Justice on the U.S. Supreme Court. The Senate confirmed her nomination by a vote of 68-31 (Roll Call Vote No. 262, 1st Session, 111th Congress). Democrats — 57 yes, 0 no, 1 not voting; Republicans — 9 yes, 31 no; Independents — 2 yes, 0 no. HRC supported the nomination. G Solicitor General Elena Kagan Confirmation On Aug. 5, 2010, the Senate voted on President Obama’s nomination of Solicitor General Elena Kagan to serve as an Associate Justice on the U.S. Supreme Court. The Senate confirmed her nomination by a vote of 63-37 (Roll Call Vote No. 229, 2nd Session, 111th Congress). Democrats — 56 yes, 1 no; Republicans — 5 yes, 36 no; Independents — 2 yes, 0 no. HRC supported the nomination. H Employment Non-Discrimination Act (S. 1584) (Co-Sponsorship) Senators were asked to co-sponsor legislation, introduced on Aug. 5, 2009, that would prohibit employment discrimination on the basis of sexual orientation and gender identity. The measure had 46 co-sponsors: Democrats 42; Republicans 2; Independents 2. ax Equity for Health Plan Beneficiaries Act (S. 1153) (Co-Sponsorship) I T Senators were asked to co-sponsor legislation, introduced on May 21, 2009, that would equalize tax treatment for employer-provided health coverage for domestic partners and other non-spouse, non-dependent beneficiaries. The measure had 24 co-sponsors: Democrats 22; Republicans 1; Independents 1.
J U niting American Families Act (S. 424) (Co-Sponsorship) Senators were asked to co-sponsor legislation, introduced on Feb. 12, 2009, that would amend the Immigration and Nationality Act to provide same-sex partners of U.S. citizens and lawful permanent residents the same immigration benefits that legal, opposite-sex spouses of U.S. permanent residents enjoy. The measure had 26 co-sponsors: Democrats 25; Republicans 0; Independents 1. K Early Treatment for HIV Act (S. 833) (Co-Sponsorship) Senators were asked to co-sponsor legislation, introduced on April 20, 2009, that would permit state Medicaid programs to cover low-income, HIV-positive Americans before they develop AIDS. The measure had 38 co-sponsors: Democrats 34; Republicans 2; Independents 2.

U.S. House of Representatives A Local Law Enforcement Hate Crimes Prevention Act (H.R. 1913) The Local Law Enforcement Hate Crimes Prevention Act (H.R. 1913) would expand federal jurisdiction to reach serious, violent hate crimes perpetrated because of the victim’s race, color, religion, national origin, sexual orientation, gender, gender identity or disability. The House passed the bill on April 29, 2009, by a vote of 249-175 (Roll Call Vote No. 223, 1st Session, 111th Congress). Democrats — 231 yes, 17 no, 8 not voting; Republicans — 18 yes, 158 no, 2 not voting. HRC supported the bill. B Local Law Enforcement Hate Crimes Prevention Act Motion to Recommit (H.R. 1913) Rep. Louie Gohmert (R-Texas) offered a motion to recommit the Local Law Enforcement Hate Crimes Prevention Act (H.R. 1913). The motion would amend the bill to add the categories of age, status as a current or former member of the Armed Forces, or status as a law enforcement officer to the legislation and make these crimes subject to the death penalty. The motion was defeated on April 29, 2009, by a vote of 185-241 (Roll Call Vote No. 222, 1st Session, 111th Congress).
