Measuring Support for Equality in the 114th Congress

DEAR FRIENDS, Over the past two years, we have seen significant victories for the lesbian, gay, bisexual, transgender, and queer community, including the U.S. Supreme Court’s marriage equality decision and the lifting of the ban on open transgender military service. Although the 114th Congress failed to pass any significant LGBTQ-friendly legislation, we have continued to see growing bipartisan support for pro-equality legislation and amendments. Notably, this Congress saw the introduction of the Equality Act, a landmark federal non-discrimination bill that would ensure all LGBTQ Americans have consistent and explicit non-discrimination protections across key areas of life, including employment, housing, credit, education, public spaces and services, federally funded programs, and jury service. The Equality Act was introduced with more than 200 original co-sponsors — the most congressional support that any piece of pro-LGBTQ legislation has received upon introduction. We are grateful to all of the supporters of this bipartisan legislation and are especially grateful to Reps. David Cicilline (D-RI) and John Lewis (D-GA) and Sens. Jeff Merkley (DOR), Tammy Baldwin (D-WI), and Cory Booker (D-NJ), whose leadership guided the introduction of this bill in both chambers, and to Sen. Mark Kirk (R-IL) and Reps. Bob Dold (R-IL) and Ileana Ros-Lehtinen (R-FL) for joining as the first Republican co-sponsors. Meanwhile, in both chambers, pro-LGBTQ amendments received strong support from both sides of the aisle, even when they failed to be adopted. In the Senate, a bipartisan majority adopted a nonbinding budget amendment to ensure that same-sex couples had access to Social Security and veteran benefits. Bipartisan majorities also voted for non-discrimination protections for LGBTQ youth in runaway and homeless youth programs, extending access to critical veteran spousal benefits to all married same-sex couples, and for LGBTQ non-discrimination protections in schools. Unfortunately, all of these amendments failed to receive the 60 votes needed to proceed. In the House of Representatives, a bipartisan majority adopted two amendments affirming President Obama’s executive order prohibiting LGBTQ discrimination by federal contractors. Despite these positive votes, an identical amendment fell one vote short of passage after Republican leadership held open the vote and twisted the arms of seven Republicans to change their “yes” votes to “no” votes. The House also voted to prevent the federal government from withholding funds from North Carolina— thereby limiting the federal government’s ability to penalize North Carolina for its anti-transgender House Bill 2 — and to codify broad religious exemptions into federal contracts. In addition, in the wake of the worst mass shooting in U.S. history, House Republican leadership took more than a month to schedule a vote condemning the Pulse nightclub shooter. To make matters worse, on the one-month anniversary of the shooting, the House Oversight and Government Reform Committee held a hearing on the discriminatory First Amendment Defense Act, which would allow for government-sanctioned discrimination against LGBTQ people, if passed. While we have clearly experienced several important milestones over the past two years, the 114th Congress has often been an impediment to further progress for the LGBTQ community. We hope this scorecard will aid you in understanding your elected officials’ support for LGBTQ equality and will inspire you to take action to ensure that your elected officials embody the pro-equality values we all hold dear. U.S. SENATE SCHATZ AMENDMENT TO THE FY 2016 BUDGET RESOLUTION (S. AMDT. 1063) Sen. Brian Schatz (D-HI) offered an amendment to the FY 2016 Budget Resolution (S. Con. Res. 11) to ensure that same-sex couples have access to Social Security and veterans benefits. The Senate adopted the amendment on March 26, 2015, by a vote of 57-43 (Roll Call Vote No. 121, 1st Session, 114th Congress). Democrats – 44 yes, 0 no, 0 not voting; Republicans – 11 yes, 43 no, 0 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the amendment. LEAHY AND COLLINS AMENDMENT TO THE JUSTICE FOR VICTIMS OF TRAFFICKING ACT (S. AMDT. 290) Sens. Patrick Leahy (D-VT) and Susan Collins (R-ME) offered an amendment to the Justice for Victims of Trafficking Act (S. 178) that included explicit LGBTQ nondiscrimination protections for runaway and homeless youth programs. The Senate defeated the amendment, which needed 60 votes to pass, on April 22, 2015, by a vote of 56-43 (Roll Call Vote No. 159, 1st session, 114th Congress). Democrats – 44 yes, 0 no, 0 not voting; Republicans – 10 yes, 43 no, 1 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the amendment. LORETTA E. LYNCH MOTION TO INVOKE CLOTURE On April 23, 2015, the Senate voted to invoke cloture on the President’s nomination of Loretta E. Lynch to serve as U.S. Attorney General by a vote of 66-34 (Roll Call Vote No. 164, 1st session, 114th Congress). Democrats – 44 yes, 0 no, 0 not voting; Republicans – 20 yes, 34 no, 0 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the motion to invoke cloture on the nomination. HRC also supported the final vote on the nomination which was approved 56-43. SHAHEEN AMENDMENT TO THE FY 2016 NATIONAL DEFENSE AUTHORIZATION ACT (S. AMDT. 1494) Sen. Jeanne Shaheen (D-NH) offered an amendment to the FY 2016 National Defense Authorization Act (H.R. 1735) to extend access to critical veteran spousal benefits to all married same-sex couples. The Senate defeated the amendment, which needed 60 votes to pass, on June 4, 2015, by a vote of 53-42 (Roll Call Vote No. 203, 1st session, 114th Congress). Democrats – 43 yes, 0 no, 1 not voting; Republicans – 8 yes, 42 no, 4 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the amendment.

FRANKEN AMENDMENT TO THE EVERY CHILD ACHIEVES ACT (S. AMDT. 2093) Sen. Al Franken (D-MN) offered an amendment to the Every Child Achieves Act (S. 1177) that would prohibit public schools from discriminating against any student on the basis of sexual orientation or gender identity. The Senate defeated the amendment, which needed 60 votes to pass, on July 14, 2015, by a vote of 52-45 (Roll Call Vote No. 236, 1st session, 114th Congress). Democrats – 43 yes, 0 no, 1 not voting; Republicans – 7 yes, 45 no, 2 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the amendment. EQUALITY ACT (S. 1858) (CO-SPONSORSHIP) Senators were asked to co-sponsor legislation introduced on July 23, 2015, that would provide consistent and explicit non-discrimination protections for LGBTQ people across key areas of life, including employment, housing, credit, education, public spaces and services, federally funded programs, and jury service. The measure had 43 co-sponsors: Democrats 40; Republicans 1; Independents 2. SAFE SCHOOLS IMPROVEMENT ACT (S. 311) (CO-SPONSORSHIP) Senators were asked to co-sponsor legislation introduced on January 29, 2015, that would amend the Elementary and Secondary Education Act (ESEA) to require school districts in states that receive ESEA funds to adopt codes of conduct specifically prohibiting bullying and harassment, including on the basis of race, color, national origin, sex, disability, sexual orientation, gender identity, and religion. The measure had 43 co-sponsors: Democrats 41; Republicans 1; Independents 1. GLOBAL RESPECT ACT (S. 2645) (CO-SPONSORSHIP) Senators were asked to co-sponsor legislation introduced on March 7, 2016, that would provide a means to prevent individuals who violate the human rights of LGBTQ people from entering into the United States. The measure had 39 co-sponsors: Democrats 34; Republicans 4; Independents 1.

PITTENGER AMENDMENT TO THE FY 2017 ENERGY AND WATER DEVELOPMENT AND RELATED AGENCIES APPROPRIATIONS ACT (H. AMDT. 1115) Rep. BYRNE AMENDMENT TO THE FY 2017 ENERGY AND WATER DEVELOPMENT AND RELATED AGENCIES APPROPRIATIONS ACT (H. AMDT. 1130) Rep. Bradley Byrne (R-AL) offered an amendment to the FY 2017 Energy and Water Development and Related Agencies Appropriations Act (H.R. 5055) to reaffirm an executive order which added religious exemptions to long standing non-discrimination protections for federal contractors and to ensure that funds from the energy and water appropriations bill would not be used in contravention of the Religious Freedom Restoration Act. The House adopted the amendment on May 25, 2016, by a vote of 233-186 (Roll Call Vote No. 259, 2nd session, 114th Congress). Democrats – 2 yes, 179 no, 7 not voting; Republicans – 231 yes, 7 no, 7 not voting. HRC opposed the amendment.
