CONGRESSIONAL SCORECARD Measuring Support for Equality in the 115th Congress

Dear Friends,

©The Washington Post/Getty Images

Since the beginning of the 115th Congress and the swearing in of Donald Trump and Mike Pence nearly two years ago, we have seen attack after attack on the LGBTQ community. From banning transgender people from serving in the military to advancing a license to discriminate, the Trump-Pence Administration has used every opportunity to undermine the rights of LGBTQ people. Nevertheless, when anti-LGBTQ members of Congress, led by Rep. Vicky Hartzler (R-MO), tried to join in by offering an amendment to ban access to transition-related health care for military service members and their families, HRC was able to work with our allies in Congress to defeat the amendment on the House floor. While the Hartzler Amendment was the only vote this Congress that specifically targeted LGBTQ people, it was not the only action—or inaction—by Congress that impacted the LGBTQ community. The fact of the matter is our community is as diverse as the fabric of this nation. We are women. We are Muslim. We are Jewish. We are black, white, Latinx, Asian, and Native American. We are immigrants and we are people with disabilities. And so, when Congress fails to protect Dreamers, that impacts LGBTQ people. When Congress votes to allow states to refuse to provide Title X family planning grant funds to Planned Parenthood—one of the largest providers of trans-competent care in the country and a vital source of healthcare for women, especially low-income women—that impacts LGBTQ people. When Congress tries to repeal core provisions of the Affordable Care Act, thereby making it more difficult for vulnerable populations, including people living with HIV, to acquire health insurance, that impacts LGBTQ people. And that is why we are scoring votes related to all of those key issues, in addition to a discharge petition that would have paved the way for a vote on the Dream Act. We know Congress, specifically the Senate, plays a key role in administration personnel, and if there was any doubt that this Administration is no friend to the LGBTQ community, we simply need to look at who Donald Trump has nominated to key positions. Among his anti-LGBTQ cabinet members, two have especially stood out in their efforts to undermine the rights of LGBTQ people: Attorney General Jeff Sessions and Secretary of Education Betsy DeVos. In fact, one of their first joint actions was targeting some of the most vulnerable members of our community by rescinding critical guidance on the rights of transgender students under Title IX. Unfortunately, their anti-LGBTQ actions have come as no surprise to our community, which is why HRC opposed their nominations and is continuing to oppose their dangerous agendas.

2

HUMAN RIGHTS CAMPAIGN CONGRESSIONAL SCORECARD | 115th CONGRESS

Yet, it’s not just anti-LGBTQ cabinet members that Trump has nominated. Over the past two years, he’s put forward many anti-LGBTQ nominees for lifetime judicial positions, including Stuart Duncan to the Fifth Circuit and Neil Gorsuch and Brett Kavanaugh to the Supreme Court. The confirmation of these judges will have a lasting impact on the rights of LGBTQ people, long after Trump and Pence leave office. The past two years have been difficult for our community and our country. The 115th Congress has done little to advance LGBTQ equality, while allowing a great deal to be done that undermines the rights of the most vulnerable members of our community. We hope this scorecard will aid you in understanding your elected officials’ records on issues impacting the LGBTQ community and will inspire you to take action to ensure that your elected officials embody the pro-equality values we all hold dear. Sincerely,

Chad Griffin President Human Rights Campaign

Mitch McConnell (R-KY) introduced the Health Care Freedom Act, also known as “Skinny Repeal,” as an amendment to the American Health Care Act (H.R. 1628), to repeal core provisions of the Affordable Care Act, which would make it more difficult for vulnerable populations, including LGBTQ people and people living with HIV, to obtain healthcare. The Senate defeated the amendment on July 28, 2017, by a vote of 49-51 (Roll Call Vote No. 179, 1st Session, 115th Congress). Sworn in January 3, 2018, to fill the seat previously held by interim Sen. Luther Strange. Sen. Murkowski opposed confirmation of Judge Kavanaugh. However, as a Senatorial courtesy, she “paired” her no vote with Sen. Daines’ intended yes vote because Daines was unable to be present for the vote. Murkowski is officially recorded as present, but we list her as supporting HRC's position against the nomination. 3 Sworn in September 5, 2018, to fill the vacancy due to the death of Sen. John McCain; not eligible for score. 4 Traditionally, the Senate Majority Leader does not co-sponsor legislation; score is based solely on votes. 5 Sworn in January 3, 2018, to fill the vacancy due to the resignation of Sen. Al Franken. 6 Sworn in April 9, 2018, to fill the vacancy due to the resignation of Sen. Thad Cochran; not eligible for score. 7 Sen. Daines supported confirmation of Judge Kavanaugh. However, he was unable to be present for the vote and Sen. Murkowski “paired” her no vote with his intended yes vote. Daines is officially recorded as not voting, but we list him as not supporting HRC's position against the nomination. 8 Traditionally, the Senate Minority Leader does not co-sponsor legislation, although Sen. Schumer did co-sponsor S. 1006 and S. 1419; score is based solely on votes. 1 2

The rule would have prevented Title X family planning grant recipients from banning abortion providers, like Planned Parenthood, from receiving Title X funds. The House passed the resolution on February 16, 2017, by a vote of 230-188 (Roll Call Vote No. 99, 1st Session, 115th Congress).
