ROLL CALL The Board of Zoning Appeals meeting was called to order at 5:00 p.m. with the following members present: Harley Macklin (6/6), Tom Hornbeck (6/6), Valerie Roberts-Ropp (5/6), Janet Hamilton (3/6), Mark Woleslagel (4/6), and Terry Bisbee (5/6), Todd Carr (5/6), and Darryl Peterson (5/6). Member Ken Peirce (5/6) was absent. Planning Staff present were Jana McCarron, Director of Planning and Development; Casey Jones, Senior Planner; Amy Allison, Housing Program Coordinator; Aaron Barlow, Associate Planner; and Jade Shain, Planning Technician.

APPROVAL OF MINUTES The minutes of the July 18, 2017 meeting were approved on a motion by Carr, seconded by Macklin, passed unanimously.

CORRESPONDENCE & STAFF REPORTS The documents and staff reports were accepted into the official record on a motion by Hamilton, seconded by Peterson, passed unanimously.

REVOCATION OF SPECIAL USE PERMIT a. SUP17-000001, Request for a Special Use Permit for a pole sign in the P/I Public Institutional District at 1300 N Plum St. Bisbee asked for the staff presentation. Jones provided the staff presentation. The applicant, Luminous Neon, is requesting a Special Use Permit to replace and refurbish the existing pole sign at 1300 N Plum St. Since the EMC portion of the sign was installed over ten years ago under the former sign code, the replacement and refurbishment require a Special Use Permit in the P/I Public Institutional District. Jones said the sign will be the same – in height and width – and that only the electronic components of the sign will be different. Bisbee asked whether the applicant would like to speak. Tom Sellers, Luminous Neon, echoed what Jones said: the sign will be the same as the existing sign, the electronic components will be upgraded, and the screen will be nicer. Sellers added that the sign will be installed by the end of 2017. Bisbee asked for staff’s recommendation. Jones replied that since all the factors of approval for a Special Use Permit were met:

Jones said that staff recommended approving the Special Use Permit request, with conditions, as outlined in the staff report and as follows: 1. This special use permit shall only be used for a pole sign at 1300 North Plum Street. 2. All electrical wiring to the sign shall be placed underground. 3. A sign permit shall be obtained prior to installation of the sign.

4. The sign shall be designed and installed according to the approved plans. 5. If the sign is not installed completely by 10/17/2018, this special use permit shall expire automatically. 6. Failure to comply with the special use permit conditions of approval may result in revocation of the special use permit. Bisbee asked for a motion. Motion by Hornbeck, seconded by Peterson, to approve Staff’s recommendation to approve Special Use Permit #SUP17-000001 for a pole sign at 1300 North Plum Street based upon finding that the required factors for special use permit approval are met and with the staffrecommended conditions of approval. The motion passed with the following vote: Yes Macklin, Hamilton, Carr, Woleslagel, Hornbeck, Roberts-Ropp, Bisbee, Peterson. 5.

ANALYSIS OF FINDINGS OF FACT REQUIRED FOR VARIANCE REQUESTS: Finding
1. The request for a variance must arise from a condition which is unique to the property in question, is not commonly found on other parcels in the same zone or district, and is not created by an action or actions of the property owner or applicant.
Analysis Front and Side-Yard Landscaping: The Link project is the first new construction project (except for the Wiley Parking Garage) in the C-5 Downtown District since the landscaping regulations were adopted. The 60% front and side-yard landscaping requirement does not have an exemption for new construction in our C-5 zoning district, requiring a more vehicular commercial landscaping standard that is not compatible with the downtown development.

Parking Lot Landscaping: Some downtown parking lots have shade trees, but not all. This is the first downtown development that has incorporated all its required parking onsite.
