CHAIRMAN’S COMMENTARY IBWA SUPPLIERS: THEY MAKE BOTTLED WATER POSSIBLE Without IBWA supplier members, bottled water would be . . . well . . . just water.

Suppliers provide all the products and services necessary to package, deliver, and sell bottled water. While the public may think about the bottler or brand when they discuss bottled water, those of us who live and breathe bottled water know the important role suppliers have on the success of our industry.

IBWA supplier members are special. In this industry, we see a lot of great products and services, but it takes a special business to invest to the point that they put their money where their mouth is and pay membership dues to IBWA. These suppliers know the value of investing not only their money but also their time. They sit in our committee meetings to learn about the issues we face every day—on the plant floors and in the halls of Congress. After hearing about our business challenges, IBWA supplier members return home to see if they can create a product or service to alleviate those problems.

On June 8, 2016, during IBWA’s Hill Day, supplier members walked side-by-side with bottlers and distributors through the U.S. Capitol to educate elected officials about the bottled water industry. PRESIDENT’S MESSAGE CONTINUING TO MEET CONSUMER AND CLIENT DEMANDS Beverage Marketing Corporation (BMC) recently reported that bottled water is poised to overtake carbonated soft drinks as America’s largest beverage category by volume by 2017, if not by the end of 2016.

This is very exciting news. Consumers continue to show a clear preference for healthy hydration, as Americans consumed, on average, 36.5 gallons of bottled water in 2015. That’s 11 gallons more than consumed in 2005. (During that same ten-year period, per capita consumption of carbonated soft drinks dropped by 12.5 gallons.)

In “Bottled Water 2015: Acceleration” (p.12), John Rodwan, Jr., BMC’s editorial director, explains bottled water’s historic high in the U.S. marketplace, when volume exceeded 11.7 billion gallons, and predicts vigorous growth in the future.

To help ensure IBWA bottlers and distributors are able to meet the demand for bottled water products, we’ve got just the tool: the 2016 IBWA Buyers’ Guide, which you’ll find on pages 23-50. Because of the continuing growth expected for bottled water, it is now more important than ever for bottlers and distributors to work with suppliers that are experts in all-things-bottled-water. Advocating for a marketplace that is free from onerous or burdensome regulations is one way IBWA contributes to the success of the industry. While IBWA members and staff do a great job of educating elected officials about bottled water, sometimes we need help. In our Government Relations column (p.52), we review how IBWA works with in-state counsel to address industry issues. We also know that bottled water’s ascension as the No. 1 packaged beverage by volume won’t go unnoticed by our critics.

Thus, in the Communications column (p.54), we suggest that increased scrutiny offers yet another opportunity for IBWA to educate consumers, the media, and legislators about the truth about bottled water. Finally, the Technical Update column (p.56) provides an overview of how the U.S. Food and Drug Administration’s (FDA) Food Safety Modernization Act (FSMA) final rule on Sanitary Transportation of Human and Animal Food will impact bottled water operations.

HEALTHY HYDRATION FOR ALL, EVERYWHERE

Congressional Committee Defunds NPS Bottled Water Sales Ban Policy On May 25, 2016, the U.S. House of Representative’s Interior Appropriations Subcommittee passed its $32 billion spending bill, which included an IBWAsupported provision defunding the National Park Service (NPS) policy that allows park units to ban the sale of bottled water. Subcommittee Chairman Ken Calvert (RCA), a champion of both the national parks and bottled water, and his fellow committee lawmakers passed the bill by unanimous voice vote and offered no amendments to the bill. In addition, the provision was not opposed by either Democratic or Republican members on the committee. Rep. Keith Rothfus (R-PA), who championed the measure on the House floor last year, worked with the subcommittee chair this 6

year to include the provision in the committee's bill.

The provision language states the following: BOTTLED WATER SEC. 121. None of the funds made available by this Act may be used by the Director of the National Park Service to implement, administer, or enforce Policy Memorandum 11–03 or to approve a request by a park superintendent to eliminate the sale in national parks of water in disposable, recyclable plastic bottles.

“IBWA has many member companies to thank for reaching out to their members of Congress, encouraging them to overturn the NPS policy as ineffective and not in the public interest,” says IBWA Vice President of Government

Relations Kristin Pearson Wilcox. “While this sales ban policy does not impact the bottom line of many of the IBWA member companies engaged in this effort,” Wilcox explains, “they are showing great leadership on behalf of the industry in standing up against a federal policy that wrongfully restricts access to bottled water—the healthiest packaged beverage on the shelf that also has the lowest environmental footprint."

Other groups are echoing IBWA’s call to end the sales ban on bottled water. Citizens Against Government Waste (CAGW), an influential tax payer group, urged committee members to end the wasteful and misguided policy. In “CAGW to NPS: Show Me the Data,” an article published on its blog, CAGW stated

that “…the NPS [has] given very little thought to measuring the outcome of the bottled water ban; there were no metrics in place to quantify whether the ban would reduce waste.” (Read CAGW’s blog at bit.ly/ CAGW_NPS1.) In addition, in a letter dated May 24, 2016, to the Appropriations Subcommittee on the Interior, Environment, and Related Agencies, CAGW suggested the committee take the following action: “Since there appears to be no information from any park that the ban is reducing plastic waste after the policy was implemented more than four years ago, we believe the committee’s actions are appropriate and the provision should be retained."

IBWA MEMBERS ARE SHOWING GREAT LEADERSHIP ON BEHALF OF THE INDUSTRY IN STANDING UP AGAINST A FEDERAL POLICY THAT WRONGFULLY RESTRICTS ACCESS TO BOTTLED WATER. IBWA continues to work with leading nutrition groups, which have reached out to members of the Interior Appropriations Subcommittee to express support for ending the sales ban on bottled water at national parks. WATER NOTES PUBLIC WATER CONTAMINATION ISSUES

During the June 7, 2016, board meeting of the Drinking Water Research Foundation (DWRF), two Virginia Tech research scientists, Min Tang, a PhD candidate, and Otto Schwake, PhD, spoke to the trustees and others in attendance about the lead-contaminated drinking water crisis in Flint, Michigan.

Tang and Schwake work with Marc Edwards, PhD, a Charles P. Lunsford Professor at Virginia Tech, who is leading a research team, and collaborating with local residents, to address lead, pathogen, and water infrastructure issues caused by a failure to implement corrosion control treatment in Flint.

During the presentation–"The Flint, Michigan Water Crisis: Holding Paramount the Safety, Health, and Well-being of the Pubic"–Tang described how a switch in water sources in April 2014, from

Detroit water to the Flint River, coupled with no corrosion control was the perfect storm for the release of lead into the city's drinking water. The researchers’ lead results for the 90th percentile at first draw was 26.8 parts per billion (ppb), exceeding the Environmental Protection Agency’s (EPA) action level of 15 ppb.

(One sample reported at 158 ppb.) The Michigan Department of Environmental Quality was skeptical of the Flint Water Study Team’s results, but the city of Flint eventually went back to the original Detroit water supply in October 2015.

Since that time, the lead levels have dropped, but they still exceed the 15 ppb EPA action level requirement.

But that’s not the only issue concerning Flint residents. Increased incidence of Legionella also occurred during the crisis. Schwake reported that the lack of

corrosion control raised the water’s iron level, which in turn lowered or neutralized the disinfection residual. That led to a Legionnaire’s outbreak with a higher incidence rate than recently reported outbreaks, including the 2015 outbreak in the Bronx borough of New York City.

Since Flint changed water supplies last October back to Detroit water, the incidence of Legionella has lowered.

IBWA Members Discuss Bottled Water Issues on Capitol Hill On June 8, 2016, IBWA held its annual Hill Day to educate members of Congress about the bottled water industry and seek continued support for the policies that will promote the growth and consumption of bottled water. More than 40 IBWA members—bottlers, suppliers, and distributors from across the country—participated in this year’s Hill Day, which was a record-setting event for IBWA, with members holding more than 85 meetings with legislators and their staff.

IBWA’s visits were timely, as several issues important to the bottled water industry are up for debate in Washington, DC. IBWA members reviewed with legislators the importance of supporting a provision in the House Interior Appropriations’ Fiscal Year 2017 bill that defunds the National Park Service (NPS) policy that allows park units to ban the sale of bottled water. They also reminded members of Congress about the safety record of bisphenol A (BPA) and asked them to oppose unwarranted restrictions on the use of BPA in food packaging. Obviously, ensuring that school children have access to safe drinking water is a huge concern right now, so IBWA members urged legislators to support the USDA bottled water grant program in H.R. 5003 and work to ensure America has a strong municipal water supply.

To kick off IBWA Hill Day, members heard from Senator Lisa Murkowski (R-AK), who has played a critical role in helping the bottled water industry oppose the NPS bottled water sales ban policy. As a senior member of leadership for the U.S. Senate, Sen. Murkowski is the chair of the Senate Interior Appropriations Subcommittee and chair of the Senate Energy and Natural Resources Committee, which both have primary jurisdiction over funding and policy of the NPS. House Committee Creates $475,000 Bottled Water Grant Program for Schools in Emergency Situations On May 18, 2016, the U.S. House of Representatives Education and the Workforce Committee passed an IBWAsupported provision that would establish a $475,000 grant program to help states provide bottled water to schools and child-care facilities when they are faced with contaminated water supplies. This grant program would be administered by the U.S. Department of Agriculture (USDA).

IBWA worked with Committee Chair John Kline (R-MN) and Committee member Mike Bishop (R-MI), who represents Flint, Michigan, on the provision, which was included in H.R. 5003, “Improving Child Nutrition and Education Act of 2016.” The language amends Section 9 of the Richard B. Russell National School Lunch Act. These funds would be available when the president has declared a state of emergency, and it is determined that the public water system poses a significant risk to the health of school children. IBWA would like to thank Absopure Water Company (an IBWA bottler member) for helping communicate to key members of Congress the importance of this program.

The bill passed the committee by a vote of 20 to 14.

To become law, the bill now has to pass the full House of Representatives, be conferenced with the U.S. Senate, and then the provision must be included in the final Senate and House agreed to bill. IBWA member company representatives who participated in the association’s June 8, 2016, Capitol Hill Day asked their members of Congress to actively support this important program.

The USDA sets the rules for the federally funded National School Lunch Program and School Breakfast Program, which includes a requirement that participating schools make potable water available to children at no charge during the meal service. However, communities across the country face challenges in meeting that requirement when confronted with failing water infrastructure and natural disasters and other emergency situations that compromise the safety of the local water supply. When schools are unable to provide their students with safe, potable tap water, they may need federal assistance to obtain safe, healthy, consistently high-quality bottled water.

U.S. AND INTERNATIONAL DEVELOPMENTS AND STATISTICS Accelerating again after a strong surge the year before, the U.S. bottled water market hit an historic high point in 2015, when volume exceeded 11.7 billion gallons. Already the second largest beverage category by volume, bottled water once again demonstrated its capacity for vigorous growth.

Recent results confirm revitalization for the category. Like many other beverage types during the economic recession, bottled water experienced downturns in 2008 and 2009. In 2010, bottled water volume and sales returned to growth, and the category showed renewed strength by both measures in 2011. Growth in 2012 was the strongest it had been in five years, and 2013 saw another strong advance. In 2014, volume enlarged even more forcefully still. Growth quickened yet again in 2015, when it was the fastest it had been since 2006. Going forward, growth should remain solid as economic conditions become increasingly favorable.

As developments in other categories make plain, bottled water achieved a unique position in the overall liquid refreshment beverage marketplace. Although carbonated soft drinks remain by far the biggest beverage type in the United States, their volume contracted once again in 2015, as it has done every year since the mid-2000s. Fruit beverages have similarly struggled year after year, slipping from having volume similar to that of bottled water in the late 1990s to having volume less than one-third the size by 2015.

Just as bottled water did, some other liquid refreshment beverages, such as ready-to-drink tea and sports beverages, recovered from back-to-back down years to grow in each year from 2010 to 2015. However, those categories remained considerably smaller than bottled water. Even though sports beverages like Gatorade may actively compete with water for consumers seeking hydration, their volume was about oneeighth that of bottled water in 2015.

Before the economic challenges at the end of the century’s first decade, bottled water experienced a remarkable streak of fast volume growth, as chronicled in U.S. Bottled Water Through 2020, Beverage Marketing Corporation’s latest annual analysis of the market. During the 2000s, bottled water volume charted double-digit percentage growth rates in two years and advanced at rates close to that level in several others. Bottled water volume grew by close to 12 percent in 2002, and after growing by 10.8 percent in 2005, it enlarged by 9.5 percent in 2006. Departing from the pattern of preceding years, bottled water volume declined by 1.0 percent in 2008 and then by 2.5 percent in 2009.

In contrast to carbonated soft drinks, which followed several years of slow growth with multiple volume reductions, bottled water showed that two consecutive declines were aberrations rather than the beginning of a protracted slump. When bottled water volume began to grow again in 2010, it essentially restored volume to where it had been prior to the declines. Even stronger growth followed in each of the next five years. By 2015, volume achieved a new record: almost 3 billion gallons higher than it had been in 2007. Soft drinks, on the other hand, underwent their eleventh consecutive year of volume reduction in 2015.

Revenue Mirrors Volume Growth Bottled water producers’ revenues declined in both 2008 and 2009 as well, and they did so more dramatically than volume, but they also revived. Bottled water wholesale dollar sales first exceeded $6 billion in 2000. By 2007, they topped $11.5 billion. Category sales declined by more than

3 percent to $11.2 billion the following year and then by more than 5 percent to $10.6 billion in 2009. They inched upward in 2010 and climbed back above $11 billion in 2011. Wholesale dollars topped $11.8 billion in 2012 and approached $12.3 billion in 2013. They exceeded $13 billion in 2014 and topped $14.2 billion in 2015.

Consumption Trends Consumer demand for bottled water looks likely to remain strong in the years ahead. Changes in per capita consumption indicate enthusiasm for a product that consumers regard as a healthful alternative to other beverages. U.S. residents increased their annual consumption by more than 11 gallons, from 25.4 gallons per person in 2005 to 36.5 gallons a decade later. During the same period, per

capita consumption of carbonated soft drinks dropped by 12.6 gallons. Per capita consumption of major beverage categories (e.g., milk and fruit beverages) also fell.

Other types, including coffee and tea, were characterized by stability, though the ready-to-drink versions of both categories made gains. Those beverages associated with beneficial properties and functional benefits—a subset that includes packaged water as well as energy drinks, sports beverages, and ready-to-drink tea—were the most resilient elements of the beverage market after 2009. Nevertheless, average intake of beverages in bottled water’s competitive set (e.g., ready-to-drink tea and sports beverages) remained fractions of bottled water’s per capita consumption level.

Indeed, bottled water added more gallons to its per-person consumption rate in ten years than either ready-to-drink tea or sports beverages reached by the end of that period.

Multiple qualities contribute to bottled water’s evident attraction for U.S. consumers. Among them are bottled water’s associations with healthfulness, convenience, safety, and value. Bottled water’s versatility makes it suitable for consumption at any time of day and in just about any setting or situation. It doesn’t need to be kept ice cold (like soft drinks or juice) or warm (like conventional coffee or tea).

Various packaging types, among them 3- and 5-gallon containers and single-serve bottles, facilitate a variety of uses. Compared to other ready-to-drink commercial beverages, bottled water is relatively inexpensive. Further, aggressive pricing, especially in the retail polyethylene terephthalate (PET) segment, continues to make it more and more affordable. Consumers’ interest in beverages that deliver benefits above and beyond simple refreshment also contributes to the quintessential hydrating beverage’s ascension in the beverage rankings. Even though it has occasionally been compared with tap water, bottled water in fact realized its prominence by enticing consumers away from other packaged beverages perceived as less wholesome than bottled water. While some consumers may have moved away from regular, full-calorie sodas in favor of their diet versions, many others switched to bottled water instead. As some consumers became wary of artificial sweeteners, they abandoned diet as well as regular soda—while bottled water volume just got bigger.

Challenges to the beverage market’s growth lessened somewhat after the late 2000s. Energy, commodity, and other input costs contributed to higher prices for consumers.

That prompted them to seek savings by opting for smaller, more affordable unit sizes, eschewing pricier imports, or occasionally foregoing packaged beverages altogether, which largely explains what happened in 2008 and 2009.

The situation subsequently altered, and did so favorably from bottled water marketers’ perspectives.

Domestic non-sparkling water reliably reigns as the largest segment of the U.S. packaged water industry.

Even where tap water may be safely potable, many people prefer bottled water, which they regard as superior in taste.

The ready availability of packaged water wherever beverages are sold also crucially differentiates bottled water from tap.

then outperformed it again in 2010, 2011, and 2012. It moved very slightly slower than the total market in 2013.

Domestic non-sparkling water saw significantly faster growth in 2014 than in 2013, but it lagged the rejuvenated bottled water market as a whole, as it did once again for a third year in a row in 2015.

The non-sparkling category includes various components that typically perform quite differently from one another. In 2015, for the fifth consecutive year, all four segments registered growth, but did so at dissimilar rates.

Throughout most of the 1990s and 2000s, the retail premium segment—consisting of still water in single-serve PET bottles—drove the overall category’s development.

Indeed, the PET component enlarged by a double-digit percentage rate 16 consecutive times through 2007.

Growth slowed markedly in 2008 before it disappeared in 2009. Yet PET’s 0.9 percent reduction was far less than the 2.5 percent loss measured for bottled water in general.

Besides, PET volume in 2009 of almost 5.2 billion gallons stood more than 4.1 billion gallons higher than it had in 1999, and its share of total bottled water swelled from 24 percent to more than 61 percent during that ten-year period. In 2010, PET experienced the strongest growth of any bottled water segment, advancing by 6.8 percent to 5.5 billion gallons, which boosted its share above 63 JUL/AUG 2016

Like retail bulk, direct delivery faced competition from convenient PET bottles. The segment, which comprised the largest of them all as recently as the mid-1990s, accounted a bit more than 11 percent of total volume by 2015. U.S. home and office delivery (HOD) volume slipped from close to 1.4 billion gallons in the early 2000s to 1.3 billion gallons in 2015, when volume moved up by 4.1 percent.

percent. Growth slowed in 2011 but remained well in advance of the total market: volume greater than 5.8 billion gallons flowed from growth of 5.4 percent, which pushed PET’s share to 64 percent. In 2012, the segment saw its strongest showing since 2007, increasing by more than 8 percent to 6.3 billion gallons, which represented 65 percent of the overall market. Greater than 6 percent growth in 2013 propelled volume to nearly 6.7 billion gallons—essentially two-thirds of the total. In 2014, the segment advanced at an even greater rate than in 2012, catapulting volume above 7.2 billion gallons and market share to 66.5 percent. Still another year of acceleration in 2015 drove PET volume to nearly 7.9 billion gallons and share to more than 67 percent.

Retail bulk volume experienced some reversals as more than a few consumers chose convenient PET multipacks in large format retail channels instead of larger (1 to 2.5 gallon) sizes. Its share slid from nearly one-quarter of the category volume at the beginning of the century to about 9 percent by 2015, largely due to competition from PET. After multiple declines, the segment did grow each year from 2011 to 2015. Even so, retail bulk’s 3.7 percent uptick

The relatively small, essentially regional vending segment involving refillable jug containers achieved growth even in the years when total bottled water volume declined. Its low cost during economic hard times undoubtedly had something to do with vending’s positive results. It continued to grow in 2015, albeit at a far slower rate than any other segment of the domestic still water market or the bottled water market as a whole.

The two segments outside the domestic non-sparkling realm—imports and sparkling—grew in 2015, and both did so dramatically. The imported water segment, the smallest of them all, is prone to fluctuations. In the 2000s, it registered double-digit percentage growth in some years, and equally sizeable contractions in others. Global bottled water consumption topped 87 billion gallons in 2015.

2007, imported water’s volume fell sharply in 2008 and then plummeted precipitously in 2009. It continued to shrink in 2010 before inching up modestly in 2011.

Volume dropped sharply again in 2012, but it did move up (at a market-lagging pace) in 2013. In 2014, in contrast, imports notched their first double-digit growth rate since 2007. And in 2015, they advanced at an even faster clip. Sparkling water held a small share of bottled water volume but grew at an even more explosive rate than imports, let alone retail PET, in 2015.

Domestic non-sparkling water accounted for almost all per capita bottled water consumption in 2015, as usual.

Sparkling water volume worked out to about 1.3 gallons per person. (With imports, the figure translated into about four-tenths of a gallon per U.S. resident.) In the key PET portion, average intake moved from 13.4 gallons in 2005 to nearly 25 gallons ten years later.

International Developments Bottled water became a beverage industry phenomenon not only in the United States—until fairly recently the No. 1 market in terms of volume—but also in virtually every major geographical region of the world. Bottled water initially emerged as a large, mainstream commercial beverage category in Western Europe, where consumption of it has long been part of many residents’ routines.

It now stands as a truly global beverage. Several Asian markets achieved strong growth to become major bottled water markets during the 2000s. In fact, Asia itself became the largest regional market in 2011, edging out North America and easily outshining Europe. After having moved ahead of Mexico to claim the No. 2 position in 2012, China surpassed the United States to take the lead in 2013. By 2015, China accounted for close to onequarter of global bottled water volume.

Global bottled water consumption is estimated to have topped 87 billion gallons in 2015, according to data from the latest edition of Beverage Marketing’s The Global Bottled Water Market. Total consumption swelled by more than 6 percent during the year. Per capita consumption of close to 12 gallons represented a gain of 2.8 gallons over the span of five years.

Of course, per capita consumption by individual region or country can diverge significantly from the global average.

For instance, several Western European countries have per capita consumption levels far above 25 gallons, and the No. 1 market had average intake of almost 65 gallons in 2015.

At the same time, much of the developing world, where the majority of the world’s population resides, finds its per capita consumption figures still in the single-digit range.

Even though the global per capita consumption figure obscures pronounced regional disparities, bottled water’s international growth signals demand for it in diverse markets. Consumers have demonstrated a thirst for it in highly developed markets, in less developed ones, and in economies in transition. Bottled water tapped into some different consumer trends around the globe. In developed countries such as the United States and Canada, bottled water became a particularly dynamic major commercial beverage category by registering as an appealing option for health-conscious consumers. Marketers positioned bottled

Health-conscious consumers continue to choose bottled water. water as a virtuous alternative to carbonated soft drinks and fruit juice drinks (some of which comprise sizeable portions of their own product portfolios). The developed world came to view bottled water as not only a way of achieving hydration but also as a functional beverage. At the same time, bottled water serves as at least a partial solution to the problem of often-unsafe water found in many economically developing countries.

Although much of the world’s bottled water market is still highly fragmented and controlled by local brands, consolidation has occurred. Four companies came to dominate much of the market. Swiss food and beverage giant Nestlé and France’s Danone are the traditional leaders of the bottled water pack. Both companies originally centered their operations around the core markets of Western Europe and the United States. However, as water growth is increasingly coming from the developing world, Nestlé and Danone expanded their initiatives to the competitive fields of Asia, Latin America, and other areas. Danone actually stepped back from the U.S. market to focus on JUL/AUG 2016

some of those other markets. Soft drink industry leaders Coca-Cola and PepsiCo have achieved solid positions in the U.S. bottled water arena and have increasingly devoted resources and energy to developing their global bottled water businesses.

North America boasts two of the three largest individual bottled water markets with the United States and Mexico, which together represented for 22.8 percent of the world’s packaged water market in 2015. Although the U.S. bottled water market had been a catalyst for much of the global expansion up until the mid-2000s, its compound annual growth rate (CAGR) of 6 percent for the five-year period ending with 2015 was slower than the 6.9 percent CAGR achieved by the growth of the global market during the

same period. Mexico alone accounted for 9.3 percent of the global volume, with 8.1 billion gallons in 2015. With a five-year CAGR of almost 3.1 percent, it grew much more slowly than either the United States or the world market.

Besides the United States, China—with 20.5 billion gallons—was the only other country that could claim a double-digit share of global volume and a percentage of the total market higher than the combined shares of the second and third largest markets in 2015. Chinese bottled water volume enjoyed double-digit percentage growth rates for several consecutive years, registering a 14.3 percent CAGR for the period from 2010 to 2015—the highest rate among the ten biggest bottled water markets. Fourth-place Indonesia moved well ahead of the international market, which allowed it to vault over erstwhile-No.4 Brazil. India, the No. 3 Asian market, ranked sixth overall. Thailand grew even faster than Indonesia and India, but lagged China.

Europe may not boast any of the biggest bottled water markets, but it does have several major ones, including three of the ten biggest. Because those markets are firmly established, however, their growth tends to be slower than those where bottled water has a less deeply established tradition. Some of the most prominent continental countries experienced only very slight growth. For instance, during the five-year period ending with 2015, Italy’s volume grew by a CAGR of just 1.5 percent. Germany, the eighth largest bottled water market in the world, had a CAGR of 1.3 percent, and tenthplace France moved only slightly faster. As a group, the trio of leading European bottled water markets accounted for 9.6 percent of the world’s total volume in 2015.

Still water accounts for the majority of bottled water sales in much of the world. Sparkling water sales are strong in a minority of countries—such as Argentina, Chile, Uruguay, the Netherlands, and Germany—where sparkling water is often tied to meal-consumption habit. On a global level, sparkling water accounts for an estimated 10 percent of the total volume, with still water accounting for the remaining 90 percent.

Plastic packaging is preferred over glass in almost every country. Even in Germany and other countries, such as the United Kingdom, where glass has a strong presence, PET is the most dynamic and rapidly growing segment. At about one-third of global volume, HOD still accounts for a minority of global bottled water sales. Yet it is a vital segment in many countries, such as Mexico, where it accounts for more than two-thirds of the volume.

Mexico regularly leads the world in bottled water per capita consumption, and that didn’t change even after

China surpassed it in absolute volume. Average intake in Mexico jumped from 58.9 gallons in 2010 to 64.5 gallons five years later. Per capita consumption in China stood more than four times lower, at 14.6 gallons, in 2015. The not-long-ago leader in average intake, Italy, consumed the equivalent of 47 gallons per person in 2015, which put it in third place behind Thailand, which in 2010 consumed the equivalent of 30 gallons per person but had upped average intake to 53.8 gallons by 2015.

Several Middle Eastern markets rank very highly in per capita bottled water consumption. With the equivalent of more than 30 gallons for each resident in 2015, Saudi Arabia had the ninth highest level of bottled water consumption in the world. In addition to Saudi Arabia, the Middle East region had the United Arab Emirates and Lebanon in the top 20 in per capita bottled water consumption. At 20 gallons per resident, Kuwait also consumes bottled water at a rate greater than the global average, though it didn’t quite make it onto the top 20 list.

Although Europe no longer held the top spot in volume per capita, nine of the top 20 bottled water consumers on a per person basis were European countries as of 2015.

The consumers of the combined market of BelgiumLuxembourg imbibed more than 35 gallons each, a rate that tended to move upward over the years. Germany, France, Spain, and Italy were the other European countries with per capita consumption greater than 30 gallons. French consumers quaffed two gallons more bottled water in 2015 than they had five years earlier. In 2015, Germany and Spain had per capita consumption rates of 37.6 and 30.4 gallons, respectively, putting them in fourth and eighth place in terms of average bottled water intake. Like France, Germany consumed more bottled water per person in 2015 than it had five years before. Hungary, which ranked eleventh, also increased its bottled water consumption, though only JUL/AUG 2016

If current trends persist, bottled water could emerge as the largest U.S. beverage category by volume by 2017, if not by the end of 2016. slightly. Other European markets among the top 20 were Austria, Switzerland, and Poland.

While Asian nations attained prominence among the world’s bottled water markets when measured in total volume, the most populous countries generally do not have high per-person intake levels. The Chinese special administration region of Hong Kong made the list for the first time as its average intake approached 22 gallons in 2009 and continued to increase per capita consumption subsequently, hitting 28.4 gallons in 2015. Despite its status as the largest market, mainland China did not rank among the top 20 markets in per capita consumption in 2015, although intake had climbed above the global norm by that point.

Americans’ 2015 per capita bottled water consumption put the United States in the No. 6 position among the countries of the world, right behind France.

Future Growth for Bottled Water Beverage Marketing Corporation expects bottled water, having put the softness of the late 2000s behind it, to reconfigure the U.S. multiple beverage marketplace during the second decade of the 21st century much as it did earlier, gaining market share all the while. The total amount of liquid Americans annually imbibe will remain stable, resulting in overall volume growth in line with population increases. Bottled water is likely to grow much faster, unlike carbonated soft drinks or fruit beverages, which will continue to lose ground. Most other major beverage categories, including coffee and tea, are likely to grow much more slowly than bottled water, which is on track to achieve still another high in per capita consumption in the future.

If current trends persist, bottled water could emerge as the largest beverage category by volume in the country by 2017, if not by the end of 2016.

Managing Outside the Box, Coast to Coast How IBWA works with in-state counsel to address industry issues

The United States is more than 3.5 million square miles. That’s a lot of space to cover for IBWA’s two-person government relations (GR) department, especially when you’re discussing the issues, concerns, well-being, and future of the bottled water industry. We can’t be everywhere, but we do need to address industry issues at the national, state, and local levels. To do that, in addition to engaging with IBWA members, we often work with federal, state, and local lobbyists. These experts understand the unique ways the feds and each state capitol works, and they are well-versed on the multidimensional nature of the topics our industry faces.

For our work in the states, it sometimes becomes necessary to retain in-state counsel. In the following text, we describe two issues tackled by IBWA in 2016 that provide insight into how we’ve collaborated with counsel and members to promote industry interests.

Oregon: Ensure a Path Forward Redemption numbers for all beverage products have been on a downward trend in Oregon since 2012, which provided a warning that, by law, the state’s bottle deposit fee would probably increase from 5 to 10 cents. A

quick survey of the legislative environment showed that stopping the likely increase was not feasible. Before being hired by IBWA on this issue, counsel we had retained previously in Oregon had assessed the situation—and that background knowledge helped IBWA ensure a path forward to an outcome the bottled water industry could live with. After several discussions with the parties impacted by the increase, IBWA and our in-state counsel got a consensus on how to proceed.

Lesson 1: Ask counsel to conduct the initial legwork that will support how to move forward on an issue. In Oregon, we had Richard Kosesan as a

GOVERNMENT RELATIONS great asset because, even before IBWA hired him, he had met with the parties that would be affected by the increase in the deposit program fee. The information he gathered helped IBWA decide that, rather than fight the inevitable, we should negotiate a plan that would give our members enough time to comply with the legislation.

Lesson 2: Know that not every state lobbyist has established relationships that can help our members. Because IBWA’s GR staff is small, having in-state counsel who can work with us to get industry’s perspective heard is paramount.

Through open and honest dialogue with elected officials, IBWA has the best chance of ensuring legislators with oversight on issues important to the bottled water industry know all the facts before deciding on an issue.

Connecticut: Know the Players A planned and approved bottling plant in Bloomfield had adversaries turning to state lawmakers in an effort to stop the facility from being built. When bottled water industry critics tried to push through an onerous piece of legislation that could have impacted state water bottlers, IBWA retained the firm Sullivan & LeShane for help. Anyone who has spent any time at the Connecticut Capitol in Hartford knows this firm.

Lesson 3: A relationship is like building a house: build it well or it will collapse. Strength in numbers is always a good lobbying strategy, and, in order to have that, you need to work with people who understand your industry concerns and can work with you to educate the appropriate players.

conducted over the years. When IBWA needed to look beyond our known universe for allies against a bill, the firm was able to not only identify those possible allies but also help us engage with them. IBWA was only able to sculpt a favorable outcome for the industry by having opportunities to educate policy-making legislators in the state.

Lesson 4: Knowledge is power— and what you don’t know can hurt you. With years of experience, Sullivan & LeShane has basically worked on every issue that has progressed through the Connecticut legislature. IBWA was able to rely on them to provide insight on how best to frame our issue. In addition, rather than waste time canvasing all elected officials in the state, Sullivan & LeShane directed us to those legislators who needed to learn about industry issues before making any policy decisions. When IBWA staff and members spent time in Hartford, we were able to hold

productive meetings. Because the firm had knowledge of the unique process bills traverse in the state, we were able to promote an educational campaign that helped to ensure decision makers affecting policy on bottled water issues were aware of all the facts—and didn’t have just the opinions of our adversaries.

Education Is Key The U.S. bottled water industry is a $14 billion business. While IBWA’s two-person GR staff is able to work with members to procure some great outcomes for the industry, there are times when we need to retain counsel in the states. When we do, we rely on those relationships to help us fine-tune our legislative strategies to secure the best possible outcomes for the bottled water industry. Ultimately, it’s all about ensuring that the legislators who will make policy decisions affecting your company know the facts. So far in 2016, IBWA’s members, staff, and in-state counsels have been able to do just that.

The Consumer Speaks: Bottled Water Poised to Be America’s Leading Packaged Beverage But challenges are on the horizon

When it comes to choosing packaged beverages, American consumers are speaking with their wallets—and the clear winner is bottled water. The cover story for this issue of Bottled Water Reporter presents Beverage Marketing Corporation’s (BMC) recently released 2015 bottled water statistics, which show consumption hit a historic high in 2015 when volume exceeded 11.7 billion gallons (a 7.6 percent increase over 2014 and almost 3 billion gallons

higher than it had been in 2007). Sales were also up by 8.7 percent, reaching $14.2 billion (wholesale). BMC predicts that if these trends continue (as expected) bottled water will overtake soft drinks as America’s largest beverage category by volume by 2017, if not by the end of 2016.

For decades, sodas have been the most consumed packaged beverage in America, but today bottled water has become the fan favorite. Consumers are getting more and more health conscious about

what they eat and drink. In restaurants, sales trends show that soft drinks orders are dropping sharply compared to previous years. This pivotal change indicates a shift in consumer behavior—with significant ramifications. In Roberto Ferdman’s Washington Post article “The Trend Restaurants Could Really Do Without” (wapo.st/1NZExDL), he relays that research by Mintel shows that “almost a quarter of Americans said they are ordering soda less often

COMMUNICATIONS than they were at this time a year ago.”

This new information shows that even when consumers treat themselves to (often less-healthy) meals at restaurants they are not ordering soda nearly as frequently. Ferdman notes that water, and bottled water, may be the main beneficiaries of this cultural change.

A New York Times article also confirms that sales of bottled water have shot up, while sodas sales are stagnating as more Americans actively try to avoid soft drinks (“The Decline of ‘Big Soda,’” nyti.ms/1Uph7XJ). That insight concurs with BMC data showing every American drank, on average, 36.5 gallons of bottled water in 2015—an increase of 11 gallons over the amount Americans consumed in 2004. Comparably, per capita consumption of soft drinks dropped by 12.5 gallons during that same time frame. (In addition, BMC reports that the soft drink category

underwent its eleventh consecutive year of volume reductions in 2015.)

Dark Underbelly of Success However, there’s another side to this story that we must remember. As more and more Americans drink bottled water, helping it make marketplace gains, we will become an even bigger target for our critics. Our adversaries continue their attacks on the healthiest packaged beverage on the shelf, with false claims about their environmental impacts. However, those claims are continuously proven false and misleading—revelations our consumers have noticed. Still, in 2016 we’ve seen coordinated and well-executed campaigns opposing bottled water plants in Oregon and Connecticut—even as the delivery of vitally needed bottled water was celebrated in the beleaguered city

of Flint, Michigan, which has lead contaminated tap water.

The landmark shift we expect to see moving into 2017, as the popularity of bottled water displaces that of soft drinks, will usher in a new era of scrutiny. As an industry, we need to work together to educate consumers, the media, and legislators about the truth about bottled water. It is up to us to better communicate the strong, positive, and accurate story of bottled water and all the work, commitment, and environmental stewardship that goes into our companies and products.

With any good marketing or political campaign, it’s a local and a personal effort. If we are not proactively and transparently telling our story to the people, media, legislators, and regulators who directly impact our companies at the state and local levels, then our opponents will gladly do it for us.

How FDA's Sanitary Food Transportation Final Rule Will Impact Bottled Water Operations

As of April 6, 2016, the U.S. Food and Drug Administration’s (FDA) Food Safety Modernization Act (FSMA) rule on Sanitary Transportation of Human and Animal Food is final. With some exceptions (listed below), the final rule applies to shippers, receivers, loaders, and carriers who transport food in the United States by motor or rail vehicle, whether or not the food is offered for or enters interstate commerce. In general, water that is intended for bottling, and 56

is shipped in bulk water tankers, will be subject to portions of the rule. Finished bottled water product in sealed containers and in shipping cartons or packaging will be exempt.

Requirements Specifically, the rule would establish requirements for the following: • Vehicles and transportation equipment. The design and maintenance of vehicles and transportation equip-

ment to ensure that it does not cause the food that it transports to become unsafe. For example, vehicles must be suitable and adequately cleanable for their intended use and capable of maintaining temperatures necessary for the safe transport of food.

Transportation operations. The measures taken during transportation to ensure food safety (e.g., adequate temperature controls) preventing contamination of ready-to-eat food from touching raw food, protection of food from contamination by nonfood items in the same load or previous load, and protection of food from cross-contact (i.e., the unintentional incorporation of a food allergen).

Training. Training of carrier personnel in sanitary transportation practices and documentation of the training. This training is required when the carrier and shipper agree that the carrier is responsible for sanitary conditions during transport.

Records. Maintenance of records of written procedures, agreements, and training (required of carriers).

The required retention time for these records depends upon the type of record and when the covered activity occurred, but that time does not exceed 12 months.

Scope of the Rule The regulation covers shippers, loaders, carriers, and receivers engaged in “transportation operations” unless they, or the food they transport, are specifically exempted. These terms are defined as follows: • “Shipper” means a person (e.g., the manufacturer or a freight broker) who arranges for the transportation of food in the United States by a carrier or multiple carriers sequentially.

• “Loader” means a person that loads food onto a motor or rail vehicle during transportation operations.

TECHNICAL UPDATE “Carrier” means a person who physically moves food by rail or motor vehicle in commerce within the United States. The term “carrier” does not include any person who transports food while operating as a parcel delivery service.

• “Receiver” means any person who receives food at a point in the United States after transportation, whether or not that person represents the final point of receipt for the food.

Food that is completely enclosed by a container—except for food that requires temperature control for safety—is not covered by the rule. Therefore, once in its final sealed container and in shipping cartons, bottled water transportation is exempt from the Sanitary Food Transportation (SFT) Rule.

•

Requirements for Vehicles and Transportation Equipment The regulation establishes requirements that apply to vehicles and transportation equipment used in association with food transportation. “Transportation equipment” includes bulk and non-bulk containers, bins, totes, pallets, pumps, fittings, hoses, gaskets, loading systems, and unloading systems. These items must be the following: • Designed and of such a material and workmanship to be suitable and adequately cleanable for the intended use to prevent the food from becoming adulterated.

• Maintained in such a sanitary condition for their intended use as to prevent the food from becoming unsafe during transportation operations.

• Stored in a manner to prevent harborage of pests or contamination that could result in food becoming unsafe during transportation operations.

• If applicable, designed, maintained, and equipped as necessary to provide adequate temperature control to prevent food requiring temperature

control for safety from becoming unsafe during transportation operations.

General Requirements for Shippers, Carriers, Loaders, and Receivers The regulation establishes general requirements that apply to all shippers, loaders, carriers, and receivers engaged in transportation covered by the rule.

As noted above, a person may be subject to these requirements in multiple capacities (e.g., the shipper may also be the loader and the carrier). In addition, entities subject to the regulation may reassign their responsibilities to another party subject to the rule through a written agreement.

The rule establishes the following general requirements: • Responsibility for ensuring that transportation operations are carried out in compliance with the regulation must be assigned to competent supervisory personnel.

• All transportation operations must be conducted under appropriate conditions and controls to prevent the food from becoming unsafe during transportation operations, including taking measures: (i) such as segregation, isolation, or the use of packaging to protect food from contamination by raw foods and nonfood items in the same load. (ii) such as segregation, isolation, or other protective measures (e.g., hand washing) to protect food transported in bulk vehicles or food not completely enclosed by a container from contamination and cross-contact during transportation operations. (iii) to ensure that food that requires temperature control for safety is transported under adequate temperature control.

• The type of food (e.g., animal feed, pet food, human food) and its production stage (e.g., raw material,

ingredient, finished food) must be considered in determining the necessary conditions and controls for the transportation operation.

Effective Dates Recognizing that businesses, especially small businesses, may need more time to comply with the requirements, the compliance dates are adjusted accordingly.

• Small businesses. Businesses other than motor carriers that are not also shippers and/or receivers employing fewer than 500 persons and motor carriers having less than $27.5 million in annual receipts would have to comply two years after the publication of the final rule: April 6, 2018.

• Other businesses. A business that is not small and is not otherwise excluded from coverage would have to comply one year after the publication of the final rule: April 6, 2017.

VALUE OF IBWA MEMBERSHIP TERRY CLARK CHIEF OPERATING OFFICER ALASKA GLACIER PRODUCTS, LLC ANCHORAGE | ALASKA ALL ABOUT TERRY On occasion, people have misjudged Terry because of his Ozark drawl; however, he has a lot of worldly experience, including living in Europe and the Caribbean.

When not working, he is flying his Beechcraft V-tail Bonanza—or traveling with his wife, playing golf, fishing, or talking with friends around the world on his ham radio.

Although an entrepreneur at heart, Terry also worked as a professional pilot and in aviation management for 25 years.

It seems Terry Clark was born to work in the beverage industry, starting out as a nine-year-old selling sassafras tea in the Missouri Ozarks and then later as director of special projects at Alaska’s only dairy—Matanuska Maid Dairy, which started bottling water at its facility in the early 1990s. Seeing the potential in water, Terry was involved in forming Alaska Glacier Products, LLC in early 2011.

“Most of my peers thought we were crazy to start [the bottled water] business, especially because of the logistics associated with Alaska. But we knew the pristine imagery, uniqueness, and global awareness of our wonderful state would give us instant recognition as a premium brand—and it’s working," says Terry.

Terry’s IBWA membership dates back to when the dairy he worked at started bottling water in the early 1990s. He says that access to IBWA’s technical information was key in helping to set up the water bottling operations at both the dairy and Alaska Glacier Products: “IBWA showed us how to do it right—giving us the basics and a foundation to build a successful bottling company.” He adds that technical support really is worth the whole price of membership at IBWA. More recently, Terry, who sits on IBWA's Technical and Government Relations Committees, appreciates the relationship building experiences he has had with industry peers and legislators. “As an industry, we are stronger when we speak with one voice. I am proud of my work with IBWA and try to meet with my legislators often to educate them about bottled water. It is valuable to our business. The more aware our state, federal, and local legislators are about the jobs and economic growth our industry brings to a community, the better decisions they will make on our behalf.” IBWA’s Kristin Pearson Wilcox, vice president of government relations, can attest to Terry’s great contributions to IBWA’s recent legislative efforts: “Terry has been instrumental in helping the association galvanize key members of Congress, like his home-state Senator Lisa Murkowski (R-AK), to work toward ending the National Park Service (NPS) policy allowing park units to ban the sale of bottled water. Senator Murkowski leads the committee with congressional oversight over the national parks and addressed IBWA’s June 8, 2016, Hill Day luncheon based on Terry’s invitation.”

Alaska Glacier Products bottles small-pack premium brands and private label products using water from the Eklutna Glacier. Its bottled water is enjoyed both domestically and internationally, with a focus on Asia—including current markets in Japan, China, and Korea. Like real estate, Terry has found producing water in Alaska is all about location, location, location. As he explains, “In our case, having the only authentic glacial source on the planet that’s close to a deep water port is a tremendous advantage.”
