TAX INCENTIVE FOR INTERNATIONAL PRODUCTIONS International films and TV series shooting in mainland Spain may benefit from a 20% tax rebate as stated in Article 36.2 Law 27/2014 dated the 27th of November, on Corporation Tax, “Rebates for investments in film and audiovisual series, live performances and musical shows”. The incentive can be accessed through Spanish producers registered on the Ministry of Education, Culture and Sport’s Film Company Register, who are managing a foreign production, i.e. work as the ‘’service company’’ which takes on the executive production in Spain. The Spanish producer carries out the tax procedures involved in applying for a tax rebate. Foreign production types: Feature length films, television series, animated films and documentaries. __ Maximum rebate limit: 3 million Euros. __ Beneficiaries: Spanish companies which are registered in the Film and Audiovisual Arts Institute’s register of audiovisual producers. __ Rebate base: eligible expenses incurred in Spain. __ Eligible expenses: creative staff with a registered address in the country or in another European Union member state, up to a maximum of €100,000 per person. Technical or complementary service. __ Minimum expense incurred in Spain: 1 million Euros. __ Procedure: the refund must be applied for by the Spanish company, during the month of July of the year after the end of filming. There may be changes in the laws which regulate these incentives. It is advised to take any accounting, legal or investment decisions upon further consultation with legal advisors that can assess your production in deeper detail.

TAX CREDIT FOR NATIONAL SHOOTS AND COPRODUCTIONS Spanish productions and international coproductions can gain access to tax credit on Corporation Tax once they have obtained their Spanish nationality and cultural certificates issued by the ICAA, and once a copy of the production has been deposited at the Spanish Film Archive or in a film library which is officially recognised in an Autonomous Community. Current applicable legislation is Article 36.2 Law 27/2014 dated the 27th of November, on Corporation Tax, “Rebates for investments in film and audiovisual series, live performances and musical shows”. Summary of the article: Spanish investments in film and audiovisual production are often carried out via an EIG (Economic Interest Grouping) which is set up as the film’s producer. These investments give the producer the right to a tax credit of 25% of the first million Euros, and 20% if the investment is higher, with a maximum of 3 million Euros per production. __ The base for the deduction is equal to the total production cost plus the cost of copies, advertising and promotion financed by the producer (with a limit of 40% of the production cost). __ The law establishes a territorial requirement and 50% of the deduction base must correspond to the expenses incurred in Spain. __ The total tax incentive amount received must not exceed 50% of the production cost. __ In the case of a coproduction, the amounts will be determined for each coproducer, according to their respective share-percentage of the coproduction. __ Once the film’s nationality certificate has been obtained and the rest of the requirements have been fulfilled, the tax rebate can be applied for during the month of July in the year after the production end-date. The laws which regulate these incentives may change every year, so it is worth finding out what, if any, aspects have changed, during the year you are making the investment. It is advised to take any accounting, legal or investment decisions upon further consultation with legal advisors that can assess your production in deeper detail.

COPRODUCE WITH CATALONIA Coproductions with Catalonia are governed by Spain’s international treaties. As such, all coproductions approved by the ICAA (Spanish Film Institute) or ICEC (Catalan Institute for Cultural Companies) are considered national productions, thus, the Catalan participation of the coproduction can apply for the same sources of funds as a purely national production. Catalan producers can benefit from financial assistance from the ICAA (Spanish Film Institute) and ICEC (Catalan Institute for Cultural Companies) for the film creation, production and promotion and can also access tax credits on investments in filmmaking and audio-visual productions.
Catalan Regional Funds ICEC (Catalan Institute for Cultural Companies) is the agency responsible for supporting film production and cinema in Catalonia. Following is an overview of the different lines of support.
Development Funding Development support for audiovisual projects from the treatment stage through to prepreproduction, focusing also on the communication and marketing strategy. It is a nonrefundable grant that supports a wide range of genres and formats, from feature films to TV drama, TV documentaries or animation series. Also interactive documentaries.
Production fund (fiction and documentary) Four different lines of funding: a. Fiction __ Feature film projects with commercial ambition aiming at international audiences. Assessment based on industrial criteria: strong financial plan, coproduction agreements (in place or deal memos), coherent marketing and commercial plan with solid artistic content. __ Feature films originated and creatively led by Catalan talent - directors, writers, producers - the content of which may express Catalan culture in some way. Assessment criteria take both industrial and cultural aspects into account. __ Intended for smaller feature film productions, which are likely to take more artistic risks, the line’s main assessment criteria will be based on the cultural excellence of the production. b. Documentary Focusing mainly on the director’s point of view, the aim of this line of support is to promote the production of auteur documentaries that will have a theatrical release.

Television fund (fiction and documentary) Fiction made-for-television productions (movies, mini-series and series) can apply for production funding. TV Movies and mini-series, intended mostly for the local market, are required to have secured broadcasting in Catalonia, whereas funding for TV Series encourages international coproductions. TV Documentaries, aimed at the national market, require the participation of a TV broadcaster that operates in the whole of Catalonia.
Animation fund A specific line of support for animation productions, intended for television (series and movies) and theatrical release (feature films). Assessment based on artistic and industrial criteria.
Short films fund Open to fiction, documentary, animation and experimental shorts as well as international coproductions. The short films are assessed in terms of artistic, cultural and industrial criteria.
P&A fund Funds for producers to enhance the promotion of films in Catalan original version. *Funding regulations for 2018 were not implemented before this catalogue went to print. Please contact us for further information.

A Contracorriente Films Fiction. Documentary A Contracorriente is committed to European and independent quality films with the potential to reach a broad audience. Ayhe Productions Fiction David Aymerich (Tarragona, 1994) founded Ayhe Productions in 2012 to produce the feature movie Sweet Lemon – El dulce sabor del limón (Aymerich’s first work as director and screenwriter). The Catalan Institute for Cultural Companies (ICEC) is a public institution of the Government of Catalonia’s Ministry of Culture that looks after the development and the consolidation of the Catalan creative sectors as an uplift for its professionalization. ICEC advises and accompanies Catalan companies in their development process in several sectors such as: music, performing arts, visual arts, audiovisual, books and digital culture. Catalan Films & TV is the program used by ICEC for the international promotion of Catalan audiovisual industry. Catalan Films & TV aims to increase the participation of the Catalan audiovisual industry at international markets and to encourage the coproduction and distribution of Catalan projects. In addition, it also supports films and talent that have been selected to attend international festivals around the world and acts as the industry’s official representative at key festivals and markets. The Catalunya Film Commission (CFC) is run by ICEC. Its main objectives are to promote and facilitate film shoots throughout Catalonia and stimulate the growth and consolidation of the Catalan film industry and associated services over the territory. At the CFC we help professionals prepare their shoot in our territory, giving assistance in their search for locations, informing on shooting conditions and film permits and providing general advice on filming in Catalonia.
