PMSA CHAPTER BRIEFING No. 41 Employer Continues to Argue Accomplished Teacher Really Means Lead Teacher Fair Work Conciliation Conference to be Reconvened to 16 April 2012 Dear Colleagues
An initial Conciliation Conference occurred yesterday (27 March 2012) in Fair Work Australia on the dispute between employees and the PMSA on the provision of an Accomplished Teacher classification as provided for in the Enterprise Agreement and the more onerous Lead Teacher provision unilaterally tabled by the PMSA to employees. After listening to submissions from both parties, Commissioner Spencer identified a number of issues she required additional information on and ordered the reconvening of the Conciliation Hearing on 16 April 2012 to further consider the key issues in dispute. Noting the urgency of the matter and the current efforts by the PMSA to present the disputed Lead Teacher classification as a fait accompli, Commissioner Spencer required the Parties to provide specific reasoning, supported by documentation, by 10 April and has reconvened the Conciliation Conference for 16 April 2012. Your union will continue to argue in documents and at the 16 April Conference that the employer is in breach of the Enterprise Agreement which clearly made provision for an Accomplished Classroom Teacher classification. A further Briefing will be issued after the 16 April 2012 Conference in Fair Work.
