Applying for a Position in the Non-Government Sector 1.

The Non-Government Education Sector The non-government education sector includes Catholic Systemic and Non-Systemic Schools, Anglican Systemic and Non-Systemic Schools, the Lutheran School System, the Presbyterian Methodist Schools Association, the various Grammar Schools, Christian Community Schools, stand-alone independent schools, the Early Childhood Sector (Kindergartens and Preschools), Business Colleges, English Language Colleges and International Colleges. The Queensland Independent Education Union (QIEU) provides union coverage and a range of industrial and professional services to employees in the non-government sector.

2.

Industrial Regulation Employment conditions in the non-government sector are regulated by Awards and Certified Agreements and Deeds of Settlement (if one has been negotiated). Your employer is required to provide employees with access to these documents. A.

AWARDS The following Awards regulate the working conditions of employees in the non-government sector: (a)

Teachers’ Award - Non-Governmental Schools (TANGS): Covers primary and secondary teachers in non-government schools.

(b)

Early Childhood Education Award – State (ECHEA): Covers teachers and assistants in community pre-schools and kindergartens.

(c)

School Officers’ Award – Non-Governmental Schools (SOA): Covers clerical support staff, teacher aides, laboratory assistants and similar occupations in primary and secondary non-government schools.

(d)

English Language Colleges Award (ELICOS): Covers teachers and instructors in English Language Colleges.


B.

CERTIFIED AGREEMENTS & DEEDS OF SETTLEMENT The conditions contained in Awards can only be improved by negotiating new provisions in a Certified Agreement or Deed of Settlement. A separate Certified Agreement or Deed applies to each employer. Not all employers have negotiated and entered into a Certified Agreement or Deed. This has significant implications for the wages and conditions you are entitled to as an employee.

Wage Rates Your employer must pay the relevant Award Rate. If you are a teacher covered by TANGS you may receive less than the Award if you choose to appear before a Magistrate and state in a private interview that you are teaching for religious purposes. Please note that if you exercise the exception provision you exempt yourself from all of the Award provisions including wages, sick leave, holiday pay, allowances, hours of duty and the like. [Award Rate for Band 2 Step 1: $36,963 p.a. as at September 2006] [See Attachment 1: Award Rates] Typical Certified Agreement Rates Each employer who has negotiated a Certified Agreement will have a separate salary schedule. However, the attached rates [Attachment 2: Typical Certified Agreement Wage Rates] are typical of the rates currently being paid in the non-government sector. [Typical Certified Agreement Rate for Band 2 Step 1: $45,145 as at 1 May 2006] These rates are also effectively the same as those rates paid in State schools. It is vital that you establish with your employer whether a Certified Agreement operates in the school and obtain a copy of the salary schedule. The difference between the Award rate and a typical Certified Agreement rate can be as much as $8,182 per annum for a Band 2 Step 1 Teacher (as at 1 May 2006).

4.

Hours of Duty Award Provisions TANGS makes the following provisions: Secondary Schools ................30 hours per week Primary Schools ....................27.5 hours per week Certified Agreements A number of employers have established certain hours of duty provisions in the respective Certified Agreement.

General As an applicant you must keep in mind that you are seeking a position in private industry. The applications are as if you were applying for any position in private industry.

Your application needs, therefore, to take the form of a private sector application in which you seek to convince the employer of your value as a potential employee. There may not always be specific selection criteria to address in your application. As a general guide you should point to your background and skills in the areas of: (a) (b) (c)

Academic / Subject areas Pastoral Care of Students The 'Other' Curriculum (see below).

Most positions are advertised through the employment section of The Courier Mail (or your local paper if in a regional area) or on their general website eg. Brisbane Catholic Education at www.bne.catholic.edu.au. Some employers will also advertise in The Australian. Catholic sector employers might also advertise in The Catholic Leader. Systemic Catholic employers rarely advertise general teaching positions and consider applications made to the relevant Catholic Education Diocesan Office. While some employment occurs at this level generally an interview is conducted by the relevant school Principal. Some schools / employers will keep a file of unsolicited applications and may request an interview if a position becomes available.

6.

Interview A successful application letter will only take the applicant to the next step - Interview. At the interview the approach adopted will be that of a private sector interview. As well as questions on your background in the areas of subject teaching, pastoral care and the other curriculum, the interview will try to establish your views around the mission/goals/value (ethos) statement of the particular school. Some time spent investigating such material will be invaluable.

7.

Offer of Employment An offer of employment will usually be in writing. If you accept the offer you should receive a letter of appointment.

8.

Letter of Appointment A letter of appointment should contain the following information. (a)

Classification, Band and Step. A four year trained graduate will begin at Band 2 Step 1.

(b)

Rate of salary either annually or per fortnight or per month.

(c)

Whether the position is continuing or fixed term. 'Continuing' means on-going employment. 'Fixed Term' means a defined commencement and finishing date.

(d)

Whether the position is full time or part time. If the position is part time it should state the number of hours per week.

9.

The Other Curriculum Schools in the non-government sector typically provide students with a pastoral care program and other curriculum offerings as well as academic instruction. Usually the other curriculum is referred to as the extra-curricular or co-curricular program. Some schools see these as interchangeable terms; others draw a distinction. The TANGS provides that extra-curricular duties 'shall be voluntary and honorary and shall be arranged between the teachers and the school authority' (Clause 1.6.7). At the end of the day this clause is enforceable. However, you should recognise that an employer in the non-government sector is unlikely to offer you a position if you indicate that you will not participate in the other curricular program. Some employers recognise that participation in two activities per year is appreciated although it cannot be demanded under the Award. A few employers have established payment systems for participation in the other curricular program.

10.

Probationary Employment The TANGS Award makes no provision for employment on probation. The Award does allow employers to fill positions where there is an identifiable short term need for a fixed period of up to one year. Identifiable short term needs could include filling a position while a staff member is on maternity leave, extended sick leave or long service leave. You should be aware that changes to the Queensland Industrial legislation provide for a three (3) month probationary period (or a longer period, which is reasonable having regard for the work to be performed and which is agreed in writing prior to the commencement of the employment) for all employees.

11.

Joining your Union - QIEU Employment in the non-government sector is very fragile. While the government sector has some protection in the regulations governing employment, an employee in the non-government sector has only the minimal protection of the Industrial Relations Act. However, being a member of your Union does enhance that protection. Not only do you have access to skilled advice, but employers contemplating disciplinary procedures or termination are always keen to establish whether the person is a member of their Union or not. Membership of QIEU also gives you automatic insurance coverage for professional indemnity and professional negligence. This provides legal protection for you against a claim for negligence as well as cover for associated legal expenses. With increasing concerns regarding duty of care this added protection gives further peace of mind.
