CATHOLIC SCHOOLS (NORTHERN TERRITORY) AWARD 2003 Understanding Your Entitlements

The working conditions and entitlements for teaching employees within Catholic Schools in the Northern Territory are determined by two legally enforceable documents; the Catholic Schools ( Northern Territory) Award 2003 and the Catholic Schools(NT) Enterprise Agreement 2006.

What is an Award? An award is a legally enforceable document which sets out the minimum terms and conditions of employment for people designated within the Award. The complete Award is available at your school or on request from the Union Office.

What is a Collective Agreement The majority of schools are now covered by a Collective (Enterprise Bargaining) Agreement which has been negotiated with employers by your Union. This collective agreement provides improvements to many of the award conditions, such as increased wage rates, modified classification rates and paid maternity leave

SUMMARY OF ENTITLEMENTS What happens when I am employed? When employed you may be offered a position on a full-time; part-time; or casual basis. This position may be a continuing position or a contracted position. Letter of Appointment Upon commencement the following should be provided in writing by the employer: Ö The nature of your position as either continuing, or contracted, full-time or a category as described above. Ö If not full-time, then the number of weeks employed. Ö The days of the week employed. Ö The normal starting and finishing time on each day. Contract positions specifically should outline the beginning and conclusion dates of the contract, the weekly/daily fractional time of employment, leave entitlement and the reason as to why the position is made on a contract basis. Casual employees shall be advised of the nature of their employment at the point of engagement. How should I be paid? Wages are varied from time to time through the process of collective negotiations. The majority of schools have now entered into an Collective (Enterprise Bargaining) Agreement which has achieved wage increases for employees. If you wish to determine your current wage rate, or obtain your current wage scales, contact your Union Office. Full Time Employees are paid an annual rate as per the appropriate classification Part Time Employees. Part-time employees are entitled to a proportionate amount of annual leave, long service leave and all personal leave. Casual Employees. analysis of the skills and responsibilities required for the position.

a position description written for each position.

classification according to the criteria set out in the Award.

Employees are appointed to a position at the appropriate level.

Classification – Teachers Entry points for teachers specified in the Award are as follows: 2 year trained 3 year trained 4 year trained 5 year trained

Beginning teachers – NT service holding their first full-time appointment since graduating, on completion of two consecutive years and on having completed prescribed professional development will move from the second to the fourth incremental step at the commencement of the third consecutive year of service. Each teach shall progress annually to the next level. Salary ceilings are as follows: 2 year trained 3 year trained 4/5 year trained

AST 1 + 2 are designated in the Award. Eligibility to apply for AST 1 classification is after 6 years of teaching. May hold AST 1 for 4 years and re-apply for AST 1 or apply for AST 2. Both AST 1 + 2 may be held in conjunction with holding a Promotion (administrative) position, but only the higher designated allowance will be paid. Superannuation The employer shall contribute the legislated rate of contribution of ordinary time earnings per eligible employee into the approved superannuation fund, namely Catholic Superannuation Fund of Victoria.

Part time employees will be entitled to receive the contribution if they work a minimum of twelve hours per week. Casual staff will be paid after the completion of 40 hours initially. Hours of Work School Officers work 38 hours as the normal length of the working week. Those hours shall be between 8:00am and 4:30pm Monday to Friday. CATHOLIC SCHOOLS (NORTHERN TERRITORY) AWARD 2003 Understanding Your Entitlements All employees, except for casuals, are entitled to sick leave. Paid personal leave is available for personal illness or injury, for the purposes of caring for an immediate family member, or for emergency leave. Personal leave of fifteen (15) days will be available in the first year of service, and fifteen (15) days per annum in the second and subsequent years of service. An employee is only entitled to use up to ten (10) days of the current year’s personal leave entitlement as sick leave in the first year. Any unused sick leave accrues at the rate of ten (10) days, less the amount of the sick leave component taken from the current year’s personal leave entitlement in that year. Where any absence exceeds two (2) consecutive days the application shall be accompanied by a medical certificate. Unpaid personal leave is available up to two (2) days (or 16 hours) if no paid entitlement remains. Emergency leave of up to five (5) days may be granted by the employer. Casual employees are entitled to not be available to attend work if they need to care for members of their immediate family or upon the death of a family member (in Australia) for a period of up to 48 hours (or 2 days) per occasion. More may be taken by agreement. Up to 3 days paid leave as bereavement leave is available on each occasion, provided that the total amount of leave taken in any year shall not exceed ten (10) days, and provided that any leave taken as emergency leave shall be counted for the purposes of this limit. A further 2 days of bereavement leave may be taken by agreement for the employee to travel to and from the designated place. Long Service Leave All full-time, part-time and eligible casuals shall enjoy the long service leave provisions. Entitlement is agreed as per the provisions of the Long Service Leave Act 1981. Pro-rata payment for LSL credit shall be paid upon resignation after the completion of seven or more years of service, and calculated at the rate of 3/10ths of one month for every completed year of service. Six months notice of the date of taking proposed LSL shall be provided. Parental Leave Parents are entitled to a combined total of 52 weeks unpaid parental leave on a shared basis, available to only one parent at a time. Both parents may simultaneously take up to one week at the time of birth or 3 weeks at the time of placement for adoption of a child. An employee entitled to parental leave may request the employer to allow the employee to extend the period of simultaneous unpaid parental leave up to a maximum of eight weeks, to extend the period of unpaid parental leave by a further continuous period of leave not exceeding 12 months, and to return from a period of parental leave on a part-time basis until the child reaches school age. CATHOLIC SCHOOLS (NORTHERN TERRITORY) AWARD 2003 Understanding Your Entitlements Maternity Leave The aggregate of paid sick leave, special maternity leave and parental leave, including parental leave taken by a spouse, may not exceed 52 weeks. Study Leave After the first twelve months service, an entitlement of six hours per week leave on full pay to attend lectures is available for approved courses, at the discretion of the employer. Leave without pay not exceeding 12 months, for study purposes, is available with the approval of the employer, without loss of any accrued benefits. Examination leave up to five days with pay for associated professional development is available for travelling to and from a local examination centre, plus the examination time. Termination of Employment Employees in their first year of service must give five (5) school term weeks’ notice, or payment in lieu of notice. Employees with a period of service from one to, but not exceeding, five years will give at least six (6) school term weeks’ notice or payment in lieu of notice. Employees with a period of service in excess of five years will give at least ten (10) school term weeks’ notice or payment in lieu of notice. Employees must give a minimum of five weeks notice in the school term prior to the date of terminating employment. Redundancy The Employer will provide written notice of at least one full term that the position occupied shall be declared redundant. The employer shall endeavour to procure alternative employment acceptable to the employee. If alternative employment cannot be provided the employer may terminate the services of the employer with notice of termination in writing. Compensatory payment of twelve (12) weeks salary plus one weeks salary for each year of part thereof of continuous service will be paid, up to a maximum of twelve (12) weeks, ;paid in a lump sum on the last day of employment.

Where an employee is given notice of partial redundancy the employee may, within one month of such notice, elect to declare the position wholly redundant. Where a partial redundancy is acceptable by the employee a pro-rata compensatory payment shall be made.

If you are not a member of IEUA and are interested in joining please contact your IEUA Staff Representative at your school or phone the Union Office on: WORKPLACE BENEFITS Industrial protection: IEUA ensures that you are treated fairly at work. We assist members with issues such as classification, wages, threatened dismissal, harassment, redundancy, leave entitlements or changes to their jobs. Health and Safety: You have entitlements to a safe and healthy workplace under the Workplace Health and Safety Act. We ensure that your legal entitlements are respected so you are not put at risk at work. WorkCover: Professional and experienced assistance for WorkCover matters is always available. The Union assists members in making claims including stress related claims. Legal Advice: As a Union member you have access to legal advice on non-industrial matters. IEUA approved solicitors throughout the state offer legal advice to Union members at reduced rates. Advice: If you need advice on any work related matter such as salaries, classification, conditions, leave and WorkCover, IEUA Officers will give you professional and confidential advice and assistance. A new publication titled Independent Education has been produced by the Union. This publication includes issues of interest to School Officers and is distributed to members triannually. Professional Indemnity Insurance: When you join IEUA you are automatically covered by a professional indemnity and professional negligence insurance policy. This provides legal protection for you against a claim for negligence as well as cover for associated legal expenses.
