Employees covered by Federal Single Site Agreements
CHAPTER BRIEFING No. 10 Dear Colleagues We are providing this briefing to all employees who are employed in a kindergarten which is subject to a single enterprise federal Agreement. Your employer took a positive step in entering into an Agreement which protects the wages and conditions for employees. The content of your Agreement may need to be reviewed at some stage in the future. The two obvious events which may necessitate this review are either: (a) an extension in the educational program to 15 hours; or (b) a consideration of the wage increase to apply in 2011. 15 hour educational programme If your kindergarten has made a decision to offer a 15 hour educational programme in 2011, then urgent consideration needs to be given to how this will be managed in light of the provisions contained in your existing Agreement. Specifically, a teacher cannot be asked to perform more than 27.5 hours teaching an educational programme. The situation will be slightly different if the workload is shared between two teachers. However, consideration would then need to be given to the entitlements of each of the teachers. If your kindergarten is providing 15 hours of educational programme in 2011 then we request that you complete the attached feedback form so that appropriate discussions can take place to vary the Agreement to facilitate this decision. The requirements to vary an Agreement are not onerous; this can be achieved before the end of the 2010 year. However, agreement does need to be reached in relation to the mechanics of the change to be implemented.
The IEUA has drafted model provisions which will enable the 15 hours to be provided. Wage increase in 2011 The Crèche and Kindergarten Association has agreed to a 4% wage increase effective from 1 July 2011 for employees employed in Branch kindergartens. The Queensland Lutheran Early Childhood Services has agreed to a 4% wage increase, effective from 1 May 2011, for kindergartens operated by that employer. Employees in state schools and Catholic schools will receive a wage increase of 4%, effective from 1 July 2011. Therefore, consideration needs to be given to the wage increase applicable at your kindergarten. Letter to committees The Independent Education Union of Australia – Queensland and Northern Territory Branch (IEUA-QNT) has written to your committee setting out the above information. The response from the committee, and your feedback, will determine whether variations need to be made to the Enterprise Agreement to facilitate our kindergarten’s operation in 2011.
