Application for approval of the Mount Gravatt Kindergarten & Preschool Association Inc. Early Childhood Education Enterprise Agreement 2011. [1] An application has been made for approval of an enterprise agreement known as the Mount Gravatt Kindergarten & Preschool Association Inc. Early Childhood Education Enterprise Agreement 2011 (the Agreement). The application was made pursuant to s185 of the Fair work Act 2009 (the Act). It has been made by the Independent Education Union of Australia - Queensland and Northern Territory Branch. The agreement is a single enterprise agreement. [2]
The Agreement was lodged within 14 days after it was made.
[3] I am satisfied that each of the requirements of ss186, 187 and 188 of the Act as are relevant to the application for approval have been met. [4] The Independent Education Union of Australia - Queensland and Northern Territory Branch, being bargaining representatives for the Agreement, have given notice under s183 of the Act that it wants the Agreement to cover it. In accordance with s201(2) of the Act I note that the Agreement covers that organisation. [5] On 12 June 2011 an undertaking was provided which is annexed to this decision and marked “A”.

[6] The Agreement is approved and, in accordance with s54 of the Act, will operate from 8 July 2011. The nominal expiry date of the Agreement is 31 December 2011.

Note - this agreement is to be read together with an undertaking given by the employer. The undertaking is taken to be a term of the agreement. A copy of it can be found at the end of this agreement.
