SCHEDULE 4 – EXPERIENCED TEACHER 5 S4 Experienced Teacher 5 S.4.1 Diocesan Catholic Education Employing Authorities are committed to providing an access mechanism by which eligible teachers are recognised for undertaking leadership task(s) amongst classroom teachers. S.4.1.1 Leadership incorporates concepts of: ‘to conduct or guide by going in front; and/or to direct by example.’ S.4.1.2 Experienced Teacher 5 is a provision by which classroom teachers undertake leadership task(s) amongst classroom teachers consistent with the Ethos of the Catholic School in at least one of the areas of: a teaching and learning b the teaching profession c the School community S.4.1.3 The provisions which are contained within this Schedule will be exclusive of the Positions of Senior Administration and Positions of Added Responsibility in Catholic Schools, Queensland, described in Schedule 6 of this Agreement, which provides for those positions designated to provide support to the Principal in the overall management of the School specifically in the areas of curriculum, pastoral care and other administrative responsibilities. S.4.1.4 Persons who hold Positions of Senior Administration, Positions of Added Responsibility in Catholic Schools, Queensland (Schedule 6) of this Agreement shall not be eligible for Experienced Teacher 5 status and remuneration. S.4.1.5 An Experienced Teacher 5 who fills a minor co‐ordinating role shall be entitled to an allowance payment in accordance with Clause 4.1.5 of this Agreement. S.4.2 Eligibility S4.2.1 A teacher classified at Experienced Teacher 5 is a teacher who: a has been on the classification Experience Teacher 4 for a period of at least 12 months or in the case of a part‐time teacher when the aggregate amount of time paid for is 1,000 hours; and b signs an undertaking consistent with Clause S4.3: Experienced Teacher 5 Action Plan: Operative Provisions. (below) c is entitled to, subject to Clause S4.6 (below), the relevant salary prescribed in Schedule 1 of this Agreement. S4.2.2 The Employing Authority will initiate advice to the teacher regarding the teacher’s eligibility for Experienced Teacher 5 status which will be: a in writing and identify the date of eligibility; and b provided in a timely manner prior to the date of eligibility. S4.2.3 Where an employing authority fails to provide written advice to a teacher regarding eligibility for Experienced Teacher 5 status, the employing authority shall in the event of the eligible teacher making successful application for experienced Teacher 5 status, backdate payment to their eligibility date for this status. S4.2.4 Where a teacher has been provided with such written advice and does not apply for Experienced Teacher 5 classification within one month, the right to payment back to the date of eligibility will cease. S4.2.5 A teacher will not be prejudiced by not having complied with the undertaking given in Clause S4.3 (below) due to circumstances relating to that undertaking beyond the control of the employee.
S4.3 Experienced Teacher 5 Action Plan: Operative Provisions S4.3.1 The teacher shall provide an undertaking to demonstrate leadership skills as a classroom teacher in the following terms: a a statement of continued support for the development of the Ethos of the Catholic School as detailed in Diocesan statements, by i reflecting and supporting the role of Catholic education in the mission of the Catholic Church ii promoting to students an appreciation and acceptance of the values of Jesus Christ iii supporting school prayer and liturgy iv adopting curriculum practices which reflect the Catholic School Mission Statement b and c an undertaking to perform task(s) in one or more of the following areas: i teacher and learning ii teaching profession iii school community S4.3.2 The demonstration of leadership skills in these areas of: a teaching and learning b teaching profession c school community S4.3.3 Shall involve the demonstration of one or more of the following: a skills in effective classroom practices; b skills in curriculum implementation; c skills in curriculum development; d skills in evaluating and reporting students’ progress; e skills in developing positive relationships with students; f skills in the development of personal and professional relationships with other staff members, parents and the wider community; g skills in the development and implementation of ideas gained from professional development activities to enhance students’ learning; h skills in the development and implementation of ideas gained from professional development activities to promote organisational development or the School’s mission. S4.3.4 The demonstration of one or more of these skills may involve one or more of the following tasks in an identified context or area which shall be listed on the Experienced Teacher 5 Action Plan. a Teaching and Learning i Developing teaching‐learning activities which enhance student learning; ii Modelling effective teaching strategies and classroom management strategies; iii Providing support to the implementation of a new syllabus; iv Providing support to the development of curriculum; v Providing support to the evaluation of curriculum; vi Providing support to resource development; vii Providing support to or undertaking a project activity or shared action research; viii Undertaking the testing, recording and reporting associated with core assessment; b Teaching Profession i Making a contribution to the professional development of other teachers; ii Providing pastoral support to students; iii Providing pastoral support to other employees; iv Providing support to core testing activities;
v Providing support to the induction programme for new staff; vi Undertaking an identified mentoring task(s); vii Providing support to a year level co‐ordinator; viii Providing support to a subject area co‐ordinator; ix Providing support to or undertaking a project activity or shared action research; c School Community i Participation in internal and/or external school/community committees; ii Providing support to or undertaking a project activity or shared action research. S4.3.5 The tasks are an indicative list only. S4.3.6 The required undertaking consistent with the provisions of Clause S4.3.1 (above) will be in the form of an Experienced Teacher 5 Action Plan consistent with Attachment A. S4.3.7 The Experienced Teacher 5 Action Plan will be provided to the Principal or nominee and if mutually agreed, signed by the teacher and the Principal and forwarded to the Director for signing. The Principal may request the teacher to reshape the Experienced Teacher 5 Action Plan in ways that respond to the specific needs of the School. S4.3.8 A teacher classified as Experienced Teacher 5 shall review the Experienced Teacher 5 Action Plan each year in conjunction with the Principal or nominee and if necessary revise the Experienced Teacher 5 Action Plan (Attachment B). The Principal may request that a teacher revise the Experienced Teacher 5 Action Plan. S4.3.9 Where an Experienced Teacher 5 Action Plan is revised it will be provided to the Principal and if mutually agreed, signed by the teacher and the Principal and forwarded to the Director or nominee for signing. S4.3.10 The tasks in the Experienced Teacher 5 Action Plan shall form part of the consideration by the teacher as part of agreed self‐appraisal structure and processes. S4.3.11 In the event that unforeseen circumstances arise which relate to the undertaking, the Experienced Teacher 5 Action Plan may be altered by mutual agreement of the teacher and Principal. The revised Experienced Teacher 5 Action Plan shall be signed by the teacher and the Principal and forwarded to the Director or nominee for signing. S4.3.12 The task(s) identified in the Experienced Teacher 5 Action Plan will be undertaken in a timely manner and on request, with reasonable notice from the Principal. S4.4 Classroom Allocation S4.4.1 The task(s) of a teacher classified as Experienced Teacher 5 complement the teacher’s primary role in the classroom. Such task(s) will not be so frequent or onerous as to detract from this primary role as a classroom teacher. The normal classroom load of a teacher classified as Experienced Teacher 5 may be adjusted when necessary, from time to time at the discretion of the Principal, within available resources and in accordance with the Hours of Duty Schedule 7 of this Agreement. S4.5 Grievance S4.5.1 If a teacher classified at Experienced Teacher 5 does not comply with the terms of the undertaking in Clause S4.3 (above), the Principal will: a outline the nature of the non‐compliance, in writing, to the teacher; and b provide the teacher with adequate opportunity to explain/address the situation. S4.5.2 If the teacher does not provide an explanation to the satisfaction of the Principal and after being given an opportunity, fails to address the situation, then: a the Principal will provide a written determination to the teacher outlining the teacher’s non‐compliance with the undertaking; and b the teacher will revert back to the classification of Experienced Teacher 4 for a period of 12 months from the date of the Principal’s written determination.
S4.5.3
After the 12 month period referred to in Clause S4.5.2(b) (above) expires, the teacher is again eligible for access to Experienced Teacher 5 status provided that the Principal is satisfied that the second undertaking given will be honoured. S4.5.4 Any teacher aggrieved by the decision not to appoint or to remove their classification of Experienced Teacher 5 or to refuse them re‐entry to the Experienced Teacher 5 classification, may access the dispute resolution procedure, Clause 2.3 of this Agreement. S4.6 Remuneration S4.6.1 Remuneration payable to a teacher classified as Experienced Teacher 5 is at the rate prescribed in Schedule 1. S4.6.2 Remuneration shall be paid from the date of eligibility provided that the teacher provides an undertaking consistent with Clause S4.3 (above) prior to that date. Where the teacher provides an undertaking, consistent with Clause S4.3 (above), after the eligibility date remuneration shall be paid from the date the undertaking is provided. S4.7 Fixed Term Employees S4.7.1 In the case of a full‐time fixed term employee, then in addition to satisfying the conditions of Clause S4.3 (above) a fixed term teacher can access Experienced Teacher 5 status only if the teacher obtains an engagement for a period of at least three (3) school terms. S4.7.2 In cases where the classification of Experienced Teacher 5 is not accessed by a fixed term teacher, then there can be no Employing Authority requirement or expectation that tasks consistent with the Experienced Teacher 5 provision will be performed. S4.8 Eligibility of Part‐Time Employees S4.8.1 In the case of a teacher employed on a part‐time basis of at least 0.4 of a full time employee, such a teacher may access Experienced Teacher 5 classification through the process identified in Clause S4.3 (above) and shall receive an allowance based on the relevant proportion of the full time Experienced Teacher 5 allowance. S4.8.2 Task(s) undertaken by a part‐time teacher consistent with Clauses S4.3 and S4.4 (above), will reflect the proportion of time employed at the school. No additional hours shall be paid to the part‐time teacher for undertaking the Experienced Teacher 5 Action Plan. S4.8.3 In the case of a part‐time employee, then in addition to satisfying the conditions of Clause S4.3 (above), a part‐time teacher can access Experienced Teacher 5 classification only if the teacher obtains engagement for a period of at least three (3) school terms. S4.8.4 In cases where the classification of Experienced Teacher 5 is not accessed by a part‐time employee, then there can be no Employing Authority requirement of expectation that tasks consistent with the Experienced Teacher 5 provision will be performed. S4.9 Portability S4.9.1 Experienced Teacher 5 status is not portable from another Employing Authority. S4.9.2 Teachers currently employed in Catholic education who change from one employer to another and who are eligible for Experienced Teacher 5 status, shall be eligible from the day of appointment by the Employing Authority, to submit an Experienced Teacher 5 Action Plan. When appointed to the classification of Experienced Teacher 5, payment of the relevant allowance shall be from the day of appointment as an employee provided that the teacher provides an undertaking consistent with Clause S4.3 (above) within one month of appointment as an employee. S4.9.3 On termination of employment an employee shall receive a Statement of Service which details Experienced Teacher 5 status as appropriate. S4.10 Transitional arrangements for AST1 to Experienced Teacher 5 (BCE only) a No further applications for AST1 status shall be received after 6 August 2010.

Those teachers who hold AST1 status as at 6 August 2010 shall either: i continue to hold AST1 status for the balance of the current tenure and be paid the AST1 allowance as per Schedule 1; or ii apply for Experienced Teacher 5 status consistent with the provisions outlined in Clause S4.3 (Experienced Teacher 5 Schedule) of this document. The AST1 provision shall cease on 30 December 2013.
