A Race to the Bottom: TPP & The Quintessential Case of Nike in Vietnam By Charles Kernaghan Institute for Global Labour and Human Rights Nike is truly the canary in the coal mine, pointing us to what unfettered “free trade” looks like, and what the world will look like under the Trans-Pacific Partnership (TPP). In the year 2014, Nike produced over 365 million pairs of athletic shoes, while at the same time refusing to make a single sneaker in the United States. Meanwhile, they are making these shoes at a tremendous profit while paying their overseas workers pennies. In fact, Nike’s largest production center is Vietnam, where more than 330,000 workers, mostly young women, toil in 67 factories making goods for Nike. Everyone knows that Nike shoes do not come cheap, selling in the U.S. from $60 to $120 to well past $200.

60% Nike Dominates Sixty Percent of All Athletic Footwear Sold in U.S. In 2014, Nike controlled about 60 percent of the U.S. footwear market (worth some $21.2 billion in 2014) and some 30 percent of the global footwear market.

I do not believe that American workers should have to compete against people in Vietnam who have a minimum wage of 56 cents an hour. — Senator Bernie Sanders

According to U.S. Customs records analyzed by the Institute for Global Labour and Human Rights, there were at least 16,423 shipments of Nike Athletic footwear exported from Vietnam to the U.S. in 2014, with an estimated customs value of $491 million!

Nike’s CEO, Mark Parker, announced that “Fiscal year 2015 is off to a strong start. Our connection to consumers and ability to innovate, combined with our powerful global portfolio, is a complete offense… Nike has never been better positioned to realize our tremendous growth potential.”

In February 2015, we looked at a sampling of ten shipments of Nike sneakers from Vietnam destined for the U.S. market. It did not take long to find that the average customs value of the Nike sneakers was just $5.27 per pair!

Nike’s revenues for the year ending February 2015 totaled $30.3 billion.

Meanwhile, Nike’s presence in Vietnam led to a continuation of wages as low as 27 cents an hour in 2012, with a slight increase to 48 to 69 cents an hour in January 2015, which is well below subsistence levels. It is common that Vietnamese workers have no legal rights. Nor has Vietnam ratified the United Nations Conventions on freedom of association and the right to organize.

Let’s be honest. For years, Nike has been exploiting the 330,000 Vietnamese workers, mostly young women, who are poorly paid and denied their most fundamental rights. But every once in a while, the truth leaks out. In this case, it was Thanh Nien News in Vietnam that spilled the beans: “Analysts acknowledge that Vietnam’s abundance of cheap labour has played an increasingly pivotal role in

wooing foreign firms looking to set up overseas manufacturing operations in a country with a population of 90 million.

for sale in the U.S. For Nike, rolling back these duties will allow us to grow in new markets, reinvest in innovation, and offset costs of doing business.”

“This edge appears to be working well in the context of rising labor costs in China and political mayhem in Thailand… They [foreign and local companies] warn any further wage hikes will cause grave consequences on Vietnam’s competitiveness in the near term, adding it needs to be considered ‘very carefully.’”

In short, Nike is after even cheaper prices, and expanded access to Vietnamese workers with no legal rights, no voice and no way out. Is this how we want to live?

— Thanh Nien News, “Vietnam Approves MinimumWage Hike of 15 Percent in 2015,” November 11, 2014 On March 10, 2015, Ms. Hilary Krane, Chief General Counsel at Nike, asked all 44,000 Nike staff to lobby for the TransPacific Partnership, telling them that the TPP would:

If Nike had the guts and morals, Nike would demand that their products made in Vietnam be made by workers who are guaranteed their freedom of association, their right to organize and to collectively bargain. I am certain that many Nike workers are desperate for reform which will allow them to make a living wage and to freely organize unions to defend their interests. Together we can work on making this a reality!

“…I am also concerned that this agreement threatens worker rights. I have not been convinced that countries such as Vietnam, which is controlled by a one-party government, will implement labor provisions that support freedom of association and collective bargaining. Any TPP agreement must include strong and enforceable labor protections as well as an action plan to ensure that countries are complying with internationally recognized labor rights.” — Congressman Chris Van Hollen, Letter to Congressman Sandy Levin announcing opposition to “fast track” Trade Promotion Authority, April 15, 2015

“Made in Vietnam Labor Rights Violations in Vietnam’s Export Manufacturing Sector” “ Freedom of Association and Collective Bargaining—These basic labor rights are not respected under Vietnamese law. Workers who have attempted to form labor organizations outside of the official union structure dominated by the state and the Communist Party have been prosecuted and jailed on criminal charges in retaliation for their efforts.” “Forced Labor—As noted, the U.S. Department of Labor has added garments from Vietnam to its annual list of products made with forced and child labor…” “Child Labor—As noted, the U.S. Labor Department has included garments from Vietnam on its global list of products made with forced and child labor…” “Gender Discrimination—Women workers in Vietnam face pervasive pregnancy-based discrimination ranging from termination of employment to denial of statutory maternity benefits.” “Health and Safety Hazards—Factory workers are often at risk from hazards such as locked fire exits and failure to provide protective equipment…” “Excessive Working Hours—Garment factory employees report being required to work far in excess of legal limits on working hours often without a single weekly rest day…” “Inadequate Wages—Despite significant recent increases in the legal minimum wage, manufacturing workers continue to receive wages that provide only a fraction of the cost of an adequate standard of living.” - Worker Rights Consortium, “Made in Vietnam: Labor Rights Violations in Vietnam’s Export Manufacturing Sector,” May 2013

Institute for Global Labour and Human Rights

“The human rights situation in Vietnam deteriorated significantly in 2013, worsening a trend evident for several years. The year was marked by a severe and intensifying crackdown on critics, including long prison terms for many peaceful activists whose “crime” was calling for political change…. “Vietnam bans all political parties, labor unions, and human rights organizations independent of the government or CPV. The authorities require official approval for public gatherings and refuse to grant permission for meetings, marches, or protests they deem politically or otherwise unacceptable…. “In May 2013, authorities in three Vietnamese cities intervened with violence, temporary arrests, and concerted harassment to prevent and break up peaceful “human rights picnics” at which activists planned to disseminate and discuss the Universal Declaration of Human Rights and other human rights standards….” — Human Rights Watch. “World Report 2014: Vietnam.”

Deep Concerns Voiced Regarding the Trans-Pacific Partnership “Companies like New Balance are simply asking that they be given an opportunity to compete and keep good manufacturing jobs in the United States.” — Senator Susan Collins (R-ME). Wall Street Journal. October 4, 2013.

“The TPP, if passed, would implement trade rules that make it illegal for governments to create and enforce regulations on everything from environmental standards, to wage and labor laws, to the duration of copyrights. A law prohibiting the sale of goods made in sweatshops in Vietnam could be ruled illegal, for example, as a barrier to trade.” — Amy Goodman and Denis Moynihan. “Flush the TPP.” Democracy Now. March 19, 2015.

Nearly Five Million Manufacturing Jobs Lost “Over two decades, a series of trade agreements not only failed to meet their business sector and political backers’ glowing promises of job creation, but instead resulted in unprecedented and unsustainable trade deficits, the net loss of nearly 5 million U.S. manufacturing jobs and more than 57,000 factories, millions of higher-wage service sector jobs offshored, flat median wages despite significant productivity gains and the worst U.S. income inequality in the last century. And, even for U.S. agriculture, a sector that consistently has been promised gains from past trade pacts, U.S. food exports have stagnated while U.S. food imports have more than doubled in the past 20 years of NAFTA-style deals. Given that the Trans-Pacific Partnership (TPP) pact now under negotiation replicates and expands on the same model, opposition in Congress and among the public is deep and broad.” — Public Citizen’s Global Trade Watch. “Prosperity Undermined Fast-Tracked Trade Agreements’ 20-Year Record of Massive U.S. Trade Deficits, American Job Loss and Wage Suppression.” January 2015.

Fast-Tracked Trade Deals Have Battered American Workers “The TPP [Trans-Pacific Partnership] would be the largest so-called free trade agreement that the United States ever bound itself to. Trade among the 12 nations accounts for 38 percent of global economic activity. “Fast track is nothing more than Congress pulling a fast one on the American people. It’s a plan for lawmakers to abdicate their Constitutional responsibility to regulate international trade. With fast track, Congress shirks its duty to subject trade deals to lengthy line-by-line scrutiny, fulsome public hearings and amendment. “While gratifying Wall Street and multinational corporations, past fast-tracked trade deals have battered American workers as factories fled off shore, wages stagnated and layoffs multiplied. Fast track is an outmoded strategy for indolent politicians. Workers in the 21st century deserve in-depth deliberation over trade proposals to ensure jobs, the environment, food safety and national sovereignty are protected.” — Leo Gerard, President, United Steelworkers. “Hey Sen. McConnell: Don’t Fast Track the Trans-Pacific Partnership.” In These Times. January 20, 2015.

Institute for Global Labour and Human Rights

11

“Over and over again we’ve been told that trade deals will create jobs and better protect workers and the environment… Those promises have never come to fruition.” — Senator Bob Casey, Democrat-Pennsylvania

5.7 Million U.S. Manufacturing Jobs Lost “FTAs and other trade deals have cost millions of U.S. jobs, most in the manufacturing sector. Congress should be very wary about approving new trade and investment deals like the TTIP.” — Robert Scott. “Transatlantic Free Trade Agreement: Job Claims Are Pure Baloney.” EPI. November 1, 2013. “Rising trade deficits are to blame for most of the 5.7 million U.S. manufacturing jobs (nearly a third of manufacturing employment) lost since April 1998.” — Robert E. Scott. “Stop Currency Manipulation and Create Millions of Jobs.” EPI. February 26, 2014.

“White House estimates show that for every $1 billion in goods exported, the economy creates 5,000 jobs. Unfortunately, that street goes both ways — data from the Economic Policy Institute shows that for every $1 billion in goods imported, the economy loses 9,000 jobs.” — John Olen, “Lack of Jobs is Due to Our Trade Deficit,” Economy in Crisis, March 8, 2014

“Big-business groups are squarely behind the TPP and have ramped up their lobbying efforts for fast-track authority…. [On the hand] various labor, environmental and health groups, meanwhile, fear the deal would benefit corporations at the expense of workers and ordinary families. Fair minimum wages and access to generic medicines are among areas of concern.” — Don Lee. “China is Obama’s trump card in push for Pacific Rim trade pact.” LA Times. March 8, 2015.

“The public has no access to materials drafted thus far, and even members of Congress have limited access.” — Jared Bernstein, Center on Budget and Policy Priorities “Meanwhile, more than 500 official corporate “trade advisors” have special access…” - Lori Wallach, Public Citizen’s Global Trade Watch

[The TPP is] designed to carry forward the neoliberal project to maximize profit and domination, and to set the working people in the world in competition with one another so as to lower wages to increase insecurity. “It’s very hard to make anything of the TPP because it’s been kept very secret. A half-secret, I should say. It’s not secret from the hundreds of corporate lawyers and lobbyists who are writing the legislation. To them, it’s perfectly public. They’re, in fact, writing it. It’s being kept secret from the population. Which of course raises obvious questions.” — Noam Chomsky. Huffington Post. January 13, 2014.

60,000 Manufacturing Plants Closed “Our free trade policy encourages production to leave the country. We’ve lost millions of manufacturing jobs. More than 60,000 manufacturing plants were closed between 2000 and 2010 as production moved overseas.” — Stan Sorscher, Society for Professional Engineering Employees in Aerospace. “‘Free Trade’ Was Never Really About Trade.” Huffington Post. June 17, 2013.

“Secrecy has real costs. Because the negotiating process combines a general shield from the public with privileged access for industry advisers, the substance of American free trade agreements does not represent truly national interests. It represents the interests of those members of industry who sit on the office’s Industry Trade Advisory Committees, which have regular access to negotiating information.” — Margot E. Kaminski, Fellow, Information Society Project at Yale Law School (New York Times Op-Ed, April 17, 2015)
