After hearing all the arguments of the counsel for both parties, he ruled that the dispute between the
applicant and the fourth respondent was purely a civil matter in respect of which the respondents had no power to exercise, and that their detention of the pastor, either acting by themselves or through their agents, was not justified. According to the judge, there was no reference to
any law that entitled the police to act the way they did or conferred them with immunity against being challenged even in a court oflaw. The judge averred that the fourth respondent did not present incontrovertible documentary evidence of ownership of the property, for which he
acted as he did. According to the judge, the fourth respondent was claiming what did not belong to him or have credible evidence of possession. The judge said there was evidence that the dispute has been in court, adding that the applicant had an affidavit supporting her claims of ownership of the
land. In his ruling, ihe judge held that while a Magistrate Court advised the fourth respondent to go to the High Court, being the appropriate court, to express nis grievances when it struck out the case, the respondent ignored it and chose to grope along crooked paths.
