n behalf of all IIUSA officers, directors, members, and staff, welcome to IIUSA’s 6th Annual EB-5 Industry Forum here in Los Angeles, California! The City of Los Angeles holds many distinctions. LA is the entertainment capital of the world, a cultural mecca boasting more than 100 museums, and a paradise of good weather LA is also one of the most prominent destinations for foreign direct investment (FDI) in the U.S. including EB-5 - and for good reason. As EB-5 investment serves as an increasingly significant part of the city and region’s economic development goals, IIUSA is proud to bring its largest annual conference to a city that has been at the forefront of putting EB-5 to work as a tool for regional economic development and job creation. Nationwide, we know #EB5isWorking. The numbers speak for themselves. In the first half of fiscal year (FY) 2016 alone, EB-5 has contributed over $1.5 billion in FDI to the U.S. economy. Furthermore, since 2008, EB-5 has contributed $14.6 Billion in Foreign Direct Investment (FDI) to the U.S. economy, transforming communities and providing quality American jobs in the process. With a majority of all EB-5 capital investment flowing through IIUSA’s member Regional Centers, this conference is about celebrating this success together while charting the path forward to making the EB-5 Regional Center Program permanent. As has become tradition thanks to your continued support and leadership, we have grown again this conference – which first occurred in 2011. GUEST OF HONOR SPEAKERS Julia Harrison
Deputy Chief, U.S. Citizenship and Immigration Services (USCIS) Immigrant Investor Program Office Julia Harrison was named Deputy Chief of the USCIS Immigrant Investor Program Office in July 2014. With more than 20 years of experience with INS and USCIS, Ms. Harrison brings a wealth of program and operational experience to IPO. Most recently she served for four years as the Chief, Operations Division within the USCIS Field Operations Directorate. There, she led four branches in developing and implementing national policy, operational guidance, and training in many areas of immigration law including citizenship, family based immigration, national security, fraud detection and international adoption. Ms. Harrison previously served USCIS in many other capacities, including as the Field Office Director in Seattle, Washington for seven years, and prior to that, as a Supervisory Port Director and Supervisory Immigration Inspector.
Michele W. Layne
Regional Director, U.S. Securities and Exchange Commission, Los Angeles Regional Office Michele Layne has been the Regional Director for the Los Angeles office since 2012. Ms. Layne was an Associate Regional Director for Enforcement in the L.A. office from 2005 to 2012. She began her SEC career 21 years ago as a staff attorney in the Enforcement Division. Ms. Layne served as the Co-Acting Regional Director after the departure of prior office director Rosalind Tyson earlier in 2012. During her tenure at the SEC, Ms. Layne has worked on many significant enforcement cases involving a wide variety of securities law violations. Among the cases in which she has played a leadership role was the enforcement action against Countrywide CEO Angelo Mozilo that resulted in the largest SEC penalty ever paid by a public company’s senior executive, and the CSK Auto matter that marked the SEC’s first-ever Sarbanes-Oxley Act “clawback” case against an individual who was required to return bonuses and stock profits while not personally charged for the company’s misconduct. Ms. Layne received the SEC’s 2009 Distinguished Service Award, the agency’s highest honorary award. Prior to joining the SEC staff in 1995, Ms. Layne worked in private practice for 11 years at the law firms of Dewey & LeBoeuf and Buchalter Nemer. Her practice concentrated on complex business litigation. Ms. Layne received her law degree from the University of Southern California. She graduated magna cum laude and Phi Beta Kappa from the University of California at Los Angeles.

Chief, Visa Controls Office, U.S. Department of State Charles Oppenheim has been employed by the Department of State since 1978. He has worked as a consular officer in the Bureau of Consular Affairs since 1979 and in 1999 became Chief of the Immigration Visa Control and Reporting Division. Mr. Oppenheimâ&#x20AC;&#x2122;s main responsibility is the administration of a complex series of annual numerical limitations on immigrants subdivided by preference category and country. This panel will review the issue of “redeployment”, that is the question as to whether EB-5 investments must be sustained at risk – or merely just sustained – after the jobs have been created. In its August 10, 2015 Draft Memorandum, U.S. Citizenship and Immigration Services (USCIS) states that the New Commercial Enterprise (NCE) cannot simply hold the money since the investment must not only be sustained, but must be sustained “at risk.” With quota backlogs for Mainland Chinese investors resulting in their not receiving their condition removals until some number of years after the traditional 4 to 5 years, the issue of redeploying EB-5 capital to satisfy the statutory and regulatory language has wide-ranging ramifications for both projects and investors in an EB-5 transaction.
