CANTWELL AND DE BLASIO: TWO CLOWNS WHO ARE PLAYING POWER GAMES WITH KIDS’ LIVES
East Hampton Town Supervisor Larry Cantwell has always been something of a dick. Years ago he had me arrested for having a pumpkin display in front of my Red Horse Gourmet food market. East Hampton Village paid through the nose to settle my false arrest suit. Larry never apologized. Now Larry is playing a much more dangerous game that can get somebody’s kid killed. He has made it impossible for Uber car service to operate in East Hampton. How does that affect you and your loved ones? A lot of people drive out to Montauk or to other places in East Hampton and party. They drink a lot and are in no condition to drive a motor vehicle. The smart ones either leave their own cars or refuse to drive with a friend who is also inebriated, and call for a car to pick them up. In the middle of the night cabs are expensive and hard to get. Sometimes there’s a wait of two to three hours. Sometimes the cabs don’t show up at all. Uber, on the other hand, is minutes away, and they have your credit card on file. So without Uber, someone will try to drive when they’re in no condition
to drive, or get a ride with someone who’s in worse shape than they are. This will get them – and other innocent people who are driving in another car, sober – killed or maimed in a crash. I pray, and I’m sure Larry Cantwell prays, and we all pray that this won’t happen. But should it happen, Larry – who takes the blame for nothing, and puts his spin on everything – will have to write the grieving parents a letter. To show I don’t carry a grudge, I have taken a shot at helping Larry with this letter. Here is how he will write it: Dear Sir or Madam, On behalf of the town of East Hampton, I would like to tell you how sorry we all are that your son/ daughter/husband/wife/etc. died in a car crash. And yes, I’m aware that had they been able to call an Uber car from Montauk/Amagansett/Sag Harbor/etc., they would be alive today. But if they hadn’t had so much to drink, and if they had the patience to wait a few hours and the cash to pay a cab driver, they would also be alive now.

I know that at that time of night, many young people don’t have the cash to pay for a cab ride. This, of course, is not my responsibility either. It’s your fault if you let them leave the house without enough money in their pocket to cover themselves when a cab asks for over a $100 to drive them from Montauk. Although you have had a loss, how do you think the family of the innocent people who were driving sober and were killed when your drunken son/daughter/husband/wife/ etc. crashed into them feel now? In light of this loss of life, you may think that my forcing Uber out of East Hampton might have been petty and small-minded and stupid. Well, Sir or Madam, I’m alive, Uber is out, and your son/daughter/husband/wife/ etc. is dead. So, in the words of Hillary Clinton, a woman who has been an inspiration to me, “WHAT DIFFERENCE DOES IT MAKE?” In this hour of sorrow I remain your humble emperor, Larry Cantwell In the world of dickdom, Larry Cantwell is just an officious, smalltown guy who makes a bad decision and is too stubborn to reverse it and do the right thing. He can’t compare to Bill de Blasio, the Mayor of New York City, who is King of the Dicks. He is destroying lives and the quality of life in New York City. Everyone who has a brain knew it was going to happen when de Blasio was elected. Everyone, that is, but the victims and their families. It started almost two years ago when Angel Rojas, an immigrant from the Dominican Republic, was shot in the back of the head while innocently sitting in a crowded New York City bus in Bedford-Stuyvesant.

A 14-year-old named Kahton Anderson, who belonged to a gang called the “Stack Money Goons,” was sitting on the bus when he spotted some rival gang members from the “Twan Family” getting on the bus. Kahton Anderson reached into his pocket and pulled out a 357 Magnum revolver. He fired at the other gang’s members. That, sadly, was Angel Rojas’s last second on earth, because a bullet that was meant for one of them went wild and tore through his brain. Thanks to Bill de Blasio, this 14-year-old kid would never have been put through the humiliation of being stopped and frisked and having his gun taken away before he could hurt anyone because Mayor de Blasio campaigned on how he would eliminate stop-and-frisk, a police method that made places like BedSty and Brownsville safe from guns when Mayor Bloomberg and police commissioner Ray Kelly were in office. De Blasio once again kept his word to the likes of Al Sharpton, so stop-and-frisk, under the de Blasio administration, is a thing of the past. This can only embolden kids like Kahton Anderson. The word is out that anyone can carry a gun and not be stopped by a suspicious cop. It’s summer. With summer comes heat, and with heat comes crime and violence. We’re on our way to becoming Baltimore. Murders are up 20 percent. At the end of May we were up 22 murders and 31 shootings compared to last year. Mayor de Blasio can poo-poo these numbers, but maybe he should try to tell it to the family of the 14-year-old black kid who was shot in the face the other day. Areas like Bed-Sty and Brownsville, which fought the hardest against stop-and-frisk, are having the most casualties. There are dead innocent little kids who got into the line of fire and hard-working men and women who only want to be left in peace. De Blasio, with his “Occupy Wall Street” philosophy, will never talk about the guilty versus the innocent. He will only talk about pitting the poor against the rich. With the murder rate soaring, de Blasio has decided he should be President of the United States, and so he’s taking a tour of the U.S., selling his leftist politics, convinced that he is just one more commercial showing his son’s Afro away from the White House. Instead, de Blasio should be indicted as an accessory to crimes committed against innocent black people. There are those who say that despite all the bluster, Bill de Blasio is just stupid. Then there are those who say he’s just plain evil. I find myself agreeing with both groups. I think he’s both stupid and evil. Uber Says Adios By Kitty Merrill
They’re playing hardball. On Friday Uber, the multi-billion dollar international transportation network company, ceased operations in East Hampton Town – setting off a tidal wave of complaints to Supervisor Larry Cantwell with an email blast to its customers across the country. At issue is the town’s taxi legislation, and Uber’s inability to comply with it. The company, launched in 2011, uses “partners” to drive the cars it dispatches through a cellphone app. Under the town’s taxi legislation cab companies or sole operators must conform to a series of regulations that include background checks, vehicle inspections, and proof of insurance. Last year the town board adopted amendments to the regulations including the requirement that companies maintain an official home base located in the town of East Hampton. That’s the requirement – and office for each company or sole operator – that has Uber irked. A hybrid, Uber is neither a cab company nor a sole operator. “It’s a technology company,” Cantwell explained. In the email blast Uber charged the town with “banning” Uber. The office requirement would be “impossible” for Uber’s drivers, the mass mailing states. That could be because so many of them come out from the city to, said Cantwell, “get the cream” during busy summer weekends. In fact, Cantwell referred to a New York Post article published earlier this spring that reported Uber suggesting its drivers head to Montauk during the summer to make quick cash. That’s what was happening
several years ago and served as a basis for East Hampton’s taxi regulations, which were first adopted in 2010. As The Hamptons, and particularly Montauk, became more and more popular with upscale revelers, an increasing number of out of town companies and individuals descended for the summer looking to make lots of dough ferrying moneyed millennials around Montauk. The first iteration of taxi legislation didn’t include the home-office requirement. It was based on regulations adopted by Southampton Town (which doesn’t have the requirement). In 2013 the Wilkinson administration held a public hearing on revisions to the cab code. The office requirement, as well as mandates for extensive background checks prompted an outcry from local taxi companies, and the legislation languished. Last year the Cantwell administration revived it, and, despite opposition to the office provision, adopted an amended code. Discussion of the amended cab code was underway for several years, wasn’t Uber aware? Spokeswoman Alix Anfang wouldn’t say. “I can’t get into specifics,” she said. “This ordinance is just not good for us.” She didn’t respond when asked if it’s true that Uber told drivers it would cover fines for drivers in East Hampton, as was stated by cabbies interviewed by News 12. Cantwell, meanwhile, said, “I think Uber was well aware of what was going on and deliberately created this conflict. It’s unfortunate this is their way of CONTINUED ON PAGE 15.

An Unseemly Kerfuffle Comes To Town Hall By Kitty Merrill
They were supposed to give an overview of LTV’s operations, but a public hearing on the performance review turned into an airing of a feud festering among members of the public access station’s board. As reported exclusively in last week’s edition of The Independent, board members broke over a severance and consulting package for exiting executive director Seth Redlus. (Visit us online at www. indyeastend.com to see the story.) Board chair Robert Strada described Redlus’ pay out as a “sweetheart” package that “just popped up” without prior discussion. He said he objected to the content
of the package as well as the “clandestine” manner in which it was negotiated. Strada said that since his efforts to look over the books had been stymied, he’d like an independent auditor to review LTV’s financials. Supervisor Larry Cantwell said such a review has already been green lighted by the town. Strada said he’d received an email agenda for the next meeting aimed at unseating him. He planned to skip the meeting, as did his supporters on the board, meaning there would be no quorum for the conducting of business. On the other side of the feud Jim Shelley, vice chair of the board
and its longest-serving member apologized for the kerfuffle. “It’s unseemly,” he said, apologizing to the board for involving them in it. Shelley said he’d fully guarantee LTV’s finances and would personally cover the expense of the audit. “Most people believe LTV is a tremendous asset,” Supervisor Larry Cantwell observed. “I get feedback from the public all the time.” It’s not the town board’s role to heal the rift, the supervisor continued, offering an appeal to board members to heal the rift. “We’ll do a thorough performance review,” he concluded, “But let’s come together.” A handful of speakers addressed

the actual topic of the hearing, weighing in on the public access station’s operations, equipment, and accessibility to the public. Almost everyone who spoke has a show on the station or is connected to it. Interim executive director Morgan Vaughn listed stats related to programming, reporting that in 2014 there were 555 shows logged in – 178 government meetings and 146 field shows, with 103 hours of local programming per week. On average, LTV offers 73 hours of government shows and 95 hours of educational shows per week. LTV held production classes and individual training for volunteers, students, and interns, and added a mobile unit for field production. Vaughn quoted the director of government affairs for Cablevision, Joan Gilbride, noting she said LTV pioneered the whole access movement on Long Island and continues to be a leader.
Slowly Independent Turning to the current dissent, Vaughn said the staff was saddened by the disagreement. She opined the severance package for Redlus is “more than worth it,” as he will continue to provide “integral” technical help to the station. The plan is for the staff to “slowly and judiciously” work to become independent of his skill set. According to Martin Drew, problems at LT V stem to the d is s o l u t i o n o f an ap p o i n t e d oversight committee. It was abandoned in 2006 and there’s been no oversight since. Before then, the community was part of LTV. “It wasn’t its own entity,” he said. Drew supports the re-establishment of a telecommunications committee. The board watcher noted that Southampton’s public access station SEATV appears to accomplish its goals, serving a larger region at a lower cost. The statement prompted SEATV executive director Bruce Nalipinski to weigh in. He noted his station offers just one channel with fewer employees and no overhead for a facility like LTV has. He believes LTV does a good job with what it has. So do other speakers who took the podium last Thursday night. If anything, the LTV budget should be increased, Alyssa Meyer asserted. She’d like to see them able to cover more community and school events than they currently do.

Advisory Committee and a past president of the local chapter of the Lion’s Club. He’s chaired the East End Committee for the United States Green Building Council, the Long Island chapter. Dalene said Assemblyman Fred Thiele approached him about the idea of running for the legislature. The candidate worked with Thiele on labor reform measures with the Long Island Builders Institute and recently initiated a bill to provide tax incentives for LEEDS-certified homes. It passed both houses and has been adopted in Sag Harbor and Southampton Town. “We’re moving forward in East Hampton,” Dalene said, describing himself as “strong on environmental issues and especially green building.” He’s a founder of the nonprofit Hamptons Green Alliance and

treasurer of the Peconic Institute. Politically, he said, most of his service has been on the national level for the Republican Party, receiving a congressional medal of distinction for his service with the RNC as well as the Ronald Reagan gold medal. “But I felt the Tea Party was hijacking the party,” he said. When Thiele told him switching to the Independence Party “freed him up,” Dalene decided to do the same. In other local campaign news, last week East Hampton Republicans announced a change to their town board ticket. Town board designee Len Czajka dropped out of the race and the committee has appointed Lisa Mulhern-Larsen to run in his place. A Montauk native, MulhernLarsen has been involved in community organizations for many years, according to the party’s press release. She’s married to Jerry Larsen, chief of the East Hampton Village Police.

Sandra Schroeder Runs For Mayor . . . and So Does Robby Stein By Rick Murphy
Sandra Schroeder, who narrowly missed being elected Sag Harbor Village mayor in 2013, is going for the top prize again. Schroeder was elected to the village board last year and will retain her seat win or lose, as will her opponent Robby Stein, who is also on the village board. Schroeder, who is now retired, was a longtime village employee and served as village clerk. She lost to incumbent Mayor Brian Gilbride, by 11 votes in 2013. He is not running this time around. “Robby and I get along but we have different ways of doing things,” she said in an interview Monday. There are a number of items on her to-do list. There are repairs to be done and a temporary building moratorium are on top of the agenda. “We have to slow things down around here,” she said, noting a temporary halt to the construction
of buildings over a certain size will allow the village to take stock of the changes sure to come as several luxury condominium projects in the village near completion. Schroeder is firmly opposed to legislation Stein favors to allow accessory buildings to be used for affordable housing. “I am in charge of code enforcement. I’ve seen a pool house on a property with no pool – guess what it’s used for? I’ve had complaints that six people are living in an accessory structure. It means more cars in the village.” She noted there are numerous houses in Sag Harbor already zoned as multi-dwellings, many with four to five apartments each. The tone of the election is more amiable this time around, she noted. In 2013 the issue of police staffing divided the village. “Two years ago we had people playing Clash Of Titans. We need people who can sit down together and work things out.”

The election that will decide who will fill the role of mayor of Sag Harbor is just around the corner (next Tuesday). Sag Harbor resident and village trustee Robby Stein will run against his colleague, Sandra Schroeder, for the coveted seat. Stein is no stranger to village government, serving as a member of the village board for nearly six years. Schroeder and Stein share similar ideas in regards to what changes need to be made to better the community, though their methodologies differ. “I want to look to the long term goals of the village,” Stein said, noting slowing down on developing, especially in the village’s historic districts, is criticial. “We need a code adjusted to the scale [of projects],” he said in an interview yesterday. “And it needs reasonable control.” Stein noted the nature of the maritime community should be preserved as such, warning not to do a “patchworked” job in certain
areas. “We really need to jump in here,” he said. “I’m really ingrained in this village. And I understand how these things work.” Currently, Stein handles matters pertaining to parks, docks, and the village’s harbor. He would like to develop the strip of waterfront land near the 7-Eleven on Water Street into a park at a low cost to the village. Slowing down development in the historic district of the village, improving the village’s website and presence on social media, flooding, and water quality and protection are other areas of the interest during his campaign. “ We need to communicate better,” he said. Win or lose, the local, who’s a doctor with a background in psychology when not serving as a village trustee, will remain on the board. “I know how to turn the ship,” he said. “And I think I have a whole, complete view.”

Summer 2015. For most here on the East End, summer is time to make the doughnuts. Right in the heart of the Hamptons, in Sag Harbor, there are plenty of new businesses gearing up for debut seasons. Main Street Sag is slated to host at least three new businesses in the upcoming weeks. Two of them are next-door neighbors. In what used to be The Cuddy, a sister restaurant of Sen, Wolffer is setting up shop. The sustainable vineyard from Sagaponack announced its newest venture last month and will be the first winery-owned restaurant in the Hamptons. He said Monday he’d received about a thousand emails and over a hundred phone calls. “I’ve also gotten calls of support,” he said. “This whole problem comes from simply trying to create order in a chaotic situation,” the supervisor asserted. As the Montauk party scene burgeoned, “The town was overrun by taxis,” Cantwell offered. They took up parking spaces at local businesses, in the municipal lots, with drivers from the city often sleeping in their cars. Local businesses complained and, said Cantwell, “It was a mess.” Prior to the adoption of the local office provision there were an estimated 700 cab companies licensed in East Hampton, with many of them coming out just for the summer weekends, Cantwell said. There are now 230 licensed companies. According to Anfang, “There is an unquestionable need and demand for Uber in the Hamptons because taxi services has been historically unreliable.” Supporters this week predicted an increase in drunk drivers on the streets and young people imperiled by the dearth of reliable rides home at night after closing time. That hasn’t happened so far (though it is still just June). “The weekend was typical volume and we didn’t see any issue with availability of licensed cabs,” East Hampton Town Police Chief Michael Sarlo reported on Monday. “There seems to be plenty of licensed taxis to go around,” the chief wrote via email. “Uber was just one option; party buses, livery hired cars, regular taxis. . . there have always been options available for those who have enough sense not to drink and drive. Uber was not here a few years ago, and there were far fewer taxis prior to that.” The number of DWI arrests was typical for this time of year, he reported. Cantwell also seems to think the loss of Uber won’t have a substantial impact on people who need rides. “Even in Uber’s absence from the market, there are more than 220 licensed taxis and vehicles for hire and other public transportation options available in the Town of East Hampton ready to provide services to those in need of a ride,” he said in a release after Uber decided to pull out of town on Friday. Uber’s adios followed a meeting with town officials Friday morning. The confab was prompted by

complaints about Uber partnering with unlicensed taxis and vehicles for hire. Over Memorial weekend more than 20 drivers – all claiming to be partnered with Uber – were charged with violations of the town code. During a cab code hearing two years ago, a driver expressed concern about the advent of new and different transportation services finding loopholes to avoid licensing. With Uber, it appears that prediction has pulled over and double-parked in East Hampton, but Cantwell isn’t going to budge. There’s nothing to stop Uber drivers from getting together and

It will be a few more weeks before a judge decides whether to grant opponents to East Hampton’s new airport regulations an injunction stalling the regs until the lawsuit they filed reaches its denouement. In federal court last Wednesday Judge Joanna Seybert issued an order extending the deadline to rule on the motion seeking to block enforcement of three local laws adopted by the town earlier this spring. Judge Seybert heard arguments pertaining to the injunction on May 18 and said at the time she’d have a determination within three weeks’ time. Last week, citing the complexity of the issues involved, the judge extended the deadline to June 26. “The Town Board remains confident that it will prevail in the litigation, however, out of respect for the judicial process, the Town has agreed to continue to not enforce the local laws pending the Court’s decision,” states a press release from town officials. The local laws create curfews and adopt a “one trip per week” regulation for noisy aircraft. K.M.

RICK’S SPACE The East Hampton Town Supervisor banned Uber, the car-service business that operates in 37 cities, from East Hampton after a “sting” operation that allegedly uncovered 20 Uber drivers that didn’t have an official town license, which can only be obtained from carefully marked packages of Frosted Flakes. Indy’s own Rick Murphy, in an exclusive interview, discussed Uber, New York City and other timely topics with the Uber-hip town leader.

EDITORIAL A Shortsighted Decision The old joke about East Hampton locals never getting beyond the Shinnecock Canal is, as we all know, truer than a lot of us care to admit. Those of us who do get to the big city -- Manhattan, not Riverhead -- know what Uber is all about, and for New Yorkers tired of hailing cabbies who ignore them, cabbies who don’t speak English, and cabbies who have no idea where they are going, Uber has been a godsend. The cars are clean, and the drivers reliable. You simply hit an app on your mobile device and it alerts the nearest Uber cab. Would-be passengers know how far away it is. Your credit card is already on file. Anyone who has experienced the madness of trying to find a cab in the Hamptons during the summer knows how frustrating it can be. That’s why the news in 2012 that Uber was setting up shop in The Hamptons was welcomed. Friday Uber halted its operations in East Hampton Town. East Hampton Town Supervisor Larry Cantwell put his spin on it in a press release, claiming Uber did so voluntarily after realizing many of its drivers were unlicensed. But Uber tells a different story. They say the town set them up with an undercover sting and has made it so difficult to operate that it is no longer feasible. Uber is the new benchmark for efficient taxi service. It works remarkably well in New York City and 36 other major cities, so it’s ludicrous to think it can’t work here. The elephant in the room is drunk driving. There are thousands of revelers on the streets at night who voluntarily leave their vehicles home. If they find themselves stranded in Montauk at 5 AM they may decide not to the next time. That’s a risk we can’t afford to take. The town wants every Uber driver to have an office in East Hampton. Cantwell said there are 220 licensed taxi drivers in town. Where are their offices? There are only a handful in the phone book. The town is fond of pretending it has stringent guidelines that are strictly enforced. The truth is this administration is big on talk but actually does very little. For every well-intentioned violator that is targeted by code enforcement there are 100 who operate with impunity. Who decides whom to target? Is it all about who you know in town hall? Uber, like airbnb, Priceline, Kindle, and so many others, is among the next wave of Internet/smart phone-based businesses that are changing the way we live. Uber will register and check the credentials of its drivers and will keep them in check. There are currently 120,000 Uber drivers that generate $40 billion in annual revenue. That means the company knows a lot more about the taxi business than East Hampton Town officials do. Supervisor Cantwell needs to do a better job managing code enforcers -- aren’t they supposed to be doing something about the illegal housing in Springs? Uber is not a scourge on the community. There are plenty of fares to go around during the summer. Let’s work something out.

Maybe the people who support the airport need to start a contest; solve the mystery of why people oppose the airport and win a box of cigars! Let us consider for a moment that someday these people with their hidden objectives win this battle – what would be the consequences? Well first, how many of those multimillion dollar homes would no longer be the destination of their owners every summer season if they had to drive in those huge traffic jams to get to them on the few roads that go east and west bound on the South Fork? A multitude of airports that have been closed down on Long Island in the past all became the sites of massive subdivisions of small homes, or large shopping centers. Wow, now that wouldn’t happen in East Hampton Airport, would it? It would make a great New Roosevelt Field Mall? Think it cannot happen? I bet the people of formerly beautiful Garden City, thought that as well when Lindbergh took off from Roosevelt flying field in 1927. Lets face it - maybe you don’t care for the airport. You will not care for the damage it will do if it ever closes down! The Hamptons will no longer be the Hamptons it is now because the rich people, will go elsewhere to live -somewhere they can fly into and not have to sit in traffic, to get to their seasonal escape. Get it? If you think it is only about noise, wake up and smell the roses! Someone is going to make a lot of $$$$$. And it is all about your peace and quiet it will cost you, one way or the other, in the long run! The folks who are behind it, are motivated by money . . . if you fall for it, they get rich! Plant-Based Meats Dear Editor, Last Tuesday, President Obama directed federal agencies to serve antibiotic-free meat and poultry in government cafeterias. The FDA will require animal producers to obtain authorization from a licensed veterinarian to use drugs to treat a specific disease, rather than just to promote rapid growth, as is current practice. As much as 80 percent of all U.S. antibiotics are used in animal agriculture. The moves come amid growing concern

Did you watch American Pharoah win the first Triple Crown in 37 years? Daniel Nigro What a great race. Afterwards they mentioned the slow start he got off to but to tell you the truth I didn’t even notice. It wasn’t enough for everyone to get shook up over. He was out in front in seconds and stayed there wire to wire. It was a great race. Sean Bishop I was there at Belmont. The roar of the crowd, the emotion was incredible. By the second turn American Pharoah was so far ahead and running so effortlessly. I knew he would win. At the end, he looked like he could have run another half a mile easily. Clyde Bishop I watched at home on television with my wife. If I had to bet I would have said he could win. He was a touch slow coming out, but pretty early on it was easy to see that no one could catch him. It was quite exciting to see a Triple Crown winner after 37 years. Tom Johnson It went as I expected. And once he got out in the lead I knew he was going to win. That’s his style. He gets out in front and takes the lead early and then he keeps it all the way. It was pretty clear from about a quarter of the way into the race that he would win.

The Wrong Hands Letter to the Editor, The Iraqi Army has a history of moving to the rear and exposing their backsides
to attacking forces. The Iraqi Army melted like butter when we attacked them in 2003. They faded away when ISIL attacked them, and then lost Mosul and most of northwestern Iraq along with large quantities of U.S. equipment. Recently they turned tail and abandoned U.S. military equipment when they ran from Ramadi. The Iraqi Army cannot be relied upon to fight ISIL or any other insurgent groups, and we should not supply them with weapons we could possibly face in the future. Our attack aircraft are currently destroying former U.S. military vehicles captured by ISIL from the Iraqi Army, and this will continue into the future. The latest news is the administration is sending 2000 anti-tank rockets to combat ISIL vehicles. We should not supply these rockets to the Iraqi Army, because they will probably fall into the hands of ISIL and other terrorist organizations, and if we ever have to go back into Iraq, our military could encounter these weapons. We should reduce sending military equipment to the Iraqi Army and increase arms shipments to the Kurds and Druze. DONALD A. MOSKOWITZ

Busy Corner Won’t See CVS Everyone can breathe again. CVS Caremark will not be building a new location at the corner of Montauk Highway, Lumber Lane and Bridgehampton/Sag Harbor Turnpike, according to a representative from the colossal pharmacy. Southampton Supervisor Anna Throne-Holst announced at a June 2 town board meeting that CVS is now negotiating with representatives from Bridgehampton-based Konner Development for a building at the proposed Bridgehampton Gateway on the other side of the hamlet. The possibility of a CVS opening on the corner of Bridgehampton’s (and maybe the East End’s) busiest intersection was met with intense opposition from locals for the past several months. Parking and increased traffic were the main points of contention for building on the small parcel of land. CVS had an application before the Southampton Town Planning Board for a special exception permit, required for the pharmacy to occupy the entirety of the 9000-plus square-foot, two-story building. When the planning board voted unanimously to require an environmental impact statement for the proposal last October, CVS Caremark and BNB Ventures (the owner of the property) filed suit against the town. Town Planning and Development Administrator Kyle Collins said the lawsuit is still active, noting the opposing party has until next Tuesday to respond to the town’s latest motion. Members of the Bridgehampton CAC said they are now looking into the possibility of the town purchasing the parking rights to the lot, and purchasing the land itself to maintain it as green space.

Obituaries
Richard Andrew Ferrara Sr., 66
Richard Ferrara, a Sag Harbor native and a well known and liked local barber, primarily in East Hampton, died Saturday at Southampton Hospital. He was 66. Ferrara, a Vietnam veteran, spoke in his later years about being accidentally sprayed with chemicals – likely Agent Orange that most likely led to the cancer that ultimately took his life. Born on June 3, 1949 to Gertrude (MacGarva) and Leonard Ferrara, Richard was one of the first youngsters in Sag Harbor to pursue the dream of becoming a rock star. Along with Randy Staudinger and others, he formed The Hustlers, probably Sag Harbor’s first unabashed rock band. The group developed a loyal local following and often played impromptu Friday night dance parties. Richard joined the navy and learned the art of barbering. He was stationed in Vietnam in 1969 on shore leave when he was exposed to Agent Orange. Richard became a barber to the stars in East Hampton, though his many upper crust clients, per their asking, were kept confidential. He was also outspoken, and dabbled in local politics, once running for East Hampton Town Supervisor. He was eternally cheerful, often passing funny jokes and videos to friends via email, saving the funniest joke for customers in his barber chair. Richard’s haircuts came with not only the latest jokes, but a summary of local and world news, and of course, a little juicy gossip about mutual friends. Richard was a self taught handyman and a good one. A special interest was renovating old build-

ceased him. There will be visitation at Yardley and Pino in Sag Harbor tomorrow from 2 to 4 PM and again from 4 to 7 PM. He will be buried at St. Andrews cemetery in Sag Harbor after a mass at St. Andrews at 10 AM Friday. The family has asked donations be made to the VA Hospital in Northport, the Chelberg-Battle American Legion Post in Sag Harbor or the American Legion Post 419 in Amagansett.
ings, like his mom’s former house on Union Street in Sag Harbor. He lived in a commercial building and circa 1900 house he owned along with his companion, Linda Calder, in Edenton, NC. Last summer he renovated his Springs house, landscaping the property replete with berms and evergreen clusters. Richard was notorious for his large vegetables. His tomatoes were famous -- and the best around. He took great care of tending to them and not allowing anyone to walk in the garden-thus stressing out the roots of the plants. Rich and Linda would harvest the tomatoes and put up at least one 30-gallon pot of fresh tomato sauce, quarts of pesto and lots of eggplant Parmesan frozen away for the winter months. Rich and Linda traveled to Italy in 2000 where they became engaged in Positano. In 2005 they also traveled to Malta – they were in Rome when the Pope passed away, which they deemed as a special spiritual experience. Other travels included a trip up the coast of California in 1995 in a Mustang convertible, something Richard wanted do to since he returned home from Vietnam. A year ago the couple traveled to New Orleans, where Richard, a saxophone player, loved to listen to the street music. Word has reached us that Mike Behan, a former resident of Montauk and East Hampton, died late last month. Michael J. “Mike” Behan graduated from Little Flower Catholic School in Montauk and East Hampton High School. He moved to Colorado five years ago. Mike’s adult years in East Hampton were devoted to raising his son Matthew who also graduated from Easthampton High. Mike is the son of Capt. Lester and Marie Behan, both deceased. He is survived by his beloved son, Sgt. Matthew J. Behan USMC, his brothers John (Montauk) and Jim (Manhattan), his sisters Joan Fitzgerald and Janice Maranov of Southampton and Marles Behan of Southold. A funeral Mass was held at The Basilica Parish of the Sacred Hearts of Jesus and Mary on May 27 followed by burial at Mount St. Mary Cemetery in Queens.

Florence V. Schellinger, 89, of East Hampton and Canaan, Connecticut died on Tuesday, April 28, at Fairview Commons Nursing Home in Great Barrington, Mass. Flo, as she was known to family and friends, was born on November 6, 1925 in East Hampton to Howard and Pheobe (Lester) Ott. She grew up and worked most of her life there. She was married in 1945 to Morley L. Schellinger. He died in 1998. Flo worked for 30 years as manager of the East Hampton Mobile Village. She was a lifetime

Missing Man As of press time Southold Police were still looking for a 59 yearold man described as “Mentally disabled” and “Vulnerable.” Eric Burton, a bald, black man, was last seen on May 8 boarding a bus to Greenport. Assault On Railroad Avenue A Riverhead woman was charged with Second Degree Assault after she allegedly took a knife to another woman – the pair was fighting over a man, police said. Vanessa E. Jones, 27, surrendered to police Saturday after her alleged victim said she was attacked on Railroad Avenue early that morning. Jones was held for arraignment and the victim went to the hospital on her own accord, Riverhead Town Police said.

A lot of cars will be heading out to the East End this weekend, but a convoy of North Fork baseball fans will be headed in the opposite direction. That’s because both Southold and Mattituck are sending their high school baseball teams upstate to The Show – The New York State Final Four tournament. The Tuckers earned a State Regional Class B Championship Saturday by overcoming Albertus Magnus in overtime. Hours earlier, playing on the same field at Mamaroneck High, The Settlers came from behind to win the Class C Regional title. Both teams play Saturday in Binghamton. Southold, playing against Tuckahoe, eventually wore the Tigers down, but it wasn’t easy. Tuckahoe came out of the gate

firing, scoring three first inning runs off Alex Poliwoda. But the Settlers regrouped and began chipping away at the lead, and Poliwoda, pitching on a bad ankle, buckled down. He did it at the plate, too. His second inning solo home run put Southold on the board. After Tuckahoe took a 4-1 lead, the Settlers managed to score two runs in the fifth without a hard hit baseball – one coming in on a walk and the other on an error. In fact Tuckahoe’s miscues – seven errors in all – sealed their doom. Dylan Clausen clubbed a runscoring triple, Greg Gehring singled in a run and Luke Hansen scored on a fielding error. In the sixth the locals put the wood – make that aluminum – on the board. Dylan Clausen tripled in a run, Gehring’s single drove in another, and a third came in on
an error. Poliwoda was in command and Tuckahoe would score only one more run. The final was 8-5, and Southold ran its record to 21-2. Tuckahoe finished with a 19-5 mark. The locals play Hoosic Valley of Section II in a state semifinal Saturday morning. A win will propel Southold into the State Final that afternoon. Mattituck also suffered through some tense moments in the Class B Regional Final. The Tuckers were one out away from victory when Albertus Magnus scored and forced overtime.
Mike Onufrak reached on an infield single. Jon Dwyer then clubbed his third double of the game, giving Mattituck a one run lead. Joe Tardif was hit by a pitch, Marcos Perivolaris walked, loading the bases, and Chris Dwyer drilled a three-run triple. Ian Nash plated another run before the third out was recorded. Mattituck will meet Ogdensburg Free Academy of Section X in a semifinal at SUNY/Broome Community College in Binghamton on Saturday morning and hopefully play for the title in the afternoon.

Coast Guard Auxiliary News By Vincent Pica

United States Coast Guard Auxiliary Unlike any other law enforcement arm, the U.S. Coast Guard (USCG) may board your boat at its discretion — officers need no search warrant, no provocation, and no reason other than ensuring your boat is in full compliance with all applicable federal laws and regulations. Do you know what do you do and say (besides “Yikes!”) if you see a USCG vessel in the vicinity and hear their voice on VHF channel 16 (or across the water) hailing your vessel and ordering you to bring your boat to a full stop? You have been stopped by highly trained federal officers who will soon impress you with their professionalism. Before they even step off their vessel onto yours, the very first question they will ask you is, “Without reaching for them or touching them, do you have any weapons on board?” Subtly but powerfully, the tone is set: “I am polite. I am professional. And I mean business.” Let’s assume (and hope) that the answer to that question is
“no,” since an affirmative answer sets up a scenario outside the scope of this article.
We’re First Of note to boaters in the First Coast Guard District, which is us, the Coast Guard has a new program called the Responsible Boater program, which can make your time on the water much more pleasant – and safer. Once your boat is boarded, the officers will be seeking compliance with regulations, starting with those applicable to all boat sizes. Your actual registration needs to be aboard and current. If you just have a copy, that’s a problem, but if you have no registration, you have a much bigger problem. The Hull Identification Number needs to be the same on your registration and on your boat (embossed into the transom, low on the starboard side). If they don’t match, you’ve got a lot of explaining to do.

The registration numbers must be at least three inches tall, appear as a contrasting color to your hull, and be the most forward of any numbering or lettering on the boat. If you have a Marine Sanitation Device (aka head or toilet), it must conform to regulations. As Long Island is a “No Discharge Zone,” an over-board, through-hull holding tank must be in the locked/closed position and the key must under the control of the captain (no exceptions unless it can be seized closed or the handle can be removed in the closed position). Other applicable laws and regulations are dictated by the size of your vessel. Is there at least one readily available life jacket in good working order for every person aboard? To be readily available, the jackets must be out of the wrapper and not buried under other gear or in a cupboard (think of your children or grandchildren having to put them on in hurry). The number of fire extinguishers depends on boat size, but all must be in working order. The amount of required flares varies by boat size, but all must be unexpired.

it is – and it should be. And the list gets longer as the boat size increases. However, if you already have a valid Vessel Safety Check sticker on your windshield, you are eligible for an “Abbreviated Boarding.” During an abbreviated boarding the Coast Guard will check for appropriate life-jackets for all aboard, that you have a sound-producing device, flares, registration, and fire extinguisher (if required for the vessel of your size) aboard. That’s it. After the vessel is checked for compliance, there are three outcomes. The first (and best) results in receipt of a Report of Boarding marked “No Violations.” You are likely good to go for the season because, if the USCG comes alongside again and you show them your clean boarding report, they will probably pass on. Your Report of Boarding could be marked “Written Warning” due to some violation that has not risen to an actionable level. However, if the officer returns to the station and finds that you were already given a warning for the same issue, the notice becomes a violation. A “Notice of Violation” may be issued on the boat, resulting in CONTINUED ON PAGE 41.

If the boarding officer believes that the nature of the violation is inherently unsafe (some aspect of your boat may lead to serious injury or death to you, your crew and passengers, or other boaters), you will be directed to follow the Coast Guard vessel back to the dock. If the violation is benign enough to allow your voyage to continue, it takes on the aspect of a driving violation. Outside the new Responsible Boater program, the notice is mailed to the USCG hearing office where the boarding report will be reviewed by a case officer who issues fines, further letters of violations, or takes other actions. You will be notified by mail and be given an opportunity to appeal. H o w e v e r, u n d e r t h e n e w Responsible Boater program, the boarding officer will tell you to contact us, get the violation fixed and recorded as such on the Vessel Safety Check form (that the Vessel Examiner will give you), mail them both in (Report of Boarding and VSC form) and, very likely, the Hearing Officer will note that and no fine will be levied. Fines can run high, so this is free insurance! Of course, if a search of the vessel and the persons aboard turns up anything deemed illegal, the USCG will take appropriate and immediate action. So, how do you get a (free!) Vessel Safety Check? Captains can avail themselves of free Vessel Safety Checks provided by the U.S. Coast Guard Auxiliary and the U.S. Power Squadrons (http://www.safetyseal. net/GetVSC/). Remember – a check is not an enforcement event — if your boat fails, you get a report that details

Schellinger and wife Barbara and Sally and Peter Riva of Canaan, Ct and Ricky Schellinger of Hampton Bays, along with 11 grandchildren and 12 great grandchildren. Interment took place at Calverton National Cemetery with her husband, Morley.
